Theres no solution that magically presents itself upon transfer or continuation of power. At some point maybe we better understand each other and Work Together towards common goals, were not there yet. Thats clear and if the elections process has taught us anything its that the road to unity does not run through it and may, in fact, lead us further from it. That said i can report tonight the process is working its just slow and messy as our democratic experiment has always been tonight, the vote is in. The count is on and five battleground states that could swing this election, all the ones you see here in yellow are still too early or too close to call unless theres a sea change, demands for a recount and legal fights are just beginning. In arizona were waiting for hundreds of thousands of uncounted ballots to drop which could extend or erase joe bidens lead in pennsylvania, President Trumps lead has been narrowing. The Trump Campaign suing to stop the ballot counting and asking the Supreme Court to intervene the Trump Campaign also trying to stop counting in michigan nbc news projects biden has won that state in wisconsin, the Trump Campaign demands a recount. Nbc news declares biden is the apparent winner there. Today, the former Vice President pushing back on the Trump Campaigns attempts to stop the ballot counting. Every vote must be counted. No one is going to take our democracy away from us not now, not ever. We, the people, will not be silenced we, the people, will not be bullied. Joe biden addressed the nation and when he really struck that bullish tone and said he was not there to declare victory but he feels confident they are on the path to 270 votes so why are they feeling so confident . Because they are starting to win back the blue wall that President Trump won back in 2016 those critical midwestern states that you mentioned, michigan and wisconsin. Remember, Hillary Clinton could not hold on to those states, and the Biden Campaign has long said that they will be the key if he is going to win the white house. So the focus tonight on nevada, on arizona and, of course, on pennsylvania as well now, its important to note that joe biden doesnt necessarily need pennsylvania, but if he doesnt win nevada, if he loses one of those other states, then he will need a pennsylvania in order to get to 270 and that is where you could see this becoming a very long, protracted battle as you pointed out, the Trump Campaign already launching legal fights in a number of these different states and ive been talking to biden, Campaign Officials about that throughout the day. What is their response, their strategy to deal with that and i can tell you theyre quite defiant. They call those legal challenges charades and pathetic and say they have a team of lawyers ready to fight, ready to get into action. Theyre fundraising off it so is the Trump Campaign so to give you a sense of where it stands the Biden Campaign launched its transition website i want to go back to a point that you opened with, though, shep i think it is really critical to where we are right now and that is, this is a nation thats deeply divided you heard biden address that he vowed to be president for all people if elected. If he is elected or if President Trump is reelected that is undoubtedly going to be one 69 Biggest Challenges moving forward. Shep. They have to earn them in the voting meanwhile the campaign professionals on the trump team are expressing confidence as well holding a Conference Call earlier today in which they suggested that theyre willing to declare victory in the state of pennsylvania. Thats largely because they say theres enough trump vote out there to prevent the president from losing the state, particularly in butler, york and blair counties of pennsylvania theyre demanding that news organizations retract their arizona call a number of news organizations, not nbc news have called arizona for biden. The Trump Campaign demanding that be retracted. They say theyre confident that the president s is going to win North Carolina and georgia and they expect the trump reelection confirmation as soon as friday and, shep, i can tell you there are a rank of emotions inside the white house tonight with some advisers with sort of chest thumping confidence. Others slipping into pessimism about where all of this is headed as this race is still unclear in terms of an outcome, shep. Many eamon javers, thanks. A political race turning into a legal battle in wisconsin. Nbc news declaring joe biden the apparent winner of the badger state by less than a percentage point. Well, yes, as you mentioned a razor thin race here and you saw the numbers just there, nbc news projoekting biden the apparent winner now this recount, what will happen and how will that play out . The Trump Campaign can officially ask for that recount once the counties certify the results. That could take at least a week then they have several days to file the petition and then Election Officials have up to 13 days to conduct the recount and might not be finished in wisconsin until much later this month. What put biden over the top here when something we have been waiting for all night yesterday in the sense of absentee ballots came in from milwaukee and green bay and added to bidens lead but, shep, you remember a few days ago, there were projections all over the place, public polls that had biden up by even double digits one poll had him up by 17 percentage points. How did the race get so close . Weve been speaking with Trump Supporters especially in the kenosha area south of milwaukee and they said that they wanted to turn out for President Trump and stayed with him and might be some hidden trump vote their didnt participate President Trump beat Hillary Clinton four years ago by less than 23,000 votes. Right now the separation is 20,000 votes or so but the breaking news this afternoon, nbc news projecting that biden is the apparent winner here in wisconsin, shep. Thats what theyve done in grand rapids and wanted to show the transparency to us so allowed us to look in. One of those mysterious vote counting centers you hear about and reference the lawsuit. Earlier all those tables filled with votes and representatives of both parties, by the way, carrying them over, tabulating the votes going through some of the contested ones as well you know how its done, men and women, republican and democrat both parties sit there, they look at the ballots, they go over them, if they have a challenge there is a lawyer behind from each party i can assure you everything was civil. Both parties talking to each other, going through problem, going through the ballots and they did it all in i guess a michigan nice way. Kind of hard to believe. Donald trump being called the winner by nbc news as you said right now joe biden, excuse me, 100,000vote marriagesen and yet theres about 97,000 absentee ballots to count by our estimates as well. Donald trump filing a lawsuit but at least here in grand rapids, the counting is done the work is done and we have called michigan for joe biden, 16 electoral votes obama won by 450,000 in 2012 trump by just under 11,000 in 2016 biden going after two group, shep, he is going after that Blue Collar Union worker that may have sided with trumps message four years ago but not today and female voters, biden capturing 8 more of the female vote in managering this than he did clinton did in 2016 so michigan being called for joe biden and our thanks to the good people in grand rapids for letting us inside. Sully with the good news in grand rapids heres a look inside the Pennsylvania Convention center where workers have been processing the ballots all day looks like some of them are still at it. Across the state more than 1 million mailin ballots have yet to be counted still. For context thats about half of all the mailin ballot there is from the Pennsylvania Department of state nbcs rehema ellis is there in philly reporter hi there. I should tell you theyre chipping away at that million number and part of the way theyre doing that is by whats happening behind me in this convention center. Theyre working on a 24hour schedule and saying theyre going to continue doing that until all the ballots are counted. Here in philadelphia, they say theyve gotten through about 66 of those mailin ballots and in allegheny in the western part theyve gotten through 68 of those ballots. These are very important because, you know, Hillary Clinton lost this state by less than 1 or 44,000 votes. So any vote that comes in here while the president is up in the inperson balloting at this moment, the biden people say they are shrinking that number and think theyll be able to do a lot more once these mailin ballots are counted. They had a big push by them to get them out to the polls. They think the mailin ballot will make the difference and despite the lawsuit that the Trump Campaign filed here in pennsylvania today to say that they want to stop the mailin balloting, the governor of pennsylvania says its going to go on and be transparent and theyre telling everybody be calm, be patient and be confident every single vote will be counted shep. Rehema, thank you arizona now where nbc news projects the race is too early to call, yeah, day after joe biden is leading there hundreds of thousands of ballots still uncounted in all important Maricopa County and jane wells live there hi, jane. Reporter hey, shep theyre getting ready to fire up the machine behind me that tabulates some of those ballots and these are some of the bipartisan teams brian was talking about over there look, were going to get big numbers in a couple of hours here the current numbers we have separate the candidates by about 95,000 votes but there have been 450,000 uncounted ballots just in this building today, 600,000 throughout the state but theres a new wrinkle in this story and some are calling it sharpiegate did you know you can use a black or blue pen or sharpie to fill out your ballot in Maricopa County the county was recommending sharpies as the preferred ink to fill out ballots and handed them out last night but the attorney general and former Election Officials wants answers after he got hundreds of complaints from people claiming they were rejected because of things like sharpie ink leaking through. Election officials tell me, thats not true. Sharpie filled ballots were counted. This is the way theres no leakage. There may have been other issues its just the latest issue announced and Trump Supporters are planning a rally outside here friday. The vote, we should get big numbers at 9 00 eastern and then another dump of votes, numbers later this evening that will be the first numbers weve gotten, shep, since very early this morning and could really tell us if this race is tightened or blown apart jane, thanks so much. The numbers close enough that it could depend on a recount but the democrat has now conceded an collins who never missed a vote in the senate called the outcome an affirmation of her work in Washington Republicans are also seeing momentum in michigan gop candidate john james, a black businessman and rising star in the party is neck and neck with incumbent senator gary peters North Carolina and georgia are weighted too close to call but sitting republican senators are ahead in tallies so far democrats best chance of flipping another republican seat can in arizona where astronaut mark kelly is leading against Martha Mcsally but nbc says it is still too early to call that race so the upshot here is that even if joe biden does end up winning the white house hes going to have a hard time getting his agenda or even just his cabinet through a senate controlled by republican, shep. The house is another big disappointment for the democrats, right reporter that is right democrats are expected to maintain control of their chamber but with a smaller majority republicans have knocked out 11 seats so far according to nbcs calls and that includes frontline freshmen like kendra horn and republicans have also protected suburban districts like ann wagners around st. Louis and say they have the most diverse caucus they have ever seen, more women, more minorities so even with the majority, democrats will not have a lot of room to maneuver and, shep, there will be a lot of questions about the strategy nancy pelosi has pursued as speaker of the house. Were getting a look at some of the new folks coming up on capitol hill in jiang. North carolina voters elected the youngest congressman, Madison Cawthorn 25 years old a rising 25 i dont even remember that year. He was born in 1995. Aagh bill clinton was in office, o. J. Simpson on trial 25 is the youngest you can be and become a congressman according to the constitution. Cawthorn will represent North Carolinas 11th district a seat formerly held by mark meadow, now President Trumps chief of staff House Republicans added at least a dozen women to their roster. Republican leader Kevin Mccarthy called tuesday night the night of republican women. Here they are, all of them beating incumbents, that will double the number of women held seats in the house of representatives, just that and when the tallies are in another six or seven women could join that group and more history made in new mexico, its now the first state to elect all women of color to its house delegation two of them are native american. Thank you very much ive had some experience look, right now youd have to say that biden has several realistic pathways to 270. In fact, he doesnt need the closely contested states on the east coast he could win hes at 253 and needs 17 votes and can get them just from arizona and nevada where he is, in fact, leading well see if the leads hold up but thats a simple way to 270 then Everything Else becomes kind of academic. Here are the uncalled states. Of the group that has not yet called in some cases because they have not finished counting, what stands out for you, larry everybody is waiting on pennsylvania thats extremely important and i think that truly is 50 50 based on what ive seen. North carolina, i would lean to trump. Things are going to be tough for biden to make up the difference there. Georgia, though, is fiercely competitive and both sides are telling me that theyve got it and theyre not leaving any wiggle room there. The biden people are insisting that once all the votes are counted theyll win by 7500 or so votes i dont know how these people could be so precise, but they are when they call you and tell you these things lets talk about arizona for just a second. There seems to be a conventional wisdom that arizona is about to go to joe biden but i dont i mean, conventional wisdom doesnt mean anything right now so i was wondering if you have any drilldown on arizona for us the reason i think biden may hold on there and theres a lot of votes left to count, i think he may hold on is because look at that senate race. Yes, it hasnt been called, but mark kelly, the democrats extensive lead will be very difficult for appointed senator Martha Mcsally to make up and when you have Something Like that happening just below the president ial race, given todays partisanship, usually the president ial race and the senate seats do align and that alignment would suggest that the democrats would win both what about nevada i mean its a changing state thats going through a lot economically and covid and all the rest what do you see there . Whats interesting to me is that was much closer than it was expected to be just like a lot of other states, and part of that was President Trump did better with hispanics and latinos across the country but especially in florida but i also see evidence of it in nevada as well, something republicans can build on for the future. The last thing i want to talk about is pennsylvania and we all know that its going to take a while to count and know why that is because they set up the rules that way and frankly we know why they did that. Clearly the people working for the people are not really doing the best for the people. Well, one thing they could do at some point and its up to them is to align the governor and the legislature this the same party if you have it controlled by one party and governorship by another odds are theyll be fighting more than theyre working together now, you also have to make sure theyre committed to change and reform those are two big things anywhere, any state and pennsylvania is a big complicated state with lots of moving parts before we go, you forecast races and everybody ive seen today asks me whats up with the pollsters . Whats your read on it yeah, im delighted that im not a pollster yeah. So i can criticize them freely look, theyre going to have to completely redesign what they do yes, there was a hidden trump vote theyve been denying it forever. People in my field have been denying it forever i think theres clear proof in the two elections 2016 and 2020 and you either find a way to get them to participate so that theyre properly weighted in the polls, or maybe we go back to reading tea leaves i love tea and when you look at those leave, a lot appears to you. Can be very revealing. Four years ago for a long while we didnt use polls in the newscast i was, you know, senioring there and i wonder if we need to look in the mirror, journalists and everybody else who uses them come four years from now and say, i dont know, you know i think its useful to refer to them and to look at them but dont be driven by them. Nbc news projects michigan goes to biden in wisconsin, joe biden is now the apparent winner which means nbc news has projected a winner but theyre so close it may depend on a potential recount and confirmation that the results reported are actually accurate and we await nevada, arizona, pennsylvania, georgia and North Carolina but if nevada and arizona get called tonight, which they could, joe bidens lead in those states right now, its over. The Trump Campaign filing a lawsuit in georgia this hour looking to pause the vote count, just stop it the state too close to call with a difference right now of less than 50,000 votes. Were still waiting for absentee ballot s from around the atlanta area the election head, fulton county, said this moments ago. Were trying to make sure that every ballot is counted and we expect to be here, were bringing in some more fresh people because weve had people here all day we expect this to go probably until midnight or more midnight or not, greg bluesteen is a political reporter with the Atlanta Journalconstitution newspaper. What is the latest youre reporting and learning about the count there . Yeah, you just kind of summed it up. Joe biden is within 50,000 votes of defeating President Trump here he would be the first democrat to win georgia since 1992 and the first statewide democratic candidate to win in a statewide office since 2006 so it would be monumental for democrats i didnt mean to interrupt. I thought you paused if you dont know the area well 50,000 sounds like a lot if you do know the area which you do, does it sound like a lot . Not at all especially when you consider more than 120,000 absentee ballots are still out and absentee ballots in georgia as in many other states are trending decidedly democratic. This is above the fold in ajc and i wonder if its like the talk of the town or with all of Stacey Abrams work did people expect it . Yeah, thats a good question because its kind of both, right . Depends upon which tribe youre in. Yeah, its not like an electoral switch flipped in georgia. Georgia has been getting closer over the last decade, 2014 republicans won by eight points, 2016 by five 2018 by a point and a half so we expected very close race but a lot of republicans needed to see it to believe it when youre looking at that margin, onepoint margin in georgia, the fact that georgia hasnt bean called before florida other battleground states are already decided in georgia still remains up in the air, still staggering to a lot of voters from both voters. Greg bluestein, thank you its the most recent legal challenge but the trump team filing lawsuits in pennsylvania and michigan the campaign asked to stop the vo vote counterclaiming their people need better access to watch it ail happen. Then theres wisconsin, the trump team calling for an immediate recount there. Citing irregularities in several wisconsin counties the rules say a recount can happen but only after the vote are all counted and when the margin is within 1 and right now the margin is that small but all the votes have not been counted. Nbc news is calling biden the apparent winner because the results are so close in other words, apparent instead of the winner. Caroline polisi is a professor of law at columbia university, caroline, how do these recounts usually play out well, i mean if past is prologue and look at the 2000 bush v. Gore situation, not very well but the overarching issue is President Trump is realizing more and more that really his only shot at getting hanging on to the presidency is through litigation and potentially taking that all the way up to the Supreme Court. I do have to say that most if not all of these cases really lack merit and the hook that theyre using here is the threat of voter fraud, right . And trump has been priming the public for making this argument for the past few weeks and, shep, we know that voter fraud just isnt a threat to american democracy right . We know based on Empirical Data it doesnt happen on a wide scale but what is a threat to our democracy is Voter Suppression and voter intimidation all of which it seems like President Trump is really condoning at this point. All true factbased not opinion. What about the lawsuits in michigan and pennsylvania . What legal grounds if any do they have there to try to stop the count . Well, theyre not going to stop the count thats for sure but there is an interesting issue in pennsylvania you know, there is another pending case in pennsylvania that the Supreme Court declined to take up because the Supreme Court is not in the business of taking cases they dont have to. Theyll only really decide it if it comes down to that margin and the issue there is whether or not the state Supreme Court in pennsylvania can put through this law that alouse for them to count them three days after. It seems as though most on the Supreme Court are pretty, you know, on the side of trump in that regard. Saying that, look, its the legislatures that have to make these law, not state Supreme Courts its actually a similar issue decided in bush v. Gore but i do think that that i mean i dont think its going to come to that, but if it does, you know, theres also we have Amy Coney Barrett on there is she going to recuse herself so much to play out but i think that really the only issue with merit is this pennsylvania case. The bottom line is the president said, im going to take it to the Supreme Court thats just factually speaking you begin somewhere else and maybe get there. That means less chance of regulation of drug places, for example and means less chance of more regulation for tech companies. What about the little one . Yeah, so the most important issue for the average american is whether theres an agreement to provide more aid to help people get through the winter. Stimulus both trump and biden have said they are in favor of very large stimulus programs to help americans in need but the Republican Senate has pushed back on large proposals. And i think thats central to the divide so to get beyond it i think weve got to create a new vision of what National Unity is all about. Its a big table its a multicultural table a table with people of different backgrounds, races, orientations it is a 21st century notion of National Unity weve got to build it, and it may not be what historic senses of unity is about because we have to tolerate differences but we have to affirm the sets that everyone is equal. Everyone should be treated fairly, that there should be tolerance and weve got to address longstanding economic and social divides. Nobody is arguing with any of that, marc there is another thing too we used to all kind of know each other and have shared experiences, you know, we would read the same newspapers and watch the same shows and go to the same places. Now we can kind of live in our own little world we can live in places where our own thoughts and feelings and prejudices are amplified and you can see them in a mirror and never have to venture out from that into a place where the others live. What do we do about that you know, shep, youre pointing to the fact that the media and the way the immediate social media, all of it where everyone can choose a lane or choose a channel and there is no shared messaging, no shared experiences i dont have an easy answer to confront that. But the first thing is that the knowledge that when it comes to our politics, the divided media and the ability of people to just embrace a different set of facts and that be the propulsion of different opinions. Different opinions are time honored in this nation different sets of facts, the grasping of things that are simply not true is what i think is exacerbated and created so many of the friction we face how we address that, ill come back to leadership i think the nations leaders have to be, if you will, voices for, leaders on, moral persuaders of the need for us to have a new vision of National Unity and i think thats what we hopefully will see with a change in the presidency. A different tone and a different approach we dont know if well have a change in the presidency but i will say this, i think covid has made it a lot worse because we so many of us in some parts of the country sit at home and live on our computers and dont go out as much, dont see other people and get caught up in that thing. As long as covid is a big deal, i dont know how it gets any better, marc you know, shep, i saw covid and i said, of all things for the nation to be divided about, a pandemic, a health emergency, you know, when this nation is has had its moments of greatest National Unity, its been in the face of crises and while those moments of National Unity were not perfect because in some cases it led to the marginalization of some, in those moment, shep, is when the nation should rise when our readers should rise and so im not certain when covid has cost us lives, has cost us damage to our economy in an effort to confront it, that is what it has cost us but it was the perfect opportunity for all of us to come together, and i think to get beyond it, i think weve got to find this new definition of National Unity.
