EXCLUSIVE: Rule of Law has suffered due to delays in Justice system; Retiring AG De Livera

COLOMBO (News 1st); COVID-19 had brought a grinding halt to the administration of justice in Sri Lanka at a time when delays in the system are already a perennial problem, said retiring Sri Lankan Attorney General Dappula De Livera.
Speaking exclusively to News 1st’s Zulfick Farzan in a one-on-one interview, De Livera PC said the delays caused by COVID-19 are a curse to the justice system and stressed it will have serious repercussions and consequences in the administration of justice in the country.
The Attorney General who is to retire on Monday (24) said Sri Lanka Police, the Attorney General’s Department, and the Judiciary are mandated to bring about Justice and all three bodies must work together and move together to ensure justice is served to the people of the country. ....

Commissions of Inquiry: Grave Threat to Democracy and Judicial Independence


Several initiatives have already been taken to implement the recommendations of the final report of the Presidential Commission of Inquiry into political victimization (the CoI) including the obtaining of Cabinet approval, the establishment of a Special Commission of Inquiry and a resolution tabled in Parliament. While Commissions of Inquiry have played a recurring role in distracting attention away from established mechanisms for justice and accountability in the past, the haste with which the recommendations of the present Commission are intended to be implemented is a cause for concern and may have grave implications for the independence of the judiciary, the rule of law and democracy in Sri Lanka. ....

Former Criminal Investigation Department (CID) Director Shani Abeysekara (59), who is incarcerated in Mahara Remand Prison, yesterday filed a Fundamental Rights violation petition, seeking his safety and compensation of Rs. 3 million.
Attorney-at-Law Gowry Shangary Thavarasha filed the petition on his behalf in the Supreme Court.
She cited IGP C. D. Wickramarathne, ASP Neville Silva, and IP S. P. D. J. Nishantha, as well as Senior DIG Deshanbandu Tennakoone and the Attorney General as Respondents.
Petitioner states that she makes this application on behalf of Abeysekara, as he is presently in detention, and has also contracted COVID-19 whilst in detention, and hence unable to grant a proxy to an Attorney-at-Law or instruct Attorneys-at-Law. ....
