On wednesday, Deputy Assistant secretary of state george kent describing giuliani building a Smear Campaign against yovanovitch. I became alarmed as those efforts bore fruit. They led to the ouster of yovanovitch and hampered u. S. Efforts with the new Zelensky Administration in ukraine. Reporter democrats intensifying their stance on impeachment. I am saying that what the president has admitted to and says its perfect, i say its perfectly wrong. Its bribery. Reporter while the president praised his republican allies the republicans, they stick together. I mean, they have really stuck. Reporter as they continue their defense of trump saying the impeachment witnesses so far only have secondhand information. Ambassdor to the eu Gordon Sondland appears behind closed doors. His boss, top u. S. Diplomat to ukraine bill taylor testified his staff member said the conversation happened one day after President Trumps call with the ukrainian leader. Schools in Santa Clarita are closed today after a student killed two students and injured others. A student pulled a hand gunn before turning the gun on himself. All of this in a matter of seconds. Stephanie elam is live with the latest. What are they telling you, stephanie . Reporter this about this happening before school actually starts, but there are kids on campus. And it just took 16 seconds. And in that time, this shooter was able to shoot five people. They know this because officials were able to take a look at surveillance video. They say in that video, you can clearly see that the shooter took his backpack, opened it up, pulled out a. 45caliber pistol out, didnt say a word, shot one student. Seemed to have a jam, cleared the jam in the gun and went back and shot four more people before shooting himself in the head. Obviously when this happens and these gunshots ring out, there was mayhem on campus. Take a listen. I heard the first shot and everyone thought it was a balloon. And it got really quiet. And then two more shots went. And then everyone just started running out of school. We were waiting outside of the locker room because it wasnt open yet. All of a sudden, we were with all of our friends and heard gunshots. We were like, lets run. Reporter and people started running out into the neighborhood out to the homes nearby. One man said students ran up, theres a shooting can we hide in your house. He took 20 kids and put them in the house. A 16yearold girl lost her life at the hospital and a 14yearold boy also died at the hospital. The shooter remains in grave condition is how they are describing it at this point. But one thing worth really mentioning is there is a lot of Law Enforcement officers that live here in Santa Clarita. So they were dropping their children off at school. Three in particular were there, heard the gunshots, saw kids running, knew something was wrong. Turned around, went on campus and started triaging and helping those students out. And then were able to get them to help they would possibly need. Although we know two children did die. Which is horrifying. And the response, though, was remarkable. Joe, what role does ambassador yovanovitch play in this story and why is her testimony today in public important . I think there are a couple reasons. One is it shows the length and the breadth of this campaign to get the ukrainians to investigate biden and his son. This wasnt just one phone call in july. She got fired in march and the Smear Campaign started even before that. Secondly, it exposing Rudy Giuliani for what he was doing. And i think she can talk about the kind of people he put in with ukraine. The corrupt people. Finally, there are a lot of people around the president who were involved in this Smear Campaign. Weve got donald trump jr. , sean hannity, Rudy Giuliani. It kind of stretches credibility that the president wasnt aware of this. We also have joe de geneva. I think we need to talk about him. Because Marie Yovanovitch becomes the living embodiment of what happens when conspiracy theories take hold around the president. And thats what happens. Joe who has been a legal adviser, i guess, to the president for a long time was on the bank roll. Its been reported in outlets of a corrupt ukrainian oligarch. And so he did not want Marie Yovanovitch standing in the way of the corruption. This is the moment he goes on Sean Hannitys show to smear yovanovitch. Watch this. The current United States ambassador Marie Yovanovitch has bad mouthed the president of the United States to ukrainian officials and has told them not to listen or worry about trump policy because hes going to be impeached. And state Department Officials have testified and said that they didnt know where they were getting that. None of that was true. He made it up is one of their comments. In fact, yovanovitch said somebody maybe even pompeo had to call hannity saying what are you doing . Why are you saying all of this . And if you have proof, tell us. And none of that ever happened. Well, of course it didnt happen. The reason they recalled her is because she was an impediment to their scheme or drug deal. And they need to get her out of the way. Its pretty simple. She was they basically, we the United States government are trying to help ukraine deal with corruption. And what these guys have done, they were basically trying to encourage ukrainians to engage in another corrupt act. Its insane. This whole thing is insane. One of the things youre looking at today is if republicans in the Intelligence Committee who will be doing the questioning will actually continue this line. Right . You want to see how they treat ambassador yovanovitch. Yeah. I mean, i think she comes up as quite the victim here. She doesnt know what happened. She wasnt around for the july 25th call. But point is, shes going to be able to paint a story about, you know, igor and the three amigos and the shadow policy these guys were running. She was trying to run the official policy. And shes relieved for it. Then comes taylor later and he discovers the same sort of thing. Thats where we are. But do you think the people on the committee, the republicans on the committee will attack her . I think they better be careful about attacking her. I think she will come across as fairly sympathetic. She does seem like a victim. Although i wouldnt be shocked if they attacked her. Rudy giuliani was also making lots of money in ukraine. Yes. And Rudy Giuliani knows about how some of these things took hold and took root and got into the president s mind. And so yesterday Rudy Giuliani was asked by the guardian whether he thinks at some point he might be thrown under the bus. Here was his response. He says that he was im not worried, but i do have very, very good insurance. So if he does, all my hospital bills will be paid. And his lawyer then interjected, hes joking. So how do you read the insurance policy . I read it as he wasnt joking. That he was sending a message to the president. That i know everything and you will protect me at all costs because at the end of the day, Rudy Giulianis going to take care of Rudy Giuliani. The other point id make on the ambassador, i think shell bring a moment of drama. There are a lot of people who said the testimony on wednesday was not dramatic. Shes going to talk about how she got a call saying in the middle of the night saying get out of the country. Youre not safe there anymore. And thats, you know, thats dramatic. Thank you. Well thought of, competent. The idea he could hear a phone call this loudly in the middle of a restaurant in kiev of all places, is this because ambassador gorgdon sondland is member of the keystone cops or because rules dont apply anymore and you dont have to be in a secure area to have a conversation with the president of the United States . All of the above. Keystone cop, naive, out of his league. Virtually we know everybody heard that call. The russians heard that call. Hey, russia, send us the phone transcript. What kind of a witness is he . Who is Gordon Sondland and what does he want at this point . That is the unknown at this point. We know hes already gone in and had to change his testimony once. There are certainly cases now out of taylor and kents testimony that put in doubt some of his other testimony. My guess but its only speculation is hes going to go in there and protect Gordon Sondland. Hes not going to go in as President Trumps guy. The president , i think, sealed that by saying i barely know the guy. I think hell go in and hopefully he has a good lawyer and well finally get the straight truth from him. Because when youre on camera and everyones watching, you cant go back and correct it later. Do you know him, charlie . Have you met Gordon Sondland . I do. I met him on june 28th at a dinner and my impression was that he was a bit arrogant and naive, the wrong guy for the job. Didnt have a lot of respect for the eu or the way it operated. I thought he may as well be wearing a maga hat. I just got the sense listening to him and speaking with him at dinner that he was a he just didnt seem to think that the eu snapped to attention every time that he made a demand. That they should snap to attention. Yeah. And didnt recognize that the eu, they cant simply say yes. They have 27, 28 nations. One nation can veto. Didnt appreciate the process. You know, seemed to think for the Marshall Plan they should be more grateful. I just thought he was the wrong guy for the job. And you need somebody in there who supports the European Union or believes in its mission somewhat. I dont think thats what you had in Gordon Sondland. America will hear from him in just a few days. There was a moment that played out on cnn and it was remarkable after the School Shooting in california. And jake tapper got former president bill clinton on the phone who was in washington, d. C. , to receive an award from the Brady Foundation on battling gun violence. They talked about gun violence. But jake also asked him a question about impeachment. Obviously president clinton knows a lot about that. And what advice clinton would give President Trump on how to do his job now. I want you to listen to that answer. You got hired to do a job. You dont get the days back. Every day day is an opportunity to make something good happen. And i would say ive got lawyers and staff people handling this impeachment inquiry, and they should just have at it. Meanwhile, im going to work for the American People. Thats what i would do. I feel like hes been listening to you, joe. Not listening to me. Its what he did do. And i think the really revealing part of that conversation with jake was the top of it where he said, every day is an opportunity. You dont get the days back. That was the sense i got working with him in 1998 and 1999. His frustration was i only have this many days until im not president anymore. He wasnt thinking about getting removed. He was thinking about the constitution and the two terms. And it really does stand in stark contrast to trump who seems obsessed with this. I mean, from the outside it looks like all he does is tweet and watch television. You know, i challenge anyone to articulate what his agenda is right now on issues and legislation and that. And i think its very solid advice coming from a very personal point of view that, you know, and it harkens back to a different time where a president i mean, trump defeated bill clintons wife and he just gave him good advice because its good for the country. We dont see a lot of that anymore. It was also in the context of what happened. President clinton was saying you can get something done on guns which the white house isnt even going to try anymore after he said he was going to work with congress on the background checks and the like. Theres plenty of opportunity. They could have passed a universal background check in a nanosecond. Because republicans follow what he says he wants to do. Hes the person that could actually do it. Absolutely. The absurdity of this whole thing, i was in the Pennsylvania Legislature and we passed universal background checks then for private sales of pistols. It was not and pennsylvania is a profirearm state. We did it. They could simply adopt the pennsylvania law. And it was passed by Republican Legislature with tom bridge as governor. Im amazed that they cant just take up something so simple as universal background checks. Its a choice. And President Trump has chosen not to do it at this point. Michael, as you well know, being one of the drafters, the word bribery is in the constitution as it concerns impeachment. The president , Vice President , and all civil officers of the u. S. Should be removed from office on impeachment for conviction of treason, bribery, and other high crimes and zme misdemeanors. Thats one reason she likes that word. Why else . When i started with you i said there was a messaging challenge for those seeking the impeachment of the president. Does this fall in the category of watergate . Hay, thats a burglary. We all know what means. Or is it white water . A very complicated land transaction. I would suggest to you that when youre speaking of quid pro quo, youre in the white water turf. So i think that Speaker Pelosi quite rightly realizes theres a messaging issue here and it needs to be explained in straightforward terms without any latin involved so that people can understand the alleged wrong doing on the part of the president. The only other thing i would say is i think shes probably mistaken in referring to this as bribery if, in fact, it occurred as they are presenting. It was probably extortion. Hey, i have something you need. Im not giving it to you unless you give me something that i need. Not by the way for my country, but for my personal plal objective. Thats more extortion than it is bribery. But to your point, extortion doesnt appear in the text of the constitution. Bribery does. I doubt, though, were going to hear the it was only extortion defense from the white house on this. Because extortion could easily fit into high crime and misdemeanors. Whether its one or whether its the other, i think were in agreement that what theyre trying to do is convey something that can be readily understood by the American People as having crossed an impeachment line. But what you do hear, michael, are the president s dechkders saying basically it cant be a crime if the victim didnt know that a crime was happening. And so they keep saying zelensky didnt know the aid was being held up. I dont know if zelensky did or didnt. Because the diplomats all around zelensky sure knew that something was up. And they were worried about it. And you start to hear bill taylor and others saying, wait a minute. Is this really happening . Whats happening with the money . So the diplomats started to know. So i think the counterparts started to know. But what about that . That republicans are saying it couldnt be bribery if zelensky isnt in on it and doesnt know that the 400 million is being held up unless he investigates. I would disagree with that interpretation. Was the money being upheld . And its not just the funding. I know you know this, alisyn. It was also access to the oval office. It was access to the president. So were both of those things being withheld . Yes, they were. Why were they being withheld . Until according to a lot of the testimony six or seven different peaces of corroboration, until such time as an investigation was launched into burisma and a look at crowd strike. So i think that the elements are there regardless of whether that had been personally communicated to zelensky. Very quickly, michael. The Supreme Court is going to be asked to take up the case of the president s tax returns. There are two separate cases that the court may ultimately hear. Whats the significance here and what do you think happens . Well, its really precedent setting if they were to reach this determination. I would like those seeking the office of the presidency to have to present their tax returns while doing so. But thats not a requirement. And so the question now is should that be forced upon by a state investigation . Which i think is really significant here. Where we dont have that rurmt. I mean, what the white house what the president s lawyers are saying is not only can you not indict, you cant even investigate during the course of his presidency. Theres precedent being set. Three others were wounded. This tragic event is raising questions about legal ways to prevent this kind of violence. I want to bring in andy mccabe. Andy, i think one of the things interesting about you and people might not know this about everything youve been connected to the last few years, you worked closely with the people running the background checks. And gun violence is absolutely in your portfolio. So when you see Something Like what happened in california, whats interesting here is this was a handgun. Not an assault weapon. No ones going to ban handguns. Those arent under any discussions there. When you talk about what the laws could do to prevent Something Like this, whats the answer . Its hard to overstate the enormity of the burden the fbi carries in essentially conducting the background check process. The bureau conducts the background checks for most states. And it is a volume that they struggle to stay on top of day after day. The highest volume days are typically the day after thanksgiving where the fbi will process close to 200,000 background checks in a day. There are a few things that congress can do i think relatively easy, inexpensive, and noncontroversial things they can do to make those background checks more effective. The first is one of the prohibiting factors. One of the things that would prohibit a sale to you of a firearm is if when the bureau checks your name, they find out there is a warrant for your arrest in some jurisdiction. There is a fugitive prohib tor for many, many years the fbi interpreted that as if theres a warrant for you, you are a fugitive and cannot purchase a firearm. They looked at that in 2017 and imposed a much greater requirement on the fbi to determine why and where you were a fugitive from. This is work that is very hard to do in the check. And one of the things you will hear gun supporters say is, well, there isnt a law that would stop this shooting. In california, they may well be the case. Many cases. But it may be the wrong question. Its not that one law can stop every School Shooting. Correct . Thats right. We have an epidemic of gun tragedy in this country. And i think everything that we can possibly do to potentially limit those tragedies, to possibly stop the next one, those are responsible steps we should be taking to make sure people are safe. Specifically about this case, is there anything that jumps out to you. This was a child. We dont know exactly where he got the gun. But his late father was a hunter. Maybe it came from his electi. Collection. Its hard to say. Is this a gun he had access to through the home . Was it legally purchased . Those are all things well find out through the course of the investigation. But it does raise if, in fact, he got the gun in his home from his father, it raises the issue of how are people protecting these firearms that they are responsible for in their own homes . And why do troubled young people have access to them . Changing gears completely here, there was an image at the white house yesterday that caught our attention. The president was supposed to be leaving to go to louisiana, but he was in the oval office, and i think we have the picture here in the middle of an animated discussion with the attorney general william barr and the white house counsel. White house reporters tell us one of the things being discussed in there was the Justice Department Inspector General report on the origins of the russia investigation. We know that you told us yesterday that you talked to investigators as part of that investigation. I did. But what does it tell you that was being discussed in the oval Office Yesterday before this report was being released . Well, its remarkable. I in the course of my time in the fbi had the responsibility of being involved in numerous ig investigations. Not just the ones towards the end of my career but many over the course of many years. I am not familiar with a single other instance in which the attorney general discussed the substance or the status of a pending ig report that was not yet finalized, had not yet been reviewed by the people interviewed and not been released to the public. I think it shows you how incredibly political this report is. It clearly has great significance to the president in terms of his own political interests. And that may, in fact, have been what they were discussing yesterday. We dont know. Definitionally its not finalized because it has yet to be reviewed by the people there. You go to ambassador school, learn how to be an ambassador, what youre supposed to do, how youre supposed to handle yourself. In many cases you also get Language Training which i assume is offered.
