In our toll picks lead, this morning the Trump Administration announced it is seeking to change the rules for Legal Immigration. Seeking to make it harder to get into this country legally. Specifically the administration is targeting immigrants who are lowincome and less educated and thus more likely to rely on food stamps or other government benefits. The Trump Administration claims it is merely trying to restore integrity to a broken system. But todays announcement is being interpreted by critics by an attempt to stir those who are poor or uneducated from the poem at the statue of liberty which a reporter asked Ken Cuccinelli about today. Is that sentiment, give us your tired, your poor, still operative in the United States and should that come down off the statue. Im not prepared to take anything down off the statue of liberty. He insisted this rule is not aimed specifically at the latinos and latinas that the president has focused on rhetorically and with his Border Patrol and he said there is no reason for any particular group to think they are targeting them. If we had been having this conversation a hundred years ago it would have applied to more italians. But of course it is not 100 years ago. This rule has been in the works for months, sources tell me. But it comes at a fraught time for the Latino Community in the United States. Just a week and couple days after the deadliest attack on latinos in this nations modern history. That massacre in el paso and not to mention the biggest single tate raid on undocumented immigrants in mississippi last week where nearly 700 people were picked up at factories across the state and an i. C. E. Raid that did not focus at all on violent criminals, as President Trump had previously suggested would be i. C. E. s number one target. All tv leaving emotional scenes of children left at Day Care Centers asking what had their parents done wrong, when would they see them again. The timing of the raid, the Homeland Security secretary called unfortunate. Cuccinelli said today, more i. C. E. Raids are to come. Jessica schneider joins me. And talk us through the new regulations and what it means for individuals who are trying to legally immigrate to the United States. This will park a drastic shift in the way that immigrants are evaluated during the application process for visas and green cards. Under congressional statute, the government has long considered how dependent it or would be on government assistance when theyre determining the eligibility for permanent resident status but up until now the government has only considered the cash benefits that immigrants received but under this new rule announced today and set to go into effect on october 15th, u. S. Citizenship and Immigration Services will factor in whether the immigrant received any number of Public Benefits including food stamps, medicare or housing vouchers and consider those as negative factors in an immigrants application. Now of course the white house is defending this rule saying that this is a way to ensure and encourage immigrants already here and those looking to come to the u. S. Are selfsufficient. We certainly expect people of any income to be able to stand on their own two feet. And so if people are not able to be selfsufficient then this negative factor will bear very heavily against them in a decision about whether theyll be able to become a legal permanent resident. So that is the white house stance. But critics are already crying foul. Theyre saying this amounts to really a wealth test that it will lead to discrimination to immigrants against poor countries and could keep families apart and prompt legal immigrants here in the u. S. So refrain from seeking public aid and today we heard the National Immigrant law center will be filing a lawsuit to challenge this new rule. Jake. Jessica schneider, thanks so much. Lets talk about this. Sunlen, let me start with you. Is it fair to say this rule says dont give me your tired, poor, huddled masses yearning to be free and give me people with education and had some money and can blend easier into the United States . It is certainly the Trump Administration through this action and other actions are certainly making it clear what type of immigrant theyre looking for into the United States. So obviously with the public charged rule that was ruled out earlier today they want as Administration Officials said, they want the immigrants who come legally to the United States to be more or less selfsufficient but the administration is doing the big legislative plan that Jared Kushner has been drafting. Also the current u. S. Immigration system to more one that is based on merit at the expense of people who may be lower income and what not. And while there has been so much focus on the president s crusade against ilLegal Immigration and the border wall there have been so much changes to the Legal Immigration that have gone under the radar such as this long debate over the public charge rule and the administration is slashing the number of refugees admitted to the United States, they are cutting temporary protective status program. So they are reshaping the Legal Immigration system day by day. And there was i remember a move by senator tom cotton and some other republicans, david purdue from georgia i think, to limit Legal Immigration. It didnt go anywhere in the senate. So now the Trump Administration is kind of trying to do it through rulemaking in a way. Right. It is the u. S. Congress has an inability to legislative on immigration and that is going to continue to be the case unless we see a sea change in election. And because of that, the only way the Trump Administration can make changes is through these rules and through these proceedings and the rules could be more difficult for immigrants to manage like in the case of what happened today, youre going to have immigrants who maybe one member of the family is on an Assistance Program and they wont be able to have that have that and if their children are u. S. Citizens, theyre going to be scared to get that Assistance Program, and their u. S. Citizen children will have lesser outcomes for the future and you end up with immigrants being poor and having lower sort of higher crime rates and just a worse outcome generally. What is your take on all of this. Im pretty libertarian when it comes to Legal Immigration. Im not on board for the idea it is somehow bad for american workers. I think largely it is good for the economy and good for us to bring people in. There does need to be away to adjudicate and it does seem that often whenever trump changes the rules, there is an objection no matter what he changes the rules in which direction. I think his i think his move to enforce immigration ilLegal Immigration are defensible than the changes made to Legal Immigration which i think is legal. And largely enriches our country. But here is the thing. We dont legislative via poem. We want to embody the spirit of it. But it isnt an unfair expectation that should be the letter of the law and the letter of the law does have to have specific rules and im okay with changing those to make this very bad legal system better at the expense of when we cannot in the ab sense of doing this legislatively, which weve seen were uncapable of doing this. What is your take on this. Here we are demonizing the immigrants and dealing with this part of the problem and it is a wholistic problem. There are people who are already here. And there are children in cages at the border and the people who hire people who are undocumented in this country. And very rarely do those folks ever get face any serious penalties. There was a study that showed Something Like 11 companies or individuals have actually been prosecuted but with minimal punishment. Syracuse did a study, one year 11 individuals were prosecuted. As opposed to a much higher number. And this is been a trend weve seen for a very long time. The second thing i would say quickly, growing up in california this reminds me of what pete wilson tried to do with proposition 187 which was to say that undocumented immigrants could not access nonemergency social services and so then you were seeing doctors and social workers and teachers were the arbiters of who is legal and who is not legal and what i worry about with this framework and given the sort of the incapacity of administration to effectively administer any change of any kind of legislation is how will this be administered. Who is deciding what the rubric for this deciding. You are darker skins so you might need to be on assistance later on and how do we decide that and to what rafael said, do we end up with a system who wont use social services that are needed. Which puts the rest of us at risk for Health Outcomes and remember these are people who pay about 7 billion in social service in social security. Undocumented immigrants make up 5 of the work force. Theyre a big part of the labor industry. More than half of the hired labor on farms, 15 of construction. There is everybody is pretending that undocumented immigrants arent an essential part of the work force, doing jobs citizens dont wan to do. And sunlen quickly, this does seem to be a piece of what were hearing from the Trump Administration on the politics side of it in terms of talking a lot about people would are not white. Whether it is the squad, or elijah cummings, i get this is policy indifferent but again it doesnt feel like a coincidence. There has been certainly a lot of the focus on race and the president recently. Just going back to the stunning racist comments with him telling the four lawmakers to go back to for u. S. Citizen congresswomen to go back to where they came from and then to the comments involving baltimore. The president as weve seen constantly is and the campaign is driving on that base focused strategy to the expense of trying to kind of broaden his base and this is going to be a tactic that well continue to see. There are some unsealed information implicating some people very high up. But you do hear different people asking questions. But it is the Trump Administration so our heads would be exploding and instead were chatting about it in a civilized manner. The one thing is trump does run a big risk here. He runs a risk of hitting a sweet spot where hes not harsh enough for his base and for the likes of ann coulter for example and too harsh for scaramucci and people who want to see his economic policies continue. Like harsh is immigration policy. I think immigration is the trump issue. Whether that is good for him or not. So if he hits that sweet spot, he could be in real political danger. It is sort of a worst Case Scenario for him but now we know that it exists. And that is he should be worried. Scaramucci said there is a risk that other former Trump Administration officials will come out and say similar things or hasnt exactly been a stampede of them but by the same token is not hard to imagine a few of them saying something. It is possible. But my own interpretation of what hes saying is hes channeling what republicans are feeling which is why are you tweeting when you should be doing your job. Right. Remember the beginning when we were waiting for the pivot and were still kind of waiting. It was cute. It was kind of cute. All of the stories about the pivot. It is not happening. There is no pivot. What hes pointing out is this guy is not going to change. This is who he is. Either we settle with the devils bargain and know this is the guy and he wont talk about the things we want him to talk about, hes not capable of again enacting some of the policy things. I disagree with him on policy. But still other than the talking about the economy. Right. Or heck anything other than the squad, the this, that. Which is a very rising critical issue for suburb voters and the Republican Party at large clearly still opposes any sort of restrictions on guns and that is something that some republicans are cognizant of that could hurt them. A source tells cnn it is believed epstein hanged himself while in a special housing unit a month after federal prosecutors accused him of paying and recruiting girls as young as 14 to have sex with him in two states. Three weeks ago epstein was placed on suicide watch after Prison Guards found him with marks on his neck. But a source tells cnn epstein wasnt on suicide watch this weekend. Regardless, protocol requires prisoners have cell mates shortly after coming off suicide watch according to the source but epstein was alone. The bureau of prisons would not comment. Well get to the bottom of what happened and there will be accountability. Reporter as for the federal investigation into epsteins alleged crimes, the Southern District of new york closed case against epstein but continues to look into employees and associates who may have helped him recruit young girls. To those victims who were denied justice when epstein died, barr had to to say. Let me assure you, this case will continue on against anyone who was complicit with epstein. Any coconspirators should not rest easy. The victims deserve justice and they will get it. Reporter and we know at minimum epstein was a multimillionaire. You hear the conspiracies, people suggesting this suicide or this death because they are suggesting all sorts of things could not have happened without some kind of coordination. What is your take . Clearly something went wrong here. Im familiar with the mcc. Our office, the main office of the u. S. Attorneys office in the Southern District is connected to the mcc and if you are awaiting trial and you havent been given bail that is where you reside. This is the most highprofile defendant perhaps in the entire country in federal custody and a lot of people knew there was an issue here and under existing protocol by the way, the Suicide Prevention program at the bureau of prisons is a very extensive one with a lot of good policies and runs to 25 pages. I red it again this weekend. So the fact you have those policies in place, a high profile defendant and he ends up being found dead on saturday morning, clearly something happened. That is a far cry, however, from some of the conspiracy theories on one side or the other suggesting that someone who had something to lose from epstein potential cooperation engaged in foul play. So what about epsteins accusers who were seeking justice . What changes now . Is there still a chance they could see some kind of justice . So the charge brought included a conspiracy count and an interesting thing that happened on saturday afternoon was not just the bureau of prisons coming out with the entertainment, although not very voluminous, but the current u. S. Attorney my successor Jeffrey Berman said and im proud of the statement my former office made is they are not stopping the investigation with respect toke kpeertors and they may still see juchs. Had i still been in place, i dont know i would have made such a strong statement when i didnt need to and wasnt asked for one on a saturday afternoon before all of the facts are known unless i had a fairly reasonable probability or possibility that we would charging additional people. That is speculation on my part. But generally you want to exercise discretion in making such statements. And by the way the attorney general echoed that in the clip you justed, saying there will be justice and coconspirators should not rest easy and thats a sign they have evidence on other people. And some of the focus has turned to this british woman, ghoulain maxwell that she helped recruit the girls, young underage girls for epstein for accused cocconspirators such a her could face criminal charges. I dont know the fact and i havent interviewed the witnesses or what they have, but the fact that the United States attorney and the attorney general both speaking so pointedly about the potential for other charges, i would think she shouldnt rest easy. And ever since the assault weapons ban expired in 2004 and the assault weapons ban for whether it is correct or not blamed in part for the 94 losses by democrats in that midterm race, it is been a difficult issue for democrats in general to touch. But now you see a movement a little bit i wrote about this last week for the post. Guns are issues where the grass roots and the voters drive and try to push the elected officials and democrats tell me theyre starting to see that with an assault weapons ban. There is legislation in the house that has about 200 cosponsors, and the support is growing. And there are certain republicans, a lot of times those republicans have dealt with similar tragedies in their backyards and are willing to embrace an assault weapons ban. I dont think it is it is clearly not passing any time soon but the gradual changes are what gun control activists say are the result of voters out there pushing them. Karen, during the first couple of years of the obama white house, when rahm emanual was chief of staff, he sent a message to eric holder trying to do something to further restrict gun ownership saying shut the f up about guns because they were worried about the electoral consequences. That is absolutely right. But i think we have a couple of things that are different now. The nra for example is in a very different place right now. They have financial troubles, ethical troubles they didnt have and they are sort of trying to deal with their own issues. Also and ive said this before, i cant tell you how many of my friends who have small children talk to me about, mommy, today we got m ms because we able to be quiet for five minutes in the closet as part of an active shooter drill. That make this is issue different and talk about the suburbs and so many different parts of the country where having your children be part of active shooter drills is something very different than where we were even two years ago. And i think biden also, can i say, is playing into this idea he knows that this a. P. Poll that said that 70 of democrats want somebody with government experience so he just have to meet that bar in terms of pick the issue, i think right now part of what hes playing to is this idea that people want a level of competence and calmness. Do you see gun politics changed significantly in the last ten years . It is hard to say. Because despite everybodys contention that it is, the nra isnt the secret sauce. The secret sauce is that gun owners are very passionate about their gun ownership and they often outweigh the ownership and the passion and the activism of the other side. And so that may remain true because on the other side it sort of ebbs and flows. It does not ebb and flow for gun owners whether the nra is in disarray or not, which it is. But biden concedes the original 1994 ban didnt really limit the lethality of the guns because it is hard to do this legislation but then said we have to do more. That is when you get into trouble with the gem electorate and gun owners and issues in a general election because how far are you going to go. Buybacks amost the most unsuccessful when it comes to gun control but he has to pass this plausibility hurdle and he basically already has. The question is whether he ends up back under it because of the gaffes.
