Justice department, democrats, mexico, news, the news business. Hes busy. What do you make of it . Well, you know at some point you stop getting surprised by donald trump. You stop getting surprised by how many things to point out. I read this open before about him going on a weekend twitter tie rate how many times . And the scattershot approach. The bizarre aspects of criticizing elements of his own administration. Acting like a spectator as if hes not the most powerful person in the government. Doing things that are borderline kind of extralegal, like singling out a particular company. But you know, the larger question you asked in the open is the real one which is, is there an issue with american credibility when the president of the United States does this . Lets remember that every president , republican or democrat, the one thing they have been very careful about is their words. There has been a sense that the United States, the president speaks with the credibility of the most powerful country in the history of the world. And now you have a president for whom words are weightless. They are like this kind of ghost. So he just pushes them out there, they mean nothing, he can change what he thinks about them. And if you ask does it have an effect on american credibility, lets remember what the criticism of barack obama was on that famous red line in syria. The criticism was that barack obama said the president of syria, if he did certain things, would probably need to go. And then he didnt quite follow through on that, even though he did in a complicated way, making a deal with the russians. That was supposed to be the thing that eviscerated american credibility. Trump every day says he says hes going to rain fire and fury on north korea like the world has never seen. Then he says, i love kim jongun, im going to get together with him, solve this problem. He says the chinese are raping america, then he says xi jinping is my best friend. He says the saudis are the most heinous regime in the world, only to make it his first stop and embrace the king and say, i love this man. Your head spins with the degree to which theres kind of the whole thing is like a circus. And i just again want to remind us, barack obama was supposed to have cheapened american credibility because of that one sentence, wasnt completely fulfilled to its entirety. I mean, what were watching now is a circus. Its not a president tial administration. Heres the dilemma. If this was a child or a poorly acting relative or friend or acquaintance or neighbor, wed just ignore them. The problem is, hes the president of the United States. And so especially as maybe most of the country is ignoring it or supporters are saying, all right, well, you know. I dont want to see that, thats a part of him i dont like. But you cant ignore it as a news organization. Because what the president says should account for something. And he says a lot. Well, it has to account for something. Because a lot of Public Policy echos the words of a president , it suggests what your legislative agenda is going to be. For example, tariffs. A good example. Ever since the smoot holly tariffs when the congress in the 1920s and 30s legislated terrible protectionist tariffs that screwed up the economy, congress basically said to the administration, you do tariffs, were going to take the back seat. So the president has enormous power to begin a trade war, to initiate it, to escalate it. And so what President Trump says on trade and tariffs could get us into a trade war because he is the authority on it. Look at the stock market. The stock market, how the chinese are reacting, how other countries are reacting. So yeah, its very important to understand theres a reason why american president s, republicans and democrats, have chosen their words very carefully. So theres been a lot of departures in the white house. Secretary mattis is the only one theyre saying hes the only adult in the room left. How does this bode for a chaotic administration by any objective standard, chaotic and not normal . The most impressive thing about mattis for me is you remember that moment when trump summoned his cabinet, and he essentially got them each to engage in this kind of bizarre act of almost dear leaderlike praise where each one was explaining how trump was the greatest thing in the world, it was an honor to serve him, they were fulfilling i think priebus said it was like fulfilling his religious duty to god by serving donald trump. Mattis is the only guy who said, i am proud to be serving the american people, and thank you for that opportunity. So he even then understood that his role was really a larger one to serve the country. The tap we have him there is frankly so comforting in a moment when we are in a complicated situation with north korea, with iran, with syria. You know, who knows what would happen if you had somebody like mike flynn, a guy who salutes and jumps when trump tells him to, when trump got into a bad mood with kim jongun, which will happen. For now, i hate to scare you, but for now, you say the fact that we have him there. You never know, let hope he remains the adult in the room and stays there to handle the situation. How do you interpret these mixed messages to syria . You know, the thing about trump ive often thought is he cant really hide his basic intentions and inclin nations. What you saw to me was a little heartening. Trump has always been something of an isolationist. He criticized the iraq war, why the hell are we in the middle east . And for many people who worried that trump seemed to be because he wants to be a tough guy, he was bombing more, he was sending bigger bombs, escalated the mission in afghanistan. To me thats the real trump. Trump really does not want to be engaged in the middle east. And thank god. Because i think a more activist, macho trump who wants to teach those guys a lesson would be much more scary than a slightly inconsistent guy who at the end of the day his gut seems to be lets get the hell out of there. Ill take that. You mentioned flynn. What would it be like to have someone like that helping him make decisions. Can we talk about john bolton . Hes the new National Security adviser, known as a hawk. Hes advocated for years, advocated war with north korea, with iran, cyber war with russia. Im just wondering what kind of influence you expect him to have on the president with these hot spots. Its very worrying. The National Security adviser is the essentially the man the president sees first in the morning, last in the evening. He is the gatekeeper through whom all influence comes. Hes the guy who shapes the options the president has. And as you say, john bolton is beyond left and right, really. John bolton is probably within the Foreign Policy establishment of the United States over the last 30 years, the most extreme hawk who exists. He has been in favor of an unprovoked war against north korea. I mean, thats a very important point to make. This is not an argument that theyre building up and it seems that theyre beginning to threaten to use icbms on the United States so they should act, no. He argues the United States should go to war unprovoked against a country 10,000 miles away, which would devastate americas credibility, stability there, what it would do to our relations with china, not to mention the fact that north korea now has Nuclear Weapons and could escalate. To have somebody like that in a situation with the president himself has a very, very thin grasp of International Affairs is very worrying. And again, as i say, this is what makes me think that general mattis is the most important person in the American Government right now, and if hes thinking of resigning, i think we should all take out petitions asking him to stay. Theyve been talking about getting this case referred back to private arbitration. They dont want this case litigated in a court where the pleadings are open to the public. They want this confidential, they want to silence Stormy Daniels. The ironic thing about this, theyre asking the court to send this back to private arbitration. Stormy daniels for all practical purposes has already told her story. Everything short of what may be the extension message or the photograph her lawyer keeps teasing may exist, weve heard her entire story. I have to keep asking myself, i and i think the American Public some ask, why does donald trump care so much . Why does his lawyer join in this motion to refer to matter to private arbitration . If he continues to insist that nothing happened, that this is a fabricated story, seems to me he would want to be transparent and have this discussed publicly. Because it didnt happen, according to him. So hes making great efforts to keep something private that he alleges didnt happen. And thats mysterious. Well, that is a veg question. Im sure Michael Avenatti i want to ask you whats your reason . I think hes trying to make precedent here. I think this cat is already out of the bag, trains left the station, whatever. But i think he understands that if this happens here, everyone else with a confidentiality provision and agreement he may have made could go on 60 minutes and do the same thing without anything happening to them. Stormy daniels attorney, this is for joe, Michael Avenatti tweeted in response, we will vigorously oppose the justfiled motion to have this case decided in a private arbitration in a private Conference Room hidden from the American Public. This is a democracy and this matter should be decided in an open court of law owned by the people. In the declaration mr. Cohen just filed, more interesting for what it does not state. It does not state he never discussed agreement with djt, that djt did not know about the agreement, that djt did not ultimately pay 130,000. All issues djt is silent on. Does he have a point, and will that convince a judge . No, i well, look, theres some points to be made there. But lets take this into federal court where it is right now. You have to understand the reason trumps lawyers want this in federal court is because a federal judge is much more likely to enforce the arbitration provision pursuant to the federal arbitration act. Thats important. The federal arbitration act basically in almost all instances will require arbitration if there is an arbitration clause in agreement. A claim for recision, which is whats happening here, a claim for recision as to an agreement with an arbitration clause does not avoid arbitration. So cohen saying i mean, Stormy Daniels lawyer saying that there should be no agreement because they violated it, well, that doesnt get you out of arbitration if theres an arbitration clause according to the federal arbitration act. The distinction i will make is that recision simply means the unmaking of a contract between two parties. In this instance, what avenattis going to argue, and maybe successfully, is that there never was a binding agreement, this contract was a fraud in the first place, what hell cite is Michael Cohen. Michael cohen went on the record, unbelievably, and said publicly that trump never knew about the agreement. Right there, what that does is render this agreement null and void. And frankly calls it fraudulent. Because he binded a client without the client knowing it, which is unethical, illegal, and certainly renders this the agreement maybe nonbinding whatsoever. So might not even fall under recision claims. You should go on twitter, theyre offering you advice. Theyre saying toothpaste is out of the tube. You didnt say that one as well. Never heard that one. Toothpaste out of the tube. Avenatti wants to nullify the agreement stormy signed with cohen and depose the president in arbitration. What are the options for the judge . The judge can decide if the case remains under his jurisdiction and keep the case and let the case move forward and let discovery proceed, including the deposition of trump and cohen, which is what Stormy Daniels attorney wants. Or send this to private arbitration. If that happens, we wont know much about this case after that. Because everything will be private. As Stormy Daniels attorney says, it will be a private Conference Room with a private arbitrator making decision about discovery, if there is discovery. Thats what the president and his team ultimately want. But i think Stormy Daniels attorney has done an outstanding job with what he was information he was given. Hes unearthed information about cohen using the Trump Organization email, letters or emails addressed to cohen with his title working for the Trump Organization. All of this evidence which suggests there is there was knowledge, there was participation, or at least there was some coordination between trump and his team and Michael Cohen, which undercuts this argument that trump didnt know anything about it. So hes walking this really fine line between trump didnt know, but yet theres this evidence that suggests his team had some particular may have had some information. So i think those arguments are going to be powerful when he makes them to this federal judge. So i have to tell you, i have to say something, joe. I think the cohen folks will tell you its a twoparty agreement, not a threeparty agreement. Well listen, heres the bottom line. Still, trump is one of the individuals who is supposedly bound by the way, by that same confidentiality clause theyre claiming daniels violated. So hes a party. If he had no knowledge of this, the agreement is fraudulent. Again, what shes saying is a good point as far as catching them in a gotcha moment, maybe, regarding whether he knew or didnt know. But its better, much better that trump, for trumps side at this point that trump knew about the agreement that the greemen was an actual agreement. Now the claim for recision is not valid in a federal court under the federal arbitration act and they do go to arbitration. Theyre all over the place on whether he knew or didnt know, theyve got to make up their mind. All right, we can talk about this all night. Thats where well focus on this. Is personal. And could have a legal component. But the corruption issue is the one that could be a political problem with his base. Thats where the base could become concerned. Because if they start to think trump is in it for himself or his cabinet members are selfdealing, remember, they were running for the little people, for the heartland of america. Drain the swamp. I think that again, i think not just him but i think hes got some political advisers around or nearby that are going to say, this is a problem. This is the kind of thing. I think the Stormy Daniels stuff, they say, big deal, nobodys surprised, this is not going to create any real consequences with our base. The mueller thing is a legal issue. But they have pretty artfully managed that in a way to convince their base that its a witch hunt. So whatever happens with that legally, i think the base is going to say, we expected this to come, he said its coming, theyre after us, the Justice Department is corrupt, theyre all democrats. So they can deal with that. Theyre not, but thats what hes saying. Thats what hes saying. The corruption issue, if im a political advisor to donald trump, id say, this is where the base gets affected, pay attention, deal with it right away. Approval rating around 40 . Hes been teflon so far. With the base but thats what im saying, thats why this is a danger, danger, mr. President. Because this is the one that could pierce the bubble, the corruption issue. Ann coulter, she has been laying it on lately. She recently told the new york times, it is the former trumpers that the president needs to be concerned about, that after failing to do anything on immigration, passing a massive spending bill, they could be his ultimate undoing. Yeah, and i think he got that message immediately. Thats a signal he was like, whoa. Because obviously she and others like her have been some of the strongest supporters. She called him a shallow, lazy ignoramus. You know what ship . She said, we knew he was a shallow, lazy ignoramus, but we thought they would at least i think thats right. But i think for that spending bill to blow the deficit out like that, and to not get any border wall funding, for those hardcore trumpers, that was a huge violation of what theyd all agreed to and thought was coming down the pike. You think thats why ann coulter, she hit the nail on the head, she struck a chord with him, do you think thats why he started tweeting all this stuff . I do. I think he pays attention to people like ann coulter, sean hannity, they ganged up on him. Lets talk about that. Immigration hardliners that were in maralago. Is it concerning to you that trump seems to be getting his policy points from friends and cable news hosts . Well, you can see how the cast and the chorus around him has evolved the last year. He has managed to remove the people who were sort of sending a compass nat conservative message, particularly on issues like this. He said he was going to create a bill of love. That wasnt so long ago. But i think the people that were pushing that sort of viewpoint are largely gone. And the hardliners are around him now. I want to talk about the circus. At the end of last season it was the wackiest, craziest first 100 days in the history of the american republic. It turns out a year later that its even wackier. This [ bleep ] is crazy is there a point at which republicans say, enough is enough . Every single day of this presidency is momentous and historic. This is not a reality show, but it is reality. But history has shown for some people, the best people mean the whitest people. So we have to have diversity and inclusion measures in place because were not getting it right on our own. And the emphasis that the Republican Party over the years has put on diversity and expanding the tent and the autopsy report after 2012 was emphasizing the importance of having to reach out to these nontraditional republican constituencies. And that is just completely gone, torn up, and reversed, if anything, in the trump era. And so i think its a shame. But im not surprised. Its reflective of what we have today with donald trump. Christopher, you disagree, why is that . Actually, im glad that were having this conversation. Im glad that cnns providing a forum for us to say, lets have more blacks join the Republican Party. Because apparently thats what youre saying is we need more blacks who are republicans. I see you blinking, youre shocked oh, no. Thats essentially what youre saying. You want more diversity, great. Instead of having what, 90 of blacks over 70 of blacks being registered democrats, over 90 voting for democrats, maybe we should have somewhere around half, right . 50 50. I couldnt say for certain but i knew of more than a handful of black conservatives who were republicans and were interns at that point in time. Different environment, though. It was different. The bush administration, which was a lot more welcoming for minorities. And had actually a real Outreach Program and there was a sense of that someone cared. Donald trump is so offputting to so many people. And george bush never said remotely close to the offensive things at all. He had too much class for that, first of all. They werent bigots. So there wasnt that big of a that level of difficulty. It was other reasons for the history of the Republican Party and why it was more of an effort to bring minorities in. It wasnt that it was unwelcoming the way trump is. Simone, what hes saying is there should be more africanamericans in the Republican Party. I think people would say, yeah, you know, if they were a welcoming party. Doesnt that sort of prove the point that this administration in christophers argument, if theyre not welcoming to africanamericans, then they dont want to join the administration, why would they do it . I want to be really clear that there are i would like to be clear and note there are africanamerican conservatives out there in america who would actually be willing to go in there and work in this white house. Jerron is someone who works in the white house who is working our ban policy issues, who has the ear of folks in the administration. So to assert that there are no black people that are conservatives in america that would go work in this administration or this administration is not true. Who made that assertion . To note this white house is in fact not welcoming of people of color, does not provide an environment if you will that would make folks feel this is a place that wants them there, is absolutely true. So, just a quick point is that if were going to have an honest conversation about this, we need to ask, how many people actually applied . So, i mean, if you had only two blacks apply, for example, and one of them got there, thats better than 50 . So, just to sit there and say, well, theres only one black person, to say that means there must be some sort of racism or its unwelcoming, thats kind of ridiculous. Yeah, it is. Dont you want to know why only one or two black people applied then or why its so many, how low that number is if that is that whole thing is a red herring. We not only hockey must be racist because theres not a whole lot of black folks playing hockey. Theres nobody out there black playing hockey. It must be because of racism. Thats a ridiculous argument. There are more africanamericans playing basketball, it must be racist. Come on. For internships, you just dont go with the people who apply. You go out and recruit at colleges, and if the Republican Party wants to have more diverse interns and africanamericans, then maybe you should hold on. Hold on. Let me finish my point. Maybe you should have a better message, which is appearing to people of color, and then you will have more people of color who want to be apart of your particular organization. But heres the problem with that. Better messengers. It takes, first of all, somebody with very thick skin to go out there and black and say, im a republican, im a conservative. Theyre going to come on your i lived it for 25 years. Theyre going to come on your network and be called everything but a child of god. What are you talking about . First things first are you going to sit there and act like thats not true . Well, if you act like it and someone calls you out on it, then we cant do anything about that. Maybe the messenger needs to be better. Its okay to call somebody that name, as long as you are acting like it . Im not you cant blame people for being called certain names if they you are getting off message. Its okay to call names . Thats what shes saying. Shes saying its okay to call someone a name im not saying okay and youre deflecting because your argument is weak. Did you just call her a tom . No, i meant to say tara. I really think that the White House Easter Egg Roll is usually a lovely event and this year, i think the message that was put out there for the young people that were there was not necessarily a message about easter bunnies and baskets. I think it was a huge mistake for Hillary Clinton to make that comment, even though, as tempting as it was, it was that was a huge mistake. It was awful, but were talking about the pin. Right, but im just saying that, and as a result of her doing that, its given its allowed this to live on, people wearing it as a badge of valor to stick it to Hillary Clinton.
