Its really sad to see the citys response has been to shutdown the Mayors Office on all disability meetings for the past four months. Deputy director Deborah Kaplan has been ignoring my emails for months, when theyre supposed to file complaints for a. D. A. Access issues. This department is not functioning like its supposed to, and i would like to know if the board of supervisors can do anything about this. The ten digit access code, the very short time for the input of the access code, the lack of an ability to auditorily enter the access code, the fast scrolling of the access code on the screen on the sfgov website, and the lack of information on the board of supervisors website and many other websites for the meetings. They dont say the many great stuff that was just said a few minutes ago. If would be great if departments could have that information, postit clearly on their websites. A lot of websites say come down to city hall to this room, and of course, thats not available. We need to have special accommodations for our disabilities. I urge the mayboard of supervis to work with the Mayors Office of disabilities to figure out why they refused to release information on the [inaudible] for people with disabilities and also look into why theres repeated sexual abuse of disability people at laguna honda. Clerk item 6 is authorization to allow the department of Public Health to accept and expend 105,000 from the epic charitiable fund to help lowincome and atrisk populations or the period of february 28, 2020 through february 27, 2021. President yee all right. Supervisor peskin . Supervisor peskin thank you, president yee. This was on our agenda last week and required a new title because president yee youre muted again. Supervisor peskin okay. Hows that . Thank you, colleagues. This item was on our agenda last week and was continued one week because the title and the uses of the charitiable gift changed. I just wanted to express my slight discomfort with this item. I mean no disrespect to epic or the department of Public Health, and i understand that the representation from the department of Public Health is that this donation was not solicited, but this is a company that was doing a very that is doing a very extensive project for the city and county of San Francisco. Im reticent to accept a grant like this. It seems to me if a charitiable donor wants to make a donation to the city and county of San Francisco, the best way they can do that is by reducing the price of their services, and we, in turn, can then spend the unspent general fund dollars on what we choose to appropriate it to. And i realize this budget is only 105,000, but im uncomfortable with it. I mean no disrespect to d. P. H. Or epic. Given everything thats going on, i wanted to express my discomfort with it and the fact that im not going to be able to vote for it, and im sorry, mr. President , for my problem with the mute button. Clerk item 7 and 8 comprise the proposed interim budget and appropriation ordinan ordinance and budget for 2020 and 2021 and 2022, continuing, creating, or establishing these positions. President yee thank you, madam clerk. So there was some discussion on these two items last week and not so much on the items themselves, but in terms of what we can and cannot do in terms of the vote, and i believe theres some clarification that as we vote on this, one can vote no on this, and if the majority of the vote is in favor of passing these items, then it will pass, even though its a no vote. Deputy City Attorney pearson, is that correct . Yes, president yee, that is correct. Okay. Thank you ve. President yee thank you very much. Supervisor preston, did you want to speak . Supervisor preston you know, i wanted to speak on the standards, but you clarified that, and also, thank you to the controller for walking me through some of my concerns. I continue to be concerned with a budget that contains police funding, but i thank the controller for taking the time to discuss the budget with me this past week. Thank you. President yee thank you. Supervisor ronen . Supervisor ronen thank you. I just wanted to thank my colleague, supervisor preston, for finding this conundrum that were in, for pointing it out in this budget process. I am on the budget committee, and i am ashamed to say that i did not notice this increase spread when we were in committee, but it really does bother me. Either were going to be serious about reenvisioning Police Reform in our city and diverting that money into other areas and into the black community, into better ways of dealing with homelessness and Mental Illness or were not. I see no reason to be increasing the Police Budget by close to 50 million and then decreasing it in a month. You know, it again, like, we should be consistent, we should be sending a clear message, and we should be serious about that. So im also going to be joining my colleague, supervisor preston, in voting no on this interim budget. Im serious about Police Reform. Im thrilled that the mayor and supervisor walton are taking the lead on diverting funds from the Police Department into the black community, and i see no reason to increase the budget now, only to be decreasing it later. I think that sends mixed messages. Thank you. President yee okay. Supervisor walton. Supervisor walton thank you, president yee, and i am going to briefly state, like i said in last weeks Board Meeting, i cannot in good conscience support a budget that has increases for the Police Department when we have made it clear the board of supervisors, that we have made it clear as a city that we will be redirecting money from the Police Department to invest in the city. I will not be supporting this budget as it is today. President yee okay. Thank you, and thank you for comments, colleagues. It is kind of strange that this is supposed to be an interim budget thats basically looking backwards and projecting forward. Even during a rebalancing activities, that you would think that the budget for the Police Department would go down and not up. It is strange. I also know that this is an interim budget thats pretty much not used it will not be used for necessarily for next years budget, so im comfortable that the impact on this year, it sends the wrong message is pretty nil. I will vote in support of it for the rest of the budget. Okay. Roll call, please. Clerk thank you, mr. President. And i will say that should item 7 and 8 be approved, my staff will do something a little different. They will be preparing the interim budget to move to the mayors desk sooner rather than later as the controller has mentioned the time sensitivity on the budget. The vote is final, with a 65 vote, and it passes. Madam clerk, lets go to item number 9. Clerk item 9 is a Charter Amendment to amend the charter of the city and county of San Francisco to authorize youths aged 16 and 17 to vote in municipal elections at an election to be held on november 3, 2020. President yee colleagues, today, i am proud to join supervisors fewer, walton, haney, supervisor, preston, safai, and mandelman to extend Voting Rights in municipal elections to 16 and 17 year olds. I would like to thank the San Francisco Youth Commission and youth advocates who have been working to make San Francisco the first city to allow 16 and 17 year olds to vote in municipal elections. I want to thank you for your tireless effort. It is so important at this time in our city and country we take steps to secure our democracy and take steps to ensure we have a government that works for everyone. It is essential that young people develop a habit of voting as young as possible and continue to participate in our democracy throughout our lives. Voting in the United States is far lower than other established democracies, and turnout is lowest among voters from 18 to 29. So when you look at that subgroup, only 30 of those voters actually vote, which is really low, and so theres also evidence that other cities and countries, they have set the minimum voting age at 16 show that lowering the voting age increases the voting turnout among young voters and even encourages parents to vote at higher rates. In San Francisco, voting turnout is lowest in the two neighborhoods with the highest number of youth and children. Thats bayview and visitacion valley. We know that on issues we vote on as a city dont just impact everyone anyone thats just 18 and over, they impact our young people also. 16 and 17yearolds dont have a say in the decisions that we make about their education system. 16 and 17 year olds can be tried as adults, but they dont have a say in our criminal justice system. And 16 and 17 year olds can get a job and pay taxes, but they dont have a say in our voting results. They can have a say in education, transportation, housing, policing, and Economic Development, and they deserve to have a say. Over many decades, they have had the opportunity to live and work in San Francisco, and weve seen that they can and want to navigate complex issues. They are at the forefront of local national and global movements, movements to end gun violence, reform our communal justice systems, and confront the challenges of Climate Change are being led by our youth. Earlier this month, 10,000 people joined a youthled protest at Mission High School to demand justice for george floyd and end the systemic oppression, racism, and other problems that communities of color continue to endure. Young people are capable of changing the world for the better, and we will stand alongside them and let their voices be heard. The struggle of equal Voting Rights extends back to the earlier days of our nations history where our right to vote belonged solely to white adult males. We have come a long ways but still have to ensure that everyone who has been afforded a right to vote in this country is able to cast their ballot on election day, and we have a long way to go to ensure that groups who have not yet been afforded the opportunity to vote but so greatly deserve to do so by extending their rights. That is what this fight is about. This is about moving us forward as a city and sending a message to our country at a time when we are confronted with division, gridlock, and so many seemingly intractable problems. It is about recognizing that our youth have always, always pushed our city and country forward, and it is about recognizing that our democracy is stronger when everyone is informed, engaged, and able to participate in decision making. And i just realized recently that even the state is almost following suit by allowing 16 and 17 year olds to vote in state elections. Clerk item 10 is an ordinance to amend the business and tax regulations code to permit the City Attorney, with the consent of the county recorder, to allow or settle Real Property transfer tax claims for refund and lawsuits in excess of 35,000 for any amount up to the amount of transfer tax, penalties, and interest paid that extends the amount of transfer tax and interest that would have been due on the transaction if the amount due had been calculated using the value of the Real Property as finally determined by the assessment appeals board. Clerk item 11 is an ordinance approving an easement deed and agreement between the city and county of San Francisco and Millennium Tower association for certain surface and subsurface rights in a portion of the sidewalk on the Southern Side of Mission Street at the intersection of mission and fremont streets and on the eastern side of fremont street at the same intersection, for 0 to allow a structural upgrade of the 301 Mission Street highrise building, known as the Millennium Tower, contingent on a number of events, including Court Approval of a Class Action Settlement of the Millennium Tower litigation, waiving requirements of adtrition code, authorizing the director of property to execute real estate documents, make certain modifications, and take actions in furtherance of this ordinance, as defined here in, adopting environmental findings, and adopting findings that the easement is consistent with the general plan, and the eight priority policies of planning code. Clerk item 12 is an emergency ordinance to delegate board of supervisors Approval Authority under charter section 9. 118 and administrative code section 23. 30 to the Mayors Office of housing and community development, mohcd, and to the Real Estate Division to amend certain existing leases regarding residual rent payments by providers of 100 Affordable Housing projects, in response to the Public Health emergency related to covid19, and to authorize the director of mohcd to amend certain existing loan agreements and policies without review by the citywide Affordable Housing Loan Committee under administrative code chapter 120. And mr. President , pursuant to charter section 2. 107, this matter requires the affirmative vote of two thirds of the board of supervisors, eight votes, with one read. President yee okay. Thank you, madam clerk. Supervisor peskin . Supervisor peskin thank you, president yee. As my colleagues know, ive had trouble with this measure actually in an earlier incarnation that was actually permanent legislation and not an emergency ordinance lasting for 60 days primarily as a matter of overarching checks and balances, and i think our decision not to delegate authority under charter section 9. 118 come before the board for our and public scrutiny. There was a long period of time where, due to no mal intent, these instruments or many of these instruments, particularly loan instruments, were not brought before the board of supervisors, and i understand there is an appropriate desire to clean those up, but i think theres a much better way of doing this that is much more transparent that does not devolve the board of supervisors oversight role. To that end, i had a conversation last night with the mayors director of the office of housing, eric shaw, and indicated my willingness to work with him to figure out a better way of doing this. This is actually a concept that has been kicking around since before mr. Shaw got his current position. I also visited with the chair of the budget committee, supervisor fewer, to indicate my desire to send this back to committee, and particularly at a moment in time where yesterday the controller released his report relative to the allegations at the department of public works where the board, the supervisors voted unanimously. Although i expressed public concerns, i was amongst those votes to stream line that process around the creation of navigation centers. It appears that because we got rid of that oversight and the appropriate checks and balances and the appropriate public process, mr. Nuru allegedly not allegedly gave a number of contracts to friends and associates, including mr. Walter wang, who was arrested by the federal bureau of investigation and is being investigated by the United States attorney. I dont think this is the time to get rid of the boards oversight, if there was ever really a time. And quite frankly, disguising this as a covid19 emergency is offputting. I have actually communicated with some nonprofit Housing Developers that have a stake in this legislation, and while they do have cash flow needs, they are not imminent. I think theres plenty of time to recraft this legislation in a way to keep the board of supervisors oversight and accomplishes the policy goals here but without getting rid of the checks and balances that are near and dear to government. So i would like to make a motion to send this back to the budget and finance committee of the board of supervisors. President yee motion made by peskin. Is there a second . Supervisor walton second. We just had a hearing on mohcd at the budget committee, and the questions we had during the hearing in terms of transparency lends a lot of support to what supervisor peskin is saying, so i would fully support this motion. Supervisor fewer . Supervisor fewer yes, thank you, president yee. I just wanted to say that while i appreciate supervisor peskins concerns, i did have a long conversation with mohcd before this came to committee, and they i asked them specifically about supervisor peskin and his concerns, and i just wanted to note that i did add an amendment that supervisor peskin requested. And colleagues, i would say if i had actually been alerted about this before the committee, which actually supervisors had an opportunity to reach out to my office, it would have been much more appreciated. But i understand supervisor peskins concerns, and we had a discussion about it. I also want to add that it was a period of about six months. I understand about giving up our authority as a board, but i just want to say if this was brought to my attention before the committee actually heard it and had discussion on it, we could have continued it before at the committee, and so that would be much appreciated. Item 26 is the motion to conditionally disapprove the departments decision subject to the adoption of written findings by the board in support of the determination. This appeal is related to the Planning Departments conditional use authorization for the project. After the hearing, the fort the board will vote on the conditional use authorization, which is requiring eight to overturn the certification or impose additional conditions. As the sunset and Park District has experienced significant changes to the physical and cultural environments just like the rest of the city. It is important to carefully consider important issues such as Housing Affordability and neighborhood character and how they interact together. Its also important we allow for meaningful neighborhood input into landuse decisions. This can help to shape projects and ensure that they are enhancing the quality of life in our neighborhood. I want to thank you for the oneweek continuance which allow me time to facilitate additional dialogue between the project sponsor and the appellant. While this dialogue unfortunately did not result in a compromise agreeable to all parties, i want to thank everyone for their willingness to engage in constructive discussion about the project and i will hold off on further comments until after the presentation. Thank you. Seeing no more names on the roster, my colleagues i will now like to ask the appellant to come forward and present the case. You have up to 10 minutes. The appellant is once again the appellant would like to would like to thank you for the tremendous work you have done to make this happen. The appellant believes the house is [indiscernible] even though the house was built in 1907 and mobile service did not begin until 1919. Second, the house is on a commercial corridor, even the businesses are clustered around 19th avenue and the lower great highway. There is no code requirement for commercial and there are already three commercial vacancies on this block alone. Third, this house is on the west side. There is a perception that the city doesnt give equal weight to Historic Resources on the west side despite how few of them there are. I will launch now into the powerpoint presentation. That should bring it up. Is that up . Okay. Lets start. I see them coming here. Okay. I think it is there. Okay. Thank you. Okay. The negative impact on the project. It eliminates Affordable Housing the replacement project or placement project is market rate it negatively impacts neighborhood character and destroys a rear Historic Resource the process for the peel started with board of supervisors petition and then it moved onto a signature of the neighbors. That is why its here. Its a petition by the neighbors and what are the issues of the project. There are issues with the planning code and other issues. This is the house. They are very narrow. They are vertical windows and they are therefore, light and air. The next thing, is okay. I was at the meeting. These concerns were about the tenants. There are three and they are all aware they need to move. The architect advised that a consultant had concluded that the house was a nonHistoric Resource. Bin lee was also there. These concerns with the side facing windows on taraval in apartments one and three. The concern was whether these windows would be blocked by the proposed project. They are narrow and vertical. It should be noted also that all of the tenants the meeting report was then submitted. Okay now, what the report said, and it states general discussion of the plan rather than specifics. Okay. The next one these are issues that we believe are inconsistent with the planning code about cultural and Economic Diversity of the neighborhood, about the discouraged demolition of existing housing, unless the demolition results in a net increase of Affordable Housing. The next one is about preserved mental units, especially rentcontrolled units. [indiscernible] this goes into the naturally occurring Affordable Housing in the definition of that and the next one is that the appellants believe that 1420 taraval is not affordable based on the issues here about the property tax, the assessed value, what each tenant is paying the Square Footage they have and also the amenities and the displaced tenants. Even though the proposed project would cover them up, the 1420 design is code compliant for that reason. This is the row of the housing houses. The far house is the only surviving one. This is the builder here, who also built the grateful dead house. The Planning Department team gave it a number of positives in terms of historic presentation preservation. The staff, however disagreed with the consulting report that was done by them, that the house was not a Historic Resource. One minute left. Okay they have supported new construction of a preservation and we are supporting so many other things. Theyre concerned about the layering graffiti if the project is not built right away. It will decrease the value of our property. We have to ask they have completely broken our windows. There is 3 feet of space outside our windows. Our tenants tony lee was there instead. Im also the coauthor of the citys parkside district Historic Context statement. Heritage supports this appeal to deny the project at 1420 taraval street. It would destroy an excellent example of one of the districts in the few surviving early houses. We agree the planning staff, would recognize the significant guidelines were saved for Historical Resources and called it an early and rare example of an early 20th century new neighborhood. But, we strongly disagree with the subsequent categorical exemption from ceqa and the determination that it lacks the integrity to be considered a Historic Resource. The alteration to the building are minor and reversible. Consisting of replace windows and porch fillers. The integrity of property in a historically workingclass neighborhood needs to be considered contextually with simple changes such as the replacement of windows that becomes a threshold for determining loss of integrity, it just reinforces the perception that the only civic structure and residences of the wealthy elite are worthy of recognition and protection. Heritage is committed to the preservation of the unique architectural and cultural identity and every corner of the city. Neighborhoods such as the bayview, the excelsior and the parkside are woefully underrepresented on the official inventory of historic property. Two Additional Market rate units would not move the needle on Housing Affordability, but this proposed project would destroy one of the last best Early Buildings on the parkside districts main street. At the end of the day, we are dealing with a very old and outdated home, which the Planning Commission had conducted a detailed hearing and has made a determination the project is moving forward as the investigation has completed. Its extremely important to note i did write a letter of support, ladies and gentlemen, that the number of units is suboptimal. We need to start somewhere. I understand the comment that three condos may not make a difference in terms of moving the needle, but we have to start somewhere. We continue to make the argument that it wont move the needle then no project will continue to be built. It is an excellent project. Three quality condos which will be available to members of the public, as well as additional commercial storefronts to support revitalization of the area. I believe the Planning Commission has done a very Detailed Analysis and there is no reason why this project should not move forward as it has been determined it should. Thank you. Having said that we feel that for years every time that weve driven by its been an eyesore. And im actually a little surprised that some of the comments on its historic significance. I would wholeheartedly and would have for years supported replacing the house. And i think that the concept of condos and commercial fits very well with the modernization that has taken place on taraval for the last 10 years. So were very supportive of this project. We think that the group that is developing that have very high character. And a longstanding multigenerational san franciscans with three kids that theyve raised here. They have nothing but the best interest of the city at heart. I have three kids. Im sorry, three more condos could help. They cant even afford the rent here. So anything that has to do with multifamily dwellings and supports the stay. And i think that the design and the concept of what the Developers Want to do at 1420 taraval really fits in well with whats happened on the street in the last 10 years. Caller hello, im speaking in support to say that the community has formally expressed their view with the form signed by the members of the community, which was within the guidelines. And their message is pretty clear do not tear down this building. And i feel that the board is not listening to the community. This house is not only historic, but its also naturally Affordable Housing. And the result of careful planning by San Francisco City Planners some time back. And given how expensive San Francisco has become, its really very important to kind of save as much Affordable Housing stock that we can. San francisco, as we all know, is probably some of the most expensive housing cost in the world. So destroying this house will remove desperately needed Affordable Housing stock in San Francisco and replace it with marketprice housing and housing that only the wealthy can afford. You know, there are thousands of apartments right now that are available, more than 3,000. And almost all of them are market price. So definitely more expensive than this home that is being proposed to be torn down. And the commission is asking not only to remove the rental property but not replace it with rental property but instead condos that will likely be affordable to only a few people that will be wealthy enough to be able to afford them. This is also an historic house, one of the few Historic Houses left in this part of the city. It needs to be saved. And theres no guarantee that if its torn down that we wont be left with a hole if the ground because maybe the economy turns in a different direction and all of the best wishes for putting up Something Different may not necessarily materialize if the economy doesnt stay moving along the way that it is. And its hard to tell if its going to continue moving along given how the economy has been impacted by the coronavirus right now. Thank you for taking my call and listening. Im the manager of the legislative affairs and a liaison. Ill present this case for the Planning Department. And im accompanied by linda, the planner for this project, and alex vanderslice who worked on the determination for the subject property. The decision before you is whether to uphold or overturn the Planning Commissions approval of the conditional use authorization for the demolition of the existing 2,170squarefoot Single Family home and construction of a new fourstory mixsuse building with three dwelling units and ground floor commercial. It has a mix of three, approximately 1,600squarefoot, three bedroom, two bath units. The building was proposed at 25 feet in height and a 65foot height district. The 20 feet below the 65foot high district. However, the Commission Approval reduced the overall height by 22 feet for a total of 42. 5 feet. Proposed project is on a major transit corridor, and it is also located in the neighborhood without a uniform architectural expression. The appellant raises four issues under the Planning Department purview in their written appeal. The first is that the proposed project is not consistent with the objectives two and three of the Housing Element. The poord Planning Section 101. 1. And the second issue is that the proposed project decreases the naturally Affordable Housing in the parkside district. And the project destroys a rare Historic Resource and negatively impacts the look, feel and character of the parkside district. And, finally, the project will block Property Line windows. In response to the first issue, on balance the Planning Commission found that the proposed project was consistent with the general plan. In granting the c. U. Approval they acknowledged the loss of rental housing, likely subject to rental control. And however, found the project to be consistent with numerous other octives and policies of the Housing Element, recreation and open space element, the transportation element and the urban design element. And when making planning general planning consistency findings, the Planning Commission must balance the competing policies and come to a decision as to whether or not the proposed project is on balance consistent with the general plan. In this case the commission did come to that conclusion. In addition to finding consistency with other policies in the general plan, the Commission Also found the resulting project would have an increase of two new dwelling units and a net addition of season bedrooms, furthering the goal to increase the supply of housing, in particular the lowrise smaller apartment buildings with three to four units. And in response to the second issue, the proposed project decreases naturally Affordable Housing. The Planning Commission found that the project benefits outweighs the negative impacts with the loss of the existing housing. And the project removes the older dwelling unit which is considered more affordable in new construction and the project will add two familysized dwelling units to the citys housing stock. This results in three, threebedroom units of 1,500 to 1,600squarefeet each. And its more affordable in design because of the proposed Square Footage. In this instance, the Planning Commission found that the proposed budget benefits outweigh the negative with the existing houses. And in response to the third issue that it destroys a rare Historical Resource, it does not have integrity. Further appeals of the historic determination are adjudicated through the ceqa appeals process. That said, the subject project was found to be significant under criterion one as part of the early Residential Development of parkside. And the latter evolution to accommodate the commercial uses. And its also found to be significant under criterion three as a rare example of early 21st century architecture in the parkside. However, the subject property does not maintain integrity with significant alterations, including from the vacant commercial space. Further, the subject building is not eligible for listing in the california registry as part of the historic district. The contrast, the project at 1409 taraval is significant as well. However, at 1409 taraval is more of an examine of Single Family residential architecture from the Early Development in parkside. Finally in response to blocking Property Side windows, most of San Francisco is zone lot zero. And they will consider the Property Line windows if they are the only windows to a bedroom and the removal prohibits them from being used as a bedroom. The windows on the adjacent property do not meet this criterion. In coon collusion, the Planning Department recommending to uphold the planning boards decision to adopting the motion, approving the conditional use authorization for this project. I conclude my presentation and i as well as the other planners are here for your questions. Thank you. President yee thank you. Are there any questions . President yee, i have some questions but i was going to wait until all of the presentations are done and also the Public Comment. President yee yeah, were more than happy to do that. Okay. Good afternoon, president yee and supervisors. Justin zucker, on behalf of peter mandel, the Property Owner of 1420 taraval street. First we want to thank supervisor mar and his legislative aide daisy kwan for their tireless efforts to address concerns raised in this appeal. With the conditional use the Planning Commission found the project to be necessary and desirable. And the appeal is meritless, should be denied, and the Planning Commissionary decision upheld. On balance the mixeduse projects, the affordable bydesign units were found to outweigh the loss of the existing twobedroom Single Family home. While we appreciate the appellants recent engagen enga, that doesnt work. It would likely want allow for the construction of one familysized three bedroom unit and results in the loss of a new ground floor commercial space and a neighborhood commercial district. Being along the corridor, the property is an excellent opportunity site for this development. And it is anticipated that the commercial space will be highly attractive. The appellants arguments regarding the historic status of the property are inaccurate. The property has been determined by the Planning Department to not be an Historic Resource. The property has lost its integrity due to numerous alterations and modifications over the years. It has a category that has no ceqa classification. This is not the proper forum to discuss the status of the property as mentioned by planning staff. Not withstanding their attack on the resource classification, appellants have no credible evidence that counters the substantial evidence relied upon by the Planning Department in determining the property is not an Historic Resource. The Planning Commission analyzed whether the project is necessary and desirable, and compatible with the taraval street and they found that it is. In making the required conditionaluse finding, the Planning Commission found the project to be consistent with the general plan. Appellant appear to argue and oppose the project on behalf of the existing tenants of the singlefamily home. But as indicated in their letter submitted to the board, the tenants are supportive of the project, recognizing it tripled the number of dwelling units at the property while also providing a ground floor commercial space. Theyre not being evicted. While this is a small project this moves us incrementally in the right direction towards addressing the citys housing crisis. As for the concerns raised regarding the neighbors windows, subsequent to the preapplication meeting, peter has met with the neighbors sheriff times to address their concerns. Most recently with supervisor mar. The window will be lost in two rooms and the two impacted rooms have large bay windows for light and air. And though declined, the mitigation offers have been made in a goodfaith effort. Including assisting in installing a sky light and interior lighting and other nonproject related repairs to their building. We respectfully request you to deny the appeal and allow this to proceed. Now ill turn it over to peter to give history on this project. Peter, you might be on mute. Is that better . Yep. Okay, peter mandel here. I have known the existing building since 2004. Before that my father owned it for several decades. I have lived in the house for about 28 years. First with my two high school roommates. And then with my wife and kids from 1980 to 2008. I did move out in 2008 as the house was very small in the interior and into a more suitable house for my wife and three kids. I am a native san franciscan who grew up in the sunset district and now live near westportal. Im not a developer but i own my own Remediation Company and have been busy for the last 16 year. My objective is to increase the housing availability in the neighborhood which is in my opinion one of the most important things at this time, along with maybe creating a few jobs during these difficult times. During some of the Planning Commission hearings and many of the appeal documents, i have read i have heard from those opposing the project, many references to the porch being authentic. But this is invalid. If you look at the photos closely, that porch is complet completely an addition to the original. And i know that for firsthand because i had to rebuild that porch, okay, with some its all made out of pine and back then they didnt use pine, they used redwood. So that is an addition. Also i have heard from those opposing that the current tenants that are in the building will be displaced and evicted but those same tenants approved this project with a written statement to supervisor mar. And so they are for this project, the tenants are. Likewise, a host of individuals recently have just sent in letters of support. A p petition is created by the merchants two blocks up and two blocks down, and everyone that knows about this project are in support of the project. You know, i regrettably have heard about statements such as fraudulent, corrupt, about the work that both bill and i, my architect, have done. And, you know, we presented everything in a concise and truthful manner. The leads themselves went to a meeting between bill and i at bills office and we presented everything on the drawings. And an hour later, you know, we did present what maybe will help to close up the windows and the skylight that opens for fresh air. And we shook hands and then they left. And two months after the Planning Commissions second meeting, which everything was approved, i got a call in saying that, you know, the rents might go down and thats when this all started about the windows. So, you know, i do look at all of the motor homes there on winton boulevard, and i am saying to myself this city needs something done. So it needs more Affordable Housing. The office space down below more than likely i will my business will be moving into that. And i do respect the opponents right to appeal. But, again, this project is exactly what this transportation corridor needs. So on some, you know, this house has no historical to it. I mean, they mentioned the grateful dead, but, you know, i dont think thats really valid here. So i i want to approve this project and i thank you for your consideration and time. Thank you. I drive by the taraval corridor often and i know that when i go by a building it screams to me what a gorgeous property that should be preserved. I think that putting in a multitenant building fits in with the properties that are around it. I understand the concerns of the other neighbors, but development is common in the city and we want to keep moving the city forward. As someone who is looking to invest in this community currently and conditions that were facing, i see the businesses close left and right in my neighborhood. And so if they want to push this city forward and invest and bring in jobs and construction and bring more housing into the city and modernize the city, im all for that. And im for supporting the local businesses in the city as well. So i wholeheartedly would like to put my support behind this as a business owner. People are going to object to whatever we try and do in this city but we need to keep moving this city forward and improving it and not constantly living in the past or because Jerry Garcias builder had something to do with it. I think that the current climate going around that we need more jobs in the neighborhood, more construction jobs. I think that if this home is not done, i dont think that it would survive another architect. So i think its time to fix it up and make more homes available for kids. I have two kids myself and we hopefully one day could buy a property. This would be the perfect location. I think that the revitalization of the street is well underway. I think that it needs more help for projects like this so that people can afford to buy. I also think that its very good for the city for more taxpayers. Right now the city is really hurting after this covid, and im scared that there will be more tax money coming into the city. And they also think that this project is very well designed. I think that has really put a lot of thought into the neighborhood with the zoning of the building. And the neighbors privacy with the building. So i honestly think that this should move forward. And i just lastly would like to invite the appellant to present a rebuttal argument. You will have up to three minutes. Thank you. I would start out, that i was at both of the Planning Commission meets and that the Planning Commission supposedly balanced the competing interests. I would challenge that. They showed really a lack of interest in any of the issues that were brought before them. And i think that it was a timing issue. The issues resulted from the executive search. And the commissioner turnover and a leave of absence and with maintaining a quorum. This was a unanimous vote but there were only four voting members there. Mr. Rosen . Supervisors, there are two Property Owners of 1420 taraval but we only heard from one. And zucker says that he represents mr. Mandel. And theres another that owns another 50 and we havent heard anything from her. Peter mandel wants us to believe that the city he said that the city needs more Affordable Housing. How misleading. What hes failed to say is that he wants to build market rate housing. We know nothing about the financing on this selfdeveloped project and whether we would end up with an empty lot and an economic downturn. This project smacks of elitism in a city that could use less elitism. How would mr. Zucker feel if a neighbor covered his windows and if mr. Mandel had his windows covered in st. Francis wood . How would any of us feel . Its not the job of the Building Code to protect tenants. It is the responsibility of this body to protect tenants under rent control, to prevent their windows from being covered, and to exercise its oversight role over the Planning Commission. Part of that oversight role is a common sense reality check. Covering windows of rentcontrol units with marketrate units doesnt pass the smell test. Did the flawed project make it through planning . Its hard to believe, but you bet it did. This project is full of flaws. Falsified affidavit of the preapplication meeting giving rise to the project, according to two people who were there. Replacing naturally affording housing, with marketrate housing clerk one minute left. Is not consistent with the code element. And covering the windows of next door at 1414 taraval, these tenants are under rent control. Do wes have a city want to block their light and air with marketrate housing . What do this body and this government stand for . We have an item today to protect the tenants due to covid. Should we protect rent controlled 10ants with a false affidavit and a flawed project . And desmollishing one of the resources that our middleclass neighborhood has that is part of the neighborhood character is outrageous. Again, elitism. Inconsistent with the general plan Housing Element and planning code section 101. 1b2 that existing housing and neighborhood character be conserved and protected to preserve the cultural and Economic Diversity of our neighborhoods. The story from the project sponsor keeps changing. He said that he wanted to help to solve the housing crisis at the Planning Commission. And then he said that he wanted to build housing for his children. Clerk thank you, mr. Rosen, that concludes your threeminute rebuttal. President yee thank you very much. I guess now that the public hearing has been held and this will be filed. We will now reconvene as the board of supervisors. As previously discussed, we will take consideration of the conditional use authorization, which involves an analysis whether the Planning Commissions determination to authorize the project was appropriate. To reverse the Planning Departments decision, or to authorize the conditional use with additional conditions. Theres eight votes of the board. So supervisor, do you have any comments to make . Supervisor mar thank you, president yee and madam clerk, for facilitating the hearing. I did have a few questions for planning staff. Mr. Starr, the other planning staff that are with us, more about the historic the determination around historic significance for this property. Yeah, this property is in an historically workingclass residential neighborhood. The homes and other buildings in the parkside were built to serve the Housing Needs of working families in the decades following the 1906 earthquake. So they understandably lack obvious architectural or design details that appear in homes in other neighborhoods originally created for the wealthy and the elite in our city. So i just have a question how do our preservation standards account for workingclass neighborhoods like the parkside, where buildings have few architectural characteristic as a matter of the economy . Sure. I can just say that the building was determined to be a resource, just not retaining integrity. But ill let stephanie, who is a preservation expert, to take over the response to that. Good afternoon, president yee and the board. I just want to make sure that you can hear me okay. President yee yes. Okay, great. Yes, so i can talk a little bit to kind of the preservation process and kind of looking at these more modestly designed workingclass residential structures. When we are completing an historic determination to see if a property is a resource, we rely on the four criteria that is outlined. So properties that are significant for their associations with events or with people or for their architecture or for archaeological resources. And with regards to specifically looking at this type of building, we do look at the Development Patterns in the neighborhood to try to figure out, you know, where it was potentially early Residential Development in relation to either earlier or later commercial development and kind of how does it work with each other. And with the understanding that the designs were a bit more of a modest of a style, and not exactly your highstyle architecture. We do we look at that and, you know, while they might not be buildings that are significant specifically for highstyle architecture, we consider them as potential Historic Resources with the working class or middleclass neighborhoods. In regard to looking at significant im sorry in regard to looking at integrity, integrity sewhat we take into consideration when we have identified that there is an Historical Resource and we want to look at whether or not we are able to portray or illustrate that potential significance. So we, you know, with an understanding that theres not really applied architectural features. We do rely on the conditions versus what the condition was for the construction. So features such as window patterns and window types, window designs, in this specific instance the front porch, looking at siding material. Things that would be considered, you know, just as part of the architectural fabric, we rely a little bit more heavily on the analysis of the conditions and those features to determine whether or not significance is still portrayed through those features. With the understanding that its not highstyle building. In this particular instance, looking at items alterations that have taken place, with windows taken out and the front clearance to accommodate for that kind of garage and or commercial space. Looking at elements related to the porch. Those, you know, alterations that have taken place further diminish the level of integrity that the resource has. Thank you. I had a followup question. So regarding your determination that the you know, that the modifications or alterations to the building are significant enough that to lead to the determination that its not an Historic Resource. Can you respond to the points made by the appellant and others that these alterations are relatively minor and can be easily be restored, you know, just replacing windows, rereplacing the windows, and the siding and the railing on the porch, for example. Sure. Supervisor mar im sorry. And is this a consideration or the ability to restore the property to more of its original state. Is that a consideration in the determination of historic significance . Sure. So for the second part of the question first. Whether or not the property could be potentially restored is not something that we have considered when were looking at determinations. Just to backtrack a little bit, the department did agree that the alterations that have taken place are minor. We feel that theyre substantial enough to cause the property to no longer maintain that integrity. And with review under the act, we look at the existing conditions of the potential historical preservation, to make the call. And so while it might be reversible in nature, thats not the existing condition. The existing condition incorporates all of these alterations with our analysis of the integrity. Supervisor mar okay, thank you. I dont have any other questions for the planning staff. I did have one or a couple questions for the project sponsor. Okay. President yee is the project sponsor Still Available . Im turning on my okay. Im here. Can you hear me . Supervisor mar yes, we can, thank you, mr. Mandel and mr. Zucker. More followup on the points raised by the lead or the owners of 144 taraval, you know, the property next door who will have two windows, you know, on the Property Line covered up by the proposed project. And i wanted to see if you would be able to state a little bit more clearly for the record what the mitigation measures that you had offered to the lead family . Yeah, justin, you want to start or you want me to start . Go for it, peter. Well, what we talked about in december 12th is that we would offer to all of the construction to close up the windows permanent and to close up those two windows. And then also to offer on the upper floor a skylight that could open for fresh air. But down on the second floor level, there we were going to offer some more lighting on the interior. They do have two bay windows that, you know, are within a few feet in the front of the building. So they do have plenty of light going in there. But those were the two items that we were going to offer for those two windows. We also there were a couple there are nonproject related building repairs, just being neighborly, and goodfaith efforts to help with consideration. One of them is on the western facade theres one missing piece of siding, and peter had mentioned that hed be happy to repair that, replace that one piece of siding. And if there were any other damage that were to occur that is not anticipated during the demolition and construction that hed obviously take care of that. But, again, not anticipated. And then finally there is a window in the rear of their building that is in severe need of fixing that peter has offered to repaint for them. Thats correct. Supervisor mar great, thank you. President yee thanks to supervisor mar. I actually have clarification question really, and im not sure who wants to answer. But theres a lot of about this being affordable units. So its a little confusing to me. Is it affordable unit . Are we talking about rentcontrolled units . There are two Different Things to me. Go ahead. Im sorry, the existing unit is market rate. It is ol has the ability to be considered rent control so its not an affordable unit by any means. President yee and then in regards to the tenants, are they moved out, theyre still there . That wasnt clear either. Theyre still there, but, you know, they are supportive of the project and thats in writing to supervisor mar. So they know that its coming. Whenever that day is. So theyre living there and theyre paying some rent, three of them. Theyre in their early 30s, i should say. President yee thank you for the clarification, it just wasnt clear. Supervisor mar, would you like to have a last word or whatever . Supervisor mar president yee, i dont have any other questions for the parties. I do have some Closing Remarks. I wanted to just start by thanking the appellant and the public who commented today and also in writing for raising very important concerns about Historic Preservation and Housing Affordability in the parkside district. Its important to look at this project in context. This early 20th century property is in an historically workingclass residential neighborhood, directly on a major transit line. And in a commercial corridor. The homeowner, as you stated, grew up in this house and proposes to build three familysized units in a commercial and a commercial space in a growing neighborhood. I believe that this is a kind of density and development that is appropriate for this location. And the commercial corridor and neighborhood. While the historic determination is usually adjudicated through the ceqa appeal process, and not the c. U. Process, i do want to speak briefly on my position. And i agree with the Historic Preservation planners assessment that the property does not maintain integrity but also acknowledge that its a significant part and really a rare example of the parkside early Residential Development. The parkside has a rich workingclass history that opened up affordable homeownership opportunities to generations of families. Many of whom were immigrants from europe and more recently asia. We must preserve our history, whether through protecting the most intact examples of singlefamily architecture, or honoring this legacy by continuing to support new generations of working and middleclass families to be able to live in our community. I look forward to continuing Historic Preservation conversations proactively identifying potential Historical Resources and historic districts in the parkside and the sunset neighborhoods and exploring incentives for the Property Owners and other creative ways to respect our neighborhoods rich and workingclass history. And with respect to 1420 taraval, i do agree with the determination by the planning staff that this home is not a significant enough resource to reject the conditionaluse authorization and the Developers Plan to demolish the home and create three new familysized Housing Units that otherwise are a good fit for this site and the neighborhood. I also want to briefly acknowledge the issues raised about Housing Affordability and tenant displacement. The project proposes to replace one threebedroom home where current tenants are paying marketrate rate rent of 4,500 per month, with three marketrate threebedroom flat. So theres a net increase of two familysized Housing Units and no loss of Affordable Housing. The three tenants submitted a project support letter and stated that there is a buyout agreement. And the owner agreed to forestall payments during this stayathome order and agreed to a repayment plan with the tenant. The tenants were notified of the owners plans to develop the property before they moved in. And they were introduced to tenant advocate, but decided that it was unnecessary. Its true that there are many singlefamily home tenants who are at risk of eviction and over the last decades, district 4 has experienced one of the biggest losses of rental housing citywide. We need to stop predatory practices, especially for lowincome tenants. So, supervisor, i would not support a project if this were the case and this is not such a case here. And, finally, we do need quality Affordable Housing in San Francisco and in the sunset district. And, unfortunately, our policies do not reflect this priority in smaller projects. We know that we cant rely on the market or private developers to rent at affordable rates. Nor should we rely on older deteriorating housing to keep rents down. We cant support developers with a clearer process and clear expectations while maintaining the neighborhood input to achieve the best outcomes. And, supervisor, i have been and i will continue to push for preserving and constructing new Affordable Housing in the sunset and parkside neighborhoods. So, colleagues, in conclusion and after full consideration of all of the facts and the prospective expressed by the project sponsor, appellant and the public, i will not be supporting the appeal today. And as such i intend to make a motion to approve item 25, and the conditionaluse authorization. President yee thank you, supervisor mar. President britt did not shy away from fighting for social justice issues even if they were wildly unpopular at the time. He was unwavering in his fight for civil rights. He did not choose politics, but it seems politics chose him. And for answering that call to service. We are lucky to see some of the most Ground Breaking laws introduced here in San Francisco and supervisor mandelman, would you like to share your in memoriam and colleagues, anyone who would like to speak about supervisor britt will be given a chance to do so before we return to our regular order for roll call. Thank you for your words and creating this special time to honor former board supervisor harry britt who died wednesday morning. He attended Duke University in the late 1950s before continuing on to the Perkins School of theology in dallas and pursuing doctoral studies and philosophy and religion at the university of chicago. While in chicago, harry completed the ordination as a methodist minister and served as pastor for two chicago congregations. In chicago he was introduced to ward politics and the civil rights effortses of dr. Martin luther king jr. In 1972 harry made his way to San Francisco and as so many did during that time, once here he began to more fully understand and embrace gay culture and his own sexuality. On one of the first nights out in the city, harry visited the black cat bar where he was moved by the performance of a legendary drag queen who became the first openly gay person to run for office in the United States in 1961 for the board of supervisors paying the way for harry, harvey, and the queer and elected candidates who followed. By 1975 he was a bonefied castro tremendousing and discovered a small camera shops and the owner harry milk. Harry became one of harveys closest friends and most impressive political proteges and was the Gay Community liaison and helped to organize the San Francisco gay democratic club. Today known as the harvey milk lgbtq democratic club. Harry was proud of that little club. He told me on more than one occasion and i think he was only kind of kidding that the most important job he had ever had was as the president of that club. With the president reeling from the loss of milk, it was harry called upon to move queer and aggressive politics forward. After Dianne Feinstein reported. And went on to the own elections in 1979, 1980, 1984, and 1988 and served as president of the board from 1989 to 1990. During his time on the board, harry was a champion and pioneer for lgbtq equality and in 1982 he introduced first of its kind Domestic Partnership legislation which was gasped by the board of supervisors but vetoed by mayor feinstein. Harry and the community kept fighting and in 1989 they were signed into law. A Citizens Initiative appealed the domestic law and turned around undaunted and his own Ballot Initiative prop k in 1990. And harry was the only openly gay official at the onset of the h. I. V. Aids epidemic leading and advocating for the Gay Community during one of our darkest hours and harry courageously fought resource and Political Support as his friends died around him. Harry believed in Coalition Politics and worked to fight for labor and in addition to the work on queer issues, he championed rent control, vacancy control and the end of u. S. Intervention in latin america. As i have been remembering harry, one of the things that struck me is what a bundle of contradictions he was. Here it was an ordained methodist minister and an atheist. In fact, by the time i got to know harry and spend time with him after the last of the campaigns was done, i was said that atheism and spreading the word about atheism might have been the gratest and last remaining public addition. He was an incredibly shy person and many have remarked that he was a reluctant politician. He did not enjoy campaigning and that is an understatement and Many Campaign workers and volunteers have stories of pulling him out of a cafe or a park bench where he was reading instead of shaking hands. He often suffered anxiety before giving a speech, but when he opened his mouth, it was magic. A galvanizing human being who when we spoke was a joy and inspiration for those who gathered to listen. Final contradiction, harry was such a sweet, kind, loving person who was so kind and generous with time and advice. And yet he recognized that his pow power power of the Community Came from anger. He spoke about anger and rage in politics particularly for those who have been kept from power and are demanding power. After the white night riot and amazing quote that tim redman used in the obituary for harry, he said harry milks people do not have anything to apologize for. Now that society will have to deal with us not as nice little fairies with hair dressing salons but as people capable of violence. Were not going to put up with damn whites anymore. Harry loved harvey. And harry insisted that he left up with two directives. By all means, give them hope, but also get angry. Harrys impact on Queer Community and politics cannot be overstated and he was the moral compass during the time on this body and although it was his dream to increase queer representation, it was harry who fulfilled that vision and let us through the darkest days decades before we would win so many victories that were not possible without him. I will conclude by thanking the incredible staff of laguna honda who cared for harry over the last coup of years and thank his friends who made up the care team. Rest in power, harry britt. You you are and will be more than missed. Supervisor yee thank you. Supervisor ronen. Thank you, supervisor mandelman, for that beautiful tribute to a beautiful man. I had the luck and privilege to sit down with him when i was running for office and i was immediately in awe of him. Of course, i had heard about his reputation and history and achievement, but getting concentrated time to chat and get to know him was something that made its mark on me. He wasnt the typical politician. No talking points involved and so straightforward and genuine and down to earth. And the questions were the questions that you would want someone to ask a candidate about how much i really cared about the people that i was seeking to serve and it was an hour and a half of my life but left this mark that has stayed with me to this day. I feel so lucky i got to have nigh moment with harry who i admire so much and this is a big loss for us. Rest in power, harry britt. Force thank you. Supervisor peskin. I had a similar First Experience with harry britt, almost exactly 20 years ago right now. And i had one endorsement and i didnt realize i had to meet people one by one and tom said, hayed to go get harry britts endorsement. And i was just like, wow, how does that work . He gave me harrys number and he said, i never leave the hate, supervisor peskin, and i went and sat with him and it was like being in the best classes and i was so enthralled that i had to call back and ask for his endorsement and he generously said yes, but the other other thing that supervisor mandelman didnt say well, there are many, many things to say about harry but that when his staff had trouble finding him, he was often at the racetrack betting on the ponies which is part of what made harry so special and just go down to the racetrack and bet on the horses. He also was a mentor once i was elected. And the first time i ran which was so miserable and i called him up and said, harry, this is really tough. And he said, super aaron, if you think running for offers is bad, if you get elected, it is worse. I would call all the time for advice and at the forefront of getting muni to use hybrid buses and reduce particulate matter and pollution and one of the most amazing members of this board and human beings i have ever had the pleasure to meet. We will miss you, harry britt. Awe thank you. Supervisor preston. Thank you, president yee and i would like to join the remarks and thank you to supervisor mandelman and other colleagues of harrys memory. And britt was a longtime resident of the hate and former constituent and a democratic socialist and ahead of his time. Its been one of my pleasures being in office when i tell folks i am the first democratic socialist elected in 40 years and always wonderful with that area. And to talk about the amazing impact that he had on the city and how he was unapologetically a socialist at a time that was going against the conventional wisdom. Harry is and will always be an inspiration to me. I have similar stories to some that my colleagues have shared. And he was such a pioneer for unheard voices for the Lgbtq Community and communities of color and really for the working class of San Francisco. And over the course of the last number of days, almost weeks now since learning of his passing, really talked with a lot of fellow d. S. A. Members and i can tell you how saddened everyone by the news of the loss of harry, but also how inspired in folks of all different generations are by the incredible work and his legacy. And i will say that its i think i struggle and probably others on this board do and others who are friends with him and its challenging to celebrate a man who in so many ways did not want to be celebrated. He is one of the most humble and kind and inspired us to fight for justice in a humble way. And each conversation i had with harry over the years, and what i really recalled is that he never got tangled in the weeds. He was smart and knew details, but the conversations were about him with his humility and humor to get to the core of the moral issue. He is someone who really distinguished right from wrong and in his mentoring of leaders, i think he always had that clarity. All the advice he ever gave me is never around the nuances of this policy or that policy, but it was about sticking what you believed in and holding on to the values and maintaining the moral clarity and as supervisor mandelman referenced, understanding and embracing anger when its appropriate. So we will all carry on his legacy we conding to fight for the most marginalized and the work he did to Carry Forward the things harvey milk did and all the things my colleagues have talked about, but i want to thank harry for the vision, the moral clarity, and his willingness to name capitalism, to name racism, to name homophobia as evil that we need to confront and dismantle. I will forever appreciate harry britt, his mentorship and his leadership. We stand on your shoulder, harry. We will continue to fight like hell. Rest in power, harry. Supervisor yee thank you. Supervisor i just want to, well, first, supervisor mandelman, thank you for bringing this forward, and i want to share my condolences with everybody who cared for harry, lovered him. This is a huge loss for the city. Like you had, my experiences with harry and the few times that i got to meet him, and each time i was around him, i was, like, oh my god, that is harry. Harry britt is a legend. When you meet him, he was so understated and he was so straightforward and so kind that you really could get a sense that this was the life of politics was something that was not necessarily natural to him but his life story and the things that he had been through and the things he saw that brought him to that. And when i think about the story of San Francisco, it is people like harry and people like harvey and its people who came here and were able to turn San Francisco into what we understand and take it for granted as being now. All of us serve on a board and live in a city where there is just an understanding that we are at the forefront of the movement for lgbtq rights. That we are always going to be pushing the boundaries on tenants rights, on human right, on civil rights, and that was something that was not always the case. That it was harvey and it was harry who because they actually experienced the opposite of that and so many other places and even the opposite of that here, that they fought to have San Francisco be a place that would be different. And so all of us now get to live that legacy and to continue that legacy, and it would not be that way if it wasnt for the work that harry did and so we get to talk about the eviction freezes and the rent cancellation and all of those things that we are in that place because harry fought and put himself out there in ways that probably were uncomfortable for him but felt he had to do. It is the leaders that harry embodied that have allowed us as a board of supervisors to continue that and to hopefully do whatever we can this elevate it as they would have wanted us to do in terms of what is possible in this city that they dreamed of and that they created for all of us. Rest in power, harry. Thank you to everyone who was a part of the community he was and fought and organized and bled and protested and did everything to make sure we had a city where people could be themselves and people should be love who they wanted, and that they could actually have some a city that saw them not just their identity but actually allowed them to have a city where they could thrive and be centered. And i think that was his vision. So rest in power. Thank you, again, supervisor mandelman, for bringing this forward. Supervisor walton . Thank you so much, president yee. And the sentiments to the course and we know that supervisor britt was legendary for us in San Francisco and the leadership in the Civil Rights Movement and the gay rights and lgbtq Rights Movement is really something that is unmatched. We know that he came up to the fact that we can celebrate samesex marriage here in San Francisco and here in the state of california but even after leaving from offers as supervisor and going to be a College Advisor and continuing to be a part of the fight but also making sure that folks what who wanted a Higher Education got to learn from somebody in the fight and in the struggle and the Academic Knowledge and to be the activists and what he brought to the College Classroom and environment. He will be missed for all of his body of work for us to make an opportunity in the seats that we are today. Thank you, supervismandelman ann perfect peace. Thank you. I am going to break precedent and i understand that the former president supervisor tom is here and he is on the line and i dont know know technically if its possible to pull him out of somewhere. Mr. President , we are getting in contact with supervisor and Assembly Member tom amiano and would like permission if and when we can reach him to pull him out of line so he is able to speak even if it is during general Public Comment. Today i am introducing a resolution calling for emergency measures in response to the ssa san quentin prison of covid19 and want to thank the Public Defenders Office in particular and also my colleagues supervisor haney, ronen, and wallton for their cosponsorship of this resolution and leadership on this issue. Also wanted to thank lex vaughan clark, and a fellow in my office and legislative aide for their Background Research on this issue. Right now there is an alarming outbreak of covid19 at san quentin that warrants immediate action. As of sunday, june 28, over 1,000 incarcerated people at San Quentin State Prison have tested positive for covid19 meaning nearly 13 incarcerated people have now been infected and that the number of cases in the last week has more than quadrupled. In addition, 89 staff member at san quentin have tested positive for covid19. The resolution urges Governor Newsom to provide adequate coronavirus testing and personal protective equipment to ul an incarcerated people and prison staff. The resolution also calls for increased and consistent information about the situation at san quentin to the public generally and incarcerated peoples families specifically included but not limited to a designated point of contact for incarcerating peoples families and a phone line for family members of incarcerated people to call to find out their health status. The state is operating a facility with one of the worst outbreaks in the country right here in the bay and there are san franciscans that are incarcerated there and neighbors that work there who are gravely at risk or already infected. It is essential that we dramaticcally and quickly reduce the prison population at san quentin in order to save lives and prevent further spread of covid19. And lets be clear about who is disproportionately locked up in san quentin and elsewhere in the state. The people incarcerated are disproportionately africanamerican men, latino men, and other people of color. The state of california has a particular responsibility to those who are incarcerated and those who are employed in these facilities to not keep them in environment where is they will get sick with a deadly virus. I have another memoriam sadly for a member of the community who was killed when walking across the street. It is with Great Sadness that i offer this in memoriam to remember a San Francisco resident who loved this community with all his heart. Sergio was hit and kill bid the driver of a vehicle at dwight street in portalon june 18, 2020. He is survived by his wife, his four children, and his four grandchildren. Sergio worked as a janitor and was a family man. He was extremely proud of all his kids and loved spending time with his family at barbecues and cook outs. Sergio loved to cook and dance and could always bring smile with his joke. He moved to San Francisco 40 years ago from nicaragua. He was a man who cherished his roots while being a san franciscan through and through. Friend and love ones remember him as being a funny, loving and charismatic person with a generous spirit. He devoted himself to god and loved to share his gift of song at church. He will be deeply missed by those he left behind and on behalf of the board of supervisors and district nine, i extend my deepest con delenses to his family together with the leadership of president norman yee, we are going to continue to fight and work as hard as we can to prevent another senseless pedestrian death from happening again in our city. I did want to highlight one thing today in getting a lot of calls from concerned parents as a parent of Public School children, a really i know many of us myself and supervisor walton have the highest concentration of children under the age of 18 in the entire city, but i know every one of our districts has children and families that go to Public School. So i have been getting a lot of emails, questions, and concerns about what the plan of action is and where we are in the process to ensure our schools will be ready for august. And the thing that most parents dont want to hear, they dont want to hear the last week of july that were not going to be ready to open up the pub lib schools land continue Distance Learning. If that is the case, it would be good to know and see how we can plan. We got a very concerned email yesterday from a former legislative aide now just a private citizen saying that we should be considering our Recreation Centers and Public Libraries and all in the vein of ensuring that we have enough space. Of course, we want to work in partnership with the representative labor groups that work in the facility, but i just want to say i know we have a joint committee that works with the board of supervisors and the school district. I dont know if any meetings are scheduled or any conversations are scheduled, but i know the school board is doing everything they can diligently to planened a push for this, and i heard of town halls and meetings that are beginning, but it would be very, very important to me as a parent of two Public School children and somebody that represents a district with significant number of Public School children that we are having this conversation now and that were able to see what we can do as a city to help facilitate that. Of course, always keeping in mind the safety and the health of our educators and our staff and our children and families, and also saying we need to be part of the planning process and dont want to be caught by surprise to find out her not going to have the schools open on time. The last thing i will say in that vein is as we reopen our economy and as we move slowly to do that very cautiously, child care is a very big issue for a lot of people. And that burden disproportionately falls on a lot of women and female workers, and parents and single house holds. It is very difficult to continue to work and educate our children in Distance Learning as we have. So these are very difficult times and i wanted to basically say that were here to help but we also want to be kept informed of the process. So if supervisor haney or others that are in charge of our joint School Committee that we can engage on that and have a thoughtful conversation on what the plan of schools for opening is coming up, that would be help l. Colleagues, i wanted to report out to all of you the status of the county veteran Service Officers position and giving veterans something they deserve is a huge priority of mine. I am thrilled to say that the office accomplish what is we set out to do and were and how long the position was vacant, i introduced a letter to the Human Services Agency Director asking for more information and may 11 i reported that it was posted publicly and qualified applicants were invited to apply. On june 2 i further reported to you that the posting was closed and the final was in the final stage of admitting candidates. The city administrator shall nominate a qualified candidate to be considered and confirmed by the board of supervisors. The executive director of the dont of disability and Ages Services is and has an impressive resume including a transition patient and with this nomination, i am pleased to and to confirm the nomination of mr. Simms to serve as a county veterans offer and this is the final step necessary to fill the position critically. And to insure that a candidate was nominating in a timely manner. I have the honor to celebrate the District Two Office and in early 2012 and since that time he has been a vital part of the offices constituent services program. To help constituents navigate city bureaucracy and city departments. One of the most Lasting Impacts quickly and efficiently and a Lasting Impact on the city as a whole. Alex has had a Lasting Impact on the city as a whole and one of the proudest equipments is saving the three jackson muni bus lineened aloved working on that project with him. When he learned about the proposal to eliminate the line, he collected over 1,000 signatures with petitions to the m. T. A. And brought Public Comment. Alex has mentored and shared graciousness, patience, and thoughtful sense of organization with us all. The resident of district two and San Francisco owe alex a debt of gratitude for the year of service to the community and the city, and i hope you will join me in designating tomorrow alex long day. And i have one more and this is when i wish we were back in chamber so she could take them and read them for me because i dont know if i will be able to get through this but i will try. I would like to close todays meeting in memory of Saint Vincent depauls pastor father ken westry. Born june 15, 1951, he passed away last week at the age of 68. Born and raised in washington, d. C. , father ken later attended the Merchant Academy in kings point, new york. After his time at the academy, father ken received a calling and attended mount saint marys seminary in maryland. As a seminarian, father ken found his way to the west coast where he attended st. Patricks seminary in menlo park. In 1982 father ken started his first assignment as associate pastor at Sacred Heart Church in San Francisco shortly after appointed to Saint Elizabeth parish and Began Service as a chaplain in the United States navy and active reserve. Before arriving at Saint Vincent depaul in 2011, father ken also served as pastor of Saint Sebastian paris and pastor of saint isabella parish. For nearly 40 years father ken has served the people of San Francisco with a particular focus on the most vulnerable populations and as a long running member of the board of directors for the San Francisco interfaith counsel, he was a unifying leader in our city. He regularly reached out to make sure that the families and michael pappas, the executive director said father ken was a visionary priest who served several terms on the San Francisco Interfaith Council board of directors including the first board. Including a former merchant marine and among the clergy and the epidemic and he was a kind and gentle soul who cared for the poor and fought for human and civil rights. He was a friend and will greatly be missed. He was so encouraging of my work and i remember him at mass after making waves at the blunt we said enough testimony about abusers. And he smiled and said keep doing what you are doing and dont let them shake you and beautiful and mischievous and has careyed me for years and Speaker Pelosi celebrated father ken today in todays congressional record. And father ken was for me and my family and countless other who is came weekly to listen to his homilies and to be a part of the community he led. Over the past few days i have begun to recall father kens road in my own Spiritual Life including watching father ken and my childrens sacrament and the first day i was sworn in as supervisor and called to let him know and not only did he show up and had the principal and my sons entire 7th grade class to walk down the hill to be part of it and i will never forget looking over there and feeling so supported. And difficult there for me. Sorry. I tell the story of one time and extremely rough day and the church i attend and walk up to Saint Vincent depaul to pray and walked into the empty church and knelt as i was taught from childhood and restraint to get through the ugly part of politics. And 20 minutes later the president er ken walked into the Campaign Office and not knowing i had been in the church to check on me and i took that as a sign and the entire staff thought i was crazy, but he helped me that day and i will never forget it. He encouraged me to campaign outside every mass, too, which i felt weird about but he insisted that i do it. And he told pelosi and dont let them shake you. Just follow your heart. And earlier today i joined with the Saint Vincent Depaul Community to mourn the loss of father ken and celebrate his life and he was a selfless man. And will continue to live on in the Saint Vincent depaul parish. As was said at the memorial mass today, it was a privilege to be left for his mother and the entire parish and school. Joy characterized his life and it was a joy and that power and compassion of god can get us through anything or whatever you believe in. He found joy, hope, and goodness in people and in the most important lesson he left with me and he believed the power of love could overcome human suffering. And father ken is survived by his mother, his sister, and brother. His warm presence and word of compassion has served as a center of guidance to many and he will be terribly missed and i am sure he will be hearing for so many of us and will continue to look to him for guidance in the times we find ourselves. I definitely want to extend my condolences to supervisor stefani. Colleagues, today i am introducing two resolutions. The first resolution is declaring antiblack racism as a human rights and Public Health crisis. This resolution is in line with our equity and justice packages about legislation that we will be bringing forth and have been bringing forth the last couple of months with the goal of improving outcomes for black people in San Francisco. This resolution was passed at the Human Rights Commission last week and will be working on the version very soon. And antiracism and opposition to you got muted. Supervisor walton. You are muted. Sorry about that. Our apologies that everyone is getting strangely muteed. Were checking into that. Thank you. And interpersonal and institutional or systemic interactions and decisions and processes and outcomes. And antiblack racism is the racism and Health Inequity and creates disparities in the wealth gap and education and environment and Economic Opportunity and housing that are available for black people. And this resolution creates that addresses antiblack racism and urges the agencies and to work with the office of Racial Equity and to prioritize and Racial Equity in all programs and understanding antiblack racism to reviewing internal practices and hiring promotions, leadership and leadership and codify ordinances with a Racial Equity lens. And in order to dismantle, institutionalize and must center as a black community in all aspects and the city and county of San Francisco and work and practices and initiatives. I would like to thank the Human Rights Commission. And i would like to thank supervisors ronen, haney, stefani, peskin, mandelman and safai for cosponsoring the resolution to push forth a more equitable future and to the black community in San Francisco. The second resolution is to support california bill 793 offered by senator jerry hill to expand banning tobacco flavored products statewide. And to ban tobacco flavored products and without f. D. A. Approval. Senator hill introduced the bill and the response to flavored tobacco use. And sb793 will make it illegal for any store that sells flavored tobacco and this would include more traditional Tobacco Products such as cigars, and chewing tobacco and products must show that the flavor was added and is different than simply tasting like tobacco. And this bill and the coalition of community and health based organizations locally and nationally. Sb793 recently passed and the Senate Health committee will be heard in the assembly soon. And thank you, supervisor walton and supervisor yee. Thank you, madam clerk. And other things i mentioned and reported out and policy committee and a few issues with supervisor safai to know and the policy committees is about reopening and working with children. And supervisor haney on that committee and so colleagues, today i am introduced the resolution to call nominations and multilying goods and multiplying goods and the nonprofit founded by the former first Lady Jacqueline Kennedy Onassis and senator robert taft jr. And sam bird in 1972. The commission is to honor outstanding individuals and the platform and the share impact and make on daytoday residents. And San Francisco had the state honor and in this Unprecedented Health crisis, and multiplying good and launches the one Million National award to spotlight individuals and organizations who are doing incredible work and these could be emergency workers. First responders and anyone who has made an impact even as smallest way and the goal is to receive one million nominations nationwide of everyday heros who should be recognized for the work and sacrifice and done by august 31. And San Francisco has so many stories to offer and join the hope and nationwide everyday and encourage generosity and positive change. And i am calling the city to promote the sam cane to nominate and in our own districts and city work force and that have stepped up during the crisis. So just a couple of quick things and that we are having a hearing on july 10 with the joint Education Committee and we will be discussing plans for reopening at that hearing. And also as supervisor and president yee said, we have a joint committee with the mayor and that president yee set up and i am the cochair of that as well. And those are both things and happy to provide updates and i dont think candidly and not as clear guidance as folks would want from [muted] supervisor haney, you have been muted. Im back. And there is a lot of reasons for that including that the state came out with guidance last week. And our own department of Public Health released their guidance. And totally hear about those concerns and to provide briefings for the supervisors who want with the committee working on this and i wanted to speak about the resolution on san quentin and i want to thank supervisor preston for your leadership and your staff and the Public Defenders Office and also public defender woods has been very active on this. And there are over 1,000 people who have contracted the virus in the single month and one of the largest outbreaks and in a california State Facility and san franciscans who work for and who are in custody and there are lutions and great urgency and call on the governor to take action to prevent the further spread to make sure people have an opportunity isolated and wherever possible to accelerate release for people who are older and maybe on the verge of being release and this is very dangerous right now and continue the way it is and people will continue to get sick and will lose their live. I want to thank everyone on that and on behalf of the city and take action taken. And introducing and announcing, lastly, that i am working with the City Attorney on a package of anticorruption legislation. And aimed at adopting the controller operation and yesterday the controller and issued the first integrity view and public works corruption and understood scored desperately needed reforms in our citys ethics and contracting and oversight laws and the problems outlined in the report. And the dire lack of external oversight and the lack of internal controls and former processes for contracts that lead to favoritism and the ability of nonelected city leaders and officials to solicit the payments without any reporting requirements and clear loopholes in our gift regulations are not new but the recent fraud and corruption charges that have shaken numerous departments have made it urgent to address immediately. And the legislation i am working on will close the loopholes and will adopt many of the controllers recommendations and to restore trust and transparency and reduce the risk of freud and abuse and taxpayer dollars. And thank the mayor breed reversing the nineyear decision and the Department Director and sole Oversight Authority and rightfully reimplement a check on the Department Heads of authority. And to be clear the department of public works and doesnt have a commission and unique opportunity for a lack of oversight and a lack of final checks over the power of the department head. And since the director was charged in january, there has not been enough progress to change the rules and culture of the City Government, and it is clear that we would havent to identify who the bad actor are and bring about more sweeping structural reform. We cannot afford to have a situation where the public believes that their money is being misused, that we are that city officials and bureaucrats are awarding millions of dollars in contracts to their friend with no oversight. And in some cases they are even getting kickbacks themselves. This corruption and the City Government goes forward beyond director and it is more about bad actors and the laws and the loopholes that facilitate this pay to play politics. I look forward to working with all of you to adopt the controllers recommendations and end this environment of reckless fraud and corruption. The rest i submit. Thank you, haney. I have today an ordinance i am introducing and a second in memoriam and the ordinance first and the ordinance to eliminate natural gas and require electric construction and new building and this is the latest step in the ongoing and resilient in San Francisco and achieve the Climate Action goals and last april and committed resolution to San Francisco doing the part to limit Global Warming below 1. 5 degrees celsius. And level scientists tell us is required to stave off is severe impacts of Climate Change. And last fall we passed the electric preference board that requires natural gas buildings to achieve Higher Energy efficiency standards. And earlier we had legislation by supervisor brown and taken up by supervisor stefani and required for municipal projects and i am proud this board passed the forward thinking niche tifrs and i look forward to taking this step on the path toward a cleaner, safer, zero emissions future. And residential and commercial buildings in San Francisco and submit a Building Permit application on or after january 21, 2021 with limited exceptions where all electric construction is not technically feasible. And this would the Development Pipeline and to plan accordingly and proceeded under current buildings areas and i am big change and with City Partners and labor housing and mixed use developers and engineers and advocate and technical experts and technically achievable and to meeting the climate goal from future hazards and natural gas is a leading source of Carbon Emissions and 80 and 40 of the emissions overall. And it is a Serious Health and safety hazard. And remember the natural gas explosion that levelled the entire 2010 and natural gas explosion and
