The Ward County State’s Attorney’s Office is appealing the dismissal of a Class A felony gross sexual imposition charge against Donald James Dean Mitchell, 21, by North Central District court Judge Doug Mattson.
According to court documents, Mattson dismissed the case without prejudice in October 2020 after finding that there wasn’t probable cause for the case to move forward. The judge found that the officer who testified did not have first-hand knowledge of the event and had failed to identify the ages of Mitchell or the girl. The testifying officer had to review a police affidavit to determine Mitchell’s age and had testified that the girl might have been 15 or 16 when she was actually 14 at the time of the alleged crime on Dec. 1, 2018. Mitchell was 19 at the time. ....

State dismisses armed robbery charge against deceased man | News, Sports, Jobs

The Ward County State’s Attorney’s Office filed to dismiss a Class B felony armed robbery charge against Larry Dominique McLean, 29, of New Town, after it learned that he died on Jan. 28.
McLean and his co-defendant, Tyquan Markeez Graham, 22, were both accused of robbing a man in the Sports on Tap parking lot in the early morning hours of July 26, 2020. McLean allegedly placed the victim in a chokehold from behind while Graham stole a firearm from the man’s vehicle. The two men then drove off in their vehicle. About an hour later, Graham was involved in a shooting incident in downtown Minot. Graham was shot and wounded in his right arm and hand. His alleged assailant, William Neal Lucy II, allegedly pistol-whipped Graham and shot him before Lucy himself was wounded. Lucy was charged in connection with the shooting and also with intent to deliver ecstasy and cocaine and is in custody at the Ward County Jail. ....

Terry Albers, Douglas, pleads guilty to sexual abuse of a child | News, Sports, Jobs

Terry Lee Albers, 62, Douglas, pleaded guilty on Wednesday to one Class A felony count of sexual abuse of a girl under the age of 10.
He had originally been charged with two counts of Class AA felony gross sexual imposition but the state agreed to dismiss one of the charges and amend the other charge to the lesser A felony.
The offense took place sometime between 2008 and 2012 and involved a victim who might have been as young as 6 at the time.
Albers is already a convicted sex offender for another offense.
Judge Richard Hagar ordered a pre-sentence investigation for Albers and set a March 31 sentencing date. ....

Man drives into Lewis and Clark Elementary | News, Sports, Jobs

Lewis and Clark Elementary was extensively damaged early Wednesday morning when a vehicle driven by Payton White Owl, 23, drove into the north wing of the school, according to Minot police.
The accident happened at about 12:30 a.m. No one was on the site at the time and no injuries were reported. The accident is under investigation and charges are being submitted to the Ward County State’s Attorney’s Office for review.The accident was not reported to law enforcement immediately and the vehicle was removed prior to police being notified, according to Minot police.
Supt. Mark Vollmer said Wednesday that the vehicle broke out a bank of windows in a third-grade classroom and caused extensive damage to a wall and struck a heating unit. He didn’t have a dollar estimate for the amount of damage done as of Wednesday afternoon. ....
