Thank you, president yee. Thank you so much for having me here today. This, as we know, has been a very challenging time for all of us and i really appreciate that san franciscans are staying home and grateful for the level of compliance that we have seen. We still know that we have work to do and were not out of the woods. So, as much as San Francisco has been a model for flattening the curve t curve is not completely gone away. And so we cant let up. We cant get complacent. We have to continue to focus on what we need to do in order to get through this. I really want to take this opportunity to thank our essential city workforce. A special thank you to our Health Care Workers, our muni bus drivers, our para transit operators showing up to work every single day. The Grocery Store clerks, they are doing incredible work. They are putting their lives on the line to really serve and protect and support the public. Our public works department, the folks who are out there cleaning the streets. Yesterday i went to the Disaster Service worker training for employees who are stepping. Up and leaving their homes to work in hotels for homeless individuals. This is a tough job for anyone. But for people who we know are not necessarily the ones who are responsible for working in this capacity, we really appreciate the work that they are doing and the training that they are taking to learn about whats necessary in order to be a Disaster Service worker. We asked hundreds of our City Employees across 41 departments to leave the safety of their homes and step up into a role that is well outside the scope of their normal jobs to help provide a safety net, including our librarians delivering food to residents and providing care and education to the children of our essential frontline workforce and those who are going doortodoor doing Community Outreach to help our residents, especially those in Public Housing understand the challenges of the Public Health order. I just want to really take the opportunity to appreciate our city workforce. Any City Employee including the staff that work for all of you are considered Disaster Service workers. If any of your staff want to help and support our effort, they can sign up for the training to be Disaster Service workers and help us so we can move faster as weve been asked to staff up our hotel room so that we can move more of our vulnerable population into hotel rooms. I want to really take this opportunity to appreciate president yee and supervisor fewer and supervisor peskin for being on the frontlines here at the Emergency Operations center, staying on top of things, working with our office collaboratively in order to address the continued challenges that we all face, im grateful for your service and your partnership. I also appreciate the many employees that are working here at the Emergency Operations center for your hard work and showing up every single day. This has been tough for many of us and, as we face what we know is a considerable challenge, we also have to keep in mind that, as fast as we want to move, as much as we want to provide services and support, these are different times, especially when a request to ask people to socially distance themselves from one another. Doing this work under normal times is already challenging but now its so different, people are afraid. There continue to be issues, which is why the fact fact that there are so many people who are still showing up to work and helping us to keep this city running, operating our buses, working at these hotels and continuing to do everything they can to provide service, it is absolutely remarkable. Madame clerk, lets go back to communications. Supervisor fewer habitat Emergency Operations Center Last Week and also this week. So, supervisor fewer, would you like the share a briefly updated [inaudible]. Absolutely, president yee. Colleagues, today i will provide the senator kerry a series of updates on the board of supervisors liaison to the Emergency Operations center. And every Board Meeting for duration of the state of emergency, which ever supervisor was stationed, it will provide a brief, highlevel update on the e. O. C. s work. Since my office began our ship at the e. O. C. , the citys priority has been moving vulnerable populations into alternative housing sites, scaling up those alternative housing sites with a bidding process with hotels, going online with a comprehensive data tracker, trading a Food Security program accessible through 311 and continuing the spread of the virus. Additionally, text to 911 is now live, thanks to the work of e. O. C. We remain under both state and local shelter in place orders and all holiday celebrations continue to be canceled, including 4 20. Last monday, San Francisco had 696 confirmed cases of covid19 and 12 deaths. Today we have 987 cases and 15 deaths. Approximately 47 of our intensive care beds remain available at this point. Thanks to the [inaudible] early action taken by Public Health officials across the bay area, a total number of confirmed cases has grown at a far slower pace than other large metropolitan areas across the country facing severe outbreaks and hundreds and even thousands of deaths. We have Testing Available for First Responders and are now subject ago total of approximately 300 to 500 tests a day. We are still struggling to scale up testing due to shortage of swabs and the e. O. C. Is working aroundtheclock to open up new supply lines. We also saw our first significant outbreak in a congregant living facility this week with over 80 confirmed cases of residents and 10 confirmed cases amongst staff at m. E. C. South shelter. As of tad, over 750 vulnerable individuals have been moved out of congregant settings and into hotel rooms where they can safely isolate, including the entire population of [inaudible] south. The e. O. C. Is currently planning for the second phase of scaling up of alternative housing site which is will include moving significant numbers of people off the street into hotel rooms. The e. O. C. Continues to prioritize Food Security services and scaling up alternative housing sites that allow for safe isolation. So far we have 1754 rooms online at eight different active hotel sites, over 400 rooms at four secured sites that are currently being prepared to come online and nine additional sites in negotiation. I would like to offer my sincerest gratitude to the hundreds of disaster workers who are staffing the e. O. C. And hotels delivering groceries and perform ago myriad of other tasks to mobilize every resource at our disposal to contain the spread of this virus and minimize loss of life. This is an unprecedented disaster on a scale [inaudible] anticipated. I dont doubt that were all doing our best and look forward to continuing to work with my colleagues on the board and at various departments, staffing at e. O. C. To ensure all urgent needs are met for the duration of this crisis. I would like to shoutout my deep appreciation for my entire staff that has been at e. O. C. Last week and this week. In addition to holding down their Office Responsibilities and i also want to thank erin mundy for joining us from the d. A. Office who joined us this week to work at the e. O. C. Thank you very much. But yesterday it appears the Land Use Committee of the board of supervisors forwarded three items that appears as items 24, 25 and 26 on todays agenda as Committee Reports that are inextricably linked to item number six on todays agenda. And i was wondering if you want to call those items out of order so we can do the entire potrero power station together and then if you are willing to do that, mr. President , i would then like the say a few comments and defer to the district 10 supervisor. There any objection to this request . There are none, then lets take item 24 through 26 together out of order. Madame clerk . Items 24 through 26 are three ordinances that refer to the petrero power stationful it amends the plan to revise the Central Waterfront plan, the commerce and industry element, the recreation and open space element, the transportation element, the urban design element and the land use index to reflect the potrero power station mixed use project, item 25 amends the zoning map to establish the potrero power station special use district and item 26 approves the Development Agreement between the city and the california barrel company, l. L. C. For the potrero power station mixed use project at the approximate 29acre site with various public benefits. It makes the proefpt findings including public trust findings in accordance with the approval of portowned land and approves specific development impactees and suspends conflicting provisions in the planning code, administrative code, confirming compliance with or suspending certain provisions of the administrative code, the planning code, the public works code, the subdivision code and ratifies certain actions taken in connection as defined herein with these items. Thank you, madame clerk. Supervisor walton, would you like to make some comments . Thank you so much. First, thank you, supervisor peskin, for putting all these items together. It makes sense for the flow of the meeting. The first thing i just want to say in terms of item number six, this Lease Agreement would allow us to have Additional Space needed in a dog patch area in the community, but also provides [inaudible] allows access to the water. As you know, we should have water with the [inaudible] waterfront but we dont have the same level of access in district 10 so this is important that we make this possible for the entire community to benefit from him. So i want to thank the Budget Committee for realising this and passing it forward to with the prior recommendation to Land Use Committee which was heard yesterday. We also have items 24, 25 and 26, which comprise of planning approvals for potrero power Station Development project and this represents the last of the outstanding puzzle pieces connected in neighborhoods of the southeast sector of San Francisco to its waterfront. We will be providing almost 800 below market rate residential units for a total of a little over 30 of affordability, no less than two thirds of these affordable units will actually be provided on site. They also include a robust Workforce Development program, a range of new recreational and open spaces and tens of millions of dollars for transportation improvement and the area that are all featured in this project. Also all the items have been shaped by Community Input over the course of a planning process, a Dog Patch Community is excited about this project. The potrero community is excited about this project. And in short, and to summarize, this project will be transformative, turning a former power plant site into a vibrant new neighborhood with the decimation of the waterfront. I would like to thank land use for forwarding this with a positive recommendation and i look forward to voting in support of this at todays meeting. Supervisor peskin . Thank you, president yee and thank you, supervisor walton. As i said yesterday in the Land Use Committee, this has been many, many decades in coming. This was originally a pacific gas and electric power plant that was subsequently transferred to a number of different power providers, last in the hands of the morant corporation. It was one of two of San Franciscos most polluting power plants located in the southeast portion of San Francisco that contributed to elevated asthma rates and other Health Impacts in that part of our city. It has been a struggle that took many, many years to shut the plant down under two mayors. Mayor willie brown and mayor gavin newsom. There was incredible work done by the then district 10 supervisor Sophie Maxwell and the board to have first they actually had a proposal to eke panted that power plant with an additional unit. The board of supervisors and the administration fought that and won. Supervisor maxwell was profoundly important, that site, as was the office of the City Attorney, dennis herrera, and Teresa Mueller and i wanted to acknowledge that history and then, as part of their agreement to decommission that power plant, the city and county of San Francisco actually agreed to give the developer, the successor in interest to morant an expedited approval and that is what led to the votes that are before us today. I would like to acknowledge the developer that is headed by a gentleman named Enrique Landa and, as was set forth in the presentation yesterday, the Community Outreach, which has encompassed hundreds and hundreds of meetings and many meaningful changes in the project has been superlative. The project addresses everything from Sea Level Rise to the appropriate preservation of historic resources. 85 of the site has already been subject to hazardous materials, remediation and, as supervisor walton said, it will provide significant amounts of Affordable Housing on site and within district 10 and, as he also said, will help link the waterfront in the southeast portion of San Francisco together. I am very delighted that this day has come. I commend this project. I salute supervisor walton on his predecessor, supervisor maxwell and all of the individuals that have made this moment come true. And i do want to thank my cosponsors of this resolution with commissioners mar, safai and roman. I want to thank the hundreds of operators and overhead workers at muni on the front lines every day doing their best to enshhh you are that our essential workers are able to take care of san francis cancel and help our neighbors have the food, supplies and medical care that they need. I had the opportunity yesterday to visit operators to start their day at Woods Division and Flynn Division as my team delivered 500 bottles of Hand Sanitizer to operators there. And let me just say these folks really represent the best of San Francisco and we appreciate all that theyre doing to keep us rolling amidst enormous stress and risks to their own health. I also want to recognize and appreciate the patience and understanding of muni riders. The service has been slashed on so many lines in my district and across the city and many of you have reached out about specific lines and were in regular touch with m. T. A. About your requests. But this resolution targets the proposed fare increases, urges the m. T. A. To refrain from any muni fare increases for the fiscal year 20212022 budget. I had fairly hoped this resolution would not be necessary, for months ive been engaging with m. T. A. Staff on this, but have not been able to secure a commitment to back off on fare increases. We pointed out that fares have doubled over the last 12 years and that further increases discouraged ridership and burden our residents unfairly, especially amidst the covid crisis, i hoped we would not be forced to talk about fare hikes on our residents who ride or who will ride again on Public Transit. Especially during this time of such incredible financial hardship. But unfortunately the fare increases continue to be recommended by m. T. A. s director and staff. It is their schedule to be voted on by the m. T. A. Board on april 21. The m. T. A. Has expanded some limited free muni options which we appreciate with response to the advocacy, but they are still insisting on across the board increase, most notably over 10 increase or 10 increase on single rides through clipper cards. So, you know, when we turn the corner and would come out of this crisis and we will, i think the last thing that we want to do have be raising fares during the time when san franciscans will be very economically insecure and also where a lot of san franciscans may be skeptical about congregating on Public Transit with lingering concerns about covid19 so we will need to do Everything Possible to incentivize ridership of Public Transportation and fare increases that do the opposite. So, calling to urge you to join me in sending a clear message to the m. T. A. Board that the board of supervisors firmly opposes balancing the budget on the backs of riders and firmly opposes fare increases. I want to thank all the folks who have reached out in support of this resolution and specifically thank Roger Morenco from t. W. U. To 50a whos made it clear that rider and operators are united against these fare increases and also to recognize an extented appreciation to transit justice riders, United States emission, senior and disability action and many others for their tireless organizing and advocacy work for transit justice and equity. We look forward to working with you all to fight the funding we need at the state, federal and local level. In the meantime we should not tolerate efforts to hike fares for those who ride transit now or after this health crisis. I urge my colleagues to support this resolution. Thank you. Supervisor mandelman . Thank you, president yee. And i want to thank supervisor preston for his compassion and concern and for bringing this resolution before us. I do have some concerns about it and will not be able to support it today. I guess first of all, i think it is worth noting that this m. T. A. Twoyear fare proposal is something that they have been working on for months and is intended to keep up with inflation and munis regular annual increases and operating costs gradually, over time, and thus to avoid the need for large fare spikes in the future that are much harder for riders to manage, especially those on fixed income or with limited means. Second, the fare proposal maintains and actually expands transit access to the most vulnerable. The proposal maintains the reduced fare for single rides at current levels and maintains monthly reduced fare passes for lowincome adults and keeps the cash fare at current levels and m. T. A. s current fare proposal will actually create two free muni programs in San Francisco and free muni for all people experiencing homelessness. This continuing and growing access to free and reduced price for people with disabilities and the unsheltered would be balanced by a modest increase in fares over two years. Full cost monthly passes would also be increased modestly over two years but by half the amount that would be required without those modest increases in clippers and single ride fares. Finally, we cannot forget that fare revenue makes up about 20 of m. T. A. s budget and translates directly to our ability to keep city workers employed. Many m. T. A. Employees would be at risk of losing Good Union Jobs with benefits without these balanced fare increase. Their salaries, health care and other benefits are a key driver of munis growing annual operating cost and i believe these front line workers deservingerer our consideration and support now more than ever. We all know that muni, along with other transit operators and segments of our society has entered a new and uncertain economic reality. Even before the current crisis, we were going to find going to need to find a way of raising new revenues to pay for critical investments and upgrades. Obviously these needs will only be intensified as we come out of current emergency and gain a fuller picture of the fiscal setbacks we face. Now is not the time to dig that hole deeper or impede thoughtful efforts to address rising costs and expand transit access to the most vulnerable among us which i believe m. T. A. s twoyear fare proposal does. I will not be able to support this resolution today and i look forward to working with you all moving forward to achieve our shared vision for the safe, reliable and accessible Transit System that San Francisco deserves. Thank you. Thank you. Supervisor ronan . Yes, thank you. I am very excited and proud to be joining on as a cosponsor to this legislation and thank you supervisor preston for bringing it forward. I am in full support of keeping up the pressure on our federal and state officials to get additional funding now for bargain m. T. A. S so they can continue to provide service to san franciscans, many of whom have no alternative and absolutely depend on Public Transportation. In addition to frontline public safety, health and social Services Workers called out in this resolution, im also hearing from another group of essential workers which are those that staff our Grocery Stores. Because of the reduced bart [inaudible] some are shortening hours because workers especially those across the bay now have no way to get home after 9 00 when they need it the most and im hearing from one of my neighbors at alameny housing that have lost the one bus line that saves them from having to get that steep mile walk. That prevents that forces them to do a steep halfmile walk to get on to the bus. Later in this month, in my role on the m. T. C. , i will be participating in decisions about the regional allocations of the first cares act transportation funds. There will be tough discussions there because theres not enough to backfill every single city and countys loss and i know there is going to be intense competition for limited funds. I will be working with my m. T. C. Colleagues, with m. T. A. Director tomlin and d. A. Director to commit to commiting to an allocation that prioritizes access and affordability for vulnerable populations with an emphasis on lines that serve lowincome populations. It has to be during this unprecedented time at the governments responsibility to backfill the Funding Crisis that we have for Public Transportation. We have one of the most expensive Public Transportation systems in the country, whether it comes to muni, to bart, to tickets. If you park too long on the street, to, you know, for cars, payments, and on meters, it relies too much on an individuals that are going to be even more cash strapped after this crisis than they were before. What i think we should be doing is putting pressure on the federal and state governments to fund, backfill the funding gaps in our local transportation system. Not on people that are more financially handstrung than theyve ever been before. I think by stating very clearly we are not going to raise the rates for individuals, we are basically saying step up. Local, regional government, fund more equitably Transit Systems like our own that are high used by lowincome populations that have no other alternatives. And i think we should make that stand and we should make that stand clearly. So very happy to support this today. Thank you. Thank you. Supervisor safai . Thank you, president yee. I just wanted to say a few words and thanks to supervisor preston for puting this resolution forward. I struggled a bit with it in some ways. One, wanting to ensure that our agency has enough money to operate. But, two, when we got our presentation and saw that even by raising the fare on or let me just say it differently. Reducing the discount for clipper card and fast pass holders, it still was really clear with the data that sfmta presented that well over 30 of lowincome households use clipper and fast passes. So, to frame this in the context that this is 100 going to be done on the backs of those that can afford it is not factually correct and so its really, really hard for me during a time of this crisis and time of economic insecurity to support a fare incaoefms ultimately the decision lies with the sfmta board of directors and sfmta leadership. But i would just say that its really difficult to see how we could, in any family during this crisis, could afford a fare increase. I agree with supervisor ronan and supervisor preston that we need to look for additional sources. Im very encouraged that well have access to federal moneys and we will have to then at that point, it would be worthwhile to revisit this conversation. But at this time, i dont think this is the right time to proceed with a fare increase. So, thats why im proud to sponsor this today. Thank you. Thank you. Supervisor peskin . Thank you, mr. President. I want to say, in the beginning for a number of reasons, i struggled with this resolution. One, because i had a history dating back 13 years, 2007, and we all voted actually more recently to put the t. M. C. Tax on the ballot, which the voters embraced. But i have a history of trying to find new sources of revenue for the cashstrapped sfmta. I also wanted the incoming director of transportation to start with a success. But as has been noted, this proposal actually predates the current economic and Health Care Crisis and ultimately i agree with supervisor preston and ronan and safai and others and i have Great Respect for what supervisor mandelman is saying. He and i were involved in the Muni Working Group and identified a series of reforms all of which required money. So im very sensitive to that. But in the face of the Economic Impacts of the pandemic, i think the timing is wrong and the sfmta should reconsider. I admit that we do not print money like the United States of america does. But i think that we need to really look to other sources of revenue in the near term as ridership goes back to normal and a fare increase at this time is the wrong thing and i say that with all respect to mr. Tomlin and his i think very smart people who have absolutely prioritized equity in this proposal, but now is the wrong time. Thank you. Thank you. So i see that supervisor preston is on the roster. Before you go on, supervisor preston, i just want to pretty much echo what supervisors peskins own words that, you know, a lot of times we have to make these decisions that are never easy. Whether its myself sitting on a transit board and having to increase fares in their equitable way and in probably normal times, i would support a fare increase. Especially with all the just free muni rides that we give to our lowincome citizens or residents. But this is, as supervisor peskin said, that this is not ordinary times and i think this is not the best time to be contemplating any fare increase. I will be supportive of increases when it comes back to our regular, normal economic times. Supervisor preston, did you were you on again . I was. I took mice off because i saw other colleagues wanted to speak to the matter before i thank you very much. Supervisor walton . Thank you, president yee and supervisor preston, you have to show me how to remove my name from the check when i get on the air. I just want to say really simply put that it would be cruel and vicious to raise fares at this time. We do not understand the complete negative Economic Impacts and what that means for our residents, our communities, and even our City Department and so for us to raise fares at a time of economic uncertainty, knowing that the folks who ride muni are in the lowincome bracket and would bare the brunt of any fare increase is something that would, at the very least, be arbitrary to our values as the city and county of San Francisco. So, im 100 in support of this resolution and i hope that we all understand that during this time, raising fares would almost be equal to cruel and unusual punishment for some folks. So, supervisor preston, do you still want to speak . Ok, go ahead. [laughter] thank you, president yee. And thank you to all of my colleagues for their thoughtful comments on this resolution. I want to thank in particular supervisor mandelman and supervisor peskin with their work with the Mayors Office and the working group focused on transit reliability and muni reliability. I think regardless of where folks fall on the fare issue, i think there is strong support at the board for prioritizing muni and prioritizing muni service. I also want to thank supervisor safai for all of his work to make sure that the muni operators are getting the support they need during this time and i want to give credit also to the folks at m. T. A. Who have expanded some of the free muni programs and i think that is really a step in the right direction. Unfortunately the 10 fare increase mostly across the board is not a step in the right direction. I think it greatly outpaces inflation and is not warranted at this time. And as supervisor walton pointed out and we had a presentation from m. T. A. , in land use around the direct impact and who was impacted. Supervisor safai alluded to this as well. We are looking at 200,000 adult single ride electronic payers who would face an increase. 49 of them are people of color. The folks, you know, 55,000 lowincome riders would face an increase and also a disproportionate impact on seniors and people with disabilities. I also just, final thought want to put it into perspective, that while every Revenue Source at muni is important, we are talking about an increase that would provide revenues in the neighborhood, according to m. T. A. Estimates, of 16 million. At a point where were also budgeting for hundreds of millions of dollars from the federal government from the m. T. C. And looking at other very large Revenue Sources. While every dollar is important here, i think that we absolutely can maintain our Service Without looking at putting more fare increases on the backs of i radioers and continue collectively our advocacy for greater state and federal dollars to support our Transit System. Item 23 is an ordinance to amend the planning code to modifying the gearymasonic special use district. [echoing] and to make the appropriate findings. Ok. Number 23. Hi. Id like to make comments. Ok. I didnt see you on the roster. So, go ahead. I tried. Thank you, president yee. Colleagues, before you today is an item that ive been working on for over six years now. First as a legislative aide begining in 2014 and now for over two years as the district 2 supervisor. It is a piece of legislation with Widespread Community support, labor support because this is a project that is 100 union and institutional support, including a unanimous vote from our Planning Commission in january of this year. It will turn an empty parking lot and a dilapidated building at the old lucky penny, often known as the copper penny a site that has caused great blight in district 2 for over six years now into muchneeded housing. This special use district legislation in front of you would create 101 new homes in district 2 and would provide 4. 5 million to our city for Affordable Housing. Im doing everything i can to ensure that my district does its fair share to increase density and provide homes for families and working peopleful when the project sponsor approached me earlier this year, or last year, and asked me to make the change of the special use district that we originally future forward to pay an inland fee, i didnt just say, ok, sure, why not . It was months of reviewing financial answer potential financing before i was convinced this is the only way to move forward and to get housing at the site. I was shown that with the current market conditions, there was no path to housing without an update in the s. U. D. , the cost to construction or of construction was simply too expensive. As it stands now, the lucky penny housing will not be built in this change of may. I have been working on this project for over six years. I started during my time as a legislative aide and have continued now. We have negotiated and renegotiated. Every element of this proposal and if i felt we could get anything more and still build the project, i would be i wouldnt be asking you to vote on this special use district today. I want to be clear that the process that brought this project here was not typical. In general and i value that we make sure we do inclusionary housing on site and following our citywide inclusion nicer zoning rules when increasing density. It is why i [inaudible] 186 units of affordable Senior Housing at the 3333 california site and demanded the developer goat rid of the office for housing at that site. However, this site has a special set of circumstances that make it different. The underlying zoning itself was a planning mistake as several Planning Commissioners agreed back in january. As initially zoned, the [inaudible] would be 80 feet but only 21 units allowed. The s. U. D. Allows for 101 units of housing and density of the parcel online with what it should be at this site. The location is transitrich. It has access to the 38 geary bus where our city is investing over 300 million. The project sponsor has also committed to using union labor for project, ensuring that we will be creating jobs with their wages and benefits and were estimating over 200 jobs and we know how much they are sadly needed during this time. A long and thorough Community Outreach process brought the surrounding neighborhoods together in support of the project. Throughout the project and talking with the Planning Commission, i heard concerns that the funds raised through the s. U. D. Will not be used to build housing in the immediate vicinity. I concurred with that as i was working hard to make sure that i bring more Affordable Housing to district 2 and to the west side. So im actively working with [inaudible] for projects that are 100 affordable in my district and this funding would be a welcomed addition to making sure we create housing for people of all income levels in district two. Im working with supervisor fewer to write legislation that will hold the 4. 5 million fee in the special fund for two years while we try to identify a site. Now i want to thank supervisor fewer again and her staff for agreeing to work with me on this. Again, one of the reasons why is because district 1 and district 2 generally dont get the Affordable Housing projects that we see in other districts and we really want to try to make sure that were doing what we can on the west side to develop Affordable Housing. So, colleagues, today, given weve been through this process for six years now, the lucky penny closed in may of 2015 and it is now april of 2020, we have worked on this project for years. I ask that you help me create more homes in district 2. I ask that you help me create more jobs in district 2. And i ask for your support today. Thank you. Thank you, supervisor stefani. Supervisor fewer . Thank you, president yee. I just want to say that i really appreciate all the work that supervisor stefani has put into this project over the years. Both at the legislative aide and now as supervisor. I understand how disappointed and upset she was when she was told that the project could not build an inclusionary units on site and i trust that the project sponsor really had to work to convince her of this. I feel strongly that if these inclusion nicer units cannot be built on site, this enthe fee should be invested in the same neighborhood as the project which is on the board of district 1, 2 and 5. As such, im happy to work with her on legislation to assure these funds are used on affordial Affordable Housing in the same neighborhooding and thank you for all your hard work on this. Thank you. Supervisor preston . Thank you, president yee and thank you, supervisor stefani, for your years of work on this site. For those of us who were regulars at the lucky penny over the years, especially late at night, it was hard to see that one closed but all share in the goal of getting housing on that site and in particular Affordable Housing. I am concerned about this item. Because of the because it frees the developer from providing the Affordable Housing on site. I understand the characterization of the zoning as some sort of planning mistake. But i view it differently. I was originally zoned with restrictions on the density that would have only allowed 23 units. The up zoning that occurred to crate this special use district was explicit that the developer was getting basically quadruple the right to build quadruple the number of units and that the purpose of the upzoning and the ordinance was, and i quote, to provide for a mixed use Development Project with ground floor retail and a combination of very lowincome, lowincome, moderateincome, middleincome and market rate residential units. So, the developer was provided a significant upzoning through the creation of a special use district which was premised on the purpose being to have mixed use housing there and we desperately need Affordable Housing on site there and as both supervisors fewer and stefani have point out this is supervisor stefanis district, but at the intersection of three of our districts. To go from that from a requirement of all of this Affordable Housing being on site, to the current proposal that they can provide none of the housing on site is, from my perspective, highly problematic. I have asked and our office has reached out and requested the opportunity to see and really verify these claims that it is not feasible to provide this Affordable Housing on site. We remain open to seeing any such evidence of that. Unfortunately, we have not gotten that and there was an analysis done by oewd which made conclusions of onsite affordable and despite our requests we havent got than documentation. With so, were left in a position that this is moved of Committee Report. Here we are a day after its heard in land use and i dont feel like we have the information to determine that this kind of exception for this project is warranted. Maybe well get there. But it is really important that we have this information before we vote on this item. I will be moving to continue this item. So we can get additional [echoing] and any questions answered. Thank you. I do want to say a number of things. When i was around for not only the original vote on the s. U. D. Back in the days when mark farrell was the district 2 supervisor, but together with then supervisor jane kim was one of the architects of what is today the inclusionary housing regiment for San Francisco which, and i spoke to this in committee, which fundamentally different yates between on site, which we incentivize with a lower percentage on site, reflected here at 23 , versus off site reflected here in two tiers at 33 or 30 depending an whether it is rental or ownership housing. I also note that i started with the same skepticism that supervisor preston is expressing and actually [inaudible] took quite some time as supervisor stefani is well aware to agree to schedule the item at committee as i do my own Due Diligence and i referenced this in committee yesterday as well, by reaching out. I am concerned that supervisor preston has made a representation that the office of economic and Workforce Development is has not shared their analysis. But i do note and this was referenced yesterday in committee that the same project sponsor actually has another project at 65 ocean on the borders of district 11 and 7 where they are not trying to do off site because they actually or in lieu because they were able to show that it penciled at that site. I finally want to say and this is not the strongest argument, just given the unit size and the number of units that this is somewhat more affordable by design than the 23 ewe thinks that would have been allowed under an original nc3 zoning. So i i personally satisfied myself over a number of months of my own Due Diligence i completely respect what supervisor preston is saying. The only thing that i would normally say, lets vote for this right now, absent the one representation that supervisor preston made about oewd not making that Information Available to him and if there is a representive from oewd on the phone, id like to get to the both of that or obviouser this Conference Call or zoom call, whatever the hell were on, microsoft teams. With that, ill yield the floor, mr. President. Ok. Before i call the next speaker, supervisor stefani, were you trying to speak also . Thank you, president yee. Ill wait until everybodys done. Can somebody is that because you dont its not working. Ok. Got it. Supervisor safai . Thank you, president yee. Yes. Just wanted to add a little more information to the conversation. I, too, my initial response on this was not necessarily favorable. But as i did my own Due Diligence and because, as supervisor peskin said, there is the same project sponsor is doing a project in my district. You would imagine that they might be asking for the same thing. The two projects are similar in the sense that both are 100 union labor, walltowall. One started six years ago. One started about four years ago. But my project in district 11 is double size. But the key component that allows the project in district 11 to continue to pencil is that its in a Economic Empowerment zone created by the federal government. I allows tax breaks for investors which allows them the amount of debt it is taking on to be more affordable for the project sponsor whereas the one in supervisor stefanis district is not. That is a key difference and one of main reasons and then also the size of the project is almost double the size in district 11, can allows them almost 200 units, which allows them to use the [inaudible] program to do 25 affordable onsite whereas this one is not. So, the scale is different. The size is different. And i will say, and i think supervisor peskin will say, when we did our updated section 415 of inclusionary, we were very adamant about getting as much and creating the offsite as much as possible. Equivalent to the outer limits of what the nexus study allowed for. That does this here. Its well over 30 equivalent of onsite. I think it is 33 . So its 4. 5 million going into a fund and that is what supervisor stefani and fewer and preston have talked about in terms of where that money is generated from. So i feel confident about where this project is. I appreciate all the hard work. And i appreciate what supervisor preston is saying in the sense that we want to push as much as we can for on site and create an opportunity. But one of the things that folks will note is over a sixyear period, significant things change throughout the course and life of a project. And i think these project sponsors have come back and said if we are to continue to do this and allow us to do this, even in this crushing market in terms of uncertainty, we can move forward and make some adjustments and as supervisor peskin said, this is a onetime adjustment that i think a majority of people support for this instance to create some housing and get some Affordable Housing at the same time. Thank you. Supervisor ronan . Thank you. Thank you so much. I just had a couple of questions to the chair and supervisor stefani. What kind of evidence did the Developers Show you [coughing] excuse me, to convince you that the project would no longer be feasible if on site was required . Supervisor stefani . Thank you. Yes. I would have several financial documents put in front of me and the reason there is no oewd report is because there wasnt one. We sat down with the joint Economic Committee the joint Development Team and went through all of those pages together. Because at first when i was looking at it, it is something that i had a lot of questions about. I had a lot of pushback about. And although i dont have a document that we went over, i talked to other developer friends and was convinced that this was a project that could not be [inaudible]. Also based on what supervisor safai said, knowing what time of project theyre doing in district 11, it further affirmed my sfwoention move forward with this because i was convinced it wouldnt pencil out, and other people told me based on the numbers it wouldnt as well. Supervisor ronan . Im sorry, what . You have permission to speak. Thank you. [laughter] thank you. You said you were able to review their full proforma . Supervisor stefani . Youre muted. Yes. Thank you, president yee. Yes, i was. We looked at the analysis of the projects finances and i was convinced after speaking with people at our economic Workforce Development department that it was something that i felt comfortable with putting forward. Because when they first came to me, i said this is a problem because i agree with the pushback. I agree that we want to do inclusionary on site. It is something that i said no, im not going to do it. I literally fought them. I fought them for months. I fought labor who was calling me and said we have to get this im not [inaudible] until im convinced because i knew this was going to happen and here weve been months and months and now people are asking me the day of the vote. This is scheduled at land use on march 16. And im telling you that, based on my experience and everything that ive gone through in six years of hard work on this project, that i am confident that this should move forward as an s. U. D. Allowing thome fee out and allowing them to build 111 units on the sigh. If you dont want to take my word for it, thats fine. At the same time, im confident with the people that i spoke with outside of city hall and inside city hall that they that this is not [inaudible]. The developer was on the call yesterday at the land use and he also spoke to this. I am opposed to a continuance todayment it has just gone on too long. We have two readings for a reason. If in the time between this week and next week people want to look at their finances, that is fine with me. That would be a good thing. I know that the developer reached out to supervisor preston yesterday and did not hear back from him. I am fine to have that week period. But the project six years in the making, the more delays and the more costs and uncertainty, the more likely this project does not get funded and im going to have an empty, dilapidated parking lot and building in district 2 thats been there since 2015. So, yes, im confident in the numbers. Yes, im confident that this doesnt pencil out. Yes, im confident this is the only way we can get housing at this site and i respectfully request that you respect my experience and my work on this project to put this over the finish line, once and for all. So, i dont think anybody has made a motion to request a continuance yet. Wait. Just to be straight on the record. Supervisor ronan . Thank you. Through the chair, supervisor [inaudible], im just trying to get information to decide whether or not i should a continuance or not. Thats all and so i wanted to understand what it was that you had seen in order to make you feel confident that the project would be and feasible. Im not attacking you in any way, shape or form or thats not my intention just so you know. You know that expression trust but verify . And i am just wanting to, you know, this in certain ways sets a precedent where you create an s. U. D. For a particular project based on the statement of the developer that theyre going to provide more Affordable Housing at that site and then when you get to the final product and i understand that conditions have change sod that makes total sense to me. At the end, you want to make sure that you are getting enough novembersing feel like this is important. I dont want you to have an empty parking lot in your district, either. I want there to be housing there. But i also want to make sure theres enough Affordable Housing. Im wondering, was there a particular percentage of return that they were looking to get thats standard in the market that they thought when the s. U. D. Was first created that they would be able to get with affordable onsite and then now when conditions change that it would make that return possible . Thank you, president yee. The specifics, i do not know the exact rate of return. But like im saying, i was convinceded by what they put in front of me. That it could not be built and that the project would not be built. I can review those materials with you. Id be happy to do that over the next week. With the people that i spoke with at the office of economic and Workforce Development but i was convince and still am convinced to this day that the project will not be built in the way if theyre required to do Affordable Housing on site. So im happy to review what i had with you at that time. I dont have it in front of me right now. As i said, this is something that weve been working at for months and months and i would hope that, you know, i trust and verify. That is exactly what i did to make sure i felt comfortable putting this forward. Also, the Planning Department was not happy with it. For these reasons. But when we went to the Planning Commission and explained it, the Planning Commission had the same questions and i urge you to review their resolution and what they said. And to hear what they said in the hearing. I dont know if anyones watch it. But they were convinced, too. And the developer was there, that this was something that should go forward and could not pencil out at the rate that they were trying to. The first when we first did this back in 2016, when the s. U. D. Was introduced and approved by the Planning Commission in 2017 and then finally voted on by this board or by the board in 2018, what they were told at the time in terms of Construction Costs from the unions and you can talk to the Building Trades as well, was a much lower number than it turned out to be. And so i confirmed that with the Building Trades , i confirmed the bid that they were given was 10 higher and what i was looking at and the costs presented to me and the analysis that was then explained to me. Not just by them but went to other developer friends that ive been working with for years and i said, you know, am i being told the truth . You know, i dont want to put something forward where i have egg on my face because i value my reputation and i would not put something forward that would be a developer giveaway. Not how i operate. And that is why i spoke to our colleagues at the office of economic and Workforce Development who did not [inaudible]. So im happy to sit down with you and the reason im so passionate, as you know, supervisor ronan, is because i care deeply about my district. [inaudible] in San Francisco. I can i drive by this dilapidated building and lot all the time and i want housing there. And i want the opportunity to work with 4. 5 million and to work with supervisor fewer on bringing more Affordable Housing to my district. Im actively working with mocd on two different sites in my district that im excited about and i want to move forward. I want housing in my district. [traffic noises] and it is a very good point. This was 21 units in the beginning. That is how it was zoned. It would have been luxury housing there and to have 101 units there, really you can look a it as affordable by design and 33 [inaudible] and 23 on site which is a sizable difference. Im confident, based on everything i reviewed and i would ask that you would today, let it move forward to the second reading so that we at least have that momentum. Like i said, this process has been entirely too long. Lucky penny went out of business in 2014. We have been working on this for six years and it is exactly the reason i think we find ourselves in the housing crisis. That is not to unvalue your concerns at all. I get it. I have the same once and i want you to trust that i have verified and why i have put this forward. Im hoping that we can move forward with today and within a week of the second reading, review those financials and proceed on that second reading. That would be my request. So, supervisor peskin, i see you are on the roster twice. Did you want to speak now or later . No. Mr. President , i wanted to defer to [inaudible] on the roster that was in so far as you cannot take your name off the roster. No problem. Supervisor mar . Can i just make one more comment . Im done with my questions. I just wanted to end with a comment, if thats ok . Ok. Go ahead. Thank you so much. This is hard because i do trust you have done incredible work. I share your desire to have housing in the district. Its way beyond time to have housing at that site. And i have negotiated many projects my district where i feel like i pushed developers up to that line of what is feasible. You know, we approved the project with Robust Community benefits and i turned out they couldnt actually build it. Im very conscious of wanting to get this right so that we can get the most Community Benefits as possible while still getting a project and housing built. The reason im going to support supervisor prestons request for a oneweek continuance, and that is all i will support is one week, is because i do want the opportunity to review some of what would make it unfeasible and i will take this week, if that motion passes one way or another to do that. But i want to make clear that i do want to see housing at that site. I believe that you have used your best judgment. I want to use mine. And the fact that it was a Committee Report and were in these unusual times where i spend four hours of the day educating my child and then try to cram the rest of the work into the other four hours of work day and then after she goes to bed, another few hours before i go to sleep. Its just really hard to get everything in at this time. Of night for a Committee Report. So it feels reasonable to me to have one extra week. But i want you to know that it is not meant to degrade your judgment or your work. I also have a lot of deference for supervisors in their district. I would just like to see the financials myself and understand what made it feasible before and infeasible now and that is the only reason that i would support that continuance. Thank you. Supervisor mar. South carolina thank you, president yee. I just wanted to share my brief briefly share my thinking on this because it is an important issue. Its complicated. I think, you know, theres obviously some different perspectives on the process that weve so i wanted to start by really thanking and acknowledging and thanking supervisor stefani for all of her work on this project. For many years. And even through this discussion, you know, kind of sharing the work all work that she has done recently on vetting the sort of proposed changes to the project that the developer has put forward. And also i really appreciate the work in collaboration with supervisor fewer and sharing that if this developer will be able to see out on the project that those Affordable Housing dollars would go to the west side expanding Affordable Housing on the west side which i share that high priority with both of you. And i do share supervisor prestons and others concerns that or concerns that have been raised about the decision right now before us and i think for me, its also a concern about shifting from inclusionary housing on site and, you know, and it was the agreement was for a range of incomes, you know, which i think was really positive and needed to just being out and building hopefully market rate luxury project on that site and but i think the biggest concern i have is just, like for myself, you know, not having been able to have adequate time to do my own necessary betting and vetting and review of this in order to make this important decision and it does have the implication beyond the project itself beyond my district and district four, there is another project that was entitled and the developer said it doesnt pencil out anymore and has come back with a very different project. So thats something that i my constituents are grappling with right now just to ensure that, you know, that project, if it does move forward, we can maximize the Community Benefits, particularly around Affordable Housing for the sunset district. I would appreciate a little more time to be able to look into the details of this. But having heard all the good discussion, i do believe that having that extra week for the second vote on the board, at least would allow the time to do my Due Diligence on this. So i will be supporting this, moving forward today. Supervisors mandelman . Thank you, president yee. I will be opposing the continuance and this strikes me as a little bit odd the way this conversation is going. You know, in general, i tend to defer to the knowledge and expertise of supervisors in their district, who have gotten to know a project, figuring out what does and does not pencil out is an art, not a science. There is not a magic computer or program that will tell us what does and doesnt pencil out. And here we have a supervisor on, you know, from a part of the city that has certainly not developed that much housing. Who is trying [inaudible] to get, you know, 100 more units built on the site and free up some money for some Affordable Housing to be developed on the west side and so i am, you know, im very supportive of that effort and dont see a great reason to try and check her work. Over the next week. So, i will be opposing the continuance. Supervisor [inaudible]. Preston or peskin . Well, i see are you going back [inaudible]. This is confusing the preston peskin thing. This is for supervisor preston. Before you get started, supervisor, did you make a formal motion to continue because i missed it . No, i will now. But i wanted to make a couple of comments just in response. First off if the developer has reached out since yesterdays land use hearing that is news to me and my team. We have not received communications. And would welcome the opportunity to speak with the developer. Second of all, this is not something that we are just raising at the last second. Our Office Reached out to the sponsor a month ago to express concerns with this and find out what was so unique about this site that would warrant this legislation and did not get any information in response and have not gotten any further information since yesterdays hearing. So all the more reason a continuance would be in order. And let me just say that i would be happy to learn what the circumstances are here and thats not just that is not an effort just around this site. I think that if this board is going to allow this legislation to move forward, that it is important that we do it in a way that doesnt set precedence and what that means that were [inaudible] to things beyond just what the developer is saying as to the specifics as to why here its ok, but otherwise it isnt. And that is the message that we would be sending. I was very concerned by the i asked yesterday in land use and why this was all or nothing. Why is it that we had a project that was requireded to be 100 onsite affordable and now were being told only 0 onsite affordable is feasible. What happened to everything in between . Was that even discussed, analyzed . And the response from the developer was none of it is feasible. You know, maybe thats true. But i gotta say that i think it is incumbent upon the developer to provide more than that statement and to look at whether there may be some middle ground here and i think we get that by doing a continuance and having that conversation. So, i think were trying to find ways as a city to incentivize onsite Affordable Housing and mixeduse development. We all want units on that site from my perspective, the more we get on that site the better. But we dont want to send the opposite message that its ok to not provide on site and if we do that for this one project and the basis is there, lets take the time in the next week to make sure thats the case, to explore whether there may be some compromise with something less than 100 on site. But i ask my colleagues to support. So i move for a oneweek continuance of this item. Ok. Supervisor peskin . Thank you, mr. President. So first of all i just want to say to all of my colleagues that this is one of the better debates that i have watched this board have and hats off to all of you. I want to start out with some thoughts about the moment that we are in. Where were using Committee Reports for things that have been delayed in committee so because the Land Use Committee did not meet for a number of weeks and because this particular item required a new 10day notice, that is why i agreed to send it as a Committee Report. But everybody has had actually a lot of notice that this was on a previous calendar for a meeting that, because of covid19, didnt happen. And i thought that would have created the space for people to ask questions. But we are all painfully aware of how were being pulled in 100 different way so i understand that that did not happen. I also share the concerns about precedent that have been raised and have been very interested in honestly with facts differentiating this project from other projects so it does not create a slippery slope. The one thing that i do want to remind the sponsor of this legislation and the project sponsor for city o. Ventures i believe theyre called is that they did indicate yesterday in committee that regardless of when this board or if this board, i should say, relative to this supervisor, when this board votes for this, that the Building Permit is still being reviewed by the department of building inspections. So, i dont actually see the and i say this through the president , supervisor stefani, any harm in a oneweek continuance because in the normal course of business, this actually would not have got ton the board until april 21st and that creates that space. I also think that part of what we should be thinking about is not only how we differentiate this project from other projects, but this spronl unique in so far as because this is an s. U. D. And this was a provision in the original special use district, it comes back to the board. But there are other instances where people can go from onsite to off site or in lieu that do not come back to the board of supervisors and we should do some thinking about that and a week would not hurt. And finally id like to make one observation on the side of a piece of evidence, albeit it is not a proforma or independent thirdparty technical analysis. But when the Planning Commission that consists of individuals appointed by the board or by various board president s and refered to by the board and appointed by various mayors, unanimously and that includes the likes of people who mind the store, like commissioner catherine moore, that to me is a sign that the project sponsor and in this case the district 2 supervisor are on the right side of history. But i see and i say this to the president to supervisor stefani, no harm in waiting one week in the normal close of business, it wouldnt have gotten there until april 21 anyway. With that, mr. President , ill stop babbling. Supervisor stefani. Thank you, president yee, and thank you colleagues for your remarks on this legislation. It is very important to me that the record is clear as to how this legislation came about and i do want to thank my legislative aide who has been working with me, right hand the entire time. So, thank you, daniel, for that. And i know that he reached out to aides in district 5 and they had discussion and he answered questions. So, it was definitely to my surprise that more questions came up yesterday. Also it is my understanding that the developer did reach out through somebody yesterday to you and im only saying that because the implication that i just haphazardly put this legislation forward without answering questions is one i take i take a little bit of offense to and i just want to be clear. Why i want this to proceed today and it is basically tied up in what supervisor peskin just said, in terms of why it went out as a Committee Report in the first place. It was originally scheduled for land use in march. And had to be continued because of the pandemic we are in. Then we tried to get it on 26th but noticing wasnt in time and now we have it now, yesterday. So we agreed to have it go out as a Committee Report because of all those delays. It is my intention that we move this forward as quickly as possible and it is also my intention that i can answer all your questions within a week. Like i said, this project, six years in the making, something i care deeply about. The more delays, the more costs, the more uncertainty, the more likely this project does not get funded. These guys have to go to the debt market. Market is fluctuating on a daily basis as we know. This is exactly the kind of reason why housing never gets developed in the end. Like i said, this has two readings, it has two readings for and are. I respectfully request that this go out today. And that there is no continuance and if you have any questions during week interim, i would be happy to sit down with you and answer them. So, i just want to be able to weigh in a little bit here. So i heard the arguments here and on both sides of arguments, there is some valid points. Ive had a discussion with supervisor stefani prior to the meeting as to answering these questions. My staff has been talking to her staff about why were doing this. Ands with deference to her being her being the District Supervisor in district two, and argument that why do we need to wait another week, all weighs in to the fact that i will not be supporting a continuance. However, my [inaudible] could change if, inneed, some of my colleagues meet with stefani, supervisor stefani and unearth things that we have not discussed that i may change my vote next week. There is one issue of fact to supervisor preston that i would like to get to the bottom of. And you can tell that im weighing the equities here. And that is that supervisor stefani made representations yesterday in committee that, indeed, there had been conversations between your staff and her staff over time. And im also aware of representations from the project sponsor that they attempted to get in touch with the president to supervisor preston and supervisor preston directly, over the last 24 hours, so i just wanted to get to the bottom of that. And appreciate the words of president yee. Supervisor preston . Sure. Yeah. My aide was in touch with daniel before this matter was scheduled about a month ago to go to land use expressed our concerns specifically about allowing developers to fee out instead of inclusionary and asked for any information showing that it was not feasible or there was Something Different about this site. Daniel came by the office. They had a brief discussion and no information beyond the comments that around it not being feasible was provided to us. We followed up again a week before the Land Use Committee hearing. There were, in fact, communication but no information was provided to us. Certainly nothing that on which for us to base a determination regarding feasibility. And then im informed so, in terms of the developer with cyrus, i believe, ive not heard from the developer. I see i think one of their lobbyists may have reached out. Id have to check my inbox because i dont know if something came in this morning or last night from any lobbyists. I did not hear from the developer directly. Thank you. And i do want to say that the words that president yee invoked from that, we can have these conversations and intervene and that is precisely why two readings are forwarded to us, makes sense to me and, with that, i conclude my remarks. Ill be presenting the mission Rock Community facility district. This is a type of special District Associated with the mission rock project occurring where the giants parking lot currently exists. So briefly, just to go over what i will be discussing, ill talk about the project just as background, and then, ill go through the Financing Mechanism and the different financing structures in place. Then, i will talk specifically about the special tax district, also known as the Community Facilities district. Those words are interchangeable in this context, and then, ill talk about the next steps in the funding mechanism and the project financing. As i mentioned, this is where the giants parking lot currently is. At full buildout, it will be 2. 7 million square feet on the waterfront. Public benefits include 40 onsite Affordable Housing, first source prevailing wage. Theres a 40 local hiring requirement and training, the rehabilitation of historic pier 48, which is one of the ports historic piers. You can see is on the map to the right it on the map to the right here. Additionally, there will be sea lot level rise protection up to the year 2100, and including an additional revenue stream for Sea Level Rise protection. Lastly, there will be onsite child care available. Youll see a range in some of the Square Footage spaces because of projects that are several year out. So there are three main sources of funding. This is developer equity. This is the money that the developer puts in and the port has a chance to put in some, as well. There are two sources. Land value and different tax sources, so specifically, the c. F. D. Or Community Facilities district, and today, were forming the c. F. D. That the i. F. D. Had formed a couple of years ago. It goes into paving things like roads it goes into things like roads, parks, sewers. Everything that goes into the building is a different part of the project. Thats not this. And we want to use the c. F. D. And i. F. R. Sources to reduce the funding capital. It reduces the amount that the developer has to put in in equity. What have we done to date . Previously, the board approved the i. F. R. Funding district in february 2018. This is the other Funding Source for the project. Last fall, the board approved priorities to the tax law. [inaudible] for this phase, which is the resolution of formation, which includes board action. The mission rom c. F. D. Itself, the map is to the right, and it includes one large parcel for the 11 building sites. The pier 48 area is an annex area, and it is a future phase of the project and we will bring it into the c. F. D. When that area comes online. It includes four different taxes, and these have four different purposes. So the four taxes, the Development Tax, this is specifically for infrastructure and parks, so roads, sewers, etc. , and it has 40 years of bonding authority. The office tax is very similar, however, it has a little more flexibility, so were allowed to cover certain expenses that a Development Tax does not allow, and this is just for the infrastructure and parks. It goes on for 40 years. The shoreline is for protected shoreline and resiliency, and it goes on for 120 years. The last one is the maintenance tax, and this exists in perpetuity. So as was previously mentioned, there are six different items here. The port would request item of the first three, the resolution of formation, determining necessity debt, and calling this election today . That will allow the special election to be held on april 27. It is a vote by mail election . And then, the port would request a continuance of the last three items, the resolution declaring the results of the election, declaring the bond, and the ordinance leveeing the taxes. This cannot occur until the first occurs. The first step is to issue bonds, so were currently aiming for 2020, however, were kind of taking this day by day, and well be working with our colleagues in the Controllers Office and the department of Public Finance because the market is changing with a lot of rapid uncertainty in the coming months. Mr. Fox was a City Attorney that worked on land use issues up and down the city in the 1980s. This is a super fund site. This is a toxic waste dump. It is absolutely insane for this board to consider a special tax without using the proceeds of that special tax to cleanup the toxic soil that is at this site. I was told by susan leal that they sludged the site in order to build the park. The reason is this site is incredibly toxic, and they were told that this site would only be used for parking, perhaps a parking garage, but never be used for housing. If you look at the site plan, its a trapezoid. The green park in the corner, that is a playground. That is a toxic hot spot. What happened was during the viet nam war, this was the site of the h h surgical facility. They would take agent orange from hunters point, the merchant marine would take it up to h h, and then, it would be mixed with waste from monsanto corporation, and then, it would be disposed of. There are over 200 attorneys who made money on the way up, on the way down, and are making money on the way back up, and this is fraud, and thats what it is, a fraud. What started under michael cohen, it was gavin newsom in the 2000s you have two questions remaining. Yes, please. We have gone through extensive testing at the site with our partner, mission rock partners, and i believe dtfc issued a report, which allows a park on the lot nearest the site and housing on another area. We also have an environmental staff, including two fulltime employees, and the port is continuing to monitor the site. President yee so probably has no bearing on the vote, but this report that was issued in january, is it something available that we can look at . Certainly, and id be happy to follow up and provide that report. And i also want to mention that the special taxes can and will be used for the remediation plan, so that is something that the special taxes will go to fund, and id be happy to follow up with a dtfc report. President yee okay. Supervisor peskin, are you on this were able to recoup the tax plain from the indebtedness, where does that flow . President yee so before you answer that, supervisor peskin, if youre going to continue to question, i dont think you have your video might be on mute. Okay. Could we have the answer . Yes. Great question, supervisor peskin. The liability goes to the Community Facilities district. It does not go to the general fund at all. If there were any type of delinquency, the c. F. D. Would be able to take action against the tenant and foreclose upon the master lease as the security for that bond. But again, that does not extend to the general fund in any way. Supervisor peskin okay. The next question is while that may be true as a matter of immediate default, i would imagine that if there was an immediate default that adversely affected a city approved c. F. D. Or i. F. D. , that it would inert to the citys bond ratings generally, and that might avail the city and the bond to bail out so that it did not affect the citys bond rating as a whole. And maybe thats a question thats larger than the port that really goes to the controller or the City Attorneys office, but the port is welcome to take a crack at that. Yeah, i would definitely i can reach out to my colleagues at the office of Public Finance to discuss this at greater length, but i can tell you that this is an unrated bond, so it is not a general Obligation Bond in any way. If there were to default in any way, it would not extend to the citys general fund or general Obligation Bond rating . However, i would seek help m the office of Public Finance for additional oversight. Supervisor peskin is there a representative from the Controllers Office who would like to comment . I know this was a concern about the controller, ben rosenfield, that he had in the past, and when he got over it, i got over it until we had covid19. April property taxes are getting delayed, all sorts of things are getting delayed. That could depend on how wall street wants to behave, so is mr. Rosenfield in this meeting, on this meeting . I am. Supervisor peskin, through the president , i think youre correct, supervisor peskin, in the line of questioning here, and its a line of questioning weve gone through with the port. As a matter of law, the debt here being issued has no impact to the city. Weve gone through our Due Diligence with the port so we think the likelihood of default is remote, so while its without any risk, i think were comfortable with it at this point. Supervisor peskin okay. And the City Attorney agrees theres no recourse as a matter of law to the general fund of San Francisco, madam deputy City Attorney through the president . Im sorry. Its an emergency ordinance to require the city to limit covid19 impacts by securing rooms through Service Agreements with hotels and motels for use as temporary quarantine use. This item suspends charter section 9. 118, the process to obtain Service Agreements for private rooms. This item requires daily reporting to the board of supervisors and requires congregate care facilities for the homeless to comply with social distancing practices and screening protocols. This item, pursuant to charter section 2. 107, that charter section authorizes emergency ordinances to secure final passage with only one reading with the affirmative vote of twothirds of the entire board of supervisors, which is eight votes, for passage. President yee okay. Supervisor ronen . Supervisor ronen yes, thank you so much, president yee. Colleagues, i wanted to start off by explaining just a little bit about the history of how we got here, because i think that that lack of understanding and knowledge has caused at least one of our colleagues to think that this is an effort of political postures, and that could not be further from the truth, and i want to explain what got us to this point of bringing this ordinance to the board of supervisors on this issue that hopefully and unfortunately the mayor we wouldnt need to be here today. And the reason im starting like this is because we are in the worst crisis weve ever seen. Probably will be the worst crisis during our time as members of the board of supervisors, and of course when we are in a crisis, it is so important to have a united front, to speak with one voice, and to have each others back. And i think that, for the most part, that we have done this. That we have gotten remarkable results from the city, going early and very clearly saying, that based on science and facts, we need to shelter in place, we need to go to remarkable, neverthoughtbefore steps of closing down our city, sheltering in place, basically stopping our local economy, and those were hard decisions. And weve stuck together hand in hand as weve done that, and weve all worked extremely hard to deal with the consequences and protect the most Vulnerable People because of it. I, from the getgo, and my colleagues that are cosponsoring this item with me, have not agreed with the mayor and the Mayors Offices handling of this crisis. A month ago, at a board of supervisors, it started out with my colleague, matt haney, had a pretty intense debate with trent rhorer of the head of Human Services agency asked him how it made sense for large congregate living situations for people that are unhoused when we are telling us those of us that are blessed with a large home, that we shouldnt be in large settings, that we shouldnt see our closest friends and family, that we should shelter in place with our own immediate family and nothing else. And mr. Rhorer a month ago said he is following the advice of medical professionals. And then, later in that meeting, our chief medical officer, tomas aragon said that that was not the safest population, and what we should be is getting individual hotel rooms so the unhoused population can do what were all doing, which is shelter in place and keep our community safe. The five of us, supervisors walton, haney, preston, peskin, and i, quickly got together, and for a good month, negotiated behind the scenes. We made very few public statements. We were pushing almost daily, trent rhorer, the mayor herself, dr. Grant colfax, we were on the phone daily, saying this makes no sense. People are going to die unless we get people in hotels. During that period of time, supervisors peskin im sorry preston and haney, while advocating for the large community, by themselves, raised money, and fitted out shelters during that time. During that time, the mayor and her cronies created Moscone Center medical west. Behind the scenes, we begged them please dont do that. Behind the scenes, we were speaking with medical experts trying to get them to not do that. What broke the camels back with me, if i am not doing my job as a supervisor, i am not respecting our different branchs of government where different branchs of government disagree with one another. Thats why we have separation of powers. Its worked well for our democracy for a long time, its time for me in a moment of crisis to come forward and express in public my disagreement. That happened the day that i was called early in the morning and was told that someone tested positive in Division Circle navigation center. Now if youve been to Division Circle navigation center, you know how close people sleep to one another. You know how impossible it is to ensure social distancing in that facility. So immediately, i was on my game. We will move people that are 60 or older or that have comorbidity or Underlying Health conditions. What is the plan . And they told me nope, all theyre going to do is move the individuals that slept immediately around the individual that tested positive. And i lost it. I said, these peoples lives matter matt matter, just as much as my life matters, just as much as your life matters. These are seniors and people are serious medical conditions. They have clearly been exposed to an individual, and you will still not move it. Thats it. Im going public, i can no longer stay silent, and so we held a press conference, and sure enough, a few days later, 70 people tested positive at m. S. C. Yesterday, it was 92. Its going up, and the city is still planning mass congregate shelters. They have moved, thankfully, about 753 people from shelters into hotel rooms. I am so grateful, i am so happy that happened. Thank goodness, but we have approximately 5600 people that are living on the streets and in shelters that could care for themselves. And the fact that we have not had the urgency, or our Planning Facilities havent been planning for it for months, i believe it wrong from every which way you look at it. Its wrong from whats healthy, what makes sense medically, and its wrong from a fiscal perspective. Its a lot cheaper, especially given that fema and the state will, for many, many people, will reimburse this vast amount of cost of the hotel rooms. Its wrong from a fiscal, conservative perspective because the amount its going to cost on a respirator in a hospital room is going to be that much greater, and the cost of having that much people out covid19 is wrong. I disagree because i dont see things the same way that the Mayors Office, and i believe it is my job to speak up. I was elected to serve my constituents, and i have a lot of homeless constituents in my neighborhood, and i simply do not agree with the mayor that they cant take care of themselves, that they dont want help, and it doesnt make physical sense to put them in hotel rooms. And i can tell you that i disagree with them because they can take care of themselves. Im going to end, and then, im happy to talk about the details of the ordinance, how we came to 8,250, any of those detailed questions, but i just want to end to say, we have turned our city upside down. Some businesses might not ever come back, but i can say we did the right thing, but saving lives means more. We can build the businesses back again, but saving lives means more. We have not made it a fiscal priority that we want to save those lives just as much as we want to save our own. And we want to make it clear, not with just as a resolution, like we did last week, but a law with a firm date that were going to get every homeless person off the street, doubled up in s. R. O. S or coming out of hospital, and we need to get that done, and we need to get it done now. So with that, colleagues, i would ask that you would support this ordinance today. Thank you. President yee thank you, supervisor ronen. Supervisor mandelman . Supervisor mandelman thank you, president yee. I have what i hope will be a noncontroversial amendment. It deals with the reporting requirements that are in section 3. One paragraph, im going to id like to move that we amend that paragraph so that after the parenthetical, i. E. Hospital [inaudible] supervisor mandelman for all members of the three vulnerable populations that are currently occupying city provided. President yee okay. So supervisor haney . Supervisor haney thank you, president yee. I want to thank all coauthors of this measure. I wont say too much because i think supervisor ronen has covered most of it, and most of it was covered in Budget Committee yesterday, as well. One thing i will just want to underscore is when we when the mayor and the Public Health officer issued the order to declare an emergency in San Francisco and order everyone to shelter in place and stay at home, that was absolutely the right thing to do. It is intended and intending to protect people in our city, and it is saving lives, but it very explicitly left out home that are homeless. It says that everyone has to shelter in place and stay home, except for people that are homeless, and i think that is a dangerous and reckless thing to do with the start. We are learning just how reckless that was. We had just in my district, in a single shelter, people who have contracted the virus, both guests and staff. Its the biggest outbreak in a shelter in the country was here in San Francisco, so this is absolutely that something, when we think about sheltering in place and staying home, we have to think about everyone. And for the last month, weve been trying everything we can to partner, to urge, to pass resolutions, and frankly, it has not happened quick enough, and the result is over 100 people in one shelter, and countless more that we didnt know about. And we have tried to do this through partnership, but legislation is absolutely required. This is a way that we as a board, as a legislative body, can make this a requirement, can make it law, can ensure that theres a budget for it, and to make it clear what people in this city are demanding right now. If we are successful in San Francisco with everyone who was housed and no one who is unhoused, we are putting people in danger. I know theres direction from the mayor, but its not clear enough, its not fast enough. It doesnt have a timeline, and its not daily reporting. I represent a district that has at least half of the people that are homeless in our city, and if they are put in danger, if they contract the virus or and spread it to others, that will put the Public Health of the entire city at risk. So i think its absolutely essential that the board of supervisors is on record here, that we are absolutely clear to the mayor where we stand and the expectations of what gets done. We know this can get done. It can get done quicker, and i think if we pass this legislation, it will get done quicker, and it will save lives. This legislation will absolutely save lives. And the budget analyst put out a report on this, that up to 93 of the cost of this could be reimbursable. So we as a city shouldnt be punished for doing the right thing if we get people into their own rooms and allow them to stay at home and protect themselves and others. So again, i want to thank not just the supervisors but all of the shelter providers, all of the advocates, everyone weve got more weve gotten hundreds of emails and calls about this. Thank you to everyone who has talked to us about this. I heard from the shelter directors about this, saying that the shelters were not safe, and people needed to be in hotels, and people were not safe. So i want to thank them for telling the truth and speaking out about this. And everybody who works at shelters and Navigation Centers and with the homeless, who are putting themselves at risk, and some of who are contracting the virus, thank you for speaking out, and i hope we can stand united and pass this legislation today. And lastly, thank you to our legislative aides who have worked so hard on this, countless hours for bringing this forward. Thank you so much for your work. President yee thank you. Supervisor preston . Supervisor preston thank you, president yee, and thank you to my colleagues who have spoken on this, and thank you, supervisor ronen for your clarity and leadership, and supervisor haney, as well. Weve been working literally every day, supervisors ronen, haney, peskin, and myself, to work better legislation for those that are unhoused, and i appreciate their effort. Also appreciate president yee, chair fewer, and all of those involved in making sure that this could be heard so quickly. The legislative body can be a challenge to act as quickly. We dont have the power like the mayor and the Health Officer to issue directives sameday directives during a crisis, but i think that this measure shows that when we need to, we can act quickly, and i appreciate president yee allowing that to move forward in this way. I want to specifically recognize the coalition on homelessness. The street sheet, the unknown topographer, whoever you are, that took the photo at moscone, to the d. S. A. , democratic socialists of america, and those who are unhoused who have shared their stories over the past couple of weeks. Im proud to be sharing this legislation. As supervisor haney said, it will save lives, making progress. I believe, were it not for the advocacy by the faith community, by the Homeless Service providers, and by Homeless People themselves, that we would be even further behind as a city addressing this crisis than we are. I share with my colleagues and you, in retroexpect, i do wish we had advanced this legislation far soon retrospect, i do wish that we had advanced this legislation far sooner. We started sounding the alarm, along with folks in Homeless Service providers and unhoused folks, that congregate living was a crack in our otherwise solid covid19 strategy. I think we underestimated the strength and the depth of the judgments, the stereotypes, and the unfair bias that many hold against our unhoused residents. I think efforts to work with the administration to change policies did not happen fast enough, and people are now suffering because of the response. I want to Say Something to our unhoused residents, i am sorry, deeply sorry, that after weeks of warning, that only the actual confirmed outbreaks in your shelter spurred the city to move, and to move faster. We need to do better, all of us, and theres no excuse for you having to wait an extra month to be able to follow your citys shelter in place order. I believe this legislation will move our city forward toward housing those in most need right now, and itll force our departments to move faster. San francisco can do Amazing Things when we want to, and i think we need to show unhoused residents that we can and will do everything necessary to protect them and everyone elses health by moving forward with a robust plan to house the unhoused in hotels during this crisis. Thank you. President yee thank you. Supervisor walton . Supervisor walton thank you, president yee. I wont theres nothing i can say that hasnt been said from my colleagues, so i will be brief in any comments, but i want to reiterate that this is literally about life and death. The fact that this advice comes from medical advice, from providers, and not just the common sense that we see from members of the board of supervisors, we do have to follow a shelter in place order that was made by our chief medical officer that also includes the intent for individuals to selfisolate as much as possible to prevent infection from the virus. Our Homeless Population that lives in congregate settings, life shelters, s. R. O. S, and encampments, we need to remove the population from them and get them into hotel rooms so that they can safely shelter in place like the rest of us. From a cost perspective, i want to reiterate that we have Resources Available to us from the federal government and possibly from the state. In addition, we know theres a possibility that we can be reimbursed up to 90plus percy of the resources that we spend on hotels. Not a given, but a possibility, and a likely possibility that we get reimbursed for the majority of our expenses. We cannot afford for the virus to spread like we saw at our largest shelter from 2 to 70 in a number of days. Every day, i walk by, drive by, and even jog by the second highest number of Homeless People in San Francisco, and they do not want to be on the streets, and they do not want to be in congregate settings, so we have to and we will do better. We are working to make sure that deaths and infection dont disproportionately affect our Homeless Populations, our people of color, and our communities where we typically suffer from the most isolation and disproportionate negative effects. Sheltering in place has to be allowed for everyone, especially for our most vulnerable population, which includes our unhoused population. We must support this legislation and get our community into hotel rooms and safely off the streets and out of congregate settings. This legislation is responsible and in line with the shelter in place order of our chief medical officer and city leadership. President yee thank you. Supervisor stefani . Supervisor stefani thank you, president yee. I would just like to simply second supervisor mandelmans motion. President yee supervisor peskin . Supervisor peskin thank you, press yident yee, and let just say to everybody, from the administration to my colleagues who im very, very proud of, to our city workers, whether theyre d. S. W. Workers at the e. O. C. Or sheltering in place to our frontline responders, whether they are working at Grocery Stores or nurses or firefighters or police officers, were all in this together, and i think that were all trying our best. As you heard earlier, some issues over bond indebtedness, i care profoundly and i dont want to put words in her mouth does the chair of our budget and finance committee, supervisor fewer. But the name of the game and this is not a game is to decongest our emergency rooms, our ventilators, our i. C. U. Units. And the great thing about our medical profession is if somebody gets shot, they end up in our hospitals. If somebody has covid19, they end up in our hospital or hospitals. And where we are failing, not for lack of desire, is in a population that has been vulnerable and shunted to the side for many, many years. We are all a part of that societial problem. But right now because of the availability of hotel rooms that are fundamentally vacant because there is no tourism in the city or this country or this planet, those hotel rooms are available to us. While i share concerns about finance and i will do this during roll call introductions, as was said earlier, a resolution is now being turned into an ordinance, and i would like to put financial teeth behind that ordinance and will be introducing a supplemental appropriation at the appropriate time. I really want to thank my four colleagues and their staff who have been a part of what i was blamed for being a member of the gang of five, but i think history will prove us right, sadly, and this is no time for saying we told you so. The last few days have clearly shown that if we want to save money, the best way to save money is to invest in this now. And mr. President , i really want to thank you, and id like to thank the chair of the Budget Committee for allowing this to go forward in record time because the chief Health Officer can act with the significant of a pen. Its a little more difficult because we have to draft documents. Same goes for our City Attorney of the city and county of San Francisco. But we are on the right side of history, and the rest, i will listen to my colleagues about. But i would rather invest in this in the front end than pay for it on the back end. And given the fact that as much as 93 can be reimbursed by federal and state authorities, i think this is the way to go. President yee thank you. Supervisor fewer . Supervisor fewer thank you, president yee. Colleagues, thank you for all of your patience in a crunch meeting yesterday that didnt allow any extra time for discussion as in order to hold a meeting in between two other committee meetings, we had to commit to completing our business in no more than one hour. I moved this without recommendation because i knew it was important to the sponsors to have this in front of the full board today but was concerned with such a short timeline, members may not have had the opportunity to fully review the legislation or ask questions of departments before voting. I agreed to hold that special Budget Committee, though the timeline was tight, because i do believe that procuring hotel rooms in the thousands to prevent unhoused residents from becoming ill and to prevent the preventible death of those who we know are vulnerable to covid19 is a priority. I also understand the frustration of Community Advocates who are fighting for and caring for Homeless People, s. R. O. Residents, unhoused people being released from jail, and those in shelters and Residential Care facilities. So many of our individuals and households have been struggling for so long and now are at great risk of experiencing major Health Impacts related to covid19. As a former community organizer, i understand the community pushing the city to be better, faster and address gaps in the response. Yesterday, i spoke with my hope that the city could be unified in our response to this crisis, and that is still true. For the past week, i have been at the Emergency Operations center, as has my whole office, and i understand better now how the city is coordinating its response to covid19 and i have deep appreciation for the tireless work that is being done by City Department staff. Has everything gone perfectly . Of course not, and truthfully, from the local to the National Level and beyond, this crisis has shown how unprepared our systems were to respond to a pandemic. I also want to acknowledge that i feel a great responsibility as budget chair to ballet necessary investment in Public Health measures and support for our most vulnerable communities to meet the basic needs with the fact that San Francisco is facing a significant deficit over the next two years. I am worried about the cuts to Critical Services and city staff that we could be seeing on the back end of this crisis, and that is not to say that we shouldnt be deciding to make critical investments, but that as much as possible, i want them to be informed and be informed and careful decisions. As the b. L. A. Has estimated the cost of the hotels to be 58 million a month, it is conf imperative that we seek reimbursement where we can. I appreciate the goal of protecting our most vulnerable residents to stop the spread of covid19. I appreciate all of the hard work everyone has been doing, including our d. S. W. Workers and other first line workers to address this unprecedented crisis, and i want to thank them. President yee thank you, supervisor fewer. So colleagues, you know, i really want to thank my colleagues for bringing this discussion forward in response to covid19. This is what it should be. The city must continue to act with urgency to acquire the thousands of Additional Hotel rooms, including shelter for people experiencing homelessness, living in congregate settings, frontline workers and First Responders and people discharged from hospitals who require a place to quarantine safely. This is about Public Health. This is about ensuring that every san franciscan has a safe place to shelter in place and can quarantine if needed. Our Public Health depends on this, as several of my colleagues have already spoken about. This pandemic has further reviewed the inequities that exist in San Francisco. We are now being called to address those disparities with more urgency than ever before, facing needs like food, shelter, and access to sanitary facilities are not luxuries. In the midst of this pandemic, meeting these needs are critical in stopping the spread of covid19 and saving lives. The massive effort to acquire thousands of hotel rooms has moved at a slower pace than we all would have liked. As of sunday, theres been 2,000 contracted rooms, in which they activated about 1750. As mentioned already, 1789 individuals that were homeless have been moved into hotel rooms. What i think its important for the public to understand and all of us to understand that no one involved in the citys response to covid19 wants to see this process delayed. And caring for our most vulnerable residents is everyones shared priority. The timeline for acquiring these rooms [inaudible] president yee we have a responsibility to make sure that we understand these difficulties, and that we understand the level of care that our city must take to ensure that this is done safely. You know, i just want to give some sense to all this, and not to make any excuses for how weve been getting these hotel rooms acquired quicker, but in getting these rooms and getting them ready, they have pretty much, like, three phases to it, and that includes a site acquisition, a Site Planning, and a site management. And im realized more and more, like, theres a lot of departments involved. For instance, the site acquisition piece of it includes h. S. A. , the Real Estate Department the City Attorneys office, the San Francisco police department, and the San Francisco fire department. Excuse me. Im sorry. And the Site Planning itself includes h. S. A. , department of Public Health, department of Human Resources, and m. T. A. I do share in the frustration that this has been slow moving, but i want to make sure that we all understand theres a lot involved, and that i being at the e. O. C. , ive seen what it takes to, from peop from get these in line. Im glad that the administration is actually moving in that direction before this legislation passes. Hopefully this legislation will speed up the process as much as possible, so ill be supporting the legislation today. So supervisor peskin, did you already speak or did you want to speak again . Supervisor peskin i do want to speak again, mr. President. President yee okay. Go ahead. Supervisor peskin i really appreciate the way that youre approaching it and the way, as you said, that youre allowing this piece of legislation to go forward. I also want to say that the information that you just shared with this board and with the public who are watching this Board Meeting is not information that has been widely shared, and i understand that youre getting this information both by virtue of the fact that youre president of the board of supervisors and your stint at the Emergency Operations center, and also later during roll call, but i think transparency is remarkably important. So as you recite the numbers of how many individuals from different populations are being dealt with in different ways, that is information that people of our city should have access to. The 11 members of this board and the City Attorney actually has information that has not been released to the public. But that notwithstanding, everything you just explained about the time frames of negotiating, indemnity provisions, and negotiating up fro front, i thought it was very important to put that on the record. Look, as i said earlier, we are all trying, we are doing our best. I think its very important that were having this conversation. I am delighted that you are going to vote for it. I think that we all should vote for it. However, i would like to delve down into the questions that supervisor mandelman made and supervisor stefani questioned. So through the president to supervisor mandelman, if you could reiterate the section and the provision which sounded like it was as long as the city had that information. And before you do that, i would like to note that the city has information that theyre not releasing to 11 Decision Makers positi for the public. Supervisor mandelman it is section 3f, paragraph five, and the and the amendment would add the additional language to the extent such data is available to the city after the parenthetical, you know, description of hospitalization, navigation, jail, encampment, parentheses, comma. It would say, to the extent such data is available to the city, comma. Supervisor peskin and this may sound inappropriate through the president , supervisor mandelman, as i said earlier, this seems absolutely benign, and i am now looking at the section. What is the motivation for this amendment . Supervisor mandelman i believe that the that the departments who are sort of who are going to be tasked with reporting this are believing that they can do most of it, but they are concerned about paragraph five, and it came back to me, and i am comfortable with proposing this. Supervisor peskin and through the president to supervisor mandelman, those departments are which departments, and if those departments are on this phone, if they can explain that to this board of supervisors, id be interested in the answers. Supervisor mandelman i think it is coming from h. S. H. And h. S. A. , but i also believe that sophia kitler is on the line and would best be the person to answer that. Yes, thank you, supervisor peskin. So the process by which we collect a lot of the Demographic Data is not collected on the intake form, and particularly when we have individuals moving from private hospitals where they may not have collected the Demographic Data and theyre moving into our collective hospitals, rather, we need to send out a case manager after the fact to do a survey, which we are very happy to do. We will use every effort to collect this data, and this is why we use our initial suggestion, i think, was available. In some instances, we are finding that it takes us a few days to find this information, but we will publish it immediately when it becomes available, but it is not something that is collected on intake. Supervisor peskin thank you. And through president yee to miss kitler, that you, by and through departments to the mayor, have asked that this amendment be made. Is that an indication that, subject to this amendment, the chief executive officer of the city and county of San Francisco has no objection to the instrument if its amended . In other words, if we make this amendment, the mayor of the city and county of San Francisco is okay with this ordinance . We are going to make our best efforts to comply. We want to bring everyone into housing, and as far as the repo reporting standards and the outreach standards, we will get right on that before the enactment. As to the specific numbers and the specific population, we are going to work as quickly as we can to bring everybody indoors. Supervisor peskin so mr. President , this will be my last comment. I want to say for the record that trent with trent rhorer and Brent Michaels and other individuals, i was at the ground floor in the overall ways that the city would procure hotel rooms. This is long before the public and now private commandeering advice was available to any of us. The public representations about the rate that those hotel rooms would be acquired have consistently not been met, so i continue to be troubled by this. I do appreciate the fact that the public representations about the number that we are attempting to acquire are increasing. And i realize that everybody is doing their best, but the actual numbers have been halting if not embarrassing. It only takes a few days to negotiate an indemnity provision. And lets be clear, that all of these hotels are vacant. Their value in todays market is zero, or less than zero, so im happy to vote for this amendment. I appreciate the comments of the boards liaison the mayors liaison to the board of supervisors. It is time to step up our game, and with that, i conclude my comments. President yee okay. Youve gotten a memo stating that, and ive just received this other memo that was put out yesterday. Item 28 is an ordinance amending the planning code and zoning map to create the bayview industrial triangle cannabis restricted use district arming the Planning Departments determination under ceqa and to make the appropriate findings. These two ordinances seeking passage today from land use are in recognition of the bay area industrial triangle redevelopment plan which was first adopted on july 1, 1980 and will it have and will expire on june 30 of this year. This is a very, very small piece of land area in bayview. The first ordinance would amend the zoning map in industrial triangle from primarily m1 and m2 parcels, preserving p. D. R. And still allowing for uses like Grocery Stores, theaters, recreation centers, and a district that is proposing to build over 17,000 homes with large percentage of Affordable Housing. The second ordinance would apply a restricted use district to the bayview industrial triangle, prohibiting Cannabis Retail establishments in the project area, which is less than five blocks, and a very small sliver of bayview with several permits and retail permits and options within walking distance. And i also would like to add it does not prohibit any other marijuana uses such as manufacturing, distribution, or cultivation. The purpose of this proposed rezoning is to stablize the existing businesses in bayview industrial triangle and, as a result, stablize the surrounding community. And with that, i will pass this back to you, president yee. President yee okay. Thank you. Supervisor mandelman . Clerk item 29 is an emergency ordinance to temporarily require private employers with 500 or more ply employees to provide Public Health emergency leave during the Public Health emergency related to covid19. Charter section 2. 107, requires one reading with the affirmative vote of twothirds of the board of supervisors. President yee all right. Supervisor mar . Supervisor mar i want to make something very clear about the law we passed last week. Public Health Emergency leave is not sick leave, and it is not an expansion of our paid sick leave ordinance. This is the creation of an entirely new public leave. You do not have to be sick to use it. You can use Public Health emergency leave if youre not sick but cayou are part of a vl neshl population or cari vulnerable population or you are providing care to a loved one. In the amended emergency ordinance today expands this leave to Health Care Providers, but the uses are significantly narrower. This represents a careful balance between protecting Frontline Health care workers and ensure we do not risk staffing shortages during a Public Health emergency. The legislative process has been quick and complex, but the goal here is simple. Our doctors, nurses, and Health Care Providers are working on t the frontlines in the midst of a pandemic, and this is to ensure that these workers dont have to go to work if they are sick. These workers are taking care of them when we are sick, and when they need it the most, we need to take care of them. I will be proposing additional, nonsubstantive amendments to Health Care Workers while maintaining we can provide adequate staffing of our workforce. So colleagues, you should have received copies of these additional nonsubstantive amendments with changes tracked, and id like to talk through them briefly for clarity. First, were amending the definition of employee to remove the requirement of minimum hours worked to eligible for leave. And to define that workers are assumed to be employees. Secondly, in section 4a, were clarifying the number of hours of leave an employee is eligible for by including the amount in the legislation directly rather than citing the federal legislation. And thirdly, in section 5b, we are further narrowing the eligible uses for Health Care Providers to address the concerns of their employers when maintaining staffing levels. So Health Care Providers will be able to use Public Health emergency leave if they are experiencing symptoms associated with covid19 and do not need c. D. C. Guidance to return to work for Health Care Personnel with suspected covid19 or if their Health Care Provider has advised them to selfquarantine, and we have narrowed the definition of which health care advisers are able to give this advice. Finally, in part c, weve clare identified the definition for parttime workers so theyll be paid for the typical number of hours they work per week. Finally, id like to thank everyone we worked with on this ordinance, including the San Francisco hospital counsel, kaiser permanente, jobs with justice, the california workforce and Labor Development agency, the San Francisco department of Public Health, deputy City Attorney lisa powell, sophia kitler in mayor breeds office, and my legislative aide, edward wright. President. I just want to say a true great deal of gratitude for supervisor mars leadership on this issue. We did a similar thing on the city side all in the vein of ensuring that city workers would have access to the appropriate amount of leave during this time of crisis. I think people shouldnt be using this opportunity to let go of staff or forcing staff to work under these conditions. These go hand in hand, and i just wanted to say that this is timely and necessary and im happy that this is moving forward in an aggressive m manner, and im happy to be a cosponsor of this legislation, if thats not already been made clear. This is a time for us to come together to raise awareness of every child that might be in danger of abuse and neglect in our community and protect those most vulnerable in San Francisco. As we are working through and dealing with shelter in place, many of the children that would normally get services and have care and have access to oversight from other adults in their home setting, that has been taken away from them. There is a lot of high stress right now. Supervisor stefani referred to that in terms of domestic violence, but people are losing their jobs, theyre losing their wages, and all of this is putting tremendous social and mental challenging social and mental environments, and resources that we have to cope with this need to be increased, especially for Young Children that are trapped in environments that are their abusers. So in the last three weeks, Child Protective Services have had a decrease in their calls by 300 . With after school and other safe spaces closed, children dont have a refuge to them available right now. Im introducing an ordinance encouraging San Francisco to take strong action and adopt policies to protect children during our covid19. Yesterday, Governor Newsom announced a 42 Million Investment to protect our most Vulnerable Children that are experiencing abuse, and so im calling on all of our leaders of this industry, as we have with so many other areas, whether its undocumented families, whether its the unemployed, whether its seniors, whether its the homeless, to raise the need of Young Children that are in abusive environments, and we need to do more. So im grateful for the organizations and agencies like safe and sound who work proactively to create situations of support, but we need to do more in this time in how we help children. I dont want to emerge from this crisis and discover that neglect and abuse rose exponentially, and many children were left, and there was irreparable damage and loss of life. So were calling for more support and 24hour hotlines. Were providing Online Support in different languages for caregivers, allocating service during shelter in place and provide respite care for caregivers experiencing severe stress and continued funding for Family Resource centers. I want to thank joan miller from the Human Resources agency, sonia melara from family visitation services, and Jennie Miller from safe and sound for your voices and your suggestions on how to best support our children. I also want to thank monica chinchilla on my staff, and happy to see Governor Newsom making the announcement yesterday before mine today. I know many of you have children, either younger or fully grown, and i know this will touch home. I look forward to working with other members of the community and our city leadership to put this vision into reality as quickly as possible for our children. The next thing i wanted to highlight is, again, we have many frontline essential workers in the private sector that dont necessarily have the same level of oversight and support and encouragement that we have. Were working very hard with our janitorial sector and Grocery Store workers and Health Care Workers. And i want to thank the companies that are continuing to pay their staff, that are continued to keep their staff on kind of measured furloughs, to remember the people on the frontlines that are essential to keeping our buildings, our society, and our businesses open, and to protect them, to encourage them, and continue to pay them. It was announced over the weekend that the Walt Disney Corporation found a way to pay for an entire year of health care for 43,000 workers in disney. So as one of the wealthiest cities in the United States, with some of the wealthiest companies and corporations, it really is disheartening to hear stories of Companies Finding ways to layoff and cut and undermine the efforts of workers. She also loved attending services at Cornerstone Mission Baptist Church and listening to the sermons by her pastor, kenneth reese. Speaker pelosi and the House Democrats have been pushing for a more robust interim package of no less than 250 billion and more in aid to Small Businesses, specifically targeting and supporting smaller businesses, particularly those in rural areas that are owned by women or people of color who have struggled to receive loans through the payment protective program that was previously rolled out. And now, Speaker Pelosi has excluded asking the republicans to expand p. P. B. For education and Higher Learning institutions. Many smaller rgs organizations are norganizations smaller organizations are not able to qualify, so theyre asking for more support. We know that such agencies are struggling while the federal Business Administration rolled out their 349 billion program last friday to provide emergency loans to american Small Businesses devastated by the coronavirus. It has been chaotic and many have not received approvals. We are hearing many Small Business owners rejected by lenders refusing to participate in the program. As a city, i commend us for stepping up to provide local grants and loans, but we need more federal support so that those impacted are able to receive the relief they need through this crisis. Small businesses are the backbone of our economy, and so much of our workforce depend on these often family owned businesses for their livelihoods. We are echoing the calls for support. I am hearing from volunteers in the industry asking for help in filling out applications in chinese or spanish because theres no applications available. I want to commend our office of workforce and development, assessor recorder chu, and those trying to advocate for stronger protections and investments. Yesterday, the Small Business Commission Also voted on a set of comprehensive recommendations which we would like to concur with, particularly in providing more targeted equitable distribution in support for businesses and organizations historically and systematically challenged with accessing capital. Today, im introducing legislation that will require the city to close county jail number four within six months and a deadline for reduction of the jail population in order to safely close the jail while preventing transfers out of county like santa reeta jail. County jail four number is a dilapidated inhumane facility jail. Its plumbing, sewage, kitchen, and laundry facilities are all in disrepair. If the department of public works, department of real estate, and independent seismic engineers have determined that the hall of Justice Building needs to be decommissioned due to health and safety concerns, including health and safety concerns at the jail. This will set us on a path to closing county jail number four ahead of hall of justice, developing a plan to reduce the population, and close the jail is absolutely the responsible thing to do for both incarcerated people and the deputy sheriffs and jail Health Employees that work there. Thank you to everyone who has worked closely with my office on giving feedback to this legislation, including the close the jail coalition, the deputy sheriffs association, District Attorney chesa boudin, and others, and thank you to cosponsors peskin, mar, haney, ronen, and preston. I know we all recognize the incredible hard work that our staff continues to do during this pandemic, and i send a big thanks to all of those who provide services, and those who have been at the forefront of this health crisis. In particular, the nonprofit staff and the homelessness response system serve vulnerable families and individuals on the street and countless other individuals. Their work is vital to the safety of our homeless neighbors, housed neighbors, and our community. Even in the midst of this crisis, they have been asked to continue their work tasks, sometimes with little to no protective equipment, a lack of guarantees free testing or basic testing protocols in their workplace. Many are reporting to work sites, knowing that they will not be able to keep social distance due to the nature of their work, putting their own lives at risk. On top of that, some of these workers earn competitive wages. Not all of these workers earn competitive wages, and the vast majority earn between 16. 50 and 20 an hour, well below the median wage. As we already know, there are 20 cases of shelter staff testing positive for covid19, and more than 80 cases of homeless guests of shelters and Navigation Centers. We know how quickly the virus can spread in congregate settings, and its a threat of safety to staff and to all of us. We have not tested every Single Person who works at or sleeps in a shelter or s. R. O. Where we know that there have been positive cases, and for the staff that work in these sites, they have been no reported positives who work in sites where they have no reported positives yet, there have been no testing. Today, im introducing a resolution calling for free testing for all onsite staff in our homelessness response system and testing for all the clients the city is serving. Its absolutely critical, and the resolution also calls for intensive pay for frontline staff that provide Homeless Services but that are not covered by a city contract. We want i want to thank the union representatives, seiu 1021, and the nonprofit workers and staff who have collaborated with us during this resolution. I look forward to having a conversation at the Budget Committee on how we can fairly compensate our workers. I also want to thank budget chair fewer and her staff and having this go to the Budget Committee for a full hearing to discuss some of the budget invocations. Im also introducing an emergency ordinance relating to bathroom access and hand washing station access. We are in the middle of a pandemic, and of course a huge part of how we prevent the spread of the virus is by having everybody stay home when they can. But social distancing is only a part of the overall response. Experts agree that hand washing and social distancing are critical in battling the virus, but for the homeless, ride share workers, taxi drivers who do not have access to bathrooms, this can be very challenging. The centers for Disease Control and prevention have found that covid19 is found in the feces of infected individuals, making access to bathrooms and hand washing facilities on our streets even more critical. Over the past few weeks, ive been in communication with the director of public works, stressing the needs for more bathrooms, including 24hour. Theyve greed to provide ten new bathrooms, and while i appreciate the effort, this is far short of the level needed. With approximately 3,000 People Living on our streets, this is bathroom to approximately 325 people. Both the american rod cres and fema have cited the more robust for one bathroom for 20 people during the Public Health crisis. Im introducing an emergency ordinance requiring the department of public works and the department of Public Health to significantly increase bathroom and hand washing stations to meet the International Crisis guidelines of one bathroom per 50 unhoused residents. These are some of our most vulnerable, and we have to make sure that we are providing these facilities, and currently whats out there right now is grossly inadequate. Phyllis was born in tulsa, oklahoma in 1924 and soon moved to northern california, graduated from u. C. Berkeley in 1946. She then embarked on a career in journalist, which led her to seattle, where she met del, and after, they moved to San Francisco. In 1955, she and del, along with other gay and lesbian couples, they began publishing the first lesbian publication the ladder, and remained in publication for 16 years, until 1972. That first year, they published lesbian woman. The couple made history as the first open lesbians to join the National Organization of women. They were also engaged in local politics and were active members of the citys first gay and lesbian political club. They stayed active as they aged, joining old lesbians advocating for change. The clinic that bears their name is currently in financial distress and facing the possibility of imminent closure, which we cannot let happ happen. Phyllis and del changes the world of countless lgbtq people for the better. Phyllis was a long time resident of district 8, and it was a pleasure to represent her. The rest i submit. Colleagues, today, as i mentioned earlier, i am going to introduce the supplemental appropriation to cover the remaining cost for the approximately 1200 hotel rooms out of the 8200 or so rooms outlined in our emergency legislation to house our most Vulnerable People. And while much has been said about the Homeless Population, less has been said about the population where the virus is spreading in single resident occupancy hotels, which is also one of the great needs for hotel rooms in San Francisco. As you all know, there are some 19,000 individuals in that typology in some 530 buildings. This supplemental would cover the cost of the additional rooms that have not, thus far, been committed to by h. S. A. And mayor breeds administration, and i am sincerely committed to working with budget chair fewer to identify how we can identify the right sources of funding and mitigate impacts to our general fund reserve. By way of full transparency, what im introducing today has a source of funds as a general fund reserve, but i fully intend, with chair fewer, and you, colleagues to supplant that with other sources and start making the tough decisions that i think we need to start making now because were going to have plenty more tough decisions as i lived through 2008 and the economic downturn of 12 years ago in the months ahead. And i want to thank all of you for your support of the emergency ordinance to house not only our homeless but our s. R. O. Residents, and as our doctors have said, it is now been over a month, lets step it up. I also referred to earlier my consistent desires that i know are shared by many of you and by many members of the public as it relates to increased transparency. And if you look at and i was just looking at this a few minutes ago, our s. F. Data tracker, it has been improved considerably today, but it still has a long ways to go. And so this is a resolution urging the department of Public Health, the City Administrators Office that has been doing a lot of housework, and other departments, including h. S. A. , to continue the Data Collection that makes this Information Available not only for the 11 of us but for the public of San Francisco and the bay area to see. Last week, through the collaboration with those departments that i just mentioned, the city published an online data tracker which has now been viewed by a third of 1 million times. Its been pushed on for many weeks. When i was in e. O. C. , some of that data was made available in the mornings. Later on, that data was not even shared with the Disaster Service workers in that building, and i want to acknowledge, albeit faulting the improvements that have happened in the last week even though i know that we in San Francisco have lagged behind several of our neighboring counties in being transparent. Since this was published, remember, all we originally showed was the number of confirmed cases and number of deaths, it has, as i said, been updated to include Additional Data sets, including the number of test positive cases, brokendown along race, gender, and age group. It now is including Hospital Capacity and the number of hospitalizations brokendown by acute care and i. C. U. Beds. The resolution im introducing today, and any and all of you feel free to cosponsor it urging the inclusion of the following data sets. The neighborhood origin of cases, which were even seeing in places like cincinnati, ohio, informed by the Public Health Case Investigation unit, the number of tests administered to homeless individuals, and the rate of confirmed cases among that population as well as, i said before, the number of confirmed cases in s. R. O. S. And i know that weve had something of a transparency double standard. The city, by and through the department of Public Health and the Human Services agency and the department of homelessness and Supportive Housing has not hesitated to say publicly that we have, in the first case, one case at division place, and its now getting, as supervisor haney said, to 100 cases, but theyve been very circumexpesp to the number of cases in places like s. R. O. S. Its time to end that double standard and try to hide behind hipaa. Its time for the department of Public Health to release that data. Similar to our Hospital Capacity, disclosure of hotel room capacity and who is occupying those hotel rooms should be made transparent, whether its First Responders, people experiencing homelessness, people from s. R. O. S, and others in need of shelter proximate to their workplace, whether it be nurses, deputy sheriffs, doctors, police officers, firefighters, all of that should be transparent online. I also want to make public the date of specimens, and lastly, as we look forward to the next year or more of recovery, i want any Contact Tracing policy to ensure that theyre considering the city safety first policy that this board and the voters passed last year. I want to thank data s. F. And the Digital Services officer operating under our city administrator, naomi kelly, and look forward to collaborating to ensuring the rest of these data sets are public and respect peoples right to privacy. Finally, as i said, supervisor fewer today, if youre told enough, and i think im getting there, you know too many people who pass away. Colleagues, last week, i announced my intention to pursue the strongest possible protections for tenants both during and after the covid19 state of emergency and ive spent the last week working with City Attorneys office to hammer out the details of legislation. Today, with the support of supervisors ronen and haney, the supervisor Tenants Union, the Housing Rights Committee of San Francisco, and Chinatown Community development center, im very proud to be introducing what i believe is the strongest possible legislation to prevent evictions in San Francisco among those who are unable to pay rent due to the Current Health crisis. Our initial focus during the crisis was to make sure that people didnt immediately lose their home, and we have basically shutdown the eviction machine for now. Today, were taking the next step to make sure that tenants, especially lowincome, vulnerable tenants who are terrified of losing their homes once the state of emergency ends, today, they have the comfort of knowing that rent during this covid19 crisis will not someday become grounds for evictions. The legislation that im introducing today specifically will permanently ban eviction for nonpayment of rent that accrued during the due to covid19 and state of emergency. It will prohibit late fees, penalties, interest or other charges to tenants related to delayed payments from rent due during this time. It will also modify habitual late payment of rent eviction rules to make sure that delayed rent during this time cannot be used as grounds for evictions. To be clear, colleagues, without this legislation, tens of thousands of san franciscans will be at severe risk of being displaced once the current moratorium is lifted. This gives protections that renters desperately need. We also know this is just one part of a major undertaking to ensure that san franciscans are not left out in the cold in the after math of this crisis, and thats why ive supported the continued efforts of some of my colleagues on this board and tireless advocates across the state and the nation who are pushing our federal leaders to implement a plan to cancel rent debt while also making sure that small landlords get relief, too, through policies like mortgage relief. But we are not going to wait for state and federal action even as we push for it. So not only are we introducing the permanent eviction protections that ive outlined, and we are introducing that today, but i also want to announce that we are also taking the next step in this process. My office will be convening city leaders, including landlord and tenant advocates to get creative and figure out on you to address the mounting figure out how to address the mounting rental debt that is mounting by the month. We look forward to discussing that with all stakeholders. As we move as quickly as possible to make sure the most vulnerable tenants dont face a wave of displacement, we also need to take care to make sure that everyone lands on their feet. I want to close by thanking the many tenant advocates who helped shape this legislation and who have also been on the frontlines to help tenants navigate what has been a very rapidly changing legal landscape. I also want to thank mayor breed, with whom my office has been in communication in the last couple days, and has indicated her initial support for this measure. And authorize those who are looking for areas where all of us are coming together and trying to protect residents, id urge you to take a look at the very strong work that all of us at the board of supervisors and as well as the Mayors Office have done both in creating the shorter term protections to prevent against immediate eviction but also, i hope, we will all come together on this measure, as well, to provide permanent stability and comfort to tenants who are struggling right now. While the San Francisco bay area has been fortunate to see early signs of progress in flattening the curve and keeping our infection rates low relative to other parts of the country, we still have had our share of casualties. As of today, the department of Public Health has reported at least 987 confirmed cases in San Francisco that have resulted in 15 deaths. Even under normal circumstances, the death of a loved one is extremely difficult and emotionaly stressful event, but the ongoing covid19 Public Health crisis has placed greater emotional and Financial Stress on the families of the deceased. To be dealing with the loss of a loved one during these scary and Uncertain Times seems unimaginable but it will be a hard reality for some of our residence dentd residence residences. Ive reached out to constituents upon hearing the passing of some of our lowincome residents of San Francisco. The resolution urges the city administrator in consultation with the office of the chief medical examiner to explore ways to minimize post death body handling costs and to develop clear options for assisting families who have been financially impacted by the covid19 crisis including waiving the basic bodily fluid handling fees during the emergency. My name is william, and i am a resident here in the bayview community, and ive been in touch with many families here, and youve had a lot of talk today about the covid19 and the many steps that youre taking. Many familiar hes here are concerned about the order to shelter in place. The event that took place on 266 shafter avenue was a total disrespect to the orders, a total disrespect to the board of supervisors, a total disrespect to the mayor, and a total disrespect to the citizens of San Francisco. Once that venue was discovered, they were allowed to leave without even being tested. We im not one for martial law, but they should have been on lockdown immediately and they all should have been tested. And if they did have it, they should have forced them to stay there for 14 days. It doesnt matter who or what club it was, be it legal or an illegal club, they must be penalized for putting the lives of all san franciscans in jeopardy. If you stopped it the first time, you let them know there is no room for this in this city. But now, youve opened the door, and whos to say how many people of those hundreds had it and are spreading it around, and the city did nothing. The police didnt do anything, the Health Department wasnt brought out. Its a total disgrace, and folks are upset about it. And you did n clerk thank you, sir. And that you include a few bullet points, the most important things that workers, while theyre serving the Homeless People, guidelines that they can follow, as well as people that are receiving the services to be aware of those points is really important as we move forward to this, that civil rights and the human rights of people involved in this action dont get diminished or taken away. So its time to police the police and police the people that are watching over these people, and we knees to said clear guidelines in this health and Mental Health crisis. Thank you. This is a moment in time with the coronavirus situation for us to become what we really should be, and that is just like gene roddenberrys vision in star trek. We should help those who need the help because when we have a society that everyones taking care of each other, and everyones off the street, and everyone has an opportunity to thrive, then we as a city and as a state and as a nation become better, we become what were supposed to be. Right now, you have the people off the stree off on the street and that means that coronavirus is still on the street. You have people peeing and pooping on the streets because they have nowhere to go. Speaking as a resident of San Francisco, i am really concerned to see the bus overcrowding. Theres no opportunity for physical distancing when theres people sitting all throughout, like i saw yesterday, within 3 feet of each other, and then somebody gets on without a mask on. Thats something that needs to be considered with respect to the m. T. A. With respect to libraries, a lot of people have always considered the libraries a place for information and entertainment, and important information. Do i have coronavirus . Where can i get information about such and such . Wed like the supervisors to look into encouraging efforts to provide more library services, especially services especially valuable to those without internet access. They recently put in a tip line that runs from 10 00 to 5 00 monday through friday. Its very useful. It could and should be expanded to typical library hours. There should be consideration of mails materials like books, magazines, c. D. S, and d. V. D. S, or curb pick up, and there could be consideration for other things like story line and stuff for kids. There is another issue, and that is the assumption, very widespread, that everybody has access to the internet based on information from the tip line, the latest census information is that 14 of san franciscans do not have access to the internet, and i think that the supervisors should really keep an eye on insisting that any information provided by the city clerk thank you, mr. [inaudible] but those California State Health care volunteer and new york City Department of Public Health got back to me earlier, and they are ready to mobilize me. I would prefer to stay in the city and volunteer. Ill gladly volunteer in the jail or hotels or encampments, but i need to be mobilized, so please try to figure out what the holdups are. Now one or two of you i see are concerned, but the rest of you are talking from both sides of your mouth. We need to wake up. I was here in 1989 when the earthquake took place, and i got a commanders award for what i did. We are in 2020, and we are still in a mess. Dr. Grant colfax, our mayor, thomas aragon, all of these that are in charge of everything, none of them can call themselves an experienced Incident Commander who can do a needs assessment, none of them. So when will we wake up . While Small Businesses are hurting, our buses are crowded, you heard it. Youve heard the concerns of san franciscans, but its time that you do something about it. My third item is i would like the supervisors to author a resolution calling for opening the streets to people. We are seeing this is done in oakland, and right now, we do not know the end of this quarantine. We have waited 4. 5 hours for Public Comment. I think the middle of an epidemic is for you guys to change the rules and put the Public Comment at the beginning of your agenda. I want to call an advocate for a couple of things. The first is testing. We need to get test, equitable testing, like whats happening in the bayview and tenderloin. We need to get people in Testing Facilities so they can get tested. The second is shelters. People at shelters, people in s. R. O. S, people in shelters or people in s. R. O. S need to be tested. Can we please get folks who are staying in s. R. O. S tested because i think theres a reason were not testing them. We dont want to see people not coming out there. I just wanted to let everyone on the board of supervisors know that we are proud to support supervisor fewers legislation to finally close San Francisco jail floor, which is located at 850 bryant. County jail four is famously seismically unsafe and has been slated for demolition for over 20 years. We believe San Francisco should Work Together to close it for good, especially in the midst of this historic crisis, as some others have alluded to. [inaudible] in addition, closing this dilapidated jail will allow our city to instead invest in what our Community Really Needs in order to thrive, such as Affordable Housing, living wages, accessible fresh and healthy food and nonjudgmental rehabilitative services, Quality Health care, and investment in meaningful spaces, and families to be reunited with their incarcerated loved ones as soon as possible. But i would say that because they are receiving a large amount of money, they need to work more collaboratively with other transportation entities in the region. I spoke to her on the phone a few days ago. She is pretty sharp of mind at the age of 100. Her progressive politics are undiminished, her love of San Francisco is as strong as ever. P. E. Equipment, theres been a shortage of ventilators thank goodness we havent reached the shortage of ventilators, but theres been a shortage of p. P. E. And weve come under the guidance of the c. D. C. Weve seen the announcement of the defense protection act that was invoked by the administration but one of the profound things that happened last week was Governor Newsom announcing a contract that would provide over 2 million medical masks for californians in the next month, so we just wanted to thank seic 1021, and all of the individuals on the front seiu 1021 and all of the individuals on the frontlines. I have had, as i expressed earlier, some questions and issues about what is reexpressed in subsection 1 of the 8 supplementals, which was the subsection 5 that i brought up in the third supplemental, and this provision has been a bit of a headache, and this led to some frustration, and i raised this concern early on, particularly insofar as this body has consistently or at least from time to time received inadequate notice of upcoming meetings of policy bodies, and that happened on several occasions that im aware of. We didnt receive notice that the sfmtacac was moving pursuant to an Emergency Declaration until after that body met. We didnt receive notice that the Small Business commission was meeting pursuant to an Emergency Declaration until after that notice had been already posted. The Emergency Declaration allowing the Planning Commission wasnt actually properly sent to us until we had to ask for it the day that the Planning Commission met, on april 9. But i thats not really what im getting at. What im getting at is that insofar as this body is delaying everything that is nonessential, i think that it is very important that im talking to the Mayors Office in the form of these powers include a description of that which is urgent, and im sympathetic to the challenges here, but i will continue to work with the Mayors Office. I am not going to oppose this today, but as i said at earlier meetings, our job as a check and balance is to make sure that were looking at these very, very carefully. Im going to do that, i want all of us to do that, i want you to do that. There is a percentage of our population represented at our Board Meetings who do not have access to the internet. In the old precovid19 days, they came to city hall, and they testified before us. They are not able to testify in these meetings, and they are being left out of democracy. So i think whether its the Planning Commission or board of appeals or our board, where were delaying many unnecessary hearings and appeals, that should really be the rule of the day as it relates to all of these advisory bodies and commissions, so i wanted to say that for the record ill continue to work with mr.
