Courts Rule: Black Man Constitutional Rights Were Violated When Arrested for Not Showing ID

On Thursday, February 4, 2021, a federal appeals court passed that Virginia sheriff’s deputies denied a Black man his rights spelt out in the constitution. The man was arrested in April 2017 for failure to show his identification card. 
The 4th U.S Circuit Court of Appeals partly nullified a ruling that was passed by a lower court, concerning the arrest of a Black man, George Wingate. The Stafford County deputies held that his arrest was valid. The deputies referred to a local ruling that justifies the showing of the identification to local authorities for purposes of public safety. ....

The U.S. Court of Appeals for the Fourth Circuit sided with a Black man and against two Virginia cops Thursday in what the plaintiff argued had been a “driving while Black” arrest.
George Wingate III had been driving on Jefferson Davis Highway in April 2017 when he experienced car trouble. Wingate is a mechanic who kept tools in the trunk of his car; he pulled to the side of the road, popped the hood, and began to work on his car, using the overhead streetlamp for lighting. Two Stafford County deputies saw Wingate’s disabled vehicle, and pulled in behind Wingate, ostensibly to render assistance. ....
