August 12th. Joseph maguire has so far refused to provide information about the complaint that was deemed credible and urgent. Now hes supposed to provide it to congress, to the house and Senate Intel Committees as required by law. Maguire has agreed to testify in open session next week. But in just a couple of hours, that Inspector General will brief the House Intelligence Committee behind close doors. Joining me now democratic congressman part of the House Intelligence Committee. This story out of the Washington Post that the president made a promise, he made a promise to a foreign leader of such concern the whistleblower report ed and they thought it was of urgent concern, do you have any idea the nature of this promise to a foreign leader . I really cant comment on the specific complaint. I havent even seen it. But we are having the Inspector General into our committee this morning just to level set whats going on for your viewers. This is unprecedented. This particular member of the Intelligence Community filed this whistleblower complaint with the Inspector General. The Inspector General then spent two weeks investigating it and determined to be one, urgent, and determined that it was credible. At that point, as is called by statute in the law, he was supposed to turn it over to the director of National Intelligence who was supposed to turn it over. Instead mr. Maguire is concealing that complaint from congress which is unprecedented. And its also i believe illegal. What does it tell you that someone inside the Intelligence Community was alarmed by a promise the president made to a foreign leader . Again, i cant comment on the specific complaint, however, we know three things that is based on public sources including the acting director. First, that the person about whom the complaint is made is outside the Intelligence Community. Second, he did not feel he had unilateral authority with regard to that person, and third, that person is claiming some kind of privilege with regard to these communications. I should just reiterate there is no privilege with regard to shielding misconduct or information about misconduct. And thats why this is so important. We have to protect the whistleblower system. These are rank and file people who make complaints about wrong doing. And we have to learn in congress and the American People need to learn what theyre about and then secondly, this is about National Security. Its not a partisan issue. We have to learn how to protect our National Security based on theess whistleblower complaints. And congressman, i should be clear. The Inspector GeneralMichael Atkinson is a trump appointee, correct . Yes, sir. I think this person, you know, im glad he doesnt display partisan bias in regards to the whistleblower system. Now the director of National Intelligence needs to do his job. Im not asking for you to divulge what you know about this. Im not sure you know anything. We dont know anything. The Washington Post couldnt tell us what promise was made. But again the notion that a trump appointee thinks that the details of this promise are of urgent concern, what does that tell you . Is. Well, again, i dont know exactly whats in the complaint. I cant comment on that specifically. But the fact a member of the Intelligence Community would be so troubled by the conduct of this person outside the community, that person would say this is urgent and credible is very alarming. And what does it tell you that the acting director of National Intelligence has tried to keep that information from congress . Im just concerned that yet again theres a potentially kind of improper influence that outsiders are having within the Intelligence Community such as potentially even the white house. And that is why i think that the chairman, chairman schiff has called todays classified hearing as well as the open hearing next week with mr. Maguire, we cant have the white house politicizing the Intelligence Community. You know, the Intelligence Community is meant to protect our National Security and, you know, they do that job day in and day out. They serve in silence. And we have to make sure we protect them as they protect us. Now, as we understand it, reading this article from cnns own reporting, this isnt about the leaking of classified information or the passing on of classified information. Its about a promise that was made. Thats important because obviously the president has the power to declassify anything he wants. So what are the limits then placed around what a president can promise or say to a foreign leader . What oversight does congress have over that . Again, i dont know the specific contents of this complaint. So i cant comment specifically on that. My question has to do with privilege. What are kmaungss that a president does have with foreign leaders are privileged and what communications that a president has with foreign leaders are not privileged . Im not aware of a privilege that aemplpplies to a communica with anyone other than within a certain small circle within the white house and certainly not communications with a foreign leader. Right. That gets to my question there which is why the distinction, by the way, between a promise and divulging classified information is important here. Because the privilege may apply to one and not the other. Or the Legal Protections might not apply to one. Are you confident that the Inspector General when he testifies today will be allowed to give you the information you want . Im waiting. Im hoping that the Intelligence Communitys Inspector General, its a mouthful, will be able to be full in his answers to us. Its going to be in closed session in a classified setting. So im hopeful he can be candid with us. And that we can do our jobs in making sure we protect our National Security. Im going to end this part of the question. We know the ed looers he spoke with during the time frame. It includes Vladimir Putin by phone and an exchange of letters with kim jongun. You can see why it does raise some eyebrows. Congressman, i want to ask you about another issue i find very important. I say this as a parent to middle schoolers. It has to do with vaping. The new numbers on vaping are simply alarming. Theres explosive growth among vaping in kids and teens. You are now in the committee concerned about this. What more do you want to see . Thank you for the attention to this. Almost 28 of High Schoolers are vaping. And then also middle schoolers. My wife and i are parents of a high schooler and middle schooler. This is personally very distressing. Two action steps came out of that. First we basically told the fda that we thought that juul and others were not marketing their products in accordance we the law. They issued a cease and desist letter to the juul corporation to tell them to stop doing what theyre doing. And secondly, they proposed a ban to flavored ecigarettes. Thats what hooks young people onto ecigarettes. The second action step is that we basically issued document requests to juul to provide us more information about some troubling facts that we learned in the hearing. One of the most troubling is that juul paid School Districts to go into those districts and talk to teens about antivaping seminars. And in those antivaping seminars, apparently they claimed that these juul ecigarettes are, quote unquote, totally safe. And this is really disturbing. Now weve issued a letter to them saying if you dont produce more information to us about what youre doing in marketing to youth, we will issue a subpoena for this information. We hope they will comply. More needs to be done, obviously, on this issue. Now were seeing mystery respiratory illnesses across the country and deaths. So weve called an emergency hearing next tuesday for the sist centers of Disease Control to come in and talk about that as well. We look forward to hearing that hearing. I want to ask what sensitivities there needs to be when talking about vaping due to the fact there are those who have moved away from combustible cigarettes to vaping. When youre talking about menthol or regular tobacco flavoring. How much does that need to be taken into account . Well, the Trump Administration secretary azar i thought said it properly the other day which is that they are willing to allow for tobacco flavored ecigarettes for those who need flavors to use them. The Intelligence Communitys Inspector General is heading to capitol hill this morning to brief lawmakers about the whistleblower report that we have been telling you about all morning. What promise could President Trump have made to a foreign leader that was of such great concern . Joining us now is jeffrey toobin. Jeffrey, there was this phone call i mean, this is according to the reporting in the Washington Post. Cnn has matched some of it. That was of such grave concern to this whistleblower because President Trump made a promise of some kind that was clearly secret to some world leader. And he felt so strongly about it, this whistleblower that he filed a complaint. He did all of the right things by law. And yet the acting director of National Intelligence has not and will not at the moment transmit this to congress. Where are we . Well, the law seems very clear on this that the whistleblower did everything right. This law is designed so there is a channel they can go through if there a serious complaint it will definitely go to congress. Thats what the whistleblower did. The idea that the director of National Intelligence now on his own authority can contradict that seems wrong to me. Well, its not exactly his own authority. Listen to this. This is what the Washington Post is reporting. After fielding the complaint on august 12th, ath kun son who was the dni submitted it to sorry. Atkinson submitted it to maguire two weeks later. By law maguire is required to transmit within seven days. But in this case, he refrained from doing so after returning from legal guidance to officials at the Justice Department. Of course thats interesting because we know that sometimes the Justice Department has seemed lately to be protective of President Trump. Right. To be the president s lawyer instead of the peoples lawyer. Obviously we are to a great extent dealing in the dark here. We dont know what the whistleblower was complaining about. One thing i think is important to point out is that virtually all president ial phone calls with foreign leaders are tape recorded. Presumably this whistleblower wasnt sitting there listening on the phone whale this Exchange Went on. So the whistleblower probably listened to an audiotape. That seems to me to be obviously the critical piece of evidence. Simply matter to listen to this phone call. Now, these are highly confidential, hayly classified dealings. Dealings between a president and foreign head of state. But the leadership of the congress, the top National Security legislators. The idea its too classified is an argument i dont think would hold water. So if this law is explicit, are you saying that the acting director of National IntelligenceJoseph Maguire is breaking the law . Well, it seams that way. But, you know, i do want to it certainly seems that way. But the Justice Department even though it does seem like theyve been overprotective of the president , they have made some sort of argument here which none of us have seen. Certainly i havent seen it. It would be important to see why the Justice Department is saying that this whistleblower complaint should not be turned over to the congress. It could be that they would claim that this interfares with the president s constitution l constitutional thats the privilege involved. Certainly on the facts that are available, the exchange between adam schiff the chairman of the Intelligence House Committee and the intelligence officials. It seams like the obligation is to turn this over. If i can just add one more thing. Late yesterday ted barrett, our colleague who covers congress, he spoke to mark warner whos the ranking democrat on the Senate Intelligence committee. And warner said he thought there was going to be resolution here where congress would be able to see this material. So, you know, figure that in. Well, thats great. We might today. Because the Inspector General is going to capitol hill. And haes meeting behind closed doors. Maybe they will have a resolution. It doesnt necessarily mean that the public will know. Which i think would help people heave a sigh of relief. Of course. Thats what this is designed for. Is for classified people who have access to classified information to go through the appropriate channels where their protests can be heard but classified information can be protected. And if it goes to the intelligence committees, then the classified information will be protected. Because thats what these committees do. And heres where it gets a little confusing. We dont know if its classified information. The way its been described is a promise was made. So we dont know if thats protected or not protected. By the way, what does that even mean . Clearly the white house doesnt want this information out, okay . This is secret or they would have mentioned this themselves. So does the president have the final say over what promises he can make and whether or not those are ever revealed . Well, again, i dont think so. Those issues would have to go to court. Congress could ultimately subpoena this Inspector Generals report then the courts will decide whether the president has the right to protect it. Remember, 1974, Richard Nixon claimed that the white house tapes were privileged and should not be turned over in the wat watergate investigation. The Supreme Court ruled he did have to turn over the tapes. Ultimately these are resolved in the courts if there can be no compromise resolution. The thing thats always important to remember about the courts is it takes a long time. They are on slow boats. They are weeks or months away from being resolved. Whether its the president s tax returns or the testimony of the attorney general, the secretary of commerce. All these fights are now in the courts. But the great advantage the Trump Administration has is delay. And they can tie this one up in the courts too and who knows when it would be resolved. I feel like youve sang that song before. The courts are really working overtime jeffrey. Maybe theyre not working overtime. Maybe theyre not getting thaez resolved. Jeffrey toobin, thank you so much. There may be the beginning of diplomacy. We dont need secret channels. You can rule out on the side lines if you were in new york . Yes. Alani was accused of trying to sabotage a plane with 150 people on board. Authorities used Surveillance Video to identify alani. They accuse him of gluing foam into a tube that measures speed. Reporter prosecutors also said they found an article about the deadly lion air crash in indonesia last year on alanis phone. They say it referenced the same type of air data module system hes accused of sabotaging. He had told coworkers his brother was a member of isis and he went to iraq to see his brother. Prosecutors say alanis roommate said he went there because he brother had been kidnapped. In court documents, prosecutors initially said he confessed to sabotage due to a pay dispute and wanted to get more overtime fixing the flaw he created. But investigators say he may be looking into whether he was somehow radicalized. Weve also seen these organizations be very creative and innovative. And weve seen more outsourcing. They essentially reach out to other people to kind of do things for them. Reporter terrorist groups from al qaeda to isis are known to be fixated on bringing down american planes. And to pull off an inside job has always been a major security concern. There are two epic hypocrisies here and one called political reality. First, federalism has always been a conservative article of faith. Thats the idea the states should have the right to be free from federal government as much as possible. But in trumpland, it doesnt extend to the environment. The california board which sets these boards was established by Ronald Reagan in 1967. At that time california was swamped with smog. Guess what. Policies worked. So when President Trump touts americas Crystal Clean air, its because of the policies hes now trying to get rid of. And this is just one example of 85 environmental rules the administration is going after. It includes letting companies off the hook from reporting methane leaks to trail pipe emissions. But on the flip side, California Governor Gavin Newsom is leading against the trump agenda. His states filed 59 lawsuits against Administration Policies from immigration to the environment. President trump says hes acting on behalf of the Auto Industry and the consumer since Companies Wont have to pass on the cost of meeting stricter emission rules. But the Auto Industry hasnt been asking for this. Dont take my word for it. Back in 2018, bill ford of the company that bears his name said, we support includesing clean standards through 2025 and are not asking for a rollback so why is President Trump flying across the country to punch california in the face . Because he can. Charging a state would be bad politics in a vote system. But because of the electoral college, he doesnt care about getting votes there. Hes never going to win it. Even if it manes damaging the environment and increasing pollution on behalf of an industry that isnt asking for is. Here in new york city, attacks on jews have spiked and one part of the Jewish Community says theyre at more risk. Jason carroll is here to explain. Reporter this issue runs deep in the Jewish Community. Members of the Orthodox Community say assaults on them are happening with alarming frequency. In the year following the shocking attacks at the tree of life synagogue in pittsburgh where 11 people were brutally gunned down and the shooting in san diego where one woman was killed, antisemitic incidents have been on the rise. In santa monica, swastikas on a pedestrian bridge this past july. In northern california, students and staff at this high school shocked to find antisemitic graffiti spray painted on walls two weeks ago. In chicago, synagogues targeted may in a rash of suspected hate crimes. The reports coming in across the country alarming, but one part of the Jewish Community feeling more vulnerable. Rabbi guppen is still recovering from a vicious attack after a man assaulted him in a park in brooklyn last month. A suspect now in custody charged with a hate crime. He said i hate jews. He said something in that direction. Looking to kill. No doubt about it. Reporter the new York City Police department is also investigating another possible bias crime involving an Orthodox Jewish man who was assaulted outside this brooklyn synagogue several days after guppen was attacked. Weve seen some mental illness. Some people that just hate. Reporter this year antisemitic hate crimes in new york city up 63 compared to last year. While those numbers do not specify the type of jewish person attacked, orths dox members of the Jewish Community say because theyre more visible, theyre an easier target. Akiva pearl says its been decades since hes felt so unsure about his surroundings. I grew up in london, england. Thats what it was 50 years ago. Somehow its returning. Why do you think its returning . What is behind it . I really dont have an answer for you. Reporter Steve Moskowitz volunteers in an area with a large Orthodox Community. One of these command centers right next to a synagogue. It acts as a deterrent. Reporter he was not surprised to hear from those disturbing numbers coming from the nypd. Id like to think we have our fingers on the pulse of the community. And we do. Were hearing a lot of stuff. People are afraid. If theyre not afraid, theyre concerned. Reporter city Officials Say they hear those concerns. We are taking this very seriously, and tackling this head on because no one should have to change the way they dress, whether they wear a facial beard or they wear a garb or yarmulke on their head. Reporter whats needed is more education, especially about the holocaust and less rhetoric from elected officials. Standing up and denouncing hate in all its forms, its not just words. It really makes a difference in the aftermath of a hate crime. Reporter as for akiva pearl, he offered this advice. Increasing in goodness and kindness toward one another, all walks of life. Thursday, september 19th, 8 00 in the east. We begin with the breaking news. President trump had a communication with a foreign leader that was so troubling to one u. S. Intelligence official that they filed a whistleblower complaint. The Washington Post reports this involved a promise. The president made to a foreign leader that raised, quote, urgent concern and prompted that official to report it. It is not known who the whistleblower is or who the foreign leader is. The post says white house records show President Trump spoke with at least five heads of state in the weeks before this complaint was filed, including Vladimir Putin and kim jongun. The Intelligence CommunityInspector General, a trump appointee, determined the complaint was credible and a matter of, quote, urgent concern. Thats a crucial legal threshold. Still, acting director of National Intelligence has refused to turn the complaint over to congress. The Inspector General will brief the House Intelligence Committee behind closed doors. Mcguire has agreed to testify in open session next week. Not clear how much they will be willing to say. Joining us now is shane harris. Hes an intelligence and National Security reporter for the Washington Post. He cowrote this article. Shane, thanks for joining us to share your reporting. What do you know about this phone call and the promise that was made . What we know essentially is what we broke in the paper last night. This communication happens between the president and a foreign leader. We dont know when and we dont know the leader nor how this individual found out about it. There are things we can deduce. We know this person is an intelligence official who worked on the National SecurityCouncil Staff for some period of time. People like that are often in a position to get read outs or summaries of conversations that the president has had with foreign leaders. But whatever it was so alarmed this individual that he or she decided to go through the legal route for reporting it and thats how weve arrived at that point where we are now with the Inspector Generals investigation. Okay. So to your point, this person was so concerned that he or she went to the Inspector General. The Inspector General then is obligated to alert the director of National Intelligence. Then what was supposed to happen, because thats where this breaks down. Traditionally what happens is the dni would then be like a conduit and give this information and the allegation to the intelligence oversight committees. Now properly secured in a classified or confidential way, its not to be made public necessarily. That did not happen. At some point in this sequence, this veered off and the dni decided to go to the department of justice and seek their input. They came back and said youve got an issue here because theres communications that could be subject to privilege contained in this complaint. At that point, we didnt know publicly what this was about. Weve since found ourkt, of course, the communication is probably a phone call the president had with a foreign leader. This is highly
