The same prosecutor who tried to give the sweet plea deal about a month ago. According to republicans, that just does not simply pass muster. Its pretty clear that there probably would have never been a plea deal or effort to resolve this case without the whistleblowers coming forward. I would like to point out one little fact that came out in the pleading that was filed by the defense. They have four law firms on this case representing the biden family. They referenced in their pleading yesterday that the prosecutors reached out to them in may of 2023 just this past may to give an invitation to initiate plea discussions. Thats a pretty crucial fact when you look at the timeline of what was happening with the whistleblowers come forward. If you recall, i wrote a letter to various committees of congress on april 19th of this year noting that i represented a whistleblower who wanted to come forward in a Major Investigation to discuss Conflict Of Interest and possible false statements by a president ial appointee. In may 24 is when Gary Shapley First came forward and revealed he was a whistleblower to come forward. The timing is precarious when the defense says the government reached out to have a plea in may, the same month. It makes it sound like they were never going to charge this case but because the whistleblowers were coming forward, they decided to just see if they could get this thing resolved quickly. They moved too quickly and made a bunch of mistakes like theyve made mistakes throughout the investigation. Dana could you react to Congressman Goldman . This is what he said Sunday About Weiss becoming a Special Counsel. I want to get your take. David weiss, The Trump Appointed u. S. Attorney in delaware was right all along. He had ultimate authority and when he requested Special Counsel status because the Plea Agreement thats broken down and he may have to charge hunter biden in outside of his own district, which he requires Additional Authority to do, he got it. Dana how do you react to that . Well, i think were hearing different statements from mr. Weiss. Weiss has come forward and said first he wrote three letters to congress saying the first letter said he had all the authority he needed to charge anywhere, any time he wanted to. Attorney general garland was echoing those comments that weiss had all the authority and even more authority than Special Counsel has. Then he wrote a second lets saying its common practice to consult with u. S. Attorneys in other districts to partner up with them if you want to bring a case. Only in those circumstances if thats denied would he seek Special Counsel status. Well, gary shapley, if you recall, his october 7th, 2022, meeting the red line meeting where weiss told him that and other executives with the Law Enforcement agents that he tried to bring it in d. C. And tried to bring it in l. A. But he was refuted and denied. And he sought Special Counsel back then authority from d. O. J. And declined for that. So these statements are bouncing all over the place. When Attorney General garland said that weiss had more authority than a Special Counsel, the fact he has been appointed Special Counsel did he get a demotion . Their statements dont make sense with each other. They are across the board. Really appointing weiss as Special Counsel now doesnt give confidence to the American People that this thing will get done the right way under the facts and law. Bill lets try to squeeze in two more. Dana do you think the timing and appointment of david weiss as Special Counsel is suspicious . Well, there is so much history under the water over the dam. The blocking of investigators efforts to try to get to the bottom of any connections following the money, any connections with the father, blocking those steps, and then coming forward now and appointed him as Special Counsel. He is the wrong person. Ive always called for a Special Counsel in this case so that somebody neutral could get to the bottom of the facts and charge the facts under the law. But also bill people would argue that weiss is not neutral because he has been on this from the beginning quickly. Without the house hearings, many of this stuff we dont know. Now that you have a Special Counsel, do the house hearings happen . Does weiss appear before a House Committee at the end of september as he is scheduled or not . Well, i dont work for congress or the department of justice. It seems to me congress has the authority to force people to come and testify under their oversight authorities. Where are we today . 2023 in august, donald trump a commanding lead at 44 , trailing him by 24 points is ron desantis. Does he make a move in the caucus come january 15th . That part of history as well. If they were held today trump would win. If they were held today, they arent scheduled until january. There are five months here. We havent had the first debate going forward. Donald trump has 44 of the vote in the iowa right now. That means that 56 of republicans want Somebody Else. In New Hampshire he has 42 . That means 58 of republicans want Somebody Else. This thing is fluid. A lot can happen. The reality is right now he is winning because no one has been able to consolidate the nontrump vote. But there is a lot of time between now and then and their debates. Our debate next week and other debates. So this thing can change a lot. Bill let me go through a few things here. All that will be forgotten in about what, nine days . If desantis makes his mark in that debate, he will have some momentum there in iowa. Huge. It all depends on how he performs and how other candidates perform. Somebody else could have a great debate night and surge out of the debate and start getting support. It will be the first time republican primary voters are taking a serious look at these guys and having a chance to judge them on how they perform. Keep this in mind. The republican electorate is in three buckets, right . A quarter of the electorate would wont Support Trump no matter what. A quarter of the electorate who are hard maga who are only considering trump. Polls show 50 of voters in the Republican Party are considering trump, considering other candidates. 75 of the electorate is up for grabs. What makes this so unusual is that these hostages are still under the control of the iranians but were discussing the specifics of the deals. Iranians leaked it to the new york times. They didnt publish it but the administration said we dont want the specifics of the deal out there in public. We may lose the deal. But then iranians went to other sources and they are transmitting this as hostages being released and ransom being paid. That is in their Public Interest to transmit it that way. I spoke to an Administration Official on this who called me and what he is trying to tell me is that this deal will have guardrails in terms of where that money goes and iranians will not be able to have control over that money. I think we have to take that with a dose of healthy skepticism given this regime and its ability to manipulate its own population and all the sources in it. For me the takeaway is certainly we want these hostages to come home. What is happening to their families is awful. The trepidation they have right now when they see this debate going on and yet their hostages are still in iranian control. When i look at it, i say regardless of the guardrails or not in terms of the money, is this to irans benefit . Is it incentive for them to do this again . The overwhelming conclusion it is. When you select this method of providing 6 billion regardless of where the money goes, is that a good deal for the iranians . I think the obvious answer is and will be an incentive for them to continue to take american citizens hostage. An Extortion Business theyve been at since the 1980s and had a handsome payoff for them.
