Shimon, what is the court deciding, what could we see today, and what do the president s attorneys, who will be inside the courtroom, want . Reporter essentially the judge here is going to decide whether or not the fbi and the prosecutors from the u. S. Attorneys office here in the Southern District of new york in manhattan will have access to the information that they seize aid week ago today of t. It was last monday morning that they raided Michael Cohen where they removed all sorts of documents and information. The government has not been able to review any of that information because Michael Cohens attorneys and now the president s attorneys are arguing that there is privileged material in those documents. In the case of the president , the lawyers for him are arguing in an unprecedented fashion that he should review, the president and his lawyers should review some of that material before the government could even start to look at it. Theyre claiming there is information there that is privileged, that is the attorneyclient privilege, and that they should have access to it. Wolf, the governments position on this is from what they know, based on their investigation, which they say has been months long, they say theyve gathered a lot of information regarding some of Michael Cohens dealings for their investigation. They dont see a lot of information that would pertain to any kind of privilege with the president. In fact, the governments position has been that based on the emails that they have reviewed, there arent a lot of emails between the president and Michael Cohen, so they dont see how privilege would apply in this case as to the president. Shimon, why is Stormy Daniels in this federal courtroom today . Reporter well, shes certainly the big draw here, wolf. There is probably dozens of cameras here at this point, certainly more cameras than were here on friday. I was here on friday. There werent this many people here. But quite honestly, its just theater. Michael avenatti decided he was going to bring her here today. She certainly could be a potential witness in this case down the line, because as weve reported, the fbi and prosecutors here are investigating, are looking at that deal that Michael Cohen made with her, that hush money that was paid to her. That is part of the investigation. So down the line, we could see her, if there is a prosecution, become a witness. But as for today, she really has no role here. Shes just coming purely as a spectator, wolf. Shimon, were going to get back to you. There will be a lot of drama unfolding in that federal courtroom in a little while. Shimon, thanks very much. Now to the epic battle unfolding between a sitting president of the United States and the fbi director he fired. His first interview and a book he wrote, a higher loyalty i a scathing book he writes about the president mentally and morally. I dont think hes medically unfit to be president , i think hes morally unfit to be president. A person who sees moral equivalence in charlottesville, a man who talks about women like pieces of meat, who lies about issues big and small and insists the American People believe it, that person is not fit to be our leader on moral grounds. Our president must embodily respect and adhere to the morals of this country. This president is not able to do that. Hes morally unfit to be president. In another astonishing comment, comey said the russians may have dirt on the president of the United States. Listen to what he said in that abc news interview. Reporter do you think the russians have something on donald trump . I think its possible. I dont know. These are words i never thought i would utter about the president of the United States, but its possible. Thats stunning. You cant say for certain that the president of the United States is not compromised by the russians. It is stunning and i wish i wasnt saying it, but its the truth. It always struck me and still strikes me as unlikely, and i would have been able to say with high confidence about any other president i dealt with, but i cant. Its possible. What about special counsel Robert Muellers russia investigation . Comey warns that the country will face a major crisis if President Trump tries to shut it down. Reporter what will it mean if President Trump tries to fire Robert Mueller . It would, i hope, set off alarm bells that this is his most serious attack yet on the rule of law. And it would be something that our entire country, again, democrats and republicans that is higher than all the normal fights about policy, and it would be to the everlasting shame of partisans if they were unable to see that higher level and to protect it. President trump fired back at james comey today in a tweet. He accused comey of committing, quote, many crimes but did not elaborate. Earlier the president said comey would go down as, quote, the worst fbi director in history. Our senior White House Correspondent jeff zeleny is traveling with the president in hialeah, south florida right now. Jeff, do we expect to hear more reaction to the comey interview . Reporter certainly, wolf, one of the central questions was, did President Trump watch that interview last evening . We have got an answer to that. White House Press Secretary Sarah Sanders telling reporters as they were flying to florida, that the president did indeed watch, in her words, bits and pieces of that interview. We certainly know the president firing back on social media, on twitter, accusing james comey of lying to congress, committing a crime. But wolf, so far, as we stand here today in this School Gymnasium in hialeah, florida, the president not mentioning james comey at all, not mentioning him once. Hes listening to hispanic Business Leaders here talking about job growth, talking about the republican tax cuts. Thats what republicans hope he sticks to. Of course theyre trying to win the midterm elections here. So far the president not going taf jam after james comey at all as he begins a full week in plor flfl. Hell be in his maralago resort meeting with Prime Minister abe. The president still seething about james comey. So far the president not weighing in, at least publicly, to james comey. See if he says anything. Well, of course, get back to you. Jeff zeleny, thank you very much. Lets get some insight from our panel. James comeys bombshell interview and the president s response. We have our Law Enforcement analyst james bach. Hes making his first appearance since the comey interview. We also have carla demergian and Senior Analyst gloria borger. I think it was a pretty stunning interview when he says the president of the United States is morally unfit to be president. Morally unfit, doesnt reflect the values of this country, et cetera, et cetera. To me the headlines are the obstruction of justice, this question where comey said its certainly possible there is some evidence of obstruction of justice. He says it depends on intent. Obviously hes just a witness in this case. Hes not prosecuting it but thats the number one. The second one, of course, is this notion that he could not rule out that the president had been compromised by the russians, period. And we also know that in a later interview with usa today, he said, even in private, the president refuses to criticize vladimir putin. So you have the former director of the fbi, who is no longer investigating this case, but was and raises these two issues which are, to me, sort of the key to what mueller, the special counsel, is investigating, and we also know comey will be an important witness, or already has been, an important witness to bob mueller. The fear is if the russians do have dirt on the president of the United States, they could bla blackmail him, they could use that in terms of their policy negotiations. Comey inside this interview, without going into too much detail about the video with the hookers in russia, that actually he could not believe that it was this outofbody experience, that in his first meeting i believe it was his first meeting with the president , he had to actually talk to him about this piece of intelligence and how nervous that made him and how uncomfortable you can imagine that made the fbi director. Its amazing. You hear this kind of talk from the former director of the fbi and you also hear similar kind of talk from the former director of the intelligence agency, john brennan. Both of these individuals have raised all these fears about the current president of the United States. Cara, james comey heard that the president fired him on the radio in los angeles. They had televisions on the wall, and i saw comey resigns on the back screens. Resigns . Yes. And it changed to comey fired. Now im staring at it and the audience could see my face change, so they turned around and looked at the back. I went into a room to find out, have i been fired . Because i did not expect to be fired. Whats your first thought . Thats crazy. How could that be . Werent you angry . I dont remember being angry. I thought, its crazy to be firing me. Im leaving an investigation of russian influence and whether anybody in the trump orbit had coordinated and conspired with the russians . That makes no sense at all. The day after you were fired, the president meets in the office of the foreign minister. Called you a nut job and said the pressure had been relieved. What did you think when you saw that . Wow. First of all, what were the russians doing in the oval office . Im thinking, thats crazy, without any americans being present. And two, the pretense is melting away. The bit about, you were fired because of how you handled the email investigation is melting away. You were fired because of the russia investigation. Cara, i want your reaction to what we just saw. Hes going through the slow process of the reality of the situation that he thought was completely i completely implausible before it happened, right . And now it becomes very personal because hes being pushed out. He kind of went underground for a little while to regroup, but now we see this book come out where hes not pulling any punches and assessing the president on all fronts. Its more details of what has been one of the more surprising and eyebrowraising episodes in this, and frankly one that started off many chapters of the russia probe story. He probably would have played differently had comey stayed in the fbi. I want to talk to you about that because youre a former special assistant to comey, youre a former special agent, supervisory special agent over at the fbi. And you were with comey in california when he looked up on the screen, saw cnn, comey fired, then you flew back to washington with him. Tell bus about that. We did, but there was a lot that went on during that period of time. Think about the chaos of the moment. You know all these officials in the intelligence committee, they have a staff that travels with them, they have a communicator that keeps in Constant Contact with the establishment. But folks always assume that that nerve center at the fbi is going to know whats going on. We called back and nobody knew what was going on. We were learning it all from cnn so it was complete chaos. Once a decision was made that its time to turn back to washington you can all remember the freeway ride to lax. It was chaos that turned into kind of a sobering atmosphere, where its sinking in for the director that the dream job he had, the pinnacle of his career, came to an end a lot quicker than he thought. He still had six years left. Did you guys call the white house or the chief of staff or the there was a direct contact with the white house from comey on the road. We were in touch with the department headquarters, the office of justice. There was a question whether comey could even return by aircraft. It went from frustration to anger when we learned that. Not only do they humiliate the director, but when hes dealing with all this chaos. It was so mishandled. There was one interesting part in the interview, where he talks about giving comey a glass of wine for the backseat. This was a real key part about leadership and when youre in the city, he would rather sit in the hotel and get room service so his security detail could go out and enjoy the city. Because he would have to take eight or ten people with him. I said, sir, you know one glass in room Service Costs the same as a bottle if you bring your own. Since we were coming back prematurely, i have this bottle of wine here. I think ill concentrate on public service. He drank that glass of red wine in a coffee cup. Comey, the former fbi director, talks about Hillary Clinton in the book as well and the reasons for his decision to reveal the existence of the investigation entered more of her emails a few days before the president ial election. I was operating in a world where Hillary Clinton was going to beat donald trump. So im sure that it was a factor. Like i said, i dont remember spelling it out, but it had to have been, that shes going to be elected president , and if i hide this from the American People, shell be illegitimate the moment shes elected. He sort of contradicted himself, gloria. On the one hand he said politics dont play a role at all, well move forward with these investigations as we see them unfolding. Then you just heard him say maybe the notion that Hillary Clinton was going to be elected did play a role. Right, and he said as soon as i start wondering whose Political Party is affected, were done. You see this kind of therapeutic confessional from him where he talks about George Stephanopolous as being a deeply flawed individual trying to make decisions. And when he mentioned Hillary Clinton saying i shivved her, he tries to make the case he didnt when, in fact, he did, and hes trying to rationalize that because its clear his family is democratic. His wife and kids were for Hillary Clinton. He makes that very clear. So listening to him last night, the clinton people are not going to be satisfied. They say, come on. You made a huge mistake. You knew what you were doing and you did it, anyway. And he doesnt deny it, but he talks about how it, quote, sucked to be him during the last ten days of the campaign because he knew he was going to get in trouble one way or another. I dont think he completely explained his rationale in a way that would make the clinton people feel that he was fair at all. One point i would make on that is, obviously this is a contentious issue. This cut many different ways. But when mrs. Clinton said she felt shivved, that means some kind of motive. I know james comey didnt go in making that decision intending to cause harm. You simply live your life one way. He knew it was a possibility. In the fbi you cant make decisions based on what the political calculus will be. Last night, 10 00 p. M. Eastern on one network, you had the pope, and on the other network, you had jim comey. What a dichotomy. He is quick to tell us hes flawed, i think we all are heres a point jim comey raised for all democrats. He suggested ten days before the election he had to announce publicly the fbi was reopening the email investigation because they found thousands, hundreds of thousands of emails, on Anthony Weiners laptop material. He was married to the alongtim assistant to Hillary Clinton. Comey said if he wouldnt have done that, and he assumed she would be elected president , maybe her election would be seen as irregular or corrupt because he didnt inform congress and the American People that he had reopened the investigation. Definitely, wolf. There is a lot going on there. I think one point i take issue with is he did announce it publicly. Then he can Tell Congress that the investigation that says more about this town. This is more about the swamp than jim comey. You have kind of this shakespearean drama with comey trying to be the hero. He makes us draw the line at that point rather than waiting before he goes through the emails. 11 days before a president ial election. He continues to try to be the one setting standards, but hes not perfect, and unfortunately, when the stakes are this high and youre talking about an institution thats not supposed to be ebbing and flowing with a person. What weve got here is we have human beings in these cases and theyre thinking theyre doing the right thing and screwing up at the same time. You know, josh, the other thing that deeply irritates the democrats as you well know, as all of us know, at the end of july 2016, the fbi opened a separate investigation into possible cooperation collusion between the Trump Campaign and the russians. And he stayed silent on that in july, august, september, october, early november. He spoke about the investigation reopening for Hillary Clinton, but he never spoke about the trump investigation. This is true. And what i would say to that, obviously these are very tough issues for people to deal w. The fbi, and im not here to defend james comey, his book will defend itself. Ive worked many investigations. I never had two investigations that worked on the same track simultaneously at exactly the same time. Theyre always in different states of existence. So in this case when he announced the Hillary Clinton closure, it was being closed. When you fastforward to donald trump and that investigation with the campaign, the fbi didnt know what it had. If it had come out and said were investigating this matter, the bad guys also listen in. Im not defending. I understand its very tough. Heres what i will say, though, about this book. Its about leadership, and one of the key areas of leadership jim comey people call him righteous and san righteous and one area he talked about was vulnerability. You see that in this book. Vulnerability doesnt work. As long as were peeling the layers of the onion here, dont forget president obama and his intelligence people going to capitol hill and saying, look, we know that there is something going on. The russians are trying to hack this election. And there was a decision made and they would blame it on the Republican Leadership in congress who said, dont make it public. Dont make it public. So there is a lot of other stuff swirling around as if comey drama is playing out with Hillary Clinton. And, i mean, what was stunning to me was, when he talks to the president about this after the election, the president didnt care about the russia involvement in our election. What he cared about was how they were going to make sure in a pr way that it didnt delegitimize Donald Trumps presidency. You heard Kellyanne Conway this morning saying, well, if it was so important, why didnt they offer up the information . Why did they have to be asked . As if its not important for the new leader in the world to show his team that he takes these matters seriously. As we await the appearance of President Trumps personal lawyer Michael Cohen, hes now inside that federal courtroom, a new report of the wall street journal says cohen used the same Delaware Limited Liability company to facilitate secret payments to two women. What can you tell us about all those payments made through that Delaware Company . This company is central consultants Michael Cohen first established in 2016 and he used it to pay Stormy Daniels, the former porn star, 130,000 to cover up her alleged affair with donald trump. And so we reported on friday that he also negotiated a nondisclosure agreement for Venture Capital elliott brody. So we learn that the fee for this deal went to central consultants, the same company that was used for Stormy Daniels. Then when Elliott Broidy found that central consultants was used for Stormy Daniels, he made the first of the payments and said, hey, i dont want to use this anymore, i want to pay you guys directly. A new story about an alleged affair with donald trump jr. Was shut down by attorney Michael Cohen. What can you tell us about that . This first came out when donald jr. s wife filed for divorce, there was allegations that he had had an affair with a member of a singing duo back in 20112012. We reported that in 2013 this story almost came out in us weekly weekly. They had a solid source for us. They called the Trump Organization and got a call back from Michael Cohen. They were on the phone with us weekly basically threatening legal action and going on and on, cursing. We did see Stormy Daniels Attorney Michael Avenatti go in the courthouse but then he left again, and we have yet to see Stormy Daniels who is a spectator for this particular hearing. A federal judge is going to do just what you said, review whether or not their prosecutors, u. S. Attorneys, are allowed to go through these documents seized in the raid of Michael Cohens home, his office, his hotel room just one week ago today. Of course, we know that cohens attorneys say thats protected under attorneyclient privilege, they shouldnt be allowed to go into it, asking for a special master, what its called, to go through those documents to make sure attorneyclient privilege is protected. But now theyre fighting on two fronts. As you just mentioned, trumps attorneys filed a different motion late last night saying it should be trump himself that gets access to those documents before anyone else goes through them. The u. S. Attorneys office already filed paperwork saying it really doesnt make any sense because they already know that email correspondence they have seize d in that raid, there is none between Michael Cohen and mr. Trump, and really that would be unprecedented and would show bad movement if they allowed the hearing to move forward. We know the hearing is to start about 2 00. We dont know how long it will be before she makes her decision, but we doect it today, wolf. Joining us now to discuss this, joseph marino, former prosecu Justice Department prosecutor. Set the scene if you will as a former justice prosecutor. We have very strict policies in place to protect people from attorneyclient privilege when it comes to due process. Filter teams, which are unassociated attorneys, to review documents is a wellestablished practice. So to deviate from the practice is a really high bar. Ive noticed. Distinction, too. Last week mr. Cohen has been told that the president gets to take the first crack. He seems to be holding out for an opportunity for a special master to do that task. Thats probably a nod to how difficult its going to be for him to get his way. The fbi, theyve been collecting documents for months and months leading up to the actual raids the other day. I went through the documents submitted to the federal judge k kimber wood by President Trumps new lawyers, three lawyers, who actually signed this. So the president has new lawyers. Whats intriguing is the president s lawyers, Michael Cohens lawyers, are in the same page against the u. S. Justice department, the u. S. Attorney for the Southern District of new york. How unusual is that . Its unusual to have basically three parties duking it out. And just because mr. Cohens lawyers and the president s lawyers are on the same page right now does not mean that there might not be some daylight between them going forward. So i could absolutely see situations in the future where there could be documents where mr. Cohens lawyers want them revealed but Donald Trumps do not. It should be interesting going forward. There are opportunities for the United States and russia to try to figure this thing out. So its not so very try olic, and in many cases, black or white. What we did in syria here over the past 48 hours is significant. Sends a very powerful message to russia, but within that chaos that exists in part of the world theres an opportunity for the United States to figure out whats next.
