Steve cormacks khakis are just as glorious in real life. Over the course of the day, jen psaki, joy reed, and so many others will give you their take on the state of this wild and crazy election. Are you enjoying it so far . Its only september all right, lets get this kicked off. You may have seen them reporting from the dnc. They are going to tell you what it was like to be there in that electric atmosphere, but first, they are going to dig into what is at stake in november. Please welcome to the stage the host of the reidout , joy reid, and the host of alex tonight, Alex Wagner thank you. I want to do that. Youve got to get the filthy. So smart. Hello thank you all for coming how amazing is this . Amazing. Thank you, brooklyn. So, we are just going to jump right in, because really what we are doing right now is we are recreating what happened at the democratic national convention. With your potato chips, unfortunately. And no table, even if we had the chips. The chips would have no seat. May be in our bodies. Thats where they belong. Can we just talk really quick about how much fun we had . We had too much fun. Listen, at a point i actually did worry, i felt bad for everybody in New York, because who he was at the convention . Was anybody at the convention . It was more amazing than i thought, than anybody thought it was going to be, and we got to be there and soak in the magic with my longtime friends, one of my favorite people in the world, and also at msnbc. And we headed endless supply of fried snacks. And then Kamala Harris got the nomination, so what could be better than that . And the thing that is so interesting is we have had a journey. I mean, one of the first shows that i used to go on on a regular basis, and one of the first people who let me fill in for her was miss Alex Wagner. So we do go back away. We have seen a lot of elections come and go. Rank this one in terms of the intensity of the vibes and the feelings around it. So, listen, i think this one holds even more weight, because when Barack Obama was running he was not running against Donald Trump. So there is the Trump Factor of it all, which is us standing on the precipice of end times, and then there is kind of the candidacy that Barack Obama represented, and one that Kamala Harris represents, in a way. Not in a way, certainly. Which is the trajectory of american society and culture, and what it means for us to be, whether we are trending towards a more inclusive, more diverse society. And i think in the Post Obama Trump years, i think a lot of People Question was Barack Obama, did he come too soon . Was he an aberration . Was it just eight years of us glimpsing prematurely into a future that was a long way off . And Donald Trump seemed to be such a repudiation of the moral arc of the universe being long, but bending towards justice. And the Harris Candidacy i think represents an affirmation that the path that Obama Sort of opened up for the country it might actually be its destiny. And so, you know, it is not just a democrat might save the country from Donald Trump. It is a democrat who could meaningfully move the ball forward and finally shatter that last glass ceiling. So, it is exponentially, the levels of import, the stakes are so incredibly high. And i think that has given rise to a joy that is really powerful. And its interesting, because if you think about the trajectory that happen. In 2008, you had this incredible thing that was happened, a country that was born a series of slave colonies elects its first black president. A remarkable achievement. And four years later he is re elected. And seeing these sort of inexorable path toward the woman being president , and that got interrupted by Donald Trump. And that was sort of the shock to the system that then produces The End of Roe V wade. It produces The End of a right that for a lot of women was unthinkable, a right they would never lose. And that is part of the context of now another woman stepping forward, getting the nomination, and it is remarkable , the question of whether the country was what President Obama represented, or whether it is what trump represented is a really live question for a lot of people, and increasingly there is a sense that maybe trump is the aberration. And i think that is an important thing. Maybe. We will see how it goes. And if that happens, one of the people who will deserve the most credit is an elder white man named Joe Biden. Right . And by the way, i have to fill this in. Because you were there, in the Spin Room, on the night of the debate. I sure was. The debate the kicked all this off. And so, at the time, what people were doing in the Spin Room would say no, its going to be fine. They were spinning as hard as they could. They made the ducks floating on the water, and their legs are powering fearlessly. The ducks were taking a day off. I remember talking to Gavin Newsom. All the republicans came out, stephen miller, matt gaetz, all the trump people, and nobody wanted to talk to them. Then Gavin Newsom came out and Jasmine Crockett came out, and everyone was like lets talk to the democrats and see how they are feeling after that. The panic that set in in the first 10 minutes of that debate was unlike anything ive ever witnessed. You know this, our phones were blowing up and there was this huge question, so many questions about biden, about the party, about the country. And what has unfolded in the course of the last eight weeks, six weeks, i have no sense of time anymore. Maybe a few days. Maybe two years. It is been 2000 years. But just to talk about the Joe Biden of it all, this man, who will be seen, potentially, as the fulcrum around two black president s. Two black president s he is there and provides a very important role for Obamas Candidacy and his presidency, and then as president himself in the wake of the covered disaster and economic calamity that was largely the fault of Donald Trump. And then potentially does something that No One has ever done, other than george washington, to see the power and to make sure that the line of succession is clear and final. I mean, the extraordinary acts will never be forgotten. Absolutely. And the thing about it is, i have likened him to a character in game of thrones, who faced Nancy Pelosi, the most powerful woman, other than Kamala Harris, ever in american history. The most successful and powerful speaker, i would argue, ever in history. Most successful speaker. And somebody who, it is not as if she was the only person. I mean, across the democratic party there was this incredible anxiety. She was just willing to say it out loud on television. So it is not as if she was orchestrating everything that happened, but she was willing to put herself out there, because of her power and because of the esteem she holds in the party. And she said this is what needs to happen. And it was not just her, i think it is really important to say that it is not just her. But when President Biden says all right, i am going to accede to the wishes of my party, but i will do the thing that, to me, confers the most power. I am going to name my successor. I am doing this on my terms, and i name this person as my successor. That is a power move. Its also, i think we just have to contrast the two parties in this moment. As you say, is Nancy Pelosi leading the charge. And i think, insofar as you have to lead the charge, its going to be a difficult position. But doing it in the most respectful way, i think, you can try to do such a thing. The democratic firmament, managing the troops, having to go public sometimes, democratic voters making their wishes known, and when Kamala Harris steps in, rallying around this person with an enthusiasm and a Joy And Electricity that none of us could have predicted. It is a party, and i say this after cheney announced, the party, you want to see what a high functioning, inclusive, Well Oiled Machine looks like, look at the democratic party. 100 . That was one of the things that was so remarkable about the convention. You saw republicans, former members of the Trump Administration walking around, getting level over the place. You saw adam kinsinger, people who ideologically disagree, it shows that you have one political party that everyone is included. Everyone is invited. Its prodemocracy. We are back with Duane Reade and Alex Wagner at the beautiful Brooklyn Academy of music. Heres the rest of their conversation. We got to talk about Kamala Harris, yall. She has stepped of the moment, and basically, right, people want to question what her background is. Basically she is alex plus me. Youre welcome. She is asian and black. Just look at the stage, get it in your mind. Caribbean american. Are moms noticed. Are moms noticed. The guy and these people, we dont care if she is guyanese. Mom was like she is asian, too. Dont forget that on your television show. And the jamaicans, my godmother, they are out of control. Dont start with the jamaicans. Out of control. The thing is, she is a polyglot human being. She is what america is. Because this is how you build america. It is the immigrants that come in, right, and they come in and they become part of this country. She has stepped up and stepped into this moment in a way that i think a lot of people failed to anticipate, because they werent covering her and werent paying attention to her. And as two people who actually did cover her and pay attention to her, it was not surprising. But lets talk about how she stepped into it. And i to say, first of all, can we have an agreement the campaigns dont need to be two years long . Give it to me. Three months and done. Nobody needs it. Nobody needs two years of it. I think certainly the media is a huge part of this. It is also, Kamala Harris has grown. She is able to define herself, she is able to speak with confidence, she is able to laugh and be joyful in a way that is exhilarating for, and ive said this before, for women who have watched other women have to sacrifice so much of themselves to be national figures. God, it is just a thrill to watch someone out there who looks like she is having fun. Who looks like she is relishing this, not solely because of duty, but because she wants to be there. And goes and talks to people on the campaign trail, and enjoys it. And that is something that i think, her ability to conduct herself with both Confidence And Ease is something that has really come to the forefront in the course of the last four years. And i think it is experience in washington, is denigrated as you are now a swamp creature. The reality is, you can learn some things on the job and maybe having someone who has learned a couple of things is a good prerequisite for being president. She would be one of the most experienced figures ever to take office if she were to win the White House. But also, we got to talk about her running mate. Because your first big decision as a president ial candidate is to choose your partner, and President Obama made a really, right . Youve got a choose your buddy. You got to choose your rug dog. Resident obama chose Joe Biden. In many ways he was one of the most effective Vice President s ever. He gave them amma demographically, what they needed. He gave the experience of washington, he made a very smart choice. Lets talk about coach walz. First of all, he knows how to order a donut. Which, i think, maybe should be one of the prerequisites going forward. Maybe just some grasp of humanity. I dont know. If you guys have not seen the Jd Vance in the Donut Shop video, it is actually, people texted me. We played it on Alex Wagner tonight, and people were mad at me. They were like why did you subject that to me . It is worse than a cringe. It is almost as painful as him being on the podcast with the gentleman who said boy, its a good thing you had that indian motherinlaw is in any year kids. Yeah, when Jd Vance starts talking about Ovulation And Menopause i turn it down. But i will say, one of the wonderful things, there are so many wonderful things about being at the convention. But you can tell what the mood of the convention speaker, the main speaker is going to be when you bring out these long signs. Like thank you, joe, or We Heart Joe was the sign the first night. And wednesday when walz was going to speak they brought out signs that said coach walz. And the walz big heads. I was like oh, this is going to be like a pep rally. Because he is the governor of minnesota. They couldve said governor walz, congressman walz, but it was coach walz. Then you could hear marching bands, and it was like oh, we are turning this into homecoming. 100 . And by the way, when i tell you i think the Minnesota Delegation was still in the arena. They werent leaving. We were literally leaving, people were cleaning around them, and they were like no. We are here. We are happy, and we are like everyone is gone and they were like we dont care no music playing. They didnt care they are still there there aint no party like a walz party. And we have to talk very briefly about the other side. Because it is been a challenging few weeks, months, for trump and vance. They have had a rough time. They have had a rough time. And this is a point i think we all need to discuss with our friends and neighbors a lot more, because so much of the year was spent talking about Joe Bidens cognitive abilities. If you have listened to Donald Trump, the man is giving rambling, incoherent answers that very much beg the question is he still playing with a full deck of cards . And that part of the conversation, im not trying to be ageist. My mom is 80 and she could out debate Donald Trump in a heartbeat. But i do think if we are concerned about the mental Health And Acuity and cognitive skills of the commander of our armed forces, one of the most powerful leaders of the free world, all republicans should have the same conversation all democrats had, about just how high functioning Donald Trump is. Absolutely. And i think it is even more important to have that conversation, because youve got a group of people from the Heritage Foundation and from his former administration that have already made plans to run the country. They have already written it down, it is called project 2025. And if Donald Trump is not at his all cognitive capacity, then one wonders well, who would be making policy . Who would be Making Decisions . And the answer, the sort of obvious answer, is that the readymade playbook is what we would be living under. And that playbook is things like getting rid of the department of education, a national abortion ban, renaming the health and human Services Department the department of life. Essentially having a handmaids tale menu. Which Robert F Kennedy junior in some way would be attached to, in some fashion. That is the reality of what we are staring down. I mean, are we going to have bear carcasses in the White House, being served for dinner . That is how you get a were membrane. I really want to talk about how the worm gets in the brain. The carcass on the side of the road, dont eat them. I keep going back to the cheney thing, because i am not a fan of much of what he has done with his life. You are being generous. Yes. I think it is so indicative of a party that has shrunk itself, that is atrophied to the point that even the staunchest, most hardline conservatives, with a C Sense of the word have no sense of it. First of all, there are huge questions about our two Party System, whether we can go on like this if trump loses. What becomes of the republican party, what is its values, what does it mean to have a two Party System when one party is not interested in Governance Or Preservation of democracy . And when it is protected by an arcane electoral College System that advantages it even when it cannot win majorities. We have a problem in an anti majority democracy, and a low participation democracy. And a Supreme Court that is run by conservatives. Its a lot. I know we have some legal experts like Chris Hayes and Kate Shaw Coming Up to talk about the court, that is a tease for later. Coming up, three iconic women take the stage together for the first time. This election is extremely export and to me, because i am a lifelong republican. I think it is important that we step outside of our Comfort Zone sometimes, join other people in the fight to keep democracy alive. I am hopeful and im excited, and i will pray through this. We have three more of your favorite stars are going to be together on stage right now for the first time ever. Theyre going to give us an insiders look at the state of this race in the final stretch. One of them worked as a white House Press Secretary for President Biden. One of them won a Senate Seat as a democrat in a place that is very, very red. And, get this, one of them has covered every president ial election since 1972. Please welcome jen psaki, Andrea Mitchell, and Claire Mccaskill this is such a good crowd okay thank you guys for having us. Okay. So, let me start with you, claire. Vice president harris, i mean, she obviously would be a historic president on multiple fronts. She does not wear that on her sleeve. She did not wear white the night of her speech. She does not talk often about being the first. What does that tell us about her . You know her well, why is that . I think she understands that to be elected resident of the united states you first have to convince the american public that you are qualified to do the job, that you are capable of doing the job. And some things can be left unsaid. If you lead with that, then it becomes the topic. She doesnt want the topic to be her gender, or whether she is black, or whether she is south asian, or any of that. She wants the conversation to be about what she can do for you. That is what she wants the conversation to be about. And the discipline she is showing about doing that, not going there, you do see a lot of pictures, which is not by accident, where she is doing, they call them otr or whatever they call them, when she is out and about. She stops for young girls. If you notice, you see in the media, more often she is talking to young girls. That is sending that message, without her having to say a word. And a much more effective way to do it. She wants to make sure the american people know she is ready to go Toe To toe with kim jongun. And i didnt ask you, i mean, you covered the Clinton Campaign very closely. You covered other prominent female candidates. Is this a sign of progress . Is this a sign of a different strategy . I think it is a sign of progress. It is so exciting to me, as someone who broke into a business, frankly, where i was the only woman in the newsroom in philadelphia, pretty big town but i started out in. And in this Radio Newsroom i only could get a job by working the night shift, where i would not be seen during the day. And i was called copy boy. I was a copy boy. So theres a lot that is changed. You know, in our profession, just look at the women who are leaving our networks. Our bosses are women, our camera people, all kinds of editors, and my colleagues and anchors. But, the difference in politics has been so profound. I covered Hillary Clinton when she was the first lady, in 1991 and 92. For all those years i was White House correspondent. And Hillary Clinton, by talking so much about gender, and perhaps it was not a good tactic for her, to emphasize it as much as she did. Made it possible for Kamala Harris not to have to talk about that, in the other piece of that is that she was so active after the dobbs decision. So she has been the primary advocate against dobbs and for reproductive rights for the administration, that is been one of her signature roles. Yeah, no question. One of the things, and i have not won a difficult senate race, nor have i been covering president ial politics since 1972. But i will tell you, when i became the white House Press Secretary, the first day i was so relieved, you know, it was an honor, it was thrilling, i was so relieved. And this wonderful woman texted me and said you did great, you did great. One suggestion, you should look like maybe you are wearing some makeup when you are out there. And it was not a bad thing. And i use this as an example, because i want to ask claire this. There are all sorts of pressures on women. Are you likable . Are you friendly . Are you approachable . Are you strong and fierce . I am not going to do the barbie monologue, but you get my just here. There are also things, campaigning is a lot of work on candidates, and you have to kind of look good for pictures. I mean, what are the things that people are not aware of, that are challenging when you are running for high Level Office as a woman . Well, i think one of the brilliant things that Kamala Harris has done, is she has adopted a uniform. Right . I always was jealous, because i couldnt decide, do i wear a suit like they do . With a floppy little tie . Can i wear pants all the time . Do i need wear a dress . From Day One she said it is pantsuit, baby. It is pantsuit. And she rocks the pantsuit. It is going to be pantsuit all day long. I wont be surprised if she turns up in a pantsuit for the inaugural ball. But i think she has figured out that if we focus on the things that are irritating to us as women, we take up too much energy. Like, have you noticed . Have you noticed how much she is embracing loving the cook . Yeah, i love that. You Guys Mightve noticed, i bake. Huge baker. So, that is a huge progress, because, back in the day, if you are a woman candidate, when i first started running years ago, i never wouldve done that. When i was running for d. A. In Kansas City i would not even put my children in the picture, because i was afraid they would think oh, shes going to be abandoning her children to be a prosecutor and she is probably not tough enough to be a prosecutor. Look at the progress we have made. There is been huge progress. We can now cook, we can bake, and we can be commanderin chief all at the same time. Absolutely. You know, and even someone at the pinnacle, we have a supreme Court Justice who, and i know her from washington, i know her as a clerk of the court, i know her as a judge, now a supreme Court Justice. And she writes this book about the turmoil she felt because her husband was in medical school, she had two small girls, she was just beginning at her job and had to decide whether she could go and pick up the kids at school. We all share that, whether we have kids, whether we are older we are young. We share that. And that is a bond, and i have learned that in my profession, with women reporters, it is unbreakable. If you respond as people and dont feel you have to hide that part of your life. I will tell you, Andrea Mitchell is the kindest person to other women. She wont surprise you at all. It is very true. Very true. Okay, i want to get to some audience questions, and i keep talking forever, but we have other panels. But i wanted to ask you about, we always shorthand this as october surprises, it could be in september, who knows what can happen. But it is the things that are unexpected. So i want to take you back to the editorial meetings in rooms, because by the way, every news organization, every Campaign Plans for all the possible things that could happen. So you see where this is going. Andrea, what are the things, as a longtime journalist, that you are watching for. That could happen, may not happen, but just over the next around 60 days. 59 days . Yes. I think about the iran hostages and jimmy carter, and what happened the night before his election. The night before his election he was out crisscrossing the country, flew back. I was standing on the South Lawn and he had to come back because there was a possibility they were going to be released. They were released by a run at 12 01 when Ronald Reagan had just been sworn in. That was the worst possible october surprise. There was Access Hollywood. That was a huge october surprise. It was the day before the debate, and the Trump Campaign tried to trot out all of these women who had made accusations against Hillarys Husband in the past, and see them in the Front Row in the president ial Debate Commission would not let the debate start until they moved to the side. So there were a lot of october surprises. The fact is this is going to be a close election, and nobody should make a prediction about this. We can talk about blue walls, we can talk about 270, and steve is the expert. He knows better than anyone, anything can happen here. Ask Hillary Clinton, about 11 days before when we are flying to iowa and they come up with a new laptop, and more emails, and the Fbi Director says two days before the election on a Sunday Night in new hampshire, and he says oh, nevermind, we were wrong. And they saw the polls go down. We all remember this. The Access Hollywood tape came out, and i think we all remember where we were at that moment. It was the same day that the u. S. Government, and i was in the u. S. Government at the time, finally put out a statement that russia was behind the hack. It was the same day, which is, you forget. And this was the same day, its okay, Access Hollywood, that will change things. It didnt. Anyway, claire, what are you looking out for . You have run many tough campaigns, what are they red teaming about, as they like to say in the world right now . Well, if you look at all the things we just discussed, probably they were not discussed ahead of time. That is why they were surprises. So, i dont know that i can guess what the surprise is going to be, because if i knew what it was it would not be a surprise, i would be telling you guys right now. But, i will tell you what im holding out for. I am holding out for a Philadelphia Rally where the Warmup Act is beyonci and taylor swift. Coming up, Chris Hayes brought a very special guest to join him on stage. You are watching Msnbc Live democracy 2024. [suspenseful music] trains. Hi, guys hey, babe, how are you . Whos got our kids . Kidding, im sure someone has them. So, we are going to talk a little bit about the election that is Coming Up, and particularly the legal landscape around it, something that you spent a lot of time thinking about. You have been sort of a practitioner, too. In a previous life you work a little bit on the campaign and you were to the transition, worked in the White House counsel office. So i wanted to start with a question about how other folks that are not necessarily legal experts were watching this, what are you looking for in terms of Issue Spotting . Obviously theres a lot of litigation in the last 2020 election. It was all frivolous, it did not really amount to anything. But what you are kind of looking out for in the legal landscape, both now, and until election day, and post election day. Short, i think at the outset, margins are everything. So we have this idea of a margin of litigation. If an election is close enough in a particular state, litigation could turn a l into a w. I can actually change the outcome. We were spared really having a state within the margin of litigation within 2020. So you had closeouts in wisconsin and arizona and georgia, but not in the couple hundred votes, or even low thousand votes of that Mightve Put is in the margin of litigation, and thus really thrown into question the outcome in those states. So, if we have states that are closer this cycle, then i think a lot of the focus will shift to the courts. So, we are seeing right now some of the groundwork for some of those potential postelection lawsuits being filed, around things like Absentee Ballot Return deadlines, the ability to correct a ballot that has an omission or an error on it, because there is a strong presumption if you file a lawsuit after the fact challenging election rules that are in place before the election, that is a very, very Steep Hill to climb to succeed. So i think that is why we have seen some of those lawsuits filed now. I do think the likelihood of success and potential impact on the national Electoral Map is really going to turn out how close the results are in these critical battleground states. Lets stay on that, the notorious Donald Trump Phone Call to georgia. You Guys Room for that. Boo, yeah, i disapprove that call. Yes, that call. If there is a very funny quote where he says fellas, i just need 11,000 votes. Im like 11,000 votes is a lot of votes. You cant, in the case of florida, famously in 2000, that margin was 537 votes or something like that. So, the margin really does matter. What you are saying is if you are in the category of 10,000 votes, even 5000 votes. Litigation is not going to be determinative either way. Yeah, it is the margin and what the legal teams look like, in some ways. This is something that i, especially since the cheney announcement, i have been thinking about this, which is that there could be this kind of moment of reckoning for the legal profession. As we know, from here, that Donald Trump has said very clearly he is not going to accept any outcomes in which he is not the victor. So, he will bring lawsuits to challenge results in states he loses. We know this. And how plausible those lawsuits will be, i think, turns in part on how close the results are. But also, what kind of team of lawyers he is able to assemble. And i really do think that this is a moment when conservative lawyers, republican lawyers could basically say you cannot sign on to facilitate an antidemocratic effort, and effort that is just a Power Play in search of legal theory. Because that is what would be, an effort to subvert the results in a state using whatever facially plausible legal set of claims you could manufacture. But you cannot sign on to that and remain a member in good standing of the legal profession. I actually think that would be a very powerful message. Yeah, i mean, you know, this is someone who is saying we already have enough votes, we dont need any more votes. He told dr. Phil the other day that if jesus counted the votes in california he would have won california. That is true, i did not make that up. So, you know, his contention is it is impossible for him to lose, and i think that he loses his rig. The other thing that i want to talk about a bit, and you have the Book Review of a great book, called let the people choose the president , which is a Bookmaking Argument for a popular democracy in the u. S. , get rid of the Electoral College. And youve made this point before, and youve made it to me in private and also publicly, and in things written for the New York times oped page. Theres a whole bunch of reasons the Electoral College is dad, on first principal democratic grounds, on the fact that huge swaths of the country, every voter in wyoming, every voter in california has basically no say over the electoral outcome, that is bad. But the Rube Goldberg Machine that is the Electoral College is like an attractive nuisance. Is like an uncovered Swimming Pool for Donald Trump to go play in. Because it is a complicated machinery, there are all sorts of dates and points of intervention which he tried to explain last time, theyre going to be around this. Yes, not just this anti democratic character, at the very complexity of the Electoral College, the different deadlines that happen in each state, and that in congress, each of those is a potential vulnerability and an opportunity for exploitation and mischief. And that is, i think the democratic deficits of the Electoral College are in some ways a bigger problem. But this is an enormous problem, as well. And theres been some reform in the Electoral College, the electoral Count Reform Act which was passed two years ago somewhat cleans up some parts of this rickety 1887 statute that governs a lot of the process by which we translate votes in the selection of president. But there are still opportunities for exploitation and mischief, and i think that is a huge part of the problem. So, if we needed another reason to be deeply skeptical of the Electoral College and committed to reform, it is susceptibility to exultation by bad actors, thats a really important one. It also connects to the first point you made, a really important one, if you take away anything about the way margins matter. The closest election of our lifetime, which was 2000, national popular vote, Al Gore won by 500,000 votes. He lost florida by 500 votes. It is impossible to imagine a national popular Vote Margin that is 500 votes. Even a very close race, this law of large numbers is going to be tens of thousands, hundreds of thousands. But the defining state could be 1000. Pennsylvania come down to 1000 votes. So you are also inviting a situation in which the determinative result was it within the margin of litigation, whereas if everyone just counted every vote across the nation, you are not going to end up in the margin of litigation. And increasingly, so Joe Biden won by 7 Million votes, is likely going to be a very big popular vote victory, whatever happens in the Electoral College for Vice President harris. But yeah, if it comes down to a state like pennsylvania where we are within a couple of thousand votes, essentially, only because the Electoral College could we even be in a position in which the courts are going to All Of A Sudden be deciding who the next president is. So, that brings us to our first question here, and this comes from jeffrey from The Bronx, who, is The Bronx in the House Today . Which, relates to what so many people have in their minds, which is can the Supreme Court overturned the 2024 election if Donald Trump loses . How can the constitution protect the peaceful transfer of power after an election. The Supreme Court decided the outcome of that election, there is absolutely president for the Supreme Court to decide the electoral election, which only becomes a realistic possibility if there is one, maybe two states in which things are close enough for a lawsuit, that, again, is well lawyered enough that it has some facial possibility that then looks like a good throw into question the result in that state. And then, yes, someone to get the case before the Supreme Court, and i think there is reason to be very, very alarmed about what we have seen from the Supreme Court in the last few years and what it might do if given the power to decide the outcome of a president ial election. Yeah, you dont want to give this crew a second run of bush versus gore. That just seems like a bad idea. This question is from york, pennsylvania. We are hoping she is registered to vote and going to vote, and all her friends are going to vote. Is not funny . Pennsylvania, your vote counts. She asked both of us what percentage of the day do you both discuss politics . What would you say . Well, we have a little screen time app that tells us. We should. A fair amount of time. Obviously the vast majority of what we talk about is the logistics of our children. Who is going to basketball. And then probably the latest Registration Data out of pennsylvania. That is next. In that order. But we talk about this stuff a lot. This is a very Law Professor answer, but sometimes we talk about, in constitutional law you kind of think about high politics and low politics. I would say partisan politics, not much, really, at all. But high politics, thinking about the nature of government, and we are not talking about that every day, either. But there is a combination of the two. But actual partisan politics, not that much. Low Singledigit Percentage of the day. We were on vacation when the announcement came from President Biden that he was going to not pursue the nomination. And then endorsed Kamala Harris, we talked about that a little bit on vacation. It came up. That was it for our afternoon session. But we were just getting started. Rachel maddow and Lawrence Odonnell are up next with a special live version of their Monday Night handoff. Now i twirl you. [ laughter ] before the night is over, you will let me twirl you. That was not in the Rehearsal Rachel i forgot to go to the rehearsal. It is pretty obvious to everyone here and i think i have said this publicly. My favorite part of the show happens to be the highest rated part of the show. Which is the Moment Rachel says good evening to me. Which some you may have noticed i might enjoy a little too much. But here whats to me. When i run into fans of msnbc, on The Street very first thing they will say to me is my favorite thing about your show is the rachel handoff. [ laughter ] and i get it. And im sure they speak for millions when they say that. Aw. But thanks to twitter, there are other views of the handoff. Oh. Oh no. Here is one. This is important. The timing on this. It was written at 10 04 p. M. 10 04 p. M. So you can imagine the depth of feeling of this particular tweet. I just cant watch the handoffs. I just Cant Watch Rachel being taken hostage for umpteen minutes. [ laughter ] i just think that side of the audience deserves a fair hearing. So my favorite thing about the handoff is that i have no freaking clue what you are going to say. Ever. Like there are other shows and there are other handovers. My host is going to ask about this thing and i know my host is interested. That does not happen with me and lawrence. So it could be me and your mom are talking about what we are going to do for thanksgiving. Like that could come up. Okay. Youre coming for thanksgiving, thats good to know. This thing that you just did, i have a better guest than you on that. Coming up. It could be this thing that you said in your a block which i have now forgotten because it was 44 minutes ago was interesting and i would like to ask you some indepth followup questions. Do i like frozen in that moment . If i look like i might be paralyzed, not moving, not blinking, nothing. It is not going badly and so you dont bring it up in therapy. Because, its not broken. And this, we dont have time for this. This is all the stuff we dont have time for on tv. I need a favor. Okay. Yeah. Im in giant trouble with my publisher. I am literally years behind. On the deadline for my next book which will be my third book which No One knows because there is so much distance between the books. Do you have a title . When im making my excuses to the publisher, well, i have to cover the Trump Trial and i have to come the campaign and all of that. I know that lurking in the background and they say this out loud every once in a while, is the fact that in the number of years. You. You have chosen to produce a couple of giant podcasts that are as much work as a book. You have a documentary out now. You produced a book or two in the number of years that i have delivered nothing. And so my favor is, rachel, would you please stop . [ laughter ] would you like to write a book together . Or do a podcast together . [ cheers and applause ] we could do that couldnt we . Lets do that. Lets do that. If you cant stop. Could you, do you believe it could ever be possible to teach a guy from dorchester to multitask . I mean listen. The reason that i have been able to get the stuff done that you just so generously described is because i have driven myself down to be a mere husk of a person. Whereas you you have a rich full life with people. He came to my Book Event by boat. Because he was boating. I dont boat i dont do these things i have nothing in My Life, lawrence. I have a question from the audience. Oh. For you. Oh. It is from sharifa from york, pennsylvania. Hi sharifa. I apologize for stepping on your question a little bit. Getting a little bit of a Head Start on this question of yours which is how do you decide topics and questions for guests and contributors . My question is how do you decide it two days ahead of time . Its the best part of the job. Getting to decide not what exactly to say on a specific thing. But what to talk about. What counts as the news of the day that you want to say something about that you think you have something to offer that you want to hear from a News Maker or a guest or an expert about. And that process to me is the most difficult and most intellectually engaging and more rewarding part of it. Much more rewarding and difficult to me than the actual writing what there is to say about it. And i value the Editorial Freedom we have. Msnbc is not some network where there is a boss chomping a cigar saying this is the six things youre going to cover and by the way, youre booking my frat brothers. Were not that kind of a place. They trust us enough to abide by nbc rules and standards. And cover what we want. And that is a blessing. And something worst protecting and fighting for. So yeah. Its the art of what we do. Not the science. And i love it. Yeah. I try to come to it as late as possible. So, im a collector. Of lazy excuses that are legitimate. The first one i ever had was on my first book that was so long ago, Larry King had a Radio Show. Larry king who had the biggest Radio Show in america was a big deal for a book. It was one minute before going on and he turns to me just before we start and says i never read the books. Because if i read the books i might think youre too interesting. I have to hear it the way they do. Then good evening, and he starts the show. And i think this is genius, the laziest possible choice. I dont like to book Guests Way in advance. Its not a very guest driven show. But i like to pick topics when things occur to me. When it comes to who comes on the show to talk about it, i still think it is magic. How do you persuade a person to Come On Television And Talk to you about a News Story . I dont know. Im too afraid to call people. So other people have to do that work and i make everybody do it very late in the game which is cruel. Lets go back to the handoff. We stopped doing it for years. Do you remember when we resumed it . No. Well it was a little more important to me. As you can tell, everybody who accuses me of being so needy in those handoffs is underestimating the neediness involved. So i got knocked out of the show for almost four months in 2014. I was in a taxi accident. I broke a lot of bones and i couldnt walk and had to learn to walk again. Out of the show a long time. Ari melber filled in for a while. I was finally coming back and so profoundly out of it, i didnt know how to do the show anymore. It was like throwing a baby into The Deep End of the pool. I had no idea. At the last minute, very last minute i said to greg, Ask Rachel to say good evening to me tonight. And this miraculous thing happened. She did that thing, the good evening lawrence. And i who was completely really disoriented to the point where i wasnt sure that i could get to the first commercial. I wasnt sure i could get through this weirdness that i was doing of coming back to the show. Rachel said good evening and started talking to me and the one thing i knew i knew how to do was talk to rachel. And so, we talked. What she was really doing in this astonishingly maternal way using a power she didnt know she had or was using in that moment when she was reaching down to that little boy and picking him up off the floor into his highchair which was the highchair. I couldnt actually sit. I had to lean. It will be okay, you can do this. And so, yeah. It means a lot. So the next night, the next night i said to greg, tell rachel to say good evening to me every night. And she has been stuck for ten years now. Very problematic since we all go to work at the same time. I dont know if you all know this, simone and Melissa Murray have been working on this special about black women in the country and refer to The Switch from biden harris The Switch. When we went and spoke with them, they said since The Switch, and melissa and i said what switch . We were at the Nail Shop actually. The switch is the top of the ticket. Since The Switch, people are thinking expansively about what they are going to do in this election. Black women chief among them. And who will make the difference in this election. In the margin. That is where this will be won or lost. You can watch msnbc, our special on sunday, September 29th at 9 00 p. M. So make sure you tune in. Mark your calendar. Never miss an opportunity for a promo. And the reason i bring it up is because i think it opened an opportunity for a lot of demographics. I focus a lot on the latino vote which will be huge. It also plays a big role in pennsylvania, wisconsin, north carolina, and georgia. To your point, not the same Vote Chair as in arizona or nevada. But this is going to be an election that is played and won on the margins. There was something that happened with latino voters when there was The Switch. Which was when it was biden and trump, a lot of latino voices just didnt like their choices. Now they have normalized. They are not 2020 Level Support for biden or nowhere near obama support. A few things are happening. I think Number One, it is important to recognize the majority of latinos are going to vote for democrats. There is also some Softness And Openness to Donald Trump. At The End of the day, they still see him as a businessman. And they know what they think about him. So the new information is going to be about what he is going to do in a second term and about her. You know Kamalas Campaign is already out there. She just did that Radio Interview and they are going to have to go out there and play hard for those votes. Which you have advocated for. We put together an amazing coalition around the country. The Irony Today is that then, because obama care, the affordable Care Act was a major portion of the conversation. There was a conversation about the individuals right to choose and to make choices for the Health Care and here we are today. My party is sitting here saying you dont have that choice, ladies, when it comes to your own body and Health Care. And that for me is one of those areas where coalitions which we have already begun to see form in places like kansas and ohio where republican women are not aligned with their party on this issue. Which is why you see the Harris Campaign working to have that more personal One On one conversation with this emerging coalition of voters around that issue. But also, around the issues you mentioned before. That dont have a partisan tag attached to them. Why . Because we havent done policy in a long time. Until the biden era. Where we got infrastructure, we got inflation down and a number of other issues. And by the way, republicans signed off on that as well. They were part of that vote. It was a bipartisan bill. Which says a lot about this president s ability to lead and the way he has led has been from my perspective, someone who mucks around in politics was good. He was good at it. So what are the aspects of this whole Coalition Thing that i find somewhat amusing is that trump has beenlying been plying the black community with cheap sneakers and menthol cigarettes. So this is the direct appeal to black men. And what i keep trying to tell republicans now as i told them in 2010 and 2009 is that brother is going to be fine until he gets home. And All Of A Sudden he is not going to be standing there looking at Donald Trump going oh yeah im with him. But my point is that is not how you build a coalition. And the fact that you think so little of our community and the black and brown community to think that is how we are going to vote and why we are going to vote for you. The outreach, if we can call it that. Voters in my opinion, they deserve a high level of conversation on the issues that are confronting them. It is a huge issue for people across this country when folks are in the polling. When you see the polls and they say oh, people feel like the economy is going in the wrong direction. When you break it down and you look at the cross halves or focus groups, what people are saying is affordability, they are talking housing, they are talking about their ability to not have to work so many jobs or extra long hour to enjoy the things they want with their family. They are talking about child care. The rent is too high. The housing is literally unattainable. And so, they want policies to do something about that. You wouldnt know unless you talk to them. You are doing actual outreach. My notes i brought with me. I dont like the polls. I dont like polls. I dont like national polls. Im not here for polls of registered voters because registered voters are not likely voters. But i dont even like polls of likely voters because the Voter Registration Boon that has happened since The Switch has been astronomical. There is voter data from 38 different states up loaded. Let me give you some of the numbers okay . Young people are surging. About a month ago, 28 of new registers. During that same week in 2024, that increased. That is crazy. That is crazy. Hispanic Women Numbers are off the charts for women under the age of 30. They quadrupled in louisiana and maryland. In iowa. In vermont. North carolina and nebraska. These are numbers that are going to make a difference. To me, that says they are primed and ready to participate. Thank you all so much. Thank you guys so much. See you tomorrow. A lot of fun. Latest Jobs Report came out. Wasnt the best, wasnt the worst, where do you see the state of the Economy Today . It is always about the economy. People always say they vote with their pocketbook. Millions of americans love to say oh, im not a money person. I dont want to talk about money. I dont want to think about money. But we need to, because it is usually important. And how is the economy right now . Heres the thing. We are a country of 330 Million people. There is not one economy, your entire Family Isnt facing the same economic picture, but for the most part, we are really good. Think about where we were. Covid is like childbirth. Businesses have been built. We are still out there hiring, wages have been up. It has been a great recovery. Compare to united states to every other developed country. We have a better economic recovery. Inflation is real. Wages are up. But when you get a raise, you credit yourself for that. You get a raise because youre great at your job, but when everything costs more, you blame the government. Thats just human nature. And the problem with inflation is we see it in every element of our life. For young people trying to rent an apartment. For people trying to buy their first home. It has been brutal. We are not in a bad situation. But because it is slowing, we are going to get that Interest Rate Cut which will relieve things a little bit. But the problem politically with inflation is that if you and i went out to dinner right now and we got a burger and two beers. You drink beer . You definitely do. Our bill might be 90 Bucks and the problem is we would talk about that for the next 15 minutes. And that is why americans dont feel good about the economy. Vice president harris put out an economic proposal. A lot of stuff there was popular. A certain grant for startup businesses. But it seems like she was penalized for her specificity where Donald Trump says i will cut taxes and thats it. And we are price controls. And it will be a socialist takeover. Seems like everyone ran with that narrative. It is hard for democrats to speak about that because it seems the more they put out, the more they get attacked. Democrats need to stop apologizing. And just own it. But the media needs to do a significantly better job at how we are covering it. I do not. I dont have a political background. I have a business background. I would love nothing more than for both parties to put out actual policy proposal. Her plan is more pro business. Is more centrist than President Biden. But what is truly twisted is people are not taking the time to see that. When people say she is super progressive what they are really saying is she is a black woman. Because thats the only thing they are saying. And they are presuming because she is a black woman she will want x, y, and z. Because she is a black woman, thats an amazing part of her but it has nothing to do with what her economic policies are going to be and everyone should take a look. Because the tariffs, Donald Trump says i will be here to cut your taxes. The greatest Tax Hike we will see is if we have unilateral tariffs. Last time, we needed a huge Farm Aid Package with his tariffs. Lets talk about vp harris. You are speaking to something very interesting. She is different from President Biden. She has strong connections with Silicon Valley and Wall Street is more open to her than perhaps President Biden. 80ceos came out endorsing her. Right . For big business, they dont want to sell product. What we will get is something the majority of Business People are not looking for. A huge portion of the world is saying this country is not working for me. I want change. But if you are the person over here and it is all working you are saying i want to keep things just as it is. That is not great for our country, but thats why we are seeing that. I want to make the point when you hear people say, im not so crazy about Donald Trump, but from a business perspective, from an economic perspective. No. From an economic perspective, we are in a very strong position. Joe biden is presiding over a very good economy. People backing Donald Trump, what that is in my opinion are people who are saying it doesnt necessarily matter what it will do to the overall economy, but how can the Donald Trump presidency serve me and my business . Remember, regulation, not all regulation is good, but smart regulation is good. The idea if you run a business and you get no regulation and a tax cut, thats like candy. That all sounds great. You have to pay for it somewhere. I would remind anybody out there. We will cut taxes and i will extend the corporate tax cut. He ballooned our deficit and the one thing he said over and over again, i will cut corporate taxes again. He has yet to articulate how he will pay for them. At some point, you have to pay the bill. Liberty, liberty, liberty, Liberty Civics and journalism should be parties pa tour. It has been a very busy year of legal challenges for former president Donald Trump. Four criminal cases being found guilty on 34 counts. With sentencing pending just delayed until November 26th after the election. And, there is a president ial election in the balance. Here to talk about all that, the Stud Msnbc legal eagles. The host of The Beat ari melber. And lead Prosecutor Attorney Law professor and cohost, andrew weissmann. How are you doing . Thank you guys so much, we are thrilled to be with you. How are you feeling andrew . I was waiting to do the morn pit. We have some time left. How did you get here andrew . What are you doing here . Because he is a very serious prosecutor. They spend most of their career avoiding any comment whatsoever. So you made a big jump. I know many of you know, 50 cent memorablely said really . This soon . This soon . He didnt have to say much. He led his success for his work do the talking and that is what andrew did through many years. In government. As a prosecutor in this Brooklyn District we are in. In the fbi. We would call in, check back, ask. We would never get comments from anyone including andrew. How would you go from that quiet mode of work to what you do now . Our Press Person had the best job ever. It was, you know, being paid. A full salary. If i left the Muller Probe and i was going into the private sector, one, i had seen so many people try to trance late what was going onto the audience and i thought having, i thought it would be useful. On a more personal level, having been vilified by the maga right, it might be useful for people to make their own judgments based on who i actually am rather than the caricature. I have a question for you. How did you become so interested in music and quoting musical lyrics which we just saw . Respect. And a great question. We have a couple of questions. I went to Jimmi Hendricks High School in seattle. There were some people in the Seattle Tacoma Area really into hip hop. Seattle has the Grunge And Rock scene. I have always been interested in words. So the Lyrics Part came to me naturally. I have always quoted Lyric Ins My Life. But for most of My Life, it was seen as quirky or annoying. And guess what . And maybe it still is. But back in the day, i would do that in school and i would be in class. I would say its like what tupac said and people would say stop. You just keep being yourself. And that was the thing. When we had Senator Booker on once, and it was a relatively serious news day. At The End of the interview, i said senator, thank you for coming on because there are different moments. We dont always have to be dead serious about everything. But it was one of those days. At tend of the interview, he looks at me and says what, no lyrics at all . So all right. Now im turning to flaw. Donald trump tried to overthrow and steal an election he lost. And is now running for office again. We have seen the legal System Work in some ways and falter in others. If he wins we get a refresher about how a sitting president is not chargeable under doj rules. If he loses, then you expect him to go on Trial In Dc for the attempted coup. App sent the Supreme Court where it was, Amy Coney Barrett is someone to keep your eye on. She didnt go along with all of the outrageous parts of the decision. It showed good faith dealing with the issues. The big issue that will remain is how much the Supreme Court continues to mess up that case. If Donald Trump does not win, the case goes forward. It will go back to the Supreme Court, however, before there is a trial. There will be a second bite of the apple. Im confident that Judge Merchan is not going to dismiss the case on his own. No way. But ultimately, if he does that, eventually Donald Trump will take that to the Supreme Court to evaluate. Now, in a world where Donald Trump has lost, you can only hope that the Supreme Court, that there arent five justices to sort of continue doing what we have seen. Im not the only legal analyst who was just shocked at the decision and the president ial immunity. I will just add i think that people have felt a lot of passion, fear, anger, what kind of republic we are. My basic overview, worse than you thought, but better than it looks on a lot of the key questions including Donald Trumps many efforts to overthrow the election. A similar court, very similar court said no to all that. Didnt want to go as far as stealing the election. They will try to actively politically help him and enrich themselves and do grifting and take gifts and all these problems. But they didnt go that far. If it is a close outcome, you can expect a lot of the appeals and lawsuits that you get. Wouldnt suggest the Supreme Court would become the dictator court. We have a couple of questions. One is from karen in seattle. Ari, it says ari, coming from a city like seattle, is a progressive place, she writes. How do you think we can bridge the gap between so many polarized regions in our country . Since we have two minutes for that, i have the solution and well be good as a nation. And leah from Athens Georgia said whats your Election Night Play list . I do think that polarization and people living in different sudo realities, especially with media in the internet is a growing problem. But one we have had a long time. You show up at a rally and you have a jersey and they have an opposite jersey, im not sure how much bonding you will do. But in where life is lived, right . In your Parents Association or School Or Community or if you worship in those places, if you listen, a lot of people will try to engage in facts. Thats part of it. The play list, andrew get it is last word, my honest answer is when im getting ready to go out to work, i usually go for the highest energy highest tempo rap. So lil john, rick ross, classic jayz. I love reggae on the weekend. Classic rock and roll. I always found for me, music works better than caffeine. If i put on the right song, i get a natural lift for a little While And None of the crash of caffeine. Andrew, technically, they have given you a minute and five seconds for anything you want to close us out with. I was hoping the question was not going to be about Play Lists but what kind of gin you will be drinking. And whether you are shaken or shared. Whether you are olive or twist of lemon. The big downside of msnbc, no drinking. None. So obviously, if you are doing the coverage on Election Night and there are no legal issues, then i will have my own form of a play list. There you have it. Join me in thanking andrew. Thank you guys so much. Thank you. Thank you guys. Stay with us, Msnbc Democracy 2024 continues after this brief break. Er this brief break.
