Judge Tim Fox this morning denied the Arkansas Democrat-Gazette’s petition to be allowed to attend, in person or virtually, his hearing this morning on the matter of a Pope County casino permit, being contested by Gulfside Casino Partnership and the Cherokee Nation.
In short, he blames the closure of the courthouse on the county judge (though people may enter with court approval) and says the question of whether a hearing may be held by Zoom is up to the discretion of the judge.

If the D-G doesn’t like it, they can ask for help from the Arkansas Supreme Court or go to a federal court. Time is short, with a hearing set at 9 a.m.

LITTLE ROCK, Ark. – Attorneys representing Cherokee Nation Businesses have filed another lawsuit in an attempt to overturn the Arkansas Racing Commission’s decision to award the Pope County gaming license to Mississippi-based Gulfside Casino Partnership.
The Feb. 16 filing alleges “errors, arbitrary actions and legal non-compliance” that failed to choose CNB’s application to build Legends Resort & Casino LLC.
In the filing, CNB’s attorneys ask Pulaski County Circuit Court Judge Wendell Griffen to reverse the ARC’s decision to grant the license to Gulfside. They say the CNB application is “objectively superior” because it does not seek outside financing, has a shorter timeline to completion, has the endorsements of Pope County officials in office and CNB has more experience with gaming venues.

Cherokee Nation entity seeking a permit to open a
casino in Pope County filed its promise lawsuit yesterday challenging the Racing Commission’s award of the permit to Gulfside Casino Partnership of Mississippi.
The lawsuit by Legends Resort Casino LLC alleges a variety of problems in the process, including the failure of Gulfside to have approval from a current local elected official.

“We were required to file this appeal due to pending deadlines, but we anticipate seeking a stay of this matter in the next few days to allow the parties time to litigate whether Gulfside can be a license applicant. The Supreme Court’s mandate will issue on Monday in that case, and Judge Fox will once again have jurisdiction over Gulfside’s appeal. When Gulfside’s appeal is ultimately decided by the Supreme Court, the petition we filed today will either be ready to litigate or completely moot.” – Dustin McDaniel, legal counsel for Cherokee Nation Businesses

Yet another wrinkle in the multi-faceted fight over a casino permit in Pope County, authorized by a 2018 constitutional amendment, but tied up in court.
The major players are casino applicants Gulfside Casino Partnership of Mississippi and Cherokee Nation Businesses of Oklahoma. Gulfside has a permit from the Racing Commission. The Cherokee Nation recently was cleared to make a court challenge of whether it was qualified.

Then you have the local people opposed to ANY casino. They now control the Quorum Court, but not the county judge, who’s given his approval to the Cherokee bid in a $40 million economic development deal that the new Quorum Court has repudiated. Efforts are underway to again pass an ordinance requiring a local election on a casino, despite an adverse court ruling on a previous casino.

In a unanimous decision issued today, the Arkansas Supreme Court ruled that the Cherokee Nation Businesses (CNB) had the right to intervene involving a lawsuit brought by the Gulfside Casino Partnership against the Arkansas Racing Commission (ARC) last year.
