The shooter was an undocumented immigrant who had been deported five times before. Del, this incident was frightening to people in the city. It was so random. It happened in broad daylight and at a waterfront that is relatively safe. As we learn more about the accused it is the city itself that is now on the defensive. Its a crime that has raised uncomfortable questions in this liberal bastion. Juan lopez admitted to killing a 32yearold woman on the citys waterfront but said it was an sent accident. Did you shoot the woman down on peer 14 . Yes. Did you shoot her. Mmhmm. Lopez sanchez has a history of drugrelated crimes. There are dozens of people released every day who are subject to ins hold who dont commit a crime. And just to add a little bit more, the mayor said he would investigate the matter although its unlikely any policy would change despite the death. Hot topic on the political trail as well. Most of the new users are white. Experts believe they switched from synthetic painkillers to heroin, which is cheaper. Three in every 1,000 americans say theyve used heroin over the past year. Thats up less than 2 per 1,000 people a decade ago. And more people dying heroin overdoses. Researchers finding people who abuse painkillers were 40 times more likely to abuse heroin. And the number of women using heroin doubling over the past decade. Courtney maest as was one of them. Weve watched her battle Getting Better for a year and a half. No one sits and puts a needle in their arm saying this is what they want for themselves. Addiction cost her jobs, friends, and loved ones. Even did jail time. I was smoking at first. Good evening, del. The parents say that this young woman went to the lobby Police Station looking for help. They say she carried with her a backbackpack full of clothes ready to go to a mental facility, but she also had an eightinch knife. The controversy was caught on videotape. Captured on the after hours phone in the lobby. I need some help. She showed up at the station with the words i have a gun written on her palm. Within five minutes she was shot by officers as a 17yearold charged them with a knife. Almost all so many pictures of her were like that right there. Just peace. Thats hour baby. Eric and beth have now filed a federal lawsuit against the language view Police Department. Seeking 10 million in damages and claiming officers violated their daughters civil rights by using excessive force. The lawsuit also accuses police of breaching the american with disabilities act by not taking the young woman to a mental facility. The family says that she suffered for years from depression and bipolar disorder, and had gone to police for help. Would you say she was different than your typical american teenager . Pretty much. I would say so, yes. Yes. In a lot of ways. Long view police are not commenting on the lawsuit but we spoke to them in march about the video that shows at least three occasions when an officer twice the girls size appears to subdue her but does not put her in handcuffs. Well, you have to remember she had a knife. Why is seeing a knife mean you dont put someone in handcuffs. I cant speak for him. 12 seconds passed where shes face down. Hes kneeling done top of her. At that moment why does he not put handcuffs on her. I cant answer that. Then more officers enter and the young woman charges with a knife in her hand. They shoot striking her four times. Last month a grand jury declined to indict the officers, concluding they did not break state law. If you were to just zoom in on that one instance where shes coming at him with a knife and shes shot, that would make sense. That would be justified and the office has the right to use reasonable force to protect himself. But im surprised it escalated to that point. And the family lawsuit claims that it was entirely preventable, and the officers should have deescalateed the situation by restraining her when they had a chance. According to the lawsuit the Police Department knew that the officer who struggled with her was a poor performing officer who did not complete the statesman dated crisis intervention training. Its been four years now since the end of dont ask dont tell when gays and lesbians were banned from openly serving in the military. But one group is still serving in the shadows. We sit down with the first army officer to publicly come forward as transgender. Ive been in the military close to 15 years. Ive been transgender my whole life. Army general enlisting as a man, james henry but inside she knew she was a woman. Much of it inner turmoil that i could not express or share with my colleagues. She wanted to transition from a man to a woman but did not dare to reveal this secret to anyone. Your psychiatrist said as recently as october that you were unfit for duty. Yes. How devastating was that, to hear Something Like that. Just mentioning this to anyone i could lose my job. I want to serve the country. I want to deploy. Ive been in since i was 17. This is my chosen professional. I want to serve. Four years after dont ask dont tell ended the military still officially disqualifies anyone who reports psychosexual conditions including transsexualism and transvestiteism. But the American Medical Association said there was no valid reason to exclude transgender individuals from the service in the u. S. Military. The first active Duty Army Officer to come forward as public transendder but shes not alone. There are 15,500 transgender in the military. Making it the largest employer of transgender people in the u. S. Transgender people are more than twice as likely to serve in the armed forces. Former navy pilot director of spatter at a for Service Members for respect and tolerance for all. She transitioned after leaving the service in 2010. Its very much like dont ask dont tell. You have people who are hiding. You have people who do come out can be discharged administratively. Do a lot of transgender people feel like they serve their country, but the country is turning its back on them . It feels unfair. These are people who are continuing to serve and want to continue to serve and are fighting to continue to serve. Despite the fact that theyre having to hide themselves, despite the fact that theyre being labeled as something less than their Service Members jet they continue to believe in United States, in the military, in their job. Advocates say the pressure transgender troops are under to hide their gender identity can take a huge emotional toll. In june sergeant ships committed suicide two years after leaving. Military to transition to a woman. She said that she left the military because she could not live a double life. The stress of transition, the stress of losing your job. Just left the military to transition as well. She was just filled withshe made people happy. Someone who is just one of the most hilarious people youll ever meet, but inside just dealing with a lot of deep, dark feelings. According to the williams institute, 41 of transgender people have attempted suicide which is anyone times more than the general public. As the community continues to mourn, groups want to see change come faster. It makes me want to insure things change and push for that change as quickly as possible. To make sugar that people dont give up hope. Theyre near the finish line. And that finish line may be in sight. This year the u. S. Armed forces provides stricter scrutiny of these discharges. Together weve been able to do more to protect the rights of lesbian, gay transgender more than any time in our history. [applause] for the fires time president obama hosted six transgender members at the white house. We were invited and told to wear and given authorization to wear the uniform that conforms with our gender identity. It felt good. It felt very very good to be able to be who i am. Because the rest of my time in uniform i was not myself. And for army germany jamie henry, she was finally able to be her self, too. They may be accepting transgender Service Members. I could have my career back. I could be like any other doctor in the military. That is incredible to me. Although he has been retired from the navy for five years she dreams to one day return. When you look back at this, what do you remember . What do you think of . Honest answer . There is a large segment of the population that disagrees and perhaps does not understand your lifestyle. But with caitlin jener there seems to be a rush to be politically correct or in their case silent. Are you worried there has not been a full public vetting of the transgender debate . Well, yes, there are uneducated people who think that transgender people has something to do with sex. It is not a lifestyle. This is my life. With all the people out there who just totally misunderstand it, thats where we start running into problems. My biggest effort right now is only education letting people know who i am. If you can spend two minutes with me youll find out that im a regular person, no different than. You how does society handle the thorny issues of where do you bathe . Where do you bunk . There are 18 other countries around the world in the military that accept open Transgender Service. Canada has done an immense study. Theyve had Transgender Service since 199. Take the examples that they have. There has been no effect on operational readiness. Im sure there would be straight facilities . No, we have male and female facilities. There is not a problem. Most of the facilities were speaking about nowadays are very private. We dont have open showers like in the 1920s. Times have changed quite a bit. The people ive served with its a professional force. Were professionals. I dont serve with beavis and butt head. So you dont see the things that you would think are going on. I dont see the problem. Should tax payers have to foot the bill for surgeries and treatments . The thing is Chelsea Manning right now is in federal prison. So its up to the federal prison system to take care of their people that they have in custody. Thats 100 across the board. Chelsea manning deserves as much surgery as everything to make her as comfortable as possible. Thats whats called human rights. So taken care of chelsea is their duty, and they must do it. But even as a convent . Chelsea man something in custody. Its up to them to tame care of a person who is in custody right across the board. Its called human rights as i said earlier. Otherwise its an undue and inhumane treatment. So i 100 support Chelsea Manning getting surgery hormone therapy being taken care of with dignity and respect. Your story grabbed headlines. If you want to get ratings because you have me on your show, go for it. But if i can get education out there and a few people to understand where im coming from, i save one life, then its worth it. Ormond beach in the town of oxnard was the dumping ground for toxic waste. Halico operated a Metal Recycling plant here. For 40 years sending toxic run off in the ponds at its base at an estimated rate of 1 milliongallons per month. Cited and sued halaco filed for bankruptcy and shut down in 2004. Leaving behind an unsightly and dangerous slag pile that is now slated as a super fund site. The towns coast is blighted by three power plants. We have in oxnard the largest remaining coastal wetlands in cal. And theyre very ecologically. Now member of city council and narrow pro tem said that this community has suffered long enough. Oxnard already has born bourne the burden for 50 years. We dont have the nicest coast in every way that other cities enjoy. Its time for us to get our coast back so we can have the same opportunities other beautiful coastal cities have. Unlike affluent neighbors malibu and Santa Barbara oxnard is a working class town with many immigrant farm workers with little means to fight big business. Thats where they could live. They could afford it, so they were stuck with it. Most Super Fund Sites i would community are poor communities in our country. Oxnard is no exception. Were people here taken advantage of . I think so. A former strawberry picker lives in a neighbor close to the dump site. I didnt even know that place was bad. Do you think thats the case with most people . They have no idea. He became a Community Organizer and strong voice about the toxic hazard in his community. Some of the chemicals are going into the potable water. According to the epa there are no health risks to nearby residents but there may be hazards from longterm contacts with the waste materials on the site. And in a statement to america tonight, the agency said epa is working to develop a cleanup proposal for the site. Cleanup costs are unknown but likely to be in the millions or tens of millions of dollars. Were joined live from los angeles. Michael, the epa saying as you pointed out there are no health risks to the nearby residents but are they buying that . Well, for the most part, del residents are wary from what the epa has to stay about this. But theyre also very wary about going to that site. There is a small number of people who occasionally do bad things or officially ehis the things from that site from time to time. But they talk about their neighbors dying from cancer, and this lingering metallic taste that they have in their mouths when the halaco site was still in operation. Essentially there has been no proven connection between those two things. But they still talk about it. So what happens at this point is anybodys guess about where were going to go. Striking photos of the places are tens of thousands of soldiers died. This month marking 152 years since gettysburg. It was a defining and deadliest battle in the civil war. David levene has marked on a new project to bring gettysburg to life. He explains it in tonights first person report. So this is a then and now photography project which gives people a chance to see how places have changed from 150 years ago to today. I came on with 23 pictures that they had found that we decided having looked at the images and looked at the photographs of the areas today that we might have a good chance at achieving the same photographs that were taken 150 years ago during the civil war. The beauty of these images, seeing the fade from then to now. Particularly if you have people in the original pictures that suddenly disappear and yet present the modern day image. It has this very ghostly quality to it. The easiest way to find the locations is having a series of reference points. So when youre presented to a scene. When you have a building in the near foreground and a building way off in the distance then its easy to reference those two buildings to each other to work out where you should be in relations to those buildings. In one picture there is a series of boulders, and its quite difficult to use those kinds of landmarks as your reference points. Also some of the landscapes have changed quite a lot. Whether thats the National Landscape or the buildings themselves. Some buildings have been modified over the past 150 years. The civil car era was an amazing time for photography. It was only 2025 years after the birth of photography and the guys who were working at the time were real pioneers in their craft. These guys were artists and they looked at themselves as artist. When im in the field and im trying to get the photograph i get quite technical actually. So i dont get swept away by the historical events at the time.
