Councillor breed under these unique circumstances with the passing of mayor lee this morning, i plan to say a few words during this item and i invite each of you to do the same. I want to take this opportunity on behalf of the full board of supervisors express our collective sorrow and deepest of condolences under the sudden passing of our mayor, mayor edwin m. Lee. Mayor lee passed away early this morning at zuckerberg San Francisco general at age 65. I know i speak for each and every one of us when i say our thoughts and prayers are with mayor lees wife, anita, and his daughters, tonya and breanna. Mayor lee lived a life of service, son of working class immigrants, mayor lee developed early on a profound sense of community and a commitment to helping others. Whether he was advocating for the powerless or serving for the voice of the overlooked, he was from the dawn of his career someone who fought for those in need before himself. In his three decades of Public Service as a director of the human rights commission, then the director of the department of public works, and as a city administrator, and finally, as San Franciscos first asianamerican mayor, mayor lee always exemplified San Francisco values and believed in the power of opportunity. He believed that everyone should have the opportunity to have a job and earn a good wage. He believed in a city where a poor kid from Public Housing could become mayor. Through his efforts, 140,000 new jobs have been created in San Francisco. Millions of dollars have been invested in Affordable Housing. And because of his tenacity and dedication, were on the path to rehabilitating 700,000 Public Housing units. I also want to underscore how important his role as San Franciscos first asianamerican mayor was to the San Francisco asian community. I remember the pride i saw from leaders and members from the chinese and asianamerican communities when mayor lee first assumed office. The significance of this achievement will not be forgotten. What mattered most to mayor lee was helping his fellow san franciscans and everyone who had the pleasure of working with mayor lee will miss him tremendously. As i now assume the responsibility, i ask for your patience and your support. To advise the board of supervisor, mayor and city departments on best approaches for reducing recitivism and make recommendations for sentencing reforms that advance Public Safety and utilize best practices in criminal justice. We look at criminal justice experts in reform and approach. Colleagues, im asking you today to join me in supporting this item, item 25. This commission would like to extend the timeline to sunset from two years instead of two years to five years and to extend for more than three years we must waive 2. 21. I have questions i dont even know where to direct them. Is there anybody here that can answer them . I dont know if mr. Elberling is here. Councillor breed it doesnt appear that he is here and supervisor safai, maybe as chair, you can tell us if the issues came up. Councillor safai thank you. We had all the applicants present at the meeting. They all spoke on the record in support of their applications. Applications were submitted in confirmity with the rules. There were no questions raised at that time, so i dont have any comment on information submitted at the last minute regarding this matter. Councillor breed thank you, supervisor safai. Councillor cohen the question is that although in his application to our body he claims San Francisco as his primary address, but when you look at his property tax, he claims an exemption, that forces him to be a resident and the address he uses is in sonoma, specifical specifically sebastiapool. Perhaps we can continue this and take it up in the new year. Thanks probably the most fair thing to do. That way mr. Elberling can respond to the accusations submitted to us today it. Councillor breed thank you. Before i call on supervisor peskin, supervisor safai you would like to respond . Councillor safai its valid. The clerk receives that information and is required to review that information to determine if the information provided, the address, was a San Francisco address. Its not in the purview of the rules committee to determine that. We take that information on face value as its submitted to the clerk. So i would ask the clerk maybe to respond to that. Councillor breed madam clerk . Clerk thank you, madam president to supervisor safai, the application has well, it is a San Francisco address, as i look upon it on its face. Councillor safai thank you. Councillor breed supervisor peskin. Councillor peskin mr mr. Elberling responded to that baseless account where he responded that he has 80 his time at the San Francisco address. He had an explanation as to why he takes a homeowners exemption with his wife and i believe it was Sonoma County and it seemed plausible. But im standing to repudiate the politics of personal attack being levied in this case. This is a gentleman who served on this exact body, the body that actually brought us the recommendations that led to the successful conclusion of our inclusionary housing policy that we did unanimously. And we have, thank you to the controller, reconvened the tack. The mayor has appointed a number of individuals. Its on the board to reappoint the same individuals that served us well in a technical advisory capacity. The add homonym attacks are beneath the institution and i would like to vote on this today. Councillor breed and i want to add that im open to a continuance, but were looking at a residency waiver for shannon way. So if were going to vote to continue John Elberling, i would like us to vote to continue shannon way as well on the decision to do a residency waiver because were potentially talking about a question of residency here. Supervisor cohen . Councillor cohen im happy to make the motion to continue item 27 and for the record im just raising a question. I did not see a response from mr. Elberling and a response should be welcomed and entered into the file. So i will make that motion that we continue item 27 and take it up in the new year. Thank you. Councillor kim i think its important that we move forward with the appointments today, given the break that were about to begin in the holidays. There is is a Technical Advisory Committee thats met and advised this board of supervisors on our inclusionary housing bill. John elberling served with the same address that he included on his application today. He actually lives in my neighborhood, so i see him very frequently. So i can vouch for the fact that i see him in the south of market. But i also want to state on behalf of shannon way, there are very few individuals that understand below market rate Home Ownership and even for market rate Home Ownership in San Francisco as well as shannon does. Its unfortunate that she lives in oakland for the sake of this committee serving the needs of San Francisco residents, but i dont think we can find another applicant with the depth of knowledge that she personally has. She spent over a decade as a Real Estate Agent selling homes and then went on to work at Home Ownership sf, where she became executive director. I have not met someone with the level of expertise that she has on this issue and the committee would really greatly benefit from her wisdom and her knowledge. Councillor breed thank you it. Supervisor safai . Councillor safai we have the ability to waive the residency requirements. It did come up. She did talk about it. She was an active ms. Way was an active participant in the negotiations that took place over the last 10 months. Her participation was invaluable. So i dont have any question of her commitment or abilities, so i want to separate the two. I think theyre two separate issues. Councillor breed thank you, supervisor safai and kim. I want to be clear. Im well aware of ms. Ways involvement and i support her and im prepared to support her here today including her residency waiver. My only suggestion in terms of this situation is that were providing residency waiver for ms. Way. If this is the case with mr. Elberling, that, too, can be an option, but it doesnt appear that thats the case. If that were an option, why wouldnt he use his specific address in sonoma if that is his primary address. If there are colleagues that are concerned about wanting to factfind and make sure that theyre comfortable with moving this forward, i will support a continuance, but i think its important to highlight the fact that these are those two individuals in particular were very instrumental in working with us to develop the legislation for inclusionary housing thats really change the the face of how Affordable Housing is done not only in San Francisco, but im sure will have a Ripple Effect in other jurisdictions as well. So im prepared to support them today, but i also understand supervisor cohens concern and she should have the opportunity to confirm the facts. Supervisor peskin . Councillor peskin first of all, maybe we can ask the controller about the deadlines that are driving this because i know that theres been a push to actually get the Technical Advisory Committee to reconvene with some deadlines and then i will ask the City Attorney about domicile laws and rulings in the state of california and i understand those relative to the statements made by mr. Elberling that he reside 80 of the time at the address south of market and i think under those rulings and laws is domiciled in south of market and i believe votes in south of market. But with that, through the president , mr. Controller. Supervisor peskin through our president , ben rosenfield, city controller. The legislation that asigns to us the task of completing this newest body of work has a deadline at the end of january. Time is of the essence for us to have impact on our meaningful work. Councillor peskin because of a spurious allegation and personal attack that we would delay our mission of affordable inclusionary housing blows my mind, colleagues. Anybody can accuse anybody of anything. And what we all voted for unanimously, i find this to be proposterous and upsetting. I realize this is an upsetting day, but this is absurd. Councillor breed i will add that the other option is, we can come back to this item later on in the agenda since there are other items. Supervisor yee . Councillor yee i want to for shannon way, i dont want to continue. John elberling, theres a question, not about whether we should waive or not waive, but more, about residency. So, number one, lets move shannon way forward. Ms. Cohen, supervisor cohen . Through the president , when did we receive this . Is this a letter floating around for a while or i dont have it in front of me. Councillor cohen i didnt hear your question. Councillor yee when did you receive this letter . Has it been around for a while . Councillor cohen let me check with my staff. I dont know when we received it. Supervisor tang said she received it via email a day or so ago. I will have my staff make a copy of it for your reference and make sure its reflected in the board record as well. All im asking for im not saying yes or no. I just want to know if theres any truth to it. Councillor yee i am wondering about the timeline. I thought maybe i missed it during the rules committee. So it was after rules committee. And i guess, City Attorney, are there let me get an understanding, if i dont know what the situation is when you are allowed to get an owners tax exemption, whether or not supervisor peskin mentioned that you might have a wife and if he and his wife owned a different home somewhere but its not his main residency but its his wifes and they claim the exemption and maybe only can claim one. Is it possible that one could claim an exemption for one place and actually have primary residency in another place. Deputy City Attorney john gibner. Basically every member of an appointed body must be a resident and registered voter in the city, although the board can waive that residency requirement in its discretion if it cant find any qualified applicants for the seat. And thats a judgment for the board to make. Whether a person is a resident depends on two factors. First, their physical presence in a place, and second, their intention to make that place their permanent home. Without getting inside someones head, the courts and the attorney general have looked at a number of different factors to determine whether a person intends to make a place his or her home. Those include, are you registered to vote there . Do you file your tax returns there . Are does your drivers license or Motor Vehicle registration list that as your address . Thats where your homeowners exemption credit is taken. Thats one factor, among many, that courts look at in determining whether someone is domiciled in a particular location. Councillor yee so one can well, one can have a certain definition that includes, i am here most of the time. This is the place where i stay. And i register to vote here as being a definition of, thats his residency . Yes. If a person is in a place and tends to make that place their permanent home and has indications that that is so, that they do intend to make the place their permanent home, including registering to vote at that address, yes, that would be their address. Councillor yee okay. Im just drawing some conclusions, that its a possibility mr. Elberling considers his San Francisco address his home, not trying to fool anybody. Otherwise, theres no reason to fool anybody. If he said that his primary home is in sonoma, then we can always give him residency waiver, like we do to many people, actually. So im okay. I cant assume hes lying. So either way, if he werent if we determined that what he claims as his residency doesnt fit our i think hes been a valuable member of this Advisory Group and that i would be willing to support him today. Councillor kim with a little bit of research that weve noted that John Elberling is a registered voter in San Francisco and only San Francisco. I just have to state as an individual who is not a homeowner in San Francisco and is not certain that they can afford to own a home in San Francisco, ive often gotten advice that i should buy a home outside of San Francisco to be a homeowner. I dont think its unusual for a San Francisco resident who is a renter to own a home outside of San Francisco, given the housing prices we have here in the city. In fact, i know i have many friends who are domiciled in San Francisco. There are individuals we know that are executive directors that are renters in San Francisco but own outside of San Francisco and we do not question their residency. So i just want to say, again, that i want to move forward with these four outstanding individuals who really have offered their support and advice to this board around housing and Affordable Housing as we move very quickly through our technical process around inclusionary housing. Councillor ronen i want to add my voice of support for these four excellent candidates and say that a letter we received last night at 4 30 when there was a hearing at rules committee is not the fairest way to give input. And given the timelines that we have to meet before us and the fact that i have worked with mr. Elberling and many times have asked for his Technical Advice on Affordable Housing issues and found him to always be incredibly knowledgable and accessib accessible. I see no reason to not move forward today. Councillor breed thank you, supervisor ronen. Seeing no other names on the roster, i think we should move this item to later on in the meeting and i think within that time well be able to confirm the residency requirement and vote on it at a later date. We inserted a clause that by the end of next year, we expect the law library to take all the books that are in storage at brooks hall and move it into the second floor of the law library at 1145 Market Street on the second floor, where there are empty shelves. So by the end of the year. If that doesnt happen, then the department of real estate has the ability to allow other departments to occupy space on the second floor of the law library. I wanted to make the Board Members aware of the condition we put into the resolution. We have received some information from the law library, which is the first ive seen in many, many years, upon many subsequent budget seasons, so im glad we finally have some information and that there may be some progress with having the law library really effectively serve the public. With those amendments, i would recommend that we approve this resolution. First, Community Access from where we restarted the discussion a few months ago and adrian hines attention to this issue, but im not sure that theyve done everything they can to give back. Im concerned that promises made will not be promises kept. And i want to get on the record and make sure that we see a commitment to examine the external balcony policy and be responsible to the feedback and usage of the community. And i wanted to see a concrete plan for the art installation for plant life around the creek restoration, right on the creekb creekbed. I believe that this plan should have been reflected in the original cost estimates and design plan. Sfmta leans heavily on the Dog Patch Community to get things done for their input, cocollaboration and the bayview community. But i still dont see the transparency to establish this trust. So i do believe that this is an appropriate location for this facility. And so i am going to be supporting the looease, but i would like to signal to mta to pay closer attention to what they promised, honoring their promises, Pay Attention to the transit corridors theyre creating and make sure were not neglecting the corridors and to think critically about how we can continue to always develop better ways to work within the neighborhoods and the communities that live and exist within the neighborhoods. Colleagues, i will be supporting this lease and i hope that you will join me, but, again, mta, want to be sure that were clear and that you deliver on the promises that youve made. Thank you. Its the oldest, most Historic Buildings that now won a 3. 8 million grant on behalf of this revitization, tax credit, and this center will be, were hoping, one of the premiere arts and performing spaces for children and families, particularly youth under the age of 18. Much needed in the part of our town that has one of the highest concentration of children and families. Performing arts workshop will work with Community Art stabilization trust and Parks Department and executive director Phil Ginsburg has worked tirelessly on this effort and its only half of the project. Its 15 million in total. Theres another 15 million to go to fully revitalize this. Supervisor yee and my district will greatly benefit and we both care deeply about this and worked collectively on this. Colleagues, i ask for your support. Thank you. And 56 was referred without recommendation, to declare an emergency to authorizing director of public works to design and construct Front Door Services case management, medical attention and Mental Health counseling to individuals affected by homelessness in support of housing property at 440 turk street. Councillor kim i am asking for a continuance. I was not made aware of this until yesterday. I was surprised to see it declared an emergency. Its not clear to me why this was unforeseeable and why were using this vehicle to move forward with the construction and tenant improvements at 440 turk, which is offices for the department of homelessness and Supportive Housing and i have a number of concerns about using this as a precedent for emergency construction when this is an item that weve talked about for over two years. Separately, there are concerns about Clear Communication about what would be provided on site. I want to say on a personal note, i support what is being proposed for the site here today. But i just have a number of questions on why were choosing this route. Also out of respect to the neighborhood that i represent that felt blindsided by this resolution that only got an email at 6 30 p. And without any disrespect to the mayor or supervisors ronen or sheehy, and not to the substance, but to the use of an emergency exemption, and if you read section 6. 60 subsection c which defines what an emergency is, respectfully, this does not meet that test. I mean, i can ask the City Attorney, i dont know if i need to put the City Attorney through the paces, but these were all foreseeable events. An emergency is an unforeseeable event. And its a really slippery slope when we start applying emergency declarations where an emergency does not exist because it was a foreseeable event. 440 turk street, highly foreseeable. This board took unanimous legislative action to not allow the department of homelessness and Supportive Housing to use a different site and to require them to use the 440 turk street site, so weve known that for quite a long time, because that happened six months ago. Thats foreseeable. I hate to be the parliamentarian, but im sounding a note of caution that we should really use the admin codes as intended and, therefore, will support the continuance. I would actually support a continuance of both items. And, quite frankly councillor breed we have not called item 57 councillor peskin it says it on the screen. Councillor breed thats a mistake. Councillor ronen im prepared to support supervisor kims motion to continue because this facility is in her district and came up and if you are looking at the situation on the street with the people who are sleeping in tents in squallor under freeways and in front of peoples houses and in the middle of streets and you dont think that is an emergency, a health emergency, at the highest proportion, you and i have a different version of the definition or understanding of emergency. I do not think there is a bigger emergency in the bigger emergency in the city of San Francisco than the fact that over 4,000 individuals are sleeping in the streets, using the bathroom in the streets, are injecting drugs and throwing needles in the streets, are in severe Mental Health crisis in our streets. And that we being a city with a 10 billion budget have not yet gotten it together to build enough facilities to temporarily house and then give services to these individuals so that they can get their life back together. In fact, one of my deepest, deepest fears and sadness today about those tragic and untimely loss of m
