Its outrageous the Police Department did what they did. Before the cops showed at freelance writers jeremy store, chief bill scott was ultimately involved in efforts to figure it out of his confidential source the chief and city leaders wanted to know who leaked a Police Report on the debt the public defender jeff hitachi. Now we are learning how close scott was to what turned out to be a disastrous investigation, even going so far as to suggest officers write a warrant to illegally search carmodys cell phone. Its all detailed in this stunning declaration from former internal affairs captain william durr county. Is asserted by journalists, but its not for journalist. Its to protect their sources. So people can freely speak to journalists and now their identity isnt going to be compromised when they do. Reporter attorney tom burke presented carmody and thought to have five warrants, the subleased served on him. They failed to mention he had a press pass. The judges who initially signed the warrants eventually quashed them. There was absolutely an improper, egregious violation of california law. Reporter californias shield law protects journalists, including freelancers, for being forced to reveal their sources. And it specifically bars using search warrants. Carmody had obtained a Police Report detailing hitachis final moments in a mysterious apartment on Telegraph Hill with a woman who is not his wife. He sold the report to Bay Area Television stations, including ktvu. City officials blasted police for the leak, accusing the department of trying to smear hitachi. And longtime adversary of the police. And demanded they root out who provided the report of the press. I think this is a very serious matter for all of us. To have that type of maligning going on, of a public official in San Francisco is disgusting. Reporter at the time. Coney apologized to the board of supervisors. We are working tirelessly on this case. Reporter what he didnt tell city officials was how far the entire department was going to uncover carmodys source according to another confidential report obtained by ktvu we now know police served a total of seven warrants in their. Bailout police to track carmodys location through his phone and retraced his steps and searched security video at nearby locations. And starbucks, the italian athletic club, coneys pizza in north beach in the Washington Square in. Were hoping to catch the handoff between carmody and his source, but records show they never did. Investigators also searched Text Messages and call logs and identified two officers they believe leaked the report. The never collected in the other evidence showing the officers provided the hitachi for report. They began planning the infamous raid with approval from command staff. Several members of the sf pd and two fbi agents held carmody for six hours while they seized possessions at his home and office. Carmody refused to reveal his source. It was stunning to me when this happened. In part, because it happened in a city that puts itself forward as a champion of civil liberties, as a champion of free press. Reporter david snyder is a journalist, attorney and directive the executor of the First Amendment coalition. He is troubled by the elected officials seeking to uncover a journalists source. When you are talking about documents that have fax nobody is contesting, the motive doesnt really matter. Reporter exactly one week after the raid, the internal Affairs Investigators who wrote the warrants called the Media Relations department and discovered carmody had a valid press pass. Another week after that chief scott changed course and admitted it was wrong. But he blamed the investigators for the blunder. Theyre trying to break down the door of a journalist using sledgehammers for doing nothing more than what journalists do every day. Reporter attorney Ben Berkowitz it was harmonies defense attorney and negotiated a settlement with the city. Part of the deal requires the department to make sure all employees are familiar with the shield law. The sfpd demonstrated a fundamental lack of understanding as to what journalists do, how they use Confidential Sources at the protections that apply under our constitutional democratic system. Reporter the department did not comment on the new revelations, citing an ongoing administrative investigation. The chief has asked an outside agency to investigate the leak. No one has stepped up to take it over and its not clear if a crime was ever committed even though there is no criminal investigation, the Citys Department of Police Accountability is conducting an administrative probe. Sources tell ktvu the agency may be using information, like the names of certain officers collected in the illegal searches. Chief scott previously said none of that information would be used. Here is what the model does, it doesnt even paint the fog in there. We know there is fog, we just saw it. But i expect the model is having trouble picking it up. But the idea is, there is your temperature spread. So coast, bay, and that pattern, snapshot that in your mind. Its the next couple of days. Its what we are used to in july. And it will increase the fire danger. They are quality will get a little bit of a downturn as well. So as we go forward, as we look at the five day forecast, no big changes for the next five days. No red flag warnings necessarily. But with the hot days inland day after day after day, right through sunday and even a little bit and monday you will magnify, it doesnt take much to start a fire in the inland valleys. Watch for that and on the bay and coast expect what you always get in july, mild to warm weather. But inland, its hot. Coming up in sports, winning can be a gift and a curse.
