Its good to have you on the program this morning, senator. Thank you so much for joining us. I want to ask about qualified immunity. I spoke with the ag about that this this weekend. He said if you dont have qualified immunity protections for the police, youre not going to have many people want to go become Police Officers. Yo. Agree agree with that. Thats talking about eliminating qualified immunity. I look at this in running a company for 37 years before i became a senator, every business has inherent liabilities to what they do and the business of Law Enforcement has got to be one of the most difficult and tricky ones out there because you suit up, your life is at risk every day, you never know whats going to happen. But when you evolve through the judicial review thats kind of protected unions to be able to maybe not have that accountability and transparency, you do not want your entity to be stigm stigmatized by cases. When you goat the point where thats kind of the emblem of what you do, youve got to make tough decisions and nobody should want to have no accountability or not have ability to redress it and you need to change procedures and protocols that fix it and my idea is if you do not at least talk about it, put a template out there, youre going to end up having something where a year or two down the road political winds change, it gets eliminated and that would make that job youd have mass exodus from people going into Law Enforcement. So its a tricky balance between accepting some accountability, getting rid of those horrific incidents and rebuild what is so good about Law Enforcement because they do such a good job in general. Maria so the collective bargaining agreements, what do you say about that . Because some people feel like this union hold is one of the reasons we cant see reform move forward because of just that. Theres bargaining agreements that keeps the police protected. Thats the irony of the whole discussion, because that would be part and parcel of a democratic philosophy that has allowed unions sometimes to bargain to the point of being ridiculous. It happens in other Public Employee unions as well. It has a lot of inherent contradictions. Running an operation is never simple. I think its in their own best interest to maybe do something that shows they want to be accountable and transparent without hampering them with frivolous lawsuits. Maria yeah. I understand what youre saying. Let me switch gears, ask about china. The president is defending the china trade deal, shutting down remarks by trade advisor Peter Navarro that the deal is quote, over. I spoke with u. S. Attorney general bill barr this weekend who told me exclusively that American Businesses are prioritizing profit over patriotism. Watch this. They havent been competing fairly and the president has confronted this when no one else has and the American Business community has been a big part of the problem. Because theyre willing ultimately, many of them, to sacrifice the longterm viability of their companies for shortterm profit. So they can get their Stock Options and move into the gulf resort. Thats whats driving some of this. Theyre not taking the longterm view and the national view. The american of maintaining the american strength. I wont list all the things that they do, but until President Trump came along and maybe having a stark assessment like barr just issued, weve given them too much slack. And yes, i come from the world of business, dont like tariffs but china is not going to listen to normal discussions and it has gotten to the point where if we do not get tough with them, we do not have businesses start to diversify their supply chain to not be in kahoots with a country like that, thats a bad business partner. Sooner or later that will come home to roost. The administration has it right, Business Needs to know thats not a good longterm relationship to have anyway. Maria well see if they get it. California has a mask controversy, governor gavin newsom is urging residents to wear masks in public place as coronavirus cases spike throughout the state. But some local officials and Police Departments are pushing back on the governor, refusing to enforce the rule. Joining us right now is fox news senior judicial analyst, judge andrew napolitano. Judge, great to see you. So is the mask mandate enforceable by law . In a word, no. If youre talking about the public wearing a mask in a public place, you know, its hard to get your finger on all of the judicial rulings that have addressed this but looking at them, the general trends are theyre going to give governors the benefit of the doubt when it comes to entities that are regulated by the state. So they are going to allow governors to enforce things like 25 or 50 of capacity in a restaurant and restaurant servers have to wear masks. But the concept that the public has to wear a mask on a public street is simply not the law, not enforceable, and theres very little that Governor Newsom can do, other than like Governor Cuomo did here in new york, make a plea to common sense. It makes sense to wear the mask. You may not like it. It may be uncomfortable. Its particularly miserable this time of year. But its the right thing to do. But he cant give people tickets or lock them up or even involve the police in this issue. Maria i mean, the cdc said its effective, it actually is saving many of us from getting sick. So its a recommendation but it sounds like a smart one. I want to ask you to switch gears because pennsylvanias highest court granting bill cosby the right to appeal two key issues in his 2018 conviction, that conviction on Sexual Assault charges. What are the implications here, judge, especially for the other me too cases . Well, this is a unique me too case, maria, not only because he is a celebrity but for two reasons. One, the evidence of his guilt is overwhelming, truly overwhelming. However, he may not have received a fair trial. And thats what the Pennsylvania Supreme Court is going to look at. Im surprised they took the appeal. There must be members on that court, theres seven justices on that court, who are really concerned about whether the trial was fair. Theres two aspects of the trial that are being challenged. One is an agreement he had with a prior prosecutor that if he testified truthfully in a civil deposition about his relationship with a woman, he would not be prosecuted. He did testify. The testimony was found to be truthful. And then they used that testimony against him in a subsequent prosecution. So is agreement with prosecutor a enforceable on prosecutor b. Thats issue one. Issue number two is the trial judge permitted six females to testify against him who were not defendants and who had never filed complaints against him. So he permitted what we call, the trial judge, prior bad acts, prior bad behavior. Normally, that is taken into account only for sentencing. But by painting cosby as something that he was never accused of being, that may very well have violated his rights. Those are the two issues the Pennsylvania Supreme Court is going to look at. Whats your assessment in terms of how much more wall we will see and is the community in arizona happy about this wall . So, maria, first of all what the president said is exactly right. Thats what weve been saying for a long time that Border Security is National Security. It matters. Like i said yesterday, its just common sense. We got to know who and what is coming to our borders. And its important that we stop drugs from pouring into our country at the border. We stop the criminals that the president talked about at our of borders to prevent them from coming in our cities and increasing Violent Crime and its important that we stop things like Infectious Disease like covid19 at our borders and prevent it from entering our country. Its just common sense. And the wall is working. And we continue right now, were absolutely confirmed that by the end of this year were going to meet that 450mile goal of brandnew wall system along the southwest border. Were confident were going to hit that goal. Maria i count believe what i saw couldnt believe what i saw when we took the show to the border. I told you the story before. But as were standing there, viewing the border wall, we actually watched people crossing the border and illegally coming in and in many cases it was a lot of children. So its not just actually illegals coming in but its actually the danger that children are being put in and also before you actually get to the wall, you have to pass by these gangs that are shaking you down for money just to get past go, so theres that danger as well. Maria, youre absolutely right. Again, ive always thanked you for actually going to the border. When you talk about this you talk from an informed position. A lot of people that talk about this are uninformed. Theyve never been there. They dont fully understand what theyre talking about like you just said. Thats exactly right. So the individuals coming here, i mean, theyre being exploited. Last year, Border Patrol and cdp officers conducted over 4,000 rescues. 4,000 rescues of people risking their lives trying to come across. That has dramatically been reduced. This is also in the best interest of the immigrants themselves. That they must abide by the rule of law and do so legally instead of trying to enter this country illegally. This president s been committed to this and the wall is one of the elements hes given us. Maria one of the reasons i asked you about the community where r that wall is in arizona is because arizona is one of these battleground states that the president is hoping to win in november. What does the Community Say about that . Do they recognize the drugs and the illegals that have been stopped as a result of this wall and also the president signed that executive order on monday, it su suspended some temporary worker visas through the end of the year, the latest effort by the administration to prioritize American Workers in the aftermath of covid19. Here too, the move has come under fire, from Major Technology ceos, theyre saying this will drive skilled workers overseas. What im trying to understand is the impact on the people of all of this and is the perception really reality . So on both fronts, what i would say to both, on the visas and the wall, a common sense approach. You heard from the community. You heard from the chief of police down there. Nonpolitical, apolitical statement based on facts. She talked about what shes seeing there when the infrastructure went up and ebbintechnology and more person, she saw crimes in her community go down. It was related. You heard that from the chief. Thats what we heard from the mayor. Thats what we heard from the governor. So it was a very positive, very honest discussion that we had yesterday. And i can tell you, on the executive order, its the same thing. Its a temporary eo that the president has done to really just put Americans First as were seeing this unprecedented unemployment because of covid, it just makes sense, maria. Hey, lets give americans the first shot at these jobs of its just common sense. Its not real complicated. Maria its a tough time. I know there were lots of ideas bandied around after hong kong and china started overreaching in hong kong. Some people were saying, well, why doesnt the u. S. Show us a show of support for the hong kongers and do a special visa for hong kongers to come in and there too it was met with wait a minute, 45 million americans have filed for unemployment benefits. Weve got a problem here, taking in all of these people from hong kong is not going to be a good answer, given that americans need their jobs. So i get it. The president weighed in on securing the borders. He said to save thousands of american lives during the coronavirus, heres what the president said with you yesterday. Easing our Emergency Public Health authorities, we prevented a coronavirus catastrophe on the southern border, shutting down human smuggling and swiftly returning the crossers. And again, the wall has helped that too. Anyone who says its just theyre not being intellectually honest. What weve done with cdcs Public Health order, title 42, that enables the individuals that wee we encounter in the bo, instead of introducing them into the system, instead of introducing the covid spread from inside the borders, were able to remove them immediately and 96 of those were done in a public hours due to the Public Health order. The school says Remote Learning will remain the norm this fall. Tuition at harvard topped 65,000 a year, several other schools faced similar lawsuits including columbia university. This is an interesting story, cabot, and something ive been thinking about lately. If students are doing everything online you are missing out on University Life. Should tuition stay the same . Cabot well, i think its reasonable for students to use their Market Forces to try to get schools to lower tuition. Weve seen a 300 increase in tuition since 1990. Students have been willing to go along with that, a large part of that is because they have an Endless Supply of federal loans at their disposal. Of ive talked to dozens of students. The consensus is i understand the past semester things were crazy, the universities had their hands forced on having to compromise the experience. This coming fall, students are saying im not going to pay full tuition if im not getting the full experience. Universities have to offer the Traditional College experience, those are things students pay for. If universities are not offering that full experience, students arent going to pay. Schools are going to have to lower prices on their own to keep attracting them or i think well see a dip in enrollment this coming semester. Maria i agree with you. Dagen remarks do you think . Dagen, what do you think . I think well see a fundamental structural change in how people get educated because of what theyve been doing the pandemic. Dagen i think parents will be asking if theyre footing the bill for the universities. Not really harvard. Harvard, you get out, you graduate and the world is your oyster because so many rich and successful people went to school there, its easy to get a job. With universities that charge close to that amount of money and all your kid is learning is how to funnel a beer and getting out and not having opportunities, maybe its not worth a quarter of a Million Dollars. How is harvard spending the 41 billione 41 billion endowme . You cant cut the tuition for the kids a little bit . Suck it up. Maria yeah. I would think you lose the University Life and the biggest portion of your cost is the dorms and living there. So its interesting to me that youre not seeing any change in the overall tuition. To me, that doesnt make sense.
