Lets talk about how this is going to happen. We heard in garretts piece, all the hypocrisy of what republicans said in 2016 versus what theyre sayinhiing about. We kn we know the democrats are trying to get a handful of republicans on their side. Lets say the president puts out his nominee next week. What happens between now and election day . Folks ive been talking to on both sides of the aisle say, look, a confirmation hearing, the naming and a confirmation hearing in october is very likely. Not many folks seem to think there is a plausible path to holding an actual vote on a Supreme Court nominee before election day. In fact, there is some thinking that in some ways Mitch Mcconnell might not have the votes. It might be easier for him to get the votes of, say, people like cory gardner or Susan Collins after election day, not before election day. Then theres President Trump who, in his own mind, he believes in some ways the scalia seat was one of the reasons that got skeptical republicans to, quote, come home, so leaving it out there almost as a carrot to incentivize people to vote is something the president wants. The most likely scenario is a naming, confirmation process, then, of course, an attempt at a confirmation after the election. But there is three potential scenarios after the election. Trump wins, then nominee gets confirmed. Trump loses but republicans hold the senate, its going to be a knockdown, dragout fight. Republicans will try. Well see if they have the votes. If democrats win the senate and the presidency, even though republicans have control, everybody i talked to said they could not imagine a scenario that republicans would have the vote to confirm anybody. Those are your three scenarios there post election. Its amazing. Youre rolling out a new nbc wall street journal poll today that shows just how solidified peoples minds are about this election. There is a small sliver of the population thats still deciding. What do you think the impact, if it plays out the way you just laid out, and thats hanging out there on election day, republicans will say thats how high the stakes are, democrats will say the same, its about the Supreme Court. San franciscos jim wallace says that in 1972 his High School Alma mater, his teacher, died during childbirth but her husband was not entitled to any Social Security benefits because he was not a widow. At the time only women were eligible. Justice ginsburg, who was an attorney at the time, took on the landmark case and won. She sued all the way up to the Supreme Court and won equal rights for this man and his son for his ability to be able to collect Social Security benefits the same as a woman would under the same circumstances. Justice ginsburg argued that contributions to Social Security were not treated on an equal basis to a mans salary so that she, and not just her husband, were being discriminated against. It was one case of several in which ginsburg grew to be a pioneer in the fight for gender equality. Kathy, as she is known to family and friends, graduated from college in 1966 and joined the navy, where she met her first husband, lieutenant kelly byerly. In 1975, she rose to be the navys first woman ever to be a flag secretary to an admiral, running his staff. The next year Time Magazine named Lieutenant Commander leen byerly one of its women of the year for her break breakthroughs in the military, placing her on the cover with pioneers like billie jean hard. In 1977, kathy filed a lawsuit against the navy and the department of defense, challenging the law that prevented women from serving at sea, arguing it denied women like her the chance to move up the ranks. Some told kathy she was committing treason. But in 1978, a federal judge agreed with her and struck down the law, revolutionizing the role of women in the United States military. By 1987, she was a captain, setting policy and leading a study that opened some 9,000 jobs for women in the navy. Captain kathleen bruyere, as she was known after her second marriage, became commander of the Orlando Naval training center, where a third of the enlistees were women.
