Building codes should be used to protect residents, not threaten homeless people


Unsafe living conditions, especially in facilities that house multiple people, are reason for immediate concern, but Johnson City’s recent building codes enforcement actions against the Haven of Mercy Rescue Mission could be seen as disingenuous as the city struggles with addressing homelessness.
Last month, Public Works Director Phil Pindzola advocated suspending available services for homeless people, like meal distribution programs and shelters, in hopes that those benefiting from them would move to another town.
Then last week, after a contractor reported burn marks in an electrical panel and city staff found other deficiencies that they said could lead to a fire, the city asked BrightRidge to shut off the Haven of Mercy’s power. Utility workers were unable to carry out the order, and the city suspended its attempt to declare a portion of the Haven’s facility uninhabitable on Thursday, because no one is currently living in the portion in question. ....

Johnson City finds no one living in Haven of Mercy annex, scraps scheduled hearing


After city staff found no one living in the Haven of Mercy’s annex, a Johnson City board scrapped a scheduled hearing on Thursday that would have decided if there was enough evidence to declare the building unfit for human occupation.
Code Enforcement Supervisor Will Righter and another staff member visited the homeless shelter on Thursday to do an inspection and did not find any residents living in the annex.
During a meeting of the Johnson City Board of Dwelling Standards and Review on Thursday, staff recommended that board members pull a scheduled show-cause hearing from their agenda.
A show-cause hearing serves as an opportunity for the board to hear city staff present evidence about why a structure is not suitable for human habitation. If board members find there is enough proof that a building does not meet minimum housing standards, they can schedule a public hearing for a later date. ....

Johnson City: Hazardous panel prompted effort to shut off Haven power


So long as the homeless shelter’s owner takes steps necessary to prevent an electrical fire from breaking out, Johnson City will not reissue an order to disconnect power at the Haven of Mercy.
Johnson City Development Services Director Preston Mitchell said the city’s chief building official, Jeff Canon, ordered electricity shut off last Friday after a licensed electrician, who the shelter hired to replace an electrical panel in the building’s annex, noticed that the panel’s main breaker was burnt. The city learned about the issues on Thursday afternoon.
The burns on the main breaker, Mitchell said, created a serious electrical hazard at the shelter. Additionally, plans had not been submitted to the city and permits had not been issued for the work. ....

Johnson City slow to offer insight into Haven of Mercy shut off attempt


Johnson City provided little new information Monday about why it attempted to shut off power at the Haven of Mercy homeless shelter last Friday.
The city did provide a copy of an order issued by Chief Building Official Jeff Canon, which repeats a section of city code that states the chief building official has the authority to disconnect power and other utilities if they pose a danger to inhabitants.
The order asks that service be disconnected from the property, located at 123 W. Millard St., until it’s cleared by a city inspector.
Reached Monday afternoon, Canon directed a Johnson City Press reporter to the city’s media relations department. ....

BrightRidge: Johnson City attempts to shut off Haven of Mercy power


Johnson City attempted to shut off power at the Haven of Mercy homeless shelter Friday evening, but BrightRidge employees were denied access, a BrightRidge spokesman said.
Tim Whaley, BrightRidge’s director of public and governmental affairs, said the power company received a request from the city’s building department to shut off electricity to the Haven of Mercy due to code violations.
Whaley said BrightRidge officials attempted to gain access to the building to shut off power, but they were denied access. As of Friday evening, power remained on at the Haven of Mercy, according to Whaley.
A Press reporter on the scene reported seeing a BrightRidge truck, along with several Johnson City police officers, but the officers and the truck left shortly after. ....
