For an officer. And today, President Trump is expected to issue an executive order on policing in america. A key model used by the white house is now projecting a second wave of coronavirus earlier than anticipated. And now, more than 200,000 americans dying by october. That is 30,000 more fatalities than just a projection last week. It is being attributed to premature relaxation of social distancing in states around the country. Right now, cases are on the rise in 18 states. Eight are experiencing increases of more than 50 , including oklahoma. And of course, thats where President Trump is planning to hold his rally on saturday. Meanwhile, the president is offering up a mindboggling defense of his rally, insisting that if we stopped testing right now, wed have very few cases, if any. Lets begin our coverage with cnns dianne gallagher. She is live in atlanta with our top story. Dianne, tell us what youre seeing on the ground. Reporter yeah, jim, Atlanta Police revealed on monday that the officer who killed Rayshard Brooks had been reprimanded previously for use of force. Now, this comes as his family is continuing to mourn, demand justice and substantive change. And were also learning more about what happened that friday night that he with killed here at this wendys. Outside this wendys in atlanta, a candlelight vigil filled with frustration and a new call for justice for another life cut short at the hands of police. [ crowd chanting ] here, the community gathered in the same place where Rayshard Brooks lived his final moments. Everybody right here is saying enough is enough. Reporter the over 40minutelong interaction between brooks and police after he was found sleeping in a wendys drivethrough caught on camera, showing sincefired officer Garrett Rolfe shooting brooks twice in the back after he appeared to shoot a taser at rolfe while running away from him, following a scuffle between brooks, rolfe, and officer devon brosnan, as they tried to handcuff him. Now a 911 call revealing what happened before authorities arrived on scene. I have a car. I think hes intoxicated. Hes in the middle of my drivethrough. I tried to wake him up, but hes parked there in the middle of the drivethrough, so i dont know whats wrong with him. Is he breathing, maam, do you know . Yeah, he woke up, looked at me. Does he appear to have any weapons from where you can see him . No, no. I think hes intoxicated. Reporter a protesters march demanding a change in brooks name. His family, still reeling if his loss, asking for the same. They feel sorry to what they took away. You know. If they had a chance to do it again, would they do the same way or would they do it totally different . Reporter meantime, Fulton County District Attorney says there will be an announcement of possible charges against the two officers tomorrow. Theres really no reason for mr. Brooks to end up dead because he fell asleep in the drivethrough or that he was intoxicated. Whatever those incidents might have added up to, it certainly didnt merit the final outcome in this case. Reporter and after brooks death, Atlanta Mayor Keisha Lance Bottoms signed executive orders, including major changes in police use of force. On friday evening, we saw the murder of Rayshard Brooks. It is clear that we do not have another day, another minute, another hour to waste. Reporter now, cnn has reached out to the officers and their union. We have not received a response just yet. And you know, here on the ground, the calls are for police reform. They want to see real changes. Well, President Donald Trump is expected to sign an executive order later today that includes some of the changes that the people are asking for. I want to talk about a little bit of that. Its expected to have a nationwide database to track Excessive Force complaints, National Officer certification system, encourage departments to involve Mental Health professionals. Thats a little bit of what it is there. Now, for some of the people, jim, that weve spoken to here in atlanta, and really, across the country, this isnt going to go far enough. They want different change. They want bigger change. They want to see an overhaul of the way that Police Interact with people, especially with black people in america. Dianne gallagher in atlanta. One person has been shot in new mexico, this after a rightwing militia confronted protesters who were trying to take down the statue of a conquistador. A local reporter posted this video of the moments the shot rang out. It is alarming to watch. [ crowd chanting ] tear it down [ gunfire ] thats right, that is gunfire, shots fired not by police but by a selfappointed militia. Albuquerque Police Detained several heavilyarmed members of that militia, known as the new mexico civil guard. Keep in mind, those are not soldiers or Police Officers there. Those are militiamen. Authorities say the shooting victim is now in critical condition. New mexicos governor says she is horrified and disgusted by the violence, tweeting, there is absolutely no space in new mexico for any violent, wouldbe militia seeking to terrorize new mexicans. Albuquerques mayor says the statue will be speedily removed as an urgent matter of Public Safety. Meanwhile, cities across the u. S. Are announcing major police reforms, including here in new york city, where the Police Department is reassigning hundreds of undercover officers. Cnns Brynn Gingras joins us now with the details. What have you learned . Reporter this is a significant change in one of the biggest the biggest Police Department in the entire country. Essentially, what this means, 600 plainclothed officers are now going to be transferred to other units within the department. The detectives unit neighborhood policing. Let me break this down. These are the anticrime units, so these are the plainclothes officers that dont respond to 911 calls. They basically go out and look for violent criminals and try to disarm them. But you can imagine their aggressive policing tactics has created a lot of discourse in the communities that they serve, and thats the point here, according to the Police Commissioner, is to try to build back that trust between these communities. In fact, some of these officers have been involved in some of the most notorious shootings, policeinvolved shootings here in new york city. So, that is the point here. The question, though, is it going to spread now nationwide . But i want you to listen to the Police Commissioner explain why he did this. Make no mistake, this is a Seismic Shift in the culture of how the nypd polices this great city. It will be felt immediately throughout the five District Attorneys offices. It will be felt immediately in the communities we protect. Commissioner shea now saying officers need to use technology and intelligencegathering, instead of brute force. Now, the police union having a fiery response to this. I want to read part of it to you, referencing that president of the police union, the uptick in gun violence that we are seeing in new york city. Said, shooting and murders are both climbing steadily upward, but our city leaders have clearly decided that proactive policing isnt a priority anymore. They chose this strategy. They will have to reckon with the consequences. And commissioner shea has said that there is a risk to making this call, but he says he wears that risk on his shoulders. So again, were seeing this reform, these calls for the reform, and then some changes in Police Departments all across this country. We know that the California Attorney general called for no choke hold, intervening when colleagues are doing aggressive force, in their opinion. So, the reform that people are calling for, but now youre seeing the Police Department, nypd, the biggest one in the country, making a major change. Again, will that be copied across Police Departments across the country . Well have to see, alisyn. It does feel like a Seismic Shift here and elsewhere. Thank you very much. Nina, what do you think as you watch these cities all, you know, obviously from new york to atlanta to seattle, grappling with this . What the Police Commissioner in new york described, as we just heard in brynns piece, is a Seismic Shift that is under way. Do you see it that way . Its about time. I mean, for some people, its a Seismic Shift. For others, especially the black community, its late. Its late coming. Africanamericans have been crying out for a very long time about a system that is unjust, a system that sees black people, especially black men, as somehow more criminal than anybody else and less deserving of mercy, less deserving of the opportunity to be able to have real justice. So, while i am glad to see these changes happening, they are very late. There have been generations of africanamericans lost to a system that does not see them as true human beings in the United States of america. Richard rose, you have multiple efforts now to introduce new police standards. You have democratic proposals, which go the furthest. You have republican proposals led by senator tim scott, which are short of that. Now you have the president today with an executive order. I just want to start with the president s, because that will come first. Hes talking about a way of accrediting Police Departments around the country, in effect, incentivizing Good Behavior on deescalation, use of choke holds, et cetera, as well as a National Database to track Excessive Force. Does that, in your view, go far enough . Absolutely not. As said, these changes are long overdue. And i dont think fixing around them will do. I think we have to do a complete restructure and shift from policing to Public Safety as a mission. You know, 911 is a great system. You call 911 if your house is on fire. They dont send police. They send a fire department. I think that many of these instances, the police should send trained Mental Health professionals, psychologists, social workers, psychiatrists, whatever it takes, but definitely you shouldnt send the police when theres a report of a naked man having a psychotic episode. So from the ground up, there needs to be a restructuring. Well, it sounds like thats under way. You know, correct me if im wrong, but it sounds like even the president s executive order does talk about sending Mental Health experts, addiction experts, social workers to some of these 911 calls that police used to do. And i was also struck by what the Police Commissioner in new york is going to do. If theyre disbanding that group of 600 plainclothed policemen that were responsible and behind a lot of the stopandfrisk aggressive policies, what it sounds like theyre doing is moving from policing on the street you know, how do i describe this . Proactively going out on the streets looking for trouble, basically, which you will find, into any neighborhood, if you go looking for it, to more reactive, going out when theres a call and maybe going out with more of those support services. Do you think that that is a great start . I think its a great start. Its a start. Sorry. Go ahead, nina. Its definitely a start, but theres no time for patting each other on the back and slapping hands. What we fail to realize is that this is a system that the police are really just a microcosm of a racist system, an antiblack system whereby generations of black folks have lost their lives. And when they were not physically killed, the spiritual death, the mental death, political, economic, social death, that is the thing. So, yes, it is a start, but we are a long way from atonement. And the United States of america as a whole must atone for its sins against the Africanamerican Community. So what i dont want folks is to get slap happy about this. This is a start, but a long way from where we need to go. As Breonna Taylors family, George Floyds family, tamir rices family, emmett till didnt have a smartphone to verify whether or not he was entitled to some humanity in the United States of america. So, this is no time for celebration. This is a time to continue work. We need not only a total restructuring, but we need wholesale, tear down the system and start and reimagine policing in a different way. Richard rose, i wonder if you agree with that, because all the proposals, even the democratic proposals that go the furthest, they talk about reform. They talk about changes. Not about tearing down and starting over, in effect. I mean, right now, thats largely isolated to the minneapolis community, right, which has talked about disbanding its Police Department. Do you believe disbanding is the way, dismantling and rebuilding, following the example, for instance, of camden, new jersey . Or do you believe that existing Police Departments can be reformed through legislation and other means to make them fair to the africanamerican members of their community . So, i would answer it like this way. We had the Voting Rights act of 1965, but yet today there remains Voter Suppression in all forms in all states. So, yes, there has to be a tearing down and a restructuring. Because if you take the same people with a little fixing up on the side, they will revert back to where they were. This, the individual that killed Rayshard Brooks was reported, had prior incidents. And we have had those discussions with chief erika shields in atlanta before. There must be a notolerance policy for abusive action towards citizens. And that is not the structure right now. It has to be restructured. I want to read one of the 911 call transcripts from the moments that george floyd was under the knee of a Police Officer, and they are so striking, because these are people, witnesses watching what the police are doing, and theyre calling the police for help, because they recognize that what this officer is doing is so out of line, according to them. Here is what it says i literally watched Police Officers not take a pulse and not do anything to save a man, and i am a First Responder myself, and i literally have it on video camera. I just happened to be on a walk, so this dude, they blanking killed him. It was so obvious, nina, to all of the people around, begging those officers for mercy. I mean, the 911 calls just, you know, drive it home, of who do you call when a Police Officer is the person responsible for the brutality . Thats right. And that is another reason why we need total, a reimagining, or imagining, if you will, because we know that theres a blue code of silence. The fact that so many officers stood by while this other officer and i use that term lightly, because police have never holistically protected and served the africanamerican communities, but treat as criminals. But to have your full force and weight on mr. Floyds neck for 8 minutes and 46 seconds with your hands in your pockets and didnt even flinch so, that outcry is so true. Why was he able to do that . Because he did not see him as a human being deserving of not just mercy, just not to be treated that way arrest him and take him to jail how about that . He would still be alive. Thats what should happen. And you know, im saying this as a wife of a retired Police Officer and a mother of a Law Enforcement officer right now. My son is a millennial black man in america who wears a badge and a gun, but then when he doesnt have his badge and his gun, his life is in jeopardy on all sides. So, i get this. So, im saying this with all the street credibility that is necessary to say to this nation that we must do a new thing. The Africanamerican Community deserves it. This country deserves it. North korea now very strongly saying that diplomacy has all but ended. And in fact, they believe it has ended so much that they decided to blow up the building that they shared up until january with south korean government officials. The Liaison Office was a place where the north and south could work in separate offices but get together and meet, if they needed to, but there hasnt been a lot to discuss lately and north koreas been very upset in recent days, jim, after defectors sent balloons into north korea that dropped down leaflets that they view as, you know, extremely provocative in terms of its language against kim jonguns regime. Of course, we dont know where kim is in all of this because its his younger sister, kim yojong, whos been calling all the shots. S. Diplomacy with north korea . The president invested enormously in this. Three facetoface summits, discussion of his love letters, suspension of u. S. south Korean Military exercises. North korea says its no longer interested in speaking to the u. S. Reporter diplomacys pretty much dead at this point, jim. And i think that we can expect to see north korea starting to push these pressure points as they try to get attention. Theyre frustrated that sanctions are still in place. Their economy is still, you know, struggling in the midst of the coronavirus pandemic. And you know, a lack of communication with the rest of the world. So, this is north korea starting to deliberately ramp up the situation on the peninsula to get the attention of south korea, but also to get the attention of the u. S. The question is how far will they go . They blew up a building on their own soil because this was in north korean territory where this explosion took place. What happens if they start attacking locations that are in south korea . For example, where those balloons were launched from . Thats what we have to watch for very closely. And even though Governor Ron Desantis Office Issued a statement late yesterday about the uptick in cases, that statement did not mention and did not address how the state was going to change its response due to the uptick. Instead, it focused on Contact Tracing and testing as well. Here locally in miamidade county, the mayor said it bluntly. He said that even though there is an uptick, he is not going to close the economy. Take a listen. Were not going back to closing our economy because numbers inch up over a couple days. What were going to continue to do is to strictly enforce the rules and continue to watch the guiding statistics carefully. Reporter now, heres whats interesting. The mayors of miami and miami beach are also looking at that same data, and they are concerned. They say that they could and are considering imposing restrictions. The mayor in miami beach going as far as saying that he might require masks to be worn all the time. The mayor of miami saying that hes concerned because a portion of the spike is within the ages of 18 and 34, and hes concerned that these individuals might take it home, and perhaps, spread it to their parents and grandparents. Now, according to Governor Ron Desantis, this spike is due to outbreaks in agricultural communities. And the mayor here in miamidade says that agricultural communities in south miamidade, alisyn, are going to be tested, that mobile units are going to be sent out, and those communities are just a short drive away here from miami. The fbi and Justice Department are now investigating the recent hanging deaths of two black men in southern california. The deaths of 24yearold Robert Fuller and 38yearold malcolm harsh occurred ten days and 50 miles apart. Both were ruled suicides. There are questions now. Suzanne malveaux has more. Theyre lynching our black children reporter residents of palmdale, california, say it is the site of a modernday lynching. Robert fuller reporter 24yearold Robert Fuller was found hanging from a tree near city hall early wednesday morning. For a black man to be hung in a tree near city hall, thats a message. You dont understand our pain reporter residents were outraged friday when city officials announced their initial findings. It appears that mr. Fuller has tragically died by suicide. A full autopsy my brother was not suicidal. Come on. There it is. He wasnt reporter now, five days after fuller was found, the Los Angeles County Sheriffs Department, which oversees palmdale, says its taking another look. The initial reports appeared to be consistent with a suicide, but we felt it prudent to roll that back and continue to look deeper. Regarding a chair or something similar found at the scene, there was nothing. Reporter the Sheriffs Department announced it would begin reviewing seemingly basic evidence. Initially, we are going to do forensics on the rope that was involved. We look to contact the witness who located him in the park and those who may have seen him in the past few days prior to his death. Reporter but residents say more should have been done. If it was another race, if it was a white boy, theyd be on it. Justice now [ crowd chanting ] reporter just ten days ago, as black lives matter rallies continued nationwide, another black man, malcolm harsh, was discovered hanged from a tree less than 60 miles from where fuller was found. The San Bernardino county Sheriffs Department says it found no indications of foul play and that the 38yearold hanged himself. Harshs family, like fullers, says no way. We believe that both these two young black men were the victims of a possible hate crime. Reporter now the families of both men are calling for independent investigations, according to a shared spokesman. Both families have stated both men were looking forward to enjoying their life, and both hangings make no sense whatsoever. The Justice Department, as well as the fbi civil rights division, is reviewing both of these cases. City Officials Say they will cooperate with federal authorities. But just to underscore the level of suspicion, i talked to many palmdale residents who dont even believe that fuller was hanged from that tree, that perhaps his body was brought there. It is a very small tree. No broken branches. It looks undisturbed. And having seen that tree for myself, you can certainly understand their suspicions. Just one of the many questions that need to be addressed. Alisyn . We need much more information. Suzanne, thank you very much for that report. Well, the Trump Campaign is moving ahead with its planned rally in tulsa, oklahoma, on saturday. Tulsa is a provocative choice from President Trump, with the citys long history of racist violence. Cnns abby phillip investigates. Were twins, yes, three minutes apart. He came out first and he calls me his little big sister. Reporter before george floyd, before nationwide protests against Police Brutality swept the country, tiffany crutchers twin brother, terance, was killed by a Police Officer in 2016. He just needed help that day. Reporter crutcher was unarmed and the officer who shot him was charged with manslaughter but later acquitted. Dont shoot reporter for tiffany, the anger in tulsa over policing dates back to 1921, when her great grandmother was one of thousands of black residents who ran for their lives as a mob of angry whites killed hundreds and burned down the black neighborhood of greenwood, known then as black wall street. Same culture that burned down black wall street and killed innocent people and ran my great grandmother from her home is the same culture, the same policing culture that killed terance. Reporter now President Trump is coming here at a time when black tulsa residents still feel like their voices arent being heard. The fact that im having a rally on that day, you can really think about that very positively as the celebration. Reporter most of the citys black residents are concentrated in north tulsa, literally divided from the rest of the city by train tracks. A 2018 Human Rights Watch found that black tulsa residents are 2. 3 times more likely to be arrested than white residents. The report also found traffic stops are more likely to happen in the black, poor parts of the city, tend to last longer, and are more likely to result in search, questioning, and arrest. But its not just drivers. My clients, who are 13 and 15, have been walking on this road, minding their own business. Reporter earlier this month in tulsa, two black teenagers arrested for jaywalking in a neighborhood with no sidewalks. Their story Getting National attention when police video of the incident was released. Donna corbett lives just around the corner and also recorded what she saw. The video showing both teens in handcuffs, one struggling with officers and at one point an officer kicking him inside of the police car. And later, the teen demanding that they call his mother. It really made me very sickened in myself, you know. Its a great burden to see, you know, such brutality on a child like that. Reporter Tulsa Police Say the arrest is being investigated. Corbitt and the younger teens mother returning to the place where her son was rested. It broke my heart that they felt comfortable harassing, abusing, and humiliating him. Reporter echoes of countless other viral videos that have laid bare the pain of black america. I just lost it. All i could think about is that baby thinking he was going to be the next george floyd or the next terence crutcher. Reporter now, oklahomas governor said that he spoke to President Trump yesterday about this visit. He said he encouraged the president to come down to the Greenwood District where black wall street had been almost 100 years ago to take a tour. He also said that he asked the president to allot federal dollars for a memorial commemorating that race riot. However, that is a different memorial than the Cultural Center that has been here in greenwood for some 25 years. And the folks ive spoken to here in the black community said that would be a pretty controversial decision, if the president were to do either of those things, alisyn. You and i have talked about it a thousand times on so many issues. But here you have a ruling sought by liberals, opposed by the Trump Administration, the Justice Department, written in favor by a conservative justice appointed by the president and joined by the chief justice. Just did you see this coming . Well, after the oral argument, it was clear that Justice Gorsuch was leaning this way. But chief Justice Roberts vote is to me the real big surprise here, because he was pretty skeptical of the plaintiffs arguments here. But i think its important to remember what this case is really about. Its not about what the constitution means for gay and transgender people. Its really the interpretation of one word in one law, which is title 7 of the civil rights act, which prohibits discrimination on the basis of sex. And the question in the case was, what does sex mean . Traditionally, the courts have said sex only means gender. You cant fire someone because shes a woman. But what Justice Gorsuch decided was, the meaning of sex also includes Sexual Orientation and transgender status. He simply analyzed that one word, and he calls himself a texturalist. And he thought, he decided, for six justices, that sex had that broader definition. Its an enormously important ruling. But i wouldnt draw too much into it about, you know, how the court is going to evolve. There are even more controversial decisions coming, perhaps as early as next week, that may push the court back in a conservative direction. Hmm. What was it about chief Justice Roberts response that so surprised you . Well, because chief Justice Roberts has voted against the gay rights position in every case thats been before him since hes been chief justice, which is now quite a while, 15 years. I do think that chief Justice Roberts, in the best sense of the word, though, is a politician. And he recognizes that in 2020, its simply intolerable that, as was the case before yesterday, under federal law, you could fire someone simply because they were gay. You could walk into their office and say, you know what, youre doing a great job, but we dont want gay people here, and youre fired. That was the position that the Trump Administration supported. I think chief Justice Roberts recognized that the world has changed too much for that to be a permissible position for the american legal system. It is dshlsi good for you highlighting that, Jeffrey Toobin, just the idea that that might have stood, right, in the year 2020 is just, its remarkable in this country or in any country in the world. You know, there were a handful of states that prohibited discrimination in employment on the basis of Sexual Orientation, but not even half of them. So, in more than half of the states, that was the law, and its not the law anymore. But this is the report now is that we dont know the number of players or the extent to which the coronavirus is widespread within these two organizations, but the Houston Texans and the Dallas Cowboys say that they cannot comment on the specific report, talking about these players that have been infected with coronavirus, so we dont know the extent to which the infection is rampant, but the commissioner of the nfl says this will have no effect on how the season rolls out here in the months ahead. So, none of those players were in the facilities. All of those players, fortunately, have had either mild symptoms or were asymptomatic. And i think our protocols are working.
