Now her declined to charge President Biden for his handling of classified documents, but of course, he caused a huge stir when he cited the president s memory as one reason he did not charge this morning. In his Opening Statement, her will reportedly testify, quote, my task was to determine whether the president retained or disclosed National Defense information will lawfully meaning, knowingly and with the intent to do something the law forbids. I could not make that determination without assessing the president s state of mind. For that reason, i had to consider the president s memory and overall mental state. Again. The Opening Statement robert hurt will deliver very shortly on capitol hill. Cnns lauren fox in washington. I have to say, if he wanted to take down some of the drama, im not sure this Opening Statement will do that. Lauren yeah, absolutely. What he is preparing for here is a slew of democrats on the committee who believe that talking about the president s age in this report was gratuitous, but he is defending this, saying that he couldnt very well say the president shouldnt be prosecuted without providing a detailed explanation as to why, in his Opening Statement again obtained by politico, he said, quote, i needed to show my work. I knew that for my decision to be credible, i could not simply announce that i recommended no criminal charges and leave it at that. I needed to explain why the evidence, and the president himself put his memory squarely at issue. He goes on to say, we interviewed the president and asked him about his recorded statement. I just found all the classified stuff downstairs. He told us he didnt remember saying that to his ghostwriter. He also said he didnt remember finding any classified material in his home after his vice presidency, and he didnt remember anything about how classified documents about afghanistan made their way into his garage. My assessment in the report about the relevance of the president s memory was necessary and accurate and fair. Now, i talked to a number of democrats yesterday going into this high stakes hearing who said that they hoped that this issue of the president s age would not be front and center. Reading that Opening Statement, i think its clear that that is going to be a key cornerstone of this testimony this morning. And we should just note that this comes as democrats were feeling very good about the president s memory, feeling very good about the Public Perception of the president s Energy Levels after that State Of The Union Speech Last week. I think democrats were hoping to turn the page. Obviously today theyre going to be going back in time a bit in a couple other data points here that are important. We learned overnight that robert here is no longer with the Justice Department. He testifies today as a private citizen, and he has retained the counsel of william berke, who has represented several prominent figures in trump world in the past, something democrats may lean into today. There were no charges there. But again, sarah, this is a white house that has taken issue with the report from the beginning. This they pushed back on the substance of this report, even though there were no charges in the present. And, you know, you brought up georgia, kate, that is a state where both trump and biden were over the weekend. I think that just underscores the importance that both men see georgia. As for, you know, as they look ahead to november. And also, you know, georgia, as you mentioned, is a place where donald trump is facing a series of criminal charges and that does relate to what he posted on truth social last night. We know that donald trump has repeatedly called for the release or for president joe biden, i should say, to release the defendants who were convicted for their role in january 6th. But hes also facing his own charges, both in georgia and at the federal level for his role that day. And so, you know, hes made these comments before. Hes used this rhetoric on the campaign trail. But i also think him vowing to release them on social media last night as some of the farthest language weve seen from the former president related to this. And i do just want to point out what we saw a former congresswoman, liz cheney, one of the people who was key on that jan Six Committee in the house, what she said in response to this, she said, quote, if your response to trumps assault on our democracy is to lie and cover up what he did, attack the brave men and women who came forward with the truth and defend the criminals who violently assaulted the capitol. You need to rethink whose side youre on. Hint its not america, so im sure were going to see other comments like this from people who are, of course, had a role on that committee who are dismayed by Donald Trumps actions and his continued rhetoric, and embracing some of these defendants. And i also think, you know, he can repeatedly refers to those convicted for their role on january 6th as hostages, something weve also seen the white house very strongly criticized donald trump for. Yeah. Can i also lets also talk about the rnc and whats going on there. Right now. Alaina, Donald Trumps team takes over. Thats not necessarily a surprise, but then the shakeup thats happening amongst the staff, politico is now describing it as less a shakeup, more a bloodbath. Whats happening . I mean, it is its a bloodbath. Theres wide layoffs and they really go farther, i think, than many people at the rnc were expected. Were told that they announced many of these layoffs yesterday in an internal email. And again, you pointed out, kate, and youre totally right, that yes, when there is a new team that comes in new leadership with a new nominee or a candidate that isnt, you know, totally out of the norm, neither are layoffs. But i think the depth of these just underscore how much the new leadership wants to overhaul the committee. And i did speak. I was in houston last week while they had these elections where the new chairman, michael whatley, and lara trump, became the cochair. And i spoke with many of the staffers there as well, and they told me that they were expecting some layoffs. But again, i dont think they were expecting the depth of some of these cuts. Were told that they affect departments ranging from communications to the data team to the political team, and theyre not just senior staffers that are being laid off, but also vendors and also having their Vendor Contracts be revoked. And so wide changes here, and we did hear from one person in this internal email, Sean Cairncross, hes someone that chris lacivita, one of Donald Trumps senior advisors, who is now going to be have a new role at the rnc as well as chief operating officer. He brought in Sean Cairncross as his number two. This is what sean wrote in that internal email. He said, quote, Chairman Whatley is in the process of evaluating the organization and staff to ensure the building is aligned with his vision of how to win in november. So, kate, i do think this is a bit of a preview of what we can expect from the new leadership at the rnc to be really overhauling the committee, wanting to change things and really align themselves with the former president s campaign. Im also told that the Trump Campaign wants to really have the rnc be an extension of them. They want it to operate as one and the same. And so i think well see a lot more of some of these changes and what the rnc is doing to really, you know, help donald trump and boost him in any way that they can ahead of november. Patrick, as you look at this, is there some sense of timing as to when henry may actually step down because there havent been you know, there havent been votes cast in that country for a very long time, which is why people have been out protesting. Absolutely. And henry himself was never elected. We should point out he came into power after the assassination of the former president. So, you know, while this is a result of the Mounting Pressure on henry, both inside of haiti, as you mentioned, sara, and from outside of haiti, you know, the United States pushing to take this step, no clear sense of timing. Listen, this is being made up as as the International Community goes along here. I think its a fair to say. But first you have to have this Transitional Council named, and then they would pick a new Prime Minister and with all the politics involved in haiti, violent politics, we should point out its going to be tough doing negotiating. Who is on this Transitional Council already . The us is saying that certain figures in haiti were involved in drug trafficking, criminality will not be included, even though these people were obviously making a case that they want to be very much involved in Power Sharing in haiti. But lets go back to what ariel henry said about why he finally is been forced to announce his resignation, something he resisted for so long. He said, we see assassinations, attacks against the government, systematic looting, all these people who are dying. The government that i lead cannot remain insensitive to the situation. Im asking all haitians to remain calm and do everything they can so that peace returns. You know, its very hard to imagine peace returning with the police, completely overwhelmed by the gangs who simply outnumbered and outgunned them. And so this haitian, this Kenyan Security force that the us is now paying a staggering 300 million for, for 1000 soldiers, you know, that breaks down to about 300,000 per soldier. We are waiting to see when they will arrive, how they can arrive. If the airport has been shut down, and then what 1000 soldiers can really do in a country that is not theirs, that has become so riven by violence. But you know, sarah, at this point, were talking about hundreds of thousands of haitians who have been displaced, and they can wait no longer for help to arrive. Patrick oppmann, thank you for that report. Really important story, kate. Yeah, its like living through a terrifying movie scene. That is how passengers are describing the moments on board a flight from australia to new zealand, when the airline says the plane encountered a technical event, one which sent people flying through the cabin banging up against the ceiling, injuring at least 50 people. Now one passenger is now talking to cnn and telling cnn that the pilot came back into the cabin and said he lost control of the plane. He openly admitted, he said, i lost control of the plane. My gauges just kind of went blank on me. And thats when the plane just took a dive. Other passengers described feeling a massive jolt before the plane suddenly dropped, throwing some passengers out of their seats. There was a two and a half year old sleeping on the seat next to us. On the other side. He went up in the air and landed on the ground, but his mother was nursing a one year old so she couldnt control both. You know, when you are in a Roller Coaster and you just go like this, thats sensation. And then everything flew up. It went down and it was like very shocking. Very shocking. Yeah. In front of my girlfriend, she was pretty much on the roof of the cabin, the girl next to me hit her head on the cabin. Today in new zealand, the investigation into exactly what happened continues, and theyre still working to retrieve the black boxes. Joining us now to talk more about this is cnn transportation analyst, the former Inspector General with the department of transportation, mary schiavo. Mary, thank you for coming on. So the airline lets walk through this a bit. Some of the more some of the new details were getting, the airline is calling it a technical event. This passenger that we just heard, speaking to cnns erin burnett, says that the pilot reported to him, his gauges went blank. Then the plane took a dive. And then the pilot told the these passengers that briefly after the dive, the gauges came back on and everything went back to normal. What kind of malfunction could this sound like to you . Well, it sounds like what the pilot described a technical malfunction. Now, ordinarily, when Something Like this happens in flight, particularly over a, you know, an ocean, they say its clear Air Turbulence or turbulence that isnt visible on the weather radar. And usually thats what this gets blamed on. But by saying it was a technical event and the instruments briefly went blank and that he lost control of the plane, three huge clues here that does suggest there was something wrong with the plane and what that could be is, is obviously the mystery, but this should be a major investigation, particularly since its a very, you know, its a new plane, a 787. And i searched the databases. I went back through whats called airworthiness directives, where boeing has to put out warnings about its aircraft. And there was one way back in 2015, 2016 where if they left a 787 powered continuously, this is unlikely, but powered continuously for 248 days that the instruments that the that the power could go blank to all the instruments and it would have to reset. So thats the closest thing that i can find. But it does sound like a technical event with the plane. How much danger do you think this flight and these passengers were in this . They were in grave danger. And the pilot said it best himself or herself. The pilot said, i briefly lost control of the plane whenever that happens, thats what i call an upset event, meaning youre flying along in a, you know, an aircraft and no one is really able to control it. That is a very big deal. Its a huge issue. The plane could have been lost. In fact, thats really what that means. And when weve lost control of the plane, the plane itself could have been lost. Its an upset event. And i think it will get a major investigation. Yeah. And the fact that at least has the pilots telling through this passenger is that the gauges go blank and then just came back on the fact that it was kind of just left up to if the gauges were going to come back on. That seems absolutely terrifying. Let me ask you also, in a separate situation with, with with the airline industry, the faa recently audited the production of boeing 737 max jets. After that door plug incident. Weve talked so much about and the faa administrator says that they found through this audit, production, plant hygiene issues, what they described as that like issues that are key to producing a quality airplane in the New York Times adds to this that the company failed 33 of the 89 audits during that faa review. And heres boeing, boeings response to the report, in part, we continue to implement immediate changes and develop a comprehensive action plan to strengthen safety and quality and build the confidence of our customers and their passengers. Mary, can you add this all up for me, if you will . What do you make of this . Now, this is a Quality Control crisis for boeing. You know, its really inexcusable that the faa has waited for, you know, problem and disaster and, you know, in accident after accident to go in and do these audits. Now they have the power to do these audits all the time. You know, my old office, when i was Inspector General, we did these kinds of audits. But to make this kind of a finding, these many problems and these many failures, i mean, you know, they failed about half of their audits, is really troubling for boeing because, remember, theyre supposed to follow their own procedures. You know, however you assemble your aircraft, theres a, you know, there are all kinds of approved procedures and you must do it that way every time. You cannot freelance. And a lot of what they found is theyre just freelancing. I think one of the investigations was that they were using a Hotel Door Card and dawn dish soap instead of the procedures. His name is brian butler, and he is explaining to cnn how he unknowingly, he says, helped move boxes out of those classified documents from maralago. At the same time the fbi was talking to donald trump. Here he is in an interview with our caitlin collins. Did the two of you ever talk about moving boxes or looking back on that . Yeah. I mean, there was one time towards one of the last times i was with him and were talking about, you know, boxes and you know, well, biden did the same thing. You know, you cant get it always got brought up about biden and other people that did the same thing. And then there was one time he said, you know, were all dirty. We all move boxes. And i said, well, look, i didnt even know what i was moving until i was at the plane. And thats when i remember moving boxes. Cnns Katelyn Polantz helped break this exclusive reporting, wow. This is a Treasure Trove for prosecutors. What more did you learn . Well, sara, brian butler, in speaking publicly and also where he is described in the indictment from the Justice Department against donald trump as trump employee number five, he is providing a window into this alleged Obstruction Conspiracy Led by donald trump and also allegedly perpetrated by his body man walt nada and another man working at mar a lago, Carlos De Oliveira, a longtime Valet Property Manager who also happened to be brian butlers best friend for 20 years, his next door neighbor and someone who was speaking to butler regularly. Those conversations are represented in the indictment, and butler now is able to articulate not just for prosecutors, not just potentially at a trial against the former president , but publicly as well, about what those conversations looked like, where Carlos De Oliveira was relaying to him how walt nada may have been wanting to come down to mar a lago to learn more about the Surveillance Tapes at the property, and also a few other things. We also know from brian butler that in his conversations with Carlos De Oliveira in these nightly walks that they were taking in the course of this fbi investigation, he was getting a message that if he wanted to have a lawyer paid for by donald trump, if he wanted tickets to a golf tournament, if he wanted to go back to work at mar a lago after he had left that job, after 20 years, he could heres a little bit more of what brian butler had to say about one of those conversations he had with Carlos De Oliveira and was witness to traveling with carlos for his 40th birthday at a casino. They were just hanging out for the weekend. And heres what happened. You know, he takes the call. Were standing in the food court. I think we went to sit down and he i cant remember how long the conversation was, but i know at the end of the conversation, when they hung up, carlos said, hes going to get me an attorney. Did he tell you Anything Else that trump said to him . I didnt ask, and i dont remember him saying Anything Else. But, you know, i was just told not that long, not, you know, too long before were getting him an attorney by walt, and then he gets the call that hes going to get him the attorney. So thats august 2022. Brian butler witnessing Carlos De Oliveira getting a direct offer from donald trump on a phone call to get him an attorney to keep him in the fold, keep him loyal. Brian butler, of course, did not use an attorney that could be provided from the trump world. He has his own attorney that he retained separately. Sara. He also made clear that this is not a witch hunt in his view. From all that he knows, this will be really interesting and a great get. So House Republicans are now accusing the january 6th Congressional Committee of withholding witness transcripts, witnesses that republicans say undercut Cassidy Hutchinsons testimony about Donald Trumps actions on the day of the insurrection. Some of those transcripts include testimony from the driver of trumps suv on january 6th, and also some Trump White House officials ever since the Trump White House aide Turned Whistleblowers testimony in 2022, republicans have tried to question her credibility. This new report says this in part none of the white house employees corroborated hutchinsons sensational story about President Trump lunging for the Steering Wheel of the beast. She was recounting what she heard from someone else. Cnns Marshall Cohen joins me right now for more on this. Marcia, youve been looking through this report. What else are republicans trying to say here . Hey, kate, this is the investigation of the investigation. Fashion House Republicans releasing this report yesterday to try to undermine and undercut the findings of the january sixth committee. So what they zeroed in on was this explosive story that you just described. End of donald trump lunging, allegedly lunging in his president ial limo right after his speech on january 6th, where he was demanding to go to the capitol. That has been at the center of a serious dispute ever since. Cassidy hutchinson described it under oath. And i want to be clear that she said that she didnt witness it, but she heard about it. Thats what she told the committee. So according to this republican report, the committee actually interviewed the driver of the president ial suv. But theres a real distinction between the way that the committee described it in their final report and the actual transcript of what this guy said, according to the way that the republicans spelled it out. So look at this, kate, on the top here. This is from the january 6th committee. Two years ago, they said that the driver testified that he did not recall seeing what President Trump was doing and did not recall whether there was movement, any Movement Towards the front of the vehicle to try to overpower either the Secret Service agents. Thats how the committee described it. But this on the bottom is actually a quote from the transcript itself as surfaced yesterday in this republican report. They said that the driver said that trump, quote, never grabbed the Steering Wheel and that i didnt see him, you know, lunge to try to get to the front seat at all. An unequivocal denial from the driver. Republicans are accusing the committee of basically cherry picking the evidence to portray trump in the worst way possible. But i want to point out, kate, that Cassidy Hutchinsons team insists that she always told the truth. And other parts of the testimony in this republican report corroborate what she said, that donald trump was irate that he could not go to the capitol that day. Marshall cohen, great to see you. Former Special Counsel robert her is about to testify on capitol hill about his classified documents investigation, where he decided not to bring charges against President Biden. We just obtained the Opening Statement. He says, quote, my task was to determine whether the president retained or disclosed National Defense information willfully, meaning knowingly and with the intent to do something. The law forbids. I could not make that determination without assessing the president s state of mind. For that reason, i had to consider the president s memory and overall mental state with me. Now, cnn political analyst natasha alford, host of Thegrio Weekly and author of the new book American Negra and founder of principle and blue streak strategies. Maura gillespie, who served as president as John Boehners Press Adviser when he was house speaker. We just got this Opening Statement which robert hoar, who, by the way, is no longer a Special Counsel, no longer works for the Justice Department. He is a private citizen. What he is about to tell members of congress, its just over four pages long, nearly two pages of it deals with what he considers to be the president s memory issues. Maura, what . How do you think this will go down this morning . Its really interesting, given the fact that he did resign last night. I think that does throw things into question. And people are questioning his credibility in that regard because hes not under the same protections as he would have been coming in as a private citizen. That being said, it is interesting he did spend so much time on the president s memory in defending himself. Essentially from the backlash he received. But but he received backlash from both sides of the aisle. You know, republicans were angry that he didnt go far enough that he found him to have done no wrongdoing. And democrats are upset that he was called out to have a poor memory of being an older man. I mean, the fact that he is older is just fact. He had an ad out yesterday that talked about it. He is not young, so i dont know that its necessarily in the democrats best interest to be so up in arms about the, you know, report by robert herb, but itll be interesting to see how he defends himself today. You know, there was a report in the wall street journal, natasha, that he wanted to take down the temperature. Her wanted to go to capitol hill, take down the temperature surrounding this today. Not so sure. Not so sure thats going to happen here. Im not surprised. I mean, i think thats what happens when people call you out, right . There are a lot of people who felt like that. Testimony about bidens age was unnecessary, that he didnt have the credentials to make that assessment. And i think in the wake of the State Of The Union, you know, where President Biden delivered a really Strong Performance by many measures was passionate, energetic, he was able to counter some of that narrative that his testimony is being used to support. So democrats, itll be an interesting moment whether they want to, you know, continue to sort of spark this defensiveness out of her or just let the State Of The Union speak for itself. What do you think they will do . It is interesting because again, her did leave the Justice Department. He is testifying as a private citizen and so thats me raising an eyebrow there. A lot of people are raising eyebrows about that. He also has obtained the counsel of william burke, who has represented several people in trump world before. For do you think democrats will or should, you know, go after him like he is a partizan here . I think you have to be careful with that. Right . Because again, you can point to the fact that he was a registered republican, you know, use that to undermine his his neutrality in this moment. But it could also cause him to potentially release more information about President Biden or draw attention to parts of the report that maybe havent gotten as much conversation in the public. So any time you put someone on the defensive, i think you have to be ready for whatever comes with that. So again, fine line here in terms of how much they want to attack him. You can bet that democrats will ask her as many questions as they can about Donald Trumps handling of classified documents. And the difference between the biden and the trump case is interesting. And again, this is the Opening Statement four pages in a paragraph long, two pages deal with President Bidens memory. Theres one tiny, teeny tiny paragraph here where he brings up donald trump in the Opening Statement, and he says, i took the same approach when i compared evidence regarding President Biden to the departments allegations against former President Trump thereto. I called it like i saw it. So hes not mounting a huge defense in the Opening Statement, at least about why he did not charge President Biden and the comparison to donald trump. And i think itll kind of to natashas point, itll be interesting to see how the democrats play it, because do they really want to push on the fact, given the fact that trump was found to have done wrongdoing and biden wasnt . So how much do they really want to push this man who said, you know, and democrats have called him, you know, thoughtful and thorough in his reporting and that he is diligent and so in the past said good things about robert. Her so its, you know, just because now they dont like it that he called biden an old man. Is it really a reason to go after him in a way that could backfire on the president . Voters in three states are heading to the polls for primaries in an Election Year where Abortion Rights are front and center. One new survey finds it is the most important issue for 1 in 8 voters. Julie burkhart has fought for reproductive rights for decades. She opened the only clinic that provides abortions in wyoming, just after the state banned them in may of 2022, while contractors were still working on the clinic, Someone Set Fire to the building, but she kept going. After repairs, she opened that clinic, and she and other Abortion Rights advocates sued to overturn wyomings abortion ban. Her clinic stays open because of an injunction that is in place now from a judge. She is joining us now. Julie, thank you so much for talking to me this morning. You know, we hear about the fire. There have been protests. There is now there is a you are now in the midst of a lawsuit. Why was it so important for you to open a place where people can obtain abortions in a state that has effectively banned them, except for your lawsuit that has put that on hold . Well, sarah, its really nice to be here this morning, so thank you. Wyoming presented an opportunity for us, looking at the state of wyoming, in advance of 2022, the laws in wyoming, were very favorable to Abortion Rights. And in looking at that state, there was low access. And so we felt that it was a really Good Opportunity to come in and put in both a procedural and medication Abortion Clinic for wyomingites, but also knowing that we were probably going to have dobbs as we did, and that other states in the in the area would also ban abortion and we wanted to be able to serve those people as well. Can you give us some sense of whos coming through your doors, what those cases look like and what theyre saying to you . Oh, absolutely. So we are seeing people from wyoming, but we have also served people from numerous other states, in the nation, we are seeing people who about 75 of our Patient Population needs funding. And so people are struggling to make ends meet, to not only pay for their health care, but also to pay for their travel, their lodging, their meals. And these are also people who have children, about 60 to 70 of our patients already have children. And so theyre trying to juggle navigating far, far distances in order to obtain Abortion Care while also taking care of their families. Well, youre also hearing from residents who are telling you theyre prolife. What are what are they saying to you . What are people talking to you about . Even being that this clinic has already been basically attacked. Well, we do have our fair share of, outspoken protesters in casper, where our clinic is located. And also, as you know, we dont have a favorable legislature and i count these people in the Minority Party in terms of who in wyoming, really supports Reproductive Health and bodily autonomy, we have received, sometimes its quiet support, but we have, you know, been receiving support from within the community. But the people who are opposing and who do oppose Abortion Rights are incredibly outspoken and loud. So youre in the midst of this legal battle. The clinic is still open because of an injunction. Then what happens if the courts go against you . Well, if the court rules against us in, this is instance in this case, and were waiting right now on Summary Judgment to come down, you know, well go back to the Drawing Table and look at our options, you know, there may be an appeal to the state supreme court, but we havent made any solid or any final decisions. I will say that we also were faced with a trap bill this session, which is target regulations against Abortion Providers and its a bill targeted specifically at us, which would put us out of business. And were waiting on the governor to either sign that veto it, or let it go into effect without his signature, and so thats something that we might have to contend with in the next week or two. Im just curious quickly, when you say contend with, i mean, are you talking about the possibility of going to jail . I mean, what are the stakes . Oh, no, were talking about the possibility of further legal action. Okay, all right. Julie burkhart, it is definitely. Thank you. Thank you.
