Welcome, madame mayor. There are no topics submitted by the supervisors today and i really would like to welcome you as the last meeting for 2019 that you will be sharing your remarks. Thank you. Good afternoon to members of the board of supervisors and members who are joining us here in the chambers, members of the public. Really great to be here at the last meeting that im required to attend for the year. Im looking forward to celebrating this Holiday Season, but i also wanted to share some information that most recently there have been discussions with Department Heads about budget instruction. Yes, we know the budget discussions dont happen until sometime next year, but the fact is, folks, we are possibly facing a significant budget deficit this upcoming budget year. Most recently in our past budget , we have made a number of commitments, not only have we made commitments to increase salaries of a number of employees of the city, but we also have made a commitment to fully Fund Mental Health s. F. Which will be a significant amount of resources required financially. As we move forward, i do think it is important, with many of the things that i have heard around additional commitments to our city budget outside the scope of the conversation around the budget that we keep in mind that we have to balance the budget. I will balance the budget by whatever i would need to do, even if you layer on additional responsibilities. The fact is we have to be responsible to the public when we talk about the finances. We still dont know completely where all of the money from Mental Health s. F. Is coming from. So to add layers and layers of responsibilities and expect that the money will fall out of the sky and come from somewhere is not the most responsible thing to do. I know as we move into the Holiday Season this is probably not what you want to hear, but i just want you to know that we have already made a significant number of commitments and that should be kept in mind when looking at introducing what i hear our new supplementals that will have an impact on how we balance the budget and follow through with the commitments that we have already made for the future. I also would like to take this opportunity to just recognize and really appreciate the service of supervisor vallie brown. I know today is supervisor brown s last meeting. I am really so grateful for your service. It may not even be your last meeting, who knows, there is an election next year. The fact is, vallie brown has been serving the district five community for many, many years, and even during her short time on the board of supervisors, the work that she has led on our things that, in some cases, people were not always comfortable to push forward, pushing for safe Parking Spaces for people who were living in their vehicles, working with supervisor fewer on the office of racial equity, pushing to make the kinds of investments in Small Businesses and to provide opportunities for Small Businesses to do things outside the scope of the things that we allow Small Business in the past to be permitted for. Being creative about solutions that actually support and protect communities. Thats what you have always been about, whether you are serving on the board of supervisors or you are working in the community picking up trash, or you are going and trying to save a man from being evicted out of his unit because there were some challenges with communication and there was a need for Mental Health support. The work that you have done both in the chamber and in the communities something that definitely is admirable, it is appreciated, and we know that no matter what position you are in, you will always be someone who will continue to fight and advocate for the community. Thank you, supervisor brown, for your service and for the work that you have done and will continue to do to make San Francisco a more equitable place for all san franciscans. We truly appreciate you. Thank you. The fact is, San Francisco has a number of serious challenges and everyone here in this Board Chamber i know, you know how important it is that we do everything we can to Work Together to resolve those issues i have made it clear from day one when i was sworn in as mayor that i am willing to be here and to work with you because its not about me, it is not about politics, it is about the future of our city. And when we make bad decisions, the people of our city his suffered. Im looking forward to seeing more good decisions come out of this chamber, more responsible decisions, and im committed to working with you to make San Francisco all that we know it can be. Item number nine is an ordinance to amend the transportation code to establish a violation for operating shared Mobility Device Service without a perimeter under authorization from the Municipal Transportation Agency and to repeal certain parking restrictions related to station list bicycle share programs and powered scooter share programs, and affirming the sequel determination. Item 10 is an ordinance to amend the administrative code to create an office of emerging technology within public works and affirming the sequel determination. Colleagues, i am proud of the work that went into creating this office of emerging technology. I have spoken about this office on several occasions, so i will keep my remarks brief today. As a reminder, more than 200 participated in the emerging Technology Working group from the diversity of fields including the tech sector, private industry, nonprofits, labor, merchants, and neighborhood associations. City departments and academics. Additional interviews were conducted with 10 governments throughout the United States and they also researched 28 other cities around this issue. What you are voting on today is a combination of research and open work group that welcome input from all stakeholders. At the epicenter of technology, what was resoundingly clear was the request that San Francisco support innovation by having a clear and streamlined process. This is what makes the office of emerging technology work. If you have a company that is offering an interesting and new technology that does not put our residentss safety at risk or have a negative impact to our public infrastructure, then this office will welcome you. If it Technology Offers a net common good, there is now approval through this office. In every industry, there are good players and ones that always take advantage of the situation. This Office Creates a clear system so the city is able to holistically evaluate impact in identifiable and measurable ways the office of emerging Technology Facilitates collaboration between departments in order to ensure that any technology that operates in our public space is safe. Safety is, in terms of mobility, privacy, and impact of our public infrastructure, and also labor, the labor market. If an emerging Tech Company Launches their device without approval, we now, for the first time, will have the mechanism to stop these bad players and reward the innovators that are committed to being good partners with the city. The office of emerging technology is innovative because , for the first time when a public facing technology opposes the launch in San Francisco, we have a mechanism to ensure departments are holistically measuring things. The office itself is also in charge to purposely work with the community and industry, not as an afterthought or reactionary as we have in the past, the office will offer insight and forecasting as a city so we can prepare for and support the changing environment i want to thank the city administrator and her staff as well as deborah from public works public works and our City Attorney for the hundreds of hours put into this process and this particular legislation. I also would like to thank sfmta who has committed to working with this office in sharing data with the city in the off chance that an emerging Technology Falls solely on their jurisdiction. I especially want to thank my staff who worked tirelessly over a year and putting this legislation together. Lastly i really want to thank all of you, my colleagues, on the board of supervisors. Thank you for all cosponsoring this legislation. Before i make a motion, there is one minor typographical error that i would like to read into the record. Item 11 is a resolution to approve modification number 11 to airport contracts for Program Management support services for the Airport SecurityInfrastructure Program with faith group l. L. C. To increase the contract amount for a not to exceed amount of approximately 17 million with no changes to the term. Colleagues, can we take this same house, same call . Twelve is a resolution to retroactively authorize the department of Public Health to accept and expand a grant in the amount of 350,000 from the Public Health foundation to participate in a problem entitled California Community reinvestment grants program for the period of october first, 2019, through september 30th, 2021. Thirteen is a resolution to approve an exclusive negotiating agreement with mercy housing california for a proposed property at 155 grove street, 165 grove street and 240 van ness avenue with an annual lease payment of 15,000 under the jurisdiction of the Real Estate Division to affirm sequel determination and adopt the report with findings. Item 14 is an ordinance to amend the health code to require the department of Public Health to maintain and operate at full capacity and addled residential facility with no fewer than 41 beds and two amended ministry of code to establish the addled residential Facility Working Group to advise the board of supervisors and the mayor regarding resident care, training, workplace conditions, and staffing at the a. R. F. Supervisor ronen . Thank you. The board passed a law in late october about the future of the addled residential facility codifying an agreement that was reached between my office and others. The law saves the only board and care facility for severely mentally ill people. We passed a legislation and then duplicated the file because we were working out the details of one component of the agreement. The specific truck structure and parameters for the management Staff Working Group that was created to address any ongoing concerns. Before you today is the amended duplicated file that incorporates all of those details. Thank you to representatives, local 21 representatives, the Mayors Office and d. P. H. Staff are working on this duplicated file with my office. We have made very a few very minor amendments that i have distributed to all of you. First we clarified on page five, line 21, that seats seven, eight , nine, or 10 should be held by a. R. F. Or Behavioral Health staff. Second, we clarified on page six , line five the members of the working group shall serve at the pleasure of their respected appointing authorities and may be removed by the members at any time. And then third on page six, line 14, any Voting Member who mrs. Three regular meetings with the working group within a sixmonth period without the express approval of the working group by majority vote shall be deemed to have resigned from the committee 10 days after the third and approved absence and the second and third amendments are very standard language for working groups in the city. Twentytwo is a resolution to establish the creation of a vision zero and homicides in Violent Crimes plan for neighborhoods most impacted by violence and city departments to implement strategies to achieve upon. I first want to start by thanking supervisor walton for this resolution. I am very happy to be a cosponsor and thank you for the conversation we had in committee about the amendments that i am about ready to introduce. When we were talking about vision zero for Violent Crimes and homicides, i realized that we cannot talk about that without calling out domestic and Family Violence. It is a leading cause of death among women and remains a threat to public safety. Intimate Partner Violence accounts for 15 of all Violent Crimes. Nearly half of all women who were murdered were killed by an intimate partner. In the United Nations report has states the most dangerous place for a woman is in her home 70 of all murder suicides involve an intimate partner. Over a quarter of all californians experience intimate Partner Violence. Presence of a firearm increases the risk of homicide by 500 . These represent real people who live in our city. In october, a woman was tragically shot near Lowell High School by her former boyfriend. Or, her murder came after months and months of as collating abuse and violence. Incidents like these are a reminder that we have so far to go before we truly address the horrific nature of Domestic Violence. We need to have every tool at our disposal to combat Family Violence in our city. That means a stronger reporting requirement and making sure that those who would harm themselves or others do not have access to weapons. You should have the amendments in front of you. They are on page two, lines through one through 19 and page four lines 22 through 25 and page five, lines one through five. I want to thank supervisor walton for this resolution and for his vision on this, and Beverly Upton and the Domestic Violence consortium for helping to draft these. We have to care about the homicides that are taking place on our streets, and so vision zero aims to not only stop this senseless violence, but also make sure resources make it two areas of high concern. There will be budget asks for future legislation to support the focus of vision zero. Today i am commending Franklin Marshall for organizing and contributing to the recognition of 400 years of africanamerican history in the United States. Over the past few years, events across the u. S. Have been produced and an honorable legacy and contributions of africanamericans since a very first recorded groups of slaves from africa can put this shares to our shores in 1619. Today i want to recognize someone who was central to the production and success of the series of events that took place in the historical fillmore district at the fillmore heritage center. Thank you, Franklin Marshall, for your work, for the last 400 years, to really bring peoples attention, of the history of the last 400 years by organizing these events. The series that franklin organized started with a launch party and a lecture back in january of 2018. He organized a storytelling our also at the fillmore heritage center, showcasing africanamerican heroes and leaders. This took place each and every saturday from january through march. Finally, this series commences with an event at the War Memorial Theatre on august 25th for a book reading and signing gala for the published book about the life of San Francisco maryellen pleasant. Franklin, i know you are here somewhere. Please come up. [applause] thank you for your work. Your contributions are valued and they have been central to providing deeper understanding of the history and contributions of africanamericans to the United States. We are grateful that we had an opportunity to use the Fillmore Center for free to put on a number of events and we would like to thank you for what you have done and your recognition today. Thank you. [applause] [applause] thank you. Next we have supervisor haney to present his commendation. Thank you, president yee. I am very excited to honor our Unsung Heroes in our community. Someone who does incredibly essential work. Often while all of us are sleeping. I know it is the month of christmas. I am referring to regroup a people who do this every single day all here and that is our recology sanitation workers. I am very excited to be able to honor frank hanson who has been working in the tenderloin for recology is a sanitation worker for the last 18 years. I had the opportunity to go on a ride along about two weeks ago in the middle of the night on a very rainy night, and to see firsthand the incredible work that frank does every single day the hard work. His professionalism, within tension, with seriousness, with care and with speed. Im excited to be able to thank you and appreciate you for your commitment to our community. Frank was born he currently lives in San Francisco. As i said, he has been servicing cans in the tenderloin for the last 18 years. He became a recology employee owner in 2001 shortly after San Franciscos first tech bubble burst in the. Com crash of 2,000. At the time, he was looking for a good and stable job with benefits that would be fulfilling and he found that at recology. Frank works five days a week, monday through friday, to make sure recology does its part in keeping the streets of the tenderloin free of trash and litter the emptying city cans, picking up spilled refuse and generally keeping an eye out for our neighborhood. Frank is one of recologys most reliable drivers, really taking sick days and always showing up on time. His supervisors have nothing but praise for his ability to remain calm and collected no matter what is thrown in his way, sometimes literally, and his precision and attention to detail has made him somebody who is loved by his fellow colleagues and by the community. I want to thank recology drivers ron and bobby for also going along and taking me on a ride along. Thank you for arranging. Thank you for supporting us every day in the community. As i said, our safety could not run without you. It doesnt work without you and your commitment, in particular to an area of our city that faces extraordinary challenges around maintaining cleanliness really means a lot. I just wanted you to know, i appreciate you. I can tell that the members of our community and the residents of the tenderloin appreciate you as well. I also want to recognize teamsters local 3504 supporting an incredible set of workers and for being such a great partner with me and my office in the city in helping to keep our streets clean. I want to recognize some of the folks who are with you also. Karina, sophia, tita and chris who are here along with you and joining you. I hope they know how proud and thankful we are of frank for all his work. If you want to say a few words . Thank you. [applause] thank you, supervisor haney for acknowledging me. It is truly an honor. Im proud to receive this commendation. A supervisor haney mentioned, i am a driver for recology for recycling, collection and resource every company. I have been relying providing reliable city can collection for 18 years. I do love the people. Collecting garbage in the tenderloin is just as challenging as it is rewarding. Im proud to be out there every day supporting the effort to keep the tenderloin clean. I have strong relationships with community members. Each thankful smile and wave hello lets me know that the neighborhood appreciates my hard work and i am humbled to know that the board of supervisors is grateful for my efforts as well. Thank you. [applause] i do this job because it is essential and meaningful. Thank you for honoring me form 18 years of collecting city trash cans in the tenderloin. Thank you very much. I appreciate it. Twentyfive is an ordinance to amend chapter 19 b. Of the ministry of code governing the citys acquisition, retention, and use of Surveillance Technology to allow the acquisition and retention of Face Recognition Technology under certain conditions, to preclude legal relief for alleged violations of chapter 19 be that the city timely cured following notice, and two authorizes a debated administrator to adopt implementing standards to guide departments in compliance with chapter 19 b. s restrictions on the acquisition, retention, and use of Surveillance Technology. Supervisor peskin . Thank you. This legislation trails the ban on the city use of facial Recognition Technology that we, the board of supervisors, passed earlier this year. I have a couple of nonsubstantive amendments that boil down to a semantic distinction between the purchase of devices or software that may have facial Recognition Technology bundled in them, and the prohibited acquisition of facial Recognition Technology. In either event, the city must make written findings that the city would never use that technology. This legislation also strengthens the citys ban on facial Recognition Technology by creating a means market for dark market to do not have this technology embedded in aunt. The changes are at the bottom of page two and the top of page three. They are the exact same insertion of language that says i Software Product or device that includes, and that it appears in subsection g. , and the two succeeding clauses. Twentysix as an ordinance to amend the ministry of code to clarify the right of current households to occupy replacement Housing Units and provide a priority to former households of an existing Public HousingDevelopment Return to revitalize Housing Development and provide a priority to current and former households of an existing Public Housing development to occupy a new affordable Housing Units. Twentyseven is an ordinance to amend to administrative code to apply eviction controls to units that are exempt from rent increase limitations because they first received a certificate of occupancy after june 13th, 1979, or have undergone a since of substantial rehabilitation. Supervisor haney . Thank you. Thank you to the rules committee for unanimously supporting this ordinance. For 40 years, the San Francisco rent ordinance, which our city has a set of laws which govern renters rights, has treated tenants differently based on when theyre building was built. If youre building was constructed before 1979, you have the benefit of rent control and protection from arbitrary eviction. If youre building is any newer than that, you simply dont. We have little data on what happens to tenants in the post 17 1979 buildings. Fifteen of renters reported they were threatened with eviction in the previous five years. Over the past decade, the number of Homeless Individuals reporting that eviction is the primary cause of homelessness has more than doubled. Now is the time to correct this inequity and treat all units the same when it comes to eviction protections. That is exactly what this universal eviction protection legislation will do. Earlier this year, we passed the tenant protection act of 2019 that establishes just because eviction protection in every California City starting on january 1st, as well as implement a statewide rent cap. This is a huge werent win for tenants statewide. We have an opportunity to go even further. Our legislation will close the gaps in the state law and build off of San Franciscos rent ordinance to ensure tenants and buildings constructed after 1979 , including tenants who just moved in and those that live in singlefamily homes, and those that are built in the last 15 years are protected by strong eviction protections and Relocation Assistance if they are subject to a nofault eviction. After the ordinance goes into effect, the rent board will have the opportunity to provide support and oversight over these buildings in a way that they have not up until this point. I want to thank the organizations in the antidisplacement coalition, especially the San FranciscoTenants Union for bringing this proposal forward and partnering with us to expand it, and also to my cosponsors who also a special thank you to Courtney Mcdonald from my office for all of her hard work. This is a huge expansion, one of the biggest, if not the biggest expansion of eviction protections in San Francisco in the last 40 years, and it is critically needed at a time when we know that many folks, regardless of when theyre building was built, are living under threat of arbitrary eviction. This will finally change that. Okay. Thank you. First of all, i want to thank supervisor haney for picking taking the initiative on this ordinance. While i will be supporting this item today, i would like to implore this board and the city to do more when it comes to educating and providing resources for small Property Owners. Many of whom are immigrants or limited english speakers. With the passage of a. B. 1482, there has been a lot of confusion and misguidance for landlords and Property Owners. Im deeply concerned that people are being misled and we are getting the unintended consequences of an eviction. This is not what we want to see happening. We need all the housing we can get and we know that many small Property Owners have provided the stock. It is unacceptable for us to assume that every landlord has knowledge or resource to understand complex tenant laws, especially in San Francisco. I know this conversation comes at a time comes up time and time again, but i have not seen any demonstration of proactive outreach and education to these types of landlords so that we can prevent evictions and disputes from happening in the first place. We need to empower communities to support each other. We want landlords to be fair counterparts so they can keep tenants housed in safe conditions. Supervisor haney and i reached an agreement last month with mayor breed to implement Mental Health s. F. In collaboration with her and the department of Public Health. I am thrilled to be voting today on Mental Health s. F. Instead of taking it to the ballot in marc. I want to thank all of my colleagues for your unanimous cosponsorship. The legislation before you reflects our joint commitment to solving our Mental Health crisis on the streets with particular attention paid to the intersections between homelessness, Mental Health, and Substance Abuse. San francisco will soon have access to a comprehensive Mental Health care program. We designed the system to provide access to Mental Health services, Substance Use treatment psychiatric medication to vulnerable residents, specifically those who are homeless, and insured, or enrolled in medical or healthy San Francisco. Mental health s. F. Includes a number of components. A 24 7 Mental Health service center, at 24 7 street Crisis Response team, a drug a sobering center, and an office of coordinated care. Increased beds at every level of the system, as well as case managers for every person who is eligible for services and who needs them. And office of Privacy Health private Health Insurance accountability for those residents who do have private insurance, but are unable to access family care. I want to thank the hundreds of frontline workers, labor unions , and advocates including nurses, Mental Health workers, and social workers, family members, and consumers of Mental Health services themselves for believing that we can do better and for partnering to make this solution. Of course, a very special thank you to my colleague, matt haney, are fighting alongside me every step of the way and to our incredible Mental Health s. F. Committee who worked so hard on every single detail of this legislation. I also wanted to give a very special thank you to supervisor Shamann Walton and gordon morrow and Assembly Member phil tang for their unwavering belief in our solution. Finally, thank you to mayor breed and her staff for her willingness to work with us to find unity and to dr. Colfax and his staff for the collaboration. And then, of course, i want to thank carlee nomar ellis and caroline from my office who spent a year living and breathing this legislation alongside me, as well as abigail from supervisor haneys office. We did it, we did it now that we have developed this thoughtful and exciting new Mental Health plan, we plan to move forward with the appointment of all members of the Mental Health s. F. And limitation commendation working group as soon as possible early next year. I thank you, president yee, for waiving the 30 day rule so we could get this rolling and get to work right away in january. The mayor has committed to hiring the director of Mental Health s. F. By next summer, and expediting major renovations of the citys current Behavioral HealthAccess Center so it can be transformed into the new 24 7 Mental Health s. F. Service center. Most other aspects of Mental Health s. F. , however cannot move forward until we have identified a long time Funding Source for the measure. I am thrilled to have the strong commitment for mayor breed to identify at least 100 million per year in new funding to fully realize Mental Health s. F. Through our efforts to reform the citys business tax or through other revenue measures. You heard that commitment again from her today. It is much appreciated and muchneeded. I will not rest, and i know that my colleague matt haney will not rest until we have the funding that we need to fully realize Mental Health s. F. And we will continue to explore every possible option for funding, including the idea of an excessive c. E. O. Salary tax if we need that. We have a lot of work ahead of us implanting this piece of legislation, but with the passage of Mental Health s. F. , we have the blueprints, we have the overarching vision, we have the structure on how we are going to effectively reform our Mental Health system. Thank you. [please stand by] lati. Supervisor haney and they shaped this into something that was truly connected to the actual needs within the system and on the ground, and so were confident that it can be successful, but were also very sure that theres a lot of work left to do. Its not fully funded yet. We have a commitment from the mayor, but we need at least 100 million a year, including startup costs, to be able to implement this. Its going to take a lot of work from the implementation committee, oversight and working together, potentially needed additional revenue from the public. So i know that the public is excited about this i hope they are, but theyre asking, well actually be excited the most about this when we see it bringing a change in our communities, and so thats going to be the next steps once it passes today. Im grateful for everybodys support and for everybodys leadership, and im excited about seeing this fully implemented and funded and lastly want to give, as supervisor ronen did, give a shout out to our staff, carolina in supervisor ronens office and abbie in my office. Must have seen this for the last seven months, and truly would not have gotten to this point without them, and the leadership of the Mayors Office in getting this down.
