Today is my last day on the Planning Commission. I will be stepping off the commission to say yes to exciting developments in my professional and personal life. I make that announcement with the heartfelt gratitude. Over the last few years it has been my absolute honor and privilege to serve. Ive met so many brilliant and amazing people passionate about the future of our city including my fellow commissioners. You have become my colleagues and my friends and im grateful for how long weve had to serve together for the opportunity to have gotten to collaborate with each of you. Im deeply grateful for what you bring to the commission and your leadership and cant wait to see how we carry on and what you accomplish. I have a few comments and first thing i want to say to the staff is thank you and your work is tireless and the leadership inside and outside. Often for folks who work in the nonprofit or Public Sector we are tasked with tackling issues larger than us and often without the tools or resources to be able to engage and ive seen them take the challenge and run with it. Youve put yourself out there and see change and seen it in reimagining what the Playing Field can be inclusive, diverse and features racial and social equity as a practice and indicator. So i am deeply grateful to all the planning staff. I want to close by sharing a little bit about what i see in my reflections over my time on the Planning Commission. And some things that i hope that follow the commission carrying forward to keep in mind to light the way through this challenging time in our city to be better than we found it and one that really holds to the tenets and values of racial and social equity and justice for all. Ive often said planning is not just about the code its about peoples lived experience and their lives. How well wield our power to help the city evolve in the name of equity for all. In order to do that we have to get clear on four questions to be the most effective possible especially during this time of great challenge. The first is how to use the department and commission that atone for what Development Looks Like in the city and lead by example of doing our own planning and Development Work with the goal of reparation and evolution. So often Community Members will say that projects start from the time an application is applied for it and from that first preapplication meeting and the tone of those things sets into motion a see at the end of the project. Especially if theyre not done in a culturally competent way. So how are we setting the tone from the beginning of how were doing development in collaboration that will lead to Good Development outcomes. The second is how to spend more of our finite time and resources to craft visionary city wide policy. The city will have to do more with less resources given everything we know about covid19 and how its impacting the Financial Health of our city and something every commission and ive watched all the speeches and talked about the need for the commission to spend more time not less city wide and neighborhood specific policy to stabilize our city and the flourishing of our neighborhood and communities. We cant craft that visionary legislation if were trying to determine the future of our city project, project by project or in a way thats reactionary. I hope over the break we can reform the way that we structure our hearings and things like discretionary review to really elevate the conversation and help us reach the higher goals and needs of thes time in our city this time in our city. The third is how we stop the trauma and pain being inflicted on communities of color by changing our code to recognize the impact of gentrification and being proactive in working to stabilize the communities and showing the community as they matter by shifting those in risk of displacement. Affordable housing has been displaced for market rate housing as long as that happens and Affordable Housing is only a fraction youll never reach your equity goals or affordability goals. Until we have findings related to those things our racial and social equity work will always be discretionary. A more equitable feature cannot rely on discretion so we need to find ways to really rectify the code to reflect those values. And lastly, i always thought my time on the Planning Commission would be facilitators of larger question of values and the future of the city we want and how we all get there together. We have to answer these larger questions about how we enable the city to evolve while keeping and holding our shared values. And really encourage us to try to continue to elevate the conversation in ore own minds and at these hearings because the old ways dont work and we can fight each other on whether its an affordability or housing crisis until were blue in the face and nobody is left to live in the city or can recognize what unifies us is that we want a better city where everyone has the opportunity to live, work and play and where social and Racial Equity are foundations of the city and its time to be brave and bold and do those works. Those are some of my reflections. I hope we can cut through the fog of the San Francisco summer and project inertia and take a broader view of our role that is ours to make and feel great pride and excitement this group of people who are on the commission now along with our planning staff and our Community Partners can make it happen. I wanted to make comments on sc35 and how it relates because the issue came up a week ago and we can get you more motivation on this too and its the streamline housing and cities have not permitted sufficient housing to meet their eightyear goals and theyre devised with lower and moderate income. Currently the city is meeting the above moderate goals but not the affordable goals. In projects with 50 or more affordable can move through the process under sc35. As we look to the next cycle our expectation the goals will be two to three times larger than the current cycle. The timing is interesting in how it work. Sc35 needs to be reauthorized in 2026 and its unclear whether the requirements will still be applied. Its a look back over four years. Once the goals are set the time is divided between the second four years and first four years and if we met our goals when it takes into effect. Its complicated. We can give you a memo to explain it more but the provisions of sc35 wont ness lay ply necessary apply until the new goals are adopted and theres time to look at how were meeting resources to have more information on that in the coming weeks. And the citys lead in implementing shared spaces and im sure as youve been out and about the last couple weeks youve seen the popularity of shared spaces. Weve approved over 600 sites sidewalk only, and sidewalk and parking lanes and roadway improvements and our staff has been instrumental in implementing the program. Theres been 1 closures. The first 12 closure the first in chinatown. Were excited how this is rolling out and moving forward. Its not without kinks. Were working to improve the time line and working with nonprofits and communities to make sure were reaching out to neighborhoods that are perhaps under resourced and i wanted to give you a quick update and thanks our staff for their efforts in the report. First was the supervisor ronin ordnance to allow covid19 activities as temporary uses. This is continued from last week to include the Planning Commissions modification to extend the permit from two years to four years. This committee submitted it to the full board with a positive commission. Next the commission will codify the item from may 21 and voted approve the ordinance with modifications. It included one in lieu of codifying the program permit at the firststory uses to the corridor vitality for a temporary period of three years and two, maintain control on exist specific uses when existing restrictions districts or other measures quantitatively limit them and the measures were not included in the ordinance and moved forward as is. At the land use the committee expressed support and supervisor ronins office requested to exclude the nct and other comments were in support citing the need to cut red tape. The board voted unanimously to approve the ordinance. Next the committee considered supervisor fewers ordinance for the educator housing streamliner program prop e to alone extra hite height and reduce the lot size from 10,000 to 8,000 square feet. You heard the item july 16 and voted to support the ordinance as drafted. And a positive recommendation. And supervisor yees ordinance you heard on the 16th was not heard this monday and will be heard at the Land Use Committee late august. Land use Committee Held a hearing on the citys affordable and how long sustainability needs and relevant Planning Department reports. The supervisor wanted to emphasize the importance of data and wants the city to prioritize and address the Housing Needs of residents and community to ensure diverse and Equitable Society and it needs to be the core of the housing policy framework and stated there is a need for measurable data and quantitative goals and metrics and the city can only address what it can measure. Planning staff delivered a comprehensive presentation with an overview of racial inequities and the impact of covid19 on vulnerable communities and an overview and timetable of mandated reports including area plan and housing reports and reports related to Economic Activity and allocation of impact fees. The summary finding of the summary of inventory and annual report and the 2019 housing pipeline and overview of the departments housing strategy and the 2022 Housing Element update efforts. During the Hearing Committee recommends various ways the department should present data with accuracy and Committee Members expressed concerns how racial and social equity are being met and wanted to ensure the racial and Equity Analysis didnt take a backseat to other demands. Other recommendations by the committee were to include data at the Regional Housing level including developing a dashboard that compares San Francisco to the rest of the bay area and to clarify how the city quantifies the loss of rent control. A lot of comments addressed racial and social equity issues and the issues the Planning Department has had with the African American community and want to prioritize the community of color and want housing reports to show the racial impact of housing imbalances and the city to address regulations to help maintain the seg ret segregated workforce and comments also stood along the lines of those who wanted the city to only allow the construction of 100 aAffordable Homes for the university versus those that wanted zoning control to allow more market rate housing to meet existing demand. As a followup to the hearing and preliminary assessment of housing will be presented in august and the report is targeted for delivery to the committee by the end of quarter three, 20. 2020. And next the committee continued the ordinance to exempt Affordable Housing for density limits to a date uncertain and finally the Committee Heard the two legislative items for the balboa reservoir project and they heard the items may 28 and recommended approval with supervisor yees proposed amendment. At the land use hearing they did not make recommendations because the pending ceqa appeal but recommended it to the full board without recommendation and they urged the city to build housing as soon as possible or sell to the private developer or turn it over to a city college or turn it over for 100 Affordable Housing and there were neighborhood preference radius for Affordable Housing and adding a unit clause and they ford forded forwarded it to the full board with positive recommendation and the zoning map for the hub project passed the second read. Supervisor ronins ordinance to amend the Zoning District passed the first three as did the ordinance to allow the parking lot behind the theatre to continue operation for next five years. Supervisor peskins resolution issuing landmark resolution for california fresco was adopted and they considered the proposed project at 2651 octavia to an existing twofamily residence and the subject is next to the golden gate valley library. Heard the item february 6 at a discretionary review and voted to not take br and accept as proposed. The appellant asserted the department issued the september 5, 2017 improperly issued without analyzing the Historic Resource impact from the library and issued without a shadow study assessing the project affects on the amount of Natural Light in the reading room and the correct cad x was not included in the staff report prepared for the Planning Commissions hearing. In response the department contends they analyzed on site and off site Historic Resources. No shadow analysis is required because the project is less than 40 feet in height. The category of light in the library is not a characterizing fee fewer in the report and would have negligible impact on the light in the reading room and the cad x for the dr hearing the clerical error did not misinform the Planning Commissioners or members of the public because the staff report clearly state the stated it qualified. The supervisor said the department made procedural errors and did not assess for Historical Impact until after the preservation review memo and prepared a shadow study after the cad x. At a result the supervisor made a motion to overturn the environmental determination which passed unanimously. Staff will carefully review the boards findings once drafted to see how the decision impacts their ceqa review Going Forward and impact on the project itself. Thank you for your time. Caller i want to propose some things you could be advocating for. You could be advocating for a category of housing but not actually housing. Theres a category that you can create non existing housing and being held for investment and should to be for inventory and you should be advocating toe to secure sites for Affordable Housing. Im calling because i want to reiterate something about the reason for section 817 the numerical articulation. The point was to preserve housing and maintain financial accessibility but allow for alterations that were reasonable and did not turn into de facto demolitions. Its a marketbased attempt at a solution and they have not been adjusted since enacted in 2008 and that was part of the marketbased solution to try to come up with the problem that was going on for years. I checked it out and sent commissions and everyone else screen shots it was an alteration with horizontal extensions and gutting of the inside and the whole new facade that was owe political rated and now obliterate and its now a large singlefamily home and it sold in march 2020 for 6. 3 million in the middle of a Public Comment is closed pandemic and youre talking about an increase of 4. 65 million over that period of time. Thats above the average of everything ive monitored on list ive sent you of projects where its usually 3. 5 million for similar projects there were no demo calcs but i think im keyed to whats going on after looking at them for six years and showing commissioner johnson and Vice President moore photograph of these projects and the staff as well. I think projects like this and many others illustrate why it should be adjusted particularly since nothings been done or concocted since 2016. I want to point out this property has not been available for housing since 2014 so think about that in terms of housing availability. Thats all. I sent a screen shot. Look at them if you can. Next the point that was brought up of an inventory of vacant units is a wise thing. I remember there was a time back when you did an inventory of vacant parking lots and things you could build more intensity on. I think you should do more city planning that address the needs of communities of color and all the type of housing that we need to accommodate low income residents especially tenants. Ed the, i like the presentation last week on the state bill but didnt go far enough particularly the impact on tenants. We want to know when the bills come forward whats happening to the tenants in those buildings . There are no provisions the housing legislations do not provide for the tenants or commission or our voices to be heard. I would like a little bit more in depth followup on not just the selling points of 902 and how great it would be and we would save money, no, but what is the cost . What is the cost going to be as evaluated . Whether or not we like these things. Thank you. Caller i wanted to talk a little bit about planning code section sb17 and db330. I think the Planning Department should reevaluate planning code section 317 demolition protection in light of the justification for planning code 317 in 2008 is old houses are rent controlled whereas new houses are not rent controlled due to costa hawkins but theres an exemption that said when you replayed a rent controlled unit it had to be replaced by a rent controlled unit and if you modify it to say you can demolish a building as long as you replace it with rent that is affordable to the new tenant we should put it into state law. And wave code requirements that are for a period of seven years. And i mentioned this when we were talking about 2005 17th street and the Planning Department and we can modify our Building Code to do something similar to what sd330 would have done and we waive open space and requirements to a 7. 32 for adus. After this we should look at Building Codes section 1207. 2 specifically the 7. 5 ceiling height which is the issue last week. Thats something we could override if we wanted to as a charter city. And Building Code section 1204 were the only city that requires Natural Light and ventilation. The state and national Building Code allow mechanical ventilation and rights and we could waive that if we wanted to. Clerk thats your time. Caller its been a strange week for me. Ive heard all sorts of Public Comments and hearings. Its strange were currently market rate units and theres comments that we dont need anymore market rate units. Ive also heard that we over built on market reg units which i have to say sadly i wish we did not need market rate units. The fact is the Planning Departments own Housing Affordability priority have shown over 80,000 households which make over 120 air median income. Of 2016 Affordable Housing report market rate tenants or occupants will start to occupy homes which are otherwise affordable to middle class. I also heard theres truth we dont need market rate units because they call for more Affordable Housing and some are occupied from someone from outside the city. In fact a 2015 report showed 84 of our homes are occupied by [indiscernible] in the city. Its impossible to make the point that theyre occupied. So i recognize our equity work will not be the responsibility of the division alone but of the entire department and commission if were going to be truly successful in centering our work. Before i start with the presentation i just want to take a few seconds to thank commissioner johnson for a very honest, powerful and thoughtful leadership that is allowing us to be where we are right now. I want to thank you for caring and for conveying the voice of our community. Owe want to thank you for challenging and finding our staff across all levels. I want to start by saying we want to acknowledge underwork. The work of our Community Leaders and the work within the Planning Department on racial and social equity. This has been going on for a while and there are essential pieces that were set in place and in motion and thanks to that, we can make a stronger move. We also want to recognize that your leadership in talking to resolutions is giving us a new opportunity to rethink what the city could be and what the role of the Planning Department could be. Ill start by summarizing key points in our preliminary responses to your resolution and then claudia will provide you an overview of the progress that were making on the planned phase 1 and 2 and some next steps. First of all in terms of prioritizing equity across the department, ill elaborate on those two points that you made very clear that we need to strengthen our dialogue with our communities especially the nativeamerican and black community, communities of color and advantaged communities. In extending resources and elevating the Community Equity work ill provide some details to what director hill has already mentioned. In terms of staff, we have shared with you this components but i want to summarize were working on recruitment and hiring practices, on training and staff on addressing equity objectives within our performance and continue to ex employer how we are handling our internships and engagement work. Were also addressing the equitable resolution in terms of policy and strategy and analysis and metrics. On policies and strategies, director hill is leading the economic housing recovery work as part of the over arching recovery strategy nor city and the for the city and the Housing Element is beginning the racial and social equity. In terms of analysis and metrics. We continue to make progress we have applied the equity budget tool to our proposed budget and continue to work on additional metrics. More of this work will proceed once we engage with more substantial conversations with our Community Leaders. Community engagement being a central component of the resolutions. We are summarizing what we have heard so far. We understand the challenges our communities are facing right now and we want to make our engagement efficient. Que have heard statements and claudia will walk you through some of those and want to start compiling with what we heard and well be sharing that with you. Second, well meet Community Leaders to discuss what you have requested racial and social equity definition and how we frame it within the Planning Department and how we elaborate and define the phase 2 of our equity plan. Now, more specifically we have on our Community Engagement strategies on the ground we have shared a memo that described how we address the Digital Divide and how we address folks in an efficient way and getting to communities who may not have the virtual resources some of us do. Were integrating Community Engagement and were expanding the engagement resources for the targeted communities that have experienced historical racial and social inequities. This is a short picture of this which is as director hill was flagging, we want to elevate some of the equity work, racial and social equity work within the department. This is not to exclude the equity work from the rest of the department. Its to help us to make faster progress, progress and more efficient progress. It was successful. This should be dismantled in five or 10 years and equity will be integrated across all tasks and divisions. In this division well have one focussed on the racial and social equity plan and one unit focussed on Community Engagement that integrates communication for the entire department with the voices on the ground and one that includes the Housing Element and the housing recovery strategies. Again, well have staff within the units and have staff across the department coordinating with the unit. S the work has been done in close collaboration with our city agencies and Community Leaders. Well be convening a group of Community Leaders to advise and inform the work that we need to do. Were also considering kitchen cabinet, meaning a group of experts to advise us on the strategies most effect pitch most effective and the office of social equity remains very tight. Our collaborations an communications and we have strategy approaches with them and well continue to review updates on the progress were making and were also Affordable Housing the supervisors and mayors office. I want to give you an update on phase 1 and phase 2 and provide a little bit of an overview of components for members of the public who may be tuning in for the first time. This time line shows the components on the left side across the phase 1 action plan you adopted back in 2019 in november. Its under implementation. We started implementation even a little bit before adoption. We have a plan we are finishing up guidelines and framework for the department and ideas for matrix. Well be refining that and finalizing it and well put it aside and well continue to work on integrating that direction. And well be releasing a draft framework in early summer or fall to have the discussion mir yal alluded to miriam alluded to and we started Community Engagement which had to be suspended due to covid and get direction on priorities and definition of equity. Well continue the work on the plan to continue the plan by the office of Racial Equity. Phase 2 is implement doesnt have to wait for adoption. Were planning to come back for adoption in 2021. We can begin to do so as we identify priorities. And more on engagement. Well have listening sessions and well have to be coordinating to make sure were not over taxing our community particularly right now. On the last row the first update is due by the office of equity in 2023. Well be updating at that point. Theres a nap shot and well work snapshot and well work to augment and add pieces to our phase 1. In addition to the tasks theyre additional implementation priorities for the fiscal year and advanced training for managers since they set the tone and recruitment for guidelines and hiring activities. Well work with them for a more confident and equitable hiring strategy. And well have summaries we are producing. Theres been a lot of ideas including from the hearing back in june and actions we should undertake. Issues we need to Pay Attention to and that will be in the framework for discussion. We talked to the Community Around the work area and asked questions about the process and how it could be more equitable and specific policy discussions theyll happen in the context of our project. Equity policy related to transportation will happen in the transportation element and so on and so forth. These are highlevel things we have planned and we were barely able to scratch the surface and theres so many communities we still need to talk to. In regards to communication i hope you can hear me okay, we heard some information members still need to work on developing our cultural competency and when we do engage communities or communicate with Community Members for an equity voice meaning they want to see our Mission Statement and our website and our communication and i think it will happen more directly and well have permitting work and ceqa work. And theyd like to see more in the staff report and important resources and for equity goals a more practical approach would be ideal. And support was in their mind and will continue to be so and the Historic Commission directed staff as part of the lift historic and cultural preservation and in legislative work they showed some Community Planning work needs to be better coordinated and approach the Community Together and this will also help Community Members not feel overtasked and the need for more Affordable Housing. Some want more requirements and then finally for us to continue working on diversifying our staff and Community Investor values. Ill repeat the goals and the third bullet is to continue implementation of phase 1 and equity resolution. And from the office of Racial Equity and have discussed it a bit we should be prioritizing high impact level changed and we need to identify those and continue to build staff capacity for social equity and conduct equity and analysis and Prioritize Community equity within the divisioniment division implementing the new division they spoke about and that concludes the staff presentation and were available for questions. Im originally from oakland and always think about how San Francisco impacts oakland and vice versa. Its difficult to try to figure out how to have an impact on the city of oakland but the things that are being discussed and out of this work do have a larger scale than just the city. Whether its sharing the findings with other cities around the bay area and trying to Work Together, i dont necessarily have that solution. I know everybody here is interested in equity beyond our square miles. While we can start here one of the great things about the city is we take good ideas and we can improve the world beyond San Francisco. We think thats really important. The other piece is obviously pushing all this forward and if the people who build the housing are not understanding this and implementing this in their outreach and conversations with communities, then its not going to be as successful as it koud be. Wed like to play a positive role in the conversation and information sharing and training and we want to be a collaborative partner and however, i can help facilitate that we can do that as an organization we very much would like to do that. Im excited to be working on the policy committee for elements of 2022 and i am also happy i worked with the Central City Coalition to get a project going for the hub area that addresses the social and Racial Equity needs of the communities in district 5, 7 excuse me, 5, 6 and 9. This moment during a rise up against the police state and extreme working crisis for people during covid19 offers the ability to analyze and reflect to what brought us to this point. We cant continue with the same land use policies that perpetuated structure and caused extreme wealth and inequality and determining who is welcomed in and first out. Data has shown theres been an influx of wealthy predominantly white people and black and brown and lowincome and working class residents are being pushed out. Continuing the policy by draining the development of market rate housing aimed at multicorporations is the problem not the solution. The Planning Department and commission need to reflect this reality by making concrete changes that put planning and development in the hands of communities and working people and lowincome residents. Community voices must lead the process of crafting strategies for racial and social equity. Shifting to a model of communityled planning offers for the commission to take the lead from impacted communities themselves. Instead of workingclass communities we can shift to a model of planning that shifts to people on the ground who know what is needed in the community. Across San Francisco theres an overabundance of Market Rate Development we need Affordable Housing and we urge the Planning Department and Planning Commission to apply these racial and social equity lens and analysis now to projects coming up. The proposed 1145 Mission Street market rate Housing Project is a perfect example and should be used as a case study for Equity Analysis. We need to ask what is needed in the community and the development and whos benefiting and how the community will be served. Thank you. Caller this is sue hester. At the board of supervisors meeting on monday with the housing presentation, one of the most important questions that was raised i think was raised by supervisor mar, he asked how to proceed and set priority around housing. Thats an important question because as long as the department is funded by the developers, the attention to this just in course of reality by the planners and supervisors in the department is getting these projects approved because it generates fees. So one of the questions that needs to be answered thought through is how do we render decisions on social and economic equity. Theyre unrelated to feebased budgets. Thats something that needs to be thought about. As a person involved from start to finish on these plans its evident area plans are one of the down falls in the Planning Department because they assume the area plan has a life over 20 years and the circumstances are very different when youre doing the planning and doing the approval of projects 20 years later. And you had had a lot of pushback on the mission because of location and thats how area plans are put together and their effect for the long term. I would can two things. One, is think through how do you area plans and what is the feebased structure of the department and who is on the automatic going to be paid attention to because theyve mistaken get getting a project through. I with a bit able to make the working Group Meeting this morning to speak on this and i wanted to express my thanks working on the plan and for the comments sent in. We cant say goodbye to racist housing policies until we say goodbye to racial [indiscernible] and we have to abolish our racial segregationi segregationist zoning. And i urge the commission to advocate for option three that pushes for more housing in previously racially segregationalist parts of the city and another topic is below market rate and will come forward in the sunset but still has to go through a lengthy process to get built. Its time to say its not okay for wealthy parts of the city that have benefitted from racist zoning policies to say sorry, we dont want apartments in our neighborhood. Its never okay to say youre only allowed to live in this neighborhood if you have 500,000 to spend on a down payment. Im looking forward to pushing for more equitable zoning in the city. Thank you. Im a resident and im calling to reiterate with the speaker before me said and highlights the fact that the lengths between exclusionary zoning and racism is well established and something that San Francisco unfortunately has a long history of and something we need to do better in. The first thing that we should start doing is looking at how we can up zone rich exclusionary neighborhoods on the west side where have you singlefamily housing where we have heavily invested in service and have 2 million and 3 million homes blocks from the train station. It reflects a history of racism and is contributing to racist outcomes and its something we have an obligation and duty to fix. Thank you. Caller good afternoon commissioners. As we talking about social and Racial Equity and planning its important for you as commissioner to drill down and recognize and reflect that one of the facts of the clear nexuses between equitable without comes and goals and land use is making sure the men and women who actually build the buildings you approve are treated and paid standard wages and having investment both in long term Workforce Development and Skill Development as well as their retirement future. Measures such as the housing sustainability measures such as the soma plan is a key element. I hope you can keep this in mind as you go through the planning process and look to capture benefits immediately from development and find ways of grounding them directly in the communities more impacted. While reading this document i designed it actually i cant believe this is working on and were starting with the histories of the planning. In this way im thankful we have this going right now. As im reading the regulatory and Design Review in the light of the last hearing too there were rent controlled units and removal other units and in tracking the Housing Units theyre complicated issues. At the same time when from what i experienced especially from the last two hearings with rent controlled units, usually the commission were contacted in terms of the tenants or People Living there. And so what happens is that were looking to a building in itself and not necessarily looking to the people which we always say planning should be about people and the quality of life. Because of that i was also thinking the relationship between Planning Department and other cities interested such as a rent board i think we need to have a strong relationship or great liaison where the planners can look into the situation in better context in terms of if there is a statement or not just the history but other history that tends to affect the people that will be impacted by development. Thats one thing i was thinking of as i was reading this. There are new developments that are asking for authorizational conditional uses and sometimes when you see it in discretionary reviews itself we have a lack of context if were going to take into the racial social equity lens and the picture of that neighborhood which i think is also going to be part of it and its good to have that context as we are going through into different kinds of uses. I read a comment i would like to highlight a comment made that needs to be thought out in terms of the fee scheduling or how fees are being used and the buildi Building Supply and how are we going to imagine the area plan taking into consideration the benefits and the fees implemented. Is it an adequate fee and how its going to be applied. Those are big issues each department and planning and this is going to be a big tackle for all of us but something we need to think through each department of the planning and im glad there is proposals going to happen for the equity budget. I would like to ask if you can spend a few minutes telling me who are the groups you have been engaged with because many times when we engage in the larger efforts somebody is saying well, we havent been contacted or havent participated. Since there were only some speaking with mr. Wu making comments, i didnt hear who anybody who had participated or had additional suggestion to make. Can you please comment on that for a second . We started with interviews and were preparing to do larger focus in Community Meetings before the shelter in place started. Away kw we conducted a focus group. We did a presentation at the magic and its a coalition of several organizations in the bay view and the presentation was done in the valley and tenderloin. I can get a more detailed list and several interviews done with some of the mission organizations. Were prepared for more robust outreach and were prepared to do focus groups in chinatown and western edition and then shelter in place happened. Were regrouping and figuring out a robust way to continue that outreach and make sure we hear from all of our different communities. Thank you for sharing a little bit of the background. I think conventionally there was a way to call but i do believe social and Racial Equity is also based in not hearing the smaller voices who are not organize the but have an equal say in what racial and social equity is all about. Its asking for every voice and participant and glad were seeing the signs to normalize and invite people to larger public hearings in an auditorium to hear what people are experiencing and how it can inform us. The one thing i would like to add most of you talked about that before, i believe therell be a layer of voices that can speak knowledgeably to how particular communities and communities of color will be affected past pandemic. I think that voice will share another angle and big spotlight on to social and Racial Equity. Were hearing certain reports from the department of health that speak about the Health Practice and how people are lowincome and disadvantaged people are being affected. I would like it take that experience directly into the social and Racial Equity discussion particularly as it ultimately theyll engage in the idea of the physical design. I believe physical design has large loopholes relative to social and Racial Equity and i would like to see those particular subjects picked up and integrated moving forward. Thank you. Clerk commissioner chan. Thank you, for your leadership and making this work a priority. Its great to see progress in taking these actions as destroyed in the resolution. As described in the representation and thank you for the presentation and for your dedication and commitment to this really important work. I want to say i find the staff report and outline plan encouraging and moving in the right direction. I do want to point out a couple question and comments. One area where i see us spending more time thinking about is the role of the commission and how the commission fits into all this work. I think its a great time to reflect on the role we have and what we need and the efforts of the department. And ive been thinking about what tools would help the commission do this work. The commissioner was talking about this in terms of a greater context in which we are evaluate and understanding our decisions. For example, we read thousands of papers in our packets each week. A lot of material to digest and i would love to see a standardized Racial Equity assessment or some framework that is integrated in all the reports we can have this frame work to consider. Speaking to some specific items in the packet so for exhibit d the summary its insightful and left and many project sponsors do not know where, when or how to engage in Community Members and made me wonder if the plan can more explicitly articulate why we do see engagement in terms of the value and benefits to the project and i think in some ways maybe we could support a process transparent for public sponsors in understanding the value and benefits of Community Engagement and in a way we can link this explicitly to our expectations of the department and as a commission. I think we have some precedence and i feel we need a rubric for the scorecard. A heavier weighted standard for what planning and engagement would be to have transparency and elevate and reward partnering with the city and a housing affordable challenge. Second comment i want it make is the feedback that communications are overly technical and monolingual. I think thats something i agree with and i think it raises question how to meet people where they are and it may mean taking inventory to understand what channels or platforms people are currently using and engage people where they might be communicating with other and thinking about who our audience is as were writing Commission Report and document and are we writing or the lay person and i think. Commissioner johnson. I want to thank you so much miriam and claudia. Express how much we have for the community and i just feel so grateful for your leadership and congratulations miriam on becoming head of the department and i look forward to seeing other work Going Forward. So i have a few things to say just in thinking about in addition to this plan some things we might consider. I would say the report is wonderful. I really appreciate how you laid out the feedback you have already gotten put our efforts and context of the larger city efforts and i think responding to all the conversations that youve had at the Planning Commission and oneonone conversations and feedback in the right direction and tactical on the things we need to change and i know that [indiscernible] but theyre crucial to be able to have information as a way to move forward to create the change we are needing to make. I want to echo the thanks to director hillis for your leadership right out of the gate. A few things to share. There was a great cart that came out this week great article that came out and i want to pull out a couple things and also some suggestions. One, in thinking about all of our lists from the framework. First we talked about Affordable Housing and being tied to market rate housing creates this dynamic and how do we get past the systems to help provide housing and Home Ownership opportunities for folks. Next is zoning and allowing multiuse family developments wedge right to return program and payout with acts of atonement for lending and development. She talks about Home Ownership distribution and antidisplacement and until we have conversations that can be in the code so much work is discretionary and i think its important we take a look at that. And things to create to the list as were creating the department and organization every department should have a cultural competency budget. For several organizations it help those helping us on our cultural competency and helps to demonstrate how much it costs not to have the expertise in house. Another thing id like to say si think discussionary review when we think about Commission Time and staff time and the resources that well need to do this work i think somebody needs to mute themselves. Discretionary review is an equitable use of resources and needs to be reformed. We need to ask whether or not the departments liability based on use is the right structure to be able to carry this forward. I think its important we at least have that conversation and give it the discussion it deserves. I would also agree with the assessment that its crucial that if were going achieve the goals we have around Racial Equity we need to coordinate with other cities in our region. The piece i mentioned came from a planner in oakland and i think we cant do this work alone and well need to collaborate in order to achieve the goals. I do think the work doesnt happen without the eco system and every part from developers and project sponsors to neighborhood groups to our planning staff to our commissions working together. In order to do that we need a framework that makes it very clear from a departmental standpoint a reason for doing this work, what it means to do meaningful, cultural competent Community Engagement and what are the outcomes youre looking for because i think theres often the idea that perhaps people dont want to do this work and sure, that may be true for some people but i think how we invite people to help us get to do this together is actually how unified a city and make sure we can actually implement those goals. Those are my thoughts and thank you so much again for all your work and your leadership. Clerk commissioner diamond. So i too want to thank both claudia and miriam for all their work. In addition to that, i want to observe or comment on one observation i have having been on the Commission Nine months and watching how the process works. That is about the time a project is in front of the commission, it is often two, three, four years in the process. And Community Groups are appearing in front of us when a lot of work has already been done on the project and people tend to be very [indiscernible] in what theyre trying to accomplish without a lot of room for negotiation. It strikes me we need to rethink how to do the process and what the role of the commission is. When market applicants submit ppas theyre already fairly set to what it is they want to do and spend a great deal of money of architects and lawyers even prior to the ppa because theyre trying to have a quote, stable project description to bring to the department. I think we need to mandate a process that has project applicants come work with the department and district and Community Groups when the project is still just an idea on the table. Community groups need the opportunity to speak with budget appropriate proponents before a lot of money is spent. We dont want them to have to weigh in at the last moment. We should be respectful of what theyre trying to planning at the earlier stages of the process. And while the commission is on the project i want to shift the engagement back earlier in the process where theres an opportunity to really reshape and rethink how we accomplish our goals including racial and social equity. Just a suggestion that as we are thinking through phase 2 and how to implement it, i would hope we spend some time thinking through how the entitlement process works in a pragmatic way for our social and racial initiatives and i want to agree with the comments made about the disproportionate amount of time spent on review based on other significant projects we undertake as a commission. Its clearly important and its important in resolving disputes but the amount of time it takes on our agenda relative to the other projects is something that i think we really need to rethink and come up with proposals for how to handle. I would suggest that too needs to be part of this discussion but again thanks again to miriam and claudia for all the work theyve done today. Clerk commissioner koppel youre on mute. You have before you a request for determination that shadow cast by the proposed project will not adversely effect mission play grounds. The proposed project exists of demolition o. Eighteen dwelling units sales and service space. Bicycle and Parking Spaces. In order for this project to proceed the commission upon the recommendation from the recreation and Park Commission must make a determination that the shadow play ground will not be adverse pursuant to code 295. The department has received two letters and six phone calls in opposition. The opposition includes concerns regarding the height relative to the neighboring buildings and more specifically to elevator stair penthouses. Concerns about the topography of the size of the units. Impact to neighboring businesses during construction. The project sponsor will out loin for you thoutlineoutline. The units in particular will be rented out for 900 a month. Unprecedented or unheard of rent in the neighborhood at the time. Next on deck. The project proposes a commercial space. The project sponsor is the owner and operator of the phoenix irish bar on site. Theyll be owning the building long term and operate tg as aina rental unit. The project is in the Mission Neighborhood across from mission play ground. Next slide, please. Now the project will cast a very minimal amount of shadow on the new play dprownd. Oground. On the worst day of the, shadows will be cast for eighteen minutes. The latest the shadow is ever cast is 743 in the morning. Next slide please. The shadow that the project does cast is a sea side area, the corner of the play ground. Theres a view of the tree in between the project and the shadow and as we all know, shadow studies conducted for this project do not consider or take into account trees and other landscaping. Practically speaking the tree is going to resist further the shadow that it has. Despite the minimal amount of shadow, significant reduction to the buildings. Half the top floor will be cost. Two to four of the dwelling units. The project sponsors already remove the roof deck, reduced the size of the roof top equipment. Theyve done everything to shrink down this building as much as they can within the height limit. As were considering the shadow impact we have an extremely small amount of shadow and balancing the significant amount of impact this project would take on given the shadow. Theres a recent building that is just a couple buil buildingsh across the street which is a fifty foot Tall Building and it doesnt overly overtake the street. As i mentioned, the project sponsor is the owner and operator of the phoenix irish bar. He has been a part of the neighborhood for a long time. That should show the amount of support this project garnered. Thirty five letters of support from closes in very close proximity to the project. These buildings mostlymore than one tenant and maybe different owners than the tenants. It doesnt reflect 100 necessarily just this is where thirty five of our letters of support comes from. Recommend the finding of most significant shadow impact. Due to the minimal shadow impact were requesting that commissions make a determination that no impact is made on the play ground from the project. Thank you. And were here to answer any questions. There are already a bunch of trees at the play ground and they provide shadows. Sometimes people rest under the shadows. Some people like the shadows. If you look at the project with two very low income units. This should be a no brainer. I strongly support the project. I cant foresee the shadows being a problem at all. Thank you. Good afternoon commissioners, im a renter in the city. Im speaking in support of the project. We need more Affordable Housing opings in the city. Im excited to see an 18 unit building with two units very low income and the other 16 units are very affordable. Its going to help our housing crisis. In terms of the shadow impact, as was set the latest is 745 in the unit. It speak it the problems in the prop k measure. This is a silly loop hool for the partloophole for theparty t. We want more people to live near parks. It it shouldnt be that wealthy home owners get to enjoy open space. People in the mission should be able to enjoy open space as well. We should let more people live next to parks. Its near trazzity trancity trat neighborhood. Them being able to walk across street to a park and hop on bart, its go to go help low and moderate income folks. This is weird project timing. The thre 311 notice deadline isg on. One of the issues that i really care about is nailing down the affordability long term. These are escrow units in mission. If theres any concerns about the housing nature of the project, they have peoplepeople have additional time to file dr. There should not have been a hearing this much in advance of the end of the common period for 311 or the 311 chat notice should have been sent out to have notice sent out before the Comment Period has ended. This is a concern of mine. Ive been involved in a couple cases that have shadow the park as well. They said it wouldnt be very important because it was in the flat part of valencia street. The trees were cut down. People said the trees cast a shadow. The park was redesigned after the project was approved. That is the main concern is i have is the timing of the 311 notice is weird to say the least. Bye. Good afternoon, commissioners. My name is sarah. I live in the commission the mi. I want to speak in strong support of this project. There was a period in my life where i experienced housing insecurity and homelessness. It took a lot of work and a lot of commitment from San Francisco to help me get back on my feet. Part of that allowed me to transition from the shelter system into an sro just down the street from this project at mission at 16th. I lived at 1941 mission for a time. That is filled with working class families, children, elderly people, exactly the kind of people who would benefit from a project like this. This is perfect for people who would be working in the neighborhood, people who know how to be resourceful and make the most of the small space. People who can afford a smaller space. I think we need more sros in San Francisco. They are a part of our tradition of making the most of small spaces and enjoying life in a thriving city where people can participate in their communities and in society. I just want to say this is a wonderful idea. I think its a perfect fit for the community, for the neighborhood having lived in it myself. Such closer to the area, im in strong support. I love shadows. Whatever the shadow issue is here, the benefits far out weigh any perceived risk here. Please support the project, its perfect for the mission and wonderful use of an important resource of the land. Good afternoon, commissioners. I live in district two. Speaking in support of the project. I think its great that the Property Owner is choosing to build housing. We have talked with the commission before about the fact sro rooms are an endangered resource in the city. One thing id like the commission to consider is toparties like this. A shadow which is legitimately imminent. The shadow in fact is under these parameters where its so small where its truly negligible, the commission can approve the project. I think this would reduce your case load. It creates less uncertainty and burdens on projects that maythe one corner abuts into the park. Thats one thing to consider. Thank you. This ends my comment. The owner imposed rent increases that we could not afford. I would caution the board to not listen to Community Members like me to stay in San Francisco. I would love to move back to this neighborhood. I will always support projects like these. The fact that were facing a discretionary review on this project because of a tiny shadow that owshadow. More shadow can be a good thing in some cases. That being said, i want to good back to the fact that this is a project that can help people like me stay in San Francisco. In a private project that casts a shadow of any sort over a public park is a shadow allotment that i cannot support. Parks are a benefit to the community at large. Were looking at small private projects one by one asking foreshadow allocation we either have to approve all of them or consistently say no. Ive opted for the former and done that my entire time on the commission. Only when there was a Public Benefit which was 100 affordable, hospital, or Senior Community project have i shado supported shadows in parks. Staying true to my previous support, i will not approve the shadow on this park. Commissioner imperial. When it comes to my work with the committee in the past and shadows are usually also an issue. Especially if we are in a district that has public living spaces. In this particular project even though the shadow impact is very minimal and only lasts about 13 minutes, however, there is the shadow throughout this park that is 30 already. Again, whether there will be new projects that will be added on in the future, i can foresee it it being approved and casting a shadow that will totally block the entire park in just shadows. Its more principle to think about when we look into the Public Open Space especially in times of pandemic that open space is very important aspect in our lives. Another thing i would like to comment is about the use of sro for this particular building. Also in my experience, you know, we should be in our documents entitled as micro units. Single occupancy usually are being used in terms of affordability where people who are homeless, are in transition to get into permanent housing. Initially sros are usually in the realm of six hundred, five hundred, or 5 of their income. This project is a micro unit that will provide two bmrs for 900. Looking at weighing the costs to the benefit of putting more shadow in the park as well as whether this is truly Affordable Housing, for me, this is questionable. I will not authorize foreshadow impact on the mission play ground. I will vote on the no shadow alternative and assume that something for the planner or part of racial social equity as we look at shadow authorization how to really minimize the shadow in open spaces and have threshold or some sort of thresholcompromise to minimize e shadow interest or not have shadow at all. Especially on the eastern part of this neighborhood, we lack Public Open Space and we need to protect more of them. Thats my comment. I wanted to step in for a moment. Yes, dogs do go outside and urinate or defecate, what i observed was the staff immediately cleaning. Immediately cleaning the outdoor space all day long. [bell ringing] so, any dogs that are barking, very minimal. Constant cleaning. And the employees were not yelling. Very calm and quiet indoors for the entire week that i observed. And the dogs are taken for walks, so that is not the only peepee place. Theyre taken for walks all day long. So while there might be minimal times where there might be some barking, that was not my observation. I observed the majority of the day fairly quiet indoors the majority of the time. Just recently the grill which was in business for 171 years is closing their doors, at least for now. And i just try to stay positive and hopeful. I do see this as an important business on an important corridor and i will be supporting the grateful dog today. Commissioner moore . Commissioner moore i believe that the commission has in march. I believe the answers we got today are conclusive and im in support of [inaudible] which i was interested in have all been answered. Commissioner diamond i was very concerned in march that the applicant had not satisfied the prior conditions of approval. They have now. I would like to see on the screen again the [inaudible] conditions they were suggesting that they would live by. I would like to add those conditions to the project. There is one modification i would like to make. David, are you able to put that screen up . There were four conditions. So condition number 1, i think is inconsistent with condition 14 in the motion, condition 14 says theyll have no more than eight dogs at a time. That the number is subject to change. I would like the Department Staff to have the ability to lower the number below eight if it turns out that Department Staff thinks that eight is too many. I dont want the staff to be able to increase it above eight, but i think they should have the flexibility and discretion to lower it. So i would move to approve the project subject to these four conditions with the caveat that number one should indicate that it is subject to the Planning Department staff. Theyll need to adjust the number down in their discretion. Second. I understood on the first point i understood commissioner fungs point, wasnt that the store couldnt be open from 7 00 to 7 00, the hours for the dogs outside he wanted to limit to 9 00 to 5 00. Commissioner fung . Commissioner fung that was my point. Commissioner moore i must have misunderstood. Im in full support of that. Commissioner imperial in terms of hours, first of all, im in full support of this of this item in front of us and also the proposed conditions in front of us as well. In terms of the operation hours, i would say about 8 00 a. M. To 6 00 p. M. , so that it looks like the business already operates already at 7 00 a. M. , however, to use the rear yard, probably give an hour at 8 00 a. M. So i would weigh on that, but, yeah. Whether its 7 00 a. M. Or 9 00 to 5 00, i think im more leaning between the 8 and 6 p. M. Im not sure about the other commissioners, but thats how i feel. Commissioner fung, could you live with 8 to 6 . That seems reasonable to me. Commissioner fung historically, ive always objected to uncontrolled noise or noise that people have no ability to control. We try to find balance between neighbors and business and Community Organizations. I certainly understand the desire to limit the hours. In response to that and in response to the noise, i do think that eight to six is a good compromise. It allows people who are sleeping a little past seven to be able to sleep until eight. That is how i would vote and support those hours. Yeah. Before i call on commissioner chan. Let me voice my support to the eight to six hours. I too am supportive of this project with the new conditions. That makes it more assuring to me. Commissioners, it sounds like we have a green light on eight to six but i think we havent yet discussed commissioners suggestion that the reduction below eight would be done as a conversation or an agreement between the staff and the project owner. Im not sure how that would work because i cant see the project owner ever really wanting it to be limited below eight though staff might think thats important. The complaint is substantia substantiatedits just he said she said. I think a discussion, for example, hypothetical. All of a sudden there are very large dogs out side there. They make more ambient noise aside from barking. Unless they can reduce that and having a discussion on the mix of dogs, i like more specificity in the manner that is fair and equitable to the business itself. I would believe its incumbent upon staff to do their Due Diligence in talking with the Business Owner to come up with a solution. Is that what you are proposing . I would like the owner to realize[indiscernible]. I do have some real dog experience. Not to slight any of the staff, i would feel better just having more of a conversation with the ownership just because eight small dogs could be very different than eight large breed dogs. There might be some extenuating circumstances daling with specific breeds of dogs that might need to be addressed and the owners might be able to shed a little more information when a decision is made. Im leaning towards going with commissioner moores decision. Thank you. I think you have the experience. I would just offer that i think that it would be where this conversation itself, i think really helps staff understand that we want businesses to lower the number of dogs in the backyard if necessary to not just be subjective and one sided but to really take the entire context and be in conversation with the owner. I think its part of good enforcement. I really like that addition. I would say that im not sure that its part of a motion, per say, but a strong recommendation for staff who will be continuing to follow this case. One hundred feet of frontage on each street. Total area of one thousand square feet. Gas service station Convenience Store constructed in 1966. Project was located in neighborhood commercial cluster Zoning District. The adjacent properties are generally within the zoning one district. The gas and service station and new construction of a fifty foot tall forty thousand square foot mixed use dwelling. Divided into four units. Twentyseven one bedroom units, 13 two bedroom units. Project provides one thousand nine hundred fifty five square feet of private open space on deck and patios. Located in a basement level garage. A ten foot wide on the street. A six foot deep extended build out at the intersection of forty Second Avenue. The Planning Commission approved a conditional use authorization at this site for a project that was a similar design in size in regards to buildings foot print but was only four feet in height. The project sponsor is seeking authorization using the home assess program. Development bonuses to allow form base density in exchange for providing 25 affordable units. The committed density is 13 units. The project proposes forty one dwelling units and this is achieved through the home assess program. A tote of ten units of the proposed 41. The project meets requirements of the tier two home assess program. Ten additional feet of building height. With that benefit the project proposed a height of fifty feet. Removal of the gas station and add a new curb cut on lawson street. A neighborhood designated residential street. Prior to the submittal of the home assess application. The department received twenty one letters and emails of individuals in opposition to the project with concerns to the height and density and increased traffic. With the demolition and removal of underground sewer soil. The projects ability to increase housing. The letters are included in the correspondence. The project was reviewed by Environmental Planning staff. They were granted an exception from c eqa as a common zoning staff. The ground water and vapor contamination as part of the Environmental Review process. They received a review on this process last week. My executive summary includes categorical exemptions. The project received a common sense exemption. The project at this site was presented to the commission in december 2017. The Commission Approved the automobile certification and construction of a forty foot tall mixed use building. Prior to resubmitting as a home assess project Building Permits for that project were submitted for further review with commissions beyond planning. The sponsor has already enrolled in the program. The site mitigation and health and safety plan must be submitted for i this project. Depending on the concentration level. These materials are included in the projects online case load. The department is recommending approval of the project with conditions. Consistent with the objectives and policies of the general plan and meets all applicable requirements of the planning code. Forty one new dwelling units. Ten of which are on site affordable units. The project will provide land use that is compatible with the zone one district. Project sponsor are you prepared to make your presentation . I am. Can you go to the second slide, please. One second, please. Okay. This slidegood afternoon, commissioners, planning staff, public. This is presenting the project was approved in 2017 as you see in the upper image. The proposed design is the lower image which is depending approval for 2020. Were actuallywe work closely with the neighborhood to get the first iteration of the upper screen showing the height modulation of the project. Thats the upper view of the building. This is two images of the proposed and the approved project. Before and after. Its slightly different as you see on the top floor which is recessednext slide. From the aerial view, the upper floor was set on the planning recommendation by ten feet on the Property Line on three sides to create an aspect of a smaller building. We were able as i see on the first and second images to achieve this kind of effect. The project as we said before, it was modulated to create a less effect from a small building. We recessed all the green areas on top as per neighbors recommendation. They had concerns about privacy. We reer successe recessed all ts from ten feet to twenty feet around the building which make its very hard for anybody to look down or someone to see whats going on. This next slide. The level of commercial level is dive idedivided into four insto to create smaller businesses on the street which is a better fit with the architectural site level. The building now is more refined and repurposed from 15 dwelling units into 41 dwelling units. That includes 27 one bedroom. Thirteen two bedroom. Home assess applications were not flexible enough to not have two floors because of the neighbor concerns which didnt apply at that moment. We actually didnt do home assess from the beginning and that was the reason. Next slide. The proposal will demo an existing gas station which is a public hazard and remove it and clean the site. All the mitigation processes which are concurrent with dph and state of california Public Health ordinance. As you see, the upper common area is centrally inside the building twenty feet from both sides on the street and ten feet and forty feet from the backyard. The project will contribute as a 24 Parking Spaces and an additional 13 spaces on street level by eliminating curb cuts created by the gas station. We are not required to provide any parking but because of the concerns of the neighbors we provided a basement that will also be part of the mitigation plan for the gas station sm the firs. The first level will consif seven hundred to nine hundred square foot. The back level is one and two bedroom units mixed the upper floor will be generous two and three bedroom units ranging from six hundred to nine hundred square foot. The second floor will consistent of other one bedroom and two bedroom units mix. Same as the third floor. Fourth floor will consistent of another two bedroom unit that is pushed away from the Property Line by ten feet all over that creates the element of minimizing the affect of a high building. Its an upper garden which we created a parket area. Parpocket area. The elevation se commercial spaces which is also for commercial spaces sm the additiospaces. The addition of at was lobinged in an area that will not conflict with pedestrian. The back elevations show the backyard garden in addition to the building elevation. Forty Second Avenue elevation shows how the building is modulated and how we were able to push the Building Back six to ten feet all the way up. Its more moderated and actually that will access Square Footage. We were able to accommodate the neighbors and that actually created a less effect of a high building. As you see in this section, the building from the street level on the bay window location. It modulates up and off the stair way all the way up to and creating a forty five degree line that virtually up into the sky. The building was modulated in a very successful way as we tried to create a less Tall Building effect. I believe we were successful in that. The proposed project will provide 41 rental units and four rental commercial units. In addition to 24 parking in the basement and 13 parking on street. Which make its one to one. The project is actually located on a transit oriented corridors which makes it as more desirable for walking and biking and other amenities. When we talk about this project we must talk about the racial history of the sun set which in the plaf past excluded ain an pe as well as black people. One way to remedy that is look at building more buildings and market rate buildings. This housing with below market rate units will be a gift and asset to the sun set district. Im excited about more low market rate housing. We certainly need it. I went to high school in the sun set. I couldnt be more excited about this project. Im been in the sun set since 1987. This is a great opportunity to build Affordable Housing on the west side. The west side has not built its share of Affordable Housing. This will be 25 Affordable Housing. I like the idea of ground floor retail spaces. If were going to make retail work, it needs to be in spaces like this. Thats good for both the Business Community having more people around as customers. This is a poster childthis is a good project for the sun set. If you cant approve this, im afraid no housing is ever going to get buil built here. This is martin. I am in strong support of this project. Im happy to call in because home sf was a project that was litigated for years. The board of supervisors came to a unanimous consensus about it. Its a project we should support. Its going to be replacing a fossil fuel, a gas station that we know we need to move forward with more environmentally friendly projects especially replacing fossil fuel developments like a gas station. Twenty five affordable on site which is incredible for the neighborhood. To have 25 affordable in a Development Like this is really incredible. Commissioners that will conclude Public Comment. The matter is now before you. Seeing as though im a resident out in the sun set district im really pleased to see this project in front of us today. Whenever weve seen a corner lot gas station theres a likelihood thats a development for residential properties. I like the size of the smaller more flexible retail spaces on the ground floor and in support today. Im also in support today. I really appreciate the design of this project. I think its a relief from some of the gray boxes that we see around the city. I also like the mix of unit sizes. And i alsoits just the cherry on top that we hear from so many Community Members that support this project as well. We want to see more home sf projects. I know the richmond and sun set and west side can take this type of density and can really b beprojects like this can be an example of how we have a nice mix of density while also having the neighborhood feel that so many of us would really like to enjoy. For those reasons, im in support of the project. Im in support of the project. There are a couple of comments id like to add. I think this project allows us to learn something and take a more discerning eye on some issues which ill get to in a minute. Replacing a gas station with housing is a good site just by nature of location brings in more density. I think its in support of the site and its in support of receiving the project of a lower height than it actually is. The next point id like to make is that the increase of units from originally 13 to fou 41 isn additional stretch even if we add an additional floor. I believe that particularly on the fourth floor, we have unit 31, 32, 33, 34, the number count is working against what we should be supporting as equity design liveable units. I think the units are too narrow and too long in order to be really quality units and more in line of what the rest of the project provides. I like us to go beyond numbers and we equity by design. These are one bedroom units provide slightly better unit quality. I would like staff to spend a little more time looking particularly at that floor and those units. The next point id like to make is the ground floor. Im very much in support of trying to animate part of the ground floor is commercial units, im concerned with sharing a four foot three corridor with 41 units and five merchants is lowering quality of residential life. The back of house entries are not exatable for equitable to f a obscured lobby. Normally units of this size have a slightly more generous entry lobby. If theres not a doorman, at least there is a drop off for packages. I dont see much of those types of amenities which i would think we should be looking for when we look at higher density Apartment Building. I would suggest while im in support of the project that the department sends a little more time tweaking those particular two elements of what is proposed here. Thank you. Looking into this particular building where there are more one bedrooms. There are 27 one bedrooms out of 41 buildings. If were going to take into consideration as well the inclusionary housing there are[indiscernible]. I understand that the home sf with the legislation that was passed, i believe probably three years ago. However, i feel thats something that we need to relook in terms because home sf is something that applies in the west side. Who are the people who are going to live here . Are we having more family units . Thats something that is disturbing to me that there are more one bedroom units instead of more two bedroom or three bedroom units. Especially seeing that sun set or we need to build more family units or Family Friendly units. Also i would like to see more comments when we look into design. I think this is becoming an issue when we look into more affordability or just Housing Units being built in the city. We dont really take into consideration the liveablity, whether the hallways or big enough for people. I think there needs to be some sort of minimum requirement or threshold as to how do we design the type of units that we think is going to be liveable especially if there are Affordable Housing units on site. Those are my critical comments. My comments about this project, i generally support this. Im not sure if actually if director can answer in terms of home sf projectwas there any requirements on housing unit sizes or that is not something that is included in the home sf . Commissioner, i believe they need to follow the rules that the city has and the Building Department has on unit sizes. I dont think theres anything specific in home sf that controls that. Okay. The affordable units need to meet the minimum unit sizes for the California Tax Credit Committee sizes. Those are set forth in section 415. Seven hundred square foot for a two bedroom. We would make sure that at least the affordable units would meet that as well. Any language on the percentage of the types of units like more5 or 12 percent on one bedroom oris there something included in that in the home sf . There are two specific ways that can you meet unit mix for home sf. One is 40 two bedroom or greater unit mix. 40 twos, that includes 10 threes. Or 50 of the bedrooms in the development have to be in units that are at least two bedroom or larger. And the development has to include at least one three bedroom unit. I believe this project meets the second criteria. Sounds like this is something that if something proposed an amendment in home sf especially if were looking at Family Friendly units wondering if thats something that planning can look into. Yeah. I would like to say my support but break through the glass ceiling. We have codes and regulations regarding size. I would like for the department to take a more critical eye at unit layout for the proportionality of the units with width to length. We had controversial units last week as well. Its only guiding applicants to do things slightly different. Its not reducing unit numbers its just spending a little more skill on what units are desirable and what one rs are n. I ask everybody else and pose themselves a question, would you like to live in that unit. That is a determinant for equity and design equity. Im making a motion to approve the project with conditions that the applicant work with staff in improving the common corridor on the ground floor and the particular unit layouts on the fourth floor. Second. Commissioners. There is a motion and a second to approve the project with conditions. This is to reconstruct a rear deck and extend a garage at the rear without the benefit of a permit. And since this work is in the required rear yard, it requires a deed requester of 147 and 153 missouri, adjacent neighbor to the east. This is the shared Property Line into the dr requests yard and acts for privacy. The proposed alternative are to one, restore the deck and two, remove the horizonal garage extension and three, remove the work into the dr requesters yard and four, replace Property Line windows with fixed fire rated assembly and obscured lacing. To date, the department has received seven letters in opposition of this project and no letters in support. The notice of the violation to legalize the addition did not recognise that a portion of the structure extended over the neighbors Property Line and buildings are not permitted to extend over neighboring Property Lines and it is the responsibility of the project sponsor to correct this condition. It is anticipated any Building Code deficiencies specifically related to fire condition would also be corrected with the permit to correct, that the Good Neighbor gesture, the project sponsor proposed a sixfoot high screen on the deck to ensure adequate privacy between the two properties. And therefore, staff recommends taking the dr and approving with modifications of the sixfoot high privacy screen to be within the rear Property Line as determined by the survey and this concludes my presentation and i am available to answer questions. As you can see in the aerial photo, the project sponsors rear Property Line runs the entire length of miss oskanozis front Property Line and to make matter more challenge, the structure not only encroaches within 100 of his rear yard, he has constructed it without permits over the Property Line. Slide two. Mr. Johnson built the deck and tendeextended the deck over the frontyard and this situation created by the project sponsor resulted in privacy impacts and news onoise and other problems r over 20 years. Slide three, please. Slide three is a photograph of the rear of 145 missouri, the project site, as it existed with enclosed porch before the project sponsor demolished it in 1998 without permit. Slide four, please. After demolishing the enclosed porch, mr. Johnson illegally constructed the rear detective d extended the garage. Slide five, please. Slide five shows the deck and the garage as they exist today and in addition to the illegal rear yard construction and construction over the Property Line, there are two other reasons that this project is exceptional and extraordinary and why you should take the dr and that the variance should not be approved. David, slide six, please. The project conflicts with key elements the residential Design Guidelines, especially those protecting privacy. Slide seven, please. And like the former condition with the enclosed porch and the rear, as you can see in the slide, the deck has direct views into the bedroom and home office office. It requires a variance and that cannot be supported. For example, variance finding four, that the granting of such variance will not be materially detrimental to the Public Welfare or injurious to the property or building. The building was constructed and does not meet current life safety codes, including seismic and fire codes and subjects mist threaten her welfare. I experienced the problems by his noncompliant problems on a daily basis. Could you turn to page 3 of mr. Winslows report which he spoke with you about earlier and the first one is regarding the encroachment issues, that the deck is reconstructed, extends into the dr requesters yard, my frontyard. They did not recognise this and it is the responsibility of project sponsor to correct this condition and must be included in a revision. I request the project sponsor remove the construction from my property. Two, regarding the life safety issue problems, they state Building Code deficiencies related to Fire Protection on the lot line condition be corrected with the permit to correct and i request that all life safety be included in the revised plans. David, slide eight, the privacy screen picture. Regarding the privacy screen issue, planning staff States Project sponsor proposes a sevenhigh privacy screen. This week i emailed the dib for codes and my sketch is cocompliant. While the ones in your packet are not. I request the privacy screen be seven feet high and fire rated and coclient as i have sketched. Slide 9, ive added a fourth item. Additionally when the project sponsor illegally remodeled his bathroom, he add aded a window d this looks directly on to my front door and walkway. I request to have that window replaced with a fixed fire rated window and glazing that is sandblasting and obscured. Theres another that allows for fresh air. Dr requester, that concludes your time. Im Amber Johnson and we own 145 missouri street and have owned the property for 25 years and rented it as a onebedroom unit for ten years and the dr requester has lived at her house the entire time. The rear porch has existed on that property for over 50 years and its been in the current uncovered configuration for 23 years. The porch dimensions are and have always been four feet wide four feet seven inches deep and 17 feet, nine and three quarters in length. And so slide one shows the porch from over the years in the earliest photos we have. This process began when we sought to perform repairs to the porch, found additional issues and it became a more extensive renovation. At the time we were doing the work, the dr supported the work and we incorporated her designs into the porch and she praised the quality of work and we were not aware this required a variance. We in no way intended to harm the drs property and we do not believe we have damaged this Property Owner in any way. No one, including the dr requester, knew that the porch encroached over the Property Line and the dr requester had a survey completed after it was complete and after her first complaint to the city in 2018. We rebuilt it to the exact dimensions as before and the new footing was on ton o top of thed foundation and doesnt encroach into the neighbors yard. If you can show slide two, please. This is the porch as it is today and as it lines up with the property next door and slide three, please, the new footing on the existing foundation and you see that the Old Foundation was painted green and then the new footing would lay directly on top of that and we built the same dimensions. In slide four, youll see an image of the survey that we had completed. So the dr requester survey showed it wassen coaching two wo feet of the line and it angles back crossing back on to our property at the four foot, six inch mark. A toll encroachment of one tenth of one square foot along the foundation and the siding has an encroachment of 7. 5 feet and crossing over the Property Line at 10 feet, fine inches. Theres a trim that causes air encroachments that we could remove. We find this to be minimal and we did try to come to an agreement, we are willing to pull that foundation and siding off the Property Line as recommended by the staff. And regarding the drs privacy concerns, as mentioned, the porch has been opened since 1997 in its current configuration and the covered porch prior had a wall of windows along the Property Line and the porch faces the neighbors front yard at 147 and this is just the unique fronttoback split yard and her backyard is our frontyard and has been this way for man a decade. Slide 5, you see down below, this is her office and you see the neurologica natural privacyd and thi really, this porch exisd many years before her office. The second is her bedroom windows and these are the top of the wall and so one can in the see in her bedroom from the porch. And one would really have to strain to the height of windows to see out of them on to the porch. And as stated, you know, she has never come to us with these privacy issues in the past and says now there have been noise issues, but dr is the first we heard of them. The deck is quite small and would not allow for more than a few people and she did not mention any nuisance issues at the preapplication meeting or in her response to the variance application. So while we think that these are nothing more than sort of typical sounds that you here in closesitting housing, we would be willing to address them and so we have we would agree to a sevenfoot screen and we propose five and half feet because the light from the porch comes into the kitchen and provides our kitchen light but, again, were willing to go into six feet as suggested by staff and we would, of course, ensure all code compliance in the Design Department and with all of these reasons, we would ask the commission approve the project as recommended by the staff. Im peter delecort and im a longtime resident of the hill and i want to speak for myself and my wife saying that the approval this variance would send a wrong message to homeowners and contractors to do illegal work. My name is evon gavaray and i live around the corner from this project. And as a longtime resident and i was born on rhode island street a few blocks away. Ive witnessed continued development and modifications in every corner of our neighborhood. Often with little regard to the correct process. So although i think that at 145, theyre trying to make changes, its important theres a discretionary review first is people go and see how close these little houses are. You know, our neighborhood is full of properties that arent exactly 25 by 100 or whatever the regular dimensions are. And so, i think that keppa has good reason to want to have a higher screen and other changes because the area is so small and the light and the air is very important. And so, i agree that i think that the variance should be denied because its illegal action. Weve had changes here just around the corner that we had to go through all of the channels to make simple changes to our properties. And so, thank you for your consideration. Im Deborah Holly again for keppa, the dr requester and david, if youre still there, could you please go slide six. And so, i just want to impress upon you the importance of the privacy issue and the reason for the sevenfoot screen and slide six shows that the deck is quite visible, someone standing on the deck can see right in the window and more importantly, please, for the dr requester, keppa, take dr and require the modifications that both we and mr. Winslow have recommended so that the long history of illegal and substandard demolition and construction can be remedied and so my clients privacy and safety can be protected. The person m who spoke for the project sponsor may not have firsthand knowledge of the entire history that has occurred, but there my client has called in many complaints over the years and it wasnt until this was offensely brought to the attention of planning in 2018 that the violations were addressed. There was the notice of enforcement, notice of violation and even a notice of penalty issued by planning and it wasnt until those actions were taken that my client could get any traction on the issues and problems. It really is a very small lot on this rear porch that has existed for many decades and it really is the only quality open space for this home on the unique lot. We know its a unique situation. The concerns that the requester just brought up, those were all in regard to this porch and this variance and, again, weve met those in the permits we filed to have the porch initially legalized. And, of course, we would go forward with planning and building compliance codes, as well, and so we would just ask that you would approve the variance based on the findings. Thank you. I would like to make a quick point, which is that because the rear enclosed porch structure was essentially demolished, doing anything back there at this point is going to trigger the variance. So i know there were some comments about dont support a variance at all here and i dont know thats necessarily appropriate but i think there is justification for putting Something Back here. But anything that would be replaced in the rear would require a variance because of the unique nature of these two lots and how small they are. I think, obviously, its just going to come down what is appropriate there in the rear, considering this unique lot configuration and a little thankful this is also a dr because i think these are the types of situations that the Planning Commission can usually get right and you have a lot of experience dealing with these types of situations. So im definitely very open to hearing commissionerss comments on this issue. Commissioner moore . I am inclined to support staffs recommendation. Is that a motion . Yes. Second. Good afternoon, im the staff architect and the item before you is a pub initiated request for a discretionary review of Building Permit application 0807. 6659. To demolish an existing garage, storage shed and garbage enclosure at the front and middle of the lot and construct and approximately 40foot tall, 260 residential building with rear few knits a units. No modifications are proposed to that structure. The dr requester, jenna smith of 3227 16th street, apartment number one, the adjacent neighbor to the east of this proposed project is concerned that the project will impact light and privacy and is out of scale with the existing context. Her proposed alternatives are to lower the height by limiting the building to three floors and to provide larger indiscernible . There are no letters in support of this project. The departments urban design revisory team reviewed this is found that the proposed addition does not create extraordinary impacts to light and privacy to the adjacent property and found that the proposed building matches the light wells above the ground floors and does not extend passed the rear walls and thereby maintains light and privacy to the adjacent privacys site wells. The rear roof decks on the third and fourth floors located where the building massing steps back are modest in side and setback from Property Lines not to have impact to privacy. And the project is a codeconforming infill on a transit corridor and replaces a onestory parking garage and provides an active use of a groundlevel residential unit that conforms to the residential Design Guidelines. Therefore staff recommends not taking discretionary review and approving. Thank you. This concludes my presentation and im available to answer questions. This is a visualization of the proposed property and i live next door representing the 14 neighbors that live to the left and the right. Next slide, please. And the current property has a twounit property separated by a yard and singlestory garage in the front and the new build would add a fourstory, five microunit residential building to their front. Next slide, please. And so while on paper, this looks great, we ask you review the details a little more closely. It completely covers some windows and blocks a lot of light to the existing apartment. Theres still an unresolved privacy and security concern and ill touch on the impacts this could have on affordability projections in our neighborhood. Next slide, please this shows the expected had deon to and over light wells from the added height and also the large trees blocking northern and southern exposure. Im hoping you can see from the illustration, we dont see how sufficient light will be able to enter those apartments. This is showing the height of the new building and you can see in the middle of the photo just how narrow the existing lightwell is. Next slide, please. This is another angle toward the back of the property, meant to be like youre looking through the new building and even though the new build will be recessed at each floor, the light walls and windows are still covered. Next slide, please. This is the other Apartment Building to the east that i live in, looking down into the light well and theres a restaurant on the ground floor with a large exhaust pipe that comes up to roost and this is hard to quickly explain, but because the wall of the new building will extend all the way up, it will box in windows with the exhaust pipe and the wall. Next slide, please. And so security and privacy, the second floor terrace is connected to our building which i can show better on the next slide, please. And this is planned to be a deck from the second floor apartment and we have had several breakins and feel this could allow someone to hop over and campaign access to the building. The architect agreed to admit the covering, but theres a door with roof terrace access and we dont feel this fully addresses the security concern. Next slide, please. The neighborhood impact. These apartments are very small microapartments and ive done a lot of research and we just dont feel this is in line with current Housing Needs and it shows that without affordability mandates, it has a negative effect on housing shortages and affordability which are two things we struggle with here in sf. Next slide, please. So what solutions do we propose . The architect didnt respond when i asked whether it was considered to redevelop the back building instead, the two existing units and you could add height to that building without affecting any of the existing units and you could put a onestory retail space on the front with the foot traffic on 16th street, it seems this would work better on this lot. We suggest opening up the light wells and not having door access to the apartment attached to the building or recessing that building away from the wall. I understand this may mean completely resigning this, but we feel its the right thing to do. Last, please consider the longterm impacts your approvals have on the neighborhood. Research from other cities that have already done this show these microapartments are not the way to go if theyre built for microrate rentals. Thank you. Dr presenter. You can see this is the same orientation as or floor plan exposplansand you see the propod building is 3227 the dr requester at the bottom which has 100 lot coverage on the ground floor and a setback on the rear yard and it has four units with a garage and groundfloor commercial. The upper building which is the 3237 has five units and it has its three stories high with a ground floor commercial and theres no midblock open space as you can see because of the Mission Complex buildings and we wanted to create a midblock open space between the buildings. Can i have the second slide, please. On the second slide, what you see is the rendering that we provide the staff of the new building along with the existing conditions with the onestory garage to your left. As you can see, we work with about three major revisions with the udad committee to, one, make the ground floor very commercial and proportioned of the look on the street scene and slide three, please. On slide three, what you see is a blownup version of the proportions of the building and it is its a 40foot high structure and we decided to slope the building with the ridge going eastwest and so from the street, the building spring point is approximately 3s within proportion of the adjacent buildings on the street and, again, we have more of the commercial look, high base thats staff asked us to do and you can see that both buildings on either side are three stories high. And next slide, please. This is the comparison, as you can see, on the colored floor plans how the Building Steps back and to your right, we did a 3d diagram and inserted it into the site. This should give you the relative proportions how each floor steps back. As you can see, theres a ten foot ten by three and a half notch away from the adjacent light well on the second and third floor and it steps back two feet and the fourth floor eight feet, ten inches and slide five, please. As you look at slide five, its a zoomin of that right image we showed you previously and there you can see the dr requesters building to the right at 322 16th street and here again, we have the notch on the second and third level that steps away from there light well is three and a half feet deep by 10 feet and 10inches and the third floor, again, twofoot setback and fourth floor, eight foot setback. On side six, quickly you see a blue line shows the second floor setback and the ground floor, theyre both the adjacent buildings have 100 lot coverage and so our setbacks start at the light well level on the second floor. If you go to slide seven, youll see, again, the green line shows the setback on the second floor and then the orange line shows the eight fea foot ten and then youll see the fourth floor setback. And then in the last slide for my presentation, slide number nine, this is just a google aerial that we copied from the google pro and it shows even late afternoons, probably in the early spring, or late fall, you still have ha shadows from the building into the adjacent light wells there. Im here today to present this project as it is exactly the kind of project that should be approved and it is an infill project, code compliant and provides muchneeded housing. You know, the light wells are very generous in the matching light wells in the setback on the building. This is a great project and should be approved. Thank you. Im board an born and raised fon francisco and the prices on forsale homes is astronomical and something to rent that makes sense is ideal and im in support of the project. Speaker i would like to speak in support of this project. Youre taking away a garage which nobody seems to want these days and well replace it with five economy units which, i they, everybody wants and so the net result here is very tight and we have plenty of two and threebedrooms in the city. Speaker a lot of my coworkers will share kitchens and bathrooms with other people and these units are a good solution and we shouldnt be viewing them with suspicion and we should welcome small units. Theyre a good thing and reduce the cost of housing in San Francisco. And in addition, they are more efficient and use less land, less floor area per unit and this is a good part of the solution towards addressing the housing crisis. Thank you. I think the units are well designed and, you know, people want their own little units. They want their own space and these are going to be within reach with peoples budgets in an area where people want to live. They want to live in a minister and they want to walk to get their cup of coffee and headed to the office or even working from home as we all have to these days. And i think the plan is perfect for the neighborhood and im a local in San Francisco, born and raised. And i would like to see this building built. Thank you for your time. Appreciate it. This is a classic case for more housing on an infill underutilized site versus the wants and needs of the existing neighborhoods and neighborhoods sometimes. But given the cost of housing, given the need for housing and the demand for housing, especially in a transitrich area like this one, i believe this project has reached that balance. The project sponsor has modified the design at the request staff and makes further changes at the request of you. These neighbors felt very strongly that the large tree in the middle of the site needs to be protected and the building needs to maintain a safe distance from it. That means creating a deeper building a bit problematic. This is in two directions to mitigate the impact of this building. Having said that, the project sponsor is willing to take further steps, neighborly steps to mitigate this project and it would be easy to make the thirdfloor decorating adjacent to the dr requester either with a cable or nontransparent glass and sometimes thats creates an issue with birds and i know we can do something. It would be easy to paint the wall on that lightwell of the new building a reflective bright color to mitigate this and the third thing is to paint their lightwell, a reflective nonbright color to soften the impact of this. And i feel this is the type of project that if were ever going to achieve our housing goals and objectives, we need more projects like this. Thank you. Operator you have three questions remaining. Speaker hi, this is rob geller and i have lived for 32 years at 3237, just west of the project. As a point of information, i wanted to point out on the agenda, its actually between gerraro and deloris. We are basically told the building would be about the same size as ours, very slightly higher and the improvabl the imn beinger taller. I feel that was misrepresented to us and the thing about this building, it will be the tallest residential building on our stretch of 16th street as mentioned in the dr and it would severely impact the light that we received. Our morning sun is lovely light, plants thrive, especially this time of year and that will be pretty much gone with this project. Critical Natural Light in the kitchen will be adversely impacted and i know that the architect said that theres adjacent windows facing a lightwell, but we do have an interior wall that blocks that light from going into the kitchen and at this time, we have children at home during their schoolwork and regardless of the hammer and power tools and the construction impacts, theyre stuck inside and we sometimes have to work in the kitchen where we need a lot of light. And what were asking what we would love to see, to have a floor lower, several feet lower. I know that the contractor did say that he would be amenable to not having a patio on the west side and we would definitely prefer that. Now, i dont begrudge anybody turning a project in difficult times, but this would have a dildeleterious effect on our li. To my find, this is an issue of social equity for families which are a vulnerable and vanishing population in San Francisco as it becomes much harder to live here economically. I work for the city of San Francisco as an essential worker for dph and my wife is a teacher. Please help to protect our familys home and quality of life and take the discretion on this project. I would like to recommend that this project not be or at least be postponed through covid. There are 14 people are protesting it and neighbors that realize it will affect the quality of our life whil life. While at home, we see theres a gigantic problem on 16t 16th street. We see neighbors and people leaving all of the time and does not seem to be the same rental market need, especially for microhousing that will be geared for airbnb clients or people there for shortterm rentals and i would appreciate it it as somebody who teaches in the area and somebody thats a parent and knowing we have families, this seems to be profit over concern for the community. Can you hear me . Yes. I would first like to point out that some of the callers do have financial interests and i recognise their name from doing research. In terms of housing, i just want to say that we are not antidevelopment, we are not antihousing, but the design as it stands just needs to be revised to accommodate to the current designs and i feel like this is taking advantage of Development Code and planning by skirting through details that have a really negative impact both on the existing residents and also the residents that will be occupying these apartments, as well. As it stands, it will make at minimum 14 residents with dark living quarters. And then, Touching Base on the microapartments to the callers that pointed out that it was welcome, i really urge you to look at maybe some of the studies out of new york and seattle and additionally, we have some microunit Apartment Buildings here in San Francisco that have not alleviated the housing crisis and the affordability concerns. In fact, within years, theyre renting at or above the equally sized use knit units they were g to replace. Its having a negative impact on afford ability anability and a e impact to the east and west and blocking the light and the security concerns that even though theres small modifications, the issue still stands and even with the cutbacks in the small lightwell that the architect has included, its just not sufficient to ameaameiliorate or concerns. Project sponsor, you have two minutes for rebuttal. A a letter to the commission, we talk about a lot of the requests from the neighbors, that they want certain things to be done and these included, like, a a sixfoot high barrier, a new fence along the Property Line. We talked about retaining an exterminator which she has already to put out traps during demolition on whats going on with the rodents. The project sponsor did a lot of things to agree to accommodate the neighbors. We have two letters of support and we have made a presentation to the mission to the deloris association and they were receptive to the project, along with the deja vu pizza people, along with the building at 3227 16th, they had a letter of support, too. One of the things we want to emphasize, too, is that the project sponsor wanted to do a sloped roof to avoid a stair penthouse. We tried to lower the profile of the building as it sits right now and hes committed to keep these as rental units and also, in the previous emails with the neighbors, they ask if it was going to be used for airbnb and we said, no, thats illegal, theyre going to be longterm rentals and, also, we had agreed they were concerned about people with pets and we put a limit on the size of the pets and to make sure there arent any yapping dogs. So i think the project sponsor has gone and done many things that the neighbors had requested and we also removed the deck that they talk about on unit 202 in the back, that was facing the east adjacent lightwell. And that is now going to be just a single hung window and nobody will be able to walk. Project sponsor, your time is up. Thank you very much. Thank you. Commissioners, the matter is now before you. Before i call on any other commissiocommissioners, i wouldo input my support. Im good with the staff recommendation and i appreciate the recommendations and comments from mr. Kedren. Those are all helpful in addressing the issue. Commissioner moore. I am in support of the project. Its welldesigned and i have a question. My question regards what i read being a groundfloor residential unit and the residential unit, we are asking for 36inch operation for privacy and in order to avoid the drawn curtains take away from what is animation to the sidewalk. And i dont quite read that the ground floor is, indeed, 36inches above grade. Could you speak to that, please . The ground floor has two steps, like a porch entry, ok, and the ceiling height at the front of the studio is nine feet. As you move to the back, it drops to ten feet and it has a porch entry. It steps up. And a stoop ep industry entry. And thats what the committee encouraged us to do and thats why it is recessed and theres two entrances. Theres the entrance at the street, making it the stoop entry and then trans i the entre corridor. Wouldnt that be better in terms of privacy to have another door there. That door is not required, correct . No, its not. And i think there was we put the door there to create, sort of the street entrance to residential unit with a stoop entry, but it could also be removed. I think it would be better to have, indeed, for reasons of privacy the separation which gives you more use of your room, but also lets the window in itself create more privacy and has the entrance where it is. That would be my preference because two steps or 24inches are not what we normally require. Youre not having a sloped room. [ laughter ] particularly, i do see any line where that transition in height would be. You would have a step inside your unit to have leveled floors. Otherwise, youre having a sloped floor by one foot and things start rolling with one foot difference front to back. Paii would prefer to have a full properly sized window instead of the door. please stand by . I have light wells in my apartment. It can be scary to have things change next to us. It can let in ambient light and light light. In looking at this project and were always looking at whether the circumstances are exceptional and extraordinary. No doubt, i hear there might be an impact how you perceive it, we look at how we see it across the city. In this case, i think the divide has beedesignhas been thoughtfu. For those reasons im going to go with staffs recommendation and a approve. Second. Incorporate the change from the side to a window i thought that was a thoughtful addition and well incorporate it. I assume youre speaking about a level unit rather than a there is a transition internally with two stairs that lead down to the kitchen and barge area in back. That was my understanding as well. I didnt see the lines on the drawing there. Its very small. Okay. Thats fine. Commissioner, if there is a modification commissioner diamond does you want to mention something as well . If we incorporate commissioner moores suggestion do we have to take dr to incorporate that suggestion . Correct. Yeah. Does that make you want to change the motion . The departments Residential Design Advisory Team with respect to the issues of the requester is set back fifteen feet of the front and a gaibl roof of the gifting to maintain the scale and building form of the street. The existing three inch set back from the south side Property Line. And the north Property Line. Does not extend further than the either of the adjacent properties to the south or to the north to maintain adequate access to both mid block open space and light to both a adjacent neighbors. The two proposed windows to the front to side are scaled to be proportionate and compatible with the surrounding context. If not, double hung windows. This complies with the guidelines and does not propose any extraordinary conditions with light or space. This concludes any presentation and im available to answer questions. Thank you. Ill refer to that page number. Your slides are up and you have five minutes. As was said, im the owner of the adjacent property. Im just completing a similar remodel to what is proposed at 246 eureka. I had also had some design aspects which werehad encroached into the residential Design Guidelines and that works with the Planning Department to correct those. Those same type of issues have shown up at 246 eureka. Its my hope they will be corrected there as well. If we can go toi note here on page five that everything here as ive stated in the dr application is related to the residential Design Guidelines. He did encapsulate what i proposed except double hung window n in the front, thats incorrect. They were proposed in the rear. Here is on page six, the boxthese boxes contain extracts from the residential Design Guidelines which i think everyone is familiar with just if we needed any reference. I hadas i said i worked with my planner and had an addition at this level and was told that that addition needed to be deemphasized. Having this much extension up and this much demonstration of a different style at the front took away from the original architecture of the house. And, in fact, he had noted an example and said that this is on page seven now, this type of structure would not be allowed on his watch. Having the larger addition. Okay. Thats why i said deemphasize that third floor addition. Moving onto page eight we get into the building scape and format the mid block open space. Basically thats the third floor. On my project, my projects right next door. The two houses are exactly the same except for a very small change to a back porch at one time. Which both are to be demolished. If you see here, the residential Design Guidelines discuss an addition at three levels. Youll note that the three acceptable alternatives, none of them allow the third floor extension. We have the nopdr that came to my project with a similar addition that that extension needed to be basically removed except for very small. The two problems there are the extension at the third floor and also because all floor rs are coming out at 246 at the same level, it looks very monolithic to have them all same. It doesnt soften the encroachment into the rear. Here i have a note Residential Design Team claim that the proposed plan does not extend further than the adjacent properties. When in fact, the third floor at 246 extends over 16 an 17 and af feet further than either of the adjacent properties. Talk about amassing study that i requested and was not granted. Again, 246 is pr proposed to exd beyond the neighbors to give a total of 22 feet beyond the current structure. On page ten, we see what the rear addition at 238 eureka looks like on the left. Im the architect for this project and im here today with robert marks project sponsor. The proposed project is an a addition to 246 eureka. Its a two story with a garage and one story pop out in the rear. Typical of houses in the area. We thought to keep the scang scn as compact as possible. The third floor is set back from the front per the residential Design Guidelines for scwai scad decorum. The rear addition is held back so the proposed rear yard is[indiscernible]. It illustrates what the rear yard is supposed to be by planning code and where weve kept it. Where we kept the back line. Next slide, please. Instead we use the principle of averaging as outlined in the planning code the further point back is the average depth of the two adjacent structures. Please note also that the deepest point is just a skinny deck hanging off the building like an awning. The rear i facade aligns and ths facade is restored, but weve aligned and set back pretty amplly. Weve maintained adequate head clearance while keeping the top of the peak down. In response to comments from planning staff, we made that extra thick to give the appearance of a further set back and deep shadow lines. You can see that the peak is only six feet eight higher than the original peak. If you could please advance to slide seven, eight, and nine. We did some visibility studies that were sketches over a model put into photographs of a site from down the hill, across the street, and up the hill. You can see which view from the street. Please advance to my final slide which is the view from the rear. You can see that the rear addition is kept narrow. It not only honors the open space but is subservient found the rear of the houses found on the block. Were not doing heroic architecture here. When we work on sites out side the city we have those opportunities. In San Francisco the goal is to expand and modernize in a way thats compared to context. It allows Natural Light inside the house. This is an approach that really benefits everybody. Planning had minimal comments in their original letter. They asked us to provide more architectural separation between the roof and the wings. Lastly on page 12 and 13, i do note that the residential Design Guidelines encourage congruenty. H10 properties have double hung window nz ths in the rear and ht gone to a modern style. It does encourage keeping with the current design style of the neighborhood. Most importantly is that third floor extension that is disallowed by section four of the rdg. Thank you. Project sponsor. We tried to resolve his matters but he stopped responding and so i know rob would like to make a few comments. Yeah, we appreciate the time of the commission today. All efforts were made to engage in discussions with our neighbors. We had some great feedback and pack anback and forth with the neighbors with mr. Brown. We tried to resolve the conflict but obviously that was unsuccessful. The project was submitted as was approved by staff, meets all my needs, has a larger rear yard. Seven hundred feet smaller than the recent renovator. I appreciate the commissions time and would appreciate your approval of the project as approve by staff. Thank you. Looking at thisi do find the review as adequate as well as the residential Design Guidelines compatible with the neighborhood guidelines. This is Department Staff before you this evening, the central soma clean up legislation. This legislation does a few things which i will step through for you. It addresses inadvertent areas which you will find in complex legislation such as misplaced references an the like. It also addresses and clarifies some of the previous language and organizes and articulates some of the policy thats were found in the other document thats you found in the plan. There was one substantive amendment. Before describing further i should just bring to your attention that the staff report and the original motion that were sent in your package last friday described three provisions that were actually not in the ordinance that are before you at this time. Staff did a little more work on them. We ask that the motion if you decide to initiate reflects those changes. I did forward a revised motion just before the meeting that reflects those changes. Besides the unit inadvertent clean up that we want to do, some of the other things were hoping to clarify through this legislation is requiring operation strategy so there is an operation plan when they are approved by the Planning Department. It clarifies lot planning limitations within the central somasud. The solar plane set back requirements that were expanded as part of the original plan. A new type that were incorporated in the plan. It also clarifies where exceptions to open space requirements can be made clarifying that if you have a Square Footage and youre looking to seek an exception to that that can be taken care of. The one that i would call a substantive change is the provision that allows some developments to provide their open space for a project. It limits it to eight hundred feet. We wanted to encourage open space next to and under the freeway. This would allow a greater distance so they could meet open space by providing open space in some of those lots. The part specifically that i want to comment on is the change that reads the amendment proposed would broaden this gree greageography. We are concerned about the changing as central soma expenditure boundary it include one fourth mile out side of soma. We are supportive of expanding this boundary to soma. To keep soma fees inside. Remove the quarter mile extension. We were only made aware of this clean up legislation a week ago. We want to make sure were aware of changes proposed and review them. Their meeting was largely taken up by just a general orientation. We have not had an opportunity to make this presentation to them. I would suggest since the proposed initiation is septembet the Planning Commission that it goes before the c a c since there are other Community Organizations that attend to that. That would be b m my comment as well. In terms of notifying the community for the initiation and reviewing it, perhaps we can actually looking at september 3, a week after that can be enough time for the committee to review after the presentation to the soma c a c. I believe the way we worded it the hearing would take place on september third or sometime there after. I would suggest their commission as well to consider the dates. Either september 10 or septembey members can review the clean up legislation and i believe the soma c a c meeting is on august 20th. Just be with that kind of excelleofscheduling. Could you please explain why you expanded the boundaries and why are you now pulling it bac. Generally what we wan t want, i can answer that question as my role as a part of it. We might find ourselves in a situation there are projects that might otherwise be eligible that still serve soma and central soma because of these boundaries, it just allows some additional flexibility.
