It does indicate the level of stress that hes been facing for months. Some in trumps circle were surprise by his unwillingness to pay giulianis bills, given he could find himself under pressure to cooperate with state and now federal prosecutors who have charged trump. Giuliani sat down voluntarily with jack smiths team this sumner two back to back sessions. Hes now a codefendant in the Election Interference Case in georgia. He is facing 13 criminal charges, like trump, and potentially serious prison time. Its not out of character for trump to not want to pay legal fees. This is something weve heard from many of his attorneys in the past, including his former attorney Michael Cohen. When i sat down with him last month. History repeats itself. One thing we know for certain is that donald does not pay legal fees. He doesnt pay fees at all. There is a pattern to what he does. He will pay a little bit. Fall behind. Pay a little more. What do you make when you hear that Rudy Giuliani is going to maralago, making this desperate plea, trying to get trump to pay for his legal fees and trump not really reciprocating on most of that. I think that trump is aware that during watergate, for example, the payment of legal fees got lawyers in a lot of trouble, as did joint defense agreements. The fact that hes not paying though is a pattern of this man as michael just said. He just doesnt like to pay his bills. He will get people to come after him to pay the fees. Michael had to go to court to get his fees paid. So theres no surprise here. And trump, i think, is willing to tough it out. He doesnt think rudy will flip. Thats a concern. The Michael Cohen effect. People have said that cohen has changed his tactics there because of a concern of it turning into a Michael Cohen situation. I doubt that rudy will. He knows the Inner Workings of the system better than most of the u. S. Attorneys from the Southern District of new york. He knows particularly the rico law. He will try to poke holes. He will think he can prevail. Certainly at the motion stage, the early stage of this proceeding, is not likely to flip. It is only if the government of georgia can overwhelm him and he realizes hes going down and maybe he can save himself some years by cracking a deal. I sat down with bill barr, trumps former Attorney General, of course, as you know, the other week. And he had this to say about what he has seen he said happened to people in trumps orbit. He leaves in his wake ruined lives like this, the people who went up to capitol hill, these individuals, many of the people who served in the government that got sucked into things. He just leaves all this carnage in his wake. Do you think he cares . No. He doesnt care. Loyalty is a oneway street for him. Do you think Rudy Giuliani winds up as more carnage here if he hasnt already in some peoples view . I think he will. I think hes in deep trouble. The governments case looks overwhelming. His federal issues have that been resolved. Trump could not pardon him in georgia, if indeed he is convicted in georgia. I dont think trump will make it back to the white house. I think people are starting to get a glimmer of what that could be and they dont want it. Maybe more republicans will do that before the primary vote. I dont know. Theyre slow learners, apparently. So i think rudy will get destroyed by this. Its sad but true. Yeah. If he is as out of money as his attorney was arguing in court today that he is, the entire reason his attorney was in court was arguing that he could not pay part of what he is being ordered to pay as part of the lawsuit. What does dough in that situation . Does he represent himself . What options does Rudy Giuliani have at that point . Well, he can get a courtappointed lawyer. Representing yourself is the worst option. Anyone who represents himself is likely to make bad decisions about that representation. I think rudy is likely to go into chapter 11, a bankruptcy of some sort. I understand his apartment is on the market. It could raise several million dollars. He probably has a lot of debt he has to handle immediately as well. So i think bankruptcy is a potential. And maybe a courtappointed attorney. That would be kind of remarkable in the worst way, as someone who was once known as managers mayor. The role that he had after 9 11 is then potentially, as you predict could happen, being represented by a courtappointed attorney and filing bankruptcy to cover his legal fees. It has a shakespearean element about it. I dont really think of shakespeare when i look at rudy and some of the news clips of him recently. It has that kind of tragic tale that is being told in front of us. So well have to watch. No one wishes him ill. Hes gotten himself where he is. What do you make of what we saw in georgia overall . The District Attorney saying she wants to have a march trial date. Shes asking for March 4th Of A Trial date. Whether or not that happens remains to be seen. Does that seem realistic given the nature of this case, how complex it is . Begin that there are 19 codefendants here . I think what will slow down the georgia case, others will file the kind of motion that mark meld owes has filed to remove it to federal court. While the State Proceedings will continue, it will bogg things down a bit. I dont really believe with my talk with lawyers who have really studied this body of law, that they will remove it to federal court. If they do, its still the same georgia prosecutors. And the calendar could be even clearer at the federal level. I dont know. It is a different jury pool. Broader, wider. That is what is likely to slow it down. So you dont think that theyre likely going to be able to get it moved from a State Proceeding as mark meadows is doing, but were told by sources that trump is also likely to do. You dont think thats likely . I dont. Its hard to envision this as official behavior of any of the people. When you read that indictment, you read what is being included. Mark meadows was not just setting up meetings. He was not arranging telephone calls. Thats done by secretaries, staffers, white house operators. He is in the thick of this. And as the indictment brings out, it is much different than his motion. So i dont think theyll prevail. And many of them dont even have federal standing to remove. Those who are the fake electors, for example. And its just limited to those who were in federal office when these events happened. Yeah. And to bring this full circle, Rudy Giuliani has said, he is going to potentially make that argument though. He obviously did not work for the federal government. Well see what the courts decide. What is the Search Operation like on the ground right now . The Search Efforts have increased multiple time over. It went from 20 search canines to 40, coming from 15 different states. That shows you the aloha and the effort that our nation is taking in getting maui what they need. You said onethird of the area is searched. The death toll will go up. More bodies will be found and well start to get closure to those who need it and identify who is missing. There are centers with Civilian Lists and dan being collected to help make the match and help people find those who are still missing. The last time you and i talked, you estimated about 1,000 people were missing. Where does that number stand tonight . That hasnt changed. Theyre still estimating many, many people to be found. With the teams increasing, both with the National Guard and fema and first responders, firefighters are now able to leave the fires. There are still fires burning in hot spots. Now they can assist the others in the area affected. Thats great. And with that effort, theyll start going into buildings. The numbers will go up a lot. I was able the talk to a Search And Rescue team member from the hawaii National Guard. He let me know the first thing they do, they walk through the area. The first thing they do is they listen for anybody who might be making a noise. Thats heartwrenching. On that team is searchers, and fatality Search And Rescue personnel. When they do find a body, you know, with compassion and care and time, they take that body and get it back to where it can be identified. It is taking a long time for the search to discover and recover the remains. We ask for patience during this time. You mentioned when the search team goes in, they listen for sounds. Are they hearing anything . No. Sadly, theyre not. Thats part of the process. The steps that they take. Theres hope but thats one of the steps they do. Then they go back with a finetooth comb and go over the area multiple times. Its sad but theyre Getting Better at their job. The motivation is the families. And this is a communitybased organization. These are guardsmen who are from the area. This is their community. Theyre used to cleaning up debris. Maybe protecting people from going down certain roads because of lava or floods. This is brand new. This is not what their normal jobs are. What other experts have been brought in . The governor last night was comparing this to the aftermath of a war zone. He said it looked like ground zero after 9 11. Different situations. He was saying that is the kind of expertise theyre needing people to come in and help identify people. Yeah. Theyre bringing in complete teams. Fema, its over 400 personnel on the ground assisting. Not just the people of maui but assisting in the process of identifying, bringing in experts from Around The World to the Little Island of maui. And with their expertise, it is actually helping the process. On top of that, you have grief counsellors, chaplains, you have community outreach. You still have people who may be on the mainland, Around The World, or somewhere other than maui. And theyre the ones missing people. And it is really hard to connect to those personnel to the ones on maui. It is not just maui people missing maui people. There might be International People missing. Family, friends. And theyre finding challenges as well. So it is a very wellrounded situation. Were trying to help maui get a handle on that. Tuberville told me hes not lifting his hold until they do. Where does this leave the military . It leaves night very precarious position. We have key leaders that are not in place. And very sensitive areas. I just returned from germany. There we have coordinating all of our activities for ukraine. And the nominee for Deputy Commander of that organization is not in place. And the commander cant assume all the responsibilities. An incredible job. We have the commander of our pacific fleet. We have the marine Corps Commander of japan. This is also an effect that sort of cascades downward. It sends signals to very promising young officers, colonels, lieutenant colonels, that theyre just political pawns and it is very, very destructive. And it is also very destructive and disruptive for the families. You said earlier this week that Republican Leadership, because of the effects you just talked about, Military Readiness but also on the families, that Republican Leadership neeps to tell tuberville in public what theyre saying in private. What are they saying in private . I think in private they recognize the detriment and the need to move quickly. But that is all very nice. They have to come out very publicly on the floor and say, this is an issue about the readiness of the United States and the professionalism of our military forces, and we have to move and confirm these offices. Otherwise it is worse and worse and worse for them and their family. The family issue cannot be ignored. Weve spoken with several of those families. It affects whether or not they can move, whether or not military spouses can start new jobs, getting their kids in schools that the senate is on a fiveweek recess. Senator schumer does set the schedule and technically, some of these nominations could move individually. And i understand what tuberville is doing is unprecedented. Usually theyre all done together. Couldnt democrats force a vote on some of these stalled nominees alone . Well, if we had to vote on all these nominees, weve asked them, they estimated it would take about 30 days if we were working seven days a week and 24 hours a day to get these nominations through. That means we cant do the supplemental appropriations for ukraine which is critical to the success of the ukrainians, and for our and natos success. We couldnt talk about the day of continuing resolution to keep it open. If we pick and choose one or two, what about the rest of those men and women . Theyll be left behind. One of the thing about being in the military is you dont leave people behind. We have to get this done. Unless there is an objection based on facts to a nominee, these nominees will move forward. And thats what we have to do. And it is the republicans who will have to stand up on the floor of the senate and say, this is wrong. We must go ahead and confirm these officers so their own satisfaction, their own reward for service, and for the safety of the nation. What happens if they dont . Well, i think theyre shirking their responsibility, frankly. We have been on the floor constantly asking to pursue these nominations. To talk about these nominations. You get some indications, i think senator mcconnell says initially that oh, he doesnt support this. But thats a lot different than going in and saying, were going to get this done. I think if they did that, that would send a signal that there are other ways to protest his objections for d. O. D. Policy and theyre more appropriate than this. This is seriously harming our national security. We have to stand together both as republicans and democrats. More importantly, as americans who value and respect the service of our men and women in uniform.
