Robert mueller and his investigators believe that the president is part of this larger conspiracy. That the president , his family members, as well as the trump organization, his company. All of this really brings home the point that if you didnt think so before friday, it is plainly clear now that prosecutors believe the president is a target of this investigation. And so we shall see where that goes. But back to the number 16. Thats the magic number now that we have reached. This is the number of people as a result of our reporting, reporting of other news organizations, we can now say have had some level of contacts with russians. If you remember, during the campaign, even after the president took office, we heard from the white house, we heard from people, that they didnt have any contacts with russians. And these are the number of people that we have now established did have those contacts. Everybody from donald trump jr. , who is involved in that trump tower meeting, where they were trying to get dirt on Hillary Clinton, all the way down to Jared Kushners assistant, who attended one of those meetings with the russian ambassador, when Jared Kushner was not available. So, from having no contacts to 16 People Associated with the president , who had those contacts, brooke. Evan perez, got it. You laid out the reporting for me perfectly. And while the white house is certainly downplaying these new Court Filings and what it means for this president , a top House Democrat is talking about the possibility of jail time for trump. My takeaway is theres a very real prospect that on the day donald trump leaves office, the Justice Department may indict him. That he may be the first president in quite some time to face the real prospect of jail time. With me now, cnn chief political analyst, Gloria Borger andset barnswise, so welcome to both of you. And i want to hone in on the legal first. So, seth, starting with you, on there are differing opinions on this. Can you just can a sitting president be indicted . Well, probably not, because the Justice Department has an informal, internal policy stating that they will not indict a sitting president. Now, there are academic arguments one way or the other, as to whether or not that as applied is correct. But thats the reality of the environment. And i think that the painful irony of that is that these strategies that apparently the president deployed in 2016 to get to the white house, the success of those are really creating this shield that he can enjoy, as a result of the fact that these strategies worked for him to be able to get into the white house. When you take a look at the filings that happened late last week and all of these developments, you really see a pathway of lies and felonies that are stretched all the way to the front door of the white house. And when you look at the two basic categories of what those lies are, they either have to do with sex or money. Sex in terms of the felonies for violating the Campaign Finance laws, for all the essential consultant transactions and everything that happened down that pathway, or the lies with regard to trump tower moscow and the purposefully deceptive testimony that was coordinated with the white house and then was delivered on capitol hill by Michael Cohen. So its the very lies that created that pathway to the white house that now may be creating some sort of immunity from the president for being indicted at this present time. Well, you heard you know, we played the sound with schiff, saying that he could face the prospect of jail time. Hes referencing the hush money payments, the illegal hush money payments. But seth, one more to you and then i want to come to you. What constitutes an Impeachable Offense . Lets go there. Can you define that for me . Sure. So in the constitution, an impeachable defense is constituting what are referred to as high crimes and misdemeanors. So lets take a look at the two laws that we just talked about a moment ago. Down the channel of the payments for the allegedly illicit sexual activity, thats a violation of Campaign Finance laws. Thats a felony. For the purposeful decepton to investigators in the congress and all the people that are surrounding that, thats a conspiracy and a violation of the false statements act. These are felonies that constitutes what is an Impeachable Offense under the constitution. And then it really drives into a political question of whether anyone on capitol hill is going to do anything about it. Yes, which leads me perfectly to Gloria Borger. Lets talk jerry nadler, right . Hes expected to be the chair of the hueshouse Judiciary Committee and heres what he said on precisely that. Well, they would be Impeachable Offenses. Whether they are important enough to justify impeachment is a different question. But certainly, they would be Impeachable Offenses, because even though they were committed before the president became president , they were committed in the service of fraudulently obtaining the office. That would be the that would be an Impeachable Offense. You dont necessarily launch an impeachment against the president because he committed an Impeachable Offense. There are several things you have to look at. How important were they . Do they rise to the gravity where you should undertake an impeachment . An impeachment is an attempt to, infect, overturn or change the result of the last election. You should do it only for very serious situations. So thats always the question. So it kind of sounds like were at this place where, okay, which Impeachable Offense is important enough . Well and i know this comes down to votes, right . Well, its a political issue. Because youre nullifying an election. And remember, with bill clinton, he lied to the grand jury, but it didnt so he was impeached in the house, not in the senate. The political reality is you would have to get about 20 you know republicans to go along with it and in the senate, i dont know that that would happen. But i think this story has yet to play out. We dont you know, its still its still unraveling. And i think what jerry nadler is saying is right. Okay, the president committed a may have committed thesefulnethese felonies, lied about it to the public, and the question is, did he lie about it to mueller . We dont you know, we dont know the answer to that. We dont know the particular answers to his questions, to the special counsel. So, this still has to unspool itself. So, what i think nadler is saying is, look, right now, if we took this to the American Public and said, yeah, he lied about payments to these women and coordinated it with Michael Cohen or directed Michael Cohen, they could yawn and say, okay, well, we knew this about donald trump already, lets just move on. But theres a lot more happening here. Were just in the foothills. Right. Im sorry to tell you this, but, right, we are. And so we have to we have to hear more about what the president told the special counsel about it. Right, because then once we move past the foothills, then, perhaps, if theyre thinking impeachment on the senate side, to get the 67 votes, it would need to be something perhaps more egregious. And were there more of his contacts with russians . In all of the Michael Cohen paperwork, we saw that there were conversations with trump about meeting with putin, et cetera, et cetera, et cetera. So you know, we have to kind of watch this unfold. And see if the president is among those many people who were lying about this. The other kind of complicating factor to all of this is the statute of limitations, seth. So i pivot back to you. The statute of limitations, Campaign Finance violation, five years. So its simple math, right . If this happened in 2016 and if trump wins in 2020, serves another four years, equals statute of limitations has run out. So if he is reelected, seth, would that be his essentially his get out of jail free card . Well, it could be. But i will tell you what the counter legal argument is. They will obviously Rudy Giuliani and company will argue that that is just going to be literally a get out of jail free card and that thats going to beat the statue of limitations issues. However, there is a legal doctrine called tolling. Which states if somebody creates a wrongful situation that is inequitable that causes a delay in their facing justice, such as a ceo committing fraud and concealing crimes against people who are then victims, the statute of limitations could be tolled for the period of time for which they are artificially protected. So the question is this. Can the prosecutors allege successfully that the statute of limitations is tolled for a sitting president , because he has created a felonious pathway to the white house in a manner that artificially protects him under the statute of limitations. I think thats a legitimate legal issue. Its never been argued, but i think it will be teed up at some point, potentially. Again, were in the foothills, but this is just perhaps foreshadowing. One thing, gloria, that was overlooked on the whole friday news dump was on manafort and the fact that he had been in touch with the white house as late as spring of this year. I know you dont have the answer to this, but im just going to ask you, anyway. I want it. Who do you think who do you think he could have been talking to . You know, its were as you know, brooke, were reporting this right now. Were trying to figure out with whom manafort communicated. And we just dont know the answer to that yet, so im not even going to hazard a guess. But what i can tell you is, what was he communicating . Here are the questions we need the answers to, also. Was he communicating with the white house in an effort to get their stories straight and let them know he was cooperating so that perchance he might get a pardon at some point . I mean, the substance of those conversations is almost as important as the name of the person he was speaking, because we need to we need to know, first of all, he lied about it. But why did he lie about it . Well, it must have been really important enough he had to know he might get caught, right . They had Text Messages and everything else. So was he doing this to protect himself and to coordinate . And to then get out of jail free . Get a get out of jail free card . And we dont know the answer to that, either. On previous episodes of the administration. Is it trump . Is it, you know, just what theyd be walking into . Is it both . Why are folks not as interested . I think its, c, all of the above here. I think previously, its not really worked out well for chief of staffs in this administration. We saw what happened to reince priebus. We saw what happened now to john kelly. These are two people more so with john kelly, who came in with great representations, were considered very respectable and now being the subject of all of these palace intrigue stories. People attacking john kellys character. I think hes leaving with a really diminished respectability. And i think that people dont want to come in to this very High Pressure job and be under attack. Its one of the most highprofile jobs in this white house. And they know that they will be the subject of all sorts of palace intrigue stories. And also, of trumps irritation. People who are around him tend to be viewed less favorably than advisers on the outside. He always wants what he cant have. He wants hat he cant have. What about so nick ayers, you and i were talking not too long ago about you had spoken with him yourself. And you can tell me about that conversation, but 36yearold, you know, maybe not that household name, but someone who has a pretty impressive resume, apparently wanted the job. And then has now turned it down. What do you know about that . Well, my dish started to hear that it was overstated how badly trump actually wanted him in the job. I do know that he was offered the job in late june of this year. That is something that the president and nick ayers both deny to me during my Oval Office Interview with trump in midoctober, but i believe that to be the case, nevertheless, regardless of what they said. He also said that there was no chaos in the white house, that john kelly would stay on through 2020. I think its a very High Pressure job, he has a young family, but i also just think that trump i had begun to hear that he was a bit frustrated that nick ayers was kind of putting himself out there as a likely frontrunner, the likely choice, when that was not necessarily the case. Weve seen this happen before, where trump gets very frustrated when things are reported as hes made a decision. And then will seek to undo whatever the decision was or make a different choice, so that he doesnt confirm the reporting, it seems like, at times. One of the pieces we have at cnn, a source tells cnn there was resistance to nick ayers, specifically, being appointed because of Melania Trump and members of senior staff. And we have talked before about, theres some folks within the white house who are not big fans of nick ayers, but one of them being Melania Trump, which is just interesting factoring in, she had spoken up about a different position within the last two months, and you know, you cover Melania Trump as well, and im just curious what you think of her impact or her influence. Well, i think that she is certainly someone who the president speaks to. I think she has more influence than maybe weve previously thought that she did. Ill defer to cnns reporting on that. I dont have anything to confirm that myself at this moment. But it doesnt surprise me. He doesnt have very many people around him anymore who he trusts. Hes lost a lot of close advisers over the last year, year and a half. And it doesnt surprise me that she is having a lot of influence on his decisionmaking. And the timeline, youre hearing, for replacement is . I spoke to a white house official just before we came onair here, and im hearing that they believe that it will be anywhere from this week to a month from now, but they also say that with trump, you just never know. If when they evacuated when sheriffs deputies and firefighters said, please, get out of this valley, get out of butte county, its burning, what would have happened . How high would the death toll be if hundreds of those people said, no, we should stay and debate whether there is actually a fire . And the scientists feel the same frustration. Theyre trying to give the same warning, that this is the beginning. This is just a taste of whats ahead, unless human beings figure out different ways to live and power their lives. So, yes, i heard the warning is not just people connecting the dots scientifically to what the future is, but First Responders who are going to have to deal with it. A month ago, it was paradise. Yeah, come on he honestly believed that he was recording the last moments of his life. And in his mind, he thought that perhaps the video would survive. Reporter but somehow, all First Responders survived. I found an elderly woman standing on the side of the road. And i only found her because i got tangled in some power lines that i had to cut. Reporter and somehow, they helped the city of 27,000 evacuate or shelter in place. Surrounded by blowing flames, on gridlocked roads, and thanks to melting pipes, no water. As i opened my doors, the embers wiare blowing inside my truck, and im thinking, my trucks going to catch on fire. Shut the door, run to the screaming i hear. It was an elderly couple, cuddling each other. Reporter there are thousands of stories like this. Making paradise a symbol of community sacrifice and survival. The biggest cleanup in state history is underway. And when the lines are up and safe, neighbors will be back helping neighbors sift through whats left. But those who study fire and water, wind and climate say paradise should be a warning. In fact, on black friday, while this fire was still burning, the Trump Administration put out the most frightening climate forecast in american history. Over 300 scientists from nasa, knnasa, noaa, the pentagon, smithsonian all agreeing that unless things change, this is just the beginning. But when asked about the report its fine. They both agree that california is also paying for the sin of building into the wilderness with no regard for natural cycles. But i suppose the lesson is, if you dont have a lot of little fires throughout the seasons, youre going to have some really big ones. Thats right. Thats right. And the little fires, if you can imagine checkerboarding a landscape with a lot of little fires, it can really do a lot to minimize those bigger fires later. Reporter there are around 130 million dead trees in california. Controlled burning or cutting them would cost billions. But the risk of leaving them to burn wild is anyones guess. One of the problems we have as part of human nature is that one, we rely upon our past experiences to predict how things are going to go forward. So ive talked to a lot of citizens who have said, yeah, we were aware of fires, but they were always able to stop them on the ridge before they got there. And so, i think it engenders this false sense of security. A lot of Natural Hazards have been viewed that way, sort of through the lens of history. And now, its much more like, uh, we cant really rely on history as a guide anymore. Yeah, and i believe that, you know, from when i started, the fires that we see on a regular basis are much more theyre larger, theyre more destructive. And the future generation moving forward, they have a very dangerous job ahead of them. Reporter and theres so many affects of this disaster, brooke, that are so hard to see. Theres the trauma to the kids that lost their schools, presideptsd for those who lived through this sort of thing. Theres the chemicals, all the plastics, all of the appliances that burned and melted into the ground that people are now worried are going to leach down into the creek systems, some which are salmon streams up here. This is the beginning of what could be a 20, 30 billion fire. Just one fire of hundreds, brooke. And again, you can see on a day like this with the sun shining, why people live here, it is paradise. Her name is maria butina. She has been in jail since she was arrested and charged with illegally acting as a foreign agent. She allegedly tried to gain access to republicans during the 2016 campaign in order to advance russian interests. So, with this, sara murray is with me, our cnn Political Correspondent who first reported this news. Sara, is there a deal . Well, it does appear that there is some kind of deal. Right now, we have very sort of small details. Weve got a notice from the court that there is a change in plea hearing requested by her attorneys, as well as the prosecutors, the judge has now set that hearing for wednesday. So well get more details then. But what it tells you that maria butina is ready to change her plea. She had originally said she was not guilty on a count of conspiracy and acting on a foreign agent. Now the fact that shes going to change her plea means that shes going to plead guilty to at least one of these charges. We dont know which one yet. And it also means she may begin cooperating with the government. On what, were still waiting to see. But remember, this is the woman that the government said was essentially acting as a russian spy. She made inroads with the National Rifle association. She snapped a bunch of pics with 2016 president ial hopefuls, even asked candidate donald trump a question at a political event. So it will be very interesting to see how this plays out in court on wednesday, brooke. If she does talk, what kind of information could she offer up . One of the Big Questions is whats going to happen to her boyfriend, paul erickson. Hes a south dakota political operative. We know that investigators have been looking at him in south dakota for a fraud investigation. Investigators are also looking at him and his ties to polina butina and whether he was sort of helping her in what they believe was this plot. So thats one question. The other question is whether she has information to offer at all on the russians, because the government said that she stayed in touch with her russian handlers while she was here in the u. S. , attending american university. So, again, well see on wednesday if we can get anymore details on why she might be useful to the government, if they believe shes useful to them. Good deal. Also in washington, the Supreme Court today handing a big win to planned parenthood by choosing not to hear a case that could have taken away critical funds from the Womens Health organization. So heres how the votes came down. Chief Justice John Roberts and the courts newest justice, Brett Kavanaugh, agreeing with the liberals on the bench, voting against taking the case. The three conservative justices who sided with the republicanled states that brought the case were Clarence Thomas, samuel alito, and neil gorsuch. Jo joankuspitch is with me now. I think this is the legal equivalent of, were not touching this with a 10footpole. The chief really doesnt want any revealing of conflicts or tension right now. And he just in november had said, you know, we are not trump judges, were not obama judges. We are above politics and were above the ideological fray. And this is exactly the kind of case that could have revealed a 54 court. So it was in his interest to avoid the topic. But whats interesting, brooke, is showing kind of a partner in Brett Kavanaugh, our newest justice appointed by President Trump, who really has sent so many signals against abortion rights. And even though abortion wasnt involved here, you know, there would have been, under normal circumstances, a signal that you would have thought Brett Kavanaugh might have gone with the more conservative justices. But he clearly has aligned with the chief here. And what Clarence Thomas wrote, joined by justices alito and gorsuch was, look, youre avoiding this only because its about plpt plpanned parenthood,e abdicating your judicial duty because its a politically fraught, ideologically fraught case. Hmm. What do you think this will mean for abortion rights moving forward . Well, thats a great question. Because as much as medicaid funding matters for poor women who are using these kinds of services that planned parenthood provides, the larger question is, what will happen down the road to roe v. Wade . And we know the four liberals dont want to take that up. And i think today is a signal from chief Justice John Roberts and from Brett Kavanaugh that theres a good flashing sign that says, not now. And the judge basically wants to see these parties back in court. This is after Paul Manafort breached his cooperation deal. The government says he was lying. Fast forward a few years and he might want to brace for a bit more of both. The former fbi director held court at the 92nd street y here in new york last night, weighing in on all things trump, including the prospect of impeachment. I hope donald trump is not removed from office by impeachment. Because, it would let the country off the hook. And it would drive into the fabric of our nation a third of the people believing there was a coup. And we need a moment of inflection, where we all get off the couch and say, that is not who we are. And in a landslide, rid ourselves of this attack on our values. Comey went on to compare the president to the mob bosses he once prosecuted. He also weighed in on trumps tweet storms about the Mueller Investigation and how it might be interpreted as witness tampering. I dont know how the special counsel thinks about it, but if i were a prosecutor and a public figure started attacking the credibility of one of my witnesses in a pending investigation, thats something that i would look at very closely. Cnn National Political reporter maeve reston is with us. And maeve, obviously, i dont need to remind everyone, but comey is a witness in an active investigation and here he is, you know, walking a fine line, getting quite political. Certainly getting quite political, brooke. But i think that what you saw throughout that interview with Nicole Wallace was the sense that he is just really at the point where he feels that trumps attacks on the department of justice and our institutions are really harming democracy at this point. And so he is making the case that the lice coming from the white house and trumps qualities. He talked about, you know, trumps insecurity and the way that that kind of governs his actions. And theyre calling for a moment of inflexion where the American People decide this is an issue of competency and vote him out of office. We still dont know how many people would agree with that assessment of donald trump. But its very interesting to hear that perspective from someone who worked as closely as he did with donald trump, and observed him in the oval office in that setting. And it was interesting, in going on in the sound bite you played, he talked about how he felt optimistic for the country, and its institutions. Because of the number of people that did get off the couch in the november election. And we are seeing kind of a gradual shift here that could potentially make big waves in the president ial election. But its not clear yet, you know, how many people will agree with that perspective. Yeah. I know. Its extraordinary to hear, to your point, of all people, comey saying, no, dont impeach him, lets let americans decide. Yeah. Meantime, you know, we reported so much on his book and how he talked about President Trump as, in his words, untethered to the truth. This is what he had to say about the president lying last night. I can tell you that all of us should use every breath we have to make sure that the lying stops on january 20th, 2021. So we have been making this point that Everyone Needs to show up. I think he said, you know, that way, you know, a third of the country oh if he were to be impeached, a third of the country would feel it was this coup, right, instead of having everyones voices be heard. Yeah. The hard core Trump Supporters clearly would see it as a coup. Thats the fine line that the democrats have to walk here. Yes. But he is also kind of expressing what you hear quietly at this point from republican sources. Which is a feeling of could there be a nominee that could, you know, really challenge trump on a competency level. Someone that some republicans would feel comfortable getting behind. And in that way, move this country in a different direction. You know, the Howard Schultzs of the world or the bloombergs of the world. They could potentially offer Something Different than what trump is offering now. And, again, you know, the next year will show us whether or not voters really are ready for that yet. Yeah. The current guidelines put in place from 20 years ago limit the number of women who may qualify for the testing and what that means for you is if you have hereditary Breast Cancer genes but dont get tested for them, you may not get properly treated. So with me is contributing medical editor at health magazine. Dr. Rog, hello . 20 years . Were talking about Breast Cancer, the most common cancer for women, taking away skin cancer. And one in eight american women will develop Breast Cancer in their lifetime. So very common cancer. And about 10 of Breast Cancer cases do have a genetic predisposition. What were finding from the study is half the people that could really benefit from that testing under the current guidelines would not be offered the testing, and it would not be covered by most insurance plans. So this is a major problem. And why is genetic testing important . It aeffect the type of surgery they may get and the type of chemotherapy. What does this mean for women . Well, what the authors of the study are saying, and many scientists and doctors agree, is we really need to change guidelines so every woman who has a Breast Cancer diagnosis gets the right genetic testing so they know, do they fall under those category 10 of cases that will benefit from a specific type of surgery, a specific treatment that can prolong their survival. Its also in effect whether their family members are tested as well. Isnt this also insurance . Like Insurance Companies, they rely on these guidelines before determining to pay. Thats exactly right. And thats why the guidelines are so important, that theyre up to date. These guidelines were created at a time where these tests were extremely expensive. About 5,000 a pop. And that was one of the reasons why they really limited the number of people that were getting tested. Now, thanks to technology and also legality and patents that are no longer standing, the cost of the tests have really reduced significantly. Good. So its absolutely time to open doors in terms of genetic testing and once the guidelines change, the Insurance Companies will have to follow suit. When will they change . When will this be updated . This new study comes out and is asking for it to be done immediately.
