Ed, we can absolutely hear the water rushing behind you. Be careful. Overnight senator Majority Leader Mitch Mcconnell made it clear he will be bound by nothing including his own precedent when deciding whether to confirm a Supreme Court nominee during an election year. This is what he said overnight. If a Supreme Court justice was to die next year what would you do . I would fill it. This will be news to merrick garland. In a far cry from 2016 when president obama nominated garland during an election year. All we are doing, chris, is following a longstanding tradition of not filling vacancies on the Supreme Court in the middle of a president ial election year. A spokesman for mcconnell said the difference now is that in 2016 the white house was controlled by a democrat, the senate by republicans. This time the white house and senate are controlled by the gop. Plenty of democrats are slamming mcconnell as a hypocrite including much of the 2020 democratic field. He said hell fill it, but thats the job of the president of the United States, not Mitch Mcconnell. We have to do a little history about the division of responsibilities between the congress and the executive branch. I have argued in front of the u. S. Supreme court. I want to believe it is a nonpolitical organization and that politics are checked at the door. But when you see things like that and hear things like that from senator mcconnell thats no longer the case. We could and should do better. It was a sham when mcconnell claimed there was an historical precedent. He said there is a long tradition. There was no tradition of it. The issue is that Mitch Mcconnell will do what he can. The strong do as they will. The weak suffer as they must. Hes going to get it done. Obviously. Proudly. Hes boldly saying that. How can people not see it as hypocrisy when they are changing their own equation midstream. There is every reason to expect that if for some reason a democrat takes the white house and republicans maintain control of the senate if a democrat nominates a justice there is no way to think mcconnell will confirm in year one. Justin amash hosting his first town hall since becoming the sole republican in congress to say the president committed impeachable offenses. Last night he got a standing ovation. Thank you. He said many of his fellow republicans believe hes right but wont say it publicly. He told the audience congress cannot be passive observers. He also heard from critics. Robert mueller clearly identifies and analyzes a number of instances, several instances of obstruction of justice. He really left it to congress to come to a determination on these issues. I think its really important that we do our job as a congress, that we not allow misconduct to go undeterred, that we not just say someone can [ cheers and applause ] violate the public trust and that there are no consequences to it. I have been your supporter since you started running for congress. I cant even tell you how disappointed i am. How can you become a democrat when we voted for you as a republican . You drink the same koolaid as the democrats. I want to hear the answer. That was a tease. Cnns hailey byrd was at amashs town hall. Shes live for us in grand rapids, michigan. What did you make of the reception he got last night . It was interesting. I think a lot of people expected the town hall to be a lot like the outrage and furor over the debates in 2018. People expected people to harass amash over his stance. Instead he was greeted with a standing ovation and the crowd was largely friendly to him. Like the woman, she was heckled throughout her conversation with him. People told her to move on. People laughed at her when she invoked Hillary Clinton and the deep state. The people who spoke to me at the town hall, many were democrats who were there to support amash. The dynamic was so prevalent. The few people who did oppose amash said im nervous now. I expected a lot of Trump Supporters to be here and theyre not. It went better than amash and the team expected. Thats interesting. If the place was packed with democrats obviously thats a selfselecting group and that would explain the standing ovation. It is important to figure out how many Trump Supporters. We saw the woman in the maga hat. Congressman amash has said President Trump committed impeachable offenses but has not signed on to impeachment resolutions yet. Whats next for him . Last night amash urged House Speaker nancy pelosi to move forward with an impeachment inquiry. He said it would be appropriate to do that and he hasnt signed on to any impeachment resolutions. He said if i want to sign on to one of those, i would want to make sure i agree with their reasoning. Amash has been slowly laying out the specifics of the stance and his reasoning on this over the past few days, the past week while hes been doing tweet threads. If he moves forward with anything it would be on his own. The crowd, when he talked about impeachment, those were his biggest applause lines. He stayed the same on policy positions and, hes still the same conservative libertarian hes always been. Hes getting support from people on the left and even moderate democrats here in grand rapids for this position. Hailey, thank you very much for being our eyes and ears on the ground in that town hall. We really appreciate that. Thats interesting, john. I need harry antin to tell us t the breakdown of the audience. If he was preaching to democrats thats different. Whats clear is he wasnt ridden out of town exactly. Good point. Overnight, new twists in the battle between President Trump and former Vice President joe biden. Joe biden is pack on the campaign trail. Jessica dean is live in washington with the latest. The president continues to hit at biden and biden welcomes it to an extent. Continuing to hit back, john. Good morning to you. Its great to be with you. We are hearing from joe bidens campaign after a weekend while the president was overseas of hearing him, seeing him tweet about joe biden. Heres what joe bidens campaign is saying. This coming from his Deputy Campaign manager yesterday. She said to be on foreign soil on memorial day and to side repeatedly with a murderous dictator against a fellow american and former Vice President speaks for itself. Then we heard from President Trump again. He went on tweeting as well saying he was actually sticking up for joe biden saying kim jongun called him a, quote, low iq idiot and other things whereas i related the quote of chairman kim as a low iq individual. Who could be upset with that . This continues to go back and forth. As you mentioned yesterday as President Trump continues to hit at Vice President joe biden it almost elevates joe biden to cement frontrunner status to have the president continuing to go after him. This happening while the former Vice President are was in texas unveiling his first major policy proposal. He did a town hall yesterday with his wife, a teacher for many years, dr. Jill biden. Also with the American Federation of teachers. This plan triples federal funding for low income schools it fixed the Public Service loan forgiveness program, helping teachers pay off student debt among other things. The former Vice President continues on in texas to dallas. Well hear more about the plan today. Thank you very much for all of the reporting. Welcome whats next israeli Prime MinisterBenjamin Netanyahu is struggling to form a new government. If he is not able to it could trigger new elections. Orin lieberman has more from us from jerusalem. Reporter there are less than 11 hours before Benjamin Netanyahu has to announce hes formed a government or the country may head to new elections less than a few months after the last election which has never happened before in israels history. In fact, discussions have begun in Israels Parliament about the final readings of a bill to set new elections already tentatively scheduled for september 17. The deadlock is with Coalition Partners and a proposed conscription law the orthodox parties want it changed. Thats where netanyahu is stuck. President trump weighing in saying hoping things will work out and b. B. And i can continue to make the alliance between america and israel stronger than ever. That may have worked during the general election. It seems to have little effect on either side here with only a few hours before the deadline. There are politically, theoretically other options of how it could play out. Most of those are with somebody else being given the opportunity to form a government. Thats why netanyahu is eyeing the possibility of new elections in september. Were watching that closely. Thank you very much. New this morning, nepal is looking to limit access to Mount Everest as a response to the deadly climbing season. 11 people died so far. Arwa damon is live in kathmandu. What have you learned . Reporter good morning. We spoke to the director general of Nepals Tourism Department who was denying this notion that the country issued too many permits and thats why the overcrowding phenomenon occurred. He said it was because of the weather. There were only a few viable summit days, but he did say that nepal is considering adding a requirement when one applies for a permit to summit everest. That they are going to need to prove a certain level of experience. Right now, you can have zero climbing experience and still end up on the mountain. Arwa, you spoke to people at base camp about their concerns. What did they tell you . We spoke to a fatherdaughter team. Shes just 17 years old. They waited for the crowds to pass before they made an attempt to the summit. Heres how they described the journey. You see a dead body, okay, hes gone. I have to move on. I have to go. A lot of climbers actually were describing seeing dead bodies along the route. One of the sherpas also at base camp was saying as he was taking his private clients up he saw so many inexperienced climbers, people he said didnt even belong on the mountain. As one climber put it, you can think youre invincible. Then you get to Mount Everest and you realize nature may have other plans. Thats the issue with Mount Everest. Senate Majority Leader Mitch Mcconnell appears to be flipping his own script or flipflopping when it comes to filling a Supreme Court vacancy in an election year. Heres what he said yesterday. If a Supreme Court justice was to die next year what would you do . I would fill it. Enough said. Joining us now, joe lock hart, Margaret Talev and john avlon. He was quite clear. Hed fill it. He didnt feel that way when president obama was president , but now he does. I dont think mcconnell is flipflopping. It was never about a principle. Not the one he articulated. It is about power. Mcconnell is symbolic of the amoral politician that will say anything at any point in order to pursue their own goals. Hypocrisy no longer has a heavy price. Mcconnell could not care less what he say about him this morning. We could call him every name in the book and it wouldnt bother him. He has power. Only when he becomes minority leader will he pay attention. Mitch mcconnell its a problem for people who tried to find justification for what he did other than he did it because he could. Its a problem for people like lindsey graham, chair of the Senate Judiciary committee, who said this this past october. If an opening comes in the last year of President Trumps term and the primary process is started, well wait for the next election. Ive got a pretty good chance youre on the record. Yeah. All right. Hold the tape. We have held the tape. We have held the tape. Well see if Lindsey Grahams word means anything. Power generally trump s principle. There is an assumption that people have short memories and a contempt for consistency. Tone comes from the top. Hypocrisy is no longer the unforgiveable sin because donald trump dauz it aoes it all the t. Take what you can while you can and thats when democracy starts to die. Democrats havent forgotten. The 2020 candidates talked about it yesterday on the campaign trail. He also said hell fill it, but thats the job of the president of the United States, not Mitch Mcconnell. We have to do a little history about the division of responsibilities between the United States congress and the executive branch. I have argued in front of the u. S. Supreme court. I want to believe that its a nonpolitical organization and that politics are checked at the door of the courthouse. When you see things like that and hear things like that from senator mcconnell, thats no longer the case. We could and should do better. That train left the station. Margaret, your thoughts . Senator mcconnell and his team would tell you that he has been consistent, that hes really not being a hypocrite because there was an asterisk next to what he said. If the senate was controlled by the opposing party that would be the rule, not if the senate was controlled by the same party and now the senate is controlled by the same party as the president. Thats a distinction for arguments purposes, but politicallyspeaking, democrats arent going to recognize the distinction. What you have is his position now will create both reinforced support for him on the republican side and create a jumping off point for a new debate on the democratic side. Mcconnells position works fine for him unless Voters Decide to revolt against this in kentucky. Or in the next president ial election. You are starting to see tension lines around the issue of abortion, for example, and the Supreme Court. The Supreme Court may be at least a big point of debate and perhaps a driver of votes in the general election. But for now, mcconnells position is predicated on the idea that it will not be. That this will be about the economy. And that for republicans, some of whom are uncomfortable with several of the positions donald trump has taken or ways hes conducted himself, that its all been worthwhile for many republicans because it has allowed them to create a lot of permanent or longterm slots in the judiciary for likeminded conservatives. If thats the game for mcconn l mcconnell, you guys are right. Hes not concerned about what we are saying. Thats the game. Check mate. Thats joes problem. You know republicans vote on the Supreme Court and democrats dont as much. Margaret makes a good point. Abortion has become a bigger issue in this campaign than Mitch Mcconnell was counting on. Traditionally hes not reflecting history well. When the economy is weak, the economy is front and center. When the economy is strong, social issues come to the fore. People are satisfied with the economy. I think republicans are vastly under estimating the power of republican women who see whats happening in georgia, alabama, missouri as overreach. Overreach thats being protected by exactly the Mitch Mcconnell strategy of packing the courts with young antiroe v. Wade conservatives. Lets talk about what happened with justin amash last night. Congressman amash of michigan is the first and only republican to publicly say he sees impeachable offenses in the Mueller Report. So what will happen when he c confronts his constituents in michigan. He had a town hall. We were waiting for the reaction. He ended up getting a standing ovation. Heres what he said during this about other republicans. A lot of them think im right about the Mueller Report but wont say it, a lot of republicans. All right. That was a little bit. And he went on. Amash is a lonely libertarian whos been consistent with his principles. Hes come under fire from donald trump and the base. You look at the standing ovation he got. Listen to all of what he said. He basically said many members of congress, his colleagues, are too cowardly to actually tell the truth about what they think about donald trump. They are too afraid of the base to actually say what they think about whats happening in washington. He went on to say that cowardice, hyper partisanship is not only making us stupid. Its hurting democracy and crippling our ability to reason together as a country. Those are important comments for people to listen to today. I want to bring up another subject. Seth moulton from massachusetts, running for president. Hes not number one in the polls. Hes at the bottom of the pack. 1 . He did something historic yesterday which is acknowledge that hes been getting therapy for post Traumatic Stress. He served in the iraq war and said he had dreams among other things after and sought help. I dont know if we have a graphic of what he said. I can read some of it. I had particular experiences or regrets from the war i thought about every day. Occasionally, i have had bad dreams or wake up in a cold sweat. Because the experiences werent debilitating i didnt feel suicidal or completely withdrawn and i was doing well in school. It took me a while to appreciate that i was dealing with post Traumatic Stress and i was dealing with an experience a lot of other veterans have. He got help. That makes him in a way the first announced candidate for president to admit he or she gets regular therapy. He goes once a month. Its a refreshing moment in history. Hes doing so many people a favor by speaking publicly about it. It reflects the sea change in the way society deals with Mental Health issues and the circumstances of returning veterans. Just compare it with what you would have seen in the 1970s with political candidates and veterans returning home from war. It reflects Seth Moultons position in this crowded field. If he were the number one, two, three candidate there would be more calculation about how publicly to be comfortable speaking about this and how much to game this out. If nothing else, now this creates a window for him to connect with voters and with veterans and with interesting parts of the Democratic Party and the electorate at large. Around the time he was born tom eagleton was drummed out of a vp nomination because he admitted to Mental Illness and intense therapy. This is a sea change. It is heroic. It increases his credibility to come out and talk about it. Thank you very much for the conversation. We have a programming note for you. The father of a football star who died of an opioid overdose is set to take the stand in a case against Johnson Johnson. Jean, what can we expect today . Reporter a number of victims and families will take the stand in this trial which is a case of first impression. This is the first opioid case to come to trial right here in oklahoma. Its craig box. His son austin was a Football Player for the university of oklahoma. He was injured. He had to recuperate. What the plaintiffs, the state of oklahoma said yesterday is he began to take opioids so he wouldnt feel the pain, became addicted and died. The defense in the opening said there is no recorded prescription of opioids for austin, that he actually died of a heroin overdose. He will be a star witness, the father, for the state of oklahoma. Oklahoma said this is the worst man made disaster. Once Johnson Johnson and janssen came in and they started supplying their drugs to the people of oklahoma and through their marketing saying how safe and effective they were, thats when the crisis began and it grew to astronomical levels. I want you to listen to the state of oklahoma in their opening statement. There is a very simple truth with opiates. If you oversupply, people will die. The reason we have an Opioid Crisis is that simple. The defense has come back strong saying the reason we, for a time period, said this was safe and effective is because thats exactly what the fda was saying. And the university of Oklahoma Health sciences center, they said no one has ever come to the center or died of an addiction that took one of their two drugs. Why are we here, they said .
