California is one of three states considering legal action against the Trump Administration following attorney general Jeff Sessions announcement. Washington state and new york are also considering a lawsuit against the federal government as the immigration status of nearly 800,000 people is now in jeopardy. A little more than a quarter of those people, 220,000 of them, live here in california. California attorney general Javier Becerra said ending daca would be devastating for recipients and for our states economy. Were here to say as leaders of our great state, where one of every four Daca Recipients lives that we are prepared to defend them. I just feel like i got played, you know, like i came here when i was 2yearold old. I had no say, like, i was just 2 years old and they want just want me to leave this country. Like, im more american than mexican. Reporter yesterdays announcement from the Trump Administration outlined the effect on dreamers. Congress has until march 5 to take action on daca. This daca decision comes as attorneys general from 10 other states threatened a lawsuit in june. They said if the Trump Administration did not get rid of daca by september 5 they would sue. A lot of people are weighing in on this. What are our state leaders in washington saying about it all . Reporter its not surprising their reaction from washington. People like senator Kamala Harris and House Minority leader nancy pelosi are using strong words against the Trump Administrations decision. Hurricane irma made its first landfall on the island of barbuda as a category 5 storm. This morning, the system was packing maximum sustained winds of 185 Miles Per Hour. Forecasters are excuse me already calling irma one of the most powerful storms ever recorded in the atlantic. Reporter seth lemon shows us its already pounding parts of the caribbean as it makes its way towards florida. Reporter this is video from the eye of irma, the most powerful Atlantic Ocean hurricane in recorded history. The storm has officially made landfall as it chubs through the caribbean heading towards florida. After everything that happened in houston, i think everyone is really paying more attention. Reporter topping the scale as a powerful category 5 storm, winds have reached 185 Miles Per Hour. In the florida keys, where most islands are three to five feet above sea level, storm surge could reach 10 feet. We could be looking at wave heights that would literally put the ocean over the island. Reporter the storm is predicted to march towards puerto rico and cuba before possibly heading towards the u. S. Mainland over the weekend. President trump has already declared emergencies in florida, puerto rico and the u. S. Virgin islands. Despite the pressing need for resources after harvey, floridas governor insists fema is prepared and ready to help in case this powerful storm takes a toll. Seth lemon for cbs news, washington. What could make a bad situation worse . A Tropical Storm has formed just behind irma. The National Hurricane center says that system called jose could become a hurricane by wednesday night. Lets check in with neda for the latest forecast. Yeah. Im watching the eye of this storm. As we saw in the video, the storm is heading towards st. Martin. The hurricane is huge. The eye of the storm gives you a sense of the magnitude here. Also, as we track this, expecting to reach puerto rico by later on tonight. Right now its west of st. Martin, gusts 225 Miles Per Hour. So yes, a category 5. 190 sustained winds. And the gusts extremely dangerous. Westnorthwest at 16 Miles Per Hour. Its picking up two Miles Per Hour as it heads towards puerto rico and the Dominican Republic. It will reach just north of haiti and continue to stay as a category 5. Thats because the sea surface temperatures are warm. They are around 85 degrees. Thats what allows this hurricane to really pick up steam. By the team it reaches the key west area, it will go down to 120mileperhour winds, still extremely dangerous and expected to bring excessive flooding, destructive flooding and lifethreatening conditions. Thats were people are evacuating. Heres Tropical Storm jose. This one also intensifying just behind irma. And this one could turn into a hurricane by later on tonight. Theres an oil spill at the phillips 66 refinery at rodeo. Petroleum was released from a transfer pipe monday morning creating a 20 by 20foot sheen in the water. They are trying to boost the amount of tankers allowed to make deliveries. 59 ships a year have the green light to deliver crude oil and gas there but phillips 66 wants the number to go up to 135. Details will be unveiled this morning about a Transit Village planned near the walnut creek bart station. Jessica flores is live in walnut creek with more on what people can expect. We are right in front of the walnut creek bart station and eventually, bart officials want to turn this entire area into what will be called the walnut creek Transit Village. The first phase of the plan starts with work on the parking garage. Eventually down the road, parent Officials Say the transit villain bart Officials Say the Transit Village will have shops, restaurants and public plazas. The new garage in the first step in the plan and this will include more than 900 stalls and that parking garage is expected to open by late 2018. Bart officials want t tell drivers, dont worry. The new garage will be built in stages so the existing garage will stay open at all times. Bart says the village will include new apartments, 596 units. And thats part of barts plan to bring 20,000 Housing Units near bart stations. The bart board president will be out here at the walnut creek bart station at 11 a. M. Most likely along the coast and the bay not so much inland areas. Higher elevations may also see a little bit of green on the screen. Heres a look at your sevenday forecast for today. Temperatures will be right there on average where we should be and then tomorrow look at that drop about a 5 degree drop for the inland areas in the upper 70s. Reporter jackie ward joins us now with the local pushback as dreamers wonder whats next. Reporter u. S. Senator harris is one of the people in washington leading the charge against this decision. In an interview on msnbc last night, harris spoke strongly against the decision. She represents the state with the highest number of Daca Recipients and says passing the dream acts is the right thing to do. When were talking about these kids who are in daca, they have cleared vetting process so for the attorney general to suggest that they are other than lawful in terms of in particular committing crimes is just its its, um, irresponsible. Reporter california, Washington State and new threat legal action against the Trump Administration for its daca announcement. Congress has until march 5 to take any kind of action on daca. So what happens if congress doesnt act by march 5 and daca begins to expire . This is exactly what a lot of those Daca Recipients are keeping an eye on. Starting next year, nearly 300,000 people could lose their status and more than 320,000 would reportedly lose their status from january to august of 2019. Thank you. Martin, the island there, and the eye of the storm, you can see how massive it is as it passes through the Leeward Islands heading towards puerto rico. Expected to reach there tonight and the Dominican Republic by tomorrow. I want to show you another storm there. Tropical storm jose expected to be a hurricane by tonight. So back to back irma, then jose, and then take a look, heres katia. This one right off the coast of mexico. This one right now has been upgraded from a tropical depression tow a Tropical Storm. A lot of activity in the atlantic. Look at the eye of irma just passing across st. Martin and the storm surge as it is expected to reach the u. S. Virgin islands, 15 to 20 feet. So this could go over the island. Right now, its expected to continue at 16 Miles Per Hour towards puerto rico. The Dominican Republic possibly going to reach just north of it or even make landfall by tomorrow expected to hit north of haiti as well and bringing a lot of rain. As it heads to south florida, it may downgrade to a category 4 or 3. Heres futurecast with all the rain. Look at this ocean, thats how you can get a sense of the storm surge. This is all heavy amounts of rain several inches 10 to 15 inches of rain as it comes through. But its the wave, the surge, its the wind thats going to cause a lot of damage. Sustained winds 185 miles an hour with wind gusts in the 200 range. Its significant. Strongest surge there, strongest storm in the atlantic basin. Coming up, well have your local forecast. A bay area lawmaker wants to boost security measures at gun stores throughout the state and make them less vulnerable to breakins. This smashandgrab at a guntion in sacramento last year was caught on at a gun shop in sacramento was caught on camera last year. Jerry hill says it would strengthen storage requirements for firearms at gun stores when they are closed. According to the atf, more than 1400 guns were stolen in california between 2012 and 2016. South sunset has been shut down for several hours. It looks like police are about to open that up. But yeah, again, it has been shut down as has story road for some period overnight. A man was shot here just after 9 00 last night. He was taken to the hospital where he died overnight. And the shooter took off from the scene. Police dont have any description of that shooter to share with us at this point. They have been collecting evidence out here and interviewing witnesses. The board of supervisors of already passed the ban. Critics gathered enough signatures to put the issue on the ballot. A number of Health Groups have thrown their support behind the ban. Grocers and smoke shop owners oppose it. This morning, a Bay Area School districts serious budget failure is leaving taxpayers on the hook for millions because someone forgot to send a letter. After a 3 budget shortfall palette Unified School District began cutting millions from last years budget. But they failed to notify the Teachers Union in writing that they were renegotiating a raise. The union was expecting it this year. The deadline came and went with no letter. It was a mistake but costly with a 6 million price tag. Without written documentation, we consulted with two different legal teams, two different firms, we are really obligated to pay the 3 raise to the teachers. The Palo Alto Educators Association says, any new development in palo altos educators is an development in the future of the out standing is an investment in the future of the Outstanding Community and in the districts ability to recruit and retain teachers. More than a dozen wildfires are burning this morning across western oregon causing air quality concerns and keeping hundreds of people from their homes. The largest has been burning for weeks, burning more than 167,000 acres. In central california, the mission fire northeast of north fork has destroyed at least 3 homes. The crews are getting some help from cooler temperatures and higher humidity. Cal fire says that more than 1,000 acres are burned and the fire is 10 contained. Were learning more about the four alameda kept disarrested for allegedly abusing inmate, four deputies. Former santa rita jail guards, justin linn, erik mcdermott, Stephen Sarcos and sarah krause faced a judge yesterday. Witnesses say they allowed gassing and then intimidated those who threatened to report it. Gassing is a prison term for throwing urine or feces at another person. One inmate also accuses mcdermott of placing pressure on his neck until he lost consciousness. All four suspects are due back in court next week. Martin heading towards the bahamas, puerto rico. The storm surge from this especially as it reaches the u. S. Virgin islands up to 10 feet high surge. Rain up to 20 inches in many areas. So significant amount of rain, mix that in with the wind gusts as high as 225 Miles Per Hour, which is what we have been seeing, this is certainly going to be destructive into west northwest direction. Heres the rain futurecast. Setting this into motion. Irma is getting closer to puerto rico. Even to haiti, cuba and florida. Its massive. Heavy rain, strong wind and dangerous strong surge. Strongest hurricane since hurricane wilma in 2005. A lot calmer, coit tower looking beautiful. Theres a bit of a marine layer here. 67 in livermore. 60s at the coast. Wind speeds out of the west cooling things off, clearing the air, as well. We are getting more of that onshore flow today. And we are going to see those winds pick up later on this afternoon. Right now, theres a bit of a storm system just off the coast of monterey, 275 miles. It is moving north towards our area which could bring us a chance of rain. We could see a 20 chance after midnight tonight into tomorrow afternoon. Most likely just along the coast and along the bay. Not going to see much inland but well see some cloud coverage inland because of the storm system, even the Higher Elevations may get precipitation. It should clear up friday morning.
