Its rare that the president gets to nominate three justices to the Supreme Court, but the president had that chance today by nominating judge amy Coney Barrett. And by doing so, the president is going to reshape the Supreme Court for decades to come, and all the important decisions will come from the highest court in the land, the president repeatedly emphasizing the importance of this including second amend rights, which is something the president highlighted for law and order issues which are key components of the president s campaign. While the president was certainly focusing on the legacy impact of all of this that it will have, this is something he has brought up privately and publicly stating nominations to the u. S. Supreme court is perhaps the most important thing he does as president aside from matters of war and peace. He was also focused on electoral impact. Thats something everyones chewing over this week as they process this decision not only to nominate judge amy Coney Barrett but also to try to confirm her before the election date. Mark meadows a few moments ago said he hopes if it goes smoothly, the judge could be confirmed by november 1st. Critically, that would be before the november 3rd election. Theres a huge question of what the impact will be on the right and the left. Of course, it is a galvanizing issue for the president s conservative base. It also has been. Its been a key part to the conservatives. But there will also be an impact on the left side with this Obamacare Decision coming up and the broader issue of reproductive rights. So certainly a lot is at stake. And one of the things not mentioned by the president is a cnn poll this week showing that 6 in 10 americans believe it is the president who is elected in this next election who should fill the seat vacated by the death of Justice Ruth Bader ginsburg and that it should not be filled before that election takes place. Im personally curious about this, jeremy. You were there in the rose garden. We saw a nice crowd, sitting very close together. Very few of them wearing masks. Alex azar, i saw he did put on his mask. Others did not. Everyone in the rose garden, were they tested for coronavirus before they were allowed in because they got pretty close to each other and pretty close to the president. Yeah, this is protocol that the white house has been following for several weeks. Only a certain number of people attending the event are actually testing for the coronavirus. Anyone who interacts directly with the president is tested, but most of the people in the audience today were not tested and many of them arrived with masks on. Some of them took their masks off after they took their seats and began mingling with each other. Think most notable was dr. Scott atlas, the president s coronavirus adviser. Hes, of course, not an immunologist or expert on Infectious Diseases or epidemiology, but he has the president s ear, and hes advising him on what most Health Experts say. You saw dr. Atlas not wearing a mask, interacting with ores in the crowd not tested for coronavirus. Its really remarkable. We need to remind people were still in the middle of this pandemic. We certainly are. Almost 1,000 people died yesterday from the virus here in the United States. Alex azar, when he was sitting there, i saw him put on the mask. But when he was lieaving, he tok off his mask. Everyone was walking around, fist bumping without any mask. There you see him smiling as he walked away. He took off his mask that he was wearing while seated. Whats the process that Mitch Mcconnell, the Senate Majority leader, Lindsey Graham, the chairman of the judiciary committee, are putting forward . The best way to look at things from here on out, this is Mitch Mcconnells ball game with Lindsey Graham taking the lead or playing the lead role for mcconnell over the next several weeks. I was texting with a republican official who has been involved in several Supreme Court nominations. When we were going through the schedule i was about to talk about, i said, its very fast. He said thats lightning fast. Heres whats laid out. By tuesday, amy Coney Barrett is expected to be on capitol hill to meet with Mitch Mcconnell. Sho sho sho shortly thereafter shell meet with Lindsey Graham. Thats what you do. In the leadup to the nomination hearings, according to the sources who had seen the schedule are set up to start october 12th. Two days of questions and outside questions. Thats what was done by the last president. Its october 12th to the 15th. Thats exactly what jeremy talked about he had heard from mark meadows. She could be confirmed by november 1st. Lightning quick. It could be in the matter of 30, 40, 45 days. Given the time period, given how close it is to the election and the republicans want it done, they plan to get it done. Theres little to nothing the democrat democrats can do to slow the process down. But so long as Mitch Mcconnell, the Senate Majority leader has a majority in the United States senate, we know for a fact, 51 of the 53 republican senators want to move forward to a vote. My understanding over the course of reporting over the last five, six, seven days, if it was going to be amy Coney Barrett, all 51 of those senators are expected to vote for that nomination. As long as that stays over the course of the hearings and meetings, right now mcconnell can move things through before the election. They certainly can. Phil, thank you very much. He sat on the bill and he can push the Supreme Court nominee because he wants to push down the plan. What ive been doing drn we may not be able to stop it. But we can slow it down. The American People need to know whats at stake. Im going to use every moment to get that across, and, of course, i will question judge barrett under oath as to her other views because as she has very closely held views that will impact a womans right to choose, and certainly shes already expressed her basically willingness to vote down the Affordable Care act and other precedents. Will you or wont you be willing to meet with her, give her the courtesy, get to know her a little bit. Clearly youll participate in the hearings and ask tough questions, but can will you mwi with her . Earlier dick durbin said he will give her that courtesy. I will not be meeting with her. I will meet her when i question her under oath. Shes got a personal story, wonderful family, but given her legal background, a Supreme Court clerk for justice scalia. A court of appeals judge right now, is she qualified to be on the Supreme Court . The issue is whether or not her closely held views on issues such as the Affordable Care act, such as abortion rights can beseparated from her ability to be a fair and objective justice. Obviously the republicans and the president is counting on that not being the case which is why they want her on the Supreme Court so fast so she can vote down the Affordable Care act. She has an antipathy to reproductive rights. She also is more than willing to not follow the Supreme Court precedent, and roe v. Wade is a Supreme Court precedent. Ill read to you while i have you for a moment, a harvard law professor, former Supreme Court clerk noah feldman whos well known. He writes, barrett is a sincere lovely person. I never heard her it ear word that was thoughtless or unkind. If you believe in an ideal temperament of calm and decor rumblings, rest assured that barrett has it. Im going to be confident that barrett will be a good justice, maybe even a great one even if i disagree with her all the way. Whats your reaction when you hear professor noah feldman say those words . The issue is whether she can be fair and objective as a justice because she will be on that court if confirmed for decades, shell be making decisions that impact our lives starting with whether or not were going to have the protections of the Affordable Care act. She will be making decision wls or not a woman has a right to control her own body. Shell be making decisions including on lgbtq rights and other decisions. Thats what we should be concerned about. If she can be fair and objective and not hold to her strongly held views and she can separate those, thats another question. That is but thats the concern i have. And clearly as i said, wolf, shes been put on the court really fast so she can vote down the Affordable Care act after sitting on the court to hear the oral argument on november 10th. Thats what the people of america should know. Well see what happens on that front. As we always say, were heading toward election day on november 3rd. The president is trying to sow doubt. Hes trying to create chaos with voting when, in fact, its a simple thing to do and its our job to educate voters on the best way to do that. But im confident our institutions, no matter what kind of attacks are leveled against the president will with stand those attacks and well have the proper winner declared on or shortly after election day here. Those ballots and those two envelopes, you have to request those in pennsylvania. Theyre not just sent out to millions of people blindly, right . Thats exactly right. You get to decide in pennsylvania how you want to vote. If you want to vote at the polls on november 3rd, you simply go there. If you want to vote from home, doing it by mail. You request a ballot, its mailed to you. You fill it out, and you mail it back. If people dont trust the mail right now there are a lot of people who dont trust the mail, are there dropoff locations where people can vote at home, put it in the envelope and put it in another envelope and drop it off . Yes. If folks want to go to an early voting center, they can do that. If they want to leave a ballot at a legal drop box, they can do that as well. I recognize there are a lot of people who have concerns about mail right now. I do as well. Thats why ive led a coalition of states in suing louis dejoy, the president s handpicked crony for postmaster general because he made illegal changes to our mail back in july. He slowed up the mail. I was talking with a person who has been waiting extra days for his drug, a businessperson has been waiting for a check for several days simply because the u. S. Postmaster general slowed up the mail. Weve sued him to reverse the changes from july and importantly because i dont trust him t president , or the word they put foncht we want an independent monitor to be placed at the Postal Service to ensure that these legal changes that were made get rolled back and the mail can begin to flow on time. The point here is we need to have confidence in our institutions of government. The president attacks them relentlessly from the Supreme Court to the post office to so many institutions of government. If confirmed judge amy Coney Barrett will undoubtedly bring a more conservative bench to the Supreme Court, and on one issue shes been particularly outspoken on, that being the Affordable Care act, which happens to be one of the first cases the judges have on their docket after the november 3rd election. Was june 26th, 2015, where he said the future judges he nominates are going to do the right thing unlike chief Justice John Roberts did. So hes clearly wanting distance from john roberts who did rule previously in navy of the Affordable Care act. The president has made clear what he wants. We would be right in assuming he got that with judge amy Coney Barrett. She argued judge roberts approach. She signed a letter, the incredibly critical contra s contraceptive portion. She has a paper trail and she was asked about it. Shes made it very clear where shes stood on it at least in the past. Were told they will hear the justices whether theres eight or nine on november 10th. Theyll hear the arguments, but a decision probably wont come for months, maybe until the spring. If the Affordable Care act is struck down by the u. S. Supreme court as unconstitutional, as you know, millions of americans could lose their health insurance, and if the u. S. Is still in the middle of a deadly pandemic, that would especially awful. Walk us through this process how it would actually work. Sure. You ask a very important question here because whats at issue here, theres three things the Supreme Court is deciding. Number one, whether texas and 17 other states have the right to sue in the first place. Thats called standing under the law. Number two, whether the penalty for the individual mandate, for not having insurance, whether having any penalty in the law is unconstitutional. And, three, if you find it unconstitution unconstitutional, does that mean the whole law is void including those who need health insurance, or you keep the law in place but take out that pep amount. Thats called serverability where you take a scalpel, in effect, and curve it out. I dont know how many Times Congress has tried to repeat and replace obamacare and has consistently failed. There are provisions that allow kids who are 26 years old to stay on parents insurance. You have to find a fix for those or they vanish and you leave people without it. Thank you very much. I put a mask on every patient who walks in the door and i wear a mask for the entire time im there, both to protect me and protect my patients. We have study after study that shows like you said that 80 to 90ch of the cases could be prevented if everyone was universally masked. Its with my kids are doing at their school. Walking around without a mask sends the wrong message. To be at the rose garden. Even whos been there has been tested. You could argue maybe it isnt necessary, but it sends a message. Its essential to all of us who hold positions of influence, government, or just in media to wear masks when were out in public, to send that right message because thats the only way that were right now that were going to combat and succeed against this virus. I think it will send a great signal to a lot of people, but shes outstanding and im glad she could be there. If you look at the ballots, you know, they found ballots in a garbage can and they had the name trump on them, cast for trump and they found them in a garbage can. They found many ballots as you know in a river bed in a state, in a certain state. They had another case where a thousand ballots were sent but not single, they were sent double, so you get to vote twice. This whole thing i have been telling you, this whole ballot scam is going to cause a lot of problems for our country. I want to see a very peaceful transition, but it has to be a legal process. When you get thousands of ballots sent to people and theyre double ballots where you get two votes, and thats just one of many problems. Go back and look at the iowa primary, democrat primary. They still dont know who won. I mean, you look at it, it was a disaster using this system. I dont think they know who won yet. Many ballots were missing. There was fraud. Look, we cant do this. That was a relatively small number of people. We cant do this to our country. So were going to see, were going to watch. Were watching very closely the u. S. Attorneys are watching, the attorney general is watching, the sheriffs are watching, local police is watching. And its a very sad thing. Also, bloomberg. Jeremy diamond, we heard the president say i want to see a peaceful transition, then he said its got to be x, y and z. He is obviously very, very concerned he says about the ballots. Yeah. And i heard similar comments from the president last night at his rally in newport news, virginia. The president there kind of walking back comments from earlier in the week where he refused to say he would support a peaceful transition. But at the same time, wolf, still telling supporters that the only legitimate outcome of the election is one in which the president is crowned the victor and that is not only false because there are a myriad of ways joe biden could win the election without any fraud, without any cheating, and theres of course no evidence of widespread voter fraud, but its also potentially dangerous because it sets up a scenario where at least a third of the country that, you know, follow the president s every word and perhaps as much as half the country might not believe the results of the election because of what the president is saying, if indeed joe biden defeats donald trump at the ballot box on november 3rd. Wolf, the president also discussing the Supreme Court nomination process, making very clear he wants to see this nomination, this confirmation happen before the november 3rd election. And he was asked the question whether he expected any fireworks, any controversy as judge amy Coney Barrett goes before the Senate Judiciary committee for her hearings. The president said he doesnt expect it, he doesnt see how thats possible given judge Coney Barretts record and stellar recommendations from some of her former bosses, from former justice antonin scalia, but nonetheless, the president as he did earlier in the day in the rose garden raised the fact that justice cavanaughs confirmation, the president also expected that to be smooth sailing and of course it was nothing but, it was anything but that because of the Sexual Assault allegation that came forward during that time. That was not something the white house had expected. So the president nodded to that fact, acknowledging there could be some surprise in the confirmation process, but nonetheless, the president and the white house expecting that judge Coney Barrett will be confirmed to be the next justice of the United States Supreme Court before the november 3rd election. Thats certainly their goal, thats what theyre pushing for here, wolf, with a much shortened time line in terms of the confirmation process that were going to see unfold in the next few weeks. But can we also do our job at journalists and talk about some of the lies he just told . The idea, the problem with the Iowa Caucuses was that there were corruption in mail in ballots, it was a caucus, there were no mail in ballots. Looks like theyre close contests in key battleground states in florida and pennsylvania, although some of the most recent polls in pennsylvania show that biden is ahead. And youre right, as far as ballots are concerned, there were a few, a handful of ballots thrown into a garbage can by mistake. There wasnt any crime there, right . There was no crime there, and he tosses off this thing about a thousand ballots here, a thousand ballots here, that is not true. That is not true. The great Ruth Bader Ginsburg is so meaningful to all of us for the great work shes done on behalf of women and so many others. I feel a special Neighborhood Pride in Ruth Bader Ginsburg. She went to Madison High School which i attended as well and we feel her loss. And to replace her with amy Coney Barrett who would undo almost everything Ruth Bader Ginsburg had done and to be more of a dying wish that the next president select the nominee is so wrong. Why is the amy Coney Barrett nomination so troubling . The American People should make no mistake about it. A vote for judge barrett is a vote to take away health care and its protections for over 130 million americans who now have protections against preexisting conditions. For over 40 million americans that pay less for drugs on medicare. Close to 10 million americans that will lose their health care all together. A vote for amy Coney Barrett is you a dagger aimed at the heart of the Health Care Protections americans so desperately need and want. By nominating judge barrett to the Supreme Court, President Trump has put Americans Health care at grave risk and
