Keep in mind the indices are still where they were about a year ago. Some of the smaller indices, transports where where they were 20 months ago. Were coming back to the upper ranges here. I think this is somewhat normal. Keep in mind, the big guy is going to happen real soon. Interest rates are coming down. The fed will lower rates. We have ten years of history when we get easier money, the market likes it, and i think thats a part of whats going on. As far as chinchina, i think th easy money is a catalyst to make it good news. Even though theres no new news because we have been hearing the same for 15 months. Yes, were going to have china trade talks, boy, the market loves that, but behind that, we are look agent a acte acquiescent fed. The consumer continues to do very well. The jobs report out of adp this morning was very promising. I think we all need to sort of take stock here. Our companies that have struggled very difficult job market to hire people, are they really going to step back from hiring because of a month or two of a slowdown on their order books . I dont think so. I think the jobs outlook continues very strong and that means good wages and good consumer sentiment. Gary you did mention falling within the range, which is true. You are seeing low liquidity which is adding to a lot of volatility. We saw some huge swings in august. I think the markets right now at this point have heavily baked in some cuts from the ecb as well as fed. Given that overly optimistic point of view, i wonder what could happen if that the cuts arent as large or dont go as prolonged as expected. I think overall this is a familiar play book. You will see it go up and see it go down the moment we hear anything about stalled talks. See it go up again. Look, i think theres positive and negative. I think the negative to build in on lizs point, look, it boils down to one thing, it is the u. S. Consumer versus the rest of the world. The rest of the world is slowing down. Our economy other than the u. S. Consumer, which everyone says is 75 [inaudible] is slowing down, but heres the other thing i disagree with gary k on one thing, we are not within a trading range. The trading range was about 26400. We opened above that. We have been moving sideways ever since that selloff of about whatever it was a month or so ago. Were above that sideways movement. We could easily head back to old highs. It really boils down to do you think the u. S. Consumer can trump Everything Else . I am skeptical at this point, but i look at the chart, and i see its pretty positive. David all right. I will make two points on. That first of all, consumers wouldnt be able to consume anything if they didnt have a job. It is really investment yes, i know the numbers make it look as though the consumer is more important. But they are not. It is the producers who are more important in an american economy. Thats point number one. Point number two, the markets keep going up. Yes, they keep falling because theres a lot of bad trade news out there and it is affecting the world economy, but the slightest bit of good news, i mean last week we just had a hint of some good news coming from china, and the markets were back up. What that tells me is markets want to go up from here. And they want to go up significantly, and i think they will. Go ahead. I dont know about significantly, but let me just say this, and im going to give you a market positive potentially. There is a ton of cash on the side lines. David absolutely. And theres a ton of bearishness. For the last few weeks, all were hearing about is recessions and depressions. The Mainstream Media for 24 7, the world was ending, it gets a lot of cash built up. And if markets start to move up, people try to catch up and thats where money comes off the side lines. Especially in the big funds that have a lot of that cash ready. I think thats totally true, gary. And i think the most important thing is people need a place to invest. Where else are you going to go right now . Thats the story we have been talking about for a long time. But it is really true. If you had ambitions to fulfill, the only place you can put money right now is the stock market. David a lot of foreign money coming in. We have some breaking news we need to jump in here. We are getting new developments on federal Housing Finance reform plans. Charlie gasparino has been following this for days now. We knew the report is coming. It is out. Charlie . A Long National nightmare is over. David lets hope. Fannie mae and freddie mac, allowed banks to make 30 year mortgages to individuals, they have been in government control since the 2008 financial crisis. Today the Treasury Department put out a report basically calling for that government control to end. Now, devil in the details here. You need to read this over to figure out exactly what they want. But the treasury is saying this we want fannie and freddie to no longer be in conservatorship, meaning wards of the government, we want them to set them on a path where they are once again totally private companies or private companies with at least some back up by the federal government, so they can continue doing what they do, which is essentially buying mortgages from banks, and when they buy those mortgages from banks, guess what, they put them into Mortgage Backed securities, they sell them but that allows the banks to make more mortgages in the 30 year variety. Theres a Public Policy by this government and many and predecessors that 30 year mortgages are a good thing. So they want a plan where its no longer the taxpayers are totally on the hook. What they are essentially saying in this plan we want the taxpayers to be a little bit on the hook, but we want them to be privatized. We also want them to retain capital. We want them maybe to issue stock in the future. It is a pretty big deal. I will say this, though, as you know and as most people know, fannie and freddie the excesses of fannie and freddie is one of the reasons we had a mortgage crisis back in the day. This plan takes a few steps towards making sure that that doesnt happen again, where these and to these blow up where the government has to take them over because by the way they were created by congress. If the government didnt take them over, given the fact that their debt is considered to treasury debt. People might have started selling our Treasury Bonds during a financial crisis. You dont want that. This takes a couple steps to ensuring that maybe fannie and freddie have enough wherewithal to withstand a financial crisis like 2008 through the building of capital. But theres a lot of details here. This is a political situation, david, because as you know, housing is a big thing. We have an election coming up. You dont want to do anything to the Housing Market that will hurt Housing Price or increase costs to consumers. The Treasury Department is walking a fine line. Some interesting things here i pulled out. I have been talking about fannie and freddie doing a stock deal at some point, that will be a huge stock deal for wall street. They talk about possibly taking fannie and freddie out of conservatorship and putting them into something called receivership. David whats the difference . Conservatorship you are kind of owned by the federal government. Receiveship is a legal place you go to prevent you going into bankruptcy while you sort out your affairs. It is an interesting legal concept. Charlie yeah, let me make this before i get to questions theres two stories here, story about the Public Policy impact here which i think it will be an evolution. Then theres a story about the stocks. Heavily traded stocks both on the common and preferred. I cant tell you what they should be trading at. It looks like just from reading this and i read it once that the common shareholders will be somewhat diluted so shares, you know, not going to go up that much more. Preferred shareholders, where a lot of hedge funds bought could go up in this plan. Anyway, any questions . Charlie, liz peek, the question i have for you is in the past, the problem for the gses was the dual mandate. They were meant to be Public Policy organizations that were aiding and abetting low income americans getting housing, and they were also supposed to be shareholder responsive entities and that just didnt work. That has changed here. As i said, nothing in that regard. Lets be clear here, when i say nothing, they are still going to be shareholder entities that are not wards of the government essentially part of government right now. They will still have a dual mandate which would be to foster housing policy and meet shareholder requirements, yet, if you read this plan, theres some safeguards on that. Theres capital requirements. Theres theyre reducing their footprint so they cant go crazy like they did in the 90s and 2000s, insuring everything, buying every loan which drove up Housing Prices too and led to people not being able to afford housing thus they defaulted and thus fannie and freddie had problems. One other thing, they want to have some competition in here. They want to have other fannies and freddies out there to compete with them, which again good for shareholders excuse me, good for taxpayers, may not be good for Share Holders if you start trading these stocks. What about the people that you have been meeting . The volunteers, usually theres so many people that come out during these times of need. Have you encountered anyone thus far . Absolutely. You know, there was a huge army of people that came ready for swiftwater rescue. People come from all over bringing their boats, their bass boats, their fishing boats to, you know, stand by and go and rescue people. In previous hurricanes, we have been out with those kinds of folks. A lot of those people came, but fortunately they werent needed because things werent as bad as they could have been. It could have been bahamas, but it wasnt, thank god. Have you heard on whether North Carolina has really prepared . This thing took a hook to the right. Im wondering if everybody got in front of it pretty well. I think so. I think people are about as prepared as they can be and maybe the golf course has a bit more rain than it would have wanted to, but i think once things get cleaned up, because, you know, i mean, look at this church behind me, this is one of the worst pieces of damage that ive seen in charleston and the charleston area. Havent been out to the beaches yet, but, you know, yeah, its not it could have been a lot worse. So i think your golf game is probably good to go. Jeff sometimes when it isnt as bad as expected, the local government is criticized for having overreacted, overprepared, overalarmed people, is any of that conversation taking place or are people basically crediting the local government with having done a good job . The thing in the bahamas, i mean a cat 5 in the bahamas, when people saw those pictures, i think they said you know what . Yeah, we understand why we had to evacuate. Because if that had come anywhere near us, we would be having a very different discussion right now. Im curious here in florida, having lived through a few hurricanes, and thankfully just dodged this last one, florida has pretty high standards on construction codes, ever since the hurricanes in the early 2000s. I wonder if charleston has the same. Im still worried even though i live in a concrete block house, like any bahama like hurricane, 170 milesperhour wind hour upon hour, i wonder what that would be like in charleston. Theres two key things about charleston. One, they have been through hugo, 1989, 26 dead, 100 i cant remember what the the wind speed was, but very serious. They updated building codes. The other thing about charleston, a lot of older homes, and they tend to be grand fathered in. Theres not a lot of cinderblock houses here in charleston. They are the old you know, they have survived forever. Thats a good thing. David they are survivored a lot of storms they have survived a lot of storms. Jeff, thank you very much. The death toll in bahamas is at least 20 after Hurricane Dorian decimated much of the islands. The damage estimated to cost the country 7 billion dollars at least. Fox newss Steve Harrigan is on the ground in nassau. When you look at the devastation, in those northern islands, particularly from the air shots, hard to believe that the death toll wont keep rising. I think thats real preliminary figures from the prime minister, at 20. That could increase dramatically over the next few days. You can hear the helicopters behind me. Part of the challenge is the only way in and out has been by helicopter since local airports have been damaged so badly. U. S. Coast guard helicopters have been pulling out survivors, and many of those when they get pulled out, cant even walk. They are either injured, too weak, or simply traumatized by what theyve been through. And when you talk to them, almost everyone who gets off the helicopter has a life or death story about how they made it through the storm. Like this man and his wife and two children. Got in about hour and a half from the eye passing through and tornadoes came and took the roof off. I held my wife and two kids, 4 and 7, for an hour and a half. The only thing that saved our life was a single door. Its hard to imagine that man hanging on to a door and hanging on to his wife and children and that door all at the same time for 90 minutes in the waves. We have seen reunion after reunion here. People who thought their relatives might be dead, finding out they are alive. It is not simple straightforward joy, though. Theres a lot of tears and red eyes. People still in shock about what they have been through. That death toll we could see climb dramatically higher as more rescue and more aid reaches those northern islands. Back to you. Let me understand there are politics at play here and theres practical what happens if you do this. I can tell you that i served in a building in california as a bomb tech, in a building that was condemned. There were 285 of us in the marine corps when i came in and about 400 when i got out. We did one of more important jobs not a back on my back, on theirs. We did it effectively. I was on deployment. When i came back, i was hurt. When you talk about infrastructure changes, in the military, usually its a big fat contract awarded to a couple of companies in the area and that congressman in that area is so happy to have it. Theres some of that at play here that i think i think when you look at where this money is actually coming from, it is not affecting troop housing. It is not affecting anything i believe, or at least the first portion of it. There are some of those things that make the money a little bit more obvious as a place to go. Highlights the fact thats what we have to do to get a border wall . We have to rob peter to pay paul . Thats where we are with congress . David im afraid it is. It seems to me theres a lot of hypocrisy going on, democrats are yelling about diversion of 1 2 of 1 of the Defense Budget to fund the wall. They spent years saying the only way we could balance budget is to keep spending down. Going with davids first question is how do you view the security of the southern border . Is that an important thing for the United States to be addressing because thats really the issue here. It absolutely is. I think the one thing we dont understand when it comes to National Security are all the things that happen to make our country safe their you dont hear about because we did it right. When i went through a certain portion of my education, the nuclear weapons, weapons of mass destruction, radiological disposal devices, a lot of education about what comes over our borders or what tries to come over our borders. So it is a threat. I think, you know, think of all the people, migrants aside, having an open border and a place that is seemingly purposefully as disrupt as mexico is. Thats a concern i had when i was in 2010 when i went to school and learned what comes across our borders before immigration was a hot topic it is today. Johnny, its gary smith. Im curious. You know, we have all heard as liz pointed out, it is a very small percentage of the Defense Budget. Weve all heard the stories of the 300 hammer and the 700 sink. You have been there on both the wartime side and the administrative side. How much percentage waste do you think is really in the Defense Budget . Man, i would love to put a number on it; right . Heres a great example. You get a certain amount of ammunition or you get a certain amount of we used explosives as a tool every year. Come towards the end of the fiscal year, theres a term called use it or lose it. So you schedule a day at the range and you go out blowi inii stuff up. You use it so you can ask for it plus 10 the next year. There will come a day where you need it all, maybe. But when that becomes the culture, right, that our government, the va, no matter where your, use the budget or lose it. Thats the culture our government have. Any time anybody talks about fraud waste abuse like this, it is laughable to me. I think a lot of major concern is the president did say mexico is going pay for the wall. Funding is being taken away. It seems it is coming from upgrade projects in military bases in puerto rico and guam, 19 Foreign Countries the list goes on. Can this not be a situation where you have the president taking advantage and bypassing the legislative branch and essentially using his executive power which is undemocratic frankly . If you want to take the fact that the president said mexico would pay for the wall, beat him in 2020, then by any means, every democrat can do that. If you saw whats trying to come across our border outside of people, i want the law. I dont care which politician loses his or her career in the meantime, i want our country to be safe. I want a country where they can live out of the shadows. It doesnt happen with the system we have today. It takes big sweeping changes to fix that for those people. So i dont understand if the best argument we have against Something Like this is just that the president didnt say this is how were going to do it. Now, it includes over a Million People, including 4600 americans. Here now fox news senior judicial analyst judge andrew napolitano. Judge, does the terror watch list violate the constitution . Well, i think that this federal judge in alexandria, virginia, made the right decision on the basis of the law as we understand it. So the fbi david not exactly an answer to my question, but go ahead. Well, i agree with him, and i would have done the same thing. David so it does violate the constitution . Yes, yes, obviously not everybody agrees with that statement and his decision will be appealed. But his decision is based on the following the fbi uses subjective standards, unproven allegations, rumor, innuendo and to some extent ethnic background in order to put people on this list. So 26 americans, american citizens challenged this. Some of them as a result of being on this list couldnt fly, couldnt get on a train, couldnt cross an interstate border. They were stopped trying to pay tolls at the George Washington bridge, couldnt enter schools and couldnt enter hospitals because of what came out of this case is the fact that the fbi shares this list with local and state governments. So when the fbi tried to demonstrate the manner which it puts people on here, it was so subjective, the judge threw it out. The right to travel is a fundamental liberty. The Supreme Court has said that since 1969. A fundamental liberty is in the same category as speech and thought and religion and privacy. That cant be interfered with by a secret list. It can only be interfered with by due process. You want to put somebody on there . You have to hold a trial and they have a right to challenge it. Senator Edward Kennedy was put on the list 15 years after he made some statements in favor of the ira and their then violent activities in northern ireland. It took him months to get off that list. Because the government and one of the things that so animated this federal judge is that no fbi agent who testified in the case gave the same story or the same understanding as to how they put people on the list. They just put them on the list, and if there was any doubt, the doubt should be in favor of freedom, not in favor of being put on the list. They put them on the list if there was any doubt. Wasnt it an issue too that they didnt tell them why they were on the list to begin with . Not only did they not tell them why, they didnt tell them they were on, so you are crossing the George Washington bridge from new jersey to new york, the way you go when you pay a toll and a toll taker says im not going to take your money. The easy pass doesnt work. They dont let you go forward. They dont know why. Nobody tells you why until a year later the lawyer files a lawsuit and in the lawsuit she finds out why. Whats the recommendation Going Forward . The government would have to have a trial, a jury trial, in order to put somebody on that list. In the case of a National Emergency, which was sort of how 9 11 was approached or viewed, i think, by the government, wouldnt there be certain powers given to the government or the fbi that might allow Something Like this, at least temporarily . No, because the Supreme Court has been very clear. Theres no such thing as emergency power under the constitution, even though there are half dozen statutes that give the president of the United States near dictatorial powers in the case of an emergency that he declares. Theres no authority for that in the constitution so President Trump could not declare a National Emergency and say as part of the remedy of this National Emergency, to address it, we need this watch list. On facebook they can see i have liked dancing pages or checked into a dance studio or anything like that. They can see what im doing and use that for future conversations. I think it is interesting that according to the latest numbers, tinder is still number one in the United States as of 2019, 8. 5 million users. However, this is a personal observation. I think the younger generations that are using dating apps are going towards a more inclusive group. Theres groups that are very different. These are for everybody, but they want more narrow focus. I mean, obviously facebook has all the information it needs to be a very effective dating service. I think you just have to come back to the rule of law these days and just say nothing is private. Nothing you put up on facebook is private. Nothing on google. What you do on your computer is not private. People have to accept that. David buyer beware. Yes, buyer beware.
