Today on inside politics, a burden of proof and politics. The trial against donald trump takes shape as a federal judge sets a date to decide when prosecutors will present their case. Lets go behind the headlines and inside politics. Up first, Donald Trumps anger and anxiety triggered by a looming trial for alleged election crimes. The former president s public posture is defiance. Today donald trump made a demand that the Supreme Court get involved, but behind closed doors, we are told trump enraged by the third indictment made clear that he was not happy with what happened inside that courtroom. What he sees as an insult from the judge who oversaw thursdays historic arraignment. Lets talk more about that with our panel here to share their insights. Its been a very long week. Lets just start with where donald trump left us after he was serving inside when he came for the arraignment. And this is what he said to reporters. It was very brief, but very deliberate. This is a persecution of a political opponent. This was never supposed to happen in america. This is the persecution of the person thats leading by very, very substantial numbers in the republican primary and leading biden by a lot. So if you cant beat him, you persecute him or prosecute him. I want to have you talk about that, but also, you were inside the court about what exactly the former president s posture was. Because some of the color and kind of the scene was really fascinating. It was. And one of the things coming up to this hearing was that the court took great pains to make sure that the public had access to it, but also that donald trump was treated like any criminal defendant in that court. And the thing that evan and i both were in this hearing, as well as the hearing in florida which we got to witness, they did it so differently. In florida he was address ed by the Magistrate Judge as the former president. He was already seated in the the room when the public was able to come in and see it. So the whole courtroom was set before the hearing. This it was not like that at all. He was the last person into the courtroom, so you had him witness him walk in with the marshals surrounding him, the secret service, sitting down at that table addressed by Magistrate Judge as mr. Trump, which i thought i caught a grimace whenever that was said by the Magistrate Judge. And Kaitlan Collins reported this he was quite irked that he wasnt address ed as mr. President or the former president. And then the way the proceeding played out, there were several moments where he was asked to do a lot more than he did in florida. He had to sign his bond paperwork. He was asked to speak. He was sworn in twice. He entered his not guilty plea in florida. His lawyers did all of that. He was barely engaged, he wasnt directly addressed by the judge, didnt say a single word. But even though this proceeding felt like really any proceeding of a criminal defendant in the d. C. District court when they make their initial appearance, it was unusual. There was so much security around it. Even with the court doing their normal court of business, seven judges took time out of their day to come into that courtroom, sit in the back row and observe. It was incredible. The Magistrate Judge actually emphasizing that the former president is not allowed to intimidate witnesses. Its a thing that you might see maybe in like a mob trial or Something Like that, where thats an issue. Did you see his reaction when she said that . One of his lawyers looked down and smiled at that point in time. They had already been through the terms with him. You cant commit crimes when youre out. Do you understand that . And she went back to it. Just to make sure. And made him respond in the affirmative that he understood. So there was absolutely all of the things that the former president has done in all his other cases, it absolutely was a fixture and was part of the extra character in this courtroom. Because again of the history of the former president. Standby. I want to get to alayna treene. What are you hearing from your sources about the former president s sort of posture today . Reporter well, hes very frustrated. He is very angered by the mounting legal troubles that he is facing. And you could see some of that yesterday. Some of our great reporters, including those on your panel, were inside the courtroom and noted this he did appear somber, he did appear dejected. I also picked that up when you could see him speaking with reporters before beoarding his plane. He likes to normally be defiant when hes speak ing publicly. He likes to seem energized, even though we know hes very concerned and frustrated about these charges, but he didnt really give a lot of that off yesterday. And he is going to alabama tonight. He will be addressing republicans there. I do think hes going to try to go back to using the defiant rhetoric and the bravado he tries to use when hes talking to supporters. But its starting to weigh on him. Youre starting to see that bleed into the public a little bit more. I also just want to point to some things hes been say iing today on truth social. Hes been railing against these charges, as he has been all week, but he also had an interesting point today about the Supreme Court. He said this morning it is electionnterference and the Supreme Court must interseed. Also he noted that hes frustrated about how much money is being dedicated to his defense team. He said, quote, my political opponent has hit me with a barrage of weak lawsuits, which require massive amounts of time and money. So you can clearly see here how angered donald trump is by this and frustrated behind the scenes. Alayna, thank you so much. Appreciate it. Back here, hes angry. There are a lot of people who were inside the capitol who still have some ramifications of it, the Family Members of those people who passed away are probably angry as well. We can keep going down that list. But lets talk about the case itself. One of the former president s attorneys, a lot of them have been on tv trying to make their case in the court of public opinion. One made an interesting claim, and i want to get both of your reaction to it. I think that everybody was made aware that he lost the election, but that doesnt mean that was the only advice haven he was given. If anybody understands, there are numerous all the of advisers and politicians and lawyers, not just one or two, that are giving you eadvice. So this particular defense is he was led to believe that he actually won the election by a certain set of lawyer this is he chose to believe. Right. And they work on television. And it maybe appealing to his supporters, but its not likely to work in the court of law for a variety of reasons. Its interesting to me the way she phrased that seems to be a little bit of a softening of the prior statements we have heard, which were more focused on, i was absolutely following counsel, and i thought that the election had been stolen. This seems to be slightly backtracking from that saying he was told by others that the election had been stolen from him. Nevertheless, the offenses hes been charged with, it will not be an effective defense to say i thought the election had been stolen from me, because hes not being charged for saying the election was stolen. Hes being charged for entering into conspiracies to commit fraud. Even if you think youre right, even if you think something has been taken from you and youre going to enter into this conspiracy to get it back, the conspiracy is still a crime. Such an important point. The fact that he may have actually thought the election was stolen, although thats highly debatable and many people im sure will come forward to say he knew it was legitimate election, either way, its not likely. Youre not allowed to rob a bank because you believe that the money in there is yours. If youre delusional and you rob a bank, thats not an excuse. Theres even a clearer piece of this in that january 6th rioters believed the election was stolen. There are judges that say you can believe this, that doesnt mean it wasnt a crime. They have been convicted by the hundreds in the same courthouse. I want to be clear. Its an entirely unfair argument for the president s attorneys to make, at least as a defense, to says there was a multiplicity of ideasaround me from attorneys a was confusing. We took opinions from a lot of people. I think its undermined by a few things. One of those people is the attorney general. One is the director of the National Intelligence and on down. And moreover, prior to that point, they filed like 62 lawsuits around the country, all of which they lost. So yes, there were a lot of ideas around the president , but the simple fact is there was an overwhelming weight of evidence to the opposite point. I think it will speak to maybe there are a lot of ideas, but you were recklessly disregarding an obvious truth. What about timing . We think the august 28th state, the next day to present there . The judge is going to stick to her guns to set a trial date. The question is whatever date she chooses whether thats set in stone is another matter. In the end, she has to be careful to make sure that the defendant has a fair trial. He has a right to that. And they are going to try everything they can can to try to muck that up. The California Republican falsely equated Donald Trumps 2020 election conspiracies, which led to his supporters ransack ing the capitol to actions taken by Hillary Clinton and al gore. I would say the same thing Hillary Clinton says about her election she lost. I can say the same thing about the 2016 race. I can say the same thing about those in the Democratic Party from the leadership on down about george bush not winning that al gore did. But were any of them prosecuted . Were any of them put in jail . Were any of them held with no response . The answer is no. So yeah, you can raise that that someone raised a question. In america you are entitled to raise a question. Youre entitled to question whether it was honest or not. Thats the unique nness of the first amendment. Thats the uniqueness of america. Put you know what . You shouldnt be prosecuted for your thoughts. He is right. Democrats were angry after Hillary Clinton lost, after al gore lost, and there were some challenges to that. But heres the big difference. Both of those Democratic Candidates ultimately conceded. I still believe in america, and i always will. If you do, then we must accept this result and then look to the future. I accept the finality of this outcome, which will be ratified next monday in the Electoral College expect and tonight for the sake of our unit don and the strength of our democracy, i offer my cob session. A few weeks after that speech, al gore, who was Vice President at the time, he even presided over the congressional session approving the Electoral College result ths that he lost. I was there and i watched it. Lets go live to lauren fox on capitol hill. Lauren, this underscores Donald Trumps influence over the gop. What are you hearing . Reporter its not that different than what we have seen from the House Speaker time and time again. This isnt trumps first indictment. We have pressed him before on previous indictments, the last time about classified documents, he often would try to move the conversation back to joe biden. What about joe bidens classified documents. Those are two very different instances, two very different cases. And clearly, what he is doing here is trying to remain close to his right flank torks remind them that he is standing with the former president , and that is no coincidence. In the weeks leading up to the indictment on tuesday, there was a lot of coordination, a lot of collaboration with trumps team to ensure that republicans in the House Of Representatives were ready to come to his defense swiftly. Thats exactly precisely what youre seeing in that clip there from Kevin Mccarthy. And talk about the House Democrats. Because one of the political rules of thumb is that if youre opponent is in trouble, you kind of step back and let them continue to be in that state. It sounds like House Democrats are getting involved, or at least trying to. Theres a number of House Democrats who sent a letter recently to the judicial conference asking for a change to the statutes, as it relates to having cameras in Federal Court argue ing that the latest is a moment when we should start to see cameras in the courtr for this case. They are asking for an i just want to read you part of the letter. It says if the public is to fully accept the outcome, it will be vitally importanfor it to witness as directly as possible how the trials are conducted. The strength of the evidence, and the credibility of witnesses. We should say cameras are not allowed in Federal Courtrooms when it comes to a criminal trial. So asking for this exception would cast a the lot of questions about whether or not this is fair. Given the fact that the Justice Department tried time and time again to make the case, they are treating trump like every other person. This would obviously cast that into question. It sure would. Theres a whole argument and discussion about the fact that it is 2023, and there are no cameras in Federal Courtrooms, but maybe a different time and place to continue that conversation. Well see. As i mentioned, its kind of politics 101 to take a step back and not get involved and insert yourself when your political opponent is having trouble. Is this the right move for democrats . If youre a democrat, why wouldnt you love watching Kevin Mccarthy do the false equivalency tango. Because otherwise, what can think say . You did see them react to the indictment. You saw a bunch of statements. But otherwise, why wouldnt you . Lets turn to the issue a at hand, which is the fundamentals of how this latest indictment and all of them put together affect the election year. And i want to show you something that a man named michael duncan, who is a gop consultaid to the guys on the ruthless podcast. If this is the conversation, mean ing about election denyism were going to have over the next year and a half, its going to be tough for republicans, particularly in suburban areas. Presumably, hes making that statement based on what happened in 2022, when that is precisely the problem for republicans. Republicans lost because this is the conversation they were having because a lot of the Election Deniers and republican primaries won thanks to donald trump. There is a base here thats Still Animate D by the idea tha theres some deep state effort to censor people and theres two systems of justice or donald trump has been wrong. The general electorate does not feel that way, and the swing voters are really not interested in relitigating the 2020 election. They know what happened. Joe biden won the election. So bidens biggest vulnerability from a general election perspective is the economy. Thats where republican strategists want to be talking about. You can make the argument as economists are that Inflation Numbers have improved and things are rosier than they look like, but in their pocketbook, people feel the lungering costs of inflation. Its a what they want to be talking about for the next year, not donald trump. Its another reason democrats are sitting back because they are watching republicans who know thats their path back to the majority. Those people might have to vote on a biden impeachment buzz thats where mccarthys conference is headed. I w go a new poll. Im looking at these numbers and thinking, t beeve this is actually a thing we have to ask, but it is. Would you vote forrump in 2024 s convicted of a felony . Yes is 35 . T then look at another to 65 . Question about would you vote for trump if hes serving time in prison. Yes, 28 . No, 52 . Not sure, 20 . The nos are still significant here. You see the difference is in jail versus just charged. But people arent excited in the general election to be talking about this. Yes, the 22 midterms showed a lot of vulnerable republicans who do not want to talk about this, do not the to be at all close to what mccarthy is trying to tell a number of House Republicans to do because they saw in their own elections, we solved these win in states where economy was the bigger issue, where we didnt have candidates that were talking about lets relitigate the election. If that becomes the mantra in the party if trump does not stay away from that, if hes the nominee, its going to be very tough for republicans. Parental rights and the economy, its strong issues for republicans. Abortion and donald trump, not a winning recipe. We have to say this all the time. It is until its not, but it is very early. And yet in a national matchup of the mood of the country, its biden and trump even. What youre also seeing in the polls is that is the people who never want to vote for trump, they are saying, i guess ill vote for biden. But the lack of enthusiasm on the democratic side right now and they are just settling for biden because hes there and everyone decided that is who is going their nominee, that isnt getting people out to vote. Thats where it might people staying home, thats where the democrats are going to have a problem. Everybody standby. Special counsel jack smith wants to hold donald trump accountable for his actions in and around the 2020 election. Its Something Congress tried to do in 2021 after the in insurrection. House democrats and ten House Republicans voted to ill peach donald trump. The senate voted to acquit him. Only two of those ten republicans are still in office. They all faced really tough Reelection Odds after breaking with the former president. Republican fred upton of michigan was one of those ten. He decided to retire after being in the house since 1987. We are watching members of your party, who are still in congress and elsewhere, really fall in line behind the former president as he continues to face legal consequences for trying to overturn the election. What is your assessment of why your party is so loyal to donald trump . Trump has a real grip on the grass roots. Theres no question about that. He has a Lock Step Group of 30 to 35 . You see his numbers in the primary states where hes running away with it. I heard David Axelrod who said last week, why should they go for ron desantis when they can have the real thing. With donald trump not getting out of the race, the desantis folks are with trump. He has a big lead. If you look at the statements just this week since the likely and now the formal indictment of former President Trump, no one has walked away. Unlike that one State Senator in iowa, when trump diszed the governor and said im switching from trump to Somebody Else, nobody has walked away. So trump has a good majority of my former colleagues, even in the state of florida where you think desantis would have a strangle hold, but they are all sticking with him. For the speaker, he has this Freedom Caucus allowing one person to have a vote to call to vacate the chair, and if he walked off that line, guess what, trump makes a call and one of those guys is begingoing to youre out, and chances are could win. I want to play the remarks he made last night after the former president s arraignment. Youre entitled to raise a question. Youre entitled to question whether it was honest or not. Thats the uniqueness of the first amendment. Thats the uniqueness of america. But you know what . You shouldnt be prosecuted for your thoughts. What is your reaction to that . And also the dynamic that you just said persists in your party . Until 2021, we had the peaceful trab signatures of power. Without exception, the loser called to concede the winner, or maybe sent a letter before t telephones, but it was an orderly process formalized in the constitution until the 2020 election, which obviously january 6th was the ultimate day. And even i remember florida with the chads with al gore, but they all conceded. Some of them went to early courts. The Supreme Court made a ruling in 08 with bush beating gore, but gore conceded within a week, maybe ten days. So why is. Com county saying what hes saying then . Because you saw the president s remarks after the indictment yesterday. Hes angry. Youre still going to win the primary. And hes going to want to give himself a pardon. Hes all in. Guns are all blazing. Im sure that in his remarks to kevin, better stick up for me. And kevin is certainly playing that role and showed that anger last night. I mentioned earlier that you were one of ten republicans in the house who voted to impeach donald trump over his actions in and around january 6th. I want you to ponder this publicly, if you will. Imagine a world in which the senate vote d to convict him. And what that would mean for our body politic today. A couple things. They actually did vote, but they didnt have the twothirds vote to get a majority of the senate. What they needed to convict. They needed 67. I wonder i remember Mitch Mcconnells speech on the floor. I know a bunch of senators came from the house, many came from the committee i chaired, i think they would like to have a redo on that vote. In large degree, they said this really why are you voting to impeach him . Hes only in Office Another hes actually out of office when they had the vote to impeach or maybe just before the 20th. Why are you voting to impeach when it is over and biden is going to be sworn in. The senators said, let the criminal proceedings move forward, and thats exactly whats happening. I dont believe for a minute, and i heard the exchange before i went on about the new polling about trump, what would you do if trump was in jail before the election. Even if he was convicted, hes not going to jail before the election. Theres going to be appeals. Hes going to be out. He is not going to be in jail. I think youre probably right about that. And decidedly old school tactic, they are plastering signs all over the country, there are going to be hundreds of thousands of them on the projects being funded by the bipartisan Infrastructure Law and the inflation reduction act. These are going to be country wide with the administration hoping this not so subtle visual appeal to voters, as they are on their commute or long walks, that they will just take note of what these legislative achievements have done and it will move the needle more than the slight amount that the more overt messaging has. Its so interesting. The question is whether or not in areas where people are not thrilled about him, whether or not that could backfire. Yeah, definitely. I think that in talking to aids and advisers, they raised two potential issues. There are certain hearts and minds that are not movable. We saw this in a poll out yesterday. Democrats in this day and age are likely to say their financial situation is doing well. Three quarters of republicans say they are incredibly pessimistic about the economy. Joe bidens economic approval among democrats, 70 . Among gop, 5 . Theres an acknowledgment that thats not going to move. People are entrenched in their views. Theres also 15s months before the election. Theres still time for this to turn around. For the Forward Momentum to start sliding back ward, thats one of the reasons why you have a little bit of a Grain Of Salt that the administration is throwing in here. We have to just remind people that when you look at the economic indicators, i mentioned the jobs numbers. But more broadly, how people maybe should feel because its money if their pocket versus how much the gds cost. Think should feel better. A lot of people writing him off. But thats been the whole point of his campaign. Listen, if we put him in front of people, if we tell the story of him, his family, casey desantis, his wife, well likely see his favorabilities go up. But pulling back, trump is lower nationally than the iowa poll, but still predominantly leading. 24 points. If you add up all the other people that are not ron desantis, its 22. Hes still going hes still beating the entire field by double digits. That and he did lose the state. And we should say barely. Bear will to ted cruz. Iowans dont naturally flock to him, i think in the same way they do to other places. However, its still such a steep climb for anyone. And yes, desantis is doing better with College Educated voters. But hes going to have to do a lot more with a lot more people. I want to put up a tweet from Bob Vander Plats who is a veteran strategist, an evangelical in iowa who does not likeonald trump. He insists while all these polls show donald trump is the frontrunnering i see no evidence on the ound to support. My early hunch is he gets beat in an iowa caucus. Did good, cant win, time to move on, need to win. In fairness, hes not a neutral observer. Hes made his view on this known and clear. But i think it is ill do if thing that needs to be said, which is a poll is a snapshot in time. It is not predictive. You cannot look at the polls and say whos going to win iowa, whos going to win the gop nomination, whos going to win in november 2024. It is a snapshot in time. But i think for ron desantis, none of the data suggests that ron desantis is going to catch up to donald trump. Ron desantis path appears to be if donald trump implodes, if support for donald trump collapses. I think some of the other polling weve seen suggests that even among that very still strong support for him in the base, there are these kind of threshold issues, like now theres an indictment. Well see what impact that makes. Theres going to be a criminal Legal Process now.
