More than a canal divides residents

Rehoboth Beach  Delaware  19958United States A proposed dock for kayaks, canoes and other non-motorized watercraft at the Grande at Canal Pointe just outside Rehoboth Beach has residents who live along the Lewes-Rehoboth Canal taking sides. CP Townhomes LLC (Canal Pointe RPC) has filed to amend condition 15 included in the approval of change of zone 1538 dating back to 2004. The applicant is requesting the condition be removed that states: “No piers, docks, boat ramps or other water-related recreational facilities shall be permitted.” During the hearing, concerns about eagles, precedents and the environment surfaced. Canal Pointe, located along Hebron Road in West Rehoboth, includes 288 single-family homes, and 307 condominiums and townhomes on a 181-acre parcel bordering the canal.

Two lawsuits filed against Rehoboth Beach BOA

Tuesday, July 17, 2018 Two prominent Rehoboth Beach property owners are pursuing lawsuits against the city’s board of adjustment, claiming the board erred when it ruled to uphold the city building inspector’s interpretation of gross floor area. Attorney Vince Robertson, on behalf of Gene Lankford and Lankford Properties, filed his lawsuit in December, while attorney David Hutt, on behalf of Jack Lingo Asset Management, filed his lawsuit in May. Both submitted opening briefs March 29 in Delaware Superior Court. In an email April 8, Robertson said the two cases have been consolidated because the issues are basically the same – they both deal with the definition of gross floor area, which in turn affects code-mandated zoning requirements. Hutt, in an email April 12, added that both lawsuits deal with the basic question of what is the exterior face of an exterior wall.

Five-lot subdivision proposed in Lewes

Tuesday, October 31, 2017 Longtime Lewes resident Jerome Virden is seeking to divide his Kings Highway property into five lots to be passed on to his family.  The application was reviewed by Lewes Planning Commission Jan. 20, and a public hearing on the matter was set for 5 p.m., Wednesday, March 17.  The 1.45-acre parcel is nestled between Kings Highway and Freeman Highway. A 2015 land swap with the City of Lewes prior to the construction of the Lewes Public Library resulted in his property having two separate zonings – R-2, low-density residential along Kings Highway, and R-4, medium-density residential on the back end of the parcel.
