Paul welcome to the journal editorial report, im paul gigot. The Supreme Court on wednesday agreed to decide whether former President Donald Trump should be immune from prosecution in his federal election interference case. Dealing a blow to special counsel jack smiths effort to try the former president and likely 2024 republican nominee before with no. Oral arguments are now set for late april with a decision expected by late june. A timetable that could push the trial originally set to begin this monday close to election day and possibly beyond. For more on the political and legal implications of the justices decision to take the case, im join ised by Wall Street Journal columnists Dan Henninger, kim strassel and bill mcif gun. So, bill, the bill mcgurn. If Supreme Court didnt have to take this case the Supreme Court didnt have to take this case, and theres an argument for dodging it because they could have let a d. C. Circuit opinion that denied immunity stand. Now they take this, they rule one side or the other is going to hate them. Right. I think you said before the Supreme Court is the only institution in washington thats functioning [laughter] and i think, seriously, i think this proves it because its the easy thing to do would be to just with let it go by. And as you say, its complicated. I dont think theres a Black And White answer. It has to do with whether what he did was in The Outer Limits of his official duties. That line has not been drawn. Paul right. So theres a lot of questions where you draw if it applies to trump. So i dont think theres a clear cut answer on each pseudo. So, again, the easy thing would be to punt because a lot of people are going to be unhappy whatever they choose. I think donald trump benefits, as usual, by having unhinged enemies that overreach all the time if the d. C. Circuit court of appeals had been more modest in what they agreed to, i think the Supreme Court might have not taken it. But i think they put the Supreme Court in a position cant pass the buck, were the place that adjudicates these things, and we have an obligation to the constitution to do it right. And we hope the one thing wed be better on all sides, if they could read the case and just instead of trumps name, read president s, because its going to apply to all all president s afterward, possibly even joe biden. Paul theres a precedent, dan, a Supreme Court case in 1982 where the court said that former president s are, have absolute immunity from prosecution against civil lawsuits. For acts that are within the outer perimeter of his official duties. This case is going to decide if that immunity applies to criminal prosecution as well, and thats what the justices are going to be looking at. With yes, exactly. And, but i think we should say i dont believe the justices are going to themselves decide whether trump committed a criminal act paul no, no, no, not at all. Some people, i think, expect that, that somehow the Supreme Court is going to decide trump committed a crime paul thats for the trial judge. Whats going on here is whether President Trump had immunity for these acts. And if he didnt have immunity, then the case is going to go back to jack smith and judge chut ca. Otherwise, or it goes back to the trial court for a finding of fact paul probably if the Court Remands that case back, finds he the does have absolute immunity and then says, okay, but we dont know if these acts were in the outer perimeter. Thats for the trial court to look at and investigate and go back and lets keep in mind theres an almost obsession around the idea that this involves donald trump. And i think whats important here is that the Supreme Court understands what have they do is going to set a precedent which would, could affect if future president s. President s make tougher decisions all the time. And if a president has to sit there while in office trying to figure out whether hes going to be criminally prosecuted after hes out of office, theyre going to be consulting with white house lawyers all the time rather than Making Decisions in the interest of the public good. Paul and that was the argument about civil lawsuits in the nixon v. Fitzgerald case. Kim, lets talk about the timeline here. This really does push things back for jack smith. Lets say that the president has, is found not to be immune, jack smith, and then go to the trial. But the Supreme Court, they wont issue a ruling until may or maybe even june. And then that will push the trial judge has said the parties need, you know, as much as three months to prepare for the trial. If that pushes it right into september which is, i mean, talk about a tough decision for Merrick Garland. Are you going let that trial proceed in the middle of a campaign . Well, to be very clear, Department Of Justice guidelines would say that you would absolutely not allow that trial to continue because they have a very firm rule written around the Justice Department interfering or using prosecutions or engaging in prosecutions in a a way that can affect the outcome of elections. Theyve always struck very strongly to that. By the way, Ask Hunter Biden whose own prosecution we now know was delayed multiple times because of the fear that this would somehow interfere with Joe Biden Ask and his campaigning. And hunter wasnt even the one on the ballot. So they have taken it very seriously in the past. Tough call for Merrick Garland, but the pressure is going to be huge, paul, because the left is already fretting and rubbing its hands about what will happen if this gets pushed beyond the election and, therefore, trump if if he were to win would have the ability to dodge any more prosecution because doj policy says you dont prosecute sitting president s or potentially just ab absolve himself. Paul and if the court finds that trump does have immunity and sends the case back to the trial court for fact finding, hen that probably extends it past the election and maybe even into 2025. Paul the biggest day of the 2024 primary race is three days away as voters in 16 states get set to head to the polls on Super Tuesday. Republican frontrunner donald trump is looking to build on this weeks win in michigan and knock challenger nikki haley out of the race once and for all. But tuesdays results in the wolverine state reveals some political per if april for the former president as well as for President Joe Biden with more than 10 is 0,000 michiganders Voting Uncommitted in the democratic primary. Lets bring in Fox News Contributor and Wall Street Journal columnist karl rove. Karl, welcome. Ing what did we learn of consequence from the michigan results for the two candidates . Lets start with trump. Well, theres a little bit of bad news amidst all the good news. He won and he won convincingly. But take a look at this. In iowa Donald Trumps final vote was 4 points under the real clear politics average for what they were projecting his margin to be. In New Hampshire, 8 points under. In South Carolina, 3 points under the average. Theres no average for michigan, there were only two polls in the weeks running up to it. So, but it was he ran 10 points behind the margin that was anticipated and won and 18 points behind the margin in the other. So there is something going on out there with a large number of people who are supporting, you know, nikki haley. Not, obviously, shes not winning, but shes got a significant number of people supporting her. And for some reason, hes consistently coming in below what the polls are projecting n. 2016 we had the shy voter, the people who said paul right. Because it may be socially unacceptable. We may have the reverse this time. Paul for joe biden, that big 100,000 votes cast for uncommitted is a pretty big signal for biden. But with i guess the question is, is that sort of just a temporary rebuke and once the choice becomes biden versus trump in the fall, theyll return to biden . Yeah. Well, thats a big question. And, look, there is traditionally 23 of the vote in michigan is for uncommitted, even in Barack Obamas reelection bid there was a small number of uncommitted. But it is a significant number. But thats only one of the problems. The other problem is, look, hes been getting good numbers, 96 in South Carolina, 64 as a writein, 81 in michigan. But heres the big issue, another big issue that we havent paid as much attention to. In South Carolina four years ago, 539,000 voted. This time 131,000 voted in the democratic primary. New hampshire, 298,000 voted in the democratic primary four years ago, this year 124,000 paul right. Michigan, 1. 6 million, 768,000. So some of that dropoff is its not seriously contested, but also i think part of it is were not enthused, say a lot of democrats, particularly younger, black and hispanic democrats. Paul nikki haley, on tuesday does she have to win own were one or two states to have a credible case for going on . I think she does. But she lost South Carolina and then the got a Million Dollars in small donations in the next 24 hours. And when she went to detroit, michigan, if you watched that video, you would have thought she had just come off a huge win in the palmetto state. Of theres something going on there. People are sort of saying, you know what . I want to send a message, im for anybody but donald trump inside the republican party. Well see how that is this next week, but shes got to do better than she did in her own home state to stay in, i suspect. Paul what about the argument that shes saying staying in the race to rack up some delegates so she has some leverage come the Republican Convention in july where she could negotiate with the trump folks and say, look, uhuh deserve a prominent Speaking Position at the convention and, you know what . You should make some Policy Compromises with me because i have a lot of support for some of those particularly like aid to ukraine or nato. Yeah, i think that thats plausibling. Im not certain donald trump finds himself in a a position where he ever thinks he needs to negotiate if hes to got more delegates. But i think thats well with worth her staying in, to make that message. And, look, shes been sustained in this not by some huge force, but by lots of ordinary americans who say i want to have a choice. Shes been outspent and shes running against the incumbent. He is the former president , after all paul right. And for her to do as well as shes done so far is an indication, you know, majority of republicans in iowa voted for somebody else. 40 some odd percent in New Hampshire voted for somebody else. 40 in South Carolina voted for somebody else. I mean, theres a significant number of people inside the republican party, excuse me, 30 in South Carolina voted for somebody else. Theres a significant number of people who are saying we want to have, you know, a different nominee, and donald trump has got to do something to patch that up. Paul but is that the dominant your mention of trump the running as an incouple belt, essentially, quasiincumbent, is that the dominant fact on the republican side of this are election primary campaign . Republican voters just think, look, he was denied a Second E Eternal for whatever reason, and we just think he deserves another shot at joe biden, thats what really fundamentally whats been going on here . Yeah. I mean, thats a significant driver. Obviously, theres another driver of, you know, the forces he are represents ideologically, maga, the neoisolationist, neotoprotection ifist views that we have. But i think the main driver is he was our nominee, he was our president , times were better. Something happened to him in that last election, maybe i believe it was stolen or he simply lost, but he deserves another shot. And i think thats the main driver in it. Paul that was Mitch Mcconnell this week announcing that he will step down as republican leader after the november election. Marking the end of his 17year tenure at the top of the gop conference, the longest serving Senate Leader in american history. Mcconnell will perhaps be best remembered for remaking the federal judiciary and the confirmation of 234 judges including 3 Supreme Court justices during the Trump Presidency alone. But the 82yearold acknowledged on wednesday that the politics within his party have changed and that it is time for a new generation of leaders in the senate. We are back with our panel. So, kim, what do you think Mitch Mcconnells legacy is as Senate Leader . Well, hes going to have a lot of legacies, paul, but i think the ones hard going to be remembered are, most importantly, the efforts he got to get a majority starting in 2014 and to keep that majority there in the early parts of the trump years. That was especially important when you had that, when antonin scalias death happened, and he kept that seat open. He essentially at that point put donald trump and his pick for a Supreme Court on the ballot. That may well have helped donald trump win that election are. Obviously, they went on for, to fill three Supreme Court seats under Donald Trumps tenure, remade part of the federal jewish disturbly and used that majority to really enable other aspects of the Trump Presidency from the if tax cuts, for instance, to rolling back a lot of obama regulations. This was a guy who knew how to get things done as a Majority Leader. Paul i dont think donald trump is president in he doesnt keep that if he doesnt keep that seat open. They wouldnt have the court legacy without mcconnell. So the left, obviously, dislikes mcconnell for the reasons kim said, he was effective. Why do so many conservatives dislike him . Well, you know, they call him a rino, republican in name only. They believe the party has moved in trumps direction. That the party is more populist rather than traditional republican. Paul, we could sit here for another hour, hour and a half trying to decide whats the difference between the populist trump party and the traditional i mean, Mitch Mcconnell got trumps tax cuts through paul sure. That was a reaganesque policy. He got the deregulation through by rescinding Paul Reaganesque policy. Populist, of course, maybe not as internationalist in terms of ukraine, for instance, but by and large i think one of the things you have to keep in mind here is that this is a political body. This is the senate, and you need a majority of votes, often 60 votes, to get anything done. And Mitch Mcconnell, or any Majority Leader whether it was lbj, their talent was collecting all of these votes and trying to get them going in the same direction. We live in an era where politicians, senators are on television all the time, they want to be influencers, they want people to Pay Attention to them, and i think part of mcconnells problem as was Kevin Mccarthy s In The House E members dont think theyre being listened to as much as they should, that their concerns are not being paid attention to. Ewell, the leader has to herd cats, and this was a tension there,s or i think, thats going to have to be resolved by the next leader of the republicans in the senate. Paul yeah. Bill, he understood that his constituency with Susan Collins of maine, in a blue state of maine on one side, and then the various senators on the right on the other. And and he, his job wasnt, he wasnt an excellent public speaker, never has been. He was not a great salesman. But he is [inaudible] if. Paul was listening to the members and making sure cow get two numbers. Hes told me many times, 51, a majority, and 60 to break the filibuster e or to hold one if you can get 41 to stop yeah. In addition to getting appointees on the Supreme Court, i think he deserves a medal for keeping Merrick Garland off the Supreme Court. I think as attorney general, you get a hint of what how politicized he might have been if he was approved. But he was very successful. As dan kind of intimated, theres a difference between being a senator and youre free to be pure and take all positions you want and being Majority Leader which means Cobbling Together A look at the house in disarray. Its more conservative than the senate. I dont think it has more achievement. Did Mitch Mcconnell vote for more spending than i would like . Yes. He voted for the chips act. I think the infrastructure bill. A lot of those things. But on the whole in remaking the federal bench and he also did it with very small majorities. Like, when Brett Kavanaugh was confirmed, was it 53 it was very close. Paul very close. He never had more than 55 republicans. Yeah. So its even more an achievement then to pull off what he did. And i think hes underappreciated. And i like his public speeches. Hed go out on the floor and say i was considering what the senior senator from georgia he had a purpose. He usually was effective in seeing that purpose through. And its very easy to look at votes and say, ah, i wouldnt have done this, especially over 17 years, right . But were going to find people are going to miss his effectiveness in getting things through. Paul bill, theres no education in the second kick of a mule, is one of his favorites. [laughter] still ahead, President Biden and former President Trump make dueling appearances at the southern border as the issue of Immigration Takes Center Stage in the 2024 campaign. Paul joe biden and donald trump made dueling visits to the Southern Border On thursday as the issues of immigration and Border Security take center stage in the 2024 campaign. President biden met with Law Enforcement and local leaders in brownsville, texas, while former President Trump was more than 300 miles away in eagle pass which has seen record numbers of migrant crossings. Mr. Trump blamed the president for the lawlessness there while President Biden challenged his predecessor or to join him in supporting a bipartisan Border Security bill. If. The United States is being overrun by the biden migrant crime. Its a new form of vicious violation to our country. Migrant crime. Here is what i would say to mr. Trump. Instead of Playing Politics with the issue, instead of telling members of congress to block this legislation, join me. Or ill join you in theming telling the congress to pass this bipartisan Border Security bill. So, dan, biden is Careerly Playing clearly playing defense on immigration, but was it smart in that case to go down to the border and highlight that issue. Well, it could have been smart depending on what he did down there. There was some expectation that he might make some emergency orders, announce even an Executive Order to reverse some of the ones that he reversed of trumps such as the remain in mexico. He did not do that. He went down there and instead appealed for papassage of this bipartisan bill which was completely quixotic and fruitless. That bill was dead on arrival. It had a lot going for it, but thats not going to happen, and thats all he offered. The problem is that he came into office, reversed all these trump Executive Orders and then, clearly, we now know the Biden Administration had no plan b as to what they were going to do after that. They have let the Border Run Open for two years and, uncredibly, migrants have now become the single most important political issue in the United States with President Bidens approval on it well well, around 30 percent. So theres no evidence that the president has figured out a way to mollify concerns over the migrants coming across the border. He will not take any action to stop that. Paul allysia, do you flee agree that at do you agree that he basically has to start taking some firm actions . Now, theres been leaks from the white house that hes going to do something including perhaps if trying to reinterpret the Asylum Standard for granting asylum for migrants. Does he have to do that and more . Well, i think he would probably try to do a lot of what is actually in the bill, and that would be tightening Asylum Standard, restricting it to people who couldnt migrate to other places than their home country, raising the credible fear standard for just even getting screened and passing through to the country or to the u. S. Also a big push among republicans is when you, quoteunquote, catch and release them, put Ankle Bracelet or some kind of gps tracking which theyve been really reluctant to do. Theres also some talk about maybe him reinstating or renegotiating remain in mexico. I think that might help paul that requires mexican cooperation. That requires mexican cooperation. The big problem that actually donald trump faces that a lot of his Executive Orders were stopped by the courts. Biden made may experience the same obstruction. At least hed be showing that he was actually trying to do something. Paul kim, do you think the president was, is smart to kind of say to trump, look, dont just block whatever theyre trying to do in the senate, but help me get something passed . And what do you think about whether or not trump should cooperate . I dont think he will, but should he politically . This is the new strategy. This is the new white house strategy. Biden went down there to look as though hes engaged at the border, but what hes going to do is try to now increasingly suggest this is all republicans fault, that democrats are ready and willing to deal with this. Look, this legislation was here. Donald trump is standing in the way, republicans are standing in the way. I dont know if that potentially works, paul, but it might be i all he has because, honestly, i dont know if he is going to pull the pen on any of those other Executive Orders because hes already getting such a massive pushback from his Progressive Left who hes worried about already for other issues as we talked about in michigan and other things that theyre angry with him about. So he seems reluctant to do something kind laterally on immigration. So hell try to blame republicans. My own view is this only just encourages donald trump even more to double down and say no, because, look, i think itd be good to pass something, but with donald trump sees this as an issue. And look at those polling numbers, there is no question that biden has a major problem, and its top on voters minds. Paul in 1996 bill clinton gave a state of the Union Address saying the era of Big Government is over, and he turned the tables on, on, on bob dole and the republicans. What do you think would happen if biden got up if the State Of The Union here next week and said, you know what . And he made a big with push on immigration, a big part of his speech . I think it would help him a lot if he did that, but hes not going to do that, paul, and ill tell you why. Were talking here, weve within talking about how biden came into office and reversed donald trump. The fact is biden came into office and reversed the policy not only of donald trump, but the Immigration Policies of bill clinton, george w. Bush and president obama, all of whom deported people who either came into the if country unlawfully or were criminals as defined by dhs. Barack obama deported a lot of people, and biden has reversed all of that under pressure if from the left, and i honestly do not see him changing course. Paul all right, dan. Paul as Opposition LeaderAlexei Navalny was laid to risk in moscow this week, russian president Vladimir Putin stepped up his rhetoric against europe and the United States, warning in his annual State Of The Nation if address that the west faced the prospect of Nuclear Conflict if it intervenes more directly in the war in ukraine with, a aapparent reference to french president emmanuel macrons comment this week that the possibility of sending western troops cannot be ruled out. This latest threat comes as russia makes gains on the battlefield with putin saying his military firmly holds the initiative in ukraine after kyivs recent retreat from the eastern town. Joining me now, fox news strategic, senior strategic analyst and retired fourstar general jack keane. Hes chairman of the institute for the study of war. General keane, good to see you, as always. So, first, what do you make of emmanuel macrons comments on nato troops potentially being sent into yaron . Was into ukraine . Was it a wise thing to do . Well, its a surprising comment and, certainly, i would imagine his fellow nato partners there were a little surprised and raised their eyebrows about it as welch certainly, he would have to coordinate with them given the implications it would mean to nato. I kind of like the idea that it pokes at putin, forces him to think and remind him whats really out there in terms of how much nato could dominate him if they chose to, thats for sure. And i think when the ukrainians look at it, im not sure they want the troops on the ground fighting. They would certainly take frances air power. That, because that would be a gamechanger. Paul pal all right putins response, again threatening Nuclear Weapons. Is it something that i guess we have to take Something Like that seriously, but is iting . That to you think is realistic . No, i dont think it is. Putin is not reckless. Hes a brute and a killer or, for sure, but, you know, hes pretty methodical about how he goes about decision making. And, listen, hes saying this, paul, because its worked. Thats a fact. I mean, the fact that hes been brandishing Nuclear Weapons for the last two years has forced this administration not to deliver the advanced weapons when the ukrainian ukrainians requested them. And its the europeans who finally realized that putin wasnt serious about this, it makes no sense, because there has been escalation and, obviously, to use of Nuclear Weapons, no movement of tactical Nuclear Weapons. And its the europeans who got on to the bluff, and they forced us to provide tanks, himars, longer range weapons systems, finally the attack ems, and eventually, f16s. All forced on us by the europeans ignoring the threat of these advanced weapons could produce a Nuclear Response by rush. That. Most everyone looking at this, certainly theyre going to continue to do it because its had some impact on the Biden Administration. I dont believe its realistic. Paul okay. So militarily right now where does this war stand . If how, how much is russia on to offensive here as most people seem to think it is . Whats happened, paul, is the ukrainians have certainly are on the defense for obvious reasons. Theyre husbanding the resources they have, certainly some of this ammunition needs to be replenished and its not. And, obviously, whats happening in the halls of the congress are certainly an issue. So the russians have taken advantage of that. Theyre conducting limited offensive operations in four different places. Theyve been able to seize towns but its limited. Their casualties are staggering. What has happened on both sides, neither side has been able to restore maneuver. And what i mean by that, you see the russians they culminated with huge casualties. What they havent been able to do once they apeeve a penetration, bring followon forces to exploit if it is and take more ground and territory. That is restoring maneuver. Were in positional warfare right now and probably will remain so is. I think the russians are looking at this very closely to see if the opportunity is there and do they really have the capability in the spring or the summer to conduct a more major offensive with end penetration achieved and followon forces. They have never demonstrated that capability in two years of the war, and certainly thats something that the ukrainians struggle with as well. That is kind of where we are. Paul but, general, i mean, if we dont get those Artillery Munitions to ukraine and we dont give them more air defenses, isnt there a chance at the russians could make a breakthrough . Yeah. If the summer if comes and the munitions are not there and the air defense systems, they need increased air defense system, we will see the russians make gains. Theres no doubt about it. And, look, the Defense Department seems to be on the cusp of finally giving the ukrainians the Long Range Attack ems missiles that go 300 miles, not the cluster munitions. So the ukrainians can hold the targets in crimea at bay. F16s are due to come into ukraine the beginning of 61 of them out of the netherlands and belgium in june. And if the rest of the f6s starts to roll in finishing f16s, the tide changes. But they cant do it without the u. S. Package of weapons systems. And the congress has to approve that, otherwise were on the beginning cusp of losing ukraine starting in the summer. Paul all right. General jack keane, appreciate it. At issue, a pair of laws passed in florida and texas that seek to prevent social media sites like youtube and facebook from Silencing Conservative Vote voices. But should government be in the business of telling Big Tech Companies how to police their platforms . Lets bring in our panel. So, allysia, why dont you tell viewers what the texas and florida laws do. Well, at the very essence they banned, quoteunquote, censorship. So the florida law would ban platforms for, quoteunquote, censoring, Shadow Banning Political candidates for office or any posts about the political candidates. Now, it would also require that the platforms issue notifications and explain why people get booted to the use arers. The texas law would do the same. And the texas law actually many some ways is broader, many some ways is narrower, but it would ban all kinds, any kind of viewpoint discrimination. So based on any individuals political views or otherwise defined. Paul okay. That doesnt sound so awful when you think about whats wrong with Banning Viewpoint Discrimination . Why is the First Amendment implicated . Well, the issue is that as platforms argue they have First Amendment speech or First Amendment rights too, they have a right to free speech, and they claim that they are publishers. Maybe not in the traditional way that newspapers are, but they actually impose and apply Editorial Discretion in what they remove and what they lead up leave up. And basically the government is now coming and essentially forcing and dictating their content and editorial decision. Paul and if the laws stand, a state could tell these platforms, look, you cant do this or that, or the platforms might say, look, we cant well let everything go then, right . Right. Theyll either have to remove everything or leave everything up. Itll be basically and that wasnt what congress intended when they passed section 230 back in the 1990s. Paul kim, what would this mean . Would this mean that government assuming these state law is are upheld this means the governments essentially would be Dictating Editing and standards by the platforms. Yeah. And thats whats really scary, paul. I totally understand a particular conservative frustration over censorship at these sites. But with lets remember that the the First Amendment was, in fact, crafted to guard against government censorship, government dictation of Information Flow out there. And while some people might look and say this is texas and florida and theyre going to do the right thing, well, maybe right now. What about future administrations there . Or, by the way, if you then green light this and say, yes, states are can dictate what happens in the Public Information square, whats california going to do with that . Whats new york state going to do with that . I mean, for for every desantis or greg abbott, the governors of those states that are trying to protect free speech in theory and against censorship, you could have other states that see that as a license to the censor in different directions. How did this argument go at the court, dan . Where do the justices seem to be coming from, the Oral Argument . The justices seemed to be very skeptical of the argument because for the reasons i think weve been arcticulating here. Its a difficult issue, for sure. The idea that the sites are expressing conservative suppressing conservative opinion would rub a lot of people the wrong way. But as we suggested, if the sites have no control over that, then they can say, well, we have no control over anything, and thered be a lot of material on these sites conservatives would get very upset about. And speaking of Elizabeth Warren, those of us in the newspaper business are well aware of how many times you are, paul, i am, you write a 1,000word editorial criticizing someone like Elizabeth Warren, how many times have they said i want 1,000 words right next to the editorial two days from now, Refooting Everything you said. Well, were running our own newspaper here. [laughter] letter to the editor. But there is a significant issue of Editorial Control and editorial independence if youre running an operation like this. Paul allysia, a couple of the conservative justices seemed more amenable to the state argument. I think thats right. I think they were amenable to the argument theegz could be deemed, quoteunquote, common carriers. If you go back to the days of being regulated like utilities paul like railroads, telecommunication. You go back to the 1800s, states actually did regulate, you know, the telegraphs, telegram companies as common carriers because they were discriminate against the journalistic outputs. Paul and the idea is because they must carry everybody, therefore, they shouldnt discriminate. But how are these platforms different from railroads . First of all, they actually do apply some expressive activity and engage in expressive activity, for one.
