Obama care from crumbling yet again . Also in politics look i give up a lot. I give up hundreds of millions of dollars in deals donald trump going all in on the presidency and saying its costing him millions. But is he as serious as that scowl suggests . A sneak peek from my oneonone interview. Good afternoon everyone. Welcome to the lead. Im jake tapper. Breaking news on the national league. The multimillion dollar manhunt in new york for escaped killers richard matt and david sweat is now on day 20. Youre looking right now at live pictures from inside the courtroom where the arraignment of prison guard gene palmer who was arrested yesterday for aiding in the escape of the two fugitives will take place at any moment now. Theres also some new information on how the prison was run. A former maintenance supervisor at the prison telling cnn the Clinton Correctional Facility used inmates to do plumbing and Electrical Work if the Maintenance Department was shorthanded and if Corrections Officers were understaffed inmates doing these jobs were not always supervised. As evidence seems to be mounting that there were lapses in security at frizz on. Investigators from the new york state Inspector Generals Office at the Clinton Correctional Facility scrutinizing security protester comes. While this is happening, the manhunt for the two men continues. Were learning more from an interview gene palmer gave police. Cnn National Correspondent Alexander Field is in oulsz head new york. What can you tell us . Reporter gene is filling in some of the details about what happened behind bars telling police he didnt intentionally help the inmates and says whatever assistance he gave them he had no idea it would make their escape easier. Were learning new details on how david sweat and richard matt were aided in their escape. An official close to the investigation tells cnn gene palmer a prison guard, gave at least one of the inmates a screw driver and needlenosed pliers supposedly to help fix electrical breakers in the catwalk area behind their cells so they could use hot plates in those cells to cook. The tools were later found at palmers home after police executed a search warrant. Palmer gave access and supervised matt and sweat while they worked on the breakers taking the tools back at the end of his shift. These are the same cat walks used during the inmates elaborate escape 20 days ago. Hes a man of integrity. Hes fully kwopcooperated with this investigation. He wants these two to be captured. Reporter palmer also accepted paintings from matt and sweat according to court documents. A search of his house by investigators showed he tried to destroy the paintings by burning some in a fire bit and burying others in the woods. In an npr radio interview from 15 years ago, palmer describes life inside the Clinton Correctional Facility as a negative environment. He went on to say that life as a prison guard is as miserable as the lives of the prisoners themselves. With the money they pay you youll go balled have high Blood Pressure become an alcoholic, divorce and kill yourself. Palmer paid the 25,000 bail with a credit card. Joyce mitchell the other prison employee charged in connection with the escape allegedly hut hacksaw blades and drill bits into chunks of hamburger meat. She asked palmer to take the meat to the inmates cell. He did not run the meat through a metal detector a violation of prison policy. He was conned by Joyce Mitchell. She duped him. Looking back on that he cant believe someone would take advantage of him. As convicted killer richard matt turns 49 today, hundreds of Law Enforcement officers are still searching through dense woods around a hunting cabin, the fugitives are believed to burg liesed. Boots and a sock were found inside that cabin. Theres a sock thats been recovered, listed as white and red, and the red could obviously be blood. I do know that a dna profile was from one of the socks. Reporter its been five days since authorities discovered that cabin and the evidence inside. Theyve had no credible leads on the mens whereabouts since then. They have upped the Law Enforcement press on on the ground. Now more than 1100 officers spread out between frederick and clinton counties. They have received 2400 tips. Alexandra, were expecting at any moment the second prison employee to face charges, this is priz an guard gene palmer expecting eergt him, his lawyer or both to show up in the courtroom that viewers are seeing live on the right side of the screen. What can we expect there . Whats going to happen . Reporter we expect he or his lawyer will enter a plea of not guilty. Were learning a lot more about what gene palmer has been able to contribute to this investigation from that interview with state police. Those details just coming in today. He is telling police a little bit more about the culture of the relationship between himself and the two inmates, richard matt and david sweat. He said what he was getting included elaborate paintings and details about the potentially illegal activity of other inmates. He said in exchange for that he was offering assistance the assistance which he said he didnt anticipate would make an escape easier. He said he would provide paint, paint brushes, the hamburger meat key to this case and the access to the electrical box. He was underscoring the point that he believed they needed access to the electrical box to repair a breaker so they could cook in their cells. We know that cooking was one of the privileges on the honor block, jake. Alexandra field in owls head new york thank you very much. Joined by craig cain retired u. S. Marshall of the Regional Task force. In Sacramento Robert Ayers former warden at san quentin prison in california. When the arraignment begins we will bring it to you live. In the meantime lets talk about whats going on. Craig, youre an expert obviously on catching fugitives. How likely do you think it is that matt and sweat or anyone that makes it three weeks without being caught is getting some sort of help on the outside . Ive been saying this all along, jaerk. Whats troubling to me right now is the dna evidence that they found in the cabin. Law enforcement got that tip, i believe it was saturday morning sometime. By the time they arrived and set up a perimeter, so to spook, a couple hours could have passed. But what i havent heard is canine did not pick up any scent. Im not privy to every bit of information thats going on up there. So if this was an elaborate conspiracy and there are other Staff Members involved or outside people could that have been a ploy a ruse . Could one of their cohorts have brought dirty underwear and a sock and a Peanut Butter jar and left it in a cabin and somebody say, oh yeah i seen somebody running from there when they werent ever there and theyre somewhere in idaho right now . Interesting. The investigation is uncovering major lapses inside the prison. Prisoneremployee sex, smuggling of power tools, what seemed like lax rules when it comes to prisoner movement. As a former prison warden have you ever seen anything like this . I dont know that ive seen it to this extent. I think the first thing i want to say is that the vast majority of people who work in our prisons are hard working, honest dedicated people. Its most of them as well as the prison administrators are always on guard and concerned about the occasional employee who crosses the line. I think this is just a stark example of the worst of what can happen when employees do cross the line. I also think it points to the fact that you can build the most secure facility on earth i was also the warden at pelican bay which is a super max prison and we always have to keep in mind that its the employees that are the strongest factor in prison security but they can also be the weakest link. Craig, you seem to sound a little skeptical of the hunt going on right now. Is there anything specifically that you think Law Enforcement should be doing that theyre not or things that they could be doing better . No not at all, jake. Theyre experts at what theyre doing out there. The public has to understand that, you know were not magicians out there. We dont have a magic wand we can wave. This aint like tv or a motion picture. This is real life o people spending a lot of hours combing through woods, dense terrain, bugs what have you. They have to exhaust every lead and they have to feel comfortable that they searched that socalled perimeter to the extent where they have to scale back at some point in time. But thats only when they exhaust every possible lead. Robert p the prison suspected a close relationship between Joyce Mitchell and one or more prisoners, why was she still working there . Wouldnt that be enough to dismiss her . Well its actually a fairly can be a fairly complicated situation. But normally when we have an employee that we suspect is involved with an inmate the first thing youd want to do is take the inmate or inmates and get them out of the situations. Normally in our state we would lock them up in administrative segregation pending that investigation, and you can we would reassign the employee usually to an area that doesnt have inmate contact. All right, craig caine and robert ayers, please stand by. Well take a quick break. When we come back more on the manhunt and much other news including a major victory for president obama when it comes to his Signature Health care law. Stay with us. Well be right back. Big day . Back to the lead. Im jake tapper. Were about to see a prison guard who allegedly assisted in the escape of two murderers. Expecting the arraignment in court. Well bring that to you live when it happens. Now to our politics lead once day, one decision could have undone a key part of his legacy perhaps his most profound legislative achievement. Instead, today it seems president obama will instead go down in history as the president to put the government in the Health Care Business and keep it there for good. The u. S. Supreme court ruling today that even though the law seemed to many to suggest federal subsidies were only for americans who bought insurance through individual staterun exchanges, the intent of the law was broader than that and everyone who qualifies can get them. Just like that the last time obama care sur viefrd a battering at the Supreme Court, its savior was chief Justice John Roberts whose nomination then senator obama voted against. He did the same again today. Lets get to justice correspondent pamela brown. A big, big victory from president obama. No doubt about it. Resounding victory from president obama who nearly saw these four words, established by the state, wreck his signature ledge laygislative achievement. Chief Justice Roberts taking the lead to save the bill. A broad ruling allowing million ofs people to keep their subsidies. Reporter supporters of the president S Health Care plan celebrating outside the Supreme Court after the justices kept the law intact. Preserving Insurance Coverage for millions of americans and handing the Obama Administration a massive win. Aca is here to stay reporter this marked the second time the conservative chief Justice John Roberts played a role in rescuing obamacare. He joined with Anthony Kennedy and the four liberal justices in the 63 decision writing the majority opinion that upholds federal Health Care Tax subsidies for eligible americans no matter where they live. Roberts says a contentious phrase in the Affordable Care act with the four words established by the state does not change the law as a whole. He wrote, quote, the context and structure of the act compel us to depart from what would otherwise be the most natural reading of the pert meant statutory phrase. The fact that the chief has yet again stepped in to lead the court in upholding the Affordable Care act is a sign i think, of the strength of the administrations arguments that the law is legal. Had obama care opponents won 6. 4 million americans in 34 states would have been at risk for losing key subsidies and potentially their coverage. Chief Justice Roberts argued quote, Congress Passed the Affordable Care act to improve insurance markets, not destroy them. We must interpret the act in the way consist stnt with the former and avoids the latter. Justice anton and scalia said quote, we should start calling this law, scodus care. Hes saying what the chief justice and other justices did is basically rewrite the law because congress was sloppy. He didnt have the argument in that case. There are other challenges in the pipeline right now to obama care but none that have such high stakes as the one today. Its interesting to note that chief Justice Roberts could have ruled more narrowly. That would have given the next administration a chance to interpret the law differently but he didnt leave the door open for that. No, he didnt. Brings bring in cnn senior legal analyst jeffrey toobin. Arian, let me start with you, lots of nasty attacks from the right against bush appointee, chief Justice John Roberts. You have to wonder does he worry about this at all . Does he mind this conservative backlash . Today he sure showed he doesnt care about it at all. You remember back in 2012 when some conservatives wore tshirts that said roberts coward. The other people saying he needs to atone for his sins. He said in todays opinion he doesnt care about that. He said the language might not have been completely clear, but he looked at the intent of the law and upheld it and looked at the way he thought what congress meant. He doesnt seem to be taking a lot of concern about such criticism. Very interesting. Jeffrey toobin the president s director of speech writing, cody keenan he had two speeches written, the one in the rose garden a triumphant one and the second one in the event the Supreme Court ruled against the administration. Keenan has the second one for prosperity the president signed it didnt need this one, brother. You say obamacare may be the first exhibit in the obama president library. Absolutely. When you look at the Obama Presidency which is now about threequarters over and whats the most significant thing he has done . You could say ending the war in iraq. You could say winding down the war in afghanistan, you could talk about the economic recovery. But in terms of what will endure i think the Affordable Care act is now firmly established, and you are talking about millions of people who have health care who wouldnt otherwise have health care. Its there and its going to stay there unless the political branches overturn it. The courts are now effectively out of the story. Its going to be up to republicans in congress and those who may win the presidency to overturn it because the courts have now said were done. Thats right. A lot of republican president ial candidates saying the fight is not over. Thanks so much. It turns out the judge came out while we were in commercial and said everything is going to be pushed to monday. So let us move on. We will obviously bring that to you on monday. Our politics lead today, another day, another good poll if your last name is trump. On tuesday one poll showed the donald rising to second place among New Hampshire republican primary voters. On wednesday he was shown in second place nationally among republicans. In 30 minutes or so,cn thnchts will release its new poll. What will that say . Granted trump starts the race with name recognition. Trump is plastered all over buildings and billboards and board rooms and synonymous with what else . Money, money, money is Donald Trumps run for the white house motivated by political ambition or is it just yet another publicity stunt . In an interview that will run sunday on state of the union i sat down with the real estate mogul and asked is this about the future or about the franchise. Some people look at you running for president and say this is just about ego, its just about getting his brand out there. He wrote a bestselling book a real estate magnet a high rated tv show. He loves to be in the spotlight but hes not really running for president. Whats your message for those people . My message is theyre wrong. Its something ive looked at over the years, i looked at it seriously four years ago. In a way i didnt i think mitt would have done a better job. He choked. Ive been thinking about it seriously over the last period of time and ive decided im going to do it. Youre in it to win it youre serious . Im in it to win it. I give up a lot. I give up hundreds of million ofs dollars in deals, things that i do. I dont want it to sound trivial, nbc renewed the apprentice because we mad a great season last season. They would love me not to be doing this i will tell you right now. The top people come to my office and say, please. Im not doing it because of this. I cant do it. Im not allowed to do it. Essentially legally im not allowed to do it. I give up the apprentice. These politicians, i see them all the time. Im with them. They run, they lose they win. They dont lose anything. They help themselves. Im giving up hundreds of millions of dollars. Forget about what it costs, thats peanuts. The cheapest part is what it costs to do it im giving up hundreds of millions of dollars to do this. Im giving up a prime Time Television show im giving that up to do this. Its not a sure thing that i can tell you. Im not a politician but i speak honestly. I will not let china rip us off any longer. I will take back joubs from all these places that are killing us including mexico who i have Great Respect for, im in it to win it. That doesnt mean im going to win it. Its a very different candidacy, a very different kind of a person. Im a little blunt. Just a little. You know what . Maybe thats what we need. We have to take it back. We have to take our country back. Joining me to talk about the race for the white house is conservative talk show giant hugh hewitt out with a new book the coming of a second clinton era. Thanks for joining me. I have so this things to ask you about including your book. First let me get your reaction to a couple things. First of all, donald trump is second in the polls nationally, second in the polls in New Hampshire. What do you make of this . I make he really is running. I talked to him on my radio show on monday. Youll talk to him on sunday. Hes going to try to win iowa. Hes hired staff on the ground there. He really is running. But the polls show jeb bush has got a narrow lead at the top and theyre all bunched at 20 or lower. Who can beat Hillary Clinton is going to be the number one question of the minds of republicans, especially after the Obamacare Decision today. Donald trump has to prove hes conversant with that and can beat hillary. I dont know he can do that. I want to talk about hillary and your book. You mentioned the Obamacare Decision. Your reaction . Im disappointed. I would have been with the dissent. Randy barnett wrote a great piece at scotus blog in which he said the chief justices position is reasonable. Its important for conservatives to remember that and not to go on a frenzy of chief justice bashing because theres this principle law, where you try and do the statutes work. The chief buys that. Im with scalias dissent. It hurts hillary. She has this anchor of obamacare around her neck. They cant blame any of the rising premiums the enormous deductibles, the lack of doctors on any republican and every republican gets a free swing at hillary who after all is the grandmother of obamacare. Hillarycare came first, obamacare came second. In the back room at team hillary, theyre not so happy about this. Lets talk about Hillary Clinton and your book the queen. I think anybody who is not a fan of Hillary Clinton will enjoy it very much even fans might find the writing lively let us say. You have said that you think shes likely to win the presidency. Your book is full of advice for her, not all tongue in cheek. Some of it very seriously. Do you see her i dont think shets shes read the book but do you see any evidence that shes taking any suggestions seriously . Yes, the fourth suggestion shes already taken which is to cain on a blanket amnesty leading the citizenship. Shes very far out on a ledge there. I havent seen her endorse the defense buildup, embrace energy. I dont expect her to do that until Bernie Sanders is locked in a cabin somewhere not challenging her from the left. Once shes done with the challenge from him, i believe shell move decisively to the right, run against the Electoral College and some of the other stuff. The patty power odds from ireland put Hillary Clinton at a 1011 favorite. Thats a prohibitive favorite. The closest republican is jeb bush at 71. Well have to run a fairly perfect campaign. Its possible to beat her. I hope we beat her. Im doing everything i can to take things off the table via the queen. But shes got formidable advantage advantages. Having read the book, its not full amnesty. Its full amnesty followed by a huge wall on the border, a wall or fence, whatever you want to put it. I just want to prove to you that i read the book. What are you telling republicans you did. When i was on your show, you read my book. I wanted to be sure turnabout. What are you telling republicans, how do you go after her . She seems to have so many institutional advantages. I think they have to lean on the server the server the server and the night of benghazi. She left the state department at 1 00 a. M. She folded up like a lawn chair. Since that time shes been engaged in massive coverup. The server she had was a National Security breach of the first order. The reason i think Carly Fiorina is taking off, when you read the queen you know i didnt think carly would get much traction. But she has because shes been hitting mrs. Clinton on the fact that maintaining the server like the opm hack was a very bad thing for National Security, something she has to answer and eventually she has to sit down with you and all the other sunday show hosts and answer tough questions about why did she put her own political interests ahead of those of the country. I dont think she can sustain tough questions. I think the Republican Party ought to stay all focused on her, her server hillary care leading to obamacare and the fact she had a catastrophic tenure as the department of state leads. She only mentioned that barry in her announcement as roosevelt island. The republicans have to stay focused on her, not chief Justice Roberts, but on Hillary Clinton and the need to not have another eight years of wildly disastrous executive leadership. There are those who work for the Hillary Clinton who disagree with everything you say. Well have somebody come back and defend her at some later point. Moving on to republican politics you believe senator ted cruz and or senator marco rubio, they are the candidates the republicans in the best position to defeat her, assuming she wins the nomination . To be careful, i think ted cruz is in the best position to run the board, meaning the rules set up best for him. What priebus did, he brought order out of chaos with the debates. I think her Worst Nightmare is marco rubio. Ted cruz is the best debater in the bunch. My advice in the book is if cruz is the nominee because he gets the momentum not to debate him. He didnt win nine Supreme Court arguments by accident. Marco rubio probably matches up best against her. At this point well see a lot in the course of conversation with the candidates. Im talking to jeb bush tomorrow for example. Well see if any of them make the case theyre best positioned to beat hillary. Thats the person that will get nominated. You and i will Work Together at the second Republican Debate at the reagan library. Im looking forward to that very much hugh hewitt thank you for joining me.
