These are the new cases reported today in the bay area. Santa clara county adding 335 cases. Alameda, San Francisco, sonoma countys all adding more than 100 cases. These new cases are pargts of the growing trend across the country. Tonight the United States has more than 11 million covid19 cases. As we mentioned, many bay area counties are tightening restrictions. Right now indoor operations in San Francisco are scaled back. Starting tuesday, marin, contra costa, santa clara counties, theyre all going to do the same. Some restrictions in Contra Costa County are being tightened even further, especially when it comes to indoor gyms. Nbc bay areas Sergio Quintana is in walnut creek where one gym owner plans on fighting the new rule. Reporter for the last several weeks, a night at the gym for walnut week resident maureen kosta has been an escape from the coronavirus pandemic. Its been a relief from everything thats hatching. Its good to get to the gym and workout and get a stress relief. Reporter but her opportunities to relieve some of that stress will soon be changing. In september here in Contra Costa County, gyms were allowed to reopen at reduced capacity. But as of tuesday that may all end. Gyms are among the businesses that will have to shutdown their indoor operations again this year as county Health Officials issue another covid19 order. Indoor gym operations, Indoor Dining and indoor theater concessions will have to stop. Its an effort to reduce the spike in cases in the county. The owner and the general manager of snap fitness say they believe gyms are being treated unfairly so theyre looking into fighting the orders. Basically we are working to find a lawyer to file an injunction so that we can stay open. Were going back into the red which would allow gyms to operate at 10 which weve been complying with. Reporter Contra Costa County slid into the red tier. Some nonessential indoor businesses can be closed. In other bay area counties that have issued new restrictions like santa clara and San Francisco, gyms are being allowed to stay open with limited indoor operations. Thats something these gym owner operators would like to see happen in Contra Costa County, too. We are more than happy to comply with any further restrictions or more strict restrictions that they can add to it in order to keep us open. Reporter they say closing again could mean the end of their business. In walnut creek, Sergio Quintana, nbc bay area news. In marin county, Health Leaders are putting a pause on Indoor Dining and theyre doing more than that. Theyre moving the county into the red tier even though the state has not told them to do that. That means all indoor stores and malls will have to cut back on the customers allowed inside. Gyms going back to 10 capacity, pools, bowling alleys, indoor bars that dont serve food have to close. The pandemic has claimed another bay area business. San franciscos own cross fit gym officially closed today. It opened 15 years ago. It was actually one of the first in the world to begin operations, but it couldnt survive the pandemic. Owners tried adapting to changing guidelines and mandates by the city and the county, but the bills kept stacking up. They say their overhead remain the same, while loss of membership and limits placed upon them were just too difficult to overcome. Its been part of our lives for so long. Weve met so many friends and created such a Strong Community here. So its just felt sort of like the bed rock of our life the last 15 years and its just such a heartbreaking loss. The gym held one final workout today, then hosted an open house for people to come and say goodbye. Some businesses are forced to move outside. Theyll be dealing with some wet weather this week. Lets check in with meteorologist rob maeda tracking all those changes, rob. Before that big change arrives, i think were going to see at least one more fairly warm day tomorrow where well see a lot of 70s around the bay area. Before what well see part of this Atmospheric River connection bring the rainfall totals on the increase as we get into tuesday. So lets look at some of these rainfall deficits around the bay area. Going back to the start of the rain season october 1st, you see san jose almost an inch and a half missing rainfall. Livermore 1 and three quarters inches of rain we havent seen yet extending the fire season and more than 2 inches of missing rainfall in San Francisco. So the satellite looks promising. You see the plume of moisture. This is the Atmospheric River connection starting to take place offshore. As the storm approaches on tuesday, it does bring the potential especially for the coastal mountains for especially briefly rain at times. Heading into tuesday well talk about how much rain were expecting out of the storm and how much more we could see in the sevenday forecast and sierra snow as well. Look at that in ten minutes. The city approved the demonstration for the event. Mike grant wrote a Facebook Post calling for protesters to show up. They included a picture, something they felt the teenager and father felt it was threatening. It means a lot. Many supporters are strangers. I couldnt imagine it. And so we are, you know, its very glad to see. Its very great to see that there are so many supporters of the movement. It felt like it was important to come out and defend the youth and defend activists and defend the community. Well, grant has since apologized for his actions and has expressed interest in meeting with the Mcmahon Family to talk about what happened. A liftoff lifting spirits across the country. Spacexs resilience launches four astronauts into space light. They are in orbit headed to the International Space station. Nbc bay areas Marianne Favro is at nasas research senener Mountain View which played a role in this historic launch. One of them california native Victor Glover is making history as the first black astronaut to live on the International Space station. The flight launches a new era in space travel. Instead of relying on governmentoperated spacecraft, nasa astronauts and anyone else with enough money can soon buy a ticket on a commercial rocket. Stanford graduate and nasa astronaut mike fink will be part of the first crew when boeing sends its star liner to the space station next year. We are privatizing space. Having Companies Like spacex, boeing, and blue virgin and Virgin Galactic allows more companies in space, better for the american economy, better for jobs. Reporter once the crew on the Spacex Mission docks at the spacex station, theyll spend the next six months conducting experiments including micro gravity studies. Tonight spacex ceo elon musk was sidelined from the historic launch at Kennedy Space center because he said he had symptoms of covid19. He tweeted out a single heart emoji after the launch. Bay area scientists also played a Critical Role in tonights launch. I know the aims Research Center people have been working with spacex over the years to develop and test the heat shield materials, the thermal Protection Systems so necessary to keep the astronauts safe. As the pandemic continues to surge, a tool that was once called critical at the beginning of the crisis is quickly losing effectiveness. Dr. Monica beggahndi says conta tracing cant keep up with this rate of spread. You have a somewhat controlled epidemic to do effective contract tracing. So that would be in San Francisco, were at 1. 87 test positivity rate. As of today. So if there is like, say, 85 people in the city of San Francisco who have been diagnosed with covid, you can call them and you can get their contacts and figure that out. When you are in a city which is really whats happening across much of the country, but especially the midwest where there are surges of large numbers of cases, you literally dont have the capability to Contact Trace people. The doctor went on to say Contact Tracing is just one tool in the fight against covid, but one that needs to take a back seat to essentials like wearing a mask and distancing. We could know in a couple of days if San Francisco is a step closer to welcoming students back to classrooms. On tuesday the San FranciscoUnified School District will discuss reopening classrooms. Three Board Members are pushing for students in first grade and younger as well as those with disabilities to return to classrooms on january 25th. To become a reality schools need to have a safety plan in place and they have to have that done by december 8th. Middle schools and high schools in the city would need to submit plans in january with a reopening date yet to be determined. Looking to the week ahead, the Oakland Museum of california is reopening to members on friday. The general public will be welcomed back on november 27th. Of course, things will be different because of the pandemic. Everyone needs to have a ticket in advance, and they need to wear a mask. The mu receiseum is keeping cap well below the 50 allowed by the state. Visitors will be will also be asked to tour the streaming galleries in one direction. The Oakland Museum hasnt been opened since march. A local honor for the nations top Infectious Disease expert, the San Jose State University journalism faculty voted unanimously to award dr. Anthony fauci the prestigious 2020 Hurst Foundation national award. Specifically this years award is for, quote, professional excellence in crisis communications. He certainly did that. Faculty praised dr. Fauci for delivering trustworthy, timely and reliable information during the pandemic. An online ceremony for the presentation of the award is set for tuesday at noon. Santa Clara County Fire Department is planning to fight fire with more technology in the future. Firefighters have three new pieces of hightech equipment. The equipment includes two new satellite communication hubs and a mobile command vehicle. The department is also getting a grant from the state to expand three data platforms. Fire chief tony boden says the new technology will especially help the techs monitor and respond to wildfires. You know, it was just a couple weeks ago we were talking about wildfires and they were burning and now weve got the rain coming in and some other good news. Yeah, and it looks like well see an extended stretch of this type of pattern as we go through the next 7 to 10 days. But before we get there tomorrow were going to see temperatures climbing into the 70s around the bay area. Thats something thats going to get your attention on monday. And by Tuesday Morning the rain makes a big comeback. Lets show you how things look right now. Speaking of technology, this is ore mobile Doppler Radar, highdefinition view on storm ranger, scanning atop San Bruno Mountain right now. And we do not see any showers on our storm ranger mobile Doppler Radar at least for tonight. But this time tomorrow night well likely begin to see some changes. As i widen out for you nothing on the radar scan offshore, but the central bay location is primed to watch the rain as it sweeps the coast and inland across the peninsula. Heres the reason storm ranger isnt seeing much. Across southern california, oregon and washington, you can see the spinoff shore. That is the area of low pressure which will strengthen on approach toward the pacific northwest. Passing clouds across the north bay for the morning with patchy low clouds in a few areas. Temperatures in the 30s and 40s to start the day. Look at these highs, especially south of san jose tomorrow. Well see numbers in the mid to upper 70s with high clouds on the increase and filtered sunshine approaching sunset which is now a sign of fall. 4 57, Late Afternoon sun sets now this time of year. Even the north by before the sunset should see temperatures in the 70s for tomorrow. So a dry day tomorrow. And then watch what happens Tuesday Morning. Right after sunrise, thats a brief burst of some locally heavy rain especially around mount tam and coastal head lands there around the marin head lands, north bay mountains at 9 00 a. M. That band pushing into the south bay by early afternoon. Then what follows, by 5 00 tuesday, probably through wednesday will be these batches of scattered showers. So unlike before where most places saw about a tenth of an inch of rain or less, look how these numbers really spike in some of the north bay hill tops. Those areas of orange, Mount Saint Helena might have an inch of rain. North bay who is seeing the most, who is seeing the least, the santa clara valley, quarter inch of rain, higher totals near ben lomond. At 6000 feet we should see a foot of snow, which you may recall last week we saw heavy snowfall around the creek fire. Again, that was burning there in the southern sierra. So good news in termtz of fire danger reduction. You have the cooling temperatures, wetting rain and snow across the sierra. San francisco sevenday outlook shows the cooling temperatures tomorrow, the exception to the rule well be close to 70 degrees in downtown San Francisco. Then as we go through the next few days you can see the highs dropping from the 70s to the low 60s. With our next chance of rain possibly as we head towards the end of next weekend. New tonight, a Surprising New study out of italy shows that the coronavirus was circulating there far earlier than first believed. Researchers at the National Cancer institute of milan shows that covid19 has been in italy since september of 2019. Nearly 12 of volunteers in a lung Cancer Screening trial that ran from september of 2019 to march 2020 had coronavirus antibodies. That suggests that covid spread beyond china months before previously thought. The outbreak was first reported in wuhan, china, last december. Italys official first covid19 patient was reported on february 21st. British Prime MinisterBoris Johnson is in quarantine after being exposed to the coronavirus. Earlier this year johnson was sick with covid19 for weeks. Now hes quarantining himself after learning he came into contact with someone who has tested positive. The Prime Ministers office said he will continue to work from his residence at 10 downing street. So far no symptoms. Back in April Johnson was hospitalized in intensive care for his symptoms of the virus. The fates of a south bay airport is up in the air as some people have their eyes on the 200 acres that it sits on. Santa clara county board of supervisors will consider on tuesday different ways to use the land that reed hill view airport is on in east san jose. Some say the land would be better served to addressing housing crisis. Others say closing the airport would take away jobs, education and fire protection. If it closes, it wouldnt be until after 2031. That airport was built more than 80 years ago. That controversy has been going on quite a while, too. We have lived through eight months of this and were not done. Coronavirus has put our lives on hold. What if you dont have time to wait . Our investigation looks at terminally ill people fighting for their day in court. Senior investigator chabad has the story. Reporter how do you build a legacy . Alphonso spent his whole life building his. If you drivethru the sea you can say, wow, look what i did. You accomplished something. Reporter hes been in charge of some of the most iconic Construction Projects in San Francisco. The cliff house. Exploratorium. And his favorite, this chapel in north beach. Throughout his life alphonso also built a marriage. My wife is the number one. Reporter a family. We have five grandchildren. Reporter and now hes building a court case. Alphonso is suing nearly 20 companies that made and distributeds Construction Materials for the site. According to his lawsuit, those companies failed to protect workers from asbestos, a material known to cause cancer. Its the very same cancer alphonso has. I have a lot of things to lose. Reporter its called mesothelioma. I have the grandchildren to lose. Reporter and its terminal. The worst part is you know youre going to die, and my life is gone. Reporter are you scared of dying . Well, yes. I dont want to think about him not being here. Reporter marisa is his wife. They met as teenagers in italy. I want to enjoy every day that i have with him, and hopefully tomorrow we have another one. But not thinking that it may be the last one. Reporter how often are you in pain . Oh, every day, every moment. Reporter every moment . Every moment. Im in pain right now. Reporter alphonso is suing for pain and suffering, which can provide legal pay outs worth millions of dollars. In most of the country that money goes to the family. If a plaintiff passes away before the end of the trial. But thats not the case in california where once the plaintiff dies, the pain and suffering claim dies, too. Do you worry you may not be here to see the case make its way through court . Yes. Reporter and what is that feeling like . Its mission not accomplished. Reporter Court Closures during the pandemic are making it harder for the terminally ill to make it to trial. Across the bay areas nine counties, four still arent allowing juries in these kinds of civil cases. So the trials cant begin. That court date for them, thats air that they breathe. They need that. That is whats keeping them going. Reporter dr. Raja flores has been treating mesothelioma patients 25 years. And said the pain they endure is excruciating. It is like a boa constrictor that strangles you with each breath until the tumor basically suffocates you. Reporter but as California Courts see it, once the plaintiff dies, theyre no longer experiencing that pain and suffering. So they cant sue for it. That is the law. But is it justice . I dont think its justice, no. Its not justice. Reporter Assemblyman Mark Stone chairs the states Judiciary Committee which serves as a watch dog over californias legal system. Do you think there is enough political will in sacramento to change this law . I think thats a very tough one. The insurance companies, their whole obligation to their shareholders and others is to minimize the pay out. That sounds kind of cold and cynical, but thats a reality of this legal structure. Reporter the nations largest Insurance Association tells us pain and suffering is intended to compensate the one who actually suffered. The group says changing the law would lead to greater expenses for businesses, and ultimately consumers. And it argues terminally ill plaintiffs already have other means to speed up their cases. In california, the terminally ill can request their trials begin in four months or less. But in the midst of the pandemic with court rooms still closed or severely backlogged, weve confirmed some plaintiffs never got their trials. Reporter just how many statewide is difficult to say because, as we found out, no one is keeping track. To me thats kind of an administrative failure within the system. Reporter after we started asking questions, assemblyman stone is now calling for each California Court to disclose to the state whether it violated the law by not prioritizing cases for the terminally ill. Are California Courts failing some people right now . I think they are. We should be able to know whether or not that right is truly being implemented and how its being implemented. Reporter alphonso roach a had to wait two months before filing his case. He was finally assigned a trial date for december. Before im gone, i want to make sure that everybody been taken care of. I want to die in peace. Reporter alphonso never made it to court. The trial, he told us, was never about him. The case he built was for the family he built. When you think of life without dad, its hard to breathe. Reporter angela is alphonsos oldest daughter. She gave the eulogy with siblings at her side. You may be gone, dad, but youre never gone from our hearts. Reporter alphonsos death could soon lead to changes at the state capital. In the new year lawmakers are expected to explore ways to better protect the legal rights of the terminally ill. Notice as we head through the morning hours, high clouds setting up the north coast, temperatures mostly in the 40s, near 50 in San Francisco. Still a chance of some upper 30s near santa rosa and healdsburg and ukiah. The afternoon temperatures your monday weather story. San jose south ward, mid to upper 70s. Close to 70 in San Francisco. Low 70s in oakland. And low 70s into the north bay. So obviously monday pretty tame, but things begin to change as we head into Tuesday Morning right after sunrise. There comes that band of rain. The most extensive rain well see will be in about 3 to 4hour window from 8 00 a. M. To 9 00 a. M. In the north bay to just after lunchtime in the south bay, and then by 5 00 tuesday you can see we have already changed over to some scattered showers. So thanks to the fact this moisture is coming in associated from the Atmospheric River from some parts of the north bay, depending how quickly that band passes through, we might see more than an inch of rain. Now, this particular model does push it through pretty quickly so were looking at an average in the hills of about a half inch to three quarters of an inch of rain. But the usual drop off in those rainfall totals for places like san jose, palo alto. Youre not going to see a whole lot. But on the other side of the Santa Cruz Mountains up towards ben lomond near the summit, might see up about an inch of rain. Thats pretty significant. Tuesday into wednesday. So after that system clears, doesnt look like were going to see any lateweek rain chances as we get into thursday and friday. Notice High Pressure temporarily rebuilds as we head towards the weekend. But its not going to stick around all that long. Notice tuesday and wednesday, those are active weather days after the warm day tomorrow. Temperatures should stay comfortably cool as we go through the week. Then as we head towards sunday, you see it right there. The chance of some showers showing up late. So lets take a closer look at that now as we head towards your next weekend forecast. Look at that storm getting its act together. Sunday into monday. So this is now into thanksgiving week, and why this looks promising to make up that early fall rainfall deficit is the pattern for thanksgiving week. Looks pretty active. In fact theres a chance we might even see more rain as we head through the following week compared to what were going to see for tuesday and wednesday. The sevenday forecast, again, most of the action for this week will be on tuesday and wednesday. But once we head towards thanksgiving week, that extended forecast does keep things pretty busy. So this go around, more ran than weve seen throughout fall so far, and potentially even more as we head into the following week. So all signs are good.
