What we know about the judge, where he might land and what one viewer is telling nbc news with the attorney for the floyd family live on the show in a couple of minutes. Good morning, im Hallie Jackson in washington on this busy friday, along with our nbc news team in surfside, florida. Kerry, we heard from officials not too long ago this morning and i was struck by the notes of optimism they were hitting, that they still have hope even with some of these frankly pretty grim numbers that were getting, a jump in the number of people unaccounted for, up to 159. It is a get punch. Reporter it is a gut punch. The confirmation of four people who died inside the rubble and the rescue teams on this have been working round the clock are being hit with the rain that just hit here and it has been like that several times. During the 3 plus hours dealing with the catastrophic failure of a building. The efforts are under way and its important to say they are still calling this Search And Rescue. They are not calling it recovery. Of the four people who have been pulled from the rubble, those bodies have been taken to the medical examiners office. They will have to do proper identification. Remember that many of the people who were here are seasonal residents and here or visitors from argentina as visitors, paraguy, some back and forth from venezuela and israel. This is predominantly a jewish area so the Identification Information when it collapses and you pull somebody out, happened at 1 30 in the morning. People dont have passports and Drivers Licenses with them. They have that challenge of identifying who is who, hallie, but the process here about saying that this is a continued effort to have Search And Rescue is to keep that hope alive. Lets hear what the may yoor had to say. Well continue Search And Rescue, because we still have hope that we will find people alive, that is exactly why were continuing and that is why were using our dogs and our sonar, and Everything Possible to seek places where there may still be people to be found. Reporter you heard the equipment that the mayor talked that the Fire Department, Search And Rescue is using on top of that, they have brought in reinforcements from the city of miamis Fire Department and six other Fire Departments around the state that have experience in urban Search And Rescue. Yesterday the Assistant Chief here those on the scene heard tapping and that tapping indicated to them on the scene that somebody was inside trying to communicate. They are no longer calling it a tapping sound, they are hearing sounds, but theyre not calling it a tapping, and it may be something as simple as a broken pipe with water just dripping. Hallie . Which is hard to hear for people who are Still Holding out hope here. Tom, weve been talking about the numbers here. There are people behind these numbers, Family Members. You and kerry have been talking with them and it is so difficult to hear them talk. I know not to put you on the spot, you know this community really well, tom. You understand, you know people who live here. Youve grown up and reported in this area for a long time. Talk to me about what youve been hearing from those Family Members and what youve been hearing from your friends in the area this morning. Its incredibly sad. The families are in a state of shock, some devastated, some Still Holding out hope. When you look at the disaster behind me, the collapse of an entire tower in surfside, and these families have seen the video that youve seen, theyve seen the Surveillance Video and some of them are Still Holding out hope and that is pretty impressive, because when you see that video and the number you said 159 people still unaccounted for, its really hard to understand. I asked the mayor if this was still a Search And Rescue operation and she said it was and i asked her if there was any proof to think that people were still alive and she says all they have is hope. The excavator is pulling off loose balconies. Firefighters are risking their lives. This is a very dangerous situation. I do know this community. I grew one a lot of the families that happen to live here, families from miami, cubanAmerican Families. We went to the same church together, to the same elementary school. I went to school with their kids. These are good mothers, a group of three grandmothers all close friends, went to an art exhibit in miami, a popular art exhibit thats going on right now. Its our understanding one of the grandmothers owned a condo in surfside and some of the grandmothers you could imagine theyre close friends, why dont we sleep over the condo. All three grandmothers right now are missing. P. J. Rodriguez whose mother and grandmother inside the building. The night before the collapse a strange sound woke her up from her sleep around 3 00 in the morning and sounded like the building was creaking. He said dont worry and the next night the Building Collapsed. Heres what he had to say after he saw the horrific surveillance footage. Hope just disintegrated at that point when we see the video showing the actual tower collapsing. You know, we dont have official word so i dont want to say its completely hopeless but after seeing the video, its not a lot of hope. She was amazing, and then my son is, thats the hardest part right now. He keeps asking me whens she coming over because he saw the footage this morning. Reporter p. J. Was telling me as you heard there his son had seen the footage. He loved his grandmother so much and hoping she comes back so they can go in the pool but he has pretty much lost all hope. He has seen the video. They were on the 11th floor. When you see that video its just so hard to understand, hallie. I really do admire the families that still are praying and have hope. This is the excavator. Theres a very, very active situation. Theres a debris cloud, piece of building fly. The excavator is taking off chunks to try to stabilize the building . Reporter our team is trying to figure this out. They havent explained it to us yet. Theyre pulling pieces off of the tower that did not go down. Theyre pulling on balconies, pulling off railings, all very strange to us because we understand they are still searching that Debris Mountain that is underneath on the bottom so some of the stuff is falling on top of that mountain. They tell us Structural Engineers are working with the firefighters who again i cant stress enough, youve seen the video, going into this garage, the walls are caving in and trying to find anything and again, pieces of this building are falling on top of that debris field so its an active, its a confuing and dangerous situation here. All the families want answers and every minute that goes by, its just you feel less and less hope. Kerry, let me have you jump in here. Theres also a huge question, we dont have the answer to this and probably not going to know for a while, how in the heck did this happen . How in the world does this building just collapse in an instant overnight . We still dont know the reason. Are we any closer to at least getting that, kerry . Reporter no, we only have people who are going to speculate and it will take forensic engineers to look at it. We know there had recently been a 15 million assessment on the kond minute condominium, the people were going to share in the expense of a 15 million renovation. 40 years a building is having a State Inspection which was under way. Its important to note the area that collapsed faces the atlantic ocean, thats where the salt spray comes from. It is common for buildings along the beach to have concrete restoration because of the salt spray, you cant see, hardly enfeel but its there, unless there happens to be a storm, migrates through the concord and can hit the rebar, the steel inside which is what holds the Structural Integrity together of a building. So once they get through what theyre dealing with now, search and recovery, then they will eventually be able to look at the pieces and see if they find in the Forensic Research of what actually happened by analyzing the debris. I might also note one of the things that may seem complicated by seeing this equipment right now taking out parts and parts that are falling, and et cetera, what theyre attempting to do from my conversation with the miamidade Fire Department is, theyre attempting to secure the possibility of this actually falling on its own, what remains there falling on its own, and so it seems counter intuitive having something come crashing down if it comes crashing down but having it out of the way as opposed to removing a piece, kind of like that game of jenga, you pull something out and hope it doesnt fall, it could, theyre trying to stabilize what might fall so that then they can begin doing this effort with super heavy equipment and pulling off off the top. Up until this point the only access point has been underneath and while theyve been tunnelling coming up from the garage they would like to attack this from the surface and thats what were looking at right now according to what the Fire Department officials have been telling me. As we said, we are 30 hours into this thing. It is still so active. Kerry sanders and tom llamas thank you. Dr. Lieberman, thank you very much for being. Us. I know youve been at the scene. Can you tell us what your experience has been like there . Yes. So i got here i guess it was yesterday probably around 1 00 p. M. I came on scene for a Trauma Surgeon. A colleague of mine is on scene the night before so i came to relieve him and for the first few hours in that capacity here as Trauma Surgeon for Jackson Memorial hospital. Around 7 00 p. M. We got the official deployment from miamidade fire rescue, urban Search And Rescue Task Force One to deploy so i kind of switched roles from Trauma Surgeon at Ryder Trauma Center to medical manager for the miamidade fire rescue, urban Search And Rescue and basically the pictures of what youre showing your viewers says it all, 12story building reduced to about four stories and pretty much where were looking at. Youre preparing for Blood Infusions in case there are survivors found who need immediate help. Tell us about that. We have a Good Relationship with Jackson Memorial hospital and miamidade fire rescue. We do a lot of projects together, and we collaborate really, really well. So we obtained blood from our blood bank at the hospital. Its all been stored in a cooler or a fridge rather and we have it here, should we need it, we could always get new blood from the hospital if we need it, but at this point, we havent had to use any blood. This is a difficult question, are you hopeful that you will be able to that there will be somebody you can find or at this point given where we are in the process, what is your sense of optimism, i should ask, doctor, based on your professional opinion of what youve seen . You never give up hope. Patients coming into the hospital i thought had no prognosis and wouldnt survive and proven me wrong and left the hospital. The same thing here. Everyone here is working this as Search And Rescue. No one has given up. Everyone is working exceptionally hard. The people that im working with, urban Search And Rescue team, some of the best people for the job, theyre absolutely amazing. They impress me every day that i work with them and no one has given up hope and were just doing our job. I understand that you also are responsible, are involved with the actual responders, the safety and wellbeing. They almost have a superhuman strength to keep going even in the face of all this. Yes. Thats, you know, it comes with the job working crazy hours, no sleep, nonstop. Some of us are going on 25, 26, 27 hours right now. My responsibility is the wellbeing and safety of the task force and all the people who are here searching, and thats my main concern, that they stay safe and they dont need my help. Reporter first before i get there i want to show you behind me the government center, the courthouse where this went down two months ago the verdict coming down here. Behind me it is open to traffic and so much of this commute had been barricaded for weeks, even months before this verdict came down, a lot of change has happened in minneapolis over the last two months. Looking ahead to this afternoon the sentencing hearing. Derek chauvin faces a maximum of up to 40 years in prison. Prosecutors are asking for 30 years behind bars. The defense wants probation and time served but Derek Chauvin sentencing guidelines for seconddegree murder are usually between 10 and 15 years behind bars. Many legal experts say hes likely to get more because the judge agreed there were aggravating factors in the case, chauvin committed his crime in front of children. We did seek with a juror who was present in the room for the Jury Deliberation and everything is sinking in for her, more than two months, journey howard, she told us the key piece of evidence in this case was dr. Martin tobin, the world renowned pulmonologist. Dr. Tobins was huge, also the chief of police hearing him speak and say definitively this is not what we train, not what we teach, this is not what we do here. This is against our poliies as caretakers. In our custody and care and that was not the case. Reporter the historic nature is sinking in for her. I asked her what she thought an appropriate punishment for Derek Chauvin would be, she declined to answer and said shed leave that up to the judge Gabe Gutierrez live in minneapolis, thank you. You heard gabe lay out the prosecution is looking for 30 years behind bars for chauvin, the defense wants probation and time served. The maximum is 40 years. What does accountability look like . Is it the max . 30 years . What would they be happy with, if you will . The family has always said that what they want to see is Derek Chauvin be sentenced to the same thing that george floyd would be sentenced, had the roles been reversed. Though seek equal justice and accountability. Theres no amount of time as they have articulated here recently that would be just because justice would have george back. They hope this sentence will help america to get equal accountability and justice. They know george is not coming back and to us its a case, a cause, a hashtag. To them thats their flesh and bloo we talk about Accountability Versus justice. I ask you as it relates to accountability the max is 40 years, right . If its anything less than the max do you feel like George Floyds family will feel robbed of the accountability theyre seeking . Well i think Attorney General Ellison and his office have asked for 30 years and explained to the family the snesen guidelines say 10 to 15 years but because of aggravating circumstances give the judge permission to have an upward departure. Would they like to see 40 years . Absolutely but they understand the Prosecution Request for 30 years and they believe if the judge gives 30 years that they will be able to thank the court. Anything less than 20 years, its troubling. The defense wants probation and time served. Derek chauvins lawyers point to the fact hes 45 with the preliminary heart damage diagnosis, likely of him becoming a target in prison and he is the product they say of a broken system. Your reaction to that . Do you think that will have a sway with the judge . I dont think so. And what im thinking about as i hear the excuses offered, none of those excuses were accepted for black people when they were convicted of murder. Why would we do this for a white man killing a black man. This is an opportunity for america to be able to show that were ready to have this racial reckoning, that were finally ready to deal with the inequities in the criminal Justice System that is inherent discriminatory effects that are articulated from the actions of our courts this could be a Turning Point pour america. Based on may 25th, 2020, 13 months to today to see if america can be better, can we have better policing. Thats why we need the George Floyd Justice in policing act after we get accountability today in the criminal matter. We got accountability on the civil matter but we need to get accountability on the policy level so hopefulie we can prevent future injustices like george floyd, breonna taylor, jacob blake, jr. , like Stephon Clark and Alton Sterling and philando castile, like jefferson, the list goes on and on. We want to have this accountability so preferably it can prevent us losing our children unjustly to the very people who are supposed to protect and serve them. Mr. Crump, im out of time. His son named luiz, Muscular Destiny Living Inside of the unit. He didnt want to go on camera but doesnt know what to do other than stand here and wait, the reality so many families are going through. Another gentleman here says a Family Member was inside and very evidently with his words losing patience. This is tough here, on day two here and the rescue crews so understandably are work so long deliberately through this but at the same time families standing waiting, hoping as officials have said that their loved ones may still be underneath that rubble here at the same time these Weather Conditions have been extremely difficult, again, bursts of rain coming about three times just in the last few hours here, hampering this very effort here. 159 individuals still unaccounted for, as everybody here on scene at the Reunification Center waits, just three individuals overnight pulled from the rubble, none of them surviving. This is tough and as the one man clearly becoming impatient and understandably as folks are desperate to understand what lies beneath that rubble and if theres any chance their loved ones may still be surviving. I do not have the updates yet. Im sure the number will change by the end of the day, if not sooner. I can only hope its for the better but i dont have an update as of yet. Okay, have you had a chance to get over to the family Reunification Center my colleague was just reporting from . I havent been there today because i was in a rush to get to the town hall, but i was there most of the day yesterday. My day was split between being there and being at the site on 88th street. I wonder what you tell those families, the families that you visited with, ms. Paul. What is your message to them, as they are in this moment of you have to imagine utter agony. I do, and what i can tell them is that we will do everything we can to help with this rescue and recovery and we will have people donating Excavation Equipment and we signed off on one yesterday at the site and another one i spoke with today, a team from mexico that is there ready to help but they have to go through the proper channels. Theyre standing by waiting and if they need assistance from the town well authorize whatever we need to authorize to help find people. One of my colleagues on scene Kerry Sanders reported officials were talking about yesterday hearing what they described as tapping. Now they destroy as noises general. Any signs, anything coming from the pile of wreckage that we are looking at that could in a specific and concrete way give the responders hope that somebody at least is alive in there . I can. Its heartbreaking when you look at that pile. Its heartbreaking, but we need to know, we need to find them. You have to have closure and you have to know, there is i believe a possibility that we can find somebody there but i dont know, and the weather is not really cooperating. Its raining its not raining, its windy. The Rescue Workers are there, not just ours, all of the neighbors municipalities have come forward. Public works director been on the site since before last night, since the night before. Ims loing track of the days. Im sure youve slept almost not at all. Anecdoally one woman woked up the night before the collapse saying she heard creaking. Any reports of concerns about the structural stability of this building prior to its collapse . Unfortunately no. The only concerns we had received was about a month ago about the roof. They were doing roof repair or new roof and we had an issue, actually one of the couples who was unaccounted for and they had contacted the town, contacted just about everyone off the commission and we all responded and the issue was that the to bring the tar up to the roof, raising it too close to the windows and the fumes were overwhelming them. An elderly couple that was homebound. We had our Building Official work with them to do what they could do to relocate it. Any concerns about any other buildings in the area at this moment . Were concerned about all the buildings because until we know exactly what happened here, we have a Structural Engineer independently hired to look at this building and all of our condo buildings because if theres, we dont know what happens so we dont know where the vulnerabilities lie, was it in their maintenance and management, was it something you know, was it Something Else . We have no idea and so we need to look at everything and make sure that all of our residents are safe. This is a building that has two Sister Buildings and they are built around the same time, so we need to make sure that the people in those buildings are safe. There are so many variables until we know well do everything we can to make sure that all of us are safe. A lot of people around the country are thinking about you and your communities this morning. Over in texas, that is where Vice President Kamala Harris you are looking i believe this is a live shot, live at her just landing in el paso, first images of live of the border visit, her first as Vice President to this area. Already responding to criticism from some republicans and at least one democrat that she should have visited sooner. Watch. Not my first trip. Ive been to the border many times. I said back in march i was coming to the border so this is not a new plan. Vice president harris expected to take several tours, have several discussions in el paso but that democrat weve been talking about, texas congressman Henry Cuellar saying shes making a politically safe choice going to el paso, which you see live on screen right now, rather than someplace like the Rio Grande Valley where most of the action is. I got a call from one of my Border Patrol friends, why is she going over there . We got about 140 higher crossings over here. This is where the activity is at and i couldnt answer him when he asked me that question. Do you think this is a politically safe choice on the part of Vice President harris to visit el paso . No, not at all. I think what shell see in el paso similar to laredo and the Rio Grande Valley. I know because ive been with all of the areas. I was with Henry Cuellar in laredo. I filmed 15 or 20 cuban women kept in a Processing Center like the one shes going to, where you have barely running water, inadequate facilities, and so forth, and so i think this is an opportunity for Vice President harris and the administration to really work on changing those conditions and making the conditions particularly at the cpp Processing Centers much more humane for these human beings who are seeking asylum and i think thats part of what shell do. Im not sure if we still have the live pictures of the Vice President who as weve said just landed, she is now there visiting that facility. I wonder, congressman, what do you hope to see . What do you hope to get out of her visit to your state, specifically i wonder as it comes to the messaging weve heard around immigration and whats happening at the border from republicans specifically ahead of former President Trumps visit there next week. Its a few things. First, she went to Central America recently really to make the point that i think most of us believe, which is we want the best for people in their own countries. I dont believe that people from around the world would want to trek a thousand miles often with their kids in Tow Fleeing Oppression and desperate situation if they have to. She went over as a Vice President to work with the governments and figure out how the United States can be helpful in strengthening the rule of law and economies of the countries. Thats the first thing is improving the conditions but secondarily, when it comes to the conditions at the border, also improving the conditions there. There was a lot of tragedy and scandal and Human Rights Abuses under President Trump for the past four years including in el paso so shes going to go there and figure out how in the longterm the Bidened Aadministration can be part of a change in treating people more humanely. Do you make anything about the timing . The aides say theres no relevance to the fact the former president you just referenced will be there in a few days next week . No, i dont think so. As you know, she took on this assignment early in the year to handle and discuss and deal with the issues of migration and figure out how we can improve the conditions in Central America but also what we can do here in the United States. I dont think we fully appreciate this yet as americans, but were coming out of an incredibly dark period of severe Human Rights Abuses with the trump administration, where thousands of kids were operated, young kids were separated from their parents and some people have still not been reunited. So i suspect that shell have a chance to talk about that with folks there as well. I know youve called on the Biden Administration to deal with, as we talked about the title 42, this thing that effectively seals the border, something put in place under the former president. Do you think her visit there will help spark or catalyze movement on that front . Is that your hope . I hope so. I think the Administration Needs to deal with the title 42 expulsions. They need to start processing Asylum Seekers as we normally would and effort in the United States Border Region and Mexican Border region for example to get at covid19 vaccinations and so i think its time to lift those restrictions. Before i let you go, i want to ask you about other news coming out of capitol hill. House speaker Nancy Pelosis select committee to investigate january 6th. Do you hope for a spot on that committee . I had the solemn duty of serving as Impeachment Manager in the second impeachment trial, senate trial of donald trump, but listen, whenever Speaker Pelosi calls and wants me to do something in the congress, of course im going to be helpful but i also think there are so many other has she called you yet . I dont know shes called anybody yet. I think shes still forming the committee. Whatever the group of people are, it will be a great group of people who take their duty seriously and try to do it fairly. Do you worry it will be viewed as too political given the fact it is not the 9 11 style independent Bipartisan Commission after republicans blocked that on the senate side . Im sure the republicans will scream its hyper political and partisan. Mitch mcconnell and Kevin Mccarthy and the Republican Leadership turned down an opportunity for a Bipartisan Commission of independent citizens, people who are not even in congress, partisan politicians, so they turned down that opportunity and really left Speaker Pelosi with no choice but to take it up in congress. Speaking of the administration, you have officials taking a victory lap this lap over the bipartisan infrastrict tour deal. The deal includes new spenders of half a trillion dollars on roads, bridges, airports and broadband. It would be historic if it passes, if it passes. Because that bill according to the president is contingent on a Reconciliation Bill which would be broader, probably not bipartisan, every democrat would need to get behind it. Even with progressives and moderates already at odds over how much to spend on it, that is something i asked a member of the Budget Committee about while i was on a reporting trip up to the hill in a one on one with senator tim kaine. I think well get both. I think well get a bipartisan bill and reconciliation. With a 6 trillion race to or 3 trillion . It depends on the first question. What are you comfortable with . What i am comfortable with is what the president is comfortable with. The president filed this american jobs plan, American Families plan. The total of those two so s around 4 trillion to 4. 5 trillion and i like that but theres no deal breaker in there for me. Leigh ann kald wahl is on capitol hill. You have the twotrack approach some republicans are turned off by, one moderate democrat raising questions about, right, and senator Lindsey Graham who says in his words a suicide mission. Reporter this is a very Fragile Coalition and going to be difficult for this coalition to stay intact and Lindsey Graham is one of the next round of republicans saying they were going to support this bipartisan bill but things are tenuous on capitol hill for two reasons. You have to watch the republicans and you have to watch the democrats. Lets start with the democrats, as you mentioned, its going to be very difficult to keep the moderates on board as well as the progressives, that contingency that you talked about, combining this massive reconciliation partisan multitrilliondollar bill, tieing it to the bipartisan package is what is expected to keep the progressives tethered to the rest of the party, to move this forward. Now, the moderates, moderate democrats, they want this bipartisan win and then theyre willing to perhaps support this other massive proposal, but that contingency is also what is infuriating some republicans. Senate Minority Leader Mitch Mcconnell went to the senate Floor Last Night to eviscerate the biden press conference, where he said that he would veto the bipartisan bill if it is not attached to this multitrilliondollar partisan bill, and so what he is saying is that he just undermined the bipartisan talks, and im told that many republicans feel the exact same way, they feel burned by the president , just hours after they reached this bipartisan win, so the senate is out for a couple weeks but going to be very difficult for the president and Democratic Leaders to keep this coalition together. That is right, the sweeping legislation would have given tools to federal governments to target some of these states like georgia that implemented especially in the wake of the 2020 election. Democrats dont have the votes, but what they do have a s a Justice Department in a democratic administration, and that is a powerful tool and that is what we will see when he comes to the podium in the next 20 minutes laying out what is the latest of a number of the series, especially in the republican leaning states. This is something when the president was traveling overseas, he announced a number of other Enforcement Actions that the department was planning to take. Ramping up their own enforcement of voting laws to protect the right to vote among black and brown communities. This comes as we also heard for really the first time the most extensive comments from President Biden yesterday as he was celebrating a bipartisan win on infrastructure that he will be pounding the pavement to speak to the public about these issues as well. And as mike was just mentioning, the votes are not there right now in the United States senate, and they cannot pass any kind of legislation addressing these Voter Restrictions that were seeing in some of the republican led states. So this action by the biden Justice Department seems to go as a way to remedy some of this. What im really interested in on what part of the georgia law that the Justice Department would be challenging. There are two different tracks. Some where people talk about the restrictions that make it more difficult for people to be able to vote in a Battleground State like georgia, but they also penalized the secretary of state, and took power away from local countries to give it to the state and the state legislature. And what direction they go in on on addressing the ones they want to be able to challenge. Ly Pay Attention to that in this news conference. Its an unsolved case, but its a Trend Happening in the United States for about 40 years. Which is that homicide rates, and the solve rate of homicides have declined nationwide. And that has been driven nearly entirely by murders in which the victim is black. Why is that . A lot of reasons and explanations. Were looking at one of those murders that happened in 2016. I think this would have been one of those many unnoticed cases were it not for an organizer in chicago, and also for the victims mom, and i think it illustrated what happened and what didnt happen. I think we have a little bit of my interview here. Are you being an investigator . No, im a mom on a mission. The last thing that his mom can do is go and find out who can this to him. You understand that in this country there is almost no family of any Homicide Victim that believes the police are doing enough, everybody wants to see more of an effort. But i dont think there are a lot of family thats have access to the evidence that i had. Here is one of the thing thats is a little different. We looked at the inside of a murder investigation, and not only what happened but what didnt happen and the reasons for why that case is unsolved is one of the more interesting parts of this story.
