Really happen in the wee hours there in brazil. The gas station owner now says that the athletes threw some rocks, ripped a sign and even urinated outside. The athletes are then seen trying to leave. At one point you see them trying to get into the wrong taxi cab after they here you go are approached by a man who appears to be in a uniform. And appears to be armed as we see one of the swimmers here raising his hands in surrender. The next Surveillance Video shows one of the swimmers wait for it youll see him fall to the ground. Here you go. And they appear to be forced to sit down there on the concrete. One of the swimmers stands up. The Surveillance Video we are given ends. Weve got a lock to walk through here, what maybe happened, legal implications. Mi miguel marquez, let me just begin with you. Walk us through. We did bits and pieces of the video. Tell me what we see and mostly what we dont see. This video was released by a brazilian newspaper, given to them by brazilian investigators. It shows what was going on at least a piece of what was going on that evening when mr. Lochte and his cohorts were got into this situation. You can see in the video as lochte walks out, he appears to be second, given that the distinctive hair color that mr. Lochte was wearing during the olympics. And he does appear inebriated at least to stumble as he walks out in that video. In the other videos, it is clear that they are confused, trying to get into the cab, and then it looks as though a Police Officer or somebody some sort of authority puts them on the ground. And thats why you have these massive changes in the story. Christine, youve seen the video, analyzing it as well. We dont see any guns. You do see them with their hands up apparently in surrender. Weve also heard that lochte has there have been different versions of his story. Tell me what you know. Yeah. Well with be if this video is accurate, it certainly looks like it is, with the reporting that were hearing now around town is accurate, ryan lochte made it all up. He said he had a gun to his head sunday morning. Obviously an incendiary comment to make at any time, but especially during the Olympic Games in this city, rio, all the time months and months weve talked about it all the runup to these games, the issue of crime and violence and zika and water pollution. Laundry list and that it would play right into every stereotype what lochte said. For four, five days this goes on, basically hijacking the Olympic Games. And then it is not true . Wow. What a bombshell. It reflects so poorly on ryan lochte and well see about the other three teammates as well. Exactly what the u. S. Olympic committee did not want to have happen. Usoc likes to lie low, let et athletes win medals. This is a pr nightmare for the u. S. Olympic committee and for ryan lochte. Are you from your perspective seeing anything criminal here in the video . It doesnt look like it from the video but as we know, the video only tells a portion of the story. Theres no audio so we cant hear anything thats being said. Again this is not the first time this has happened with u. S. Swimmers. As you recall several years ago during the olympics in south korea, we had a swimmer that had vandalized a local church or some type of religious stole some type of religious statue from a church or something. This isnt the first time this has happened. Lochte is back here in the u. S. We do have an extradition treaty with rio. I dont think this rises to the point where hes going to be extradited. This is filing a false Police Report. Its being investigated as we could investigate it here. So theres a lot of questions to be answered yet. Unfortunately weve still got those three swimmers down in brazil that are being held in custody until this all can be sorted out. You mention the false filing of a report. If this turns out to be entirely false, whole story was made up, what kind of trouble could these guys be in . If they communicated a false report, in brazil, my understanding is that is a crime that carries a penalty of up to three years. Similarly, back here in the United States, there is a federal crime, lying to Government Law enforcement agents, that carries a potential sentence of five years. When it comes to extradition, all extradition is governed by the applicable treaty. Brazil has a treaty with the u. S. There are two main components. First, it has to be an extraditable crime. It either needs to be within a list, then additionally it has to be something that is punishable in both countries with a year or more imprisonment. Now technically that may meet the definition of the treaty, but even the listed crimes in a treaty are so general that it really depends, number one, on what brazil chooses to charge them with. And number two, the politics of the state department in even evaluating that request because treaties are its not uncommon for people just not to follow them and decide, you know what . We dont feel like giving this person back. What makes this case particularly complicated is that we have more than one person in each of the countries. It would be very awkward for the United States to say, were not giving you lochte, brazil, and then in the same breath turn around and say, by the way, can we have those other guys back . Christine, heres my other question. The whole why we care factor of all of this. When you look at someone like ryan lochte, i think he is the secondmost highly decorated swimmer behind Michael Phelps. We hold them to a higher standard and when you hear these sorts of stories, people talk and people dont like it. Brooke, absolutely hold olympians to the highest standard possible. The toughest drug testing, by far, way tougher than Major League Baseball or the nfl or anything else. The quaint term role model thats gone out the window with so many sports is alive and well with the olympics and usa swimming. Usa swimming has banned Michael Phelps twice, once for the marijuana photo and then for six months after the dui incident. I believe with all my heart ryan lochte should be banned for u. S. But in terms of having an affiliation moving forward. When you place in context i know it sounds harsh. Place in context rio and what hes asserted and how he has taken the spotlight from hundreds of athletes over the last few days. The predicament hes put his teammates in as a team leader, leaving these three guys, to a twist in the wind from the u. S. Team, and then of course the u. S. Olympic committee, the ultimate embarrassment. I dont see any way they cannot ban him for life. Usa swimming takes these things very, very seriously, and im glad they do. Wow. Perhaps he was forced to give over some money in his wallet. Maybe there wasnt a gun to his head. What do you make of that . Yeah, i think that were in this grey area where we still dont know everything and i think we will know a lot more in the next few hours. This is a kind of story that just develops so quickly. Yeah, i think there is some grey area. But assuming he made it up i am assuming right now, just for the sake of this conversation, that it is all made up then i dont know how you let him back into this sport. I know people would say he is almost 32, it is almost done. But doing usa swimming, alumni events. By the way, ive now covered 17 olympics. Yeah, i started when i was in kindergarten. But tanya and nancy in 1994, im sure many of you remember that. Tonya harding was kicked out of u. S. Figure skating for life. That was a whack on the knee, it was a terrible thing but it also became humorous in its own terrible way. A bruised knee and she was kick out for life. The u. S. Olympic National Governing bodies take this stuff very seriously. I dont know any oldschool people out there might say, you know what . Good. Good that there is some consequence for ones actions, especially for hijacking these games, as i mentioned, and for doing this to rio, playing into the stereotype not only of the ugly american, if in fact it is all true, if he made it all up, and of course what he did to the people of rio making it look like something happened when it did not, if in fact it did not. What are they up to before they hop that plane and head home . Well, you bring up a great point. This is why for a while there hearing that they were getting at a cab at 4 00 in the morning that many of us nodding our heads saying, sure they were. Events go very late here. Saturday night was the last night. Swimming. He was there with his teammates. That was Michael Phelps last race and the womens medley, a big allamerican celebration. Then they decide to go out. Theyre already leaving the venue at around 1 00 in the morning. By the time theyre back out it is 2 00 or 3 00. That part of it is understood. Ryan lochte is an interesting fellow. Google him and youll see a lot of what hes been up to. Social media star. He is a happygolucky fellow. Obviously wanted to go out on the town and celebrate with his friends. He talks about that in interviews which he says he is just playing himself. He has a pretty good sense of himself. This is also somebody whos been in trouble in the past. He went to university of florida three times since 2005 hes been picked up, arrested. Once for fighting, once for urinating in public. Once for trespassing. For folks who are just joining us, what are you listening for from police and what kind of trouble if this whole thing was false, what kind of trouble could they be in . Truth lies somewhere in the middle. You are never going to get the exact story from either side. Any criminal defense attorney there is a video but it doesnt show anything. We would hope with the advent of video everything would be more objective. As you see, minute by minute it just raises more questions. Seems to me at least part of the story is, hey, ryan lochte and guys, you were lying, says brazil, because you said you were robbed when in fact it may have been the case that instead, somebody came up to you at gunpoint and demanded money. To me, thats still a robbery. So somewhere in the middle is the truth. If they were forced at gun point to hand over money, even over some civil dispute, there is some element of crime there. While they may not have been picked out at random and robbed on the street, maybe the brazilian side of the story isnt 100 fru eithtrue either. Hopefully as video emerges we can get closer and closer to what happened. Christine, in the lead up to the olympics there was all kinds of coverage about rio, zika, crime, pollution and when you followed the games, it was pretty tame. There was a green pool for a minute. And there was some empty stands. Then you have this. Youre there in rio, youre feeling how this story is resonating there. How big of a deal is this in rio . I think it is a very big deal and i think thats one of the reasons the police have been so public in the last 24 hours, to say wait a minute, here, there is whole other side to this as lochtes story unraveled, at least what we believe has unraveled. Its interesting because i have not seen one mosquito. Ive been here for close to three weeks. Ive not seen one mosquito. Thats kind of funny, although the zika virus is not funny at all. But i am being asked by other journalists to give my First Impressions the first week, kind of halfway through, and saying that things were pretty good. I sent those quotes actually to someone who was writing a piece for pointer. Org. If green water and this incident with the bus then if thats it, nen rios doing pretty well. And once the lochte news hit and he said again, it is important to said, he said, he told nbc that he had a gun to his forehead and they were robbed and all the things that, as we all know now he said. Once that happened i emailed the reporter who asked me, i said about those about my impressions. I said let me make a change here. I sent him another paragraph or two. Thats the best story i can tell you to illustrate how i, as someone whos covered a lot of these things, reacted to the lochte news. To me, it changed everything and put the games, as i said earlier, on edge. Everything was just edgier. The visual with an american with a gun to his head, a u. S. Athlete with a gun to his head, was really troubling. So to answer your question, i think it was a big shift from what we have seen to that moment, until that sunday morning and sunday afternoon when we first heard the news. I think it was a big deal. I think it is a big deal because we are all covering it so closely because of that turning point and the International Relations aspect of it. Rio and brazil were on the defensive and want to stand up for themselves and if the story was falsified, they want us to know. We are watching and waiting for civilian police, Tourist Police chief to sit at that table and speak to the members of the media. Meantime, another quick break. S. , bring him back with be we want to charge him . Does the u. S. Say what . Oh, what a difference if you are charged with a crime, where your feet stand geographically. Ryan lochte being back in the United States puts him in a drastically different position than his fellow swimmers who are back in brazil. And for the swimmers, as well as other u. S. Citizens, the state department will cannot and will not do much if you are arrested abroad. There is a misconception among some americans that somehow our government will send the blackhawk helicopters when we are are arrested in cancun or somewhere else. Not true. The only thing the state department may help you do is find a lawyer. They may help you get in touch with your parents. But they are not going to bust you out of jail, pay your bail or represent you in court. So those swimmers that are in brazil have a very different situation. Only way to get lochte back to brazil is through extradition. Through brazil and the United States, extradition treaty. There are rules and requirements and ultimately its something that the state department has to approve of and grant that extradition. Doesnt that add a layer of complication, the fact that there are three in one country and one in another . It adds a diplomatic political layer because, if brazil demands lochte back and the United States says, no, well, meanwhile, brazil has some swimmers that the United States might want back. So each of them is sort of at a draw at this point. If it gets to that. Whereas, really the better diplomacy would just be to come to some agreement and that would probably be some kind of restitution, a big apology, all over those many millions of followers that some of the swimmers have on social media. I dont know. But that might be the wise resolution instead of this could potentially escalate to an International Conflict over what started out as a particularly illadvised night out. On the left side of your screen, that is a piece of video from the gas station where they were for 4 30 in the morning. My question to you, sir, is what sort of criminal activity what sort of activity, i should say, could be deemed criminal in the eyes of rio police . Well, first of all, weve got some report of vandalism. Again, there is a ton of questions up in the air that hopefully well get answers during this press conference. But the vandalism is the key part. Did they pay the store owner off . We dont know. What was actually vandalized . Were they confronted by a Security Guard . We dont even know that. But i do agree with the panel that somewhere in between here there is the truth. If thats the case, then i think both parties have to come to some agreement here. Its just very odd also from a purely investigative standpoint that lochtes back here in the u. S. I mean did he call his attorney right away . I know his attorney has said that this was a scheduled trip for him to come back. But its just, as an investigator, it just throws some doubt on the whole story when all of a sudden the next day after this event lochte gets on a plane and comes back to the u. S. First of all were going to provide you all with a brief explanation, with a chronological analysis, explaining the evolution since the police was aware of what happened to now. They were very contradictory. There were a lot of contradictions since the beginning. The Team Coordinated by our chief of police, and then we start receiving some information that were clarifying how actually the incident took place. The first information that we were able to gather was from a taxi driver who he drove two ladi ladies, two girls, from they were leaving that party. And those two girls, they were they were in a way, they were dating. They had some interaction in a way with the swimmers, the athletes. They mentioned that to the taxi driver. The taxi driver, when he saw what occurred when he saw everything on the media based on what he heard from those two girls in the taxi, he brought that information to our Tourist Police department. So then we realized that probably, by now, some of the athletes already had a story to lie. This was not disseminated, but now we can tell that was true. We established several measures to end investigation. We gather Surveillance Video from the gas station. Also from other places when they arrive at the athletes village. Then we are trying to get that could tell what happened. And during that time our citizen command center which was created to interact with the civil society, some people went there and said that they knew exactly what happened and it was not really a robber, but it was actually a great confusion. So this citizen command center, they got in touch with our head of police, sitting next to me, and these people, they came and told exactly what happened. They were afraid to talk to the police because they were afraid of some kind of retaliation because were very well known and renowned for rn aeign athle. We talk again to the people and told them it was key for us to get these statement. So based on that statement, we then were able to understand exactly what really happened that day. We also heard other witnesses. We are also listening, as i speak, other witnesses. So this investigation is, again, under way, as i mentioned to all of you here, that its in progress. And during this investigation, even the taxi driver, he presented himself to the Police Department. We contacted our Tourist Police department. We heard then the taxi driver, and he confirmed. He in a statement confirmed what the police already thought was going on. Our tactical and Scientific Department is providing some kind of analysis of the gas station which was probably vandalized by one or by all of the swimmers. Niece are some of the measures that we implemented, that we can share. We all here, maybe my colleague can tell a little bit more. We are going to try to reduce the number of questions that you all might have. Thats why we are providing this analysis. No, hold on. Its not ready for questions yet. Right now as we speak, what the police can affirm, there was no robberies the way it was reported or claimed by the athletes. They were not victims of the criminal actions that they claim they were. The police cant affirm that. Since we still have some measures for instance, we still have to listen to witnesses, two of the athletes that are still in rio. We have not concluded our investigation. Therefore, we are not going to answer questions that relate to what is how they are going to be what kind of crime they will have to answer. These questions we cannot answer right now. Why . Because the measures to provide these kind of questions are still going on. We need to understand what each athlete actually did so in order to define what was the crime that anyone committed, if they committed. This is the real story. I say thats probably the real story, because we are still going to listen to other witnesses. So when they left that party, they stopped at the gas station. They went to the bathrooms, as the surveillance has shown, and they literally one or all of them started to vandalize the bathroom inside of the gas stati station, damaging some mirrors an things that they had inside that bathroom. With this altercation, some employees from the gas station tried to control that situation, as the Surveillance Video also show, the images also show the athletes going back to the taxi and trying to get away from the gas station. When the gas stations employees realize what was going on there, the Security Guards asked the taxi driver to not leave that place and wait for the police to arrive. We have also asked the Police Report saying that they were asked to go to this place. It has already been confirmed by our military police here in rio. So the athletes they refused to stay there. They didnt want to wait for the police to arrive. During that time a third person offered to be a kind of interpreter because the Security Guards of the gas station didnt speak english and the athletes didnt speak portuguese. So this third person, it is going to also be heard we are going to have a hearing at this possible interpreter explain then this interpreter explain to the athletes what they had done. So those vandalists attitude or behavior created a daniel to the gas station. They had to pay for that. So they offer to pay. Of a they paid with a 20 bill and 100, 100 plus 20. So 100 in the brazilian currency, and 20. So they left that money just to almost like to pay for the damage that they cause and leave the place before the police could arrive. The Surveillance Video of the gas station confirmed that version that is also being confirmed by one of the athletes. He is a witness, so he gave his statement as a witness. The images also show the moment when the athlete are sitting on the ground. One of them started to stand. And we can see, based again on the Surveillance Videos and with the statement of the witness, we can notice and realize there was no violence. With regards to the identity of the Security Guards, one of the requests that they made because of afraid of any kind of retaliation. They ask their identity, the preserve. We promise that to them. So we will tell the judge in charge that he did collaborate with the investigation. So its not really the police that can say that he needs to stay or go back to United States. What we cannot accept that responsibility for the Public Security or safety is not only for the police. For everyone. Also for the victim. If the victim doesnt bring that information to the police, might potentially be contributing to the lack of safe and security. They said we need you to say, we want the Brazilian Police to show up. The other issue is ryan lochte was saying he was held at gunpoint. Theyre essentially saying, the authorities, these olympians were not robbed but, somebody may have come up to them with a firearm and demanded money. Possible extortion . They said, perhaps. Well, thats robbery here in the United States. Gun plus demand for money is robbery, even if you think you have some civil right to that money. If somebody wrecked your bathroom, i get it. We have civil ways of getting that money back. Typically here in the United States, what are the options that would not be sanctioned by your local police is, yeah, he owed me 220 so i went over to his house with a gun and demanded that he sit down on the ground, pull out his wallet and peel off wads of money. It seems very strange right now because the video as it is seems to back up the story that for some reason, these guys who were acting boarish and aggressive, suddenly became very cowed and very demure and sat down on a sidewalk, and that there may have been a fire oorm arm involved. I do think that thif the story true, if they trashed a bathroom, if they behaved horribly, again, covering all these olympics, i remember in seoul, in 1988, there were two u. S. Not sure if that is related to what happened here that night. This is a busy gas station here in the heart of rio. So here is where the rest of the cctv plays out. Listening to the discussion here, the explanation that authorities have given so far is some explanation, but after gathering the attention of the gas station officials, they come through here, they go to the wrong tex wrong taxi initially, and then move over here to where their taxi was parked. They get in and you see a man in black approach the driver. Lean in the car, have a conversation, that may be where the firearm was pointed at the swimmers. Obviously they had just seen these men damage part of the bathroom here at 6 00 in the morning. According to the police chief, they were aggressive and drunk. And want police think a financial transaction was had to end the event. So we dont have a new version of events from mr. Lochte or the other swimmers. It was at a Police Station but as of yesterday, his attorney was very clear to say that had they have not changed their series of events. Another thing that is interesting and worth paying attention to, im going to just move out of the way of a family car here. You have to ask yourself when did the u. S. Olympic committee become aware there may have been a contrasting version of events to his clear story to nbc that he was held with a firearm to his temple, on the ground, that took his possessions and not taken his cell phone. If they learned about it earlier on, there was rumors here in rio on monday until yesterday when the court order came out, or if they learned later, is it possible they feel the athletes they represent were not being open enough with them. If lochte, except for a second whatever this guy is saying in the press conference. They urinated on a door, they ripped down a poster. Someone sticks a gun in your face, you dont know that that relates to you urinating on a door. You dont know that that is connected. And that is a robbery. Row dont get to negotiate over a deal of some side and say i have a gun in your face, pay me or i will press charges.
