Volunteers are collecting items at about a dozen stations. Some of the most important items include baby food, diapers, batteries, flash lights, water filters. The donation drive is happening today from 9 00 to 4 00. In national news, roy moore the Senate Candidate accused of Sexual Misconduct in alabama is facing added pressure to drop out of his race. This is not christianity. Thats right. Rather, it is an extreme republican religionism. Several Alabama Church leaders urged people supporting moore to reconsider their vote before the special election on december 12. Republicans outside of alabama are also concerned. Senator jeff flake of arizona was heard on open mic saying he is worried what will happen if moore wins. The party of roy moore and donald trump. Latest polls show moore trailing doug jones by between 5 to 8 percentage points. Reporter President Trump has not spoken publicly about the allegations against moore. However he has commented about a democratic senator al franken. He tweeted about allegations against the lawmakers from minnesota and later frankens accuser read aloud from a hand written note in which franken apologized. Mr. Trumps outrage in the case is bringing fresh attention to the allegations about his behavior. Last year more than a dozen women came forward to accuse him of misconduct. The Trump Campaign denied all the claims but his former opponent Hillary Clinton spoke in a radio interview. Look at the contrast between al franken accepting and apologizing and roy moore and donald trump who have done neither. Mr. Trump responded on twitter saying crooked Hillary Clinton is the worst and biggest loser of all times. She just cant stop, which is so good for the republican party. Hillary get on with your life and give it another try in three years. Judge moore, al franken, the president s frankenstein tweet, Sexual Harassment allegations are all over. Melissa and i asked willie brown if he has ever seen anything like this before. Its almost as if its the wild fire in the world of politics and the accusations that are coming almost every day. Every politician i know among those who are still alive are shaking in their boots because they dont know at what point somebody will remember something they said or something they did that was at that time okay or explainable. I wouldnt say it was okay, but it wasnt going to be brought up. It was not a liability. I have had people privately tell me, i am going back through my whole life and at this point i would need to go through every interaction to say will i get in trouble for that . Is this going to be something somebody will bring up . Are we still on friendly terms . They can forget trying to go back and recall everything they have done because you are now in a position in this whole thing of having somebody Say Something that you have to deny. The minute you get to denial, you are convicted. Roy moore certainly hasnt done himself favors by blanket denial and not a specific rebuttal. A guy running for senate in alabama, right . In alabama, he is faced with consistent credible consistent accounts and if he cant give a specific denial, i never met this person whose year book i signed. I think if he had a legitimate he said she said, people would be open to that. You seem to have a skeptical look on your face. Senator moore to be as he calls himself, i call him judge roy bean moore, thats the old one that was there years ago, he is in a position where you start disproving one. I always say forget that one, how about the other five . What about al franken on the other side . Al franken is acknowledging and admitting every step anybody is accusing him of, he is accepting the blame. Thats part of the strategy of trying to say i am honest and pure and trying my best to let you know. I regret everything i have ever done. Lets not give franken too much credit. He initially did not admit what happened. He said i dont recall events that way. Then the photograph came out of him that he called the joke photograph where he was hovering over her breasts and then came the apology. Then all of a sudden, i can take responsibility. So lets not roll out the gold stars for him just yet. This story is definitely moving in all directions and including sacramento. On the national front, reverend Jesse Jackson confirms he has parkinsons. The 76 year old civil rights leader and two time president ial candidate says he has been seeking out patient treatment for the past two years after a 2015 diagnosis for the neurological disorder. Barbara lee who has known reverend jackson for years issued a statement saying reverend jackson is a fighter. He has fought his entire life for equality and justice. The shooting left 58 dead and hundreds oned. A central sheriffs deputy under investigation after a video surfaced online that showed him repeatedly hitting a suspect. We will be talking pot, money, politics of Recreational Marijuana rules. State lawmakers have to enact new regulations local governme before Recreational Marijuana use becomes legal, state lawmakers have to enact new regulations. Local governments can also enact restrictions but some like San Francisco board of supervisors say they need more time. Here are a few details of what might happen at the state level. The size of cannabis farms would not be limited but every plant would be required to be tracked from farm to sale. Security would be required at all farms and dispensaries and cannabis marketers would not be able to advertise to minors. San francisco is not on pace to have new laws ready to go on january 1 because city leaders say they need more time to come up with some kind of legal framework. That includes deciding on how close dispensaries can be to schools and things like daycares. Joining us to talk about city and state politics surrounding Recreational Marijuana is state senator scott wiener. You know, from the time that we invited you to come on to the show this morning, we have had the state issue the guidelines. It was a surprise at least to many that they said big grows are okay. During the campaign there were reassurances that it wasnt going to be corporate. We werent going to have big plantations moving into the state. It was going to be small growers that benefited. This is instant reversal. Your reaction . I was disappointed to see that decision. The last thing we need is to start displacing all the california Small Farmers who have been growing cannabis for decades and now finally can do it legally and then to have big guys come in with these massive farms and flood the market. So i dont agree with that decision. Is there a way to appeal it or to change it . If voters were sold on the idea end rethat sort of to be slowly grows up and it turns into a corporate one, is there a way to change that or these people have final stay . We can legislate it. I am sure there will be discussions about that, because we want our california businesses to succeed. These people who are persecuted by federal government for so long and we need to bring the small california farmers out into the sunlight and not give them incentive to stay under ground. Also there are questions about paving the way for big tobacco or big somebody else rolling in. We dont want mega corporations to be taking over cannabis in california. We are in this gray area after what voters said yes to in the enacting of it. There have been surprises along the way in San Francisco and other cities for example. Theyre having difficulty or big debates about where this should be sold and how. A big question was how close should it be to schools, childcare centers, whether or not neighborhoods should be allowed to say no . We want good regulation, good zoning. None of us wants the wild west. The problem is that some of the rules and restrictions that the board of supervisors is considering would go to the opposite extreme and effectively ban all new cannabis businesses in San Francisco. The voters of San Francisco voted 74 to legalize adult use of cannabis. So we want to take a balanced approach of good zoning. We want to have a buffer, the 600foot buffer around schools. We dont want to have clustering. You can do that without wiping out the industry. One of the tug of wars here is in San Francisco we have 46 licensed, brick and Mortar Stores or delivery services. How many do we need . We are only 48 square miles. Thats why we want to have zoning in place that includes anticlustering where they have to be spaced out. We dont want to have an infinite number of these businesses. You can do that without killing the industry. We need to strike the right balance, and i am an optimist. I think the board of supervisors is working to get it right. Some of the ideas that we have heard would almost totally prohibit new cannabis businesses in San Francisco. Thats not what the voters intended. Why do we need new . If we have 46, i understand the voters said yes to doing it but on the other hand they may say we dont want corporations moving in. This isnt about corporations. This is about really small businesses. I dont think anyone intended to grant a monopoly to the existing cannabis businesses. We talk about pulling up the gate and saying no new cannabis business, you are giving monopoly to existing people. In terms of equity, we had communities of color that were persecuted under the war of drugs. We want people who were persecuted by this war on drugs to be able to open legal businesses. This would ban them from doing that. Or put it on hold until you work out the rules. Weve had plenty time. But they havent. Just like the rules in sacramento that are surprising to everybody. A lot of this comes down to the cannabis industry. You and others are advocating it will bring jobs and money to california and cities like San Francisco. On the other hand we say if the corporations getter in, it will bring too much in. How are you going to balance that out since the rules go into effect january 1 . This is an industry that creates blue collar jobs in a city where it is sometimes hard to get by if you dont have an advanced engineering degree. These are good jobs, and we want them. We also want to be sure that the industry has a robust small business, mid sized business component and it is not just taken over by Mega International corporations. Well see how that works out because come january 1 the rules come in and then you will go to sacramento i guess and try to rework the rules. Thank you for joining us. A very different thanksgiving than mine which involves napping. A tax plan would result in 1. 5 trillion in cuts. But the senate has its own version and reconciling the two may not be easy. The senate bill, the tax cuts and jobs act, does to the repeal obamacares individual mandate but it does repeal the estate tax. It reduces Corporate Tax rate on companies. The Senate Finance committee passed the bill thursday night and now it is on to the full senate where its fate is uncertain. I am concerned. I believe that if we start getting into healthcare issues with the individual mandate that we send a very mixed message. The full senate will consider the bill after the thanksgiving holiday. Here is how California Republicans in the house voted. 11 voted in favor of the tax plan and three voted against it. Democrats are already running ads slamming those republicans who voted yes. There are two rules for any legislative leader when facing trying to pass something controversial like this tax bill. One is to get enough votes to get the job done. At the same time you are trying to protect your members who can face blow outs back home in districts if theyre asked to vote yes. We asked state Assembly Speaker or former state Assembly Speaker willie brown whats his take on paul ryans hand aling of the vote and protecting or not protecting members in california when it comes to raising taxes. He did a good job. When you are in the leadership and you have a surplus number of votes, you can turn to your members and say if you have a problem in your district with voting for this, dont worry about it. We have to move the program. Thats essentially what paul ryan did as speaker of the house. And thats the way you manage the game. Three republicans opted out and said we are not going to vote. In california. In california. The remaining said were in. Four of those remaining are in districts that are in tight races. Why would they go for it . I have no idea but i will point out also that one congressman who is not in a swing district or a district where there seems to be much of a race going on for his seat also voted against the tax plan. It is odd that two we know are in trouble voted against it. How mcclintie votes, if it has a price tag one way or another, he votes no. Hes done that for 20 years. I served with him. The only thing i ever remember him voting for was me. That was the only vote that counted. He didnt vote ever to spend a nickel. That means that beyond these two, you have five other republicans in the Hillary Clinton districts who voted in favor of it. So i dont know that paul ryan really did protect them since they ended up voting in favor. He gave them the option. He had a sufficient number of votes. He needed 218 or 219. He got 226 or 227. So he had a lot of room to play with for purposes of allowing people off the hook. What do they get out of voting for it . Why would they choose to vote for it . Keep in mind, it was a dramatic benefit to a collection of republican supporters. It is the confirmation of a premise made over the years for republicans to do something about taxes that effects your pocket if you are beneficiary. Thats what you have. Its going to be interesting here in california because for years weve had Estate Income tax thats basically balanced the budget in california. But the idea was you are getting hit with a high state income tax. But you will be able to deduct from your federal tax so you are not feeling the pain. We will be feeling the pain and next year weve got billions in bonds that voters are going to be voting on. Questions about if theyre going to be tax deduct unemployment loan. I doubt if voters now we will move onto segway to big game hunting. President trump is backing off of his decision on big game hunting at least for now. U. S. Fish and wildlife said it would allow hunters to import africanamerican trophies from zip zimbabwe into the u. S. The administration faced immediate backlash. Speaking of updates, members of the Senate Judiciary committee requesting more information from the president s soninlaw and adviser jared kushner. They gave him until november 27 to turn over more documents for its investigation of russian interference into the 2016 president ial election. They want information related to his security clearance and questions over whether the Trump Campaign concluded with russians. Chuck grassily and Ranking Member diane fine stein sent a letter making the request after russian actors used social media to influence the president ial election, tech terms are making changes. Google and facebook joined an initiative aimed at identifying what theyre called trustworthy news sources. Microsoft and twitter have also agreed to participate in the trust project. Leaders of the state Democratic Party are meeting this weekend in San Francisco and theyre making it a point to denounce Sexual Harassment as allegations keep emerging at the state capitol. Some say the partys actions dont exactly match the rhetoric. We believe in due process. This isnt due process. This is back room Protection Program where elected officials who have no self control. Strong words from candidates for office. I think people have to be held accountable. Jeff bleach. We just cant have them in the leadership role when that cloud is hanging over. Not everyone was so clear. The Party Chairman wouldnt give his opinion but he did manage to point out how long ago the harassment happened. Thats a decision that the speaker has to make. My comment about what i believe he needs to do is look into his heart and figure out whether he believes he can be effective. Make a decision perhaps talking with the speaker. Remember that incident occurred eight years before he was in legislature or eight years ago which was three years before he was in the legislature. If he came to you and asked for advice, what would you tell him . Think very deeply. Think about how he can serve constituents best. The Senate President pro tem referred to the speaker of the assembly. I have no jurisdiction because he is on the assembly side, not the senate side. Reporter but he did take action against a senator tony mendoza who three former aids have accused of misbehave i dont remember. I made a decision to remove him from his chairman ship as well as other boards and commissions that he serves on. At least for now. Its going to be an independent investigation that will be conducted with regards to the allegations that have been made towards his person. We will let that process and work itself out. What was the reaction of the womens caucus, democratic womens caucus to what we just heard . There is a petition asking for the two to resign from office. They are not thrilled. The chair woman of the democratic womens caucus has been clear that he should at the very least not be in a position of Party Leadership anymore now that we know there was an investigation and a finding that he engaged in this kind of harassment. Today there will be a big vote on a proposal, a resolution about this issue. So there may be amendments or other fights about whether or not to add a provision that the guys have to be kicked out. I understand there is a growing concern about a loophole in california strict vaccination laws . That is true. New data shows a lot more Public School kid have been getting medical exemptions since the new law. Some believe that doctors are manipulating the law, writing unnecessary or improper medical exemptions to allow children to avoid getting their shots. Theyre advertising that if you are interested in medical exemption, come talk to them. A state senator richard pan who sponsored original legislation says some of the websites have been taken down but california medical board says it has opened investigations into close to 50 doctors who may have written invalid medical exemptions. Northern california firefighters who battled wildfires will undergo tests to determine if they were exposed it high levels of toxins. The Cancer Prevention foundation is committing 100,000 to the research project. 175 firefighter will take part. Researchers will look for evidence of heavy metals, chemicals, other pollutants from blood and urine samples. A judge has ruled jurors will closing arguments are set for tomorrow in the trial of the man accused of killing kate steinly. A judge ruled that jurors will be able to consider a first degree murder verdict. That typically requires that the killing be premeditated. The defense argues that garcia shot her by accident after he picked up a stolen gun on pier 14. Prosecutors tried to prove that the gun couldnt fire without a firm pull of the trigger. He is undocumented and the case ignited immigration debate across the nation when President Trump used this killing to call for a crack down on sanctuary cities like San Francisco because he had been deported before. Now joining us to talk more about the trial is former San Francisco prosecutor, now a criminal defense attorney. As melissa pointed out, this trial and case made national and International Moves largely about the question. Thats not what is being decided. That debate stops at the courtroom doors. What is the debate in the courtroom that we are seeing. Jurors will focus on the moments that led to the shooting and on the shooting itself. That National Debate is going to have no place in the jury pool. What are the key issues . The defense says its an accident. The prosecutors are saying that at worst it was premeditated and on the lightest, an intentional shooting at the pier. The battleground will be the level of intent of this man when he had that gun in his hand. Is this an act of recklessness, act of criminal negligence or depraved heart . Absolutely a deliberate indifference to human life . Thats going to be the real battleground. We are talking about a gun that was stolen from a bureau of Land Management agents truck a few days before that was left in that truck, loaded and cocked and ready to go off. Why is there so much attention being paid to the source of the gun . I think its important because no one, jurors especially, arent going to like the idea of a gun being left negligently in the car so it can enter the stream of criminal behavior on the street. The fact that the gun wasnt left protected, was loaded in a car, just a piece of glass between it and a life of criminality, its something the jurors may focus on and it may take blame off of the defendant. No one is saying he broke into the car and stole the gun. That is not there. But the question is how did the gun get on the pier . Prosecutors are saying he carried it in his over sized coat. He came across it and carried it. Others say no it was wrapped under the chair where he was sitting and he picked it up and it went off. There are arguments on both sides of that. This is a 1000 gun that anyone on the street would want and that has value to someone, even the person who committed the shooting. He can sell that gun. There is only a four day window i understand between when the gun was in the rangers car and when it shows up on the pier. The journey between the car and pier is unknown. Without that, its an issue, an unanswered question. The defense is saying this is a ricochet shot, that the gun went off by accident, recognize shead off and struck kate steinly. Prosecution is saying somebody had to pull that trigger, that it takes a certain amount of pull to do that. What is their argument that says it wasnt an accident . Well the trigger had to be pulled. The mechanics of this particular firearm, a six hour p226 firearm, it cannot fire without the trigger being pulled. The question is was it pulled deliberately . It takes a certain amount of pounds, a deliberate act, whether it is cocked or uncocked it does not go off accidently. If it went off as a result of a trigger pull but not intentionally aimed at someone but in the general direction of people, what is that . What is the difference between say Second Degree murder which is one charge and manslaughter or accidental discharge . The difference there is intentionality. If that trigger was pulled in a crowd of people on a pier, the question is is that an act of recklessness or is it what is referred to in Second Degree murder as depraved heart . Is it an act so vial, so indifferent to human life that it qualifies as Second Degree murder . The idea of first degree murder i think maybe is giving a long shot to the jury so if there is a compromise, they will compromise to Second Degree murder as opposed to giving prosecution everything they want. Asking for first degree might lead to Second Degree. It is very difficult to buy in wholeheartedly based on this evidence to a first degree murder because the shooting is with a ricochet, it is difficult to see how this would be cared out carried out. It would be tough to be on the jury. Its like throwing a football and predicting its project rebefore it hits the ground.
