Test driver. And i dont believe they have rceived any training on how to be a test driver like i was a test pilot and i received training. Is that correct . That is correct. Two days after the crash, investigators drove the same route wong took, see the lane line fade on the left. The autopilot in wongs model x followed the bolder line into that traffic barrier. As i first reported in 2018, wongs family said he complained that it steered toward it as recently as four days before the crash. You would think with the knowledge, something my car is going to act squarely on, that maybe at least if im playing a game through the rest of my ride, maybe i should at least be more vigilant at this particular location. Cell phone record for wongs iphone show he was active on the three kingdoms video game. His hands off the Steering Wheel in the six seconds before impact. He was on the game each day driving that week. His attorney emailed me this statement. We believe he was using autopilot in a foreseeable manner. Th way tesla encouraged its customers to use it. The board criticized tesla for not designing a system that better monitoring driver alertness and for failing to test autopilot in more realworld situations. Higher speeds and varied obstacles. I think for my staff and myself, theres nothing more disappointing than investigating a crash coming up with a good solution and having no response from tesla. The board faulted the National Traffic Highway Administration for lack of oversight and state agencies for another big failure. A prius driver hit that same barrier at 70 miles an hour and walked away. 11 days before wong died. But the chp did not report the damage to cal trans. Highway workers eventually put up cones in the area but did not fix the safety cushion or crash attenuator before wongs tesla slammed into it. Had the previous collision that happened prior to this one not collapsed that attenuator and had it been operational, the driver would likely not have survived. Theyre suing tesla and the state of california. They want to put in a default mode that will go thats going to get a lot of flack. Intriguing idea, though. Dan, thanks so much. She spoke to abc 7 saying now is the time to come together, not theres definitely a need for Community Healing and to not attribute this with the actions of the entire African American community. This is about a few individuals who, unfortunately, played a really terrible role in this action towards an elderly man and he deserves better. We know that we are better than this. Abc 7 News Reporter kris reyes in the newsroom with the latest on the investigation. Good evening. State senator, supervisor calling this video part of a disturbing trend against Asian Americans that needs to be taken very seriously. Scared . [ bleep ]. The video first posted on instagram almost needs no explanation. A man in obvious distress as hes attacked and chased down in san Franciscos Bayview district while he collects cans. At this recycling center nearby, Police Investigators are looking at Surveillance Video to try to find the victim. I see hundreds of faces every day. He looked familiar. I cant say that i know him. But i know ive seen him. Sfpd has been getting calls since we aired the story. They Hope Community contacts leads to the victim so he can get help. We have a number of multilingual officers, solange waj should not be an issue. Its all about the community and giving us tips and nfrpgs. At the board of supervisors meeting, they talked about concerns over the video. He wants quarterly reports on crime trends that would detail type of crime and the specific communities and demographics affected. This legislation came directly from growing fears within the Asian Community in particular that they have been increasingly victimized by violent and property crime. There have been highprofile racially motivated attacks on asian seniors in San Francisco. In the video, you can hear racial slurs. Senator scott wiener says this case needs to be investigated as a hate crime. It appears to me that the victims status as a chinese american was part of the reason for the attack. Again, police are asking for the communitys help on this one. If you recognize anyone from the video, you can call the Anonymous Tip Line at 4155754144. Im kris reyes for abc 7 news. Thank you, kris. Today we have abc 7 news staff riding the trains all day long from the start of service to the finish and end to end on each line. Lets check in live with reporter luz pena to find out what shes convenient on the rails. Reporter i promise to show you the good, the bad and the ugly. Lets jump to the good. Many of the crews riding b. A. R. T. , it looks way better than last year. Lets give b. A. R. T. Some credit. Many of the stations seemed cleaner, less Homeless People in many stations. When it comes to b. A. R. T. Police presence, we saw more than last year. Something else important to highlight, for the most part trains were running on time. Theres the bad. We spoke to several people riding b. A. R. T. Who said crime is still a big concern. Thats where the ugly comes in. Take a look at this video. We got this from a b. A. R. T. Rider who sent it to us. It shows b. A. R. T. Police arresting a young man on the platform of the station. In the video, you can see them confiscating a handgun from the man. He was wanted for assault with a deadly weapon. He said he doesnt go to this station often but the crime has decreased in that station. Heres a second video we got from another viewer. He captured a man using drugs on the train this morning. Our producer believes he saw this same man later passed out on a train. The rider claims he sees this sort of thing all the time. Something else that b. A. R. T. Riders talk about was the bad smell. We also experienced it. First of all, the smell is [ inaudible ] reporter despite the ugliness we saw today, the overall impression is that b. A. R. T. Is doing better than last year. The overall satisfaction is still not 100 . In San Francisco, luz pena, abc 7 news. Very interesting. Luz, thank you. We want to know what you think about b. A. R. T. Use the dear bart with stories on twitter and facebook. If that is a backdrop, employees are taking home sixfigure paychecks. Were out there doing the right thing. This comes along and i go, oh. Its part of life as a b. A. R. T. Direct of millions of americans during wall strethe recession. Advantage so, my wife kat and i took action. We started a Nonprofit Community bank with a simple theory give people a fair deal and real economic power. Invest in the community. In businesses owned by women and people of color. In affordable housing. The difference between words and actions matters. Thats a lesson politicians in washington could use right now. Im tom steyer, and i approve this message. We choose to go to the and do the other things, not because they are easy, but because they are hard. President kennedy knew settling for halfmeasures wasnt good enough. So when candidates say we cant guarantee health care for all, make College Affordable for all, combat climate change, or create a world at peace, remember that america is best when we strive to do big things, even when its hard. Im Bernie Sanders and i approve this message. Ziemt building a better bay area is about finding solutions and following through. B. A. R. T. Is making changes. Is it making a difference . Every b. A. R. T. Line, every problem. Every solution we can find. Dozens of b. A. R. T. Workers are taking home sixfigure overtime checks. Why is there so much overtime pay . A board member wants answers. Its a very visual, visceral relatable concern about who is minding the store. The iteam found one b. A. R. T. Employee worked 361 days in one year. Abc 7 News Reporter Melanie Woodrow looks at why b. A. R. T. Doesnt just hire more people. We put in a records request and b. A. R. T. Provided us with the 2018 compensation for all employees. Certaindepartments and employees stood out as receiving more overtime pay than others. We asked b. A. R. T. Why. B. A. R. T. Says it moves up to 430,000 people per day. It takes more than 4,000 employees to move all of those people. Its a very complex organization. Sometimes we have to pay overtime. The agency paid one employee more than 172,000 in overtime. In some cases, overtime pay was nearly twice an employees regular pay. Why is there so much overtime pay . Were proud of the fact that our employees are willing to go the extra mile and put in the work needed to make sure we move the bay area consistently. Really going the extra mile. One station agent in particular, thats the person who opens and closes the station, provides passengers information and deals with emergencies. According to b. A. R. T. , one of their station agents in 2018 worked 361 out of 365 days at more than 40 different stations. Making more than 114,000 in overtime. Combined with regular pay, nearly 200,000. I dont think that 361 days a year is good for an employee. I dont think its great for an agency. On b. A. R. T. s board of directors. It is a very visual, visceral, relatable concern about who is minding the store. Deputy general manager wouldnt answer questions about individual employees. Why not hire more employees to cut back on some of that overtime pay . In almost every case, its more financially sound for the district to pay an employee overtime than to hire an additional head count. If you have one person working overtime, you are paying one pension, you are paying for one family of health care versus if you hire a person, youre paying for double that. From a dollars and cents standpoint, you can make a case that overtime costs less. I do think from a morale standpoint, i think from a Public Perception standpoint and i think just in the fact that these are good jobs, theyre middle class jobs that enable people to live in the bay area, i would err on the side of expanding our personnel. In 2018, some departments paid more overtime than others, like revenue vehicle trouble those are the technicians that ride and troubleshoot the trains. One made 163,000 in overtime, almost twice their regular pay. More than 253,000. Also police operations, remember the b. A. R. T. Employee who made more than 172,000 in overtime . It was a b. A. R. T. Senior Police Officer. Add in regular pay, more than 279,000. We hired over 63 officers just last year alone. More than b. A. R. T. Has ever done in the histor and were on track to have a fully staffed police force before the end of this year. For all the good b. A. R. T. Is doing around Public Safety issues, he doesnt want to see Something Like overtime pay set the agency back. Were out there doing the right thing and then this comes along and i go, oh, its part of life as a b. A. R. T. Director. B. A. R. T. Tells us the station agent who worked 361 days in 2018 is still a b. A. R. T. Employee but not currently working at any station. B. A. R. T. Would not say why. B. A. R. T. Also says hr is in the process of compiling 2019 compensation data but doesnt yet have a firm timeline of when it will be completed. In the newsroom for the iteam Melanie Woodrow, abc 7 news. Abc 7s building a better bay area contributor and chronicle insider phil ma tier joins us to talk about the overtime policy. You heard b. A. R. T. Saying its more Cost Effective and cheaper to use overtime rather than hire more employees. But is this a little extreme . When you go into b. A. R. T. Or any public agency, you want the people to be ready to work, whether its safety or a station agent. Some of this working 361 out of 365 days isnt necessarily going to be on that level. Now, sure, theyre filling the slot, yes, the job is getting done. For b. A. R. T. The question is and for riders, is it getting done up to the level whether its policing or somebody at that station agent thats good for the entire system. Thats one of the questions here. Right. Because of the satisfaction by customers suffers, then you have a different problem. How much of this is b. A. R. T. s history. History of using so much overtime contributing to this negative Public Perception. It does have a history of it. I was talking with the person in the piece a couple years ago, he was trying like crazy just to get more janitors, lets say, in downtown San Francisco stations, which were really dirty. He was basically told by the management, we can give you a janitor, that means we take one from bawalnut creek. When you sit there and go, why are you doing that . They say no, were short staffed. You say okay, is this about being short staffed or about saving money. If youre saving money, youre not necessarily saving the system for the riders. Whats the priority there . And thats the question that b. A. R. T. Has got. Why do you suppose this touched a nerve so much in the public and amongst riders . Because they have so many other bigger problems on the system. People are talking about homelessness, safety, cleanl cleanline cleanliness, crime. This one seems to get people on a gut level. It gets them on a gut level until the next one comes along. But on this level, its this. You cant understand a lot of Different Things that are going on in b. A. R. T. We dont necessarily understand the engineering even on the crime problems. Its evasive. The fact of somebody making 172,000 or more than twice their pay in overtime, everyone understands that because they work. Its something they understand. They go, hey, i dont do that. By the way, what kind of job do you have where you can do that . Because id be exhausted if i was working that kind of hours. Thats a very good point. All right. This conversation was interesting. Ill certainly continue all this week for b. A. R. T. Week as we look at the biggest transit system. Phil ma tier, thank you so much. Lets keep an eye on it. A lot of you ask is this much overtime legal . Can an employer force someone to work overtime. Heres the answer from the state department of industrial relations. Quote, the employer may discipline an employee up to and including termination. If the employee refuses to work scheduled overtime. However, an employer cannot discipline an employee for refousing to work on the seventh day of a workweek. An employee who is fully apprised of the entitlement to rest may independently choose not to take a rest day. If you have more questions, look for our building a better bay area on abc7news. Com.
