Youll hear from his attorney. Also, we have a lot of breaking news this morning. The president talking about that canceled summit with north korea. Could it be back on . Just moments ago the president said to reporters his team is talking to north korean leaders right now and that he still is holding open the door that this meeting that he just canceled 24 hours ago could be back on. Listen to the president. Were going to see what happens. Were talking to them now. It was a very nice statement they put out. Well see what happens. Well see what happens. It could be the 12th. They much would like to do it. We want to do it. Well see what happens. Thats very significant. The president right now is on his way and you see him there in annapolis, maryland, going to give the commencement address at the Naval Academy. Well bring that to you live. Lets go to joe johns at the white house. You were among that team of reporters asking the president these questions. A lot of headlines, the big one, the summit could go back and be back on for june 12th. Thats right. And after only 24 hours, a tense 24 hours, certainly, in the region where there was great consternation about the president canceling this summit, now a suggestion from him that it could be back on, on the date that was originally scheduled, june 12th, and certainly will be received both here in washington and in the Korean Peninsula as a change in tone coming from the president of the United States. And he, essentially, portrays this as something that happened because of a statement that was put out by north korea, you heard him speaking about it there, in which north korea made it clear they were very much interested in having this summit go forward. So, the president using that as room to say that the United States, he, the president , would like to do it too. Of course, there are a lot of obstacles to that. Certainly logistical questions and joe johns, let me take our viewers back to right outside the federal courthouse in manhattan. A brief press statement in writing as well, which hopefully you will share and i may take just a couple of questions. Mr. Weinstein intends to enter a plea of not guilty. We intend to seek im going to make a brief statement. Im going to distribute a brief written statement, and i may take a few questions. Mr. Weinstein will enter a plea of not guilty. We intend to move very quickly to dismiss these charges. We believe that they are constitutionally flawed. We believe that they are not factually supported by the evidence and we believe that at the end of the process mr. Weinstein will be exonerated. Someone inside asked me how mr. Weinstein feels this morning. And my response was as well as can be expected when you are accused of a crime that you vehemently deny having committed. So we are going through the process. Today is the first step. We knew that mr. Weinstein was under investigation for more than seven months. He voluntarily surrendered this morning, and we have met all of the bail conditions by agreement so that we would not have extended court proceedings. We have a right to revisit any issue in this case later, in the event that an indictment is returned, and i anticipate that this case will ultimately be resolved favorably as to mr. Weinstein. Im going to take just one or two questions. What are the bond im going to make that decision next week. What are the bond conditions . Mr. Weinstein has always maintained that any Sexual Activity he engaged in was consensual. He has vehemently denied any of the allegations, which suggest that he engaged in nonconsensual Sexual Activity. Many of these allegations are long overdue, quite frankly, having been made about events that are alleged to have occurred many years ago. They were not reported to the police at the time these events occurred and i anticipate the women who made these allegations, when subjected to cross examination, in the event we even get that far, that the charges will not be believed by 12 people, assuming we get 12 fair people who are not consumed by the movement that seems to have overtaken this case. What are the details of the bail conditions . And is he wearing an ankle bracelet . I think the details of the bail conditions were discussed in open court. I really dont want to revisit them now. He has met them. We deposited the Million Dollars of cash bail that was required by the court, and we have agreed to turn over mr. Weinsteins passport and thats where we are. Is that what you plan on if you get to that point . What . A vigorous i anticipate a vigorous defense. Thats been my professional job for almost 40 years and i think most of you know that. I think the federal investigation, if it occurs, we will deal with it when and if that happens. I am hoping to continue my discussions with the Southern District and my efforts to dissuade them from proceeding that investigation too has gone on for many months. Thank you very much. Dozens of women say there is a pattern of behavior, a pattern of misconduct by mr. Weinstein against these women. Let me say this, without defending behavior, my job is not to defend behavior. My job is to defend something that is criminal behavior. Bad behavior, mr. Weinstein did not invent the casting couch in hollywood and to the extent that there is bad behavior in that industry, that is not what this is about. Bad behavior is not on trial in this case. It is only if you intentionally committed a criminal act and mr. Weinstein vigorously denies that. They say he did commit a i understand that. Thats why were here. Thats why were here. People dont get convicted based on accusations. People get convicted only when there is credible evidence beyond a reasonable doubt and in this case, i do not believe that the District Attorney has that, nor i do believe that mr. Weinstein has intentionally violated the law. Thank you very much. The headline out of those statements from Harvey Weinsteins attorney Benjamin Brafman is that his client Harvey Weinstein will plead not guilty on all of the charges against him. Let me bring in former u. S. Attorney Michael Moore with me. There is so much to digest here. I will say lets remind people of the charges against Harvey Weinstein, because his attorney there talked about bad behavior, not being criminal behavior. This is a man, a hollywood mogul, charged with three counts, rape first degree, rape in the third degree, and criminal sexual act in the first degree. He, his line of defense seems to be, for weinstein, that these events took place, he says, a long time ago, and were not reported to police at the time. You know, im not sure i think thats the best tact to take. Were hearing the statement now. I think you can talk to bill cosbys lawyers about whether or not things that could have happened in the past and challenges on just time. He said basically were not going to have a trial or there cannot be a conviction about bad behavior. You know, but hes setting up the theater if you will for there to be a discussion now or real argument about consent. Thats what rape is all about. Was there consent from these ladies, at the time . And if it comes down to simply a question of credibility, it will come down to whether or not they consented, he talked about the casting couch and this type of thing, im not sure that that argument is going to save the day. You have a pattern of behavior over and over again, you see things over and over again, jurors i think start to believe, okay, there is more to this than just bad behavior. A few interesting points, he also seemed to question michael whether this would get to trial. He was asked about cross examination. He said, if it even gets there, indicating they think maybe there will be some settlement. Im not sure. These are criminal charges here from the manhattan District Attorney. He also said, he questioned the ability to get a fair jury in this, right . The fundamentals of having justice play out and he said, if we can get a fair jury that has not been in his words consumed by the movement, talking about the me too movement, what did you make of that . I always think it is interesting when lawyers come out and milwaukake a statement courthouse steps and whether or not they can get a fair impartial jury and tainting the jury pool by making Public Comments about an on going criminal matter, those arguments are better left in court and made in court. Hes going to defend this case vigorously. No question hell move forward with many defense motions, challenge the charges, hell move to dismiss, hell have a vigorous cross examination of the ladies. Ive got no doubt about that. Im sure mr. Weinstein has a very good lawyer. But at the end of the day, these cases come down to whether or not jurors believe the ladies and the victims over the accused, and i just dont know that going in and saying basically, yes, the events happened, but, you know, it is just the hollywood casting couch and he didnt invent that, im not sure thats the tact i would take going in. To give people some background on this lawyer, this is the 69yearold former manhattan prosecutor, known as one of the best trial lawyers around, no surprise that hes going to vigorously defend this, if it if it goes through trial, et cetera. A 10 million bond set and a not guilty plea that is going to be entered. Yeah. First i want to mention that casting couch comment certainly struck me as well when asked that direct question, what do you have to say to all the victims who have come forward with accusations. I want to mention, we know there is reporting that Harvey Weinstein left out of a back door of this manhattan courthouse. Didnt see him next to his attorney here. So we know that he is under gps monitoring. We know that he posted that 1 million cash bail and we know that his bail requirements are that he has to stay either in new york or connecticut. We know he has a home in connecticut. We also learned a little bit more out of that News Conference that i want to point out, if you havent already, and thats that mr. Brafman has been in conversations with federal authorities for several months now. And that was something that we just learned this week or earlier this week. Im getting my timetables off, that there was a federal probe into this. Now, he also there say grand jury going on still, today, that going forward, going on for weeks, to give more charges to this case. And we know that that grand jury has heard from at least four witnesses, they heard other evidence in this case, and by next wednesday, may 30th, mr. Brafman says he will have to make his decision on whether or not Harvey Weinstein will testify in front of the grand jury. Thats important there. So a lot happened out of that News Conference. I think the most striking was his response to all of these womens accusations that, of course, he says defense attorney, but he says he doesnt defend bad behavior. Very interesting to me. Past negotiations ive covered, northern ireland, Israeli Palestinian talks, the Iranian Nuclear deal, drama behind the scenes is normal. But the fact that were getting to see it play out by tweet, like this, lends to this feeling that were watching a teenage breakup and makeup session. Is it in any way beneficial to the process, to the ultimate goal of peace . Right . Denuclearization of the peninsula, to have this play out like this in public . Well, we are in a different era in that now north korea can threaten the United States with a nuclear weapon, that never applied before. So that raises the stakes and, yes, they did need to break the normal negotiating pattern and step things up. The problem is now we had north korea say that denuclearization is not automatically on the table. And yet it seems that the summit has become a goal in and of itself. So the danger is, in this back and forth drama, we lose sight of the u. S. original goal and sacrifice that just for the sake of having a meeting. You have an interesting read on something the president said this week, which is that ultimately if a deal is reached, the u. S. Would protect the safety of kim jongun. You think that that actually really irked him. I think that that really stuck in their crawl, because north korea, what kim jongun feels like right now is that hes negotiating from a position of strength as in Nuclear Armed power. By the president offering him protection, thats the same sort of thing as south korea having to rely on the United States for its nuclear umbrella. Makes him look weak. North korea called south korea a lackey. They dont want to join that club. If the talks, i mean, eventually become back on for june 12th, do you expect a different strategy from the white house from kim jongun heading into them, seeing what can happen with these abrupt cancellations . Well, what i think Trumps National Security Team is wishing is that the new element will be that he will listen to them and conduct more of this behind the scenes, giving them room to maneuver because, you know, a peace negotiation thrives like mushrooms, best in the dark initially. So that they can make some of these high stakes bargains, and then have the two leaders meet. So the consegcessions dont d to be in public, potentially embarrassing one or the other, forcing them to pull out. Kimberly dozier, thank you very, very much. President trump is repeating those unproven claims that a spy was embedded in his campaign. The white house is being heavily criticized from both sides of the aisle for sending the lawyer for the president emmet flood into yesterdays confidential doj fbi briefing on that confidential source. Now the president s personal attorney Rudy Giuliani is laying out a quid pro quo for the president to sit down for an interview with mueller. Dana bash spoke with giuliani, she joins me now. He is being, dana, remarkably transparent in saying you give us this and maybe well give you the interview. Reporter you and kimberly were talking about how out in the open the drama is on north korea. Thats the case for what is going on in the russia probe. Not the mueller side, we have no idea what is going on inside that investigation. But certainly in terms of the president and his Legal Team Strategy here. And youre right, Rudy Giuliani said to me, point blank, im not going to send my client, the president , in for an interview where he will be trapped and by trapped in this context, giuliani was saying that that would be if they dont know anything about or enough about the confidential source that the fbi sent to have conversations with trump officials, trump allies, people in trumps orbit, during the campaign. So that is that is point one. But point two is the fact that they are so sort of nonchalant about the notion of the president s legal team or his lawyer, the white house counsels office, and his chief of staff attending this meeting yesterday with the socalled gang of eight, which traditionally is done with the briefers and members of congress and the white house is not involved. And thats for basic briefings, poppy. Never mind a briefing this is not this is not exactly. This is about an president , right . This is not basic. It brings up the big picture issue, dana, which you so aptly point out, which is how complex it gets when you have the president ial campaign being looked at under investigation and the president , you know, helms the justice department. Exactly. Look, there are so many, you know, overlapping issues here, which would be complicated in any situation. I mean, the last time we really saw this, to this extent or close to it was during the clinton era. Sure. When you have a president and his campaign being investigated by a special counsels office, and this president is completely okay with shattering every single norm and every single bit of fromtraditional protocol tha goes with it, it turns everything upside down. And i have not talked ive talked to some pretty senior officials who have historically been involved in these socalled gang of eight meetings. When i say gang of eight, i mean the four bipartisan leaders in congress and the four heads of the intelligence committees. And nobody has said that it is normal for a white house to be involved. Never mind in this kind of situation where they are the subject. Im glad Rudy Giuliani talks and talks to you so you can bring us the thinking of his team and the president on this. Im told that this class led Navy Athletics to the highest win percentage in your 172year history. Think of that. That includes taking the army Navy Star Series for the fourth straight year, a remarkable achievement in sport and athletics, remarkable. And because you care about every contest against army, for the record, this year, Navy Beat Army 19 times. And i will not mention, i promised who won the football game, i will not mention. I wont mention it. Refuse to say it. But that is a great achievement. And let me take a guess, youre still not tired of winning. Winning is such a great feeling. Isnt it a great feeling . Winning. A great feeling. Nothing like winning. Got to win. In every endeavor, the class of 2018 has shown its mettle, and its proved its might. You have earned your place in that ancient league of sailors and ship mates, captains and commanders, warriors and mariners and marines. You crave adventure. Hello, folks, back there. You chase, discover and you never flinch in the eye of a raging storm. America is in your heart the ocean is in your soul, the saltwater runs through your veins. You live your life according to the final law of the navy. The word impossible does not exist because navy never quits. You dont give up. You dont give in. You dont back down. And you never surrender. Wherever you go, wherever you serve, wherever your mission takes you, you only have one word in mind. And thats victory. Thats why youre here. Victory. Very important word. You are now leaders in the most powerful and righteous force on the face of the planet, the United States military. And we are respected again, i can tell you that, we are respected again. A lot of things have happened, were respected again. For the last four years, you have walked the same paths as navys greatest legends, the giants of midway and coral sea and manila bay, here in annapolis, the glorious past is all around you, and so are the stories of your great heroes. One such hero who appears in the pages of your old yearbooks is bruce vorhees. He hailed from nevada and was a member of the Naval Academy class of 1929. Beneath his picture in the 1929 lucky bag, bruces classmates wrote that he spent most of his time teaching the City Slickers from the east the correct pronunciation of nevada. And i had to learn that too to win the state. Great place. He saw studying as an unnecessary evil and they remember remembered in three cruises and four years in blue surge, brass buttons, he left a trail of broken hearts extended the full length of both coasts and radiating for miles around granttown. In other words, he was just like you in many ways. Just like you, not a lot of difference. Just over a decade after his graduation, Lieutenant Commander ben vorhees found himself at war. 75 years ago this summer he was in the south pacific, commanding Bomber Squadron 102, during the battle of the solomon island. That was a rough battle. Only brother had been killed in the baton death march. On july 6th, bruce volunteered for a mission to destroy a crucial enemy base. It was a rough time, it was a rough, tough situation. He knew full well that he would likely never return, he knew he was going to die, but he also knew his daring action could prevent a surprise attack on large scale american forces. So his plane took off alone, on a 700 mile flight. Bruce flew through the darkness to his target, a tiny speck on the vast open sea, he braved unrelenting antiaircraft fire, like nobody had ever seen at that time. And a trail of enemy planes to singlehandedly destroy this large enemy base including multiple fortifications and a Critical Communications link. And at this final act of valor, bruce was caught in the blast of one of his own bombs and perished in a remote lagoon, very far from here. His life was lost, but his legacy will live forever. Many of you have seen the star marking bruces old room at bancroft hall, commemorating his congressional medal of honor. Our highest honor. Some here today will trace his path to pensacola, to earn your wings. You may even make it all the way out to the legendary combat Training School known as top gun in bruces beloved hometown in fallon, nevada. There you will have the honor to take flight from the vorhees field and remember a hero who fought for his country and died for his homeland and saved so many lives with his bravery. Each of you inherits the legacy of the heroes who came before you. It is a living history, passed down from officer to officer and generation to generation. Each of you will make your own mark on the navy, the marine corps, the military, and the history of our great nation. Seize today and you will shape tomorrow. In a few moments you will be commissioned into the mightiest fighting forces of the air, the land and the sea. Together you will blast off carriers of which were just now finishing, the largest Aircraft Carrier in the world. Launch off submarines of which we have many under construction. And ward off evil. Among our graduates today will be 283 naval aviators, 134 submariners, 256 Surface Warfare officer officers, 70 restricted line officers, and 15 explosive Ordinance Disposal officers. 236 United States marines and 35 very tough, very well conditioned navy s. E. A. L. S. Together you are the tip of the spear, the edge of the blade, and the front of the shield defending and protecting our great country. You know, there is no mission our pilots cant handle. There is no hill our marines cant take. And there is no stronghold the s. E. A. L. S cant breach. There is no sea the navy cant brave. And there is no storm the american sailor cant conquer. Because you know that together there is nothing americans cant do. Absolutely nothing. In recent years, and even decades, too many people have forgotten that truth. They have forgotten that our ancestors trounced an empire, tamed a continent, and triumphed over the worst evils in history. In every generation there have been cynics and critics who tried to tear down america. It is not working too well lately. But in recent years, the problem grew worse. A growing number used their platforms to denigrate americas incredible heritage, challenge americas sovereignty, and weaken americas pride. But we know the truth, we will speak the truth, and we will defend that truth. America is the greatest fighting force for peace, justice and freedom in the history of the world. And in case you havent noticed, we have become a lot stronger lately. A lot. We are not going to apologize for america. We are going to stand up for america. No more apologies.
