Someone gave the President A Statement to read on tuesday that was incomplete at best, misleading at worst. Who . So i have read out the president s statement. I have read it out yesterday and what he said. He said that he respects or he takes Classified Information and documents very seriously. Thats what he said. He said he did not know that the records were there. He does not know whats in them. He said that. You heard from him directly on this and his team has been cooperating fully, fully and not only that, again, ill say this, the Attorney General said this himself, that he heard from the team shortly after. So we have laid out, laid out what has occurred here. You heard from the white house counsel. I just read the statement from his lawyer and, again, you know, we take this very seriously and the president does as well. When will the white house release a log of visitors to the Wilmington House . You know, peter, youve asked this question or your colleagues have asked this question before. Lets not forget what we did here in this white house. We instituted something that the last administration got rid of, which is putting out the white house putting making sure there was a white house log, extensive white house log the Wilmington House where there is potentially unsecured classified material. Again again again, we did something that the last administration got rid of which is instituting the white house lost. Did you ask the last administration why they got rid of the white house lost . This is the lead. Merrick garland announced he has appointed robert herr as a Special Counsel. Herr is a d. C. Lawyer right now. He previously served as a u. S. Lawyer until 2021. He had been appointed by President Trump, the previous administration. The announcement from garland came just after the white house announced Classified Records had also been found at President Bidens home in wilmington, delaware, including some in his garage. This discovery was in addition to the Classified Records that had been found at bidens private office in washington, d. C. , as Phil Mattingly reports for us. It is confident the documents were, quote, Inadvertently Misplaced. Im here today to announce the appointment of robert herr for Special Counsel. It was in the Public Interest to appoint a Special Counsel. Reporter Attorney GeneralMerrick Garland appointed robert herr to investigate and revealing a lot more detail about an issue biden and his lawyers kept quiet for weeks and had desperately tried to manage since the story broke four days ago. People know i take classified documents, classified materials seriously. Reporter special announcement coming after a second statement about a second set of documents found at a second location. As part of that process my lawyers reviewed places where documents from my time as Vice President were stored and they finished the review last night. They discovered a small number of documents with classified markings in Storage Areas and File Cabinets in my home and my personal library. Garlands time line underscored at the time of the first statement on the issue earlier this week were cooperating fully, cooperating fully with the review and which i hope will be finished soon. Reporter his lawyers had been aware of the second set of documents discovered at his wilmington home for a month. It started with the November 10th discovery. Ment which led garland to appoint u. S. Attorney john lausch to investigate the matter. On december 20th, more documents discovered. President bidens personal counsel informed mr. Lausch that additional documents were identified in the garage of the president s private residence in wilmington, delaware. Reporter all key factors for what lausch would recommend to garland last week. On january 5th, 2023, mr. Lausch briefed me on the results of his initial investigation and advised me that further investigation by a Special Counsel was warranted. Reporter the recommendation that came four days before the initial discovery of classified documents leaked and before days of white house statements that intentionally avoided key details or obfuscated key details in part out of an effort to avoid this very moment and to follow strict limits set by his lawyers. Im going to get a chance to speak on all of this god willing soon. Reporter as a Due Diligence was still ongoing. This morning President Bidens personal counsel called mr. Lausch and stated an additional document was identified at the president s personal residence in wilmington, delaware. Reporter jake, while there was not a lot of information from the Press Briefing that has been going on for the last hour, she did confirm that the internal review is complete. There are no more areas they are going to search. As for the president s position on the Special Counsel, they said we are confident a thorough review will show they were Inadvertently Misplaced and they acted promptly. Do you think Attorney General garland made the right decision appointing a Special Counsel, not just a Special Counsel but one who had been a u. S. Attorney under donald trump. He had no choice because he had so unevenly handled this. The it is so uneven with former president clinton and Hillary Clinton and President Trumps house being raided and then we have President Biden who has documents in his home for a period of six years. Having appointed a Special Prosecutor for the trump issue, he had no choice but to do this. Hes lost a tremendous amount of credibility as a result there was such an over abuse of discretion in the way the trump issue was handled. There is a significant difference in the sense that classified documents are classified documents. Whoever has them, they should be dealt with appropriately. From what we can see, President Biden and his team telling the national archives, telling the Justice Department about it. President trump resisting any negotiation and quantity its different. There are a number of questions that need to be answered. With former President Trump, he says he was cooperating all the way until there was an inspection and he agreed to put an additional lock on. There were ongoing negotiations but he said these had been declassified. He said they were declassified because a president can think about them being declassified and he did add that. As i said with you before. Thats a facts based issue hes going to have to deal with whether or not they were actually declassified. The issue is especially in the light of just the irony of President Biden being so scathing that these documents were found at maralago and now he has them in his garage behind his corvette next to the leaf blower. He said he takes classified documents very seriously, when i hear that in my mind im thinking hes obviously pretty serious when he takes classified documents. The question is why did he have them to begin with . Whats inadvertent . When he took them in his home . Where were they before they ended up in the back of his corvette . What do you say to a critic who says you sound very animated about this. I was animated then and now. Its not just the classified documents. The issue is the abuse of discretion, we talked about the concern of the raiding of maralago. The second issue here is the irony of the indignation from the biden administration, the fact that theyre the ones that ordered the raid, his political rival. He ordered the raid the Attorney General ordered the raid on his home. This is how outrageous this is. Imagine if someone said there were classified documents found at bidens home. Lets go look in jills closet. They looked in mimelanias clos. Again, i would say that from what we know and, again, this is about what politicians tell us, but from what we know, the biden people told the national archives, told the Justice Department, said we have these and gave them over and from what we know about the trump case, the Justice Department was told about it and the trump people resisted it and did not turn over these documents to the point that the fbi felt they had to go there and get the documents back and the only reason we know about that is because trump announced it. Theres a couple things here that youre missing. One, there were a number of documents that were surrendered in those negotiations. Not all of them. And secondly the documents that had not yet been surrendered, the biden team excuse me, in the trumps team view they were in ongoing negotiations and they had secured the facility further. The biden team, the only reason we know about it is somebody leaked it. They didnt say, this is inadvertent and weve leaked it. The theres more. Additional ones. Just the callousness of this being in boxes in the back of the garage shows you the disparate treatment between the two. The irony between the biden administrations treatment of trump and the fact that this is now an issue for President Biden i think is something the American People take note of . So i do want to ask you because youre a new chairman. Weve talked about this before. The top democrat and republican on the Senate Intelligence committee, mark warren and marco rubio, im sure they disagree on a lot of things. That committee, at least from where i sit, seems to operate in a functionally bipartisan way. They seem to cooperate a lot. The House Intelligence Committee, youre just the fresh chairman so im not holding you responsible. Im not a Ranking Member yet. You will be. The House Committee hasnt operated like that since mike rogers, different mike rogers than the one who got in a fight with gaetz. Years. Its been years since the House Intelligence Committee operated in a bipartisan way. Is it your goal to do that . Or do you see the house intelligence way that jim jordan looks at the Judiciary Committee . Its a place for the party in charge to be in charge. I dont think this is a goal, i think were going to achieve it. The Intelligence Committee is going to be looking back on Classified Information and were going to work on a bipartisan basis but on bicameral. I believe the members of the committee, both republican and dem democrat, are ready for the committee to regain focus. My hope and in many things that are being discussed that have a number of overlapping committee jurisdictions, is some of these areas will not be areas where our committee is handling them. Were only handling them with respect to National Security, Classified Information. Theyre public and when they have a Hearing Everybody gets to see. The other aspect is some of these overlapping areas of jurisdiction are true oversight of areas of the government that arent in our committees jurisdiction. Evan, before we get to what we learned today, what do you think about what you heard from mike turner. He made it sound like trump was bending over backwards to work with the Justice Department and what biden did is very egregious. Its just not true. The former president fought every step of the way. He filed a lawsuit in court in florida which forced the Justice Department to show a lot more of its investigation, right . They showed the search warrant, they showed pictures and so on. All of those things came about because the former president went public and was fighting. He is too this day fighting aspects of this. The Justice Department is trying to get the trump team to say there are no more documents, right . This is a fight that is actually still happening in court behind the scenes at the federal court here in washington. So the idea that the former president has been cooperative is far from the truth. So lets talk about the current president , this process. How is it going to play out . Well, you know, the problem, as i think we all know with Special Counsels, is they are easy to appoint perhaps as we have seen and theyre hard to get rid of. Thats one of the reasons why Attorney GeneralMerrick Garland was hesitant to do the first one on donald trump and felt he was forced to because of the situation of donald trump running for president and against his boss and then he was forced to do this one. Once he received the recommendation from john lausch, the u. S. Attorney in chicago, the facts of what he had found, the Attorney General felt he had to take this step. It didnt, of course, help that the Biden White House has had trouble putting out a straightforward time line of what was found and when, right . Certainly i think the Attorney General made a quick decision, jake, about what to do. The problem is, as you know, i mean, john durham is still around, right . A Special Counsel appointed a few years ago. Thats the reason why its difficult to put a time line on these things. People might not remember ken starr but i think the original charge was not to be looking into whatever president clinton and Monica Lewinsky was doing. It was about whitewater, the land deal. In any case, do you think President Biden is going to talk to the Special Counsel . Is he going to be interviewed . Well, thats a question for the investigation in terms of whether they think that there is a reason to talk to him. My guess would be that what theyre going to do is first theyre going to talk to everybody else. I would think the investigators would leave a current president to the very final person that they would investigate if they think they need a reason to interview him, i mean, interview. So first theyre going to talk to all of the aides. One of the complications in this particular investigation is the time lapse. This is now were talking years that these documents have been in these locations presumably since the time he was Vice President. In some ways its a harder investigation than the former President Trump investigation because theres just much more time. They have to go back and find people who were involved in the handling of these documents many years ago. But i think President Biden would be one of the last, if not the last person that they would come to if they need to. Jamie, put this into context for us. How unusual is it, two president s being investigated by two Special Counsels, about their handling of documents. In a word, never. When you talk to former president s, Vice President s, people at the archives, it is true, unclassified papers, things happen. Folders go astray. Mistakes are made. Honest mistakes are made, but looking back, weve reached out. You know, bush 41, bush 43, clinton, obama, quayle, cheney, weve never seen anything like this before. Can i just go back to the word cooperation here when you were talking to chairman rogers. The reality is this is one area where these two things are completely different. We dont know yet whats in this second batch of documents that were found, how sensitive it is. Right. What the National Security implications were, but as soon as they discovered there was a problem, they immediately cooperated and that day immediately turned things over. We still dont know, evan, if there are other classified documents there in the president s possession, President Bidens possession or anywhere else. Right. The representation from the white house is that theyve completed a search of all of the possible places they can think of that would be relevant. The question, jake, is going to be when the Special Counsel sets up his office and he gets his fbi people who are going to be doing this thing, how do you make sure that thats true . Do you get a representation from the president and his team that we can swear there are no more documents . Or do they ask to go take a look . And those are going to be sensitive questions that are going to have to be approached. The only reason Donald Trumps house was searched in the way it was, because they clearly had refused to turn over documents and they knew documents were being moved after being told not to. Thats why jamies point is so important as the investigations continue. The most important thing the Justice Department has to flush out is the intent. All of the criminal statutes that deal with the handling or misha mishandling. They point to whether the conduct was knowing, whether the conduct was willful, whether there was an intent to mishandle or remove them in an unauthorized way. Both of the investigations of both the former president and the current president is going to hinge on whether or not people were intentional in their mishandling or whether it was a big accident. He has full support from speaker Kevin Mccarthy who will not call on him to resign. The voters elected him. He is seated. He is part of the congress. That after he promised to tie raising the debt ceiling to specific Spending Cuts setting up what will likely become a fiscal showdown between the two parties and the house and senate later this year. Lets get some reaction on this and all the busy information from somebody who knows a little bit about the job. Joining us now is the former speaker of the u. S. House of representatives, paul ryan. First, with all this news about classified documents, whether President Biden or President Trump, i want to ask you as somebody who when you were Speaker Of The House who had access to classified documents, if you could give us some sort of insight into how easy or not or difficult it might be to actually accidentally or no, i never took them home. I left them in my safe in the office. Is that right . They went from the safe in the office to the skiff and back to the office. I never took them in my body. They were in locked briefcases. I never took them out of the office. I guess it would be different if you were president maybe . Im trying to figure it out. Its the system you put in place in your office. You had a rigid system . I had a rigid system. They went from the intelligence community, the one clear staffer of mine had access to. We would take them from the safe down be to the skiff which is underground in the capitol. I would read them there, discuss them there, have my briefings there. Wed go back to the office and theyd go in that safe either in the skiffs safe or in the safe in my office and they would go nowhere else. Sounds like a pretty good process. Thats the way we did things. Yeah. The. Okay. Lets talk about the house race because this hasnt happened. We saw something last week. It hasnt happened in 100 years and longer if you want to go to the number of ballots. A serious battle on the floor of the house to be Speaker Of The House. And some very serious personal criticisms of the man who ultimately won election, Kevin Mccarthy, including about whether or not hes trustworthy and the like. As a friend of his, as somebody who was speaker when he was House Majority leader, what was going through your mind when you watched it all play out . I thought he was going to gut it out. I didnt think it would take 15 votes. I suppose between 4 and 14 i wasnt so sure, but i still thought there was no alternative. Because there was really no alternative the dynamic was different when i was there because i was seen as the alternative. I wasnt looking for the job. I got drafted into it. There was no dynamic like that at play here and kevin had done so much more. First of all, remember, i came mid midterm. Boehner, the motion to vacate was placed on boehner. I came midterm. Kevin had worked his tail off to campaign and fund raise and build over the last two cycles. He did that. Its different than what happened in 2015. Kevin was the leader of the conference as the Minority Leader for two cycles, built that majority. Then there really wasnt another alternative for people to go to so i really thought he would get through it, even with this tough margin, i just didnt think it would take 15 votes and all the concessions that it did, but it did. Theres this moment, well show it, Armed Services committee you dont have to show me the pictures. There he is lunging at Congressman Matt Gaetz after gaetz did not vote aye, thus stopping mccarthy from winning on the 14th ballot. Does this bode ill for your partys ability to unite and govern . No. Theyre very good friends of mine. Mike just got hot under the collar. They were pretty exasperated by that time. My understanding is matt gaetz was going to vote for him and then changed his mind in the vote without telling anybody. That makes people pretty upset. Look, hot heads happen. Things like that occur. By the way, thats what the floor is like whenever you have any contentious vote. Cspan doesnt usually cover that. Its always on the floor when you have difficult votes. Gaetz wants the cameras and i have to say i support it no, im not a fan of the performance. This would feed into that. No, im actually not a fan of that. That is what the floor is like when you have tough, contentious votes. Ive seen that movie a million times over. You just havent seen it on cspan. No, i dont want to see that happen. They will play on the floor like they do everywhere else. The Counter Argument is a little too much entertainment in politics these days. Id like to see that toned down. Such a buzz kill. Mccarthy made so many concessions to this wing, chip roy, matt gaetz, however you want to call it, these insurgencies, rebels, and he made these concessions to get their votes and without question the concessions weakened the speakership and empowered individual members. The motion to vacate, which you mentioned, which got rid of john boehner is back to one vote, as it was before, but there are other things in terms of whos on the rules committee, opening up the process. Anybody can offer a bill. Anybody can offer an amendment. I like some of those, by the way. Some of those are pretty good. The 72 hour one is a good one. The idea you need 72 hours to read a bill. Appropriations. I didnt want to cut you off at your question but let me say this, i think i had too much power as speaker. Oh, really . I really do. Yeah, absolutely. The thing that bothered me most were the omnibuses. A bill that thick that four people openly decide on. 15 Spending Bills crunched together. 12 crunched together and its thousands of pages. It would be myself, nancy, chuck, mitch. The House Speaker we know who youre talking about. They were your friends. Well some of them are. Ish. Ish. We all got along. We all respected one another. The problem is, no four people should be doing all of that, making those decisions. I was making decisions on composition of Spending Bills. I think im a smart, principled person but the guy and the man and the woman whos in the Subcommittee Spending two years reading Inspector General reports and gao reports, they should be making those decisions, not kicked up to elected leadership. Are there any new rules or the free for all whether that i think the vacate has become weaponized. I never worried about this myself, frankly, but that was because of my own dynamic, i suppose, but i think members now see this as sort of a tool they can take for a ride. I think thats bad for the institution. The last thing john boehner the last words john boehner said to me as he walked out of the room of his smoke filled office that i took over, dont forget your number one job is to preserve the institution, defend the institution. If you are a Committee Chair as i was, i never really thought about that. Most members dont think about the institution. Right. Youre thinking about your Policy Agenda or whatever you want to do to get done. Thats not normally what you think of. So i became a big institutionalist but it took me a while once i became speaker because i realized just how important for our freedom, liberty, democracy this is. Were going to take a quick break.
