Well have more on that In A Momentch but let us start with the Impeachment Trial and donald trump and the breaking news coming from capitol hill. Manu raju has been combing through this brief, coming from the house Impeachment Managers and joining us right now. Manu, what is the case that theyre laying out against donald trump . Reporter well it is essentially broken out into four key areas. What he did before the election, how alleged without any evidence there was going to be mass fraud and accepting he wouldnt accept the election results. After the election saying stop the steal and encouraging his supporters to come to the Capitol On January 6th and come to this rally that occurred before the deadly riot. And then the third part, what he said to those rallygoers as he told them to go to the capitol, later leading to the deadly riot. And then the argument about the constitutionality, it is well within the bounds for a senate to try a former president , trying to rebut the republican argument that is isnt. Now this is what they say here. They say the president s responsibility is unmistakable. They said the president s effort to extend his grip on power by fomenting violence was a profound violation of oath he swore. If provoking an insurrection is not an Impeachable Offense, it is hard to imagine what would be. The framers themselves would not have hesitated to convict on these facts. Now they of course are trying to appeal to republicans here because democrats are expected to be overwhelmingly united if not completely united, all 50 democrats very lickly going to Convict Donald Trump but where will the republicans go. Will they be convinced by the arguments here. They are try to lay out that it was intentional reaction by the president that all of the members experienced when they stormed the capitol here and arguing that it is completely legitimate more the senate to move forward. But that is the argument that the trump team is going to make, that it is not constitutional and republicans leaning in that direction, kate. Thank you so much for that. So ross, i was looking through some of the excerpts, this is not a routine corruption charge the democrats write. Trump has committed an Impeachable Offense of historic proportions. What do you think of this pretrial brief, what sticks out to you . So were still going through it to me it seems like a very, very strong detailed effort by the House Managers to lay out their case and to anticipate the trump defense. And on the constitutionality and on the facts. And well have to see what the trump folks say about it but this is a strong opening shot. John, all of the details are important, of course. But i dont know if the politics are any different no matter what is laid out. Do you see this moving the needle with republicans or is it more about maybe what the president s team does or doesnt present in response . Reporter i think it could move the needle with a few republicans. But it doesnt move the needle overall. Weve gotten a forecast of how this trial is going to come out from the 45 senate votes, that the trial itself was unconstitutional. We saw from david schoen, the new lawyer on trumps case, that is a principle argument that he is going to make, that it is not constitutionally viable once he is out of the office. The republicans want to acquit trump and move on. It is not entirely what trump wants because trump wants to advance the lie that he actually won the election and it was stolen from him. But it is difficult for a selfrespecting lawyer to stand up and make that case when Everybody Knows it is not true. You will get some pushback from the Trump Lawyers saying well trump didnt mean to the violence to take place and if you look at his words, he didnt intend that, that is one way in which they will try to bush pack on what democrats are alleging. Do you think that is the main route though go, ross . I think there is a couple of key arguments. One is on constitutionality and the second i think is potentially a compelling argument particularly for republicans which is that what trump was saying was kind of normal, if not normal, protected, legitimate First Amendment speech. What he wasnt telling the crowd that was gathered in washington was to go storm the capitol, to do violence. But what he was saying was, again, essentially political speech and it wasnt reasonable for him to foresee the violence and i think that points at a very interesting question which is will there be witnesses. That is exactly what i was going to ask you. What is the calculation do you think in that question . Well, here is the issue. If theyre going to have any chance at all of convincing republicans theyre going to need witnesses anz theyre going to need new facts. The problem is, it is unlikely that Senate Democrats who control this process are going to want a long drawn out trial where regardless, the outcome seems to kind of be predictable. So i think that is the thing to look at, is will the House Managers seek to call witnesses. It is a big question. John, the senate trial is already having an impact on bidens agenda in some part. One example were learning about now is Lindsey Graham, still the clair of the Judiciary Committee because they are still working out how theyre going to run the 50 50 split senate which is a whole other conversation of why is this taking so long, regardless, graham is now saying hes not going to be able to hold Confirmation Hearings for bidens Attorney General because the trial is starting and getting in the way. Is this the white house saying anything about this . What are you hearing . Well the white house is saying they could move dick durbin, the Senior Member of the Democratic Senate caucus is making the point you could move this if you want to and they could and republicans are trying to make the case that the trial is counter productive because it will hurt the democratic president , not that they mind hurting the democratic president but how how theyre making the argument to shield trump. And there is not much democrats could do about it if they want to throw sand in the gears and that is what Lindsey Graham seems to want to do. Overall it is not likely to have Avenue Effect on the president s agenda because Merrick Garr Lands will get approved any way. All of the Cabinet Members will be approved and theyre moving ahead on a fast track through the reconciliation while talking to republican senators on this covid Relief Package and joe biden seems to have the votes, well see how the negotiations go and whether republicans could temp people like joe manchin and Kyrsten Sinema so go with a smaller compromise but it looks like they hold the votes for something close to what joe biden wants. Why do the democrats need to bring witnesses forward when and why do they need new facts . I wonder because you have in court testimony, you have actually already people who stormed the capitol, rioted and saying they did it because of donald trump, they did it because donald trump told them to. There are people on tape saying that. It is a couple of things. One is, remember during the first trump Impeachment Trial there was a lot of criticism about the process because it looked nothing like a trial. You didnt have witnesses. And so i think common sense and kind of public suggestion is that if youre going to have a trial and charge the former president of the United States an insurrection, it should look like a trial and you should have witnesses. Second, on key points, what we dont have is testimony or insight. For example, we dont have any connections so far, at least between the president and his team and the rioters, number one. And number two is the brief talks about what the president was doing during the riot. But there is no actual testimony, there is no actual accounts of that. All of the accounts are kind of these hearsay accounts from what press was reporting on Anonymous Sources said. So i think that is the other key thing. If youre going to move republicans, youre going to have to present something more compelling tieing the president to the misconduct. Lets see what the president s Team Presents as theyre up against a new deadline today. Thank you both. Reporter well i think it is Crystal Clear today that democrats are going to be charging ahead with their partisan effort essentially to try to pass as much of bidens 1. 9 trillion plan as they possibly can. And theyre going to take that very first step today in the u. S. Senate. Theyre going to have a procedural vote essentially to move forward with the budget resolution. That is the first step in this twostep process that allows democrats to try to advance this proposal with just democratic votes. But look, there are major differences. Yes, republicans could continue talking to the white house. They could continue talking to some of their moderate democratic colleagues about how to shape this proposal. But there are huge differences. Republicans are suggesting 618 billion for a top line number. Of course we know bidens plan is 1. 9 trillion. And we heard yesterday from the house that theyre willing to make some changes around the edges here but not willing to come down to 600 billion. We also of course know that there democratic plan provides 1,400 checks to families and to individuals who are affected by this crisis and hit a certain income threshold. That number much smaller in the republican plan. And democrats want to provide direct state and local aid. That is not something that the republican plan provides for. So some significant differences here. And yes, the conversation between republicans will continue with biden. But it is unclear how much theyre actually going to shape the final proposal. Kate. What is the new information mean to you and in the fight to control the pandemic here . Hi, kate, thanks for having me. I think it is concerning as you pointed out and as dr. Fauci pointed out, that were detecting these variants. It is important to continue to monitor the variants and what it means into terms of resistance to the vaccine, in terms of whether you could get reinfected and how severe you are when you get the virus and the variants and we dont know that information yet but more information will be coming. I think what it does make me think is that in the context of additional funding being necessary, is that with these variants circulating, it does increase urgency in which we should be vaccinating. We need to get them out and into peoples arms a quickly as we can so more resources are negl necessary to do that. They need more resources to scale up and make sure vaccines are getting out and into the right arm. And from what we know so far about the vaccine effort, and there is clearly a lot a lot lacking in the data, according to new cdc data, white women over the age of 50 account for most of the people that are getting shots so far. And the administration said that they dont have race or ethnicity data for almost half of the Vaccine Records so far. They point to that as a real problem. And you actually just wrote an Opinion Piece with dr. Richard besser getting at why this is such a problem here. Why is this so concerning and is it clear to you what needs to be done to fix this quickly . So i think from a Public Health perspective, data are fundamental. In order for us to know who is getting sick, who is getting the most sick and ending up in the hospital and dying, and who is getting vaccinated and not getting vaccinated. You have to have the data. So having data based on race, ethnicity, gender, geography, as well as occupation is critical. And so as were rolling out and ramping up the vaccine program, we need to have timely data that tells us who is getting vaccinated and not so the programs could be adjusted. And i pointed out earlier, the state and locals didnt have sufficient resource to ramp up a scale for a response and it is not too late. Ive heard many jurisdictions looking at ways to help people get registered for the vaccines who are not able to ramp up the Vaccine Supplies and get them into arms more quickly. So, the resources need to keep coming, so these programs could be scaled up and to see the vaccines are getting into the right peoples arms. Absolutely. And for those who have been lucky enough to get the vaccine so far, there are a lot of questions now about kind of what they can and cant do now that they have the vaccine. Do they have to do they still need to wear a mask, who could they visit and can they travel . This is the new wave of what is the guidance, what is the best advice. What do you say . I think the vaccine is great. It is the two best things are that it has high effectiveness against the strains they were tested against but with we dont know they protect against transmission to another person. And so wearing masks, keeping social distancing and washing hands are still critically important while people are getting vaccinated as well. So, we know that many people arent getting vaccinated yet and some that are vaccinated need to feel more comfortable themselves that their protected and know there is a possibility this could spread to others. Le me take you down a list of the few actions hell take in the three Executive Orders the most significant is establishing a task force to reunite families. There are hundreds of children who remain in the United States who were separated from their families and who have not yet been reunited from their families. That task force will be led by the secretary of Homeland Security who is expected to be confirmed today. There will be aid to Central American countries as well, focusing on the root causes of migration, something that the Previous Administration didnt do as much time on as they focus more on border security. Many of the changes wont be immediate. They wont take immediate effect and youre seeing a lot of reviews here to try and unwind these policies. So it is a cautious approach. As the review is happening, though, to be clear, there are still legal cases, lawsuits moving forward and that is why yesterday you saw the Biden Administration asking tem to postpone oral arguments on a pair of cases involving the border wall and this remain in mexico policy where migrants and asylum s asylumseekers will have to wait for adjudication. Well see what the Supreme Court says. Jeremy, thank you very much for that. What do the Executive Actions mean for the thousands of families that you have, have been and are representing what, do you need to hear from this task force that is being formed to know that it is actually helping . Right. So that is i think youre asking the exact right question. So the Executive Order we expect to be today. We applaud President Biden for investing in this issue and dr. Biden. That is great that shes going to be involved in the biden team is committed to this. But ultimately it is what does the task force do and we need to see them do some concrete things immediately because there are little children involved. We need to see the families be allowed to come back to the United States to stop deportation and to give them legal status and some type of restitution. And were looking for once the Executive Order is in place does the task force take immediate concrete steps. You mean immediate. This is three years later. I cant believe it is three years since youve been coming on my show talking about this. And there are still more than 600 families that are not together. Why, lee . What are their stories . So it is shocking that were still looking for families. The reason is because the Trump Administration failed to disclose their names until they were forced to and then failed to disclose Contact Information it find them and as you know, things in Central America are dangerous and logistics are hard and were still looking for the 600 but it is critical to understand there were more than 5,500 families separated. So beyond finding the 600, we need the task force to help all of the families, that means allowing them to come back to the United States to reunite with children because many more than 600 are still separated. We need them to be given legal status, restitution. This is the worst thing that ive ever seen in the immigration era, maybe one of the worst things ever in the history of this countrys immigration policy. The United States government engaged in deliberate child abuse and the Biden Administration needs to fix this. It promised it will fix it and i think the task force needs to act quickly as youve said. And the Emotional Trauma on the children and the parents is something that is not fully appreciated. Every time a read another story it is unbelievable what the families have gone through and what and the trauma that these children are facing. Even after they are eruinited with their parents, the irreparable harm they are facing. And this is not over. The families are still separated an the system is broken and amess, after three years fighting this, lee, what is the lesson that youve learned throughout this here . I think the lesson to be learned is that there needs to be public outcry right from the beginning and that people within any administration who are the Career People need to push back so that this never happens again. I think public outcry did a lot. Unfortunately youre right, it is three years and its way too long. But i think we need as a country to be vigilant about what our government is doing and to pushback and Everybody Needs to put their foot down when they see something this inhumane. We are taking little babies away parents and traumatizing them as you said, kate, because it is not over. These children will live with this potentially for the rest of their lives. Yeah, absolutely.
