My only update is in regards to a action that Deputy Director azvedo took in my absence relevant to the brick stn we have been keeping apprised of during enforcement updates. Pursuant to section 1060. 20. 2 of police code, Deputy Director issued the brickson a 15 day suspension of limited Live Performance permits on july 21, for three permit violations during a 90 day period. They had prive Business Days to appeal the suspension, which they did not do, therefore the 15 day suspension is currently in effect. It went into effect july 28 at 5 p. M. And cease august 12, 5 p. M. Saturday 29 inspector did a site visit and conformed the business was not hosting entertainment at that time so they were in compliance. We will conduct another site visit this weekday to insure compliance and from there conduct further random site visits to check compliance moving forward. We received 34, 311 complaints since the last hearing. I have one update, please let me know if you have any questions. My only update is neck of the woods at 406 clement street which holds a poe. Neck of the woods received 2, 311 complaints july 16 stating excessive noise. Responded july 22 at 950 p. M. Observed a dj downstairs and band upstairs. The she took a sound measurement which showed the dj in compliance but up stairs was 97. 3dba and 107. 3dbc which the allowable limit is 91dba and indiscernible they were operating 6 decibels the dba and 5 above the dbc limits. When inspector spoke with the sound engineer he stated he did not have control over the equipment. The manager was aware of the doors and windows being open and did not close despite asked to do so. Lastly, inspector learned the meter being used by the business was reading average dba and dbc level opposed to live readout and therefore no way to insure compliance. Neck thof woods issued a notice of violation july 25 for violating the sound limit and operating entertainment with the doors and windows open. An july 29, visited neck of the woods. Upon arrival he observed the front door open and loud dj music coming upstairs. He noted the sound curtains were not closed on the upstairs windows causing sound it bleed outside. Took a sound measurement at 87. 1dba and 104. 7dbc. The reading was about 3 decibels above for upstairs which is 91dba and 102dbc. Inspector spoke with onsite manager for 24 reason for the visit. Asked them to close the front door and close the sound curtains which they did. He also spoke about the valium of the dj and worked to bring the volume into compliance. Then inspector returned a few hours later 12 30 a. M. Due to together sound compliant. When he arrived the front door was open and dj music clearly audible outside. Took another sound measurement which showed the volume at 91dba and 102. 8dbc. The approved sound limit is 89dba and 97dbc. Issued citation for violating the Good Neighbor policy number 7 which requires businesses to keep doors and windows shut during entertainment and for exceeding the allowable limit on two separate occasion s that night. We have a list of special events, many of which are sunday. We did send an inspector out recently to one of those events and she did find i believe they were over their limit. I have been in touch with the permit holder regarding the complaints and in touch with the complainant and one of the suggestions that the neighbor had made was being able to view the calendar of evepts on the website and so they dont have that but after speaker to the permit holder that is something they are rectifying and within the next month they will have a calendar of events and did have a event of pop up on the website with a phone number to contact someone in real time and link to the event. They reached out to the two residential buildsings that we know of that have a lot of residents with a link to the event and contact information, however it sounds that is potentially want disseminating among the tenants. So they went to the property manager and good faith effort to try to get the nrfshzsent out. Since the event saturday where the violation happened, the permit holder has put in touch directly with that neighbor and another group of folks who want direct contact from the venue and are going to be doing that. Ec staff sent internal sound limit for the space listed as a recommendation as well. As you may recall, mikroblack appeared at the hear ing june 20and due to opposition from the neighbors you voted to continue to july 18. At that hearing they requested continuance to do more outreach and i also requested continuance based on news about the lease agreement. In your file you see a subfolder for this item. In the folder i included the original application along with separate pdf with the communications between june 20 and july 18 hearing and july 18 to together. The point they could not reach is frequency of the sunday dj events. Was to host sunday 37 p. M. While the neighbors want once a month sundays. We have concern about the practices and quite enjoyment of our homes and health and wellbeing. This process began because mikroblack had unpermitted after hours parties lasting past 2 a. M. Inability to follow San Francisco regulations has been claimed by multiple residents and recorded in 311 regards. I appreciate they are trying to approve the process, but that doesnt dismiss the history of the case. As of today our household still does not believe acting in Good Neighbor policies. Both of which noted in the statements to the commission this was unprecedentsed use of retail space. To my knowledge mikroblack did not reach out to neighbors during the extension period. These two units believe to the day the permit should be rejected. While our units original request is also to have the application requested outright, we took the Commission Recommendation seriously and created the proposed which allowed to host 15 events per year. The applicant is asking for weekly events on top of this allowance which is 67 events per year versus the 15. indiscernible louder then the radio. We are trying to believe mikroblack can repair the relationship with residents. At the same time we want to protect the home and residents of the building. It is very male, it is verya lot of beautiful things for that community and i love that they have that, but there is discrimination against women and it is obvious and fruitful and i am a independent personal trainer and the gym i choose to take most of my business out of didnt have a female locker room for the longest time and the manager of a woman a russian woman would be spit on by a older group of gay gentleman that dont want women in this neighborhood. It is not just young or old or whatever, it is just a certain personalty, who knows. This store does a lot of good for a lot of people and its not loud. I work with a lot of different groups and have worked with enough groups that many years ago was named after myself for being a Community Leader in this city. The type of neighborhood business that mikroblack is, and what they are trying to achieve in creating community is really important to the castro. There arent a lot of places where unless you want to go and are have a cocktail or have a full meal you can just sit and have a stimulating conversation with someone. For more then three months we endered loud sound of the amplifyers every day getting even louder when they hosted dj. The loud sound would be on from the moment they open to the moment they close. Many times the closing time is past 1 30 a. M. Imagine trying to work, zoom meetings, read a book, watch a tv show while a constant drum beat all day. It gets old pretty fast. There was a time on the first week introduce myself to jewels to welcome them to haveon the same night we have them play loud music to 7 30 a. M. The next day. Countless times enter my place and have walls and floors trembling. We reached out to jewels many times asking to turn the volume down, she reply it is not that loud you can come down and check for yourself. The fact is we dont ever need to go downstairs because we could hear it very well from our apartment. Now, an inspector came to visit the space and every since the volume has been acceptable. But that is our experience with mikroblack so far. Here lies our concern in having concerts and live music hosted at the space. So far we havent heard from mikroblack a preposition in terms of sound proofing the space. In fact, the suggestion was for us to live about the space to buy carpet to fix a problem they have created. That will not do. We dont mind the fact they want to host events. We stand for everything mikroblack stands, we want to create community for artists, for minorities, and we want all that to happen and we want them to thrive as a business, but not at the expense of our peace and quite of our home. We strive to center the needs of all lgbtq people, especially underrepresented people in the castro, including lesbian, bisexual, transgender and lgbtq of color. The district has a Small BusinessGrant Program that distributed close to 100 thousand for Small Businesses in the castro and we support Economic Development in the neighborhood. We also distributed 60 thousand to residents at risk for evictions and displacement during the covid epidemic. We definitely need to increase visibility of lesbian and bisexuals in the castro and happy mikroblack owned by women and as a adult goth girl happy about the business being in the castro. All of this is separate from the need for sound containment. Regarding this request, one of the tenants above mikroblack shared strong concerns regarding the application with us in an adrisery Board Meeting and we have not heard from mikroblack regarding the application. We support tenants rights and Small Business in the costry castro and in this instance we advocate for tenants rights. This is very important as gentrification in the castro lead to fewer rent controlled units and decrease in lgbtq tenants that have middle or low income. We need Small Businesses to thrive, though it should not be otthe at the cost of tenants wellbeing. We strongly urge the Entertainment Commission to not approve this request until it meets the tenants conditions. Especially regarding frequency of sunday events. Loud regular music is disruptive to working from home and lead to hearing loss and can negatively impact emotional and mental health. I personally walked by mikroblack multiple occasions when they played loud music and disturbed by the volume with a amplifyed speaker outside the door. They also play loud music inside the store. Devlin, been in San Francisco all most 10 years and owner and cofounder of queer arts feechards a boutique gallery in the castro in the space that used to be harvey milks camera store. I had a lot of interaction with jewels and know first hand how important it is for space in the castro now which we know is going through a shift and identity change and struggling to get back on its feet. How important to have diversity of ownership and uniqueness of vision to bring new people to the castro and make the castro a more inclusive and truly representative space and i think jewels is exemplary of both those things. A lot is said on both sides of that. As far as the specific complaints of the tenants, i personally have not experienced excessive sound coming from and more importantly, what i noticed is the clear desire to work now that this has become the situation it is and we all know the situations can sour, mikroblack is committed and devoted to reestablishing a Good Relationship with tenants and trying to meet the requirements that work within a compromise, because when you live in a city you have to make compromises so everyone can have some of what they want if not all what they want and think it is very important for mikroblack to host events. We need events to bring folk tuesday the castro and they bring in entirely new community that can only make the neighborhood better and thrive more. So, i am very much in support of that. Thank you to Deputy Director azvedo for navigating the communication here and glad in the end you were able to get people on the same email thread and it feels there is substantial progress in terms of coming together on a set of criteria that everyone is in agreement with, so i just wanted to say thank you. I know thats part of the unsung work of entertainment Commission Staff and i appreciate that and i appreciate everyone else who has been able to work on this together. Thats very helpful and makes it a little easier for us. I dont have super strong opinions between the once a month or every sunday. Im inclined to go for the obvious, every other sunday and split the difference, but where are the other commissioners . Yeah, i think that you know, part ofyes, great thanks to staff for navigating this. This is extremely difficult. Whereas, there still seems to be acrimony on both sides of this equation, and the acrimony i strongly discourage, especially if the spirit of these request is works with the community, i would not begin by necessarily blasting the community. I think that there arethere has been opportunities here for Community Outreach and i think therei also agree with what has been shared that there are not enough businesses owned by women and women identified folks in the castro in particular, and district director spoke in Public Comment, castro cultural district was established for that express reason is. That said, the other component here is cultural competency, and working with legacy communities, legacy residents. I think you can have both without erasing either one, and i really caution against erasing the queer elders in our community no matter who they may be. That said, i agree with commissioner thomas. I think that splitting the difference makes the most sense to me. It allows a little equity i think on both parties and yeah, i really do commend everyone involved for trying to find some Common Ground here. As everyone if you dont know, the Entertainment Commission, part of our express purpose is to foster and protect the delicate eco system that is night life and entertain in San Francisco, but that requires this to workfor everything involve said in the eco system to work in harmony. I think i agree with commissioner thomas on that suggestion. Yeah. I would echo a lot of that and want to thank in addition to staff folks who came to give Public Comment today. I know this is a controversial one and strong opinions on both sides and it takes a lot of time and commitment to give Public Comment, i have done it many times myself. As a queer woman, i completely agree. There is a indiscernible spaces for our community and especially for woman owned spaces in the castro, so i definitely see that need. Im also sensitive to what all the tenants here and neighbors have been saying about noise and what i want to say to you all is that, when the Entertainment Commission gives out a entertain permit, whether that is limited or place of entertainment, that brings a business into our purview,ing and that means we are able to regulate them more and if they violate the conditions we set, then we are able to bring them back in and recondition them, as opposed to operating outside of the scope of our commission. Hopefully that also mitigates some of the concerns that were expressed today. My thinking on this is also we can maybe split the difference, see how that goes and revisit this at some later time. I echo everything everyone already shared. I do want to just like really highlight kaitlyns work bringing everybody together. Clearly this is a room divided, but you have done a great role in bringing everybody together and think meeting in the middle will be the best way for us to continue to build the solidarity between the two groups. I had a numberim not a member of the Castro Community but part thof reason i moved to San Francisco is specifically because of the Castro Community and what it brings to the city. It is likeit is both a place for amazing people and also a symbol of our city and what it can be, what it could be and though we dont always live up to it and that is a place that welcomes everyone and treats everyone fairly no matter how they feel or who they are and that is one thing im most proud of having moved here 20 plus years ago and most proud of the city for but we have to work on it and try to realize that as a community. I had 11 something, 12 something bars in San Francisco and every one had a neighbor who lived upstairs. All of them did. It is really hard, because as a Business Owner, im trying so hard to make ends meet. It has gotten so hard in the city now to do that, and then also, there are people literally trying to sleep or work or live their lives who are separated by inches of wood from what we are doing and for us to be successful is literally the opposite of what they need to be happy and there is just a lot of tension there. I think there is a lack of trust that is what i heard here. I think mikroblack it sounds like when you came out trying to build Something Special and clearly you have, but that i think some of the ways that you did that may have lead to people not feeling that they were being heard and now it seems that is reversed where okay, we are all here together and there are people unwilling to sit down and meet with you and despite our best efforts or whatever is going on and can only communicate by email. So, what i would encourage are some very pragmatic things that worked for me, because i think they can help. First of all, there has to be people from the neighbors and from the business who can communicate with one another without us there. I cant require that. We cant condition it, but it has to happen so maybe there are people best at communicating that could start a conversation together. What i have personally found is that once i have established a relationship with the neighbor and they realize im not out to get them and not just go toog do my thing, no matter what they say, and i built that trust which has to happen here i think, then what i realized is actually giving them some sort of simblance of power, some real power over the sound and for my businesses it has always been text messaging and we have Group Text Messages where somebody living above us says look guys it is really loud and that goes to everybody working, you can do whats app, signal, group me, there are ways to do this and we say oops, sorry, well turn it down and they say thank you. That doesnt necessarily we turned it down so much that we cant hear it, but it has been so successful for us in the past because they dont feel trapped and the neighbors dont feel trapped and helpless and we are able to react and in our case and hope the same for you, we dont want to disturb them bust we can within our limits. That is one thing. I do think that some sound proofing, we cant condition it, but think it would be something you would want to look at. I always put sound proofing because it is hard to sound proof Old Buildings but there are pragmatic things that can be done. One is double sheet rock with a hanging joint and putting another level of sheet rock. It isnt that expensive. It is a lot cheaper then quite rock which is the expensive sheet rock. It is effective and just taking maybe 2 or 3 inches off the ceiling, can be done by a contractor quickly and may be able to get grants. That has been really successful for us in the past. The other thing is, once a relationship is established, i really really really encourage you and you to do tests where the speakers are located because we found multiple time thrz is a single speaker that is up against something that is a shalf in the building and these Old Buildings have weird areas and sound spaces and sound can travel in the weirdest ways. It can cut through a building to the building next door and sound like you are in the room. In the past we turn this speaker up, someone up stairs. Turn this up, cant hear it. This i can hear that. Unplug the speaker, move to a different part of the room and they cant hear it anymore so sometimes the solutions are so simple that are all most baffleling dumb, but you cant do them without having a simblance of trust and trying to build a relationship together. The castro is really hard because the buildings are really old and there is a lot of night life. The final thing i say is retail is dying. It is not going to exist in the present form anymore, so part ofthere is a reckoning coming for people who traditionally lived near and around retail where that simply will not exist anymore. The only things that people are going out to now if they are going out is to hospitality, events spaces and things like that and with very few exceptions. Like book stores are fine. There are retail spots all over the city that are about to change and there are people who lived decades and decades above a very quite place that is no longer goin to be that and it will be a hard thing for our city to do and well have a lot more meetings like this in the future im sure. This is one of hundreds to follow. Those are my comments. I am okay with the splitting the baby. I think biweekly parties are easier to get a handle on then monthly and so thats where im at. I have a couple questions for staff. I saw that they have a abc number 42 . Uhhuh. I heard references to the accessible to all ages, does that preclude them from being all ages . My understanding is that you had to be over 21 for a 42. I have to look. Okay. I can tell you. I dont want to get anyone in trouble. It is pending i want to make that clear so not fully executed, but a simple Google Search will tell me. And this is dovetail off conversation with staff earlier this past month. I dont know if this looks like a condition or recommendation, but since the cultural districts are a program we can avail ourselves of and creating harmony between the various components of culture within their respective districts is part of that mandate, maybe perhaps having engagement with the castro cultural district since we have been in receipt of some of the concerns expressed by residents that maybe this would be beneficial, especially in regards to cultural competency and also availing the cultural district of support mikroblack might need in regards to opening a woman owned space in the castro. I dont know what that looks like. I differ to you on that. They may just throw that back at you. We did have a conversation abouti am trying to be careful about how implementation, that is where i differ to staff on in terms of the recommendation or if it is a condition. Maybe im unclear of what you are requesting . Engagement. I dont think that could be a commission but 80 we can make it a instruction. I had seen something from the castro group but it is castro merchants. I thank mikroblack for reaching out to because that was a recommendation at the first hearing. I think to facilitate engagement might be helpful for both parties involved. Again, we will be working to do a Narcan Training and passing out narcan and Fentanyl Test strips and educational materials, and this is a pilot and we are going to assess the impact and we are going to see how we can potentially scale this so it is city wide somehow, work with other partners, but it has been a real pleasure to put this together, so thank you so much.
