Loved ones. State and federal officials now working to find emergency housing for the hundreds of people displaced by this fire. Fema and nonprofit groups bringing in supplies for those who have sadly lost everything. Welcome, everyone, to the four. This afternoon, im Heather Holmes and im alex savage. The death toll in lahaina is expected to climb. And this wildfire already is the deadliest in modern us history. At least 96 deaths have been confirmed, and that surpasses the deadly camp fire here in Northern California, which claimed the lives of 85 people back in 2018. The search and rescue operation is taking painstaking efforts to try to find survivors and victims with thousands of people still waiting to survey the damage, the initial steps toward recovery coming amid a Class Action Lawsuit targeting hawaii electric. Foxs max gordon has the latest details. So much heartbreak, so much sadness on this island and so many people here still searching for answers. Still no official reason why these fires started. But over the weekend, a Class Action Lawsuit was filed against Hawaiian Electric. Thats the power provider here this lawsuit alleges that Hawaiian Electric kept their lines energized and ignored weather warnings, weather warnings that said, essentially that the winds would be high, that their red flag fire advisories and that the electrified lines going down caused these fires. Hawaiian electric, in a news, said that they cant comment on pending litigation, but that their focus on reenergizing the west side of the island. Meanwhile the states governor asking for an investigation into the cause of these fires and into their aftermath and saying that firefighters initially thought this fire was out. The fire that destroyed lahaina. But 80 mile per hour winds caused what he calls a fire hurricane. That meant that fire traveled one mile every minute, resulting in this tragedy with those kind of winds and a 1000 degrees temperatures. Ultimately, all the pictures that you will see will be easy to understand. The local government here still limiting access to the town of lahaina devastated by fire, saying its still unsafe and that theyre still recovering bodies. In one case, an entire family of four was identified as victims. And overnight, curfews in place on the west side of maui running from 10 p. M. Through 6 a. M. With access during the day limited to residents and people with hotel reservations. According to the governor, more than 2700 buildings were destroyed. The vast majority of them being houses. With so many people now without homes, the need is immense. The county estimates around 4500 people now need shelter and many waiting for word of loved ones still missing life, what i have imagine somete th of a and unequal disaster like the town itself. I cannot describe how no feelings i get. Meanwhile, the death toll is expected to rise. People here asked to submit dna swabs to help identify victims on the island of maui. Max gordon fox weather and investigators there in maui are searching for clues for what may have sparked the catastrophic wildfire. This is more questions are being raised about preparedness and the islands warning systems. Our Investigative Reporter brooks jarocz joining us now live from the newsroom in. Brooks, youve been digging into what officials may have known and when about those alerts. What have you found out . Well, so far, i found several reports that explicitly say wildfires could become more frequent as Drought Conditions there become more frequent in the islands Hazard Mitigation plan. It says west maui has a 90 chance or greater of seeing a wildfire every year. I want to put up a graph on your screen. This is from a july 20th, 21 wildFire Prevention report. And it shows and warns of fires increasing in frequency and severity. The report concludes mauis new Strategic Plan fails to address Fire Prevention as a mission or a goal. And data shows maui county has experienced 80 wildfires over 20 years. That means on average, four fires a year. Guys okay, so, brooks, what about this latest fire that ultimately, as we all know, sadly burned down the town of lahaina . What precautions were taken or where did things fall short . Well, lahaina is very vulnerable to wildfires for a few reasons. First, there are only two main ways in and out of the city, which did cause evacuation issues. Next county reports show west maui has the second highest rate of households without a car, making it harder for people to get out. Also, that area includes lahaina, as is having the highest rate of nonenglish speakers in the county. And while Officials Say they issued text alerts about the fire and evacuation warnings, many survivors say they never received any alert. Now we do know electricity and Telecommunications Towers went down in areas before alerts went out and Officials Say hawaiis highly touted siren system, well, it never sounded anywhere in maui, hawaii state attorney general has since now launched a review of the wildfire response. And this, of course, will be part of that. We can imagine a multifaceted investigation will get underway now from from what you know, are there other measures that should have been taken to prevent a fire from from starting in the first place . Well, short answer is yes, because across maui, several plantations have closed and Vegetation Management has really been limited or hasnt happened. So theres been an increase in non native grasses that im told have grown fast and dry fast. That means they burn fast. I also spoke with a professor at uc merced who studies wildfires and climate and he says we have to be better prepared for anything and everything. This is a warning that things that we didnt expect could happen and are much more becoming much more likely to happen. And we have to start trying to anticipate with inadequate and complete information in perfect models, you know, the past not being a sure guide to the future, how to build resilience into our systems. If were going to rebuild lahaina, they need to be built with different materials, different spacing between structures, different systems for suppressing fire. Do we need to manage the vegetation area differently . Things like that as well. So the biggest hangup right now in maui appears to be funding. Theres some debate on how much money should be thrown at wildFire Prevention. Im going to look at some of the things that maui was warned about before this fire and potential solutions for the future. Thats all coming up. New at five, guys. All right. We have thunderstorms there. You can see just lighting up the sky over areas of the sierra. It comes in our direction, but tends to fizzle out as it does. We had a few lightning strikes over the pacific earlier this morning and we had a downpour or two moved through the bay area last night into this morning as well. And as i stop this here, you can see we are mostly cloudy with a little bit of a green on the screen indicating that we do have the possibility of isolated showers out there today as well. So were going to continue with this pattern, at least for one more day. It will begin to shift out on wednesday. Right now, we do have winds onshore at 13mph through fairfield. So the onshore breeze hasnt let up completely, although it has died down quite some. And with that temperature are just as warm today. Compare to yesterday, even a little bit warmer in some spots, although areas over the north bay where we do have the clouds overhead helping to offset the heat just a little bit down by nine degrees over novato, san jose down by four compared to yesterday at this time. But still very toasty inland. Take a look at the inner east bay where we are near 100 degrees. Areas like livermore 97, 96 reported in fairfield, a little bit more comfortable today in the north bay, 82 in santa rosa. And then you get closer to the water, 68 degrees in San Francisco just a Beautiful Day there. We have the giants playing a little bit later, mid 70s right now in hayward. Now we turn to the latest from georgia, where a grand jury heard from more witnesses in the investigation into alleged interference in the 2020 election by former President Trump and his associates. Current and former georgia politicians were seen at the Fulton County courthouse today and this afternoon a list of criminal charges against the former president. Briefly appeared on a Fulton County website, but that filing was taken down quickly. And District Attorney fani willis said the report of charges being filed was inaccurate. The counts posted included conspiracy to commit false statements and state racketeering charges. Some of his alleged coconspirators are under the rico act. The acts of one are deemed to be the acts of all trump faces other charges in new york, florida and washington, d. C. But this case could be different than those federal trials because georgia often allows cameras in the courtroom. And in the case of a state conviction, there is no chance of a president ial pardon. For more now, we are joined by laurie levenson, a law professor at Loyola Marymount university. Thank you so much for being here. So as of last check, the grand jury still meeting. So that means theyve been at it really all day. What does that tell you about whats going on inside and the likelihood of charges . Oh, i think it indicates that theres probably charges that are imminent. Now, they may not come tonight because the grand jurys been working all day. But weve all anticipated, given the security at the courthouse, given the witnesses have called before that there will be some charges against donald trump and others that will come out in the next day or two. When we talk about this georgia case, an investigation thats been ongoing now for a couple of years. Oftentimes people think of that infamous phone call made by former President Trump immediately following the election to georgias secretary of state. Lets listen to a brief bit of that call. I i just want to find. 11,780 votes, which is one more that we have because we won the state. So tell me, brad, what are we going to do . We won the election. And its not fair to take it away from us like this. The people of georgia are angry. The people of the country are angry. And theres nothing wrong with saying that, you know, that youve recalculated. All right. So, lori, how crucial is that recorded phone call going to be to the prosecutions case . Well, i think it is likely to be one of the counts, but its not the only count. You know, we have some leak of what the charges are allegedly going to be and soliciting a public official to do something false. This may be one of them, but there are others as well. And one of the blessings of the prosecutors using what theyre calling the racketeering statute, the rico statute, which is usually for mafia cases, is that they can link together a series of criminal acts in multiple counties and say that those were all being done to benefit donald trump. So i think that call is key. Trump will probably just say, well, i wasnt really asking you to do anything specific. I was just sort of hinting around. But thats why you have a grand jury to sort out how serious donald trump was in his request. And in terms of what were seeing happening there in georgia, where does this stack up, lets say, in the level of severity . When you look at the other legal troubles that the former president is now facing . Well, hes certainly facing many legal troubles. The big case up in washington, dc is a federal case, and that has serious consequences because some of those charges are ten, 20 year penalty. I think the least serious case right now is the new york case. Thats kind of an odd case involving Michael Cohen and others. And then you have the mar a lago case. And in my mind, that is by far the strongest case. And in particular because of the obstruction of justice, when hes telling people to erase video, thats pretty key evidence of his intent. So how do you expect trumps legal team to respond to what we expect is going to be an indictment in the state of georgia . And how do you think the response will differ from from what we have seen previously with these other charges . Well, well see the kind of attack that weve seen donald trump bringing all along, saying that this is a political witch hunt in that, in fact, people have misconstrued what he has to say. I think on the more serious side, hes going to say that my statement i didnt really know that i had lost the election. So i wasnt asking people to do something i knew was untrue. Thats becoming much harder for him to say. The more people who come forward and say, i told them he had lost the election and he still wanted to push. Yeah, we just want to remind viewers at home about the number of indictments that are that are facing the former president. I believe we have a full screen that sort of lays out all of the different various charges that hes facing. And we have seen throughout this process, his team kind of come at it, as you say, from saying this is a political witch hunt. Do you believe, though, that the response will be any different . And do you believe that it will depend on what the charges, if there are any, coming out of georgia, will be and which of those charges, potential charges, do you believe will be the most serious . I think some of it will be the same. I think that trump will try to convert this to an advantage by seeing, say theyre going after me, give me more money to defend myself. I think on the coconspirators, thats the new element because we can very well expect that there will be people beyond trump who are going to be indicted here. And then that raises interesting questions. Are they going to be on the government side . Are they going to turn against him . And if they do, the defense people, the trump people will go after them. So it expands the nature of the cases. But as you said, there is so much going on and you layer on that that trump still is a candidate for the presidency. Its hard to keep track of it all. Okay so finally here from just purely a timing standpoint, how do you see each of these Different Cases unfolding . Which one do you believe gets to trial first . Well currently, we have the march trial for the new york case scheduled. Then in may, we have the maralago case. But the government just asked for a january date on the washington case. And we dont know about that yet. I think its fair to say that there will be some criminal trial against donald trump in spring. I dont think hell be able to avoid all these criminal trials until after the election is over. And i also want to say he has a couple of civil trials that are facing him as well. Yeah sure. A very busy legal schedule to say the least here. And a political schedule as well. As you point out. Laurie levenson, law professor at Loyola Marymount university, thank you for the insight. We appreciate it. My pleasure. Okay. Back here in the bay area, some confused driverless cars. Were going to take a closer look at that traffic jam in San Franciscos north beach neighborhood. Our tom vacar has been digging into the problems and joins us now live from San Francisco. Tom a park more than 4 or 5 miles away from north beach. Now, this was more than a jam up. Its turning out to be a clam up by some of the key players in all of this. And this is what i mean. This event in north beach, just one day after the California PublicUtilities Commission allowed the cars to provide paid passenger service, 24 over seven is raising a lot of concern with sf board of supervisors president aaron peskin raising the specter of earthquakes, Power Outages and fires. Think about a major disaster. I mean, if you had a lahaina type event or events that weve had in San Francisco , loma prieta most recently when cell phone reception can be disrupted, theres no way to move these things at precisely the time that we would need to deploy ambulances, first responders, fire trucks, as we did in loma prieta, and fires in the marina. Now just as they did friday, the cruise people, which is the division of General Motors corporation, mind you, chose not to talk to us at all. No writing, no nothing, no interviews. And because of that, we have another problem. The California PublicUtilities Commission, which i asked for an interview, said that they would try to get back on me to do such a thing, but they never did it within the time frame that they themselves had laid out. Now coming up, five, were going to take a look at this connectivity issue and what that really means and why that may not be a very bit of good news for a lot of people who depend on these cars in the future. Reporting live, back to you. Okay. So, tom, you spoke with the board of supervisors president aaron peskin. And whats the next step . Is he planning to appeal the fccs recent decision . Well he initially called for a rehearing, but whats going to happen now is that the cpuc itself really has the opportunity to relook at this simply because of this very embarrassed and somewhat dangerous thing. Now, what peskin says is that the technology, when it is finally mature, will be awesome and itll provide a lot of opportunities throughout San Francisco and other other cities around the country. But he wants it phased in much more carefully and as a result, theyre not trying to put the genie back in the bottle. They just want to make sure that when the genie comes out, it can really do the magic that is constantly promised but not delivered upon it. Finally, tom, let me sort of see if i stand this the Taxi Companies are blaming the huge amount of people who were at Golden Gate Park for outside lands, for the connectivity issues with those cars in north beach. Yeah thats exactly what they did initially. Now, whether or not theyre sticking to that story, i think one of the reasons theyre not answering my questions is because it doesnt make a heck of a lot of sense unless there was some vital, really important facility that crews had in that area that may have been interfered with it. But the reality of the situation is thats the same thing is when you go to like a big Football Game and you try to make a phone call or send text, sometimes its problematic because so many people are using it. This occurred over in north beach, which even by any standards of today, is not busy like it used to be before the pandemic. So that claim is not really something that i give too much credence to. What are also known as pdx. This project was a collaboration between experts at the Lawrence Berkeley national laboratory, the molecular founder and the joint bioenergy institute. The work was supported by the Us Department of energy. While traditional plastics cant be recycled, this new approach creates plastics that can be repeatedly broken down and formed into new products. Once again. And for more on how this all happens, were joined by brett helms. Scientists of organic and macromolecular synthesis at Livermore Labs. Brett, thank you for the time today to help us understand what this all means. First off, explain the process here. How did you and your colleagues use e coli to create the Raw Materials for bio renewable plastics . Yes so youre probably aware that we make about 400 Million Metric Tons of plastics every year, and these are mostly from petrochemicals in the us, we recycle about 5 of those plastics because Plastics Recycling is both difficult and expensive. The bonds that make up the plastics really hard to break. So at berkeley lab and uc berkeley, we cracked the genetic code to trick bacteria like e coli to turn sugar and other renewable carb sources into the Building Blocks for new plastics that are easier and cheaper to recycle. As you mentioned, these plastics are called poly amines or pdx. We think that about 10 of all plastics can be replaced with pvcs, where we would look to use them in things like mattresses, furniture, shoes or even clothing. We also found that these bio alternatives are greener and cheaper than petrochemicals. Once we advanced to production scale and were currently partnering with companies to develop these plastics for use in their products. We give them materials choices that are more sustainable and more recycling and efficient options to reuse those materials in their manufacturing and subsequently. So i mean, i think people are listening to this and they hear, well, you know, obviously this is a greener alternative when it comes to plastics here. But but will these biological alternatives be less expensive than plastics created using petrol chemicals, especially when you Start Talking about doing this at scale . Yeah, great question. So when we think about the feedstocks that we use to make materials that go into products, you know, the closer we can get to local low cost feedstocks, thats how you bring down the cost of production. And it turns out that e coli and other bacteria can be engineered to take things like aggregate waste, which is essentially discarded. Right and you take that and turn it into the Building Blocks for future generations of materials. And thats really where this this project is going. What the advance purports to benefit the community and i think well see a lot more from this team making that happen at at the scale at which it needs to happen in the time frame that it matters to solve the problem. All right. So what about quality . I mean, do you lose anything in terms of quality with bio renewable plastics . And are there any limitations on how these plastics can can be used . Excellent question. So when we recycle plastics today, we basically grind them up into little bits. The plastic chains get shorter and shorter and shorter and their properties deteriorate with each cycle of reuse. Thats whats great about pvc is that they can be chemically recycled back to the original Building Blocks. And so you remake the same material fresh and it loses none of its properties as you recycle it. How ever many times you recycle it. So thats thats the key advance here Th Technology to do better than toh existing plastics. All right. You were talking about the Plastic Waste problem that we obviously have here. And i think we have a graphic to illustrate what what were talking about here. 400 million tons ofte geny year globally here. How how significant is this breakthrough from you and your colleagues in terms of reducing the amount of Plastic Waste that all of us create . Yeah. So about half of that 400 Million Metric Tons goes to things like single use plastics. These will be, you know, plastics, straws and Water Bottles and things like that. Thats a very specific class of plastics that youre likely to watch. The technology veer towards. You know, compost ability, because those are in contact with food. But theres a whole collection of plastics that are used in durable goods, again, like furniture and mattresses and things like that, where its been really challenging to find a solution to recycling those materials. You dont want them to be biodegradable. You dont put them in compost files. And so thats really been a niche area for us to focus on and one that differentiate rates. The type of outcome that we are able to deliver. I think a lot of activity and industry is addressing the single use plastics. We go after the difficult to recycle stuff and in doing so, i think we present a unique opportunity to solve those problems. Yeah. Yeah. It sounds like youve taken a really important step, step forward here in trying to address the Plastic Waste problem that we certainly all have. Brett helms with Livermore Labs in berkeley. Hopefully we can get back to that really important conversation, something that were all kind of looking at as we await that decision in georgia, potential decision as the grand jury continues to meet, weighing potential charges against the former president. Okay we want to get back now to the appeal amongst republican voters. A former President Trump, despite his legal troubles hopefully. Now here with us is shawn rosenberg, a professor of Political Science and psychology at uc irvine. I know we had an earlier issue with the connection, but hopefully you are there now. We talked about the polling numbers, which show trump with about 57 of support amongst primary at a potential fourth indictment. Why do you believe it is that so many members of the Republican Party are sticking by former President Trump . Partly, i think its a matter of what they understand corruption to be. In their context, what trump is doing. Trump really, its essentially the popular will of the people and therefore, insofar as he is acting in a way that serves them any obstruction on how he acts, as in appropriate and any suggestion that what he may have done is in some sense problematic or corrupt just doesnt make sense to them. He should be able to do what he wants. He is the president. He is the leader and any attempt to undermine him is , in fact, corrupt and problematic. And so these various kinds of accusations and indictments are not very meaningful to most of trumps supporters. I think a lot of people sit back and they say, boy, he has really been able to kind of rebuke the most modern pattern of politics, which is if you get into some sort of legal trouble, if theres something that comes after you, you poll numbers start to sink a little bit. But that is quite the opposite of what were seeing here. Right. Because trump is basically saying, you know, in a context of a liberal democracy, we really are rule governed in a way thats supposed to protect all of us as individuals. The law is sacrosanct, and trump is really challenging that basic understanding of politics and what government is all about for him, its not about protecting individuals or the rule of law associated with that. For him, its a matter of a leader doing what needs to be done to pursue goals which are presumed to be really defined on problematically. And anything that gets in the way just makes no sense or is itself a problem. Okay, professor, we have seen the former president really pushed this persecution complex. Want to take a listen now to how he feels about his current legal troubles. Im being indicted because theyre afraid of all of us, because we have a movement thats never been seen in the history of our country. Okay. He says its a movement. And as weve talked about, it seems to resonate again with a majority of republican voters, at least at this point. Trump and his support lives in a world of us and them. The people that are for us and the people that are against us. And what this judicial and legal action reflects is the opponents, the illegitimate opposition, trying to abuse power by undermining trump and obstructing the people he represents. Okay. So weve seen this support sort of hold steady, professor, but do you believe that there is anything that would change the amount of support that the former president is seeing, anything in terms of a legal outcome . No, i dont. I think if the indictments, you know, georgia will probably come down with an indictment as well. And even if he were to be convicted prior to the election, none of this if anything, this would rally support because its just an example of how a illegitimate opposition is unfairly abusing its power. We turn now to our weather here in the bay area and things feeling very muggy. You might have noticed a little bit more humid than we are used to here. As we give you this live look in the east bay, it looks like that is mount diablo right there. And you see a lot of those clouds off in the distance. Rosemary, i think like a lot of people around the bay area, i was very surprised to wake up in the middle of the night to pouring rain on the roof of my house. I was not expecting that. Yeah. So the berkeley area, parts of the east bay hills did receive a downpour, a little bit of lightning moving through the bay area at times. You may have noticed in that shot over mount diablo, weve got som indicatior and the possibility of a few sprinkles out there, maybe even some lightning. We are, of course, are worried about the fire danger that comes along with that. But were seeing some pretty good rain of fall as well, especially over areas of the sierra. Lets take a look at the temperatures in and around the bay area because for most, in addition to feeling very muggy out there, its about the heat, especially inland where we are in the upper 90s for the inner east bay right now. Livermore 99 degrees. It was just a moment ago that number hit 182 in the north bay of santa rosa and in the south bay 84 over san jose, a beautiful 72 in the city of San Francisco though. So not everybody is baking, but it is fairly warm in most areas, if not hot if youre going to the giants game a little bit later, today is going to be nice out at oracle park, 67 degrees, partly cloudy skies and the west breeze to about 15mph. So we havent lost the onshore breeze completely, but it has definitely tapered off quite a bit. And our inland cities arent enjoying that cool pacific air. Heres a look at just all the thunderstorms that are firing up over the sierra. And you can see how the motion comes in our direction. Now they have been fizzling out for the most part. Right now, it looks like that motion is moving north of us and will perhaps take aim over areas of ukiah. But we are still partly to mostly cloudy over the north bay, partly cloudy for the rest of us. The futurecast here, the low thats off the coastline that is drawing in that monsoonal moisture in this direction. Well eventually shift actually a little bit closer to us, turned a little bit more southerly and help to push that moisture out. And as we get later into the week, a trough will be developing and that is going to cool things down. So thats whats to come.
