I go to the top of mount tam and you can see it. It is you above the fog. A lot of people are disappointed and say it is foggy. I say fog makes everything more dramatic and romantic. It cleans the air. It is special. I love the fog. Before we go on, something that i missed yesterday thai want to ask your opinion. Roger goodell is asking for 49 and a half million dollars, a private jet for the rest of his life and Health Insurance for the rest of his life. Sounds like a lot to me but the nfl as a whole takes in how much money a year. If youre making 50 million you can afford your own private jet. I want a private jet for the rest of my life. It is hard for the average person to maam. He is at the top of a multi billion dollar empire. I dont know. The nfl owners are debating that right now. We will see. In a couple hours, the family of a boy who slid off a water slide earlier this year will announce they have filed a lawsuit. Alex savidge is live in dublin with more on the injuries that the boy suffered and who exactly is the family suing . Reporter well, they are going after the city of dublin, which runs the wave water park, as well as the manufacturer of this particular slide. It is a Company Called white water industries. They made the emerald plunge slide. It is this slide right here that has been closed every since this accident happened back in may. You will remember that this entire episode was captured on video. It happened in fact on opening day of this brandnew water park here in dublin. That 10yearold boy was near the bottom of the slide when he flew off and landed on the concrete. He suffered scrapes and bruises to his back, his elbow and his leg. The familys attorney released photos showing those injuries. Now, the city has already tried to settle this case before a lawsuit could be filed. Legal analyst michael core dose awho we talked with this morning says it is not surprising that the two sides couldnt reach an agreement here. The city may attempt to settle. But what the plaintiff is thinking, this isnt their best offer. Were going to refuse this particular offer to settle. And do a little more discovery in the case and a little more litigation. And then they feel that the best offer will be put on the table. So theyre not going to accept something right out of the box. Reporter the city of dublin issued this statement in response to the lawsuit. It says, quote, the city and its legal representatives have attempted to reach an amicable settlement with the family but the family lawyer has refused to provide any information about the familys injuries that would be necessary to resolve the claim. That News Conference announcing this lawsuit or speaking offering more dedales on the lawsuit will involve the parents of the 10yearold boy as well as their family attorney. It gets underway at 10 00 this morning at the wave water park in dublin. And we will be here for it. We will have more at noon. Thank you, alex. Hundreds of people packed the San Carlos City meeting last night because of one agenda item, the discussion of opening a second gun store in the city. Turners wants to open a store north of highway 101. It announced it would open before the end of the month. After hours of public comment, the council imposed a 45day moratorium on the store opening. That would push it to the end of the year. People on both sides of the issue agree they need more time to talk about if there should be guns and gun stores in their community. A lot of people really dont want to live in an environment where guns are as accessible to guying and buying a disney video. You know, i mean, what kind of environment do we want to raise our children. Reporter what kind of environment do we want to live in . They decided it was in the best interest of this community to stop a legitimate business from opening. I think it is unconstitutional and unreasonable. I think if someone is scared of guns, that is something that we can talk about. Council members say the moratorium should give people time to educate themselves and hear a variety of opinions. And if more time is needed, the moratorium could be extended to a total of two years. Today, five separate law firms are expected to announce lawsuits against pg e filed by those who lost homes in the north bay fires. Among those represented is the former San Francisco mayor frank jordan and his wife. They lost their home to a fire. The lawsuits claim power lines owned and maintains by pg e are to blame. The utility has already suggested that the destructive tubbs fire may have been started by privately owned Power Equipment but has yet to be more specific. The Sonoma County board of supervisors meeting today will include a Fire Recovery update. They will update supervisors on the cleanup efforts currently underway and the next steps in the rebuilding process. The meeting started just about 30 minutes ago at the county Administration Building in santa rose. As we have been reporting, last weeks concert brought in for the victims of the north bay fires. That brings the fund to 23 million. For more on where all of the money is going, we are joined by marissa. How do we distribute the money . Are you going through different phases here. Tipping point has been around for twelve and a half years. We have built our reputation on trust, transparency. You mentioned the 17 million raised that night. 1 hunters will go to organizations in the north bay working on the ground 100 will go to organizations in the north bay working on the ground. They are all on our website. Tippingpoint. Org. You dont have to name all of the groups. We have three community foundations. One in sonoma, one in napa, one in mendocino. Catholic charities of santa rosa. On the move that works with foster youth that have really lost everything in these fires. And every single one of those groups are listed on our website. How do you find or vet the groups . Yeah. I imagine theres a lot of discussion when you decide who will get the money. There is. Our Due Diligence the whole year is extensive. We worked with groups that we have up in marin to identify who are the ones that really know the local need. And we did interviews and we went up there and walked the area and really had that long term vetting process to make sure that they were going to be doing, you know, Effective Work on the ground be there. Is that localism important . It strikes me that you didnt mention the American Red Cross which a lot of people automatically doe it nate to whether it ace wildfire or hurricane or earthquake. Why have you chosen the smaller agencies. We believe that, you know, these groups are in the communities. They know what the needs are. Again, this is all of this 17 million, the 23 million total is going to low income and vulnerable communities. They know theyre working with the people right there. And we trust them, that they will know what is best for their neighborhoods. Would you say the majority of the money will go to the rebuilding process or the process that is going on right now and the cleanup and the recovery, short term housing. Sure. Absolutely. This is it will take a long time to recover. So in the immediate need, it is the relief. It might be trying to help somebody find a home that lost everything. But, you know, it is an emergency. In six months, nine months down the road, it might be that people need Mental Health services or financial services. We are evaluating thats as time goes on. We need to figure out what people need at this moment where low income communities lost everything. 17 million sounds like a lot but it will probably go fast. Are you already planning other events to restock. We had the band together bay area concert that had metallica, dave matthews, all of these amazing bay area groups. That was a huge event. So, you know, right now were getting that money out the door. We already have 2 million out the door. As funds come in, we will allocate those as well. But right now no future concerts planned from tipping point. So the 2 million out the door has gone where. To the eight groups. To all of the eight groups. Yes. Do you give yourself a deadline. Come back in three years, we have 5 million left. We do have a deadline. Or do you get rid of every pen ogle we have been around 12 and a half years. Everything that we raise in one year, for fire relief or anything else goes out the door. The 23 million that we raised for the fire relief we want to get that out by the end of 2018. So 13 months. Yes. If another huge need arises, do you take from the big pot that you already have or do you start anew. This is specifically for the Fire Relief Fund of the north bay. The 23 million will go to the eight groups and potentially more if we identify others to, you know, serve those low income communities hit hardest. Did you have a number when you started that a goal . I remember j. J. Watt in texas said i want to raise half a million dollars. And look what happened. Did that happen with you guys. We launched this fund four days after the fires hit. We knew we couldnt just stand by. We were blown away by the support. We had 6 million just from our community of donors. And then the 17 million on top. We didnt put a goal out there. We said sky is the limit. We need to be there for our neighbors in the north and band together. Band together. Since 2014, there has been a 30 decrease in the prescription of opioid painkillers but more people are transitioning to street drugs such as heroin and fentanyl. To continue the fight, there will be a meeting tomorrow to address addiction and treatment. We are joined by dr. Willis in the studio. Thank you for joining us. What are you doing right in that county to decrease the opioid use. We have several strategies that are working. Safe prescribing. We have a 30 reduction of the amount of prescriptions written from 2012 to 2016. That is working with our commission to make sure that they can make safe choices. They were overprescribing, for instance like, is this mainly for teenagers who get hurt for some reason. Across the board. I myself as a primary care physician trained in 2005 to 2010, i was taught every time that a patient comes in to solicit whether or not they are having pain. The good news there is a safe and effective remedy that you can offer, which is an opioid. We are learning how unsafe it is. It is unsafe because the wrong people get their hands on it or unsafe for you if you prescribe it to me, i might get hook. We underestimated the risk of addiction with opioids. So over a period of about ten years, we were prescribing medications to people who actually developed addictions. And now weve you know, we have a whole covert of people addicted to opioids that we need to get into treatment. What about people, dr. Willis who go doctor shopping. If you dont give it to me, maybe dr. Sal castaneda will or dr. Mike mibach. We have a database across the state that allows a doctor to check what the prescribing history of the patient has been. See if there are other doctors prescribing as well. We have increased our rate in the county significantly. Thats why we have had success in fewer opioids being described. Do you get push back from your patients, i need that. Absolutely. I think were all learning to have new conversations here. There are healthier ways to manage pain other than opioids. Exercise, yoga, nonopioid medications. Yes. Some of those studies show some of the medications are tha person is being brought back multiple times. Absolutely. One of the most important risk factors for overdoses is the history of a nonfatal overdose. When somebody survives an overdose event, we need to make sure that were available to help that person and get them treatment and make sure that they have it on hand. What is one piece of advice before we go to county Public Health officers across the country that you would give to them. I think it is important to recognize that this problem wont be solved by Just Health Care alone or educating people not to use drugs. It requires a comprehensive approach, like a Community Wide coalition, bringing everyone together to offer their perspective to Design Strategies that work. The Berkeley Police Department Like most Police Departments dont need approval to acquire equipment from the United States military. City council wants to stop that. During the obama administration, there was a rule what Police Departments could obtain and had to receive specific training before receiving it. President trump reversed that order. Today Kate Harrison will introduce a plan that will require Berkeley Police department to get approval from city leaders on a case by case basis. It would take effect immediately if approved. The question of the day, should Police Departments have to get approval for military grade weapons. 63 say yes. 37 say no. Maybe from the mayor in regard to budgeting for these items. It may have violated the citys sanctuary city policy. A number of oakland Police Officers guarded the street as immigration agents executed a search warrant and arrested one man in west oakland. Iso officials said they were investigating a Human Trafficking case but kaplan and Community Activists say the man arrested has only been charged with being an undocumented immigrant. The policy bans City Employees from helping federal immigration authorities. There was a hearing scheduled for today but for some reason it has been pulled from the agenda. Kaplan says she wants the Oakland Police chief and kirkpatrick to explain the Police Departments role in the ice raid. House Speaker Paul Ryan is saying that roy moore should step aside because the allegations against him seem credible. This comes after another woman came forward accusing moore of sexually assaulting her 40 years ago when she was just 16. She says that moore locked her in a car and grabbed her. Moore says she doesnt know the woman. Mitch mcconnell believes the accusers and wants moore to drop out of the senate race. Moore says this is an attempt to decrail his election. We have been on the southern end of the systems. This looks like a pretty solid bet here for wednesday night and especially thursday morning. You can see that system, one dropping out of the gulf of alaska. This is the first atmospheric to show up. There are hints of rain here. Two to three inches for some. Have to keep an eye on the burn areas. To the north, it started. Some of these have had some rain but nothing like this yet. Down to the Santa Cruz Mountains we could be looking at two to three. I know one of the forecasts this morning put two inches of rain on sfo by about noon on thursday. South bay leaders are addressing the Housing Project in the area. Allie rasmus is live in downtown san jose at the county government center. Allie, what will happen today . Reporter well, last year voters in Santa Clara County approved a historic 950 million Affordable Housing bond. Some of the money from that bond is now starting to come in. So today the Santa Clara County board of supervisors is expected to vote to approve the construction of six new Housing Projects using that money. Now, the first one of the firsts will go on them tee lot that you see pictured here on lee avenue in san jose. The board is expected to approve 45 million in loans for the six new developments. They will add about 350 apartments to the Housing Stock in Santa Clara County from gilroy to cupertino. We have a housing crisis in Santa Clara County, as does most of california. The key thing to remember is that the Affordable Housing crisis disproportionately affects our lower income families, especially those with disabilities. Reporter and this new housing is going to be geared towards people with special needs, seniors, and low income residents. It will take about two years for the first apartment in the six developments to be built. They hope to build more than 4800 new Housing Units catering to low income residents and seniors using the bond money approved last year. The catch is that these projects never move quickly. It will take about ten years to complete all of the Housing Projects. The 4800 Additional Units that they have planned. Back to you guys. Thank you, allie. The San Jose City council is also issuing Affordable Housing today. The measure would tie the amount that rents can go up to local inflation. The death toll now tops 500 from the iraniraq border an a 7. 3 earthquake. 530 people have been killed. More than 7,000 hurt. In iraq, 7 people died in the quake. More than 500 have been hurt. Rescue crews are still searching through the rubble for survivors. More than 12,000 homes were destroyed. Many survivors need tents and blankets. Here at home, another Court Appearance today for the man accused of shooting and killing a teenager near concord high school. The 20yearold did not enter a plea to a murder charge for allegedly killing 17yearold Lawrence Jansen last week. Jansen was with a group of people outside of Olympic High School when a honda pulled up next to them and Authorities Say the man got out of the car and started shooting. Jansen, according to authorities, was targeted. The reason why is not clear. At first Concord Police arrested five people, but two have since been released. No charges were filed. Three ucla basketball players are now on a plane heading back here to the u. S. From china. After being detained on suspicion of shoplifting. One of them is le angelo ball. They were arrested on the suspicion of stealing sunglasses at a Louis Vuitton store. They were promoting the pac12 conference. Now to the deadliest fire in oaklands history. 36 people trapped by flames inside of a warehouse that had been turned into an artist collective known as the ghost ship. All this week, 2 investigates brings us a series of reports on the legacy of the ghost ship one year later. This morning we look at whether oakland city officials are keeping the promises made after the fire to correct safety problems. 2 investigates reporter Candice Nguyen has that part of the story. Reporter in the weeks and months after the deadly ghost ship fire, there were News Conferences. This fire has been a devastating tragedy. Reporter an executive order and a call for an overhaul of oaklands Fire Prevention bureau. Promises to improve safety for unpermitted Living Spaces while avoiding displacement in a city desperate for housing. We understand there were communication gaps. Are you talking more than you did before. A lot more. Reporter claudia, oaklands assistant city administrator is talking about her departments relationship with the Fire Department now led by darren white. If we look back a year ago versus today, i can say with certainty that our community and First Responders are a lot safer than they were this time last year. Reporter 2 investigates took a closer look at the progress, requesting information on how well the city is delivering on promises, including hiring a new fire chief after theresa reid went largely unseen after the ghost ship and then retired. Darren white was sworn in february. Doubling the staff. Around the time oakland had eight fire inspectors and eight Building Code inspectors. Next month they will have six more for fire and three additional for building but theyre not on the job yet. Identifying hazardous properties in. The last year, oakland identified 135 what they call priority properties, buildings with multiple hazards. In regards to unpermitted buildings with People Living inside, 21 of the cases are open. One theyre still trying to access the property. How confident are you that those are all of those kinds of buildings in oakland right now . I would be naive to tell you that we are not confident at all. We know there are other buildings and we have to be diligent and identify them and give people an opportunity to come in and correct it. Reporter another major promise implementing an interdepartmental database, a digital platform to address the lack of communication between departments revealed by both the ghost ship and san pablo fires. The new 500,000 database system is expected to be completed by december. It will go live early 2018, plus inspectors will be equipped with tablets. There were very unrealistic things said in that executive order. And also some crucial things. Reporter strauss is the lead organizer of the oakland warehouse coalition. He is hopeful but skeptical of oaklands progress announcement. So you have to following up an executive order with actually making sure that your staff does it. Which as far as i can tell wasnt done. Unrealistic is probably not a fair word. We didnt know in a lot of ways what we would encounter. Weve had to adjust to a new reality. We had to ajudge tout a variety of things that i havent seen other local agencies had to adjust to in the same compressed amount of time. Reporter a multi layer de lema they say addressed by the wheels of government known to turn slowly but theyre turning. There was a really delicate balance. All right. Candice joins us this morning. It looks from your report, theyre not just letting the days go by. Theyre making progress. Is there one thing that theyre not doing enough on. One surprising thing in the Progress Report released this week is that the Fire Department thats a backlog of 1,000 state mandated inspections. That seemed like an alarming number. Theyre still state mandated inspections and there was a thousand of them. They are facing a historical Staffing Shortage that theyre trying to battle and trying to get creative with implementing technology. Technology cannot replace a human with regards to inspections. I want to add even though were holding the city accountable and we should, this shows that work is being done. A lot of these are longterm solutions that take a long time to implement. Do you think that if these steps that they have taken now would have been in effect a year ago that maybe we wouldnt have had all of these people die in that fire. Thats a big question. Why wasnt this done years if not decades ago. We asked those questions. But at this time, their tone, the citys tone is how do we fix this and move on. Thats an excellent question and something that we should address. Because how do you move forward if you dont address there was a problem in the first place. Lets circle back to the number of fire inspectors. They are not at the full number that the mayor laid out for us immediately after the fire. Is it that theres not enough people wanting to fill the positions . Why cant they fill that number. It is not in the hundreds. Just above a dozen. Yes. Definitely not in the hundreds. I think the answer is a multi layered one. It is money, finding the qualified people. It takes training. A fire inspector is not something that you just learn in a couple weeks or months. A lot of time people are firefighters for a long time and go to school. It is that challenge and money. And that is something that theyre still trying to figure out. It is clear that it seems to be a difficult process. But something that we will continue to checkup on because we should. They have made progress. They have made progress. But is the money there or do they need more money to fill the positions . I do know in the report released this week, they secured funding. Yet. For morin spectors. Now, in terms of exactly how much to to double and then ultimately triple the staff, ill check on that. I know it hasnt launched yet, but when the database launches, just talking to each other. That is the biggest problem in a lot of businesses. That was one of the biggest, scary problems revealed, the lack of communication between departments. It showed some people in the city saw there were problems and reported it via email but it didnt get to the right person who can do something. Because that was revealed, they want to create a system where if i report it, we can fix t back to the question, why didnt we have this before. Thank you, candice. Appreciate the report. The fbi reported more than 6100 hate crimes in 2016. About 300 more than were reported in 2015. In San Francisco, reported hate crimes increased the past three years from 22 incidents to 37 last year. In oakland, hate crimes went down from 2015. In san jose, they more than tripled. The bay area is not immune to the same hatred that we see happen in other parts of the country. But it is it is different. In some cases we find that, you know, when we take proactive steps to remedy a situation, employers or businesses want to work with us. That might not be the case in other parts of the country. According to the antidefamation league, the best way to eliminate hate crimes is through education and drawing attention to the fact that the crimes are in fact happening. Police have released a description of the suspect in a deadly hit and run accident in south San Francisco. 44yearold Theresa Gonzales was hit late saturday night as she crossed El Camino Real near spruce avenue. The driver fled in a 1998 to 2000 black toyota or lexus. Witnesses say the hit and run driver is a white male, early to mid30s. 58 to 510 with a pencil mustache and short faded haircut. If you went to a particular valero gas station in the past couple of weeks, check your statements because a skimmer was found inside of the gas pumps. It was in pump number two at the gas station west of highway 101. Ktvus jessie gary says there is no way that people would detect that something was wrong until they learned that money was missing from their accounts. Reporter karina says 1,000 was withdrawn from her bank account after she swiped her card at this pump at the gas station in gilroy. Police say it is a crime migrating from Southern California to the north. Have you ever seen this kind of thing before. It is rare. In Southern California, it is more prevalent. On monday, at least 40 victims came forward. Filing complaints of credit and debit card fraud. That number had could grow. Investigators found a card skimmer similar to this installed inside of a gas pump. They say it could have been hidden for over a week, collecting thousands of victims information. We tend to think it was a crew or somebody with a lot of local contacts or contacts that are willing to come and take these credit cards and make purchases. Reporter Sergeant Jason smith says detectives have traced fraudulent purchases and unauthorized withdrawals spread over the south bay. The size of the device with this kind of activities is getting smaller. It is not like what we had before. Somebody has a little bit of technical knowledge, he or she can install it. Reporter the engineering professor says that Technology May be a way of combating this technologically driven card that stores card information until wirelessly downloaded by the thieves. That is the indication that there is something going on with that reader. Reporter this as some customers bitten once by crime are now twice shy about swiping their cards. Thats why i went inside and paid this time. Thats what im going to do now. Im never going to put my card in these machines again. Reporter Gilroy Police stress that everyone that used this gas station over the past one or two weeks should check their statements to make sure that theyre not victimized.
