How do you think it was handled . Batting 500 pretty much i think that checking with the office of Legal Counsel which is the office within the Justice Department that really determines the what the governments position is with respect to legal issues it was a good idea, because out turns out that the Inspector General of the Intelligence Community was not the person to whom that report should have gone. Checking with the white house, i understand that we have a unitary executive, the white house supervises the entire executive, they dont see the need of having to do that or the optics of having done that are not good. Paul the political wisdom of that, it creates the impression that maybe theres a political im sort of outside my lane at this point. Im not supposed to counsel people on political wisdom. That doesnt seem to be a smart thing to do. Paul what about this issue of executive privilege . The president raised in saying that, you know, that he has private phone calls with heads of state. He has to have those. If heads of state think that they can that anything they say is going to be public, youre not going to have candid conversations. Correct. But thats not what executive privilege is about. Executive privilege shields the president s conversations with people who are giving him advice. Paul uhhuh. Usually it is people on the staff to have white house or people in the cabinet, people like that. I think its an open question as to whether, for example, if the president called Henry Kissinger who is no longer in any administration and wanted to get advice, it might cover that conversation. Paul what about a conversation, though, with xi . Does that mean any time a whistleblower decides he wants to make a complaint and say i think i heard, i heard that there was some something bad happened in a call. Therefore im going to write a complaint and it goes up to capitol hill and capitol hill says we have to see what the text was. Thats a bad precedent. Yeah, this is not a precedent for that. First of all, the whistleblower blew the whistle to the Inspector General of the Intelligence Community. The Inspector General of the Intelligence Community is not his jurisdiction is confined to the Intelligence Community. Paul not the president s behavior. Hes not the lone ranger. He doesnt rove the landscape looking for anything bad and if he finds something he thinks is bad reports it. The president is not a member of the Intelligence Community. So that complaint went to the wrong place. The fact that it ultimately went to congress doesnt mean that then the conversation itself has to be released. These rules pretty much rely on the discretion and common sense of people who are serving in the government. There are you cant theres no rule that enforces itself. Ultimately you rely on peoples discretion and common sense. Paul but if the congress is saying we want other conversations. We want your conversations with Vladimir Putin and your conversations with any other foreign leaders and see how thats been affected, how that might have been an abuse of power, if you were the president of the United States and you heard that request, what would you do . What would your advice to the president be . My advice to the president would be to say no because otherwise the president cant conduct foreign relations. Theres a separation of powers. The president conducts foreign relations. Congress conducts oversight. Paul right. Sometimes of some things. The notice by the way that the powers of congress are e mum enumerated, the powers of the president arent. The founders paul made that distinction. Correct. The notion that somehow congress can look into any conversation of the president is doesnt go any place, wont go any place with the court. Paul one of the reasons i gather they havent had a formal vote for an impeachment inquiry because the committees the speaker has said can go ahead with their work, theres not a lot of powers for the minority in that situation. There are no powers for the minority at all. In the house of representatives, if you remember the minority, youre pretty much without power. Paul but you have if a formal impeachment inquiry, then you may have to bring them in because predictably if you want any republican votes for it. Yeah, to some extent, theres a need to include them, and obviously thats done ad hoc. Paul do you see anything so far in as you have looked at this big picture that theres any violation of law that you detect . By the president of the United States . You mean the president s conversation with the ukrainian president . Paul thats correct, in the whistleblowers complaint. The whistleblowers complaint pretty much relies on that conversation. It goes into various other things that the whistleblower has heard, but they all relate they all center on that conversation. And that conversation doesnt contain any violation of law. The suggestion that somehow the president is requesting a thing of value which would violate the Campaign Finance laws i believe has already been passed on by the Justice Department. Paul it has. Investigation and maybe even a larger investigation playing out as democrats launch their impeachment inquiry. The Justice Department confirmed last week that u. S. Attorney john burr hamm is separately exploring durham is separately exploring the extent to which a number of countries including ukraine played a role in the counterintelligence investigation direct at the Trump Campaign during the 2016 election. Former cia director john brennan said this week he is concerned about the Justice Department review of the origins of the russia investigation and questioned why the durham probe is necessary. Supposedly im going to be interviewed by mr. Durham as part of this noninvestigation. I dont understand the predicating of this worldwide effort of trying to uncover dirt either real or imagined that would discredit that investigation in 2016 into russian interference. Paul were back with former u. S. Attorney general. So you heard the former director. Is this probe necessary . Yes. There was a succession of theories as to how that the 2016 counterintelligence investigation got started. First, we heard about the dossier. And when that blew up, then we heard about the conversation in the wine bar that papadopoulos had with an australian minister. It wasnt either one of those. It went back further than that. And we ought to know how it started and what its content was. Paul because if in fact this was started with bad intelligence from overseas or foreign dirt of some kind or by some officials internally in the United States, thats a terrible precedent for our politics to have Law Enforcement agency starting that kind of probe. And its certainly terrible precedent to have the cia involved in investigations that relate to domestic activities and to american elections. Interesting that that john brennan is questioning this. He says he doesnt see the need for it. By the time its over, he may. Paul you know john durham. I do. Paul u. S. Attorney. What kind of person is he . He is a straight as the edge of a ruler. This is somebody who has investigated cases for janet reno who i selected to investigate the destruction of the cia tapes who eric holder suggested to investigate the reopened interrogation issues relating to people who conducted interrogations in the cia. He is well recorded. He is well regarded. Hes a person for the thirst of anonymity. He doesnt seek the limelight. Hes a rigorous capable investigator. Working with him by the way is a woman named nora danehy who also had a pleasure of selecting to do another investigation. Interesting they both out of connecticut. Paul best thing out of connecticut we have heard in a long time. Right. Paul is it in this context appropriate for the Justice Department and these investigators to seek the help, cooperation of foreign governments in this probe, if they have information . Absolutely. The Justice Department interacts with Foreign Countries to get their cooperation in matters all the time. I did it myself. Paul so the attacks on bill barr here, by some in congress saying this is simply part of this seeking dirt on a foreign leader, its a completely separate question. Of course. And nobodys seeking i mean interestingly that people assume that hes seeking dirt. Paul they may not be. They are trying to find out what happened. What happened. Paul yeah. And how is it that a counterintelligence investigation was begun that wharfed into a criminal investigation and we ought to know how that happens and why. Paul separate from that, though, lets take the president s comments this week publicly inviting china to investigate joe biden and hunter biden and what they did in china. What do you make of that . Bad paul bad form . Bad form, for sure. But i dont see that it involves criminal activity, number one. And number two, there was in fact an attempt not an attempt, but efforts and activity by the Obama Administration to get the ukrainians to provide information on Paul Manafort, which they did, and i dont see anybody being outraged about foreign meddling in a u. S. Election, notwithstanding that a Ukrainian Court found that ukrainian officials had been induced to meddle into the u. S. Election and it didnt help ukraine. Paul it would be better for the country if both sides stopped doing it . Correct, correct. But so far as it, you know, so far as it being a crime, i dont see it. We want to be fair as we go forward. Paul as House Speaker pelosi moves to expi dishsly on impeachment expeditiously on impeachment. Democrats accusing the white house of a cover up as secretary of state pompeo acknowledged he was on the july 25 phone call between President Trump and ukrainian president zelensky. And republicans crying foul after a New York Times report that Intelligence Committee chair schiff and his staff learned about the outlines of the whistleblowers complaint before it was filed. Lets bring in wall street journal columnist and Deputy Editor Dan Henninger and columnist kim straussle and bill mcgurn. Dan, did the democrats advance the case for impeachment this week . Well, i think the short answer to that would be no. But lets put it in some caveats here. Impeachment is what the House Democrats want to make it to be. They can define impeachment. But nonetheless, most of the American People regard impeachment of a president as a grave serious activity. And the question is why had the democrats decided to elevate the issue of Donald Trumps interactions with the president of ukraine to an impeachable offense, as nancy pelosi says a violation of his oath of office . I think they are going to have difficulty reaching that bar. For some political reason, they are insisting on going that far. Having said all that, this ukrainian issue with the president is not going away. I think more information is going to come out about Rudy Giulianis involvement with the ukrainian government, the interactions between state Department Officials in ukraine and in washington who were trying to get the ukrainians to sort of cooperate with President Trump, both politically and on the question of international security. So its going to get very complex, and it could get uglier before it becomes clearer. Paul i have to say, bill, Rudy Giuliani going out and running sort of a shadow Foreign Policy with ukraine and when he could just go through the state Department Just doesnt look good. Particularly given the fact that Rudy Giuliani at any given moment just makes a bad presentation of the facts. You never know whats really true yeah, look, president s choose emissaries all the time outside of government paul sure. Rudy is a pretty volatile emissary. It does complicate things because the democrats are trying to secretary pompeo and attorney general barr, and i think it would have been easier for the president without rudy being in the middle of that mix, because i think what they are doing is perfectly appropriate. Look, we know that you dont have to commit a criminal act for it to be impeachable. The house can determine paul right. Still i think a lot of this is untorrid. I think asking governments to investigate someone through rudy is not a good idea. But im not sure it is impeachable. Quickly, bill, rudys brief an assignment from the president was to find out ukraines involvement with Paul Manafort and then secondly joe biden and hunter biden and the ukrainian gas company. Typically that would not be a job taken up by state Department Officials or the secretary of state. That is a political question. Could be a legitimate political question. But normally you would not ask diplomats to be pursuing that kind of inquiry. Thats what rudy was doing. Paul kim, i want you to focus on the head of the Intelligence Committee, adam schiff, and the question of the time line about what he knew and when he knew it. Does it matter if he had an early indication before the whistleblower complaint was released about what was in it . Yeah, of course it matters. It matters because it gets to the legitimacy of this probe. It turns out that if these reports are to be believed, the whistleblower reached out to his staff before the whistleblower even filed the official complaint, with the Inspector General. That happened august 12th. The public, the nation did not find out about this until almost a month later. Adam schiff used that month to lay the groundwork for what would ultimately be this ukrainian issue, and he exploited it. You go on his twitter. He suddenly developed this new fascination with ukraine and what Rudy Giuliani was doing and the fact that the administration was withholding ukrainian aid. He was building this up. And i think that makes a lot of americans question his motives in this because he wasnt being straight up about what he knew. He was using it for political gain. Paul and i guess the democrats are saying motives aside, the facts are the facts, and this is still an abuse of power. Why do i mean we all know schiff wants to impeach the president. Hes wanted to do that probably since january 20, 2017. Well, right, but look, heres a fundamental problem, though work the entire democratic claim that this is an abuse of power. A lot of americans look at this and say okay, could we just have one set of rules for the road instead of a doublestandard . Why was it not an abuse of power when the Hilary Clinton campaign was directing russian dirt to the fbi for use on a counterintelligence investigation against the Trump Campaign . Nobody was complaining about that back then. And so yeah, is it terrible on both sides . We wish nobody would do it. Yes, but it is hard to say one side was abuse of power and the other one was just trying to help the country. Paul is that going to be the defense the president uses, doublestandard . I agree with kim there is a doublestandard particularly in the media and their attention on the media. But there is something untorrid about the president to my mind standing up at press conference and saying communist chinchina china, you investigate joe biden. I agree it is unpresident ial. The American People need to make up their mind. This president since the Inauguration Day has had the entire established washington against him and this is the way donald trump fights back whether hes president or citizen of the United States and i think voters will have to figure out whether thats appropriate. Paul still ahead as polls show growing support for impeachment, a look at the potential political fallout on capitol hill and the campaign trail. They are the do nothing democrats. They dont do any work. Paul the impeachment battle playing out on capitol hill and on the campaign trail. With 2020 democratic president ial hopeful joe biden saying this week that hes in this for the long haul. As President Trump doubles down on his attacks against the former Vice President and his son over their political and business dealings both in ukraine and china. So kim, could this possibly, the politics of this, possibly be helping joe biden in the sense that he can now point to say, look, the president is attacking me and hunter and it is unfair and therefore he looks tough by standing up to the president and gets some sympathy from democratic voters. Look, joe biden did the right thing in coming back out to refute these claims and attack back what we always know from politics is that being aggressive is better than being defensive. Its still unclear, though, how he surmounts this at least in the minds of some democratic voters because it goes to the heart of bidens campaign. He claimed that hes the guy who can prosecute the case against donald trump. Well, democrats, the case they are making now is that there is an issue with the ukraine and that is the issue that donald trump is making with biden. It is hard to see him bringing this up without having it thrown back in his face. Thats going to make some democrats wonder if he really is the right guy for the job. Yeah, i agree with kim. I dont see how you can get to donald trump on ukraine without constantly bringing up hunter biden. Common sense, what were the cain ukrainians what were the ukrainians buying . He had no experience on energy. Paul hes buying influence. The polls have gone up in terms of support of impeachment. Nadler said about a year ago that before we could impeach, we would need to have the American People, even trump voters paul right. Thats not happened. Most of the support has 79 of democrats supporting peach now supporting impeachment now but only 12 1 2 of republicans and i think independents are slightly in favor of nonimpeaching but very slight, sort of evenly divided. Paul pelosi is moving very fast. They want to get this done, probably have a vote on the floor thats whether to impeach or not. Theres still a question of why havent they had a vote on the floor authorizing an inquiry, impeachment inquiry like happened with clinton and nixon . Well, i think she wants the political issue. She wants the bad press for President Trump to keep dribbling out these stories and leaks keep occurring, and she wants to delay it for that reason, to build up political pressure against donald trump. And i think there is sort of another political side to this as well, with the democrats, which is that most democrats who have been polled say what they really want to do is defeat donald trump. Now, then youve got the progressives who say they want their candidate to win. We have to mention that Bernie Sanders temporarily suspended his campaign for cardiac problems, which at least causes progressives to rethink whether theyre going to support him or elizabeth warren. But i think a lot of those democrats out there are thinking joe biden is being hammered by President Trump. And in a way trump is giving those democrats more of a reason why they were supporting joe biden in the first place. And as bill is suggesting, if joe biden can survivor the hunter biden stuff and the investigations, i think probably this helps him ultimately. Paul yeah, it is an interesting question, kim. You go with the detate coming up, the president ial debate, it will be interesting to see if any of the democrats on that stage take on hunter biden and the businesses and the ukraine and china and put it right before the Vice President former Vice President and say look, sir, how can you attack donald trump with this in your background . Yeah, i will be curious to see it too because on the one hand, some of the candidates that have gotten nasty up on the stage have gotten blowback from the wider democratic establishment saying look, we need to not be tearing each other up. At the same time, this is a very crowded field, and you have a lot of candidates that are desperate to distinguish themselves and get in the headlines, and one easy way to do that would be to go after joe biden on this issue. Paul yeah. What about the way Senate Republicans are behaving . Mitch mcconnell has said if it comes to the senate, we will have to deal with the impeachment flowing over . Hasnt said exactly how. But most of the other republicans are staying real quiet. Smart . I think it is smart. Look, they should be in the position they are going to be making the decision if theres an impeachment of guilty or not get, and they should wait to see the evidence. I think senator mcconnell is right that he has no choice on this, but look, i think one larger thing about this impeachment, its been a regular from the start. You mentioned the lack of vote. Thats not just a minor point because when the issue subpoena as the judge pointed out you have more authority if it is a judicial proceeding, and if it is not, if the speaker can just declare that, without any change in the rules, this is going to be tangled up in a lot of fights and so forth before we get there. Paul if ultimately if this is partisan impeachment, dan, it will have a lot less credibility. Oh, yeah, it will, but i mean thats i think what the democrats are trying to do is put some of these republicans in the senate on the hot seat, susan collins, cory gardner in colorado and just maybe force them to separate themselves from the president , put a wedge between the republicans and the president. Paul still ahead, a tumultuous week on wall street as the market reacts to signs of a slump in manufacturing and Service Parts of the economy as well as september jobs report. The numbers i think are being affected by all of the nonsense, all of the politics going on in this country by the democrats, but the numbers really are looking very good going into the future. So we will see. Paul President Trump this week touting the strength of the American Economy and suggesting this weeks market fluctuations were tied to the democratic impeachment push. The latest Economic Indicator came friday with the Labor Department reporting that employers added 136,000 jobs in september with the Unemployment Rate falling to a 50year low of 3. 5 . Wall street journal columnist mary ogrady joins us with more. So mary, mixed signals this week, kind of a decent jobs report, considering what some had expected and yet real signs of a manufacturing recession. Youre right, paul. I mean, we havent had such good unemployment numbers since the mets won their first world series in 1969. [laughter] paul parochial reference. The world series is not parochial. [laughter] but, you know, what were looking at here is that the consumer remains in very good shape and thats important because the consumer has been carrying this economy all along, and so providing that the, you know, wages are still going up, not as fast as they were, but were still rising. We have inflation thats under control. So thats a good story. But there are clouds on the horizon. I think thats why the market is skittish, and think the skittishness of the market could feed into undermining consumer confidence. So some of these things that are making the market nervous i think need to be addressed, and number one is trade policy which of course is a problem. Paul lets talk about that because the manufacturing is in recession around the world, and a lot of thats related to trade because goods are traded globally and that has now seeped into the United States. There was manufacturing unemployment that fell a couple thousand jobs in the u. S. In september, which is awful. Right. Which isnt awful. Right. Paul i guess the question is how worried should we be about the Manufacturing Sector . The Manufacturing Sector is only a smaller portion now of the u. S. Economy, than the service economy. Paul they pay really good wages. They pay good wages and i would add to that that the Service Sector also started to not actually contract but its not performing as well as it has for many months on end. In fact, i think the latest read is sort of the weakest that its been in about three years. So thats also a place for a little bit discomfort, but the point that you bring up about the interconnectedness of the Global Economy i think is the key point. I mean, we dont make things whole together here in one shot. We import things. We add inputs. We send it somewhere else. I mean cars go back and forth to mexico. But that includes all over the world. So that inner connectedness of the Global Economy is very important and i think, you know, were not just seeing this issue with donald trump challenging china. Many people are defending him on that because of the intellectual property component, but hes also in a fight with europe, and hes got the u. S. , canada, and mexico trade agreements sort of up in the air and not ratified yet by the u. S. Congress. Paul and imposed tariffs on retaliation on europe for subsidies to airbus. I look at that jobs report this week, and heres what i thought, if imagine how strongly the American Economy would be growing with better trade policy, if we didnt have the protectionism thats broken out in so many places yeah, i mean, he set records, but it would be historically unprecedented. I mean it would be something President Trump could indeed brag about as perfect, the best ever. Heres the number heres the thing that jumped out in me in this jobs report, said the number of job postings exceeded the number of unemployed workers by more than 1 million in july. I mean, thats extraordinary. There are so Many Employers out there, small, mid sized, larger, looking for workers and indeed a lot of it is in the Service Sector, but the wages have been rising for those people so there must be an amazing sense of optimism out there both by employers and the people who are finding jobs. And yeah, if you could pull the trade component out of it, and rationalize trade, get past it, i think you would see a second boom. Paul what would happen if he got a deal with china, put this at least a truce on trade and took some of this other stuff off the table . I think the market is raring to go. You see in spite of these sort of negative stories on trade, the market is holding up. It has bad days and good days but it is moving around the same sort of 300 point range that its been in. I think theres one other thing we should keep in mind which is consumers are also owners of stocks. You know, elizabeth warrens of the world would have you believe it is the only rich people who have them, but Many Americans have stocks. Paul through pensions. Through pensions paul 401 k s. Yes, exactly. Earnings matter and the earnings for this year were not great. They are expected to pick up again next year, but i think we need to keep an eye on that. Paul thank you both. Paul Chinas Communist Party on tuesday marked the 70th anniversary of its 1949 revolution but amid the fireworks and military parade in beijing, antigovernment demonstrations in hong kong took a violent turn with Police Shooting an 18yearold protester at close range as tens of thousands of people took to the streets of the city. Hong kong chief executive carrie lam invoked rarely used Emergency Powers on friday to impose a ban on people wearing face masks at public gathering with offenders facing up to one year in prison. Wall street journal editorial writer was in hong kong this week. She joins us with the latest. Whats the significance of this emergency power on face masks . Well, it hasnt been invoked since 1967. Its basically the chief executive has the authority to say its an emergency, and then if its an emergency, do anything that she wants in terms of regulation, whether thats censoring people, censoring publications, seizing private property, arresting people, so it is a really sweeping power. This is the first exercise we have seen of it in a long time, but i think hong kongers are very concerned about how this authority may be exercised next. Paul it sounds as if this is going to be exercised as part of a strategy to basically squeeze the protesters, give another rationale for arrest aring them and imposing a pretty harsh sentence. Do you see that as a strategy and do you think the protesters will obey . I think it is a strategy but i dont think they will likely obey, though. Already we have seen tens of thousands, hundreds of thousands of protesters taking to the streets for unauthorized protest. Now thats something that can get you up to five years in prison, and i think the risk here is that hong kong is essentially criminal sizing a huge portion of criminalizing a huge portion of its population. Paul that means that i guess the attempt is scare people, keep them off the streets and hope that over the longterm that is over the next weeks and months, the protests dissipate and the whole Movement Goes away. I think thats the hope, but im not sure it is going to work. These protests began over concerns about erosion of rule of law in hong kong. And i think hong kongers are not going to be reassured that the chief executive is unilaterally now exercising emergency power. They are concerned about where this is going to go. They are concerned that this is going to hurt rule of law. That thats ultimately going to have an impact on hong kongs economy as well. These rights concerns the concerns about rule of law, the core of this protest movement, and i think this just energizes protesters. Paul one of the things about the evolution of demands of the protestors over time, and you met with them in hong kong and we met with them in new york when some of them visited that this is not just about the original extradition law thats since been withdrawn, but its become really a debate and a cause about telling the world about whats going on in china. Hong kong protesters really want to change china, which strikes me as a very hard thing to do, and if thats their goal, i mean, its going to be these are going these protests are going to go on for a long time. Yeah, this is highstakes for sure. I think protesters are looking at the situation and saying that if we dont take a stand now, were never going to have a government thats accountable or respects rights. This week certainly i saw a lot of protest graffiti bringing up whats happened, so thats kind of lurking in the back of peoples minds. In addition to, that i think protesters are kind of moving forward the narrative that they are fighting the wests fight, that somebodys got to confront chinas bad behavior, and i saw a sign up the other day that said hong kongs problem today, the worlds tomorrow. Paul yeah, the muslims in the province who many of them are in interment camps. Whats happening in hong kong economically . Are you seeing capital flight and maybe the flight of human beings if they can get visas . You sure are. I went this last week and was meeting with immigration lawyers, and they say that they are getting calls from about 100 or 200 people every single day, saying we want to get out. Theres some signs of capital flight. You see people buying property abroad. I had to chuckle when i saw on the side of a tram Western Union now advertising for how to get money out of hong kong. So i do think that people are at least looking for a plan b, if not moving immediately. Lets broad then a bit, bill. You met with some of the protesters. You lived in hong kong. Right. Paul you agree with jillian this is going to go on and on . Absolutely. The problem is what the hong kong people have learned, these guys in beijing are communists. Communists are still communists. Its always been more about power than economics, they might want to get rich but they want control. The hong kong people to your point, they have concluded that if china is not going to answer the promises it made to hong kong, that we would get more control, then our only way paul for autonomy. For autonomy in hong kong because people in hong kong would have gladly taken their own freedom and minded their own business and they are concluding we are not getting anywhere unless we get a new leadership in china. I think they have done irreparable damage because they have injected politics into the Business World paul meaning china . China has done it. You see the cafe ceo had to resign rather than turn over you see the protesters targeting pro beijing stores and so forth and other people forced out of their business, a prominent lawyer for a bank was forced out because he supported i dont see a hong kong comeback.
