Oh, i apologize, the appellant, the second appellant is here. And i was wondering if he could come forward to do his presentation before we move into the other presentations . Thank you for remembering me. Through the president , to mr. Youll have seven and a half minutes to make your presentation, however the system will reflect eight minutes. When you hear the first bell that should conclude your presentation. My name is sal, i represent the sunset merchants and neighbors association. Im 71 years old. Born in San Francisco and raised in north beach. Growing up in my culture, family, community and hard work are the qualities of a happy and successful life. I moved to the sunset 42 years ago and living on 22nd and irving. I feel i know the neighborhood quite well. My wife and i raised three children. They went to the local schools. When i first moved to 22nd and irving it was, a quiet and some would call it a sleepy neighborhood. If you havent been to irving street lately, let me describe to you the activities that go on in these six small blocks between 19th and 25th avenue. This is a definition of a thriving and family oriented neighborhood. When you have 30 restaurants, 11 nail and hair salons, hardwood store, grocery stores, produce markets, pastry stores, bank and savings, starbucks, walgreens, music store, florist, ophthalmologists, dentist office, three phone stores, five houseware stores, herbal shops, two delis. Remember, this in is in seven blocks. Laundromats and now two new additions, the urgent care facility and San Francisco month sory school. This is what the quality of life is in my neighborhood. This is not the right location for the Barbary Coast or any other cannabis dispensary. I cant go a day without walking the streets of my community, seeing families shopping, walking with dogs, or enjoying the neighborhood. My 16yearold granddaughter and her friends love to hang out on the irving street as do many other teens. Parents living in the neighborhood, in our community, 52 of the children are between the ages of 617. 52 of the children are between the age of 617. My community and i stand here today worried that introducing the Barbary Coast will falter the ability to have families, children and teens alike to appreciate our community and feel safe in doing so. And continue to enjoy the quality of life that we have come accustomed to. And there other concerns the community has about the Barbary Coast moving into our residential neighborhood. Most importantly, the overall safety to the elderly and children. Secondhand smoke and quality of the air coming from the dispensary. Parking, which is always an issue. And will become a bigger issue. The urgent care facility is next door to the proposed mcd. Children, adults and elderly alike will be entering and leaving the urgent care facility constantly smelling marijuana while waiting news for themselves or loved ones. This could not be a pleasant or comforting experience. According to the drawings submitted to the Planning Department, they plan to install a ventilation system. Let me tell you about ventilation systems. When i owned paradise pizza, one of the tricks i used was to saute garlic and onions, it would send the aroma out to those, the customers would say, it always smells good. Does the neighborhood kneeled need to tolerate the odoris of marijuana, or skunk weed . Together, as supervisors and parents, it is our duty to protect the children of our city from anything that may be deemed dangerous. Together, we need to pro vent the youth prevent the youth access and exposure to cannabis and we need to minimize the potential harms to our community from cannabis. Pro proents of cannabis like to point out states like washington, colorado and oregon as model states. Heres a quote from the Health Department. The number one complaint was odor. And most jurisdictions felt that the retail sale of cannabis was ruled out too quickly and the edible cannabis and wish they had more control over the cannabis market. We as a community understand the need for an mcd. We all have loved ones who suffered from cancer, or other illnesses. Marijuana has helped them in some way. I myself lost my sister carolina to cancer just a month ago. The properties that make marijuana cannabis helpful to treat nausea and pain comes from the cbds in marijuana, they are not psycho active. Irving street is not the right location. There are Companies Like spare, that will deliver if youre not able it drive. And if you can drive, go to harvest on gary boulevard, 20 minutes away from 202nd and irving. We as a community understand proposition 464 has passed and unfortunately marijuana is here to stay. But there is a new game in town of the new game is called recreational adult use. And this is just a youve nix for getting high or getting stoned. There are no benefits to the community. There are no benefits to the community for adult recreational use. There is even greater danger with edibles. Young people experimenting, not knowing their tolerance level for edibles can be dangerous. Even worse, edibles left out by a parent, son daughter or friend, where a child can consume them because somebody was too stoned to remember to put them away can be deadly. In the 60s, and i know, the thc levels were 34 . Today, they can be as high as 85 . We certainly know that marijuana doesnt make you smarter. What about all the other side effects . Altered senses, altered sense of time, change of moods . Difficult in thinking and problemsolving, impaired memory, hallucinations and psychosis when taking thc in high doses. Im not making this up. When the Tobacco Industry started in 1860 nobody knew the dangers of tobacco. It took over 100 years to learn the daily effects this is exactly where we are with recreational use. Will the presentation talk about each one separately . So you basically will have up to 15 minutes, but youre not obligated to use the entire time. Im joined this evening by nancy tran our lead planner for the case and aaron star for legislative affairs, well be consize as possible given the amount of comment we have heard and will hear. The matter before you tonight of course, is whether to uphold, to amend or overturn the Planning Commissions approval of the conditional use authorization that is prerequisite to opening the mcd in question. Just as the Planning Commission did before you, you are charged with deciding if this project is necessary or desirable and compatible with the neighborhood. Supervisors, weve heard from the two separate appellants in the case, ms. Kimmerlings appeal articulates restrictions under her group feel that mcd would be acceptable use in the neighborhood. She asks that you uphold and amend the commissions approval in order to impose those particular restrictions. As well hear from ms. Tran, many of the restrictions and conditions proposed are implicit in the commissions approval or otherwise already regulated by the existing city law. On the other hand, the couple asks that you overturn the Planning Commission action and disapprove the cannabis dispensary, the appeal does set forth a range of concerns, perhaps principally arguing that the mcd is not necessary or desirable in regards particularly to the potential impact on youth. The Planning Commission did consider this argument at their hearing. The Planning Commission found this was not the case. Supervisors, at the Commission Hearing there were hours of testimony, the commission did review thousands of petition signatures and letters. They did find unanimously that as the only medical cannabis dispensary near, remotely near this location, the proposed mcd would provide a desirable amenity to sunset residents and would address geographic equity to medical cannabis noted by the Planning Commission and the board and would provide Vacant Store Front with a proven local business. I want to note that the proposal and the conditional use path that it followed thus far is consistent with the land use controls that you adopted earlier today on your agenda on second read. With that, supervisors, we are recommending that you uphold the Planning Commission unanimous action as is and with respect to some of the salient details in the two different appeal letters i will refer to ms. Tran. Thank you. Thank you. The first proposal is amendment by imposing additional conditions with regard to the mcd Business Operation such as restraighti restraighti restraigicting business owns an prohibiting scope of services offered. The Planning Commission determined that the proposed mcd operational hours between 8 00 a. M. And 10 p. M. Compliy with te hours in the health code. They did not restrict Business Hours despite raised concerns because minors are not allowed. The mcd intends to train personnel in verifying that they have valid identification. The operator also intends to install cameras, maintain Adequate Security on the premises and address unzooer desirable activities. With the respect to store front display, both california prohibit edible products from being visible outside of the facility. Any significant changes to the approved use, would require Planning Commission approval of new cancel use authorization. In this case, as well, the appellants concerns are addressed by existing code requirements. With respect to permit conversion, this principally co within the use size of the district. Supervisors, during deliberations the commission acknowledged the issues on the neighborhood and expressed disagreement that the proposed mcd or any other would limit risk to use. Instead seeing that improved education and discuss on the matter is more effective. The commissions decision to grant use was informed by the requirements of the code. There was real opposition to the proposal, there was also support. On balance, the commission did find the proposed mcd to be necessary and desirable for and compatible with the neighborhood and consistent with the policies and objectives of the general plan. As such, supervisors, we recommend this unanimous approval be upheld as is. Staff is available, should you have any questions. Supervisor breed thank you. Now well have up to 15 minutes for the project sponsor or their representative to do a presentation. Good evening. Supervisor breed can you hold on, supervisor tang, i didnt see your name. Supervisor tang just a quick few questions for the Planning Department staff and also i think since our director of cannabis is here, i dont think that everyone knows what 312 notification or the Building Permit process. So if for example this mcd were to be approved and wanted to expand to adult use, i was wondering if you would explain what the process is. Supervisor tang, what id like to do is address the land use component of that and perhaps ms. Elliott can respond to the remaining half. Under section 190 of the code requires section 312 notice. This is a 30day mailing to owners and occupants that Properties Within 150 feet of the subject location, advises these recipients of what is proposed in the case, adult cannabis retailer and affords them the opportunity to request a discretion review before the planning decision and that could be appealed to the board of appeals. Supervisor tang thats 150 feet new york, not a radius . Thats 150 feet from every direction of the parcel boundaries. And ms. Tran mentioned the Building Permit process. Perhaps you want to elaborate on that. Sure, the permitting mechanism that triggers the notification process. It is the subject, action, notice and could be appealed to the board of appeals following a Planning Commission decision. Supervisor tang i hope thats clear for the public. Essentially if the project sponsor wishes to expand to adult use, they would need to pull Building Permits and that Building Permit is subject to section 190 of the planning code, meaning there could be 30day notification to owners and occupants that live within 150 feet in each direction of the proposed project site. That is that process. And then perhaps director elliott can speak to the regulations that we had just passed around adult use. Beyond the land use approval process, what this board just approved today is additional process that requires these operators to seek an article 16 permit for their retail activity in 2018 as part of that application. They will be required to do numerous thing, including outreach to neighbors and residents, commercial and residential neighbors within 300 feet of the proposed operation to seek input on their Good Neighbor policy. They will also be required to post staff at the entrance of the facility to ensure no one under age accesses the premises. And they will also be required to submit a mitigation plan for the operation as well. Among many other things. Supervisor tang that permit, the article 16 permit issuance is appealable to the board of appeals. Thank you very much for the explanation. I did want to ask the Planning Department, because this was raised in one of the appeals, the issue with noticing the neighbors. So if you could speak to that and why you feel it is adequate. Supervisor tang, in response to your question, 207 notices were required under the planning code for the project. Nine of those didnt go out. We did revau this matter with the zoning administrator. He found that the notification was in compliance with the requirements. I want to note that the sponsor issued a broader notice to members of the neighborhood in reviewing the notification list that the sponsor used, seven of those nine recipients that didnt receive the earlier notice were notified. So in sum, there were two recipients out of 207 that did not receive any notice. Supervisor tang to my understanding, there were two types of notices involved here in the proposed project. I dont know if perhaps you might want to clarify which notice was not done properly. The planning code has, i think the number is 35 different notification types in it. The notification for cannabis is 300foot radius mailing including owners and occupants. In this case what happened was that the 300foot radius included owners. And not occupants. And the 150foot radius, which is more typically sorryinged with the 312 process included owners and occupants. Because of overlap between those folks who own and occupied the household, we did notify the vast majority, 4 of individuals that would have been required to be noticed under the requirement. Supervisor tang just to clarify, this is something i learned, but there was a 300foot radius for just owners for the cu hearing, the conditional use permit hearing and then the 100foot, not radius, but foot notice regarding the cannabis use, is that correct . Supervisor, i would add in this case, the specific notification process for an mcd takes priority because its more inclusive. And that is a 300 foot owner and occupant notice. So the notice performed was the cu for the 300 and what is the delta there, is the difference between the 150 owners and occupants and the 300, only owners. I hope that is somewhat responsive. Supervisor tang essentially, my thing was that the proper number of people who should have been notified about the cu hearing got their notices . Ok, thank you. And then planning staff, and or director elliott, there was an urgent care that opened next to the proposed site. That was to my surprise because i learned that the urgent care did not need to do any sort of notification. They got an overthecounter permit and that is something i want to address. I wanted to confirm whether the mcd, whether the patients who go to the mcd can obtain a prescription were the urgent care facility next door. There are doctors on site and so i wanted to confirm whether they can write prescriptions. Supervisors, moving forward in 2018, i believe that a primary physician will be the only one who may prescribe to patients any sort of recommendation for the use of a medical cannabis. And that includes creating a plan for that patient with the primary doctor. Ok, so does the urgent care doctor qualify as a primary care doctor . I am supervisors, i dont believe im capable of answering that question. Supervisor tang does anyone else here have the answer . I heard before they dont, but i definitely want to verify that. If we could get in touch with someone from dph by the end of the hearing, that would be great. Because if they can issue prescriptions, i would be concerned thats next door to mcd. Thats all my questions for the Planning Department staff. Perhaps you can go to the project sponsors. Im the attorney for the project applicant Barbary Coast dispensary. I have been representing cannabis businesses for over ten years in San Francisco and this is the first time ive had the opportunity to present a project to the board of supervisors. Im honored and excited to have the opportunity and i thank for hearing the matter tonight. I would like to present by introducing the team behind the project. Their roles and qualifications and will provide Background Information about the project, including how and why this location was qualified for mcd use. Jessie henry who ill be sharing time with is project applicant. He will be serving as general manager of the location. Terry mueller, who worked his way up through Barbary Coast, will be coowner, manager. Clayton copps, who founded over a decade ago, serves as operating consultant. David ho is liaison on the Community Benefits program. And nate haas, general manager of Barbary Coast, will serve as Compliance Consultant to Barbary Coast. I wanted to give everyone an idea of what experienced and qualified group of operators are involved in this project. So, three and a half years ago, i attended a strategy meeting with the Barbary Coast Leadership Team and it was a clear consensus that they wanted to open a small dispensary in the city. The idea it was they were positioned to serve clients in Civic Center Areas and wanted to locate to a new project of town, in a part of town there was clear need for access to cannabis. After determining their parents, they determined they had patient members and employees on the west side of the city. At that time we began to survey the sunset and Richmond District. Because the Richmond District had existing dispensary, it was determined that the sunset district would be the better choice. The process began with the review of the corridor, but it was determined that terreville was not optimal because the past application there was conflicted. Noriega was isolated and not a great point of access, had limited Public Transportation options available and was surrounded 360 by residential areas. Irving street was the most viable option for the dispensary and the only location on the west side of the city. The line that runs from embark dario to the beach, stops a block away. Another thoroughfare makes it idea for public access. Golden gate park is a block away from the north, which mitt gaits the impact on properties. After the projects accessibility was determined to be positive, a physical survey of the area was done. As we walked the commercial corridor together what jumped out, which you heard, was there was a significant number of empty store fronts. There were a dozen between 19th and 25th avenue. There were few new businesses and businesses that seemed to be barely surviving. We noticed there seemed to be minimal diversity in the businesses. Although we knew locating and building a business in the corridor would be a challenge, it jumped out as a great opportunity for another reason. It was an opportunity to make a direct and measurable positive impact on a specific geographical area. The frontage of the project will be clean and discreet similar to mission street. It will have Clear Windows that allow natural light, but blinds to obscure the view from the outside and protect privacy for customers on the inside. The signage will be professional and will not openly advertise the sale of cannabis. They pointed to Barbary Coast as a model for dispensaries in its report. Dispensary will have a trained staff member working at the front to make sure there is no loitering and double parking and to verify the legal status of clients. Security cameras will be placed on the exterior to ensure that crimes are recorded and forwarded to sfpd and liaison will be appointed. Barbary coast will provide Employment Opportunities for San Francisco residents with hiring of sunset residents, including entry level job opportunities, training for advancement in the cannabis industry, employment mentoring programs and commitment to creating a diverse workplace. Additionally bilingual Senior Education and support is planned as well as community and nonprofit engagement. Barbary coast has a long record of giving back to nonprofit businesses that improve the community and will continue to reach out to and form partnerships with these types of Community Organizations in the sunset specifically. In addition, we plan to work closely with the board in the District Supervisor as well as the office of cannabis to assist in any outreach we can pursue to discuss the issues surrounding the cultural sensitivity in the community toward cannabis. Thank you. Good evening, thank you for the opportunity to present our project today. My name is jess city henry, im the executive director. Im Second Generation san franciscan and my wife and i have raised our three daughters here in the city. When we opened downtown, we wanted to establish accountability with the neighbors and have a business that has a positive impact and work in harmony with the other existing businesses and offer a positive example of what a Good Business would look like. We established ourselves by keeping the store front discreet, safe and clean. Were consistent presence as the doorman and cameras maintain an eye on the store and the entire block which has led to reduction in crime and increased safety for everyone and we feel weve added a great deal to the revitalization. As we are accountable to patients and city and state, we established a place that is clean, safe and comfortable that provides medicine is that tested by the highest rated lab in california for mold, pesticides, and anything else that is markhamful to patients with that may be harmful to patients. We intend to bring the same approach to the irving street location. This is something we wanted to express to the sunset community. Our group held 18 open House Community meetings. These were held every tuesday and thursday for two and a half months, twice a day for hour at a time. We held them in the evening, morning and afternoon. To ensure every neighbor and merchant had an opportunity to make it. It was important to be up front about what we are and what we intended to do. The meeting schedule was posted on the store front from the start and we had an interpreter present. Our Outreach Team stood in front of the store. We attended two Association Meetings and presented at one and were available for questions at the second. The president of the association stated he did a poll of 87 merchants the support for the project was over 50 . Ewe let and presented to the representative oss the sunset association. I personally walked from 19th avenue to 25th avenue alongside each side of irving, spoke to the businesses and passed out information about the project in english and cantonese and passed out the open House Community meeting schedule. In addition we sent out 375 letters about Barbary Coast to each address within the 500 foot radius, this was in addition to the mandated letters by the Planning Department. I handed out my business cards and email to neighbors and merchants. I am and will be personal accountable to this neighborhood and if there is a problem, i will correct it. During our outreach, we came across a few concerns. Security. As stated before, well have a doorman present at all times as well as security cameras that will be recording 24 hours a day and those recordings will be available to the police if a crime is committed on the block. Were going to have a policy of no consumption between 500 foot of the store and monitor the area by car, foot, or bicycle. The second was kids affected by cannabis from the shop. Kids are not allowed in the dispensary period. They make sure they dont get in without i. D. We will not let kids or anyone loiter near our store and our store front will be cannabis and will not anything specifically that advertises we are a cannabis dispensary. We dont sell anything that is marketable to kids. We have warning labels, packaging that has been approved and regulated by the San Francisco Health Department. The Third Community partnership, we want to help with what the neighborhood is doing. We want to help with Tree Planting and sponsor car washing. We want to join the merchant association. Were donating financially to the youth group and would like to expand and donate to other facility in the sunset. The fourth was hours of operation. I think its important to be able to facilitate anyones schedule. Some of our patients work early, some work late and some a mid shift and we want to provide maximum access for all the patients. Having a presence on the block is another set of eyes that adds to the overall safety of the block. There is a lot of parking between 8 p. M. And 10 p.
