What is important what is happening right now in the oval office with President Trump as it relates to this executive order and social Media Companies is, that the attorney general bill barr is there. So you have got President Trump, the attorney general and as we are going through the notes here as this is happening, what the administration, the president and his ag, are taking aim at is section 230 of the Communications Decency act. It appears as if as well that the president according to the notes is going to try to insure somehow that taxpayer dollars necessarily dont flow into these social Media Companies. That we await to see the exact comments that the president is making. In any event, as the president is about to sign this executive orderlier this afternoon the White House Press secretary Kayleigh Mcenany outlined sort of what the administration hopes to accomplish with this. Listen here. There are various shields in place that essentially shield some of these social Media Companies and allow them to censor conservative users and were not able to see what happens behind those shields. That section was one of those shields you mentioned. Were looking ways to remove the shields to shed light what is happening with some Decision Making behind the scenes. Reporter twitters decision to apply the first fact check label to a president ial tweet is what really spurred the executive action. The twitter ceo in leadup to all of this jack dorsey said following on twitter, in part, quote, this does not make us an arbiter of truth. Our intention to connect dots of conflicting statements to show truth where people can judge themselves. More transparency from us is critical so folks can clearly see the why behind our actions n a interview with foxs dana perino, Mark Zuckerberg says the companies should the be the arbiter of truth on the issue but he took issue with the executive brand trying to intervene. He is thinking about regulations or perhaps shutting down social media sites. What is your reaction to that . Well, i mean, look, i would have to understand what actually would intend to do but, in general i think a government choosing to censor a platform because theyre worried about censorship doesnt exactly strike me as the right reflex there. Reporter so thats the broad outline there. Well get the finer details on this shortly, and what the attorney general could potentially do with all of this. Then of course there is that second headline from the, a Different Event this afternoon which the president said there will be a press Conference Tomorrow regarding actions on china or potential next steps with china. The president saying, quote, well be making certain decisions and discussing them tomorrow. President trump saying that will happen via a press conference. The state department actually telling congress they can no longer separate hong kong from economist china which means the special status hong kong received from the u. S. Is going away and showing up instead, major Human Rights Concerns for the people in that region. Protests in hong kong continued overnight into today after Chinas Parliament passed that law, that essentially designates hong kong protesters as terrorists and is what the state department is calling essentially a takeover of the communist party of hong kong. No human rights, taking away all the core values weve come to know and they have completely, successfully on hong kong. From now on hong kong is nothing just another mainland chinese city. Reporter secretary of state mike pompeo says removing hong kongs autonomous status is not escalation coming from the United States but instead it is undeniable truth that china is undermining hong kongs essential freedoms saying this, quote, no reasonable person can assert today that hong kong maintain as high degree of all tony from china, given facts on the ground this decision gives me no pleasure but sound policy making requires a recognition of reality. Reality for china because of this, could include some action from congress. The Treasury Department is reportedly weighing sanctions in response to beijings battle forecontrol over hong kong. Other options looked at could include freezing assets of chinese officials and businesses and visa restrictions for chinese governmental officials. China says what happens between china and hong kong should stay that way. The u. S. Should stay out of it. Foreign munster secretary saying this, quote, the National Security law for hong kong is purely chinas internal affair that allows no foreign interference. This change in special status, melissa could put in jeopardy the 66 billiondollar trade relationship with hong kong and u. S. They have been exempt from tariffs, targeting china as a result of the status that could soon be going away. Melissa, we, as we wait for the president s comments on social media lets bring in Edward Lawrence on a different story today. Information for Small Business owners as we have adjustments being made Paycheck Protection Program. Edward. Reporter exactly. The house of representatives passed the Paycheck Protection Program flexibility act t makes critical changes to the Paycheck Protection Program. In fact overwhelming with the support theyre, 4171. The only one holdout was representative Thomas Massie from kentucky. It was again, the changes here make critical changes. It increases the amount of time that businesses have to use the payroll Protection Program from eight weeks to 24 weeks. It creates a new ratio for those businesses of 60 of loans on salaries, 40 on other costs. The bill also allows businesses to get the loan to deferral payroll taxes. The Administration Says the ppp program has saved over 50 million jobs so far. There have been a number of people, particularly in the restaurant industry, gee, eight weeks isnt quite enough to get people back to work and be in position to, have that loan forgiven. They want it extend ad bit. That is something were looking at. Reporter there are some 4. 4 million loans that have been written under the Paycheck Protection Program so far t started eight weeks ago. Some of those loans are being converted to forgivable. House Speaker Nancy Pelosi brought this bill making critical changes without attaching anything else to it. She still thinks more needs to be done. As i said earlier, our health care workers, our firstresponders, so many people are risking their lives to save lives and now they will lose their jobs because their state and local governments and county governments provide some of the health care are, just dont have the money. Reporter the senate comes back into session on monday with the overwhelming support of the house, likely to pass, same amount in the senate when the senate does take it up. Back to you. Melissa now lets go to Lauren Simonetti for the jobless numbers. Lauren. Lauren, hey, melissa, they were bad as expected another 2. 1 million americans filing for unemployment benefits. The lockdown total, 41 million americans, or one in four out of work. Guess what . Teenagers have been impacted as well. Unemployment rate hit 32 in april. It is expected to get worse. It is creating additional strain on pocketbook of mom and dad who have to fend for their teenage children. Coronavirus decimated the seasonal job market source of income for teenagers. Pools will stay closed and that curbs need for lifeguards and swim instructors. Golf courses suspending caddie services. Retail restaurants are focusing getting fulltime employees back to work safely. It is not just jobs in short supply here but internships as well although some big tech firms like apple, ibm, theyre offering virtual opportunities. Graduating College Seniors might get hit the hardest. They have gone from entering one of the strongest job markets in history just a few months ago looking for work in the midst of a recession. And research does show that when you start your working life in the middle of an economic downturn, that can actually hurt your income for as many as 15 years. What are you hearing from people in terms of turn around as people start to open up and start to ad some jobs back . Its, you know, you want to know, have we hit bottom . Is it time to start picking back up again . A lot of folks are saying we have hit bottom because the numbers are improving, however the fear among most people, business owners, economists, regular people is a second wave where they reopened and they have to shut down again. That shaped recovery is probably the worst one that well get. But look, you know, if you look at states where they reopened, numbers are Getting Better. We report earnings from all the companies, give us a glimpse into the future, numbers are Getting Better as these lockdown orders are lifted. So hopefully, were in the worst of it here, new york, new jersey, connecticut, weve been hit really hard but the rest of the country things are slowly getting back to normal. We hope businesses can keep the workers that have been furloughed, call them back. Those workers do decide to come back, you know, maybe they can just do more with less. A lot of Small Businesses, i know you guys talk to Small Businesses all the time, there was a report just done, Small Businesses are saying what they need now more than the money is guidance. We had to open a digital operation so we could have some sort of income. We have to open our stores, how do we safely do that . They need help with those things, the help with transition to the new economy. Melissa i remember a little while ago, amid the polling and economic reports, 70 of people who were furloughed thought the job would be waiting for them when this is over. That sounded optimistic. Connell any moment well have the play back of President Trumps comments on social Media Companies. He is signing an executive order related to those companies at the white house right now. Before he signed it, he spoke to reporters, i believe in the oval office. Just to give you a little tease before we play this back. The president says the social Media Companies are tantamount to a monopoly. Said that moments ago. Also said in addition to the executive order, wii well talk about, the judge standing by for analysis, he said he will pursue legislation for these companies. Well play that back. One quarter of the labor force filing for jobless benefits over the past 10 weeks as local leaders push forward plans to safely get back to business. At this point all 50 states now have resumed Retail Services in some capacity. Alaska is actually leading the charge, the only state allowing businesses to operate at full capacity. They have points of view. If we go by that, it is actually amazing that there was a success in 2016 but we cant let this continue to happen. It is very, very unfair. You look at the statistics, you look at what is going on, i think everybody would very much agree with that. Including democrats by the way. I saw quite a few democrats are saying this is about time something is done. Lets see if they keep that decision after we hear we agree with them. The choices that twitter makes when it chooses to suppress, edit, blacklist, shadow ban, are editorial decisions pure and simple. Theyre editorial decisions. And in those moments twitter ceases to be a neutral public platform and they become an editor with a viewpoint and i think we can say that about others also, whether youre looking at google. Whether looking at facebook and perhaps others. One egregious example when they try to silence views they disagree with by selectively applying a fact check, fact check, fact, fact check. What they choose to fact check, what they choose to ignore or even promote is nothing more than a political Activism Group or political activism and it is inappropriate. You look at whats happened. You look where theyre going, where theyre coming from, i think you all see it yourselves. The censorship and bias is a threat to freedom itself. Imagine if your phone company silenced or edited your conversations. Social Media Companies have vastly more power or reach than any phone company in the United States. More reach actually than your newspapers by far. More reach than a lot of your traditional forms of communication. Therefore today im signing a executive order to protect and uphold the free speech rights of the American People. Currently social media giants like twitter receive unprecedented liability shield based on the theory theyre a neutral platform which theyre not, not an editor with a viewpoint. My executive order calls for new regulations under section 230 of the Communications Decency act to make it that social Media Companies that engage in censoring or any political content will not be able to keep their liability shield. That is a big deal. They have a shield. They can do what they want. They have a shield. Theyre not going to have that shield. My executive order further instructs the federal trade commission, ftc, to prohibit social Media Companies from engaging in any deceptive acts or practices affecting commerce. This authority resides in section 5 of the federal trade commission act. I think you know it pretty well. Most of you know it very well. I would think you know quite well, right . Additionally im directing the attorney general to work cooperatively with the states. He is going to be working very much and very closely in cooperation with the states to enforce their own laws against such deceptive business practice the states have broad, powerful authority to regulate in this arena and they will be doing it also and we encourage them to do it if they see exactly as weve been seeing. What theyre doing is tan at that mount to monopoly you could say. Tantamount taking over the airwaves. Cant let it happen, otherwise well not have a democracy, not have anything to do with a republic. Finally im directing my administration to develop policies and procedures to insure taxpayer dollars are not going in any social Media Company that represses free speech. The government spends billions of dollars on giving them money. Theyre rich enough. Well be doing none of it or very little of it. As president i will not allow the American People to be bullied by these giant corporations. Many people wanted this to be done by president s for a long time and now were doing it and im sure there will be a lawsuit. Im also sure were going to be going for legislation in addition to this and the legislation will start immediately. I tell you ive been called by democrats that want to do this and so i think you could possibly have a bipartisan situation. But were fed up with it, and it is unfair. It has been very unfair. Well see what happens. Any questions . Reporter mr. President given concern with twitter, have you given any consideration to deleting account, walking away from this platform youve been so critical of . If you werent fake i would not even think about it, i would do that in a heartbeat. Reporter im real, sir. The news is fake. If you look at what is printed in newspapers, if only the public could understand where you know, they are reading a story and they think it is real, not real in so many cases. Im not saying in every case. You have some great journalists. You have journalists i have Great Respect for but largely i find at least in a political sense there is so much fake news it is disgraceful. I would do that in a heartbeat. If we had a fair press in this country, i would do that in a heartbeat. There is nothing i would rather do than get rid of my whole twitter account but im able to get to, i guess 186 million people, when you add up all the different accounts and add facebook and instagram. That is a lot of people and that is more than the Media Companies have frankly by a lot. And so if i get a story thats wrong, i can put a social media, i dont usually use word twitter, i say social media, but i put something out and the next day or the next hour or the next minute everybody is reading about it. So im able to refute fake news. That is very important. I would like to ask the attorney general please to, say a couple words. He is very strongly behind it, backing it very powerfully. Again well be doing this. Were also going through congress. Well you, mentioned, mr. President , some of the things i found has the broadest bipartisan support these days is the feeling this provision, section 230, has been stretched way beyond its originally intention and people feel that on both sides of the aisle. This was adopted 25 years ago to protect fledgling industry and its purpose was to allow websites that were serving as essentially Bulletin Boards for diverse Third Party Content coming on saying youre not responsible for the content of that third party information. It also tried to encourage these companies to take down things like child pornography or Human Trafficking advertising and things, saying if you act to remove this kind of objectionable material you wont be liable for taking it down. Now is is completely stretched to allow what has become behemoths who control a lot of flow of information in our society, to engage in censorship of that information and to act as editors and publishers of the material. So when they put on their own content like fact check content on to other peoples content, and when they curate the collection and start censoring particular content, including in many cases direction of fallen governments like communist china, they become publishers and they shouldnt be entitled to the same kind of shield that was set up earlier. Now this executive order is very strong step toward addressing this problem. It sets up a rulemaking procedure that will eventually be under the fcc, to try to get back to the original interpretation and understanding of section 230. It also empowers the attorney general to work with state attorneys general to come up with model legislation that addresses this at the state level. And were preparing federal legislation which, we will be sending over shortly for review of the office of management and budget. So it is an important step, to get back to the original understanding. You know, there is a bit of a bait and switch that has occurred in our society. These companies grew because they held themselves out as Public Forums, as free Public Forums where a variety of voices and Diverse Voices could come on and be herd. That is how they grew. That is how they attracted the eyeballs. That is why people joined them. Now that they have become very powerful network of eyeballs, they have grown by holding themselves out as free Public Forums they have now switched and they are using that market power to force particular viewpoints and thats wrong, and it has to be addressed not only through this executive order but i think litigation going forward, and further action on capitol hill. Thank you, mr. President. Reporter mr. President any questions for the attorney general . Reporter yes, actually, i do, mr. Attorney general not only have you been against section 230 and president has been against section 230 the Vice President says he is against section 230. Do you believe that the executive order the president is about to sign in any way repeals or amend 230 . No it doesnt repeal section 230. Im not against section 230 if it was properly interpreted and applied but it is has been stretched. I dont know anyone hon capitol hill who doesnt believe it was stretched beyond its original intention. This helps us get back to the right balance. Reporter can you give us more details on the legislation you and the president referred to . What do you want in the legislation. There are a number of possibilities and it may be premature we may remove, bill, or totally change 230. What i will say we will regulate. It is a provision and wellregulate it. Take this example. This was just out. Twitter moments mueller witchhunt. So we won. We were in the right. You see whats happened. It is a total fraud. It was a total fraud. 761, okay, 761. You look at it. You think thats fair. Twitter classifies the term illegal alien as hate speech, illegal alien. You just article after article. Here is one. This is our, this is the arbiter, this guy. Is the arbiter of what is supposed to go on twitter. He is the one, he thought that, he thought, used cnn as a guide, cnn which is fake news. Used cnn as a divide. This name is yoel roth, he is one said mailin balloting, no fraud, no fraud, really . Why dont you take a look all over the country . There are cases all over the country f we went to mailin balloting our election all over the world would look as a total joke. It would be a total joke. There is such fraud and abuse and you know about harvesting where they harvest the ballots and they go and grab them and go to peoples houses, they say, sign here. No. Doesnt work. Absentee ballot, cant be there or youre sick, you go to register, do all sorts of things to get that ballot, there is good security measures. But when they send out like in california, millions and millions of ballots to anybody that is breathing, anybody in california thats breathing get as ballot. Reporter mr. President. That is no true. Im not finished. Here is your man. And that is on twitter. And the amazing thing is, hes wrong. Even no matter who it is they will admit he is wrong because there is tremendous controversy on mailin voting. I can say this, the Republican Party cannot let it happen. Go ahead. Reporter you know gavin newsom, Governor Newsom has not sent ballots out to everybody in california. Theyre only going to registered voters. How many are there. Reporter so what youre tweet said was not wrong, was not correct t was wrong. Oh really . When he sends out 28 million ballots in all the mailboxes and kids go and raid the mailboxes and hand them to people signing ballots down the end of the street which is happening. They grabbed the ballots. You dont think that happens . There is ballot harvesting where, we had seven elections for congress and they were like tied and they lost everyone of them because they came and dropped a whole pile of ballots on the table. But you dont think they rip them out of mailboxes . All the time you read about it. You can read about it. Take a look. They do worse than that in some cases they wont republican community, conservative community, they dont happen to send ballots to those communities. There is no way of checking. You have to go, you have to vote. Voting is a great thing. Voting, we would be the laughingstock of the world. If you just used common sense, you know that is going to happen. But they raid the mailboxes. They can even print ballots. They get the same paper, the same machine, nothing is special. They get the same paper. The same machine. They print ballots. And bill would have to do a great job to catch them doing it or your state authorities would have to but you have tremendous potential and you have tremendous fraud and abuse but tremendous potential for fraud and abuse. Reporter mr. President you had said in one of your twitter, one of your tweets you would consider shutting down twitter and social Media Companies. Did you actually mean you would shut down i have so much, it seems influence over twitter in the sense of people wanting to see go twitter because what i have. I have a vast number of web platforms as you know. We have millions and millions of people. I think this, if twitter were not honorable, you will have a guy like this be your judge and jury, i think you shut it down as far as im concerned but i have to go through a legal process. Reporter how would you shut down . I dont know i would have to ask the lawyers. I with have to go through legal process. If were able to be legally shut down i would do it. I would think i hurt it very badly we didnt use it anymore, we have other sites we could use and or develop other sites. Im not just talking about tweeter. Look at facebook. The tribunal they set up at facebook. The woman testifying at congress her hatred was so incredible at Republican Party and me, no way you can get a fair trial. So, this is not like, it is supposed to be. This is not like it is supposed to be. So were going to see what happens. You know what . I guess it is going to be challenged in court, what is it, i think well do very well. Go ahead. Reporter as to potential litigation, can you discuss the timing of that and what is remedy that youre going to be seeking . No, what i was referring to, there is litigation going on all the time on section 230 and its scope. We would look for appropriate vehicles to wee in and file statement of interest. Ive asked the attorney general, fbi and the attorney general to take very strong look and to see what went on, because that was a very, very bad thing that i saw. I can tell you, i think what i saw was not good, not food. Very bad. Anybody else . Reporter are you definitely staying in the u. S. China trade deal . Well be announcing what were doing tomorrow with respect to china and we are not happy with china. We are not happy with whats happened. So thats President Trump moments ago in the oval Office Taking questions from reporters right before he signed an executive order targeting social Media Companies. Some questions at the end on other topics but well focus on twitter and other social Media Companies now with instant analysis. The judge joins us, andrew napolitano. Fox news senior judicial analyst. Also on the line with us is Adam Lashinsky. Adam calling in from california, the fortune executive editor, fox news contributor. Adam, stay on hold, i need a minute or two to talk to the judge on some legal questions before we come to you on some of the company questions. Judge, this executive order the president has now signed he said at the beginning of his remarks there, this all started by the way when twitter fact checked one of his tweets, obviously not happy about that. Now he signs an executive order where he says twitter is not a neutral public platform. So it seems if he is trying to take away a liability shield from social Media Company like twitter based on the fact that it is required to be a neutral public platform. Is it . No. It is not required to be a neutral public platform. Now the world is very different today in 2020 than it was in 1996 when this section of the Communications Decency act that gave platforms like twitter and facebook in their infancy in those years the liability protection, but one of the president s favorite supreme occur opinions, i happen to like the opinion myself, Citizens United expressly says, that corporations have freedom of speech. So the president s executive order which i have not seen, i dont think any us has a company yet and editorial comment by the attorney general are totally out of line. The government cannot censor speech, it cannot interfere with free speech. It cant threaten free speech and cant chill free speech. Chilling occurs when the government engages that causes the thinker to think two or three times before he expresses his opinion. The Supreme Court condemned all of that. Attorney general barr should have revealed all his negative comments about section 230, it was just upheld by unanimous panel of the United States court of appeals for the d. C. Circuit which is couple blocks from where his office is last week so has portrayal of it as weak and undermined and out of touch and grossly misused and out of proportion is not shared by the judiciary. The judiciary decides what these statutes mean, not the attorney general and not the president. Connell so if this executive order is challenged, the president says he will pursue legislation on this topic as well, that is a separate issue, but if this executive order is challenged as the president moments ago predicted it will be how do you predict that challenge will go . Well, the executive order is essentially toothless. Again i havent read it but it is a wishlist on the part of the president and those who drafted it for him they would have the authority to observe and manipulate the inner workings of twitter, facebook, and the other platforms to the extent that they would do something to harm twitter, they would be enjoined from doing so by the first court that looked at it. To the extent he is toe telling the attorney general to form a commission investigate it, there is no harm until the attorney general documents in court and accuses somebody of something. I dont think the executive order goes away right away. Connell one more legal question, then i go to Adam Lashinsky on the companies and how they might be doing this out in Silicon Valley. On the legislation, the president says he will pursue legislation. We dont know exactly what at that might entail, he was asked about it in those remarks. President trump says one of the things we may do, change or totally remove 230, referring as you have done multiple times section 230 of the 1996 law, Communications Decency act. How would that work, and what might the ramifications would that be if it were to be removed in legislation down the line . If it is removed in legislation then it is removed. Legislation as we all know can only come about about congress. I doubt that happens between now and election day. If President Trump is reelected, people share his view that Republican Party controls the house as well as the senate in 2021 they will probably have a shot at removing legislation. But if section 230 that grants immunity to the Bulletin Boards of a poster of it, be careful the president should be careful what he wishes for. Facebook and twitter will be forced to police their own postings. They can remove whatever postings they want removed including those from donald trump. Connell that is a very interesting angle on all of this. Let me take that to Adam Lashinsky because what the judge brings up, were a long way from getting there, i think it is worth pointing out that some democrats expressed reservation about this section of the law including i believe in past comments, former Vice President joe biden. Is there a nervousness building up out where you are, adam in Silicon Valley about how all this is playing out . Absolutely and well before today. Ive been following section 230 issue very carefully. Everything the judge said is 100 accurate. Facebook and twitter and google, youtube, and others are very concerned eye bought losing this exemption from liability. My sense here without having read the executive order, president is in varying ways is trying to throw the kitchen sink at big tech. One thing the judge said is right, that cant happen quickly. Obviously this has been an enormous issue during the pandemic . Right now theyre shutting down subways overnight in order to clean it. That is not sustainable, of course. There has to be a way for people to feel safe to get back on the subway. One of the biggest things for employers in new york, they dont feel like currently they can require their employees to come in if they have to ride the subway. It may not be safe. So theyre evaluating different ways of doing that in the stations, at the end of the runs, overnight and theyre going to figure out the most effective way for them to do the job. Melissa i know hospitals have been looking at this technology for a long time but i wonder about other applications. Could you have Something Like this in a school . Is it Cost Effective and would it work . Yeah. I mean the beauty of our technology is that we can miniaturize this. One of our units is six inches nine inches, cost 4,000. We have them installed in kindergarten classrooms where kids touch a lot of things. Theyre great in disinfecting. Theyre being used in hotel rooms, condoses, residences, foot processing facilities.
