But no matter what the president says, all along sessions hasnt done anything. Right . I mean he just continued to do his job. Could this just be is this just a new chapter in the what the heck is going on with this relationship and this is just a bunch of nothing . I would say that this relationship has been pretty toxic for a long time, ever since the president made it known publicly that he was angry at Jeff Sessions for having recused himself. And you are right, there have been peaks and valleys. At some point weve heard Jeff Sessions kind of actively push back against the president , making some of these suggestions when hes threatened the investigation in the past. It will be interesting to see how he deals with this tweet given that it is actually a pretty clear directive by the president. This is the president of the United States telling his Attorney General to shut down an ongoing investigation. Now he is recused from that investigation so you could say that it really is a big nothing in the end. But it is a direct order and hes part of the president s cabinet so it is going to be really fascinating to see how he reacts and how the Justice Department reacts. You have a great point. Because words here matter because the words of a conversation behind closed doors, between james comey and the president , those matter. Was it a directive . Can you see your way to letting him go . Was that a direct order, was that not . This one is pretty clear what the president is saying. I dont know another way to see it. Absolutely. And really, it is going to make it a lot harder for the president s allies to say that he didnt make those statements in private. Right . Weve heard in the past that james comeys a liar, he made it all up. The president of the united states is saying basically the exact same thing to all of us in public on tweet, via tweet. So it is very hard to see an argument that he was saying Something Different in private. One thing ive got to say, too, is, weve talked a lot this morning about the president s anger with Jeff Sessions for recusing himself. Just so the viewers understand, that is a normal process that prosecutors have. It is something thats recommended by people who arent political, who are Career Employees there. It is based on making sure you dont have a conflict of interest. So Jeff Sessions was doing his job and the president s angry at him for doing his job. That in itself suggests the president has an improper purpose because it is that unusual for being that angry at someone for recusing themselves. Whether it is a directive or not, we were just talking about that language, i just think about for a second. When is the last time your boss told you you should do something and you thought that was a mere suggestion. Right . That is just now how you read language like that from your superior. Just so much of the details and accusations coming out of the day one of the manafort trial, the first trial and first big court test to come interest the Special Counsel Robert Muellers Russia Investigation. Day two is under way. The former trump Campaign Chairman is facing a laundry list of crimes. One person keeping a close eye on this President Trump. His tweets this morning bearing out the fact that hes asked his staff to keep him updated on whats happening in that courtroom. Joining me right now, cnns crime and justice reporter, shimone, whats been happening in court today. Seen some pretty significant testimony. Certainly. It is our second witness of the day. The court in a short recess at the moment but we expect to continue to hear from an fbi agent who was at manaforts home executing a Search Warrant last year and that fbi agent is describing how they went about conducting that Search Warrant. They went to his home in alexandria, virginia. They knocked on his door three times. It was about 6 00 a. M. Or so, this agent says. When no one came to the door, they had a key and they used that key to enter the home. They saw manafort in there. Now the fbi agent spent this morning describing some of the documents that he found in it the home having to do with loans, some Banking Transactions with manaforts name on it, wire transfers with manaforts name on it. Obviously that is sort of the meat, sort of the heavy stuff of this trial of the evidence that the fbi gathered. There was some question about whether or not certainly people on the Manafort Side have raised issue with how the fbi went about conducting this Search Warrant on manaforts home. They said no one had ever knocked, that they had just entered. But clearly the fbi agent here this morning testifying quite differently, that they did knock, and when no one answered they went into the home. Fascinating. Much more to come on this one. This is just getting back under way in a few minutes. Lets get some perspective from day one what we just heard from the fbi agent testifying about. Renato, what do you think is key from this fbi agent . Not just about the raid but it kind of seems investigators may be getting into the meat of their argument that manafort knowingly signed several kinds of false financial documents. Well, those documents, the documents that they found in the Search Warrant, are going to be the basis of this prosecution. We can we talk a lot about you mentioned the lavish spending and so on. And that is very interesting and it catches attention. But what is going to prove his guilt beyond a reasonable doubt will be that evidence. Thats what prosecutors are relying on. In a case like this, it is usually hundreds and hundreds of pages of financial documents. As they said, follow the money. It seems thats what theyre starting with right now. The prosecutors legal strategy is, as we heard from yesterday, manafort is a liar, he opened 30plus Bank Accounts to hide his money. For the defense the strategy seems to be blame the other guy. Blame manaforts longtime aide, rick gates. What do you think of hthat . I think it is very common defense strategy. We have to grade on a curve here because the defense doesnt have a lot to work with. On the defense side you are usually trying to either say no crime was committed, thats hard to do in this case. So you usually try to offer up somebody else. It makes sense for them to choose gates because gates is the governments witness. He is a star witness for them. He is the flipper. You have to take down the flipper if youre on the defense side. If the governments rerlying on that cooperator, you have to undercut his credibility. So what are you listening for today as the fbi agents going to testify again. A known democratic strategist has been testifying as well. The governments strategy is going to be very clear and straightforward. Im going to Pay Attention to what the defense is doing on Cross Examination because what the defense is going to do is try to plant the seeds for the jury of what their arguments are going to be at closing against the government case. The top democrat of the Senate Intelligence committee announcing today the top executives from these Top Tech First are going to be call up to testify before congress once again next month. Why . Well, to face questions, enduring questions, about what they are doing to protect against foreign influence as the Midterm Elections fast approach. This all comes as facebook Just Announced that it has removed more than 30 suspected russianlinked accounts and panls th pages that were organizing political influence campaigns to disrupt the Midterm Elections. The tech giant briefed lawmakers about all this and says that they cant say for sure whos behind it all but say the signs are there that it could be russia. Cnns Senior Reporter dylan byers is following all this for us. This is, with regard to what facebook is doing and saying, this is a really big deal. What exactly did facebook do . This is a really big deal for a few reasons, kate. One reason is it is a reminder that meddling, foreign meddling, russian meddling is going to be a reality for facebook in perpetuity. This is not a problem that they can ever fully prevent. The best that they can do is monitor the situation and bring it to the attention of congress which is what they have done. At least they got ahead of it this time. At least they reported before the 2018 midterms, not after the 2018 midterms which is what we saw in 2016. A key detail there though is, well, they are a he not publicly acknowledging this was linked to russia. They have told lawmakers all signs point to russia, and thats significant because what theyre doing is they are effectively putting the ball in congress court. They are saying, look, we put in the time, the money, the resources, we have 20,000 people working to combat misinformation on our platform. At the end of the day, if this is an issue you guys are serious about, balls in your court. What congress will inevitably say is, in order to do that, we need to get the president of the United States behind it. As you and i both know, the president of the United States, at present, doesnt really have any interest in addressing the issue of russian meddling. If you follow just one final note. If you follow congress at all, there is a real disconnect of an understanding of tech firms and social media and the pace with which it changes and the understanding of members of congress and what theyre actually dealing with. It is apparent. I think thats one of the problems. Kate, that is huge issue. Even senators like mark warner will acknowledge that they are constantly going to be behind on this issue. He told me once while theyre dealing with 2016 problems, foreign meddlers are preparing not just for 2018, but for 2020. And again, facebooks ceo coo, sheryl sandberg, has said this is an arms race that you can never completely win. Again, it is a game of whack a mole. At the end of the day, every Election Cycle we are going to see this issue. The Silver Lining is that facebook is finally getting ahead of the problem as opposed to being behind the problem. Whats next . Lets see. Joining me now, director for a group that partnered with facebook to monitor disinformation campaigns. He was a top aide, also to president obama on Cyber Security. Graham, thanks for coming in. You studied these accounts. Youve studied these ads. You know what facebooks talking about here. Do you think russia is the one behind this . This time . I think that based on looking at some of the pages that facebook took action against yesterday, what we can tell is that the content, the tactics, the language, was very similar to that that we saw coming from the infamous st. Petersburg russia troll farm from 2014 through 2017. I would say the Behavior Correlates very highly with what weve seen previously. Do you think it is wrong or premature for some Top Democrats to say that they think it is russia . So i think that attribution is very different than correlation. What we can say right now with a high degree of confidence is that there is a very high correlation. But can we say right now today that it was 1 h00 russia . Thats going to be a lot more difficult. How do you definitively find out eventually who is behind it . Anything in this scenario, theres no Silver Bullet to say it was 100 russia. What you can do is say, okay, well, theres 12 different factors that we look at and this very specific case exhibited eight of them, so we can say with a high degree of confidence that it was russia or was not russia. So what you are talking about is not 100 but you are talking about degrees of confidence. Okay. Graham, is this influence campaign that facebooks talking about this time and that youve looked at, is it different tactically, if you will, from the previous one after 2016 . So, what i would say is that, those who would sow disinformation are adaptive. The tactics are changing. I would say that it is getting more sophisticated, harder to detect, and what we saw on the pages yesterday was a very specific focus on highly polarized issues, as well as growing as much of an audience, then trying to translate to action in the real world. Growing an audience on a Facebook Group or page or Something Like that, then trying to translate that into action on the street or in protests or things like that. With regard to all of this, the Trump Administrations very squarely placing the blame on the Obama Administration for being caught flatfooted. I want to play for are the Vice President in what he just said just yesterday. Listen to this. The last administration all but neglected Cyber Security, even though the digital threats were growing more numerous and more dangerous by the day. In 2014, a Foreign Government actually hacked in to the White House Network itself, and yet in the face of constant attacks like that, the last administration too often chose silence and paralysis over strength and action. Graham, you worked for obama. You were a top aide for Cyber Security. How do you make the case that you all did enough when russia is clearly, was then, is now still attacking and interfering . So i think that a very distinct decision was made during the last administration. You can see from announcements that were made from the department of homeland security, the intelligence community, the fbi, well ahead of the 2016 elections, as well as a communitywide assessment that came out after the elections that said, russia is 100 trying to influence the United States elections. Thats that is a conclusion that we came to any number of times. What is true is that this is a truly National Security issue. It is bipartisan in nature. And any action that needs to be taken needs to be bipartisan. During the Campaign Season around 2016, there wasnt a bipartisan appetite to address this problem. I hope that that will be slightly different heading into the 2018 midterms. One thing that has changed, i noticed, its been noted, that when john bolton came on as National Security advisor in may, he eliminated the position of Cyber Security coordinator at the white house. Do you think that position would be making a difference today . I think that regardless of whether theres a Cyber Security coordinator at the National Security council, there are a number of truly dedicated Public Servants and Career Professionals that are working on Cyber Security issues, specifically across the u. S. Government. I think that that is important. Thats a 24 7 capability. That will continue to be the case. But at the same time, not having a Cyber Security coordinator at the white house specifically is a statement of priorities. So there is a disconnect between the comments that were made yesterday in new york talking about Cyber Security as a growing challenge, then actually not placing personnel on the white house that are working on those issues. Can you put it finally in perspective for me . Dan coats is saying that the Warning Lights are flashing again with regard to russian interference. How under threat is the Midterm Election . So i think the Midterm Elections are a top threat target. The way that we would talk about that is, it is a target for cyberenabled activity. I think that youve seen actions on both ends of that leading in to the midterms. So just last week it was reported that certain emails were being potentially hacked in to for key candidates, as well as the action that facebook took yesterday which would be an influence operation. So i think that you do have the clear telltale signs that both of those activities are occurring in the leadup to the 2018 midterms, and that it is a top priority in terms of threats that we face right now. Again, is it a top priority on a bipartisan way to stop it from happening. Graham, thanks for coming in. Really appreciate it. Thank you. More Breaking News this hour we need to get it. Congressman, great to have you here in the studio. Thanks for coming in. What is your rae being a to the statement from the president today when he says Attorney General should put a stop to this . First, as we all know, Attorney General sessions has recused himself so he doesnt have the legal capacity to terminate mueller. That would have to be rosenstein. Does that bring you comfort . What i think that that does is, it separate President Trumps opinion from his instructions. I still find the tweet to be inappropriate and intemperate. But having said that, just from a purely legal perspective, it is important to note that if the president wants to fire mueller, he can do this a under article 2. But instructing or suggesting that Attorney General sessions should, Attorney General sessions doesnt have the ability to do that. I think the best thing that can happen here is the president which he wont do, but he should do is leave it alone. Let the investigation run its course. People are concerned about russian interference in american elections. Fering in elections all across the globe. We should take it very, very seriously. Russias trying to harm us from within. I think to shut it down is highly improper. This is the first time that hes really explicitly saying that Jeff Sessions should do this. I know that some republicans have said, of course, that mueller should be able to finish his work and just like you said, donald trump should stay out of it. Does this now mean you all should act and do something to protect mueller . Well, i do think that we should. There is legislation in the house be have signed on to that would not allow the dismissal of the independent counsel except for cause. And if that were to happen, you would have to report that to congress. There would be a little bit of a process that would be undertaken. Do you think this changes the appetite for that . Because clearly theres been no appetite for that. I many doubt fam doubtful. Ultimately i think someone will say he was expressing an opinion and he doesnt have the capacity to do it anyway. It undermines the integrity of the investigation. I think it is a legitimate investigation. Let me just echo the comments of my colleague, trey gowdy, if youre innocent, act like youre innocent. Dont do this stuff day after day. We should be focused on the trade issue which is very serious. It is very damaging to our farmers. We should also be talking about the success of the tax cuts, something that i voted for. Republicans do have a good message. This gets in the way of that. I want to get to trade. Ive heard paul ryan say i have received assurances that his firing is not even under consideration. Does paul ryan in light of this today, does paul ryan need to reconsider that . Does paul ryan need to Say Something more forceful as the Top Republican in the house . I think the speaker is obviously a very smart man. I dont know what he is doing today but im sure he will review what was said and speak with his counsel on that. I dont want to get out in front of the speaker. I have great confidence in his leadership. I think that hes probably said he would prefer i dont mean to put words in the speakers mouth, but he would probably prefer the president tweets a lot less on this. I think hes dentally said that one or two times. Lets talk about these tariffs. Cnns now reporting the Trump Administration is considering raising tariffs on 200 billion of chinese goods, raising the tariff from 10 to 25 . I want to play for you what the president actually said about the trade war with china last night. Listen to this. Our farmers are true patriots. Because china and others have targeted china and others remember this have targeted our farmers. Not good. Not nice. And you know what our farmers are saying . Its okay. We can take it. These are incredible people. Are you hearing that from farmers, its okay, we can take it . Farmers are concerned. They are small businessmen, businesswomen and they have taken decades to develop a lot of the relationships they have with their exports. So if we also know, by the way, that china we knew that the retaliatory tariffs were coming and they were going to hit america where it hurts the most. And farmers are bearing the brunt of that. I dont think they like the thought of getting a 12 billion bailout. I think what they want is not to have their Business Operations interrupted by now having to sell something or having it be purchased for much more than what they had anticipated. Having said all that, i think what the president wants to do is reduce barriers. Hes right to do that. What hes hes said to members of congress, dont be weak, dont talk about this. I think what hes trying to do is forecast to the International Community that he is dug in and he is going to get better deals. Its basically short term paying longterm gain do you see that . Were feeling the shortterm pain right now and for a lot of us, it is very concerning because we have constituents that are bearing the brunt of that. This is very uncertain terrain right now and i think that i would point to the National Defense authorization act which we just passed out of the house. It is going to get passed out of the senate. What we are doing there is getting tough on china in different ways. I think my concern here, as it is with many, is this is not the appropriate way to go about Getting Better trade deals. Real quick. The president s continuing his threat on the Government Shutdown if he doesnt get his border wall and other national border security measures. Do you agree with that . No. I think it is no. I dont. I dont think the governments going to get shut down. If we are talking about a government where is your confidence . I just i dont see that happening. What i that was as much, i think, about shifting the discussion from his Press Conference with vladimir putin, as it was anything else, because now we are talking about a potential shutdown in september. It is just not going to happen. There is no appetite for it, one. And two, we had a bill in the house that conservatives left us out to dry on that would have funded the wall, that would have solved daca and some other very longterm durable Immigration Reform measures. So there is a frustration amongst many of us in the house that want to get an Immigration Reform package done that does include border wall funding that was undermined by some in our party. I think the president could have leaned in on that and supported the Compromise Bill a lot stronger than he did. This is why it is all so confusing for everyone watching it play out. Well, there was a Message Board of folks hosted outside the country who are sort of followers of this theory, and it was a sort of go to this rally and show your support for q. So thats what explains last night but this is something that keeps popping up again and again and again. Theres a strong crosssection with people who are donald trump supporters. By the way, thats not to say its not even close to 5 or even 1 of Donald Trumps supporters. Its just those people who are who ascribe to this to tend to support donald trump.
