And now on twitter, professors across the country, from usc to the university of arizona, northwestern, penn state, and more, are offering to help, saying theyre willing to hold in person independent study sessions to meet these new requirements. We have an update to a story weve been covering for noted that of the 26 counties months, which began with san now on the state watch list for Francisco Police knocking down the during door of a journalist, searching for information about the leak of rapid virus no audio the deaf report for a public well, the ongoing pandemic defender. Now we are finally getting a is prompting universities to look at just how high up the make some very difficult decisions. Stanford Just Announced cuts to ranks this all went. Its athletics programs. Evan broke this story today at it is eliminating 11 varsity ktvu. Com, and evan joins us now sports due to the financial live to talk about what he has impact of the coronavirus. Joining me now to talk more uncovered. Lets start with the fact that this was on directed by people about the sports reductions is high up within the san rebecca, an attorney and title Francisco Police department, 9 expert. Here, and you also uncovered that police chief bill scott was rebecca. These are significant cuts, but the University Said they were very much involved in guiding this investigation. Unavoidable. Thats right, alex. Yeah. And looking at the fact that right from the beginning, the frequently asked questions that Chiefs Office gave the investigators in the internal stanford put out, i now am affairs unit the name of brian convinced that they worked really hard to save the athletic programs, and i think it seems to many of us that carmedi and his phone number. They eventually served a search stanford has unlimited money, warrant on him and the whole thing began to unspool from but i think that this there. Then according to a new declaration from the internal coronavirus is impacting everyone, even stanford. Affairs captain that i just yeah, it certainly is. Obtained, he said that scott so lets talk about how the was intimately involved in students participate in these meetings along the way, 11 programs are going to be including one meeting in which affected here. Many of them are on Affairs Officers serve a search scholarships. Yeah. Warrant on him that later got yeah. I mean, its a real bummer. Overturned and quashed because i one thing i read that i think could offer some comfort it was illegal, violating to these students is that theyre maintaining the california shield law. Alex . All right. So shouldnt the chief, the scholarships, theyre not cutting the scholarships, and i think that that is the right higherups within the department, the officers thing to do from a legal directly involved in this perspective to keep their investigation, and the judges contracts. A lot of these kids, young who signed off on those search adults, turned down other warrants, all have known that offers to attend stanford. Brian carmedi was an accredited it doesnt seem either legal or more to let them go, and i journalist and afforded protection under the shield law . Think stanford, lack of well, thats one of the things that is so particularly scholarships, i think st is doing the right thing therto disturbing about this case. This wasnt just a rogue unit of officers who werent aware of a certain law that maybe you have achieved the highest would need to get some restraining on or something in success, you know, as a type like that. This was a fundamental of student gets cut at the breakdown across the system in college level. Its sad. Yeah, and to really kind of San Francisco. You somewhere judges who had come out of the blue, if you will. Information about brian carmedi i mean, you know, just four or five months ago, i dont working in the media, and how thinking some like this was he should have been protected. You have the chief on down even on the table. Talk, though, again, from your through the command staff, all attorney perspective, talk about the considerations that the way to the investigators, are made when a university who were intimately involved in looks at making any sort of all of the details, and never cuts to its athletic programs, considered the shield law. In fact, they thought what because title ix, of course, brian carmedi was doing was a does come some into play. Crime, and if thats a crime, yeah, and honestly if this that same crime is being interview were 25 years ago, it committed every day across the country, and its protected by would be a very different interview. I think that stanford has the First Amendment. Really come a long way, and its not a crime. Its journalism, and its one of that stanford, you know, as title ix law has progressed and become better understood, from the pilars of our constitution. What i can tell, stanford has and quickly, evan, just let done a good job ensuring that everyone know, this is potentially a Chilling Effect an equal or equitable amount of number of women and are this has on journalists, impacted by this. I think choices of sports. Because sources, potentially, are more reluctant to give information over to journalists when they see this kind of a and thats what title ix raid happen. Requires, because in our reporter right 100 . I mean, we depend on people to country right now, access to come forward as journalists, to give up information so we can college for many is limited to these types of scholarships, so hold our Public Officials its fair and its correct, and accountable. In this case, it was a police its a legal requirement that report on the death of a very men and women are impacted equally. Powerful publicly elected official, and if other sources yeah. And before i let you go, begin to see this kind of a rebecca, stanford certainly not response, you know, officers alone in facing the financial showing up and beating down the door of a journalist in order impacts of the pandemic. Yeah. I think were going to see this to get at their source, theyre going to be a lot more happening all over the country, and in a way, i reluctant to participate, and the public is going to be worse announcement early. It allowed people to prepare, off for that. Yeah, absolutely. And because they were so openly evan, really appreciate you bringing all this to light, and thanks for joining us this mindful about title ix afternoon. We should let everyone know compliance, hopefully that will that evan broke this story on set the tone of compliance line this morning. You can read his full across the country under these investigation on the ktvu mobile app at the top of our very disappointing home page. We want to get our kids back in the classroom, get our teachers bark the front of those classrooms and our kids learning in person once again. Reporter Vice President mike pence reiterated the Trump Administrations strong urging today for schools across the u. S. To open in the fall for daily in class construction. The American Academy of pediatrics noted keeping schools close places children and adolescents at significant risk of morbidity and in some cases mortality. Everyone should start with a goal of having students physically presence in school. Reporter pence said the cdc will be issuing new guidelines next week for schools to reopen. Yesterday President Trump suggested federal funding for schools could be at stake if they dont fully reopen. Today the Vice President struck a milder tone. As we work with congress on the next round of state support, were going to be looking for ways to give states a strong incentive and an encouragement to get kids back to school. A spokesperson for the California SchoolBoards Association represents more than a thousand School Districts and county education offices throughout our state. He said in a survey of the groups members, about 70 of districts are planning on starting the Academic Year with a high model with students spending half their time in a classroom and half learning at home, and said going back to the way things were before the pandemic in just a matter of weeks isnt realistic. How are we going to get sanitation stations to every school in california in the next five weeks . How are we going to do the deep cleaning that has to be done on a regular basis . Is there going to be sufficient ppe, masks, gloves, and other devices for every school in california for the next again, it could be a year, could be 18 months. Even though schools do get some federal funding, the decisions about how to reopen is mostly made at the local level. California is requiring a significant amount of instruction for kids, but there is still debate over whether most of of that will be in person or online. Teachers and Staff Members are concerned about their safety as well. The a School Board Association said roughly a third of the states teachers are over the age of 50. Supreme court issued a pair of orders today on Workplace Discrimination and Birth Control. Both decisions are being considered victories by christian conservatives, and the Trump Administration. Reporter on wednesday, the Trump Administration handed two wins by the Supreme Court, both 72 decision siding with relinkious freedom advocates in one ruling, the court deciding employees who serve in any faithbased capacity religious institution cannot sue for Workplace Discrimination, due to the separation of church and state. The other says the Trump Administration was within its rights when it allowed for more care acts contraception man ens healthcare they need does not require banishing religious groups who are forced to surrender their reliefs from the public square. Nancy pelosi said it is unconscionable that in the middle of the worst Global Pandemic in modern history the administration is focusing on denying basic healthcare to women that is essential for their health and financial security, instead of protecting lives and livelihoods. Plus we learned on tuesday that chief Justice John Roberts suffered a fall last mowas hosp injury. Doctors believe it was due to dehydration during a walk. While chief justice rob effort has not indicated hes going anywhere, his injury only further fuels speculation that another vacancy could come open before the election. The white house prepares for this. This is a big, big deal for them. Anytime a justice might step down. Reporter normally the Supreme Court in summer recess by this point, all remaining opinions are scheduled to be announced on thursday, including whether the president can keep his tax returns and financial records private. For more on todays rulings, were joined by joel paul, constitutional law professor at u. C. Hastings college of law. Good to have you on today. Lets start and talk about the Birth Control ruling today from the high court. Why did a majority of the justices believe that the Trump Administration has the right to craft instance relied exclusively on the Authority Given by congress to the president. They held that it was broad enough under the Womens Health amendments to obama to give the administration the right to decide to extend this exception not just to religious organizations, its important to note that this actually gives all employers the right to deny women contraceptive coverage under obamacare. Based earth on religious grounds, or on more principles. Joel what potentially could be the effect of this ruling on working women in this country in terms of their access to Birth Control . Well, Justice Ginsburg in her dissent points out that this is devastating, especially for women who are minimum wage workers, who really rely on the insurance provided by the gover for example, the right to deny its workers coverage for contraception, and that could have a really devastating impact on Womens Health. So this is the third time that this particular issue has come before the Supreme Court since 2014. Do you think that this has finally been settled, or are we going to be back here once again with the high court making another decision on this matter . Well, i think that a new administration could certainly issue a regulation to withdraw the Trump Administrations regulation, and to reimpose the regulations that were in existence under the obama administration. And so it is possible a new administration could renew the coverage for women to cover contraception. So we could be right back here once again next year, potentially. Let me shift gears and ask you about the other ruling from the high court today. A majority of the justices ruled that religious schools can fire teachers without leaving themselves open to job discrimination lawsuits. What was the rationale of the justices in this case . In this case, the court relied on the religion clauses of the First Amendment. They said that the ministerial exception, which ordinarily gives churches the right to her and fire their own ministers without regard for employment discrimination laws, but that ministerial exception is broad enough to apply to teach herself in parochial schools, if this case teachers who are teaching secular subjects, were not necessarily catholic, teaching math and science. One teacher allegehad been subjected to age discrimination. The other teacher alleged she had been discriminated against after informing her principal principal that she had breast cancer, she lost her job, and she was filing the climb under the americans with disabilities act. So this has very broad application. The court was vague enough in its opinion that it could potentially apply to any person who works for any religious organization who has just some incidental involvement with religious practices. A nurse, for example, in a hospital, who offers a prayer to a patient, or a coach at a football a coach who offers a prayer before a football game. Sure. Any of these people now could be subject to employment discrimination. The court has stripped the protections that congress had intended. Joel, let me we wrap up here, because were running out of time, but there is a big decision we are expecting tomorrow from the high court. The court will be announcing whether President Trumps personal financial records should be turned over to congressional investigators and prosecutors in new york. What do you expect on this big question, and what are the implications for the november election . Well, i would hesitate to make a prediction, but in the or argument before the Supreme Court, it was clear that the justices were more skeptical of the arguments for giving financial records to congressional committees than they were to turning over those financial records to the prosecutors in new york. So i dont know exactly what to make of that, but well find out tomorrow in the financial records are turned over to the grand jury in new york, then it will not necessarily mean that those records will ever become public, unless theres an indictment. But if the records are turned over to congressional committees, then it is far more likely that the records will become part of the fall campaign. All right. We appreciate you helping us to cover a whole lot of ground here. When it comes to the high court, a big decision is coming tomorrow. Joel paul, constitutional law professor at u. C. Hastings college of law. Thanks for your time. Helping the unemployed find work. Coming up, the effort to provide an important job seeking element free of charge to those affected by the pandemic.
